为了帮助民族自治地方加快经济和社会的发展，增进民族团结，促进各民族共同繁荣，根据《中华人民共和国民族区域自治法》，制定本规定。
These Provisions are formulated in accordance with the Law of the People's Republic of China on Regional Ethnic Autonomy for the purpose of helping ethnic autonomous areas accelerate economic and social development, enhance ethnic unity, and promote common prosperity among all ethnic groups.
各级人民政府应当加强《中华人民共和国民族区域自治法》以及相关法律、法规和民族政策的宣传教育，依法制订具体措施，保护少数民族的合法权益，妥善处理影响民族团结的问题，巩固和发展平等、团结、互助的社会主义民族关系，禁止破坏民族团结和制造民族分裂的行为。
People's governments at all levels shall strengthen the publicity and education of the Law of the People's Republic of China on Regional Ethnic Autonomy and related laws, regulations, and ethnic policies, formulate specific measures in accordance with the law, protect the legitimate rights and interests of ethnic minorities, properly handle issues affecting ethnic unity, consolidate and develop socialist ethnic relations of equality, solidarity, and mutual assistance, and prohibit acts that undermine ethnic unity or create ethnic division.
维护祖国统一和民族团结是公民的职责和义务。
Safeguarding national unity and ethnic unity is the duty and obligation of citizens.
民族自治地方人民政府应当切实保障宪法和法律在本地方的遵守和执行，积极维护国家的整体利益。
People's governments of ethnic autonomous areas shall effectively ensure the observance and implementation of the Constitution and laws in their localities, and actively safeguard the overall interests of the state.
各级人民政府应当积极开展促进民族团结进步的各项活动，对为民族团结进步事业作出突出贡献的单位和个人，给予表彰和奖励。
People's governments at all levels shall actively carry out various activities to promote ethnic unity and progress, and commend and reward units and individuals that have made outstanding contributions to the cause of ethnic unity and progress.
上级人民政府及其职能部门在制订经济和社会发展中长期规划时，应当听取民族自治地方和民族工作部门的意见，根据民族自治地方的特点和需要，支持和帮助民族自治地方加强基础设施建设、人力资源开发，扩大对外开放，调整、优化经济结构，合理利用自然资源，加强生态建设和环境保护，加速发展经济、教育、科技、文化、卫生、体育等各项事业，实现全面、协调、可持续发展。
When formulating medium- and long-term plans for economic and social development, higher-level people's governments and their functional departments shall solicit opinions from ethnic autonomous areas and ethnic work departments, and based on the characteristics and needs of ethnic autonomous areas, support and assist ethnic autonomous areas in strengthening infrastructure construction, human resources development, expanding opening up, adjusting and optimizing economic structure, rationally utilizing natural resources, strengthening ecological construction and environmental protection, and accelerating the development of economy, education, science and technology, culture, health, sports and other undertakings, so as to achieve comprehensive, coordinated and sustainable development.
国家实施西部大开发战略，促进民族自治地方加快发展。未列入西部大开发范围的自治县，由其所在的省级人民政府在职权范围内比照西部大开发的有关政策予以扶持。
The state implements the Western Development Strategy to promote the accelerated development of ethnic autonomous areas. For autonomous counties not included in the scope of the Western Development, the provincial people's government in whose jurisdiction they are located shall, within its authority, provide support by reference to the relevant policies of the Western Development.
上级人民政府应当根据民族自治地方的实际，优先在民族自治地方安排基础设施建设项目。
Higher-level people's governments shall, based on the actual conditions of ethnic autonomous areas, give priority to arranging infrastructure construction projects in ethnic autonomous areas.
中央财政性建设资金、其他专项建设资金和政策性银行贷款，适当增加用于民族自治地方基础设施建设的比重。
The proportion of central fiscal construction funds, other special construction funds, and policy bank loans used for infrastructure construction in ethnic autonomous areas shall be appropriately increased.
