为了加强长江河道采砂管理，维护长江河势稳定，保障防洪和通航安全，制定本条例。
These Regulations are formulated to strengthen the management of sand mining in the Yangtze River channel, maintain the stability of the Yangtze River regime, and ensure flood control and navigation safety.
在长江宜宾以下干流河道内从事开采砂石(以下简称长江采砂)及其管理活动的，应当遵守本条例。
Those engaged in the extraction of sand and gravel (hereinafter referred to as Yangtze River sand mining) and related management activities in the main stream of the Yangtze River below Yibin shall comply with these Regulations.
国务院水行政主管部门及其所属的长江水利委员会应当加强对长江采砂的统一管理和监督检查，并做好有关组织、协调和指导工作。
The water administrative department of the State Council and its subordinate Yangtze River Water Resources Commission shall strengthen unified management and supervision over Yangtze River sand mining, and carry out relevant organization, coordination, and guidance work.
长江采砂管理，实行地方人民政府行政首长负责制。沿江县级以上地方人民政府应当加强对本行政区域内长江采砂活动的管理，做好长江采砂的组织、协调和监督检查工作。
The management of Yangtze River sand mining shall implement the responsibility system of the administrative head of the local people's government. The local people's governments at or above the county level along the river shall strengthen the management of sand mining activities within their administrative regions, and carry out the organization, coordination, and supervision of Yangtze River sand mining.
沿江县级以上地方人民政府水行政主管部门依照本条例的规定，具体负责本行政区域内长江采砂的管理和监督检查工作。
The water administrative departments of local people's governments at or above the county level along the river shall, in accordance with these Regulations, be specifically responsible for the management and supervision of Yangtze River sand mining within their administrative regions.
国务院交通行政主管部门所属的长江航务管理局负责长江航道管理工作，长江海事机构负责长江交通安全的监督管理工作。公安部门负责长江水上治安管理工作，依法打击长江采砂活动中的犯罪行为。
The Yangtze River Navigation Administration under the transportation administrative department of the State Council shall be responsible for the management of the Yangtze River channel, and the Yangtze River maritime authorities shall be responsible for the supervision and management of navigation safety on the Yangtze River. The public security departments shall be responsible for the public security management on the Yangtze River waters and shall crack down on criminal activities in Yangtze River sand mining according to law.
国家对长江采砂实行统一规划制度。
The State implements a unified planning system for Yangtze River sand mining.
长江采砂规划由长江水利委员会会同四川省、湖北省、湖南省、江西省、安徽省、江苏省和重庆市、上海市人民政府水行政主管部门编制，经征求长江航务管理局和长江海事机构意见后，报国务院水行政主管部门批准。国务院水行政主管部门批准前，应当征求国务院交通行政主管部门的意见。
The Yangtze River sand mining plan shall be prepared by the Yangtze River Water Resources Commission jointly with the water administrative departments of the people's governments of Sichuan Province, Hubei Province, Hunan Province, Jiangxi Province, Anhui Province, Jiangsu Province, Chongqing Municipality, and Shanghai Municipality. After soliciting opinions from the Yangtze River Navigation Administration and the Yangtze River maritime authorities, it shall be submitted to the water administrative department of the State Council for approval. Before approval, the water administrative department of the State Council shall solicit opinions from the transportation administrative department of the State Council.
长江采砂规划一经批准，必须严格执行；确需修改时，应当依照前款规定批准。
Once approved, the Yangtze River sand mining plan must be strictly implemented; if modification is necessary, it shall be approved in accordance with the provisions of the preceding paragraph.
长江采砂规划批准实施前，长江水利委员会可以会同沿江省、直辖市人民政府水行政主管部门、长江航务管理局和长江海事机构确定禁采区和禁采期，报国务院水行政主管部门批准。
Before the Yangtze River sand mining plan is approved and implemented, the Yangtze River Water Resources Commission may, jointly with the water administrative departments of the people's governments of the provinces and municipalities directly under the Central Government along the river, the Yangtze River Navigation Administration, and the Yangtze River maritime authorities, determine prohibited mining areas and prohibited mining periods, and report to the water administrative department of the State Council for approval.
长江采砂规划应当充分考虑长江防洪安全和通航安全的要求，符合长江流域综合规划和长江防洪、河道整治以及航道整治等专业规划。
The Yangtze River sand mining plan shall fully consider the requirements of flood control safety and navigation safety of the Yangtze River, and shall conform to the comprehensive plan of the Yangtze River basin and specialized plans such as flood control, river regulation, and channel regulation of the Yangtze River.
