总则
General Provisions
为了加强对民用爆炸物品的安全管理，预防爆炸事故发生，保障公民生命、财产安全和公共安全，制定本条例。
These Regulations are formulated to strengthen the safety management of civil explosives, prevent explosion accidents, and ensure the safety of life, property, and public safety.
民用爆炸物品的生产、销售、购买、进出口、运输、爆破作业和储存以及硝酸铵的销售、购买，适用本条例。
These Regulations apply to the production, sale, purchase, import and export, transport, blasting operations, and storage of civil explosives, as well as the sale and purchase of ammonium nitrate.
本条例所称民用爆炸物品，是指用于非军事目的、列入民用爆炸物品品名表的各类火药、炸药及其制品和雷管、导火索等点火、起爆器材。
For the purposes of these Regulations, 'civil explosives' means all types of gunpowder, explosives and their products, as well as detonators, fuses, and other ignition and initiation devices listed in the Civil Explosives Inventory for non-military purposes.
民用爆炸物品品名表，由国务院民用爆炸物品行业主管部门会同国务院公安部门制订、公布。
The Civil Explosives Inventory shall be formulated and published by the competent department of the civil explosives industry under the State Council jointly with the public security department under the State Council.
国家对民用爆炸物品的生产、销售、购买、运输和爆破作业实行许可证制度。
The State implements a licensing system for the production, sale, purchase, transport, and blasting operations of civil explosives.
未经许可，任何单位或者个人不得生产、销售、购买、运输民用爆炸物品，不得从事爆破作业。
Without a license, no unit or individual may produce, sell, purchase, transport civil explosives, or engage in blasting operations.
严禁转让、出借、转借、抵押、赠送、私藏或者非法持有民用爆炸物品。
It is strictly prohibited to transfer, lend, sublet, mortgage, donate, conceal, or illegally possess civil explosives.
民用爆炸物品行业主管部门负责民用爆炸物品生产、销售的安全监督管理。
The competent department of the civil explosives industry is responsible for the safety supervision and management of the production and sale of civil explosives.
公安机关负责民用爆炸物品公共安全管理和民用爆炸物品购买、运输、爆破作业的安全监督管理，监控民用爆炸物品流向。
The public security organs are responsible for the public safety management of civil explosives and the safety supervision and management of the purchase, transport, and blasting operations of civil explosives, and monitor the flow of civil explosives.
安全生产监督、铁路、交通、民用航空主管部门依照法律、行政法规的规定，负责做好民用爆炸物品的有关安全监督管理工作。
The departments in charge of work safety, railways, transportation, and civil aviation shall, in accordance with the provisions of laws and administrative regulations, be responsible for the relevant safety supervision and management of civil explosives.
民用爆炸物品行业主管部门、公安机关、工商行政管理部门按照职责分工，负责组织查处非法生产、销售、购买、储存、运输、邮寄、使用民用爆炸物品的行为。
The competent department of the civil explosives industry, the public security organs, and the administrative departments for industry and commerce shall, according to their respective functions and duties, be responsible for organizing the investigation and punishment of illegal production, sale, purchase, storage, transport, mailing, and use of civil explosives.
民用爆炸物品生产、销售、购买、运输和爆破作业单位(以下称民用爆炸物品从业单位)的主要负责人是本单位民用爆炸物品安全管理责任人，对本单位的民用爆炸物品安全管理工作全面负责。
The principal responsible person of a unit engaged in the production, sale, purchase, transport, and blasting operations of civil explosives (hereinafter referred to as a civil explosives practitioner unit) is the person responsible for the safety management of civil explosives in that unit and shall be fully responsible for the safety management of civil explosives in that unit.
民用爆炸物品从业单位是治安保卫工作的重点单位，应当依法设置治安保卫机构或者配备治安保卫人员，设置技术防范设施，防止民用爆炸物品丢失、被盗、被抢。
Civil explosives practitioner units are key units for security and protection work and shall, in accordance with the law, establish security and protection institutions or assign security and protection personnel, install technical prevention facilities, and prevent the loss, theft, or robbery of civil explosives.
民用爆炸物品从业单位应当建立安全管理制度、岗位安全责任制度，制订安全防范措施和事故应急预案，设置安全管理机构或者配备专职安全管理人员。
Civil explosives practitioner units shall establish safety management systems and post safety responsibility systems, formulate safety prevention measures and accident emergency plans, and set up safety management institutions or assign full-time safety management personnel.
无民事行为能力人、限制民事行为能力人或者曾因犯罪受过刑事处罚的人，不得从事民用爆炸物品的生产、销售、购买、运输和爆破作业。
Persons with no capacity for civil conduct, persons with limited capacity for civil conduct, or persons who have been subjected to criminal punishment due to a crime shall not engage in the production, sale, purchase, transport, and blasting operations of civil explosives.
民用爆炸物品从业单位应当加强对本单位从业人员的安全教育、法制教育和岗位技术培训，从业人员经考核合格的，方可上岗作业；对有资格要求的岗位，应当配备具有相应资格的人员。
Civil explosives practitioner units shall strengthen safety education, legal education, and post technical training for their employees. Employees may only take up posts after passing the assessment; for posts with qualification requirements, personnel with corresponding qualifications shall be assigned.
国家建立民用爆炸物品信息管理系统，对民用爆炸物品实行标识管理，监控民用爆炸物品流向。
The state establishes a civil explosives information management system, implements identification management for civil explosives, and monitors the flow of civil explosives.
民用爆炸物品生产企业、销售企业和爆破作业单位应当建立民用爆炸物品登记制度，如实将本单位生产、销售、购买、运输、储存、使用民用爆炸物品的品种、数量和流向信息输入计算机系统。
Civil explosives production enterprises, sales enterprises, and blasting operation units shall establish a civil explosives registration system and truthfully input into the computer system the varieties, quantities, and flow information of civil explosives produced, sold, purchased, transported, stored, and used by the unit.
任何单位或者个人都有权举报违反民用爆炸物品安全管理规定的行为；接到举报的主管部门、公安机关应当立即查处，并为举报人员保密，对举报有功人员给予奖励。
Any unit or individual has the right to report acts that violate the safety management regulations on civil explosives; the competent department or public security organ that receives the report shall immediately investigate and handle the matter, keep the reporter confidential, and reward those who have rendered meritorious service in reporting.