国家安排的基础设施建设项目，需要民族自治地方承担配套资金的，适当降低配套资金的比例。民族自治地方的国家扶贫重点县和财政困难县确实无力负担的，免除配套资金。其中，基础设施建设项目属于地方事务的，由中央和省级人民政府确定建设资金负担比例后，按比例全额安排；属于中央事务的，由中央财政全额安排。
For infrastructure projects arranged by the state that require matching funds from ethnic autonomous areas, the proportion of matching funds shall be appropriately reduced. For state-level poverty-stricken counties and financially difficult counties in ethnic autonomous areas that are truly unable to bear the matching funds, the matching funds shall be exempted. Among them, if the infrastructure project is a local affair, the central and provincial people's governments shall determine the proportion of construction funds to be borne and arrange the full amount accordingly; if it is a central affair, the central finance shall arrange the full amount.
国家根据经济和社会发展规划以及西部大开发战略，优先在民族自治地方安排资源开发和深加工项目。在民族自治地方开采石油、天然气等资源的，要在带动当地经济发展、发展相应的服务产业以及促进就业等方面，对当地给予支持。
The state, in accordance with the economic and social development plan and the Western Development Strategy, gives priority to arranging resource development and deep processing projects in ethnic autonomous areas. When exploiting resources such as oil and natural gas in ethnic autonomous areas, support shall be given to the local area in terms of driving local economic development, developing corresponding service industries, and promoting employment.
国家征收的矿产资源补偿费在安排使用时，加大对民族自治地方的投入，并优先考虑原产地的民族自治地方。
When arranging the use of mineral resource compensation fees collected by the state, investment in ethnic autonomous areas shall be increased, and priority shall be given to the ethnic autonomous areas where the resources originate.
国家加快建立生态补偿机制，根据开发者付费、受益者补偿、破坏者赔偿的原则，从国家、区域、产业三个层面，通过财政转移支付、项目支持等措施，对在野生动植物保护和自然保护区建设等生态环境保护方面作出贡献的民族自治地方，给予合理补偿。
The state shall accelerate the establishment of an ecological compensation mechanism, based on the principle that developers pay, beneficiaries compensate, and destroyers make restitution, and through measures such as fiscal transfer payments and project support at the national, regional, and industrial levels, provide reasonable compensation to ethnic autonomous areas that have made contributions to ecological environmental protection such as wildlife protection and nature reserve construction.
国家通过一般性财政转移支付、专项财政转移支付、民族优惠政策财政转移支付以及其他方式，充分考虑民族自治地方的公共服务支出成本差异，逐步加大对民族自治地方财政转移支付力度。上级人民政府有关部门各种专项资金的分配，应当向民族自治地方倾斜。

The state standardizes the fiscal transfer payment system below the provincial level to ensure that the state's preferential policies such as transfer payments and tax rebates for ethnic autonomous areas are implemented in autonomous counties.
国家设立各项专用资金，扶助民族自治地方发展经济和社会各项事业。
The state establishes various special funds to assist ethnic autonomous areas in developing economic and social undertakings.
中央财政设立少数民族发展资金和民族工作经费。资金规模随着经济发展和中央财政收入的增长逐步增加。地方财政相应设立并安排少数民族发展资金和民族工作经费。
The central finance establishes the Ethnic Minority Development Fund and the Ethnic Work Fund. The scale of funds shall gradually increase with economic development and the growth of central fiscal revenue. Local finances shall correspondingly establish and arrange the Ethnic Minority Development Fund and the Ethnic Work Fund.
国家帮助民族自治地方拓宽间接和直接融资渠道，加大对民族自治地方的金融扶持力度。
The state helps ethnic autonomous areas broaden indirect and direct financing channels, and increases financial support for ethnic autonomous areas.