长江采砂规划应当包括下列内容：
The Yangtze River sand mining plan shall include the following contents:
(一)禁采区和可采区；
(1) Prohibited mining areas and permissible mining areas;
(二)禁采期和可采期；
(2) Prohibited mining periods and permissible mining periods;
(三)年度采砂控制总量；
(3) Annual total control volume of sand mining;
(四)可采区内采砂船只的控制数量。
(4) Control number of sand mining vessels in permissible mining areas.
沿江省、直辖市人民政府水行政主管部门根据长江采砂规划，可以拟订本行政区域内长江采砂规划实施方案，报本级人民政府批准后实施，并报长江水利委员会、长江航务管理局备案。
The water administrative departments of the people's governments of provinces and municipalities directly under the Central Government along the river may, based on the Yangtze River sand mining plan, draft implementation plans for Yangtze River sand mining within their administrative regions, submit them to the people's government at the same level for approval before implementation, and report them to the Yangtze River Water Resources Commission and the Yangtze River Navigation Administration for record.
沿江省、直辖市人民政府应当将长江采砂规划确定的禁采区和禁采期予以公告。
The people's governments of provinces and municipalities directly under the Central Government along the river shall announce the prohibited mining areas and prohibited mining periods determined in the Yangtze River sand mining plan.
沿江省、直辖市人民政府水行政主管部门可以根据本行政区域内长江的水情、工情、汛情、航道变迁和管理等需要，在长江采砂规划确定的禁采区、禁采期外增加禁采范围、延长禁采期限，报本级人民政府决定后公告。
The water administrative departments of the people's governments of provinces and municipalities directly under the Central Government along the river may, based on the needs of water regime, engineering conditions, flood situation, channel changes, and management within their administrative regions, add prohibited mining areas or extend prohibited mining periods beyond those determined in the Yangtze River sand mining plan, and shall announce them after being decided by the people's government at the same level.
长江水利委员会和沿江省、直辖市人民政府水行政主管部门应当加强对长江采砂规划实施情况的监督检查。
The Yangtze River Water Resources Commission and the water administrative departments of the people's governments of provinces and municipalities directly under the Central Government along the river shall strengthen supervision and inspection of the implementation of the Yangtze River sand mining plan.
国家对长江采砂实行采砂许可制度。
The State implements a sand mining permit system for Yangtze River sand mining.
河道采砂许可证由沿江省、直辖市人民政府水行政主管部门审批发放；属于省际边界重点河段的，经有关省、直辖市人民政府水行政主管部门签署意见后，由长江水利委员会审批发放；涉及航道的，审批发放前应当征求长江航务管理局和长江海事机构的意见。省际边界重点河段的范围由国务院水行政主管部门划定。
The river channel sand mining permit shall be examined, approved, and issued by the water administrative departments of the people's governments of provinces and municipalities directly under the Central Government along the river; for key river sections on provincial boundaries, after the water administrative departments of the relevant provinces or municipalities directly under the Central Government have signed opinions, it shall be examined, approved, and issued by the Yangtze River Water Resources Commission; if navigation channels are involved, opinions from the Yangtze River Navigation Administration and the Yangtze River maritime authorities shall be solicited before approval and issuance. The scope of key river sections on provincial boundaries shall be delineated by the water administrative department of the State Council.
河道采砂许可证式样由国务院水行政主管部门规定，由沿江省、直辖市人民政府水行政主管部门和长江水利委员会印制。
The format of the river channel sand mining permit shall be prescribed by the water administrative department of the State Council, and shall be printed by the water administrative departments of the people's governments of provinces and municipalities directly under the Central Government along the river and the Yangtze River Water Resources Commission.
