总则
General Provisions
为了加强对民用核安全设备的监督管理，保证民用核设施的安全运行，预防核事故，保障工作人员和公众的健康，保护环境，促进核能事业的顺利发展，制定本条例。
These Regulations are formulated to strengthen the supervision and administration of civil nuclear safety equipment, ensure the safe operation of civil nuclear facilities, prevent nuclear accidents, protect the health of workers and the public, protect the environment, and promote the smooth development of the nuclear energy industry.
本条例所称民用核安全设备，是指在民用核设施中使用的执行核安全功能的设备，包括核安全机械设备和核安全电气设备。
For the purposes of these Regulations, 'civil nuclear safety equipment' means equipment used in civil nuclear facilities that performs nuclear safety functions, including nuclear safety mechanical equipment and nuclear safety electrical equipment.
民用核安全设备目录由国务院核安全监管部门商国务院有关部门制定并发布。
The catalogue of civil nuclear safety equipment shall be formulated and published by the nuclear safety regulatory authority of the State Council in consultation with the relevant departments of the State Council.
民用核安全设备设计、制造、安装和无损检验活动适用本条例。
These Regulations apply to the design, manufacturing, installation, and non-destructive testing activities of civil nuclear safety equipment.
民用核安全设备运离民用核设施现场进行的维修活动，适用民用核安全设备制造活动的有关规定。
Maintenance activities of civil nuclear safety equipment carried out away from the civil nuclear facility site shall be subject to the relevant provisions on manufacturing activities of civil nuclear safety equipment.
国务院核安全监管部门对民用核安全设备设计、制造、安装和无损检验活动实施监督管理。
The nuclear safety regulatory authority of the State Council shall exercise supervision and administration over the design, manufacturing, installation, and non-destructive testing activities of civil nuclear safety equipment.
国务院核行业主管部门和其他有关部门依照本条例和国务院规定的职责分工负责有关工作。
The nuclear industry competent authority of the State Council and other relevant departments shall be responsible for relevant work in accordance with these Regulations and the division of duties prescribed by the State Council.
民用核安全设备设计、制造、安装和无损检验单位，应当建立健全责任制度，加强质量管理，并对其所从事的民用核安全设备设计、制造、安装和无损检验活动承担全面责任。
Units engaged in the design, manufacturing, installation, and non-destructive testing of civil nuclear safety equipment shall establish a responsibility system, strengthen quality management, and assume full responsibility for the civil nuclear safety equipment design, manufacturing, installation, and non-destructive testing activities they undertake.
民用核设施营运单位，应当对在役的民用核安全设备进行检查、试验、检验和维修，并对民用核安全设备的使用和运行安全承担全面责任。
Civil nuclear facility operating units shall inspect, test, examine, and maintain in-service civil nuclear safety equipment, and assume full responsibility for the use and operational safety of civil nuclear safety equipment.
民用核安全设备设计、制造、安装和无损检验活动应当符合国家有关产业政策。
Activities of design, manufacturing, installation, and non-destructive testing of civil nuclear safety equipment shall comply with relevant national industrial policies.
国家鼓励民用核安全设备设计、制造、安装和无损检验的科学技术研究，提高安全水平。
The State encourages scientific and technological research on the design, manufacturing, installation, and non-destructive testing of civil nuclear safety equipment to improve safety levels.
任何单位和个人对违反本条例规定的行为，有权向国务院核安全监管部门举报。国务院核安全监管部门接到举报，应当及时调查处理，并为举报人保密。
Any entity or individual has the right to report to the nuclear safety regulatory authority of the State Council any act that violates the provisions of these Regulations. Upon receiving a report, the nuclear safety regulatory authority of the State Council shall promptly investigate and handle it, and keep the reporter confidential.
标准
Standards
民用核安全设备标准是从事民用核安全设备设计、制造、安装和无损检验活动的技术依据。
Civil nuclear safety equipment standards are the technical basis for engaging in the design, manufacturing, installation, and non-destructive testing of civil nuclear safety equipment.
国家建立健全民用核安全设备标准体系。制定民用核安全设备标准，应当充分考虑民用核安全设备的技术发展和使用要求，结合我国的工业基础和技术水平，做到安全可靠、技术成熟、经济合理。
The State establishes and improves the civil nuclear safety equipment standard system. The formulation of civil nuclear safety equipment standards shall fully consider the technological development and usage requirements of civil nuclear safety equipment, combined with China's industrial base and technical level, to achieve safety, reliability, technical maturity, and economic rationality.
民用核安全设备标准包括国家标准、行业标准和企业标准。
Civil nuclear safety equipment standards include national standards, industry standards, and enterprise standards.
涉及核安全基本原则和技术要求的民用核安全设备国家标准，由国务院核安全监管部门组织拟定，由国务院标准化主管部门和国务院核安全监管部门联合发布；其他的民用核安全设备国家标准，由国务院核行业主管部门组织拟定，经国务院核安全监管部门认可，由国务院标准化主管部门发布。
National standards for civil nuclear safety equipment involving basic principles and technical requirements of nuclear safety shall be drafted by the nuclear safety regulatory authority of the State Council, and jointly issued by the standardization administrative department of the State Council and the nuclear safety regulatory authority of the State Council; other national standards for civil nuclear safety equipment shall be drafted by the nuclear industry competent department of the State Council, approved by the nuclear safety regulatory authority of the State Council, and issued by the standardization administrative department of the State Council.