国家合理引导金融机构信贷投向，鼓励金融机构积极支持民族自治地方重点建设和农村发展。上级人民政府安排的国际组织和国外政府赠款以及优惠贷款，在条件许可的情况下，向民族自治地方倾斜。
The state reasonably guides the credit direction of financial institutions, and encourages financial institutions to actively support key construction and rural development in ethnic autonomous areas. Grants and concessional loans from international organizations and foreign governments arranged by higher-level people's governments shall, where conditions permit, be tilted towards ethnic autonomous areas.
国家完善扶持民族贸易、少数民族特需商品和传统手工业品生产发展的优惠政策，在税收、金融和财政政策上，对民族贸易、少数民族特需商品和传统手工业品生产予以照顾，对少数民族特需商品实行定点生产并建立必要的国家储备制度。
The state improves preferential policies to support the development of ethnic trade, the production of commodities specially needed by ethnic minorities, and the production of traditional handicraft products, and provides preferential treatment in tax, financial, and fiscal policies for ethnic trade, commodities specially needed by ethnic minorities, and the production of traditional handicraft products. 国家鼓励与外国接壤的民族自治地方依法与周边国家开展区域经济技术合作和边境贸易。

国家对巩固边防、边境安全具有重大影响的边境地区居民，在居住、生活、文化、教育、医疗卫生、环境保护等方面采取特殊措施，加大扶持力度。

上级人民政府将人口较少民族聚居的地区发展纳入经济和社会发展规划，加大扶持力度，在交通、能源、生态环境保护与建设、农业基础设施建设、广播影视、文化、教育、医疗卫生以及群众生产生活等方面，给予重点支持。
Higher-level people's governments incorporate the development of areas inhabited by ethnic groups with small populations into economic and social development plans, increase support, and give priority support in transportation, energy, ecological environment protection and construction, agricultural infrastructure construction, radio, film and television, culture, education, medical health, and the production and living of the masses.
国家加强民族自治地方的扶贫开发，重点支持民族自治地方贫困乡村以通水、通电、通路、通广播电视和茅草房危房改造、生态移民等为重点的基础设施建设和农田基本建设，动员和组织社会力量参与民族自治地方的扶贫开发。
The state strengthens poverty alleviation and development in ethnic autonomous areas, focusing on supporting infrastructure construction and farmland capital construction in poor villages and towns in ethnic autonomous areas, with emphasis on water supply, electricity, roads, radio and television, thatched house and dilapidated house renovation, and ecological migration, and mobilizes and organizes social forces to participate in poverty alleviation and development in ethnic autonomous areas.

民族自治地方各级人民政府引导和组织当地群众有序地外出经商务工。有关地方人民政府应当切实保障外来经商务工的少数民族群众的合法权益。
People's governments at all levels in ethnic autonomous areas guide and organize local people to go out for business and work in an orderly manner. Relevant local people's governments shall effectively protect the legitimate rights and interests of ethnic minority people who come from outside for business and work.
国家帮助民族自治地方普及九年义务教育，扫除青壮年文盲，不断改善办学条件，大力支持民族自治地方有重点地办好寄宿制学校；在发达地区普通中学开设民族班或者开办民族中学，其办学条件、教学和管理水平要达到当地学校的办学标准和水平。
The state helps ethnic autonomous areas to popularize nine-year compulsory education, eliminate illiteracy among young and middle-aged people, continuously improve school conditions, and strongly supports ethnic autonomous areas to run boarding schools with focus; set up ethnic classes or establish ethnic middle schools in ordinary middle schools in developed areas, and their school conditions, teaching and management levels shall meet the school standards and levels of local schools.
国家采取措施，扶持民族自治地方因地制宜发展职业教育和成人教育，发展普通高中教育和现代远程教育，促进农村基础教育、成人教育、职业教育统筹发展。

People's governments at all levels shall include compulsory education in ethnic autonomous areas in the scope of public financial security. The central finance sets up special subsidy funds for minority education, and local finance arranges corresponding special subsidy funds for minority education.