国家鼓励民用爆炸物品从业单位采用提高民用爆炸物品安全性能的新技术，鼓励发展民用爆炸物品生产、配送、爆破作业一体化的经营模式。
The state encourages civil explosives operating units to adopt new technologies that improve the safety performance of civil explosives, and encourages the development of an integrated business model for the production, distribution, and blasting operations of civil explosives.
生产
Production
设立民用爆炸物品生产企业，应当遵循统筹规划、合理布局的原则。
The establishment of civil explosives production enterprises shall follow the principles of overall planning and rational layout.
申请从事民用爆炸物品生产的企业，应当具备下列条件：
An enterprise applying to engage in the production of civil explosives shall meet the following conditions:
(一)符合国家产业结构规划和产业技术标准；
(1) Comply with the national industrial structure plan and industrial technical standards;
(二)厂房和专用仓库的设计、结构、建筑材料、安全距离以及防火、防爆、防雷、防静电等安全设备、设施符合国家有关标准和规范；
(2) The design, structure, building materials, safety distances, and safety equipment and facilities such as fire prevention, explosion prevention, lightning protection, and static electricity prevention of the factory buildings and dedicated warehouses comply with relevant national standards and specifications;
(三)生产设备、工艺符合有关安全生产的技术标准和规程；
(3) The production equipment and processes comply with relevant technical standards and procedures for safe production;
(四)有具备相应资格的专业技术人员、安全生产管理人员和生产岗位人员；
(4) Have professional and technical personnel, safety production management personnel, and production post personnel with corresponding qualifications;
(五)有健全的安全管理制度、岗位安全责任制度；
(5) Have a sound safety management system and post safety responsibility system.
(六)法律、行政法规规定的其他条件。
(6) Other conditions stipulated by laws and administrative regulations.
申请从事民用爆炸物品生产的企业，应当向国务院民用爆炸物品行业主管部门提交申请书、可行性研究报告以及能够证明其符合本条例第十一条规定条件的有关材料。国务院民用爆炸物品行业主管部门应当自受理申请之日起45日内进行审查，对符合条件的，核发《民用爆炸物品生产许可证》；对不符合条件的，不予核发《民用爆炸物品生产许可证》，书面向申请人说明理由。
An enterprise applying to engage in the production of civil explosives shall submit an application, a feasibility study report, and relevant materials proving that it meets the conditions specified in Article 11 of these Regulations to the competent department of the State Council for the civil explosives industry. The competent department of the State Council for the civil explosives industry shall conduct a review within 45 days from the date of accepting the application. If the conditions are met, it shall issue the "Civil Explosives Production License"; if not, it shall not issue the license and shall provide a written explanation to the applicant.
民用爆炸物品生产企业为调整生产能力及品种进行改建、扩建的，应当依照前款规定申请办理《民用爆炸物品生产许可证》。
If a civil explosives production enterprise carries out reconstruction or expansion to adjust production capacity and varieties, it shall apply for the "Civil Explosives Production License" in accordance with the preceding paragraph.
民用爆炸物品生产企业持《民用爆炸物品生产许可证》到工商行政管理部门办理工商登记，并在办理工商登记后3日内，向所在地县级人民政府公安机关备案。
A civil explosives production enterprise shall, with the "Civil Explosives Production License", go through industrial and commercial registration with the administrative department for industry and commerce, and within 3 days after the registration, file with the local public security organ of the county-level people's government.
取得《民用爆炸物品生产许可证》的企业应当在基本建设完成后，向省、自治区、直辖市人民政府民用爆炸物品行业主管部门申请安全生产许可。省、自治区、直辖市人民政府民用爆炸物品行业主管部门应当依照《安全生产许可证条例》的规定对其进行查验，对符合条件的，核发《民用爆炸物品安全生产许可证》。民用爆炸物品生产企业取得《民用爆炸物品安全生产许可证》后，方可生产民用爆炸物品。
An enterprise that has obtained the "Civil Explosives Production License" shall, after the completion of capital construction, apply to the competent department of the civil explosives industry of the provincial, autonomous region, or directly-administered municipality people's government for a safety production permit. The competent department of the civil explosives industry of the provincial, autonomous region, or directly-administered municipality people's government shall inspect it in accordance with the "Regulations on Safety Production Licenses" and, if the conditions are met, issue the "Civil Explosives Safety Production Permit". A civil explosives production enterprise may only produce civil explosives after obtaining the "Civil Explosives Safety Production Permit".
民用爆炸物品生产企业应当严格按照《民用爆炸物品生产许可证》核定的品种和产量进行生产，生产作业应当严格执行安全技术规程的规定。
A civil explosives production enterprise shall strictly produce according to the varieties and output approved in the "Civil Explosives Production License", and production operations shall strictly comply with the safety technical regulations.
民用爆炸物品生产企业应当对民用爆炸物品做出警示标识、登记标识，对雷管编码打号。民用爆炸物品警示标识、登记标识和雷管编码规则，由国务院公安部门会同国务院民用爆炸物品行业主管部门规定。
A civil explosives production enterprise shall make warning labels and registration marks on civil explosives, and code and number detonators. The rules for warning labels, registration marks, and detonator coding of civil explosives shall be stipulated by the public security department of the State Council jointly with the competent department of the civil explosives industry of the State Council.
民用爆炸物品生产企业应当建立健全产品检验制度，保证民用爆炸物品的质量符合相关标准。民用爆炸物品的包装，应当符合法律、行政法规的规定以及相关标准。
A civil explosives production enterprise shall establish and improve a product inspection system to ensure that the quality of civil explosives meets relevant standards. The packaging of civil explosives shall comply with the provisions of laws, administrative regulations, and relevant standards.
试验或者试制民用爆炸物品，必须在专门场地或者专门的试验室进行。严禁在生产车间或者仓库内试验或者试制民用爆炸物品。
Testing or trial production of civil explosives must be carried out in a dedicated site or a dedicated laboratory. It is strictly prohibited to test or trial produce civil explosives in production workshops or warehouses.
