为了加强工商行政管理所(以下简称工商所)的组织建设，使工商所工作规范化、制度化，更好地发挥工商行政管理的职能作用，制定本条例。
These Regulations are formulated to strengthen the organizational construction of industrial and commercial administrative offices (hereinafter referred to as ICOs), to standardize and institutionalize the work of ICOs, and to better play the functional role of industrial and commercial administration.
工商所是区、县(含县级市，下同)工商行政管理局(以下简称区、县工商局)的派出机构。工商所的人员编制、经费开支、干部管理和业务工作等由区、县工商局直接领导和管理。
An ICO is a dispatched agency of the district or county (including county-level city, the same below) industrial and commercial administrative bureau (hereinafter referred to as district/county bureau). The staffing, funding, cadre management, and business operations of an ICO are directly led and managed by the district/county bureau.
工商所的基本任务是：依据法律、法规的规定，对辖区内的企业、个体工商户和市场经济活动进行监督管理，保护合法经营，取缔非法经营，维护正常的经济秩序。
The basic tasks of an ICO are: in accordance with laws and regulations, to supervise and manage enterprises, individual industrial and commercial households, and market economic activities within its jurisdiction, to protect lawful operations, to ban illegal operations, and to maintain normal economic order.
工商所按经济区域设立。
ICOs shall be established based on economic regions.
工商所的设立，由区、县工商局根据辖区大小、经济发展情况和管理任务需要，提出具体方案，报区、县人民政府批准。
The establishment of an ICO shall be proposed by the district/county bureau based on the size of the jurisdiction, economic development conditions, and management needs, and submitted to the district/county people's government for approval.
工商所设所长一人；任务较多的，设副所长一至二人；工作人员若干人。
An ICO shall have one director; if tasks are numerous, one or two deputy directors may be appointed; and a number of staff members.
工商所实行所长负责制。
The ICO implements a director responsibility system.
工商所的职责包括：
The duties of an ICO include:
(一)办理辖区内由区、县工商局登记管理的企业的登记初审和年检、换照的审查手续，并对区、县工商局核准登记的企业进行监督管理；
(1) Handling the preliminary review of enterprise registration, annual inspection, and license renewal for enterprises within its jurisdiction that are registered and managed by the district/county bureau, and supervising enterprises approved and registered by the district/county bureau;
(二)管理辖区内的集贸市场，监督集市贸易经济活动；
(2) Managing the marketplaces within its jurisdiction and supervising market trade economic activities;
(三)监督检查辖区内经济合同的订立及履行，调解经济合同纠纷；
(3) Supervising and inspecting the conclusion and performance of economic contracts within its jurisdiction, and mediating economic contract disputes;
(四)受理、初审、呈报辖区内个体工商户的开业、变更、歇业的申请事项，对个体工商户的生产经营活动进行监督管理；
(4) Accepting, preliminarily reviewing, and submitting applications for the establishment, change, and closure of individual industrial and commercial households within its jurisdiction, and supervising their production and business operations;
(五)指导辖区内企业事业单位、个体工商户正确申请商标注册，并对其使用商标进行监督管理；
(5) Guiding enterprises, institutions, and individual industrial and commercial households within its jurisdiction in correctly applying for trademark registration, and supervising their use of trademarks;
(六)对辖区内设置、张贴的广告进行监督管理；
(6) Supervising advertisements placed and posted within its jurisdiction;
(七)按规定收取、上缴各项工商收费及罚没款物；
(7) Collecting and remitting various industrial and commercial fees and confiscated money and goods in accordance with regulations;
(八)宣传工商行政管理法律、法规和有关政策；
(8) Publicizing industrial and commercial administrative laws, regulations, and relevant policies;
(九)法律、法规规定的其他工商行政管理职责。
(9) Other industrial and commercial administrative duties as prescribed by laws and regulations.
工商所的具体工作范围，由区、县工商局依照工商行政管理的有关法律、法规和规章的规定，根据辖区内管理工作的实际需要，在前条所列职责范围内予以确定，并报上一级工商行政管理机关备案。
The specific scope of work of an ICO shall be determined by the district/county bureau within the duties listed in the preceding article, based on the actual needs of management within the jurisdiction and in accordance with relevant laws, regulations, and rules on industrial and commercial administration, and shall be reported to the higher-level industrial and commercial administrative authority for record.