民用核安全设备行业标准，由国务院核行业主管部门组织拟定，经国务院核安全监管部门认可，由国务院核行业主管部门发布，并报国务院标准化主管部门备案。
Industry standards for civil nuclear safety equipment shall be drafted by the nuclear industry competent department of the State Council, approved by the nuclear safety regulatory authority of the State Council, issued by the nuclear industry competent department of the State Council, and reported to the standardization administrative department of the State Council for record.
制定民用核安全设备国家标准和行业标准，应当充分听取有关部门和专家的意见。
When formulating national and industry standards for civil nuclear safety equipment, opinions from relevant departments and experts shall be fully solicited.
尚未制定相应国家标准和行业标准的，民用核安全设备设计、制造、安装和无损检验单位应当采用经国务院核安全监管部门认可的标准。
Where corresponding national and industry standards have not yet been formulated, units engaged in the design, manufacturing, installation, and nondestructive testing of civil nuclear safety equipment shall adopt standards recognized by the nuclear safety regulatory department of the State Council.
许可
Licensing
民用核安全设备设计、制造、安装和无损检验单位应当依照本条例规定申请领取许可证。
Units engaged in the design, manufacturing, installation, and nondestructive testing of civil nuclear safety equipment shall apply for a license in accordance with these Regulations.
申请领取民用核安全设备设计、制造、安装或者无损检验许可证的单位，应当具备下列条件：
A unit applying for a license for the design, manufacturing, installation, or nondestructive testing of civil nuclear safety equipment shall meet the following conditions:
(一)具有法人资格；
(1) Having legal personality;
(二)有与拟从事活动相关或者相近的工作业绩，并且满5年以上；
(2) Having relevant or similar work performance related to the intended activities, and for more than 5 years;
(三)有与拟从事活动相适应的、经考核合格的专业技术人员，其中从事民用核安全设备焊接和无损检验活动的专业技术人员应当取得相应的资格证书；
(3) Having professional and technical personnel who are suitable for the intended activities and have passed assessment, among which professional and technical personnel engaged in welding and nondestructive testing of civil nuclear safety equipment shall obtain corresponding qualification certificates;
(四)有与拟从事活动相适应的工作场所、设施和装备；
(4) Having workplaces, facilities, and equipment suitable for the intended activities;
(五)有健全的管理制度和完善的质量保证体系，以及符合核安全监督管理规定的质量保证大纲。
(5) Having a sound management system and a complete quality assurance system, as well as a quality assurance outline that complies with nuclear safety supervision and management regulations.
申请领取民用核安全设备制造许可证或者安装许可证的单位，还应当制作有代表性的模拟件。
A unit applying for a license for manufacturing or installing civil nuclear safety equipment shall also produce representative mock-ups.
申请领取民用核安全设备设计、制造、安装或者无损检验许可证的单位，应当向国务院核安全监管部门提出书面申请，并提交符合本条例第十三条规定条件的证明材料。
A unit applying for a license for design, manufacturing, installation, or nondestructive testing of civil nuclear safety equipment shall submit a written application to the nuclear safety regulatory authority of the State Council, along with evidentiary materials meeting the conditions specified in Article 13 of these Regulations.
国务院核安全监管部门应当自受理申请之日起45个工作日内完成审查，并对符合条件的颁发许可证，予以公告；对不符合条件的，书面通知申请单位并说明理由。
The nuclear safety regulatory authority of the State Council shall complete the review within 45 working days from the date of accepting the application, issue a license to those meeting the conditions, and make a public announcement; for those not meeting the conditions, it shall notify the applicant in writing and state the reasons.
国务院核安全监管部门在审查过程中，应当组织专家进行技术评审，并征求国务院核行业主管部门和其他有关部门的意见。技术评审所需时间不计算在前款规定的期限内。
During the review process, the nuclear safety regulatory authority of the State Council shall organize expert technical reviews and solicit opinions from the nuclear industry competent authority of the State Council and other relevant departments. The time required for technical review shall not be counted within the period specified in the preceding paragraph.
民用核安全设备设计、制造、安装和无损检验许可证应当载明下列内容：
A license for design, manufacturing, installation, and nondestructive testing of civil nuclear safety equipment shall specify the following contents:
(一)单位名称、地址和法定代表人；
(1) Name, address, and legal representative of the unit;
(二)准予从事的活动种类和范围；
(2) Types and scope of activities permitted;
(三)有效期限；
(3) Validity period;
(四)发证机关、发证日期和证书编号。
(4) Issuing authority, date of issuance, and certificate number.
民用核安全设备设计、制造、安装和无损检验单位变更单位名称、地址或者法定代表人的，应当自变更工商登记之日起20日内，向国务院核安全监管部门申请办理许可证变更手续。
If a unit engaged in design, manufacturing, installation, or nondestructive testing of civil nuclear safety equipment changes its name, address, or legal representative, it shall apply to the nuclear safety regulatory authority of the State Council for license modification procedures within 20 days from the date of industrial and commercial registration change.