销售和购买
Sale and Purchase
申请从事民用爆炸物品销售的企业，应当具备下列条件：
An enterprise applying to engage in the sale of civil explosives shall meet the following conditions:
(一)符合对民用爆炸物品销售企业规划的要求；
(1) Comply with the requirements for the planning of civil explosives sales enterprises;
(二)销售场所和专用仓库符合国家有关标准和规范；
(2) The sales premises and dedicated warehouses meet relevant national standards and specifications;
(三)有具备相应资格的安全管理人员、仓库管理人员；
(3) Have safety management personnel and warehouse management personnel with appropriate qualifications;
(四)有健全的安全管理制度、岗位安全责任制度；
(4) Have a sound safety management system and post safety responsibility system;
(五)法律、行政法规规定的其他条件。
(5) Other conditions stipulated by laws and administrative regulations.
申请从事民用爆炸物品销售的企业，应当向所在地省、自治区、直辖市人民政府民用爆炸物品行业主管部门提交申请书、可行性研究报告以及能够证明其符合本条例第十八条规定条件的有关材料。省、自治区、直辖市人民政府民用爆炸物品行业主管部门应当自受理申请之日起30日内进行审查，并对申请单位的销售场所和专用仓库等经营设施进行查验，对符合条件的，核发《民用爆炸物品销售许可证》；对不符合条件的，不予核发《民用爆炸物品销售许可证》，书面向申请人说明理由。
An enterprise applying to engage in the sale of civil explosives shall submit an application, a feasibility study report, and relevant materials proving that it meets the conditions specified in Article 18 of these Regulations to the competent department of the civil explosives industry of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located. The competent department of the civil explosives industry of the people's government of the province, autonomous region, or municipality directly under the Central Government shall conduct a review within 30 days from the date of accepting the application, and inspect the sales premises and dedicated warehouses and other business facilities of the applicant unit. If the conditions are met, it shall issue the "Civil Explosives Sales License"; if the conditions are not met, it shall not issue the "Civil Explosives Sales License" and shall explain the reasons to the applicant in writing.
民用爆炸物品销售企业持《民用爆炸物品销售许可证》到工商行政管理部门办理工商登记后，方可销售民用爆炸物品。
A civil explosives sales enterprise may sell civil explosives only after holding the "Civil Explosives Sales License" to go through industrial and commercial registration with the administrative department for industry and commerce.
民用爆炸物品销售企业应当在办理工商登记后3日内，向所在地县级人民政府公安机关备案。
A civil explosives sales enterprise shall, within 3 days after completing the industrial and commercial registration, file a record with the public security organ of the people's government at the county level where it is located.
民用爆炸物品生产企业凭《民用爆炸物品生产许可证》，可以销售本企业生产的民用爆炸物品。
A civil explosives production enterprise may sell the civil explosives produced by itself by virtue of the "Civil Explosives Production License".
民用爆炸物品生产企业销售本企业生产的民用爆炸物品，不得超出核定的品种、产量。
An enterprise producing civil explosive materials that sells the civil explosive materials it produces shall not exceed the approved varieties and output.
民用爆炸物品使用单位申请购买民用爆炸物品的，应当向所在地县级人民政府公安机关提出购买申请，并提交下列有关材料：
A unit using civil explosive materials that applies to purchase civil explosive materials shall submit a purchase application to the public security organ of the people's government at the county level where it is located, and provide the following relevant materials:
(一)工商营业执照或者事业单位法人证书；
(1) Business license or legal person certificate of public institution;
(二)《爆破作业单位许可证》或者其他合法使用的证明；
(2) Blasting Operation Unit Permit or other legal use certificate;
(三)购买单位的名称、地址、银行账户；
(3) Name, address, and bank account of the purchasing unit;
(四)购买的品种、数量和用途说明。
(4) Description of the varieties, quantities, and purposes of the purchase.
受理申请的公安机关应当自受理申请之日起5日内对提交的有关材料进行审查，对符合条件的，核发《民用爆炸物品购买许可证》；对不符合条件的，不予核发《民用爆炸物品购买许可证》，书面向申请人说明理由。
The public security organ that accepts the application shall review the submitted materials within 5 days from the date of acceptance. For those that meet the conditions, it shall issue the Civil Explosive Materials Purchase License; for those that do not meet the conditions, it shall not issue the Civil Explosive Materials Purchase License and shall explain the reasons in writing to the applicant.
《民用爆炸物品购买许可证》应当载明许可购买的品种、数量、购买单位以及许可的有效期限。
The Civil Explosive Materials Purchase License shall specify the approved varieties, quantities, purchasing unit, and the validity period of the license.
民用爆炸物品生产企业凭《民用爆炸物品生产许可证》购买属于民用爆炸物品的原料，民用爆炸物品销售企业凭《民用爆炸物品销售许可证》向民用爆炸物品生产企业购买民用爆炸物品，民用爆炸物品使用单位凭《民用爆炸物品购买许可证》购买民用爆炸物品，还应当提供经办人的身份证明。
A civil explosive materials production enterprise shall purchase raw materials that are civil explosive materials with the Civil Explosive Materials Production License; a civil explosive materials sales enterprise shall purchase civil explosive materials from a civil explosive materials production enterprise with the Civil Explosive Materials Sales License; a civil explosive materials using unit shall purchase civil explosive materials with the Civil Explosive Materials Purchase License, and shall also provide the identity certificate of the handler.
销售民用爆炸物品的企业，应当查验前款规定的许可证和经办人的身份证明；对持《民用爆炸物品购买许可证》购买的，应当按照许可的品种、数量销售。
An enterprise selling civil explosive materials shall verify the licenses specified in the preceding paragraph and the identity certificate of the handler; for purchases made with the Civil Explosive Materials Purchase License, it shall sell according to the approved varieties and quantities.
销售、购买民用爆炸物品，应当通过银行账户进行交易，不得使用现金或者实物进行交易。
Sales and purchases of civil explosives shall be conducted through bank accounts, and cash or physical goods shall not be used for transactions.