从事长江采砂活动的单位和个人应当向沿江市、县人民政府水行政主管部门提出申请；符合下列条件的，由长江水利委员会或者沿江省、直辖市人民政府水行政主管部门依照本条例第九条的规定，审批发放河道采砂许可证：
Units and individuals engaged in Yangtze River sand mining activities shall submit applications to the water administrative departments of the city or county people's governments along the river; if the following conditions are met, the Yangtze River Water Resources Commission or the water administrative departments of the people's governments of provinces and municipalities directly under the Central Government along the river shall, in accordance with Article 9 of these Regulations, examine, approve, and issue the river channel sand mining permit:
(一)符合长江采砂规划确定的可采区和可采期的要求；
(1) Comply with the requirements of the permissible mining areas and permissible mining periods determined in the Yangtze River sand mining plan;
(二)符合年度采砂控制总量的要求；
(2) Comply with the requirements of the annual sand mining control volume;
(三)符合规定的作业方式；
(3) Comply with the prescribed operation methods;
(四)符合采砂船只数量的控制要求；
(4) Comply with the control requirements for the number of sand mining vessels;
(五)采砂船舶、船员证书齐全；
(5) The certificates of the sand mining vessel and crew are complete;
(六)有符合要求的采砂设备和采砂技术人员；
(6) Have qualified sand mining equipment and sand mining technical personnel;
(七)长江水利委员会或者沿江省、直辖市人民政府水行政主管部门规定的其他条件。
(7) Other conditions prescribed by the Yangtze River Water Resources Commission or the water administrative departments of the people's governments of the provinces or municipalities directly under the Central Government along the river.
市、县人民政府水行政主管部门应当自收到申请之日起10日内签署意见后，报送沿江省、直辖市人民政府水行政主管部门审批；属于省际边界重点河段的，经有关省、直辖市人民政府水行政主管部门签署意见后，报送长江水利委员会审批。长江水利委员会或者沿江省、直辖市人民政府水行政主管部门应当自收到申请之日起30日内予以审批；不予批准的，应当在作出不予批准决定之日起7日内通知申请人，并说明理由。
The water administrative department of the people's government of the city or county shall, within 10 days from the date of receiving the application, sign its opinions and submit it to the water administrative department of the people's government of the province or municipality directly under the Central Government along the river for approval; if it is a key river section at the provincial boundary, after the water administrative department of the people's government of the relevant province or municipality directly under the Central Government signs its opinions, it shall be submitted to the Yangtze River Water Resources Commission for approval. The Yangtze River Water Resources Commission or the water administrative department of the people's government of the province or municipality directly under the Central Government along the river shall complete the approval within 30 days from the date of receiving the application; if the application is not approved, the applicant shall be notified within 7 days from the date of the decision not to approve, and the reasons shall be stated.
河道采砂许可证应当载明船主姓名(名称)、船名、船号和开采的性质、种类、地点、时限以及作业方式、弃料处理方式、许可证的有效期限等有关事项和内容。
The river channel sand mining permit shall specify the shipowner's name (name), ship name, ship number, and the nature, type, location, time limit of mining, as well as the operation method, waste disposal method, validity period of the permit, and other relevant matters and contents.
从事长江采砂活动的单位和个人应当按照河道采砂许可证的规定进行开采。有关县级以上地方人民政府水行政主管部门和长江水利委员会应当按照职责划分对其加强监督检查。
Units and individuals engaged in sand mining activities in the Yangtze River shall conduct mining in accordance with the provisions of the river channel sand mining permit. The relevant water administrative departments of the local people's governments at or above the county level and the Yangtze River Water Resources Commission shall strengthen supervision and inspection according to their respective responsibilities.
从事长江采砂活动的单位和个人需要改变河道采砂许可证规定的事项和内容的，应当重新办理河道采砂许可证。
Units and individuals engaged in sand mining activities in the Yangtze River that need to change the matters and contents specified in the river channel sand mining permit shall re-apply for a river channel sand mining permit.
禁止伪造、涂改或者买卖、出租、出借或者以其他方式转让河道采砂许可证。
It is prohibited to forge, alter, buy, sell, rent, lend, or transfer the river channel sand mining permit in any other way.
为保障航道畅通和航行安全，采砂作业应当服从通航要求，并设立明显标志。
To ensure the smooth flow of navigation channels and navigation safety, sand mining operations shall comply with navigation requirements and set up obvious signs.
长江水利委员会和沿江省、直辖市人民政府水行政主管部门年审批采砂总量不得超过规划确定的年度采砂控制总量。
The total annual sand mining volume approved by the Yangtze River Water Resources Commission and the water administrative departments of the people's governments of the provinces or municipalities directly under the Central Government along the river shall not exceed the annual sand mining control volume determined in the plan.
沿江省、直辖市人民政府水行政主管部门应当在每年1月31日前将上一年度的长江采砂审批发证情况和实施情况，报长江水利委员会备案。
The water administrative departments of the people's governments of the provinces or municipalities directly under the Central Government along the river shall, before January 31 each year, report the previous year's Yangtze River sand mining approval and issuance status and implementation status to the Yangtze River Water Resources Commission for record.