民用核安全设备设计、制造、安装和无损检验单位变更许可证规定的活动种类或者范围的，应当按照原申请程序向国务院核安全监管部门重新申请领取许可证。
If a unit engaged in the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment changes the type or scope of activities specified in its license, it shall reapply for a license to the nuclear safety supervision department of the State Council in accordance with the original application procedures.
民用核安全设备设计、制造、安装和无损检验许可证有效期为5年。
The validity period of a license for the design, manufacturing, installation, and non-destructive testing of civil nuclear safety equipment is five years.
许可证有效期届满，民用核安全设备设计、制造、安装和无损检验单位需要继续从事相关活动的，应当于许可证有效期届满6个月前，向国务院核安全监管部门提出延续申请。
If a unit engaged in the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment needs to continue relevant activities upon expiration of the license validity period, it shall submit a renewal application to the nuclear safety supervision department of the State Council six months before the expiration of the license validity period.
国务院核安全监管部门应当在许可证有效期届满前作出是否准予延续的决定；逾期未作决定的，视为准予延续。
The nuclear safety supervision department of the State Council shall make a decision on whether to approve the renewal before the expiration of the license validity period; if no decision is made within the time limit, the renewal shall be deemed approved.
禁止无许可证擅自从事或者不按照许可证规定的活动种类和范围从事民用核安全设备设计、制造、安装和无损检验活动。
It is prohibited to engage in the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment without a license or not in accordance with the type and scope of activities specified in the license.
禁止委托未取得相应许可证的单位进行民用核安全设备设计、制造、安装和无损检验活动。
It is prohibited to entrust a unit that has not obtained the corresponding license to carry out the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment.
禁止伪造、变造、转让许可证。
It is prohibited to forge, alter, or transfer licenses.
设计、制造、安装和无损检验
Design, Manufacturing, Installation, and Non-destructive Testing
民用核安全设备设计、制造、安装和无损检验单位，应当提高核安全意识，建立完善的质量保证体系，确保民用核安全设备的质量和可靠性。
Units engaged in the design, manufacturing, installation, and non-destructive testing of civil nuclear safety equipment shall enhance nuclear safety awareness, establish a sound quality assurance system, and ensure the quality and reliability of civil nuclear safety equipment.
民用核设施营运单位，应当对民用核安全设备设计、制造、安装和无损检验活动进行质量管理和过程控制，做好监造和验收工作。
Operators of civil nuclear facilities shall conduct quality management and process control over the design, manufacturing, installation, and non-destructive testing activities of civil nuclear safety equipment, and perform supervision and acceptance work.
民用核安全设备设计、制造、安装和无损检验单位，应当根据其质量保证大纲和民用核设施营运单位的要求，在民用核安全设备设计、制造、安装和无损检验活动开始前编制项目质量保证分大纲，并经民用核设施营运单位审查同意。
Units engaged in the design, manufacture, installation, and nondestructive testing of civil nuclear safety equipment shall, based on their quality assurance program and the requirements of the civil nuclear facility operator, prepare a project quality assurance sub-program before commencing the design, manufacture, installation, and nondestructive testing activities, and shall obtain the review and approval of the civil nuclear facility operator.
民用核安全设备设计单位，应当在设计活动开始30日前，将下列文件报国务院核安全监管部门备案：
A civil nuclear safety equipment design unit shall, 30 days before commencing the design activity, file the following documents with the nuclear safety regulatory authority of the State Council for record:
(一)项目设计质量保证分大纲和程序清单；
(1) Project design quality assurance sub-program and procedure list;
(二)设计内容和设计进度计划；
(2) Design content and design schedule;
(三)设计遵循的标准和规范目录清单，设计中使用的计算机软件清单；
(3) List of standards and specifications to be followed in the design, and list of computer software used in the design;
(四)设计验证活动清单。
(4) List of design verification activities.
民用核安全设备制造、安装单位，应当在制造、安装活动开始30日前，将下列文件报国务院核安全监管部门备案：
A civil nuclear safety equipment manufacturing or installation unit shall, 30 days before commencing the manufacturing or installation activity, file the following documents with the nuclear safety regulatory authority of the State Council for record:
(一)项目制造、安装质量保证分大纲和程序清单；
(1) Project manufacturing or installation quality assurance sub-program and procedure list;
(二)制造、安装技术规格书；
(2) Manufacturing or installation technical specifications;
(三)分包项目清单；
(3) List of subcontracted items;
(四)制造、安装质量计划。
(4) Manufacturing and installation quality plans.
民用核安全设备设计、制造、安装和无损检验单位，不得将国务院核安全监管部门确定的关键工艺环节分包给其他单位。
Units engaged in the design, manufacturing, installation, and nondestructive testing of civil nuclear safety equipment shall not subcontract the key process links determined by the nuclear safety regulatory department of the State Council to other units.
民用核安全设备制造、安装、无损检验单位和民用核设施营运单位，应当聘用取得民用核安全设备焊工、焊接操作工和无损检验人员资格证书的人员进行民用核安全设备焊接和无损检验活动。
Units engaged in the manufacturing, installation, and nondestructive testing of civil nuclear safety equipment and civil nuclear facility operating units shall employ personnel who have obtained qualification certificates for welders, welding operators, and nondestructive testing personnel of civil nuclear safety equipment to carry out welding and nondestructive testing activities of civil nuclear safety equipment.