国家积极创造条件，对民族自治地方的边境地区、贫困地区和人口较少民族聚居地区的义务教育给予重点支持，并逐步在民族自治地方的农村实行免费义务教育。

各类高等学校面向民族自治地方招生时，招生比例按规模同比增长并适当倾斜。对报考专科、本科和研究生的少数民族考生，在录取时应当根据情况采取加分或者降分的办法，适当放宽录取标准和条件，并对人口特少的少数民族考生给予特殊照顾。
When various types of institutions of higher learning recruit students from ethnic autonomous areas, the enrollment ratio shall increase year-on-year according to the scale and be appropriately tilted. The state helps ethnic autonomous areas to establish and improve science and technology service systems and science popularization systems. The central finance increases support for science and technology work in ethnic autonomous areas through national science and technology plans, science funds, special funds, and other means, and actively supports and promotes the development of science and technology in ethnic autonomous areas.
上级人民政府从政策和资金上支持民族自治地方少数民族文化事业发展，加强文化基础设施建设，重点扶持具有民族形式和民族特点的公益性文化事业，加强民族自治地方的公共文化服务体系建设，培育和发展民族文化产业。
Higher-level people's governments support the development of ethnic minority cultural undertakings in ethnic autonomous areas from policies and funds, strengthen the construction of cultural infrastructure, focus on supporting public cultural undertakings with ethnic forms and characteristics, strengthen the construction of public cultural service systems in ethnic autonomous areas, and cultivate and develop ethnic cultural industries.
国家支持少数民族新闻出版事业发展，做好少数民族语言广播、电影、电视节目的译制、制作和播映，扶持少数民族语言文字出版物的翻译、出版。
The state supports the development of ethnic minority news and publishing undertakings, does a good job in the translation, production, and broadcasting of radio, film, and television programs in minority languages, and supports the translation and publication of publications in minority languages.
国家重视少数民族优秀传统文化的继承和发展，定期举办少数民族传统体育运动会、少数民族文艺会演，繁荣民族文艺创作，丰富各民族群众的文化生活。
The state attaches importance to the inheritance and development of excellent traditional culture of ethnic minorities, regularly holds traditional ethnic minority sports games and ethnic minority literary and artistic performances, enriches ethnic literary and artistic creation, and enriches the cultural life of people of all ethnic groups.
上级人民政府支持对少数民族非物质文化遗产和名胜古迹、文物等物质文化遗产的保护和抢救，支持对少数民族古籍的搜集、整理、出版。

上级人民政府制定优惠政策，鼓励民族自治地方实行计划生育和优生优育，提高各民族人口素质。
Higher-level people's governments formulate preferential policies to encourage ethnic autonomous areas to implement family planning and eugenics, and improve the population quality of all ethnic groups.
上级人民政府应当按照国家有关规定，帮助民族自治地方加快社会保障体系建设，建立和完善养老、失业、医疗、工伤、生育保险和城市居民最低生活保障等制度，形成与当地经济和社会发展水平相适应的社会保障体系。
Higher-level people's governments shall, in accordance with relevant state regulations, help ethnic autonomous areas accelerate the construction of social security systems, establish and improve systems such as old-age insurance, unemployment insurance, medical insurance, work-related injury insurance, maternity insurance, and urban minimum living security, and form a social security system compatible with the local economic and social development level.
上级人民政府及其工作部门领导人员中应当合理配备少数民族干部；民族自治地方人民政府及其工作部门应当依法配备实行区域自治的民族和其他民族领导干部，在公开选拔、竞争上岗配备领导干部时，可以划出相应的名额和岗位，定向选拔少数民族干部。
The leading personnel of the people's governments at higher levels and their working departments shall include a reasonable proportion of cadres from ethnic minorities; the people's governments of ethnic autonomous areas and their working departments shall, in accordance with the law, equip leading cadres from the ethnic group exercising regional autonomy and other ethnic groups. 民族自治地方录用、聘用国家工作人员时，对实行区域自治的民族和其他少数民族予以照顾，具体办法由录用、聘用主管部门规定。

People's governments at higher levels shall guide ethnic autonomous areas in formulating talent development plans and take various effective measures to actively cultivate and employ talents of all levels and types from the ethnic group exercising regional autonomy and other ethnic groups.