销售民用爆炸物品的企业，应当将购买单位的许可证、银行账户转账凭证、经办人的身份证明复印件保存2年备查。
Enterprises selling civil explosives shall keep copies of the purchasing unit's permit, bank account transfer voucher, and the agent's identity document for two years for future reference.
销售民用爆炸物品的企业，应当自民用爆炸物品买卖成交之日起3日内，将销售的品种、数量和购买单位向所在地省、自治区、直辖市人民政府民用爆炸物品行业主管部门和所在地县级人民政府公安机关备案。
Enterprises selling civil explosives shall, within three days from the date of transaction, file the types and quantities sold and the purchasing unit with the competent department of civil explosives industry of the provincial-level people's government and the public security organ of the county-level people's government at the place of sale.
购买民用爆炸物品的单位，应当自民用爆炸物品买卖成交之日起3日内，将购买的品种、数量向所在地县级人民政府公安机关备案。
Units purchasing civil explosives shall, within three days from the date of transaction, file the types and quantities purchased with the public security organ of the county-level people's government at the place of purchase.
进出口民用爆炸物品，应当经国务院民用爆炸物品行业主管部门审批。进出口民用爆炸物品审批办法，由国务院民用爆炸物品行业主管部门会同国务院公安部门、海关总署规定。
Import and export of civil explosives shall be subject to approval by the competent department of civil explosives industry of the State Council. The measures for approving the import and export of civil explosives shall be formulated by the competent department of civil explosives industry of the State Council jointly with the public security department of the State Council and the General Administration of Customs.
进出口单位应当将进出口的民用爆炸物品的品种、数量向收货地或者出境口岸所在地县级人民政府公安机关备案。
Import and export units shall file the types and quantities of civil explosives imported or exported with the public security organ of the county-level people's government at the place of receipt or the port of departure.
运输
Transportation
运输民用爆炸物品，收货单位应当向运达地县级人民政府公安机关提出申请，并提交包括下列内容的材料：
To transport civil explosives, the receiving unit shall apply to the public security organ of the county-level people's government at the place of destination and submit materials including the following:
(一)民用爆炸物品生产企业、销售企业、使用单位以及进出口单位分别提供的《民用爆炸物品生产许可证》、《民用爆炸物品销售许可证》、《民用爆炸物品购买许可证》或者进出口批准证明；
(1) The Civil Explosives Production Permit, Civil Explosives Sales Permit, Civil Explosives Purchase Permit, or import/export approval certificate provided by the civil explosives production enterprise, sales enterprise, user unit, or import/export unit respectively;
(二)运输民用爆炸物品的品种、数量、包装材料和包装方式；
(2) The types, quantities, packaging materials, and packaging methods of the civil explosives to be transported;
(三)运输民用爆炸物品的特性、出现险情的应急处置方法；
(3) Characteristics of civil explosives being transported and emergency response methods for dangerous situations;
(四)运输时间、起始地点、运输路线、经停地点。
(4) Transport time, starting location, transport route, and stopping points.
受理申请的公安机关应当自受理申请之日起3日内对提交的有关材料进行审查，对符合条件的，核发《民用爆炸物品运输许可证》；对不符合条件的，不予核发《民用爆炸物品运输许可证》，书面向申请人说明理由。
The public security organ accepting the application shall review the submitted materials within 3 days from the date of acceptance. For those meeting the conditions, it shall issue the "Civil Explosives Transport Permit"; for those not meeting the conditions, it shall not issue the permit and shall explain the reasons in writing to the applicant.
《民用爆炸物品运输许可证》应当载明收货单位、销售企业、承运人，一次性运输有效期限、起始地点、运输路线、经停地点，民用爆炸物品的品种、数量。
The "Civil Explosives Transport Permit" shall specify the consignee, sales enterprise, carrier, one-time transport validity period, starting location, transport route, stopping points, and the type and quantity of civil explosives.
运输民用爆炸物品的，应当凭《民用爆炸物品运输许可证》，按照许可的品种、数量运输。
When transporting civil explosives, the transport shall be carried out with the "Civil Explosives Transport Permit" and in accordance with the permitted type and quantity.
经由道路运输民用爆炸物品的，应当遵守下列规定：
When transporting civil explosives by road, the following provisions shall be complied with:
(一)携带《民用爆炸物品运输许可证》；
(1) Carry the "Civil Explosives Transport Permit";
(二)民用爆炸物品的装载符合国家有关标准和规范，车厢内不得载人；
(2) The loading of civil explosives shall comply with relevant national standards and specifications, and no persons shall be carried in the cargo compartment;
(三)运输车辆安全技术状况应当符合国家有关安全技术标准的要求，并按照规定悬挂或者安装符合国家标准的易燃易爆危险物品警示标志；
(3) The safety technical condition of the transport vehicle shall meet the requirements of relevant national safety technical standards, and shall be marked with warning signs for flammable and explosive dangerous goods that meet national standards as required;
(四)运输民用爆炸物品的车辆应当保持安全车速；
(4) Vehicles transporting civil explosives shall maintain a safe speed;
(五)按照规定的路线行驶，途中经停应当有专人看守，并远离建筑设施和人口稠密的地方，不得在许可以外的地点经停；
(5) Travel along the prescribed route; any stopovers during the journey must be guarded by a dedicated person, kept away from buildings and densely populated areas, and shall not be made at locations not permitted;
(六)按照安全操作规程装卸民用爆炸物品，并在装卸现场设置警戒，禁止无关人员进入；
(6) Load and unload civil explosives in accordance with safe operating procedures, set up aalert (security cordon) at the loading and unloading site, and prohibit unauthorized personnel from entering;
(七)出现危险情况立即采取必要的应急处置措施，并报告当地公安机关。
(7) In the event of a dangerous situation, immediately take necessary emergency response measures and report to the local public security organ.
民用爆炸物品运达目的地，收货单位应当进行验收后在《民用爆炸物品运输许可证》上签注，并在3日内将《民用爆炸物品运输许可证》交回发证机关核销。
Upon arrival of civil explosives at the destination, the receiving unit shall conduct an inspection, endorse the 'Civil Explosives Transport Permit', and return the permit to the issuing authority for cancellation within 3 days.
禁止携带民用爆炸物品搭乘公共交通工具或者进入公共场所。
It is prohibited to carry civil explosives on public transportation or enter public places with them.