民用核安全设备焊工、焊接操作工和无损检验人员由国务院核安全监管部门核准颁发资格证书。
The qualification certificates for welders, welding operators, and nondestructive testing personnel of civil nuclear safety equipment shall be approved and issued by the nuclear safety regulatory department of the State Council.
民用核安全设备焊工、焊接操作工和无损检验人员在民用核安全设备焊接和无损检验活动中，应当严格遵守操作规程。
Welders, welding operators, and nondestructive testing personnel of civil nuclear safety equipment shall strictly abide by the operating procedures during welding and nondestructive testing activities of civil nuclear safety equipment.
民用核安全设备无损检验单位应当客观、准确地出具无损检验结果报告。无损检验结果报告经取得相应资格证书的无损检验人员签字方为有效。
Units engaged in nondestructive testing of civil nuclear safety equipment shall issue nondestructive testing result reports objectively and accurately. Nondestructive testing result reports shall be valid only after being signed by nondestructive testing personnel who have obtained corresponding qualification certificates.
民用核安全设备无损检验单位和无损检验人员对无损检验结果报告负责。
Units and nondestructive testing personnel engaged in nondestructive testing of civil nuclear safety equipment shall be responsible for the nondestructive testing result reports.
民用核安全设备设计单位应当对其设计进行设计验证。设计验证由未参与原设计的专业人员进行。
Units engaged in the design of civil nuclear safety equipment shall perform design verification on their designs. Design verification shall be carried out by professionals who did not participate in the original design.
设计验证可以采用设计评审、鉴定试验或者不同于设计中使用的计算方法的其他计算方法等形式。
Design verification may take the form of design review, qualification tests, or other calculation methods different from the calculation methods used in the design.
民用核安全设备制造、安装单位应当对民用核安全设备的制造、安装质量进行检验。未经检验或者经检验不合格的，不得交付验收。
Units engaged in the manufacturing and installation of civil nuclear safety equipment shall inspect the manufacturing and installation quality of civil nuclear safety equipment. Equipment that has not been inspected or has been inspected and found unqualified shall not be delivered for acceptance.
民用核设施营运单位应当对民用核安全设备质量进行验收。有下列情形之一的，不得验收通过：
The operating entity of a civil nuclear facility shall conduct acceptance inspection of the quality of civil nuclear safety equipment. Acceptance shall not be passed under any of the following circumstances:
(一)不能按照质量保证要求证明质量受控的；
(1) The quality cannot be proven to be under control in accordance with quality assurance requirements;
(二)出现重大质量问题未处理完毕的。
(2) Major quality issues have occurred and have not been resolved.
民用核安全设备设计、制造、安装和无损检验单位，应当对本单位所从事的民用核安全设备设计、制造、安装和无损检验活动进行年度评估，并于每年4月1日前向国务院核安全监管部门提交上一年度的评估报告。
Entities engaged in the design, manufacturing, installation, and non-destructive testing of civil nuclear safety equipment shall conduct an annual evaluation of their activities in these areas and submit an evaluation report for the previous year to the nuclear safety regulatory authority of the State Council before April 1 each year.
评估报告应当包括本单位工作场所、设施、装备和人员等变动情况，质量保证体系实施情况，重大质量问题处理情况以及国务院核安全监管部门和民用核设施营运单位提出的整改要求落实情况等内容。
The evaluation report shall include changes in the entity's workplace, facilities, equipment, and personnel, implementation of the quality assurance system, handling of major quality issues, and the status of compliance with rectification requirements proposed by the nuclear safety regulatory authority of the State Council and the operating entity of the civil nuclear facility.
民用核安全设备设计、制造、安装和无损检验单位对本单位在民用核安全设备设计、制造、安装和无损检验活动中出现的重大质量问题，应当立即采取处理措施，并向国务院核安全监管部门报告。
Entities engaged in the design, manufacturing, installation, and non-destructive testing of civil nuclear safety equipment shall immediately take corrective measures and report to the nuclear safety regulatory authority of the State Council when major quality issues arise in their activities.
进出口
Import and Export
为中华人民共和国境内民用核设施进行民用核安全设备设计、制造、安装和无损检验活动的境外单位，应当具备下列条件：
Foreign entities conducting design, manufacturing, installation, and non-destructive testing activities of civil nuclear safety equipment for civil nuclear facilities within the territory of the People's Republic of China shall meet the following conditions:
(一)遵守中华人民共和国的法律、行政法规和核安全监督管理规定；
(1) Comply with the laws, administrative regulations, and nuclear safety supervision and management provisions of the People's Republic of China;
(二)已取得所在国核安全监管部门规定的相应资质；
(2) Have obtained the corresponding qualifications as required by the nuclear safety regulatory authority of their home country.
(三)使用的民用核安全设备设计、制造、安装和无损检验技术是成熟的或者经过验证的；
(3) The civil nuclear safety equipment design, manufacturing, installation, and nondestructive testing technologies used are mature or have been validated;
(四)采用中华人民共和国的民用核安全设备国家标准、行业标准或者国务院核安全监管部门认可的标准。
(4) The national standards, industry standards of the People's Republic of China for civil nuclear safety equipment, or standards recognized by the nuclear safety regulatory authority of the State Council are adopted.
