Worker Assessment Regulations

为了考察工人的思想政治表现和生产工作成绩，鉴定实际技术业务水平，调动工人生产劳动和学习政治、技术业务的积极性，全面提高工人队伍素质，适应我国社会主义现代化建设的需要，制定本条例。

These Regulations are formulated to examine workers' ideological and political performance and production work achievements, appraise their actual technical and professional level, mobilize workers' enthusiasm for production labor and learning politics and technical skills, comprehensively improve the quality of the workforce, and meet the needs of China's socialist modernization.

本条例适用于全民所有制企业、事业单位和国家机关。

These Regulations apply to enterprises owned by the whole people, institutions, and state organs.

国家实行工人考核制度。对工人的考核应当与使用相结合，并按照国家有关规定确定其工资待遇。

The state implements a worker assessment system. Assessment of workers shall be combined with their employment, and their wage treatment shall be determined in accordance with relevant state regulations.

工人考核工作应从实际出发，统筹安排，严格标准，保证质量。

Worker assessment work shall proceed from reality, make overall arrangements, adhere to strict standards, and ensure quality.

工人考核分为录用考核、转正定级考核、上岗转岗考核、本等级考核、升级考核，以及技师、高级技师(以下统称技师)任职资格的考评。

Worker assessments are divided into employment assessment, regularization and grade determination assessment, post-entry and post-transfer assessment, current grade assessment, upgrade assessment, and assessment for the qualification of technician and senior technician (hereinafter collectively referred to as technician).

企业、事业单位和国家机关从社会招收录用新工人，包括录用技工学校、职业学校、职业高中的毕业生，以及就业训练中心和其他各种就业训练班结业的学生，须经工人考核组织的录用考核，方能择优录用。

When enterprises, institutions, and state organs recruit new workers from society, including graduates from technical schools, vocational schools, vocational high schools, and students who have completed training at employment training centers and other various employment training classes, they must undergo an employment assessment by the worker assessment organization before being selected for employment on a merit basis.

学徒(培训生)学习期满和工人见习、试用期满时，须经转正定级考核。经考核合格发给相应的《技术等级证书》或者《岗位合格证书》或者《特种作业人员操作证》之后，方能上生产工作岗位独立操作，并根据其思想政治表现、生产工作成绩和实际技能按照国家有关规定确定工资等级。考核不合格者准予延期补考。补考仍不合格者应当解除劳动合同或者调换其他工作。学徒、见习、试用期各方面表现优秀的，可以提前进行转正定级考核。

When apprentices (trainees) complete their study period and workers complete their probation or trial period, they must undergo regularization and grade determination assessment. Only after passing the assessment and receiving the corresponding "Technical Grade Certificate" or "Post Qualification Certificate" or "Special Operations Personnel Operation Certificate" can they independently operate on the production work post, and their wage grade shall be determined according to their ideological and political performance, production work achievements, and actual skills in accordance with state regulations. Those who fail the assessment may be allowed to take a deferred make-up assessment. Those who still fail the make-up assessment shall have their labor contract terminated or be transferred to another job. Apprentices, probationers, or trial workers who perform excellently in all aspects may undergo regularization and grade determination assessment ahead of schedule.

工人改变工种，调换新的岗位，或者操作新的先进设备时，应经过技术业务培训和上岗转岗考核合格后方能上岗。在精密稀有设备上工作和从事特种作业的工人，离开生产工作岗位一年以上，重新回到原岗位，应有一定的熟悉期，期满经技术业务考核合格后方能上岗，并按考核成绩，重新确定技术等级。

When a worker changes their type of work, transfers to a new post, or operates new advanced equipment, they must undergo technical and professional training and pass the post-entry or post-transfer assessment before taking up the post. Workers operating precision and rare equipment or engaged in special operations who leave the production work post for more than one year and return to the original post must have a certain familiarization period, and after the period expires, they must pass a technical and professional assessment before taking up the post, and their technical grade shall be re-determined based on the assessment results.

企业、事业单位和国家机关根据生产经营活动或者工作需要，对本单位的工人定期进行本等级的技术业务考核。考核不合格者允许补考。补考仍不合格者，应降低其技术等级或者调换工作岗位，重新确定技术等级和工资待遇。

Enterprises, institutions, and state organs shall conduct regular current grade technical and professional assessments for their workers based on production and operation activities or work needs. Those who fail the assessment may take a make-up assessment. Those who still fail the make-up assessment shall have their technical grade reduced or be transferred to another post, and their technical grade and wage treatment shall be re-determined.

工人经本等级考核合格的，可以申请参加升级考核。升级考核一般二至三年进行一次。有特殊贡献者经班组推荐和工人考核组织批准，可以提前参加升级考核或者越级考核。考核合格者发给相应的《技术等级证书》，作为使用和调整工资的依据。

Workers who pass the current grade assessment may apply to participate in upgrade assessments. Upgrade assessments are generally conducted once every two to three years. Workers with special contributions may, upon recommendation by the work team and approval by the worker assessment organization, participate in upgrade assessments or skip-grade assessments ahead of schedule. Those who pass the assessment shall be issued the corresponding "Technical Grade Certificate," which serves as the basis for employment and wage adjustment.