沿江县级以上地方人民政府水行政主管部门因整修长江堤防进行吹填固基或者整治长江河道采砂的，应当经本省、直辖市人民政府水行政主管部门审查，并报长江水利委员会批准；长江航务管理局因整治长江航道采砂的，应当事先征求长江水利委员会的意见。
If the water administrative department of the local people's government at or above the county level along the river conducts sand mining for the purpose of reinforcing the Yangtze River embankment by hydraulic filling or regulating the Yangtze River channel, it shall be reviewed by the water administrative department of the people's government of the province or municipality directly under the Central Government and reported to the Yangtze River Water Resources Commission for approval; if the Yangtze River Navigation Administration conducts sand mining for regulating the Yangtze River navigation channel, it shall first seek the opinions of the Yangtze River Water Resources Commission.
因吹填造地从事采砂活动的单位和个人，应当依法申请河道采砂许可证。
Units and individuals engaged in sand mining activities for land reclamation by hydraulic filling shall apply for a river channel sand mining permit in accordance with the law.
除按照河道采砂许可证规定的期限在可采区作业外，采砂船舶应当集中停放在沿江县级人民政府指定的地点，并由采砂船舶所有者或者使用者负责管护。无正当理由，不得擅自离开指定的地点。
Except for operations in permissible mining areas within the period specified in the river channel sand mining permit, sand mining vessels shall be centrally moored at a location designated by the people's government of the county along the river, and shall be managed and maintained by the owner or user of the sand mining vessel. Without justifiable reasons, they shall not leave the designated location without authorization.
禁止运输、收购、销售未取得河道采砂许可证的单位、个人开采的长江河道砂石。
It is prohibited to transport, purchase, or sell sand and gravel from the Yangtze River channel mined by units or individuals that have not obtained a river channel sand mining permit.
长江水利委员会应当会同沿江省、直辖市人民政府水行政主管部门及有关部门、长江航务管理局、长江海事机构等单位建立统一的长江河道采砂管理信息平台，推进实施长江河道砂石开采、运输、收购、销售全过程追溯。
The Yangtze River Water Resources Commission shall, together with the water administrative departments of the people's governments of the provinces or municipalities directly under the Central Government along the river and relevant departments, the Yangtze River Navigation Administration, the Yangtze River Maritime Safety Administration, and other units, establish a unified Yangtze River channel sand mining management information platform, and promote the implementation of full-process traceability of sand and gravel mining, transportation, purchase, and sales in the Yangtze River channel.
违反本条例规定，未办理河道采砂许可证，擅自在长江采砂的，由县级以上地方人民政府水行政主管部门或者长江水利委员会依据职权，责令停止违法行为，没收违法开采的砂石和违法所得以及采砂船舶和挖掘机械等作业设备、工具，并处违法开采的砂石货值金额2倍以上20倍以下的罚款；货值金额不足10万元的，并处20万元以上200万元以下的罚款；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if a person engages in sand mining in the Yangtze River without obtaining a river channel sand mining permit, the water administrative department of the local people's government at or above the county level or the Yangtze River Water Resources Commission shall, according to their authority, order the cessation of the illegal act, confiscate the illegally mined sand and gravel and illegal gains, as well as the sand mining vessels and excavation machinery and other operating equipment and tools, and impose a fine of not less than 2 times but not more than 20 times the value of the illegally mined sand and gravel; if the value is less than 100,000 yuan, a fine of not less than 200,000 yuan but not more than 2 million yuan shall be imposed; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，采砂单位、个人未按照河道采砂许可证规定的要求采砂的，由县级以上地方人民政府水行政主管部门或者长江水利委员会依据职权，责令停止违法行为，没收违法开采的砂石和违法所得，并处违法开采的砂石货值金额1倍以上2倍以下的罚款；情节严重或者在禁采区、禁采期采砂的，没收违法开采的砂石和违法所得以及采砂船舶和挖掘机械等作业设备、工具，吊销河道采砂许可证，并处违法开采的砂石货值金额2倍以上20倍以下的罚款，货值金额不足10万元的，并处20万元以上200万元以下的罚款；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if a sand mining unit or individual fails to conduct sand mining in accordance with the requirements of the river channel sand mining permit, the water administrative department of the local people's government at or above the county level or the Yangtze River Water Resources Commission shall, according to their authority, order the cessation of the illegal act, confiscate the illegally mined sand and gravel and illegal gains, and impose a fine of not less than 1 time but not more than 2 times the value of the illegally mined sand and gravel; if the circumstances are serious or sand mining is conducted in prohibited mining areas or during prohibited mining periods, the