为中华人民共和国境内民用核设施进行民用核安全设备设计、制造、安装和无损检验活动的境外单位，应当事先到国务院核安全监管部门办理注册登记手续。国务院核安全监管部门应当将境外单位注册登记情况抄送国务院核行业主管部门和其他有关部门。
Overseas entities that carry out civil nuclear safety equipment design, manufacturing, installation, and nondestructive testing activities for civil nuclear facilities within the territory of the People's Republic of China shall register with the nuclear safety regulatory authority of the State Council in advance. The nuclear safety regulatory authority of the State Council shall send a copy of the registration information of overseas entities to the nuclear industry authority of the State Council and other relevant departments.
注册登记的具体办法由国务院核安全监管部门制定。
The specific measures for registration shall be formulated by the nuclear safety regulatory authority of the State Council.
国务院核安全监管部门及其所属的检验机构应当依法对进口的民用核安全设备进行安全检验。
The nuclear safety regulatory authority of the State Council and its inspection agencies shall conduct safety inspections on imported civil nuclear safety equipment in accordance with the law.
进口的民用核安全设备在安全检验合格后，由海关进行商品检验。
After the imported civil nuclear safety equipment passes the safety inspection, the customs shall conduct commodity inspection.
国务院核安全监管部门根据需要，可以对境外单位为中华人民共和国境内民用核设施进行的民用核安全设备设计、制造、安装和无损检验活动实施核安全监督检查。
The nuclear safety regulatory authority of the State Council may, as needed, carry out nuclear safety supervision and inspection on the civil nuclear safety equipment design, manufacturing, installation, and nondestructive testing activities conducted by overseas entities for civil nuclear facilities within the territory of the People's Republic of China.
民用核设施营运单位应当在对外贸易合同中约定有关民用核安全设备监造、装运前检验和监装等方面的要求。
Civil nuclear facility operating entities shall stipulate in foreign trade contracts the requirements for supervision of manufacturing, pre-shipment inspection, and supervision of loading of civil nuclear safety equipment.
民用核安全设备的出口管理依照有关法律、行政法规的规定执行。
The export management of civil nuclear safety equipment shall be implemented in accordance with relevant laws and administrative regulations.
监督检查
Supervision and Inspection
国务院核安全监管部门及其派出机构，依照本条例规定对民用核安全设备设计、制造、安装和无损检验活动进行监督检查。监督检查分为例行检查和非例行检查。
The nuclear safety regulatory authority of the State Council and its local offices shall, in accordance with these Regulations, conduct supervision and inspection of the design, manufacture, installation, and non-destructive testing activities of civil nuclear safety equipment. Supervision and inspection shall be divided into routine inspections and non-routine inspections.
国务院核安全监管部门及其派出机构在进行监督检查时，有权采取下列措施：
When conducting supervision and inspection, the nuclear safety regulatory authority of the State Council and its local offices have the right to take the following measures:
(一)向被检查单位的法定代表人和其他有关人员调查、了解情况；
(1) Investigate and understand the situation from the legal representative and other relevant personnel of the inspected entity;
(二)进入被检查单位进行现场调查或者核查；
(2) Enter the inspected entity to conduct on-site investigation or verification;
(三)查阅、复制相关文件、记录以及其他有关资料；
(3) Consult and copy relevant documents, records, and other related materials;
(四)要求被检查单位提交有关情况说明或者后续处理报告；
(4) Require the inspected entity to submit a description of the situation or a follow-up treatment report;
(五)对有证据表明可能存在重大质量问题的民用核安全设备或者其主要部件，予以暂时封存。
(5) Temporarily seal civil nuclear safety equipment or its main components for which there is evidence indicating possible major quality problems.
被检查单位应当予以配合，如实反映情况，提供必要资料，不得拒绝和阻碍。
The inspected entity shall cooperate, truthfully reflect the situation, provide necessary materials, and shall not refuse or obstruct.
国务院核安全监管部门及其派出机构在进行监督检查时，应当对检查的内容、发现的问题以及处理情况作出记录，并由监督检查人员和被检查单位的有关负责人签字确认。被检查单位的有关负责人拒绝签字的，监督检查人员应当将有关情况记录在案。
When conducting supervision and inspection, the nuclear safety regulatory authority of the State Council and its local offices shall make records of the inspection content, problems found, and handling situations, and the records shall be signed and confirmed by the inspection personnel and the relevant responsible person of the inspected entity. If the relevant responsible person of the inspected entity refuses to sign, the inspection personnel shall record the situation in the file.
民用核安全设备监督检查人员在进行监督检查时，应当出示证件，并为被检查单位保守技术秘密和业务秘密。
When conducting supervision and inspection, civil nuclear safety equipment inspection personnel shall present their credentials and keep confidential the technical secrets and business secrets of the inspected entity.
民用核安全设备监督检查人员不得滥用职权侵犯企业的合法权益，或者利用职务上的便利索取、收受财物。
Civil nuclear safety equipment inspection personnel shall not abuse their powers to infringe upon the lawful rights and interests of enterprises, or use their positions to extort or accept property.
民用核安全设备监督检查人员不得从事或者参与民用核安全设备经营活动。
Civil nuclear safety equipment inspection personnel shall not engage in or participate in the business activities of civil nuclear safety equipment.