禁止邮寄民用爆炸物品，禁止在托运的货物、行李、包裹、邮件中夹带民用爆炸物品。
It is prohibited to mail civil explosives, and it is prohibited to conceal civil explosives in consigned goods, luggage, parcels, or mail.
爆破作业
Blasting Operations
申请从事爆破作业的单位，应当具备下列条件：
A unit applying to engage in blasting operations shall meet the following conditions:
(一)爆破作业属于合法的生产活动；
(1) The blasting operation is a lawful production activity;
(二)有符合国家有关标准和规范的民用爆炸物品专用仓库；
(2) Possession of a dedicated warehouse for civil explosives that meets relevant national standards and specifications;
(三)有具备相应资格的安全管理人员、仓库管理人员和具备国家规定执业资格的爆破作业人员；
(3) Having safety management personnel, warehouse management personnel with appropriate qualifications, and blasting operation personnel with nationally prescribed professional qualifications;
(四)有健全的安全管理制度、岗位安全责任制度；
(4) Having a sound safety management system and post safety responsibility system;
(五)有符合国家标准、行业标准的爆破作业专用设备；
(5) Having special equipment for blasting operations that meets national standards and industry standards;
(六)法律、行政法规规定的其他条件。
(6) Other conditions stipulated by laws and administrative regulations.
申请从事爆破作业的单位，应当按照国务院公安部门的规定，向有关人民政府公安机关提出申请，并提供能够证明其符合本条例第三十一条规定条件的有关材料。受理申请的公安机关应当自受理申请之日起20日内进行审查，对符合条件的，核发《爆破作业单位许可证》；对不符合条件的，不予核发《爆破作业单位许可证》，书面向申请人说明理由。
A unit applying to engage in blasting operations shall, in accordance with the provisions of the public security department of the State Council, submit an application to the relevant people's government public security organ and provide relevant materials proving that it meets the conditions stipulated in Article 31 of these Regulations. The public security organ that accepts the application shall conduct a review within 20 days from the date of accepting the application. For those that meet the conditions, it shall issue a "Blasting Operation Unit Permit"; for those that do not meet the conditions, it shall not issue the permit and shall explain the reasons in writing to the applicant.
营业性爆破作业单位持《爆破作业单位许可证》到工商行政管理部门办理工商登记后，方可从事营业性爆破作业活动。
A commercial blasting operation unit may engage in commercial blasting operations only after holding the "Blasting Operation Unit Permit" to go through industrial and commercial registration with the administrative department for industry and commerce.
爆破作业单位应当在办理工商登记后3日内，向所在地县级人民政府公安机关备案。
A blasting operation unit shall, within 3 days after completing industrial and commercial registration, file a record with the local county-level people's government public security organ.
爆破作业单位应当对本单位的爆破作业人员、安全管理人员、仓库管理人员进行专业技术培训。爆破作业人员应当经设区的市级人民政府公安机关考核合格，取得《爆破作业人员许可证》后，方可从事爆破作业。
A blasting operation unit shall provide professional technical training to its blasting operation personnel, safety management personnel, and warehouse management personnel. Blasting operation personnel may engage in blasting operations only after passing the assessment by the public security organ of the city divided into districts and obtaining the "Blasting Operation Personnel Permit".
爆破作业单位应当按照其资质等级承接爆破作业项目，爆破作业人员应当按照其资格等级从事爆破作业。爆破作业的分级管理办法由国务院公安部门规定。
A blasting operation unit shall undertake blasting operation projects in accordance with its qualification grade, and blasting operation personnel shall engage in blasting operations in accordance with their qualification grade. The graded management method for blasting operations shall be stipulated by the public security department of the State Council.
在城市、风景名胜区和重要工程设施附近实施爆破作业的，应当向爆破作业所在地设区的市级人民政府公安机关提出申请，提交《爆破作业单位许可证》和具有相应资质的安全评估企业出具的爆破设计、施工方案评估报告。受理申请的公安机关应当自受理申请之日起20日内对提交的有关材料进行审查，对符合条件的，作出批准的决定；对不符合条件的，作出不予批准的决定，并书面向申请人说明理由。
When conducting blasting operations near cities, scenic spots, and important engineering facilities, an application shall be submitted to the public security organ of the city divided into districts where the blasting operation is located, along with the "Blasting Operation Unit Permit" and an assessment report of the blasting design and construction plan issued by a safety assessment enterprise with corresponding qualifications. The public security organ that accepts the application shall review the submitted materials within 20 days from the date of accepting the application. For those that meet the conditions, it shall make a decision to approve; for those that do not meet the conditions, it shall make a decision not to approve and explain the reasons in writing to the applicant.
实施前款规定的爆破作业，应当由具有相应资质的安全监理企业进行监理，由爆破作业所在地县级人民政府公安机关负责组织实施安全警戒。
When carrying out the blasting operations specified in the preceding paragraph, a qualified safety supervision enterprise shall conduct supervision, and the public security organ of the people's government at the county level where the blasting operation is located shall be responsible for organizing and implementing safetyalert.
爆破作业单位跨省、自治区、直辖市行政区域从事爆破作业的，应当事先将爆破作业项目的有关情况向爆破作业所在地县级人民政府公安机关报告。
A blasting operation unit that engages in blasting operations across provinces, autonomous regions, or municipalities directly under the Central Government shall report the relevant information of the blasting operation project in advance to the public security organ of the people's government at the county level where the blasting operation is located.
爆破作业单位应当如实记载领取、发放民用爆炸物品的品种、数量、编号以及领取、发放人员姓名。领取民用爆炸物品的数量不得超过当班用量，作业后剩余的民用爆炸物品必须当班清退回库。
A blasting operation unit shall truthfully record the variety, quantity, and serial numbers of civil explosives received and issued, as well as the names of the personnel receiving and issuing them. The quantity of civil explosives received shall not exceed the amount needed for the current shift, and any remaining civil explosives after the operation must be returned to the warehouse for storage within the same shift.
爆破作业单位应当将领取、发放民用爆炸物品的原始记录保存2年备查。
A blasting operation unit shall keep the original records of the receipt and issuance of civil explosives for two years for future reference.