国家积极采取措施，加大对少数民族和民族自治地方干部的培训力度，扩大干部培训机构和高等院校为民族自治地方培训干部与人才的规模，建立和完善民族自治地方与中央国家机关和经济相对发达地区干部交流制度。
The state shall actively take measures to increase the training of cadres from ethnic minorities and ethnic autonomous areas, expand the scale of training cadres and talents for ethnic autonomous areas by training institutions and institutions of higher education, and establish and improve the system of cadre exchange between ethnic autonomous areas and central state organs and relatively economically developed regions.
国家鼓励和支持各级各类人才到民族自治地方发展、创业，当地人民政府应当为他们提供优惠便利的工作和生活条件；对到边远、高寒等条件比较艰苦的民族自治地方工作的汉族和其他民族人才的家属和子女，在就业、就学等方面给予适当照顾。
The state encourages and supports talents of all levels and types to develop and start businesses in ethnic autonomous areas. The local people's governments shall provide them with favorable and convenient working and living conditions; for the family members and children of Han and other ethnic talents working in remote, high-cold, or other harsh conditions in ethnic autonomous areas, appropriate preferential treatment shall be given in employment and education.
各级人民政府民族工作部门对本规定的执行情况实施监督检查，每年将监督检查的情况向同级人民政府报告，并提出意见和建议。
The ethnic affairs departments of people's governments at all levels shall supervise and inspect the implementation of these Provisions, report the results of the supervision and inspection to the people's government at the same level each year, and put forward opinions and suggestions.
对违反国家财政制度、财务制度，挪用、克扣、截留国家财政用于民族自治地方经费的，责令限期归还被挪用、克扣、截留的经费，并依法对直接负责的主管人员和其他直接责任人员给予行政处分；构成犯罪的，依法追究刑事责任。
Where anyone, in violation of the state financial system or financial system, misappropriates, withholds, or intercepts state funds allocated for ethnic autonomous areas, the misappropriated, withheld, or intercepted funds shall be ordered to be returned within a time limit, and administrative sanctions shall be imposed on the directly responsible persons in charge and other directly responsible persons in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
各级人民政府行政部门违反本规定，不依法履行职责，由其上级行政机关或者监察机关责令改正。
Where an administrative department of a people's government at any level violates these Provisions and fails to perform its duties in accordance with the law, the administrative organ at the next higher level or the supervisory organ shall order it to make corrections.
各级行政机关工作人员在执行本规定过程中，滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。
Where any functionary of an administrative organ, in the course of implementing these Provisions, abuses power, neglects duty, or engages in malpractice for personal gain, if a crime is constituted, criminal liability shall be pursued in accordance with the law; if no crime is constituted, administrative sanctions shall be imposed in accordance with the law.
本规定所称上级人民政府，是指民族自治地方的上级人民政府。
The term 'people's government at a higher level' as used in these Provisions refers to the people's government at a higher level than the ethnic autonomous area.
国务院有关部门、自治区和辖有自治州、自治县的省、直辖市人民政府在职权范围内，根据本规定制订具体办法，并将执行情况向国务院报告。
The relevant departments of the State Council, and the people's governments of autonomous regions, provinces, and municipalities directly under the Central Government that have autonomous prefectures or autonomous counties shall, within their terms of reference, formulate specific measures in accordance with these Provisions and report the implementation to the State Council.
本规定自2005年5月31日起施行。
These Provisions shall come into force as of May 31, 2005.