国务院核安全监管部门发现民用核安全设备设计、制造、安装和无损检验单位有不符合发证条件的情形的，应当责令其限期整改。
If the nuclear safety regulatory authority of the State Council finds that a unit engaged in the design, manufacture, installation, or non-destructive testing of civil nuclear safety equipment no longer meets the conditions for the license, it shall order the unit to rectify within a specified period.
国务院核行业主管部门应当加强对本行业民用核设施营运单位的管理，督促本行业民用核设施营运单位遵守法律、行政法规和核安全监督管理规定。
The competent nuclear industry department of the State Council shall strengthen the management of civil nuclear facility operating units within its industry, and urge such units to comply with laws, administrative regulations, and nuclear safety supervision and management provisions.
法律责任
Legal Liability
国务院核安全监管部门及其民用核安全设备监督检查人员有下列行为之一的，对直接负责的主管人员和其他直接责任人员，依法给予处分；直接负责的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任：
If the nuclear safety regulatory authority of the State Council or its civil nuclear safety equipment inspection personnel commit any of the following acts, the directly responsible supervisors and other directly responsible personnel shall be given disciplinary sanctions according to law; if the directly responsible supervisors and other directly responsible personnel constitute a crime, criminal liability shall be pursued according to law:
(一)不依照本条例规定颁发许可证的；
(1) Issuing licenses not in accordance with these Regulations;
(二)发现违反本条例规定的行为不予查处，或者接到举报后不依法处理的；
(2) Failing to investigate violations of these Regulations, or failing to handle reports according to law after receiving them;
(三)滥用职权侵犯企业的合法权益，或者利用职务上的便利索取、收受财物的；
(3) Abusing powers to infringe upon the lawful rights and interests of enterprises, or using positions to extort or accept property;
(四)从事或者参与民用核安全设备经营活动的；
(4) Engaging in or participating in the business activities of civil nuclear safety equipment;
(五)在民用核安全设备监督管理工作中有其他违法行为的。
(5) Other illegal acts in the supervision and administration of civil nuclear safety equipment.
无许可证擅自从事民用核安全设备设计、制造、安装和无损检验活动的，由国务院核安全监管部门责令停止违法行为，处50万元以上100万元以下的罚款；有违法所得的，没收违法所得；对直接负责的主管人员和其他直接责任人员，处2万元以上10万元以下的罚款。
Where a unit engages in the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment without a license, the nuclear safety regulatory department of the State Council shall order cessation of the illegal act, impose a fine of not less than 500,000 yuan but not more than 1 million yuan; if there is illegal income, it shall be confiscated; the directly responsible person in charge and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 100,000 yuan.
民用核安全设备设计、制造、安装和无损检验单位不按照许可证规定的活动种类和范围从事民用核安全设备设计、制造、安装和无损检验活动的，由国务院核安全监管部门责令停止违法行为，限期改正，处10万元以上50万元以下的罚款；有违法所得的，没收违法所得；逾期不改正的，暂扣或者吊销许可证，对直接负责的主管人员和其他直接责任人员，处2万元以上10万元以下的罚款。
Where a unit engaged in the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment does not carry out activities in accordance with the types and scope of activities specified in the license, the nuclear safety regulatory department of the State Council shall order cessation of the illegal act, set a deadline for correction, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if there is illegal income, it shall be confiscated; if correction is not made within the time limit, the license shall be suspended or revoked, and the directly responsible person in charge and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 100,000 yuan.
民用核安全设备设计、制造、安装和无损检验单位变更单位名称、地址或者法定代表人，未依法办理许可证变更手续的，由国务院核安全监管部门责令限期改正；逾期不改正的，暂扣或者吊销许可证。
Where a unit engaged in the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment changes its name, address, or legal representative without going through the formalities for license change in accordance with the law, the nuclear safety regulatory department of the State Council shall order correction within a time limit; if correction is not made within the time limit, the license shall be suspended or revoked.
单位伪造、变造、转让许可证的，由国务院核安全监管部门收缴伪造、变造的许可证或者吊销许可证，处10万元以上50万元以下的罚款；有违法所得的，没收违法所得；对直接负责的主管人员和其他直接责任人员，处2万元以上10万元以下的罚款；构成违反治安管理行为的，由公安机关依法予以治安处罚；构成犯罪的，依法追究刑事责任。
Where a unit forges, alters, or transfers a license, the nuclear safety regulatory department of the State Council shall confiscate the forged or altered license or revoke the license, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if there is illegal income, it shall be confiscated; the directly responsible person in charge and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 100,000 yuan; if the act constitutes a violation of public security administration, the public security organ shall impose a public security penalty in accordance with the law; if a crime is constituted, criminal liability shall be investigated in accordance with the law.
民用核安全设备设计、制造、安装和无损检验单位未按照民用核安全设备标准进行民用核安全设备设计、制造、安装和无损检验活动的，由国务院核安全监管部门责令停止违法行为，限期改正，禁止使用相关设计、设备，处10万元以上50万元以下的罚款；有违法所得的，没收违法所得；逾期不改正的，暂扣或者吊销许可证，对直接负责的主管人员和其他直接责任人员，处2万元以上10万元以下的罚款。
Where a unit engaged in the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment fails to carry out activities in accordance with civil nuclear safety equipment standards, the nuclear safety regulatory department of the State Council shall order cessation of the illegal act, set a deadline for correction, prohibit the use of the relevant design or equipment, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if there is illegal income, it shall be confiscated; if correction is not made within the time limit, the license shall be suspended or revoked, and the directly responsible person in charge and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 100,000 yuan.