实施爆破作业，应当遵守国家有关标准和规范，在安全距离以外设置警示标志并安排警戒人员，防止无关人员进入；爆破作业结束后应当及时检查、排除未引爆的民用爆炸物品。
When carrying out blasting operations, relevant national standards and specifications shall be observed, warning signs shall be set up beyond a safe distance, andalert personnel shall be arranged to prevent unrelated personnel from entering. After the blasting operation, a timely inspection shall be conducted to check for and remove any unexploded civil explosives.
爆破作业单位不再使用民用爆炸物品时，应当将剩余的民用爆炸物品登记造册，报所在地县级人民政府公安机关组织监督销毁。
When a blasting operation unit no longer uses civil explosives, it shall register the remaining civil explosives in a ledger and report to the public security organ of the people's government at the county level where it is located for organized supervision of destruction.
发现、拣拾无主民用爆炸物品的，应当立即报告当地公安机关。
If any ownerless civil explosives are discovered or picked up, the local public security organ shall be immediately reported.
储存
Storage
民用爆炸物品应当储存在专用仓库内，并按照国家规定设置技术防范设施。
Civil explosives shall be stored in dedicated warehouses, and technical prevention facilities shall be installed in accordance with national regulations.
储存民用爆炸物品应当遵守下列规定：
The storage of civil explosives shall comply with the following provisions:
(一)建立出入库检查、登记制度，收存和发放民用爆炸物品必须进行登记，做到账目清楚，账物相符；
(1) Establish a check-in and check-out registration system; receipt and issuance of civil explosives must be recorded to ensure clear accounts and consistency between accounts and physical inventory.
(二)储存的民用爆炸物品数量不得超过储存设计容量，对性质相抵触的民用爆炸物品必须分库储存，严禁在库房内存放其他物品；
(2) The quantity of stored civil explosives shall not exceed the designed storage capacity; civil explosives with conflicting properties must be stored in separate warehouses, and it is strictly prohibited to store other items in the warehouse.
(三)专用仓库应当指定专人管理、看护，严禁无关人员进入仓库区内，严禁在仓库区内吸烟和用火，严禁把其他容易引起燃烧、爆炸的物品带入仓库区内，严禁在库房内住宿和进行其他活动；
(3) Dedicated warehouses shall be managed and guarded by designated personnel; unauthorized persons are strictly prohibited from entering the warehouse area; smoking and using fire are strictly prohibited in the warehouse area; it is strictly prohibited to bring any other items that may easily cause combustion or explosion into the warehouse area; it is strictly prohibited to stay overnight or engage in other activities in the warehouse.
(四)民用爆炸物品丢失、被盗、被抢，应当立即报告当地公安机关。
(4) If civil explosives are lost, stolen, or robbed, the local public security organ shall be immediately reported.
在爆破作业现场临时存放民用爆炸物品的，应当具备临时存放民用爆炸物品的条件，并设专人管理、看护，不得在不具备安全存放条件的场所存放民用爆炸物品。
When temporarily storing civil explosives at a blasting operation site, conditions for temporary storage of civil explosives shall be met, and designated personnel shall be assigned to manage and guard them; civil explosives shall not be stored in places that do not have safe storage conditions.
民用爆炸物品变质和过期失效的，应当及时清理出库，并予以销毁。销毁前应当登记造册，提出销毁实施方案，报省、自治区、直辖市人民政府民用爆炸物品行业主管部门、所在地县级人民政府公安机关组织监督销毁。
Civil explosives that have deteriorated or expired shall be promptly cleared out of the warehouse and destroyed. Before destruction, a register shall be made, and a destruction implementation plan shall be submitted to the competent department of the civil explosives industry of the provincial, autonomous region, or municipality directly under the Central Government, and the public security organ of the county-level people's government where the explosives are located shall organize and supervise the destruction.
法律责任
Legal Liability
非法制造、买卖、运输、储存民用爆炸物品，构成犯罪的，依法追究刑事责任；尚不构成犯罪，有违反治安管理行为的，依法给予治安管理处罚。
Whoever illegally manufactures, buys, sells, transports, or stores civil explosives, if constituting a crime, shall be investigated for criminal liability according to law; if it does not constitute a crime but violates public security management, shall be given a public security penalty according to law.
违反本条例规定，在生产、储存、运输、使用民用爆炸物品中发生重大事故，造成严重后果或者后果特别严重，构成犯罪的，依法追究刑事责任。
Whoever, in violation of these Regulations, causes a major accident in the production, storage, transportation, or use of civil explosives, resulting in serious consequences or particularly serious consequences, if constituting a crime, shall be investigated for criminal liability according to law.
违反本条例规定，未经许可生产、销售民用爆炸物品的，由民用爆炸物品行业主管部门责令停止非法生产、销售活动，处10万元以上50万元以下的罚款，并没收非法生产、销售的民用爆炸物品及其违法所得。
Whoever, in violation of these Regulations, produces or sells civil explosives without permission shall be ordered by the competent department of the civil explosives industry to cease the illegal production or sales activities, fined not less than 100,000 yuan but not more than 500,000 yuan, and the illegally produced or sold civil explosives and illegal gains shall be confiscated.
违反本条例规定，未经许可购买、运输民用爆炸物品或者从事爆破作业的，由公安机关责令停止非法购买、运输、爆破作业活动，处5万元以上20万元以下的罚款，并没收非法购买、运输以及从事爆破作业使用的民用爆炸物品及其违法所得。
Whoever, in violation of these Regulations, purchases, transports civil explosives or engages in blasting operations without permission shall be ordered by the public security organ to cease the illegal purchase, transport, or blasting activities, and shall be fined not less than 50,000 yuan but not more than 200,000 yuan, and the illegally purchased, transported, or used civil explosives and illegal gains shall be confiscated.
民用爆炸物品行业主管部门、公安机关对没收的非法民用爆炸物品，应当组织销毁。
The competent department of the civil explosives industry and the public security organ shall organize the destruction of the confiscated illegal civil explosives.