工商所的具体行政行为是区、县工商局的具体行政行为，但有下列情况之一的，工商所可以以自己的名义作出具体行政行为：
The specific administrative acts of an ICO are specific administrative acts of the district/county bureau, except that an ICO may perform specific administrative acts in its own name in the following circumstances:
(一)对个体工商户违法行为的处罚；
(1) Penalties for illegal acts of individual industrial and commercial households;
(二)对集市贸易中违法行为的处罚；
(2) Penalties for illegal acts in market trade;
(三)法律、法规和规章规定工商所以自己的名义作出的其他具体行政行为。
(3) Other specific administrative acts that laws, regulations, and rules stipulate may be performed by an ICO in its own name.
前款第(一)、(二)项处罚不包括吊销营业执照。
The penalties in items (1) and (2) of the preceding paragraph do not include revocation of business licenses.
工商所应当建立健全监督管理和行政执法的工作程序，公开办事制度和办事结果，接受群众监督，做到公正严明，管理有章，处罚有据，廉洁奉公。
An ICO shall establish and improve working procedures for supervision, management, and administrative law enforcement, make public its work systems and results, accept public supervision, and ensure fairness and strictness, orderly management, evidence-based penalties, and honest and clean conduct.
工商所应当建立健全岗位责任制，对工作人员的德、能、勤、绩进行定期考核，并将考核情况作为任职、奖励、晋升的主要依据。
Industrial and commercial offices shall establish and improve the post responsibility system，and conduct regular assessments of staff's morality,、ability,、diligence,、and performance,，and take the assessment results as the main basis for appointment,、reward,、and promotion.。
工商所应当建立健全财务管理和监督制度，配备专职财务人员。各项工商收费和罚没物资、现金、票证，应当分别登记造册，按规定处理。
Industrial and commercial offices shall establish and improve financial management and supervision systems,，assign full-time financial personnel,。and all industrial and commercial fees and confiscated materials,、cash,、vouchers,，shall be registered and recorded separately,，and handled according to regulations.。
工商所的费用开支，按有关财务规定执行。
Expenses of industrial and commercial offices，shall be implemented in accordance with relevant financial regulations.。
工商所应当建立健全内勤工作制度。各类文件和资料应当及时登记归档；认真处理来信来访；严格执行用印制度。
Industrial and commercial offices shall establish and improve internal work systems,。all documents and materials shall be promptly registered and archived,；letters and visits shall be handled seriously,；and the seal use system shall be strictly implemented.。
工商所工作人员必须清正廉洁，秉公执法，不得以权谋私，索贿受贿。
Staff of industrial and commercial offices must be honest and clean,，impartially enforce the law,，and shall not abuse power for personal gain,，solicit or accept bribes.。
工商所工作人员必须严格遵守国家及有关部门制定的政府机关工作人员的各项纪律、守则，积极工作，忠于职守。
Staff of industrial and commercial offices must strictly abide by the various disciplines and rules formulated by the state and relevant departments for government agency staff,、codes of conduct,，work actively,，and be devoted to their duties.。
工商所工作人员执行公务时必须按规定着装，仪表庄重，待人礼貌。
Staff of industrial and commercial offices must wear uniforms as required when performing official duties,，with dignified appearance,，and be polite to others.。
工商所工作人员在工作中取得突出成绩的，工商所可提请区、县工商局给予奖励。对违纪违法的，由区、县工商局依照国家有关规定给予处分；情节严重，构成犯罪的，由司法机关依法追究刑事责任。
If staff of industrial and commercial offices achieve outstanding results in their work,，the office may propose to the district、or county industrial and commercial bureau to give rewards.。For those who violate discipline or law,，the district、or county industrial and commercial bureau shall impose sanctions in accordance with relevant state regulations.；If the circumstances are serious，and constitute a crime,，the judicial authorities shall pursue criminal liability according to law.。
工商行政管理系统的其他专业所、队、站参照本条例规定执行。
Other specialized offices,、teams,、and stations of the industrial and commercial administrative system shall implement these regulations by reference.。
本条例由国家工商行政管理局负责解释。
These regulations shall be interpreted by the State Administration for Industry and Commerce.。
本条例自发布之日起施行。
These regulations shall come into force on the date of promulgation.。