民用核安全设备设计、制造、安装和无损检验单位有下列行为之一的，由国务院核安全监管部门责令停止违法行为，限期改正，处10万元以上50万元以下的罚款；逾期不改正的，暂扣或者吊销许可证，对直接负责的主管人员和其他直接责任人员，处2万元以上10万元以下的罚款：
Where a unit engaged in the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment commits any of the following acts, the nuclear safety regulatory department of the State Council shall order cessation of the illegal act, set a deadline for correction, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if correction is not made within the time limit, the license shall be suspended or revoked, and the directly responsible person in charge and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 100,000 yuan:
(一)委托未取得相应许可证的单位进行民用核安全设备设计、制造、安装和无损检验活动的；
(1) Entrusting a unit that has not obtained the corresponding license to carry out the design, manufacturing, installation, or non-destructive testing of civil nuclear safety equipment;
(二)聘用未取得相应资格证书的人员进行民用核安全设备焊接和无损检验活动的；
(2) Employing personnel who have not obtained the corresponding qualification certificates to carry out welding or non-destructive testing of civil nuclear safety equipment;
(三)将国务院核安全监管部门确定的关键工艺环节分包给其他单位的。
(3) Subcontracting key process links determined by the nuclear safety regulatory department of the State Council to other units.
民用核安全设备设计、制造、安装和无损检验单位对本单位在民用核安全设备设计、制造、安装和无损检验活动中出现的重大质量问题，未按照规定采取处理措施并向国务院核安全监管部门报告的，由国务院核安全监管部门责令停止民用核安全设备设计、制造、安装和无损检验活动，限期改正，处5万元以上20万元以下的罚款；逾期不改正的，暂扣或者吊销许可证，对直接负责的主管人员和其他直接责任人员，处2万元以上10万元以下的罚款。
If a unit engaged in the design, manufacture, installation, or nondestructive testing of civil nuclear safety equipment fails to take corrective measures and report to the nuclear safety regulatory authority of the State Council as required when a major quality problem occurs in its activities, the nuclear safety regulatory authority of the State Council shall order it to cease the activities, rectify within a time limit, and impose a fine of not less than 50,000 yuan but not more than 200,000 yuan; if it fails to rectify within the time limit, its license shall be suspended or revoked, and the directly responsible manager and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 100,000 yuan.
民用核安全设备设计、制造、安装和无损检验单位有下列行为之一的，由国务院核安全监管部门责令停止民用核安全设备设计、制造、安装和无损检验活动，限期改正；逾期不改正的，处5万元以上20万元以下的罚款，暂扣或者吊销许可证：
If a unit engaged in the design, manufacture, installation, or nondestructive testing of civil nuclear safety equipment commits any of the following acts, the nuclear safety regulatory authority of the State Council shall order it to cease the activities and rectify within a time limit; if it fails to rectify within the time limit, it shall be fined not less than 50,000 yuan but not more than 200,000 yuan, and its license shall be suspended or revoked:
(一)未按照规定编制项目质量保证分大纲并经民用核设施营运单位审查同意的；
(1) failing to prepare a project quality assurance sub-outline as required and obtain the review and approval of the civil nuclear facility operating unit;
(二)在民用核安全设备设计、制造和安装活动开始前，未按照规定将有关文件报国务院核安全监管部门备案的；
(2) failing to file the relevant documents with the nuclear safety regulatory authority of the State Council as required before commencing the design, manufacture, or installation activities of civil nuclear safety equipment;
(三)未按照规定进行年度评估并向国务院核安全监管部门提交评估报告的。
(3) failing to conduct an annual assessment and submit an assessment report to the nuclear safety regulatory authority of the State Council as required.
民用核安全设备无损检验单位出具虚假无损检验结果报告的，由国务院核安全监管部门处10万元以上50万元以下的罚款，吊销许可证；有违法所得的，没收违法所得；对直接负责的主管人员和其他直接责任人员，处2万元以上10万元以下的罚款；构成犯罪的，依法追究刑事责任。
If a unit engaged in nondestructive testing of civil nuclear safety equipment issues a false nondestructive testing result report, the nuclear safety regulatory authority of the State Council shall impose a fine of not less than 100,000 yuan but not more than 500,000 yuan and revoke its license; any illegal income shall be confiscated; the directly responsible manager and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 100,000 yuan; if the act constitutes a crime, criminal liability shall be pursued according to law.
民用核安全设备焊工、焊接操作工违反操作规程导致严重焊接质量问题的，由国务院核安全监管部门吊销其资格证书。
If a welder or welding operator of civil nuclear safety equipment violates operating procedures and causes serious welding quality problems, the nuclear safety regulatory authority of the State Council shall revoke his or her qualification certificate.
民用核安全设备无损检验人员违反操作规程导致无损检验结果报告严重错误的，由国务院核安全监管部门吊销其资格证书。
If a nondestructive testing personnel of civil nuclear safety equipment violates operating procedures and causes serious errors in the nondestructive testing result report, the nuclear safety regulatory authority of the State Council shall revoke his or her qualification certificate.