违反本条例规定，生产、销售民用爆炸物品的企业有下列行为之一的，由民用爆炸物品行业主管部门责令限期改正，处10万元以上50万元以下的罚款；逾期不改正的，责令停产停业整顿；情节严重的，吊销《民用爆炸物品生产许可证》或者《民用爆炸物品销售许可证》：
Where an enterprise that produces or sells civil explosives, in violation of these Regulations, commits any of the following acts, the competent department of the civil explosives industry shall order it to make corrections within a time limit, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if it fails to make corrections within the time limit, it shall be ordered to suspend production or business for rectification; if the circumstances are serious, the Civil Explosives Production License or the Civil Explosives Sales License shall be revoked:
(一)超出生产许可的品种、产量进行生产、销售的；
(1) Producing or selling beyond the permitted variety or quantity;
(二)违反安全技术规程生产作业的；
(2) Conducting production operations in violation of safety technical regulations;
(三)民用爆炸物品的质量不符合相关标准的；
(3) The quality of civil explosives does not meet the relevant standards;
(四)民用爆炸物品的包装不符合法律、行政法规的规定以及相关标准的；
(4) The packaging of civil explosives does not comply with the provisions of laws, administrative regulations, and relevant standards;
(五)超出购买许可的品种、数量销售民用爆炸物品的；
(5) Selling civil explosives beyond the permitted variety or quantity of the purchase permit;
(六)向没有《民用爆炸物品生产许可证》、《民用爆炸物品销售许可证》、《民用爆炸物品购买许可证》的单位销售民用爆炸物品的；
(6) Selling civil explosives to units that do not have the Civil Explosives Production License, the Civil Explosives Sales License, or the Civil Explosives Purchase License;
(七)民用爆炸物品生产企业销售本企业生产的民用爆炸物品未按照规定向民用爆炸物品行业主管部门备案的；
(7) A civil explosives production enterprise that sells civil explosives produced by itself fails to file with the competent department of the civil explosives industry as required.
(八)未经审批进出口民用爆炸物品的。
(8) Importing or exporting civil explosives without approval.
违反本条例规定，有下列情形之一的，由公安机关责令限期改正，处5万元以上20万元以下的罚款；逾期不改正的，责令停产停业整顿：
In violation of these regulations, under any of the following circumstances, the public security organ shall order correction within a specified period and impose a fine of not less than 50,000 yuan but not more than 200,000 yuan; if correction is not made within the time limit, order suspension of production or business for rectification:
(一)未按照规定对民用爆炸物品做出警示标识、登记标识或者未对雷管编码打号的；
(1) Failing to affix warning marks or registration marks on civil explosives as required, or failing to code and mark detonators;
(二)超出购买许可的品种、数量购买民用爆炸物品的；
(2) Purchasing civil explosives beyond the varieties or quantities specified in the purchase permit;
(三)使用现金或者实物进行民用爆炸物品交易的；
(3) Using cash or physical goods for transactions of civil explosives;
(四)未按照规定保存购买单位的许可证、银行账户转账凭证、经办人的身份证明复印件的；
(4) Failing to keep copies of the purchaser's permit, bank account transfer voucher, and identity certificate of the handler as required;
(五)销售、购买、进出口民用爆炸物品，未按照规定向公安机关备案的；
(5) Selling, purchasing, importing, or exporting civil explosives without filing with the public security organ as required;
(六)未按照规定建立民用爆炸物品登记制度，如实将本单位生产、销售、购买、运输、储存、使用民用爆炸物品的品种、数量和流向信息输入计算机系统的；
(6) Failing to establish a civil explosives registration system as required, and failing to truthfully input into the computer system the varieties, quantities, and flow information of the civil explosives produced, sold, purchased, transported, stored, or used by the unit;
(七)未按照规定将《民用爆炸物品运输许可证》交回发证机关核销的。
(7) Failing to return the "Civil Explosives Transport Permit" to the issuing authority for cancellation as required.
违反本条例规定，经由道路运输民用爆炸物品，有下列情形之一的，由公安机关责令改正，处5万元以上20万元以下的罚款：
In violation of these regulations, when transporting civil explosives by road, under any of the following circumstances, the public security organ shall order correction and impose a fine of not less than 50,000 yuan but not more than 200,000 yuan:
(一)违反运输许可事项的；
(1) Violating the transport permit requirements;
(二)未携带《民用爆炸物品运输许可证》的；
(2) Not carrying the 'Civil Explosives Transport Permit';
(三)违反有关标准和规范混装民用爆炸物品的；
(3) Mixing civil explosives in violation of relevant standards and specifications;
(四)运输车辆未按照规定悬挂或者安装符合国家标准的易燃易爆危险物品警示标志的；
(4) The transport vehicle failing to display or install warning signs for inflammable and explosive dangerous goods that comply with national standards as required;
(五)未按照规定的路线行驶，途中经停没有专人看守或者在许可以外的地点经停的；
(5) Not traveling on the prescribed route, stopping en route without dedicated personnel on guard, or stopping at locations not permitted;
(六)装载民用爆炸物品的车厢载人的；
(6) Carrying persons in the compartment loaded with civil explosives;
(七)出现危险情况未立即采取必要的应急处置措施、报告当地公安机关的。
(7) Failing to immediately take necessary emergency response measures and report to the local public security organ when a dangerous situation occurs.
违反本条例规定，从事爆破作业的单位有下列情形之一的，由公安机关责令停止违法行为或者限期改正，处10万元以上50万元以下的罚款；逾期不改正的，责令停产停业整顿；情节严重的，吊销《爆破作业单位许可证》：
In violation of these Regulations, if a unit engaged in blasting operations falls under any of the following circumstances, the public security organ shall order it to cease the illegal act or rectify within a time limit, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if it fails to rectify within the time limit, it shall be ordered to suspend production or business for rectification; if the circumstances are serious, the 'Blasting Operation Unit Permit' shall be revoked:
(一)爆破作业单位未按照其资质等级从事爆破作业的；
(1) The blasting operation unit fails to conduct blasting operations in accordance with its qualification grade;
(二)营业性爆破作业单位跨省、自治区、直辖市行政区域实施爆破作业，未按照规定事先向爆破作业所在地的县级人民政府公安机关报告的；
(2) A commercial blasting operation unit carries out blasting operations across provinces, autonomous regions, or municipalities directly under the Central Government without reporting in advance to the public security organ of the county-level people's government where the blasting operation is located as required.