优秀的高级技术工人，可以按照国家有关规定申请参加技师任职资格的考评。有突出贡献的技师，可以按照国家有关规定参加高级技师任职资格的考评。考评合格，分别发给相应的《技师合格证书》，作为应聘职务的凭证。

Outstanding senior technical workers may apply to participate in the assessment for technician qualification in accordance with relevant state regulations. Technicians with outstanding contributions may apply to participate in the assessment for senior technician qualification in accordance with relevant state regulations. Those who pass the assessment shall be issued the corresponding "Technician Qualification Certificate," which serves as the credential for appointment to the position.

工人考核的内容包括思想政治表现、生产工作成绩和技术业务水平。

The content of worker assessment includes ideological and political performance, production work achievements, and technical and professional level.

工人思想政治表现的考核，主要包括遵守宪法、法律和国家政策以及本单位的规章制度，树立良好的职业道德、劳动态度等方面。

The assessment of workers' ideological and political performance mainly includes compliance with the Constitution, laws, national policies, and the unit's rules and regulations, as well as establishing good professional ethics and work attitude.

工人生产工作成绩的考核，主要包括完成生产任务的数量和质量，解决生产工作中技术业务问题的成果，传授技术、经验的成绩以及安全生产的情况等方面。

The assessment of workers' production work achievements mainly includes the quantity and quality of completed production tasks, results in solving technical and professional problems in production work, achievements in imparting technology and experience, and safety production conditions.

工人技术业务水平的考核，主要是按照现行《工人技术等级标准》或者《岗位规范》进行技术业务理论和实际操作技能的考核。

The assessment of workers' technical and professional level is mainly conducted in accordance with the current "Technical Grade Standards for Workers" or "Post Specifications," covering both technical and professional theory and practical operation skills.

工人技师任职资格的考评，应当按照国家有关规定进行。

The assessment for worker technician qualification shall be conducted in accordance with relevant state regulations.

工人思想政治表现的考核，在加强班组日常管理的基础上，定期进行。

The assessment of workers' ideological and political performance shall be conducted periodically on the basis of strengthening daily management of work teams.

工人生产工作成绩的考核，在加强班组日常管理的基础上，可以采用定量为主、定性为辅的方法，明确评分标准，定期进行。

The assessment of workers' production work achievements may, on the basis of strengthening daily management of work teams, adopt a method primarily quantitative and supplemented by qualitative, with clear scoring standards, and be conducted periodically.

工人技术业务理论考核以笔试为主，操作技能考核可以结合生产或者作业项目分期分批进行，也可以选择典型工件或作业项目专门组织进行。技术业务水平考核评定采用百分制，六十分为合格。

The theoretical assessment of workers' technical and professional knowledge is mainly conducted through written examinations, while the assessment of operational skills may be carried out in batches in conjunction with production or work projects, or may be specially organized using typical workpieces or work projects. The assessment of technical and professional level adopts a hundred-point system, with 60 points as the passing mark.

工人思想政治表现、生产工作成绩和技术业务水平三项考核成绩均合格的，即为考核合格。

A worker is deemed to have passed the assessment if they pass all three assessments: ideological and political performance, production work achievements, and technical and professional level.

全国工人考核工作由劳动部综合管理，并负责制定有关规定，指导协调工人考核工作。

The national worker assessment work is comprehensively managed by the Ministry of Labor, which is also responsible for formulating relevant regulations and guiding and coordinating worker assessment work.

各省、自治区、直辖市及计划单列市劳动行政部门和国务院有关部门的劳动工资机构，制定实施办法，分别负责综合管理本地区、本部门的工人考核工作。

The labor administrative departments of provinces, autonomous regions, municipalities directly under the Central Government, and cities with independent planning status, as well as the labor and wage institutions of relevant departments under the State Council, shall formulate implementation measures and be respectively responsible for the comprehensive management of worker assessment work in their respective regions and departments.

各省、自治区、直辖市及计划单列市劳动行政部门会同本地区有关行业主管部门，国务院有关部门的劳动工资机构会同本部门的有关业务机构，分别成立工人考核委员会，负责组织本地区、本部门的工人考核工作。

The labor administrative departments of provinces, autonomous regions, municipalities directly under the Central Government, and cities with independent planning status shall, together with relevant industry competent departments in their regions, and the labor and wage institutions of relevant departments under the State Council shall, together with relevant business institutions in their departments, respectively establish worker assessment committees responsible for organizing worker assessment work in their respective regions and departments.

企业、事业单位或者企业主管部门应当根据实际情况组成不同专业(工种)的考核组织，负责具体考核工作。各专业工种的考核组织成员中，应当有三分之二以上的专业技术人员、技师、高级技术工人。

Enterprises, institutions, or the competent departments of enterprises shall, based on actual circumstances, establish assessment organizations for different professions (types of work) responsible for specific assessment work. Among the members of the assessment organizations for each profession and type of work, there shall be no less than two-thirds of professional and technical personnel, master workers, and senior technical workers.