民用核安全设备设计单位未按照规定进行设计验证，或者民用核安全设备制造、安装单位未按照规定进行质量检验以及经检验不合格即交付验收的，由国务院核安全监管部门责令限期改正，处10万元以上50万元以下的罚款；有违法所得的，没收违法所得；逾期不改正的，吊销许可证，对直接负责的主管人员和其他直接责任人员，处2万元以上10万元以下的罚款。
If a civil nuclear safety equipment design unit fails to carry out design verification as required, or a civil nuclear safety equipment manufacturing or installation unit fails to carry out quality inspection as required or delivers for acceptance a product that has failed inspection, the nuclear safety regulatory authority of the State Council shall order rectification within a time limit and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; any illegal income shall be confiscated; if it fails to rectify within the time limit, its license shall be revoked, and the directly responsible manager and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 100,000 yuan.
民用核设施营运单位有下列行为之一的，由国务院核安全监管部门责令限期改正，处100万元以上500万元以下的罚款；逾期不改正的，吊销其核设施建造许可证或者核设施运行许可证，对直接负责的主管人员和其他直接责任人员，处2万元以上10万元以下的罚款：
If a civil nuclear facility operating unit commits any of the following acts, the nuclear safety regulatory authority of the State Council shall order rectification within a time limit and impose a fine of not less than 1,000,000 yuan but not more than 5,000,000 yuan; if it fails to rectify within the time limit, its nuclear facility construction permit or nuclear facility operation permit shall be revoked, and the directly responsible manager and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 100,000 yuan:
(一)委托未取得相应许可证的单位进行民用核安全设备设计、制造、安装和无损检验活动的；
(1) Entrusting a unit that has not obtained the corresponding license to carry out civil nuclear safety equipment design, manufacture, installation, and non-destructive testing activities;
(二)对不能按照质量保证要求证明质量受控，或者出现重大质量问题未处理完毕的民用核安全设备予以验收通过的。
(2) Accepting and passing civil nuclear safety equipment that cannot prove quality control in accordance with quality assurance requirements, or for which major quality problems have not been resolved.
民用核安全设备设计、制造、安装和无损检验单位被责令限期整改，逾期不整改或者经整改仍不符合发证条件的，由国务院核安全监管部门暂扣或者吊销许可证。
If a unit engaged in civil nuclear safety equipment design, manufacture, installation, and non-destructive testing is ordered to rectify within a time limit but fails to do so or still does not meet the licensing conditions after rectification, the nuclear safety regulatory authority of the State Council shall temporarily suspend or revoke its license.
拒绝或者阻碍国务院核安全监管部门及其派出机构监督检查的，由国务院核安全监管部门责令限期改正；逾期不改正或者在接受监督检查时弄虚作假的，暂扣或者吊销许可证。
If a unit refuses or obstructs supervision and inspection by the nuclear safety regulatory authority of the State Council or its dispatched agencies, the nuclear safety regulatory authority of the State Council shall order rectification within a time limit; if rectification is not made within the time limit or if fraud is committed during the supervision and inspection, the license shall be temporarily suspended or revoked.
违反本条例规定，被依法吊销许可证的单位，自吊销许可证之日起1年内不得重新申请领取许可证。
If a unit violates these regulations and its license is revoked according to law, it shall not reapply for a license within one year from the date of revocation.
附则
Supplementary Provisions
申请领取民用核安全设备设计、制造、安装或者无损检验许可证的单位，应当按照国家有关规定缴纳技术评审的费用。
A unit applying for a license for civil nuclear safety equipment design, manufacture, installation, or non-destructive testing shall pay the fees for technical review in accordance with relevant state regulations.
本条例下列用语的含义：
The meanings of the following terms in these Regulations:
(一)核安全机械设备，包括执行核安全功能的压力容器、钢制安全壳(钢衬里)、储罐、热交换器、泵、风机和压缩机、阀门、闸门、管道(含热交换器传热管)和管配件、膨胀节、波纹管、法兰、堆内构件、控制棒驱动机构、支承件、机械贯穿件以及上述设备的铸锻件等。
(1) Nuclear safety mechanical equipment includes pressure vessels, steel containment (steel liner), storage tanks, heat exchangers, pumps, fans and compressors, valves, gates, pipes (including heat exchanger tubes) and pipe fittings, expansion joints, bellows, flanges, reactor internals, control rod drive mechanisms, supports, mechanical penetrations, and castings and forgings of the above equipment that perform nuclear safety functions.
(二)核安全电气设备，包括执行核安全功能的传感器(包括探测器和变送器)、电缆、机柜(包括机箱和机架)、控制台屏、显示仪表、应急柴油发电机组、蓄电池(组)、电动机、阀门驱动装置、电气贯穿件等。
(2) Nuclear safety electrical equipment includes sensors (including detectors and transmitters), cables, cabinets (including chassis and racks), control panels, display instruments, emergency diesel generator sets, batteries (groups), motors, valve actuators, electrical penetrations, etc., that perform nuclear safety functions.
本条例自2008年1月1日起施行。
This regulation shall come into force as of2008year1month1day。