(三)爆破作业单位未按照规定建立民用爆炸物品领取登记制度、保存领取登记记录的；
(3) The blasting unit fails to establish a civil explosives collection registration system or fails to keep collection registration records as required;
(四)违反国家有关标准和规范实施爆破作业的。
(4) Implementing blasting operations in violation of relevant national standards and specifications.
爆破作业人员违反国家有关标准和规范的规定实施爆破作业的，由公安机关责令限期改正，情节严重的，吊销《爆破作业人员许可证》。
If a blasting operator implements blasting operations in violation of relevant national standards and specifications, the public security organ shall order correction within a time limit; if the circumstances are serious, the Blasting Operator Permit shall be revoked.
违反本条例规定，有下列情形之一的，由民用爆炸物品行业主管部门、公安机关按照职责责令限期改正，可以并处5万元以上20万元以下的罚款；逾期不改正的，责令停产停业整顿；情节严重的，吊销许可证：
In violation of these Regulations, under any of the following circumstances, the competent department of the civil explosives industry or the public security organ shall, within their respective responsibilities, order correction within a time limit and may concurrently impose a fine of not less than 50,000 yuan but not more than 200,000 yuan; if correction is not made within the time limit, production and business operations shall be ordered to suspend for rectification; if the circumstances are serious, the permit shall be revoked:
(一)未按照规定在专用仓库设置技术防范设施的；
(1) Failing to install technical prevention facilities in the dedicated warehouse as required;
(二)未按照规定建立出入库检查、登记制度或者收存和发放民用爆炸物品，致使账物不符的；
(2) Failing to establish a warehouse entry-exit inspection and registration system as required, or failing to store and issue civil explosives in a manner that results in discrepancies between accounts and actual items;
(三)超量储存、在非专用仓库储存或者违反储存标准和规范储存民用爆炸物品的；
(3) Storing excessive quantities, storing in non-dedicated warehouses, or storing civil explosives in violation of storage standards and specifications;
(四)有本条例规定的其他违反民用爆炸物品储存管理规定行为的。
(4) Other acts violating the provisions on the storage management of civil explosives as stipulated in these Regulations.
违反本条例规定，民用爆炸物品从业单位有下列情形之一的，由公安机关处2万元以上10万元以下的罚款；情节严重的，吊销其许可证；有违反治安管理行为的，依法给予治安管理处罚：
In violation of these Regulations, if a civil explosives business unit falls under any of the following circumstances, the public security organ shall impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; if the circumstances are serious, its permit shall be revoked; if there is a violation of public security administration, public security administration penalties shall be imposed according to law:
(一)违反安全管理制度，致使民用爆炸物品丢失、被盗、被抢的；
(1) Violating safety management systems, resulting in the loss, theft, or robbery of civil explosives;
(二)民用爆炸物品丢失、被盗、被抢，未按照规定向当地公安机关报告或者故意隐瞒不报的；
(2) Where civil explosives are lost, stolen, or robbed, and the matter is not reported to the local public security authority as required, or is intentionally concealed;
(三)转让、出借、转借、抵押、赠送民用爆炸物品的。
(3) Transferring, lending, subletting, mortgaging, or giving away civil explosives.
违反本条例规定，携带民用爆炸物品搭乘公共交通工具或者进入公共场所，邮寄或者在托运的货物、行李、包裹、邮件中夹带民用爆炸物品，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，由公安机关依法给予治安管理处罚，没收非法的民用爆炸物品，处1000元以上1万元以下的罚款。
Whoever, in violation of these Regulations, carries civil explosives on public transport or enters public places with them, or mails or conceals civil explosives in consigned goods, luggage, parcels, or mail, if constituting a crime, shall be investigated for criminal liability according to law; if not constituting a crime, the public security authority shall impose a public security penalty according to law, confiscate the illegal civil explosives, and impose a fine of not less than 1,000 yuan but not more than 10,000 yuan.
民用爆炸物品从业单位的主要负责人未履行本条例规定的安全管理责任，导致发生重大伤亡事故或者造成其他严重后果，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，对主要负责人给予撤职处分，对个人经营的投资人处2万元以上20万元以下的罚款。
If the principal responsible person of a civil explosives business unit fails to perform the safety management responsibilities stipulated in these Regulations, resulting in a major casualty accident or other serious consequences, if constituting a crime, criminal liability shall be investigated according to law; if not constituting a crime, the principal responsible person shall be removed from office, and the individual investor shall be fined not less than 20,000 yuan but not more than 200,000 yuan.
民用爆炸物品行业主管部门、公安机关、工商行政管理部门的工作人员，在民用爆炸物品安全监督管理工作中滥用职权、玩忽职守或者徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。
If staff members of the competent department of the civil explosives industry, the public security authority, or the administrative department for industry and commerce abuse their power, neglect their duty, or engage in malpractice for personal gain in the safety supervision and management of civil explosives, if constituting a crime, criminal liability shall be investigated according to law; if not constituting a crime, administrative sanctions shall be imposed according to law.
附则
Supplementary Provisions
《民用爆炸物品生产许可证》、《民用爆炸物品销售许可证》，由国务院民用爆炸物品行业主管部门规定式样；《民用爆炸物品购买许可证》、《民用爆炸物品运输许可证》、《爆破作业单位许可证》、《爆破作业人员许可证》，由国务院公安部门规定式样。
The format of the 'Civil Explosives Production License' and the 'Civil Explosives Sales License' shall be prescribed by the competent department of the civil explosives industry of the State Council; the format of the 'Civil Explosives Purchase License', the 'Civil Explosives Transport License', the 'Blasting Operation Unit License', and the 'Blasting Operator License' shall be prescribed by the public security department of the State Council.
本条例自2006年9月1日起施行。1984年1月6日国务院发布的《中华人民共和国民用爆炸物品管理条例》同时废止。
These Regulations shall come into force as of September 1, 2006. The 'Regulations of the People's Republic of China on the Management of Civil Explosives' promulgated by the State Council on January 6, 1984 shall be repealed simultaneously.