《技师合格证书》，地方所属单位由省、自治区、直辖市及计划单列市劳动行政部门核发；国务院各部门所属单位由其主管部门的劳动工资机构核发。

The "Master Worker Qualification Certificate" shall be issued by the labor administrative department of the province, autonomous region, municipality directly under the Central Government, or city with independent planning status for units under local jurisdiction; for units under the jurisdiction of departments under the State Council, it shall be issued by the labor and wage institution of their competent department.

《技术等级证书》的核发办法，地方所属单位由省、自治区、直辖市及计划单列市劳动行政部门规定；国务院各部门所属单位由其主管部门的劳动工资机构规定。

The issuance method for the "Technical Grade Certificate" shall be prescribed by the labor administrative department of the province, autonomous region, municipality directly under the Central Government, or city with independent planning status for units under local jurisdiction; for units under the jurisdiction of departments under the State Council, it shall be prescribed by the labor and wage institution of their competent department.

企业内部的《岗位合格证书》的核发办法，由企业自行规定，但企业主管部门有统一规定的，应当按照统一规定办理。

The issuance method for the internal "Post Qualification Certificate" within an enterprise shall be prescribed by the enterprise itself, but if the competent department of the enterprise has uniform provisions, it shall be handled in accordance with the uniform provisions.

《技师合格证书》由劳动部统一印制。

The "Master Worker Qualification Certificate" shall be uniformly printed by the Ministry of Labor.

《技术等级证书》由劳动部统一规定式样。

The "Technical Grade Certificate" shall have its format uniformly prescribed by the Ministry of Labor.

《岗位合格证书》的式样，企业主管部门有规定的，按规定办；企业主管部门无规定的，由企业自行规定。

The format of the "Post Qualification Certificate" shall be as prescribed by the competent department of the enterprise if there are provisions; if the competent department has no provisions, it shall be prescribed by the enterprise itself.

《特种作业人员操作证》的式样、印制和核发办法，按照国家有关规定办理。

The format, printing, and issuance method of the "Special Operations Personnel Operation Permit" shall be handled in accordance with relevant state regulations.

企业、事业单位和国家机关违反本条例第六条规定招收录用新工人的，当地劳动部门不予办理招收录用手续。

If enterprises, institutions, and state organs violate the provisions of Article 6 of these Regulations in recruiting and employing new workers, the local labor department shall not handle the recruitment and employment procedures.

各级工人考核组织成员，企业、事业单位和国家机关的工作人员在工人考核、评审过程中弄虚作假、徇私舞弊的，应当视情节轻重，由其所在单位或者上级主管部门根据人事管理权限对直接责任人员给予行政处分。

If members of worker assessment organizations at all levels, or staff of enterprises, institutions, and state organs engage in fraud or malpractice for personal gain during the worker assessment and evaluation process, depending on the severity of the circumstances, their unit or superior competent department shall impose administrative sanctions on the directly responsible persons in accordance with personnel management authority.

违反《技师合格证书》、《技术等级证书》、《特种作业人员操作证》的核发办法和规定，滥发上述证书的，除应当宣布其所发证书无效外，还应视情节轻重，由其上级主管部门或者监察机关对有关责任人员给予行政处分；对其中通过滥发证书获取非法收入的，应当没收其非法所得，并可处以非法所得五倍以下的罚款；构成犯罪的，应当依法追究其刑事责任。

Anyone who violates the issuance methods and provisions for the "Master Worker Qualification Certificate," "Technical Grade Certificate," or "Special Operations Personnel Operation Permit" and indiscriminately issues the above certificates shall, in addition to declaring the issued certificates invalid, be subject to administrative sanctions imposed by their superior competent department or supervisory authority on the responsible persons depending on the severity of the circumstances; if illegal income is obtained through indiscriminate issuance of certificates, the illegal income shall be confiscated, and a fine of up to five times the illegal income may be imposed; if a crime is constituted, criminal liability shall be pursued according to law.

集体所有制和私营企业、事业单位的工人考核工作参照本条例执行。

The worker assessment work of collectively owned enterprises, private enterprises, and institutions shall be implemented with reference to these Regulations.

工人考核工作所需经费由财政部会同劳动部另行规定。

The funds required for worker assessment work shall be separately prescribed by the Ministry of Finance in conjunction with the Ministry of Labor.

本条例由劳动部负责解释。

These Regulations shall be interpreted by the Ministry of Labor.

劳动部可以根据本条例制定实施细则。

The Ministry of Labor may formulate implementation rules based on these Regulations.

本条例自发布之日起施行。原劳动人事部一九八三年发布的《工人技术考核暂行条例》(试行)同时废止。

These Regulations shall come into effect on the date of promulgation. The former "Interim Regulations on Worker Technical Assessment" (for trial implementation) issued by the Ministry of Labor and Personnel in 1983 shall be simultaneously abolished.