illegally mined sand and gravel and illegal gains, as well as the sand mining vessels and excavation machinery and other operating equipment and tools, shall be confiscated, the river channel sand mining permit shall be revoked, and a fine of not less than 2 times but not more than 20 times the value of the illegally mined sand and gravel shall be imposed; if the value is less than 100,000 yuan, a fine of not less than 200,000 yuan but not more than 2 million yuan shall be imposed; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，运输、收购、销售未取得河道采砂许可证的单位、个人开采的长江河道砂石的，由县级以上地方人民政府水行政主管部门、长江水利委员会、有关海事管理机构以及县级以上地方人民政府其他有关部门依据职权，责令停止违法行为，没收违法运输、收购、销售的砂石和违法所得，并处2万元以上20万元以下的罚款；情节严重的，并处20万元以上200万元以下的罚款；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if a person transports, purchases, or sells sand and gravel from the Yangtze River channel mined by units or individuals that have not obtained a river channel sand mining permit, the water administrative department of the local people's government at or above the county level, the Yangtze River Water Resources Commission, the relevant maritime administration agency, and other relevant departments of the local people's government at or above the county level shall, according to their authority, order the cessation of the illegal act, confiscate the illegally transported, purchased, or sold sand and gravel and illegal gains, and impose a fine of not less than 20,000 yuan but not more than 200,000 yuan; if the circumstances are serious, a fine of not less than 200,000 yuan but not more than 2 million yuan shall be imposed; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，采砂船舶未在指定地点集中停放或者无正当理由擅自离开指定地点的，由县级以上地方人民政府水行政主管部门责令停靠在指定地点，处3万元以上10万元以下的罚款；拒不改正的，予以强行转移至指定地点。
In violation of these regulations, if a sand mining vessel is not centrally moored at a designated location or leaves the designated location without justifiable reasons, the water administrative department of the local people's government at or above the county level shall order it to moor at a designated location and impose a fine of not less than 30,000 yuan but not more than 100,000 yuan; if it refuses to correct, it shall be forcibly transferred to a designated location.
伪造、变造、转让、出租、出借河道采砂许可证，由县级以上地方人民政府水行政主管部门或者长江水利委员会依据职权予以吊销或者收缴，没收违法所得，并处5万元以上50万元以下的罚款；构成犯罪的，依法追究刑事责任。
If a person forges, alters, transfers, rents, or lends a river channel sand mining permit, the water administrative department of the local people's government at or above the county level or the Yangtze River Water Resources Commission shall, according to their authority, revoke or confiscate it, confiscate the illegal gains, and impose a fine of not less than 50,000 yuan but not more than 500,000 yuan; if a crime is constituted, criminal liability shall be pursued according to law.
在长江航道内非法采砂影响通航安全的，由长江航务管理局、长江海事机构依照《中华人民共和国内河交通安全管理条例》和《中华人民共和国航道管理条例》等规定给予处罚。
If illegal sand mining in the Yangtze River channel affects navigation safety, the Yangtze River Administration Bureau and the Yangtze River Maritime Safety Administration shall impose penalties in accordance with the Regulations on the Administration of Inland River Traffic Safety and the Regulations on the Administration of Navigation Channels.
依照本条例规定应当给予行政处罚，而有关水行政主管部门不给予行政处罚的，由上级人民政府水行政主管部门责令其作出行政处罚决定或者直接给予行政处罚；对负有责任的主管人员和其他直接责任人员依法给予处分。
If an administrative penalty should be imposed under these Regulations but the relevant water administrative department fails to do so, the water administrative department of the people's government at the next higher level shall order it to make a decision on the administrative penalty or directly impose the administrative penalty; and shall impose sanctions on the responsible persons in charge and other directly responsible personnel according to law.
依照本条例实施罚款的行政处罚，应当依照有关法律、行政法规的规定，实行罚款决定与罚款收缴分离，所收取的罚款必须全部上缴国库。
When imposing a fine as an administrative penalty under these Regulations, the decision on the fine and the collection of the fine shall be separated in accordance with relevant laws and administrative regulations, and all fines collected must be turned over to the state treasury.
有下列行为之一，对负有责任的主管人员和其他直接责任人员依法给予处分；构成犯罪的，依法追究刑事责任：
Any of the following acts shall result in sanctions imposed on the responsible persons in charge and other directly responsible personnel according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)不执行已批准的长江采砂规划、擅自修改长江采砂规划或者违反长江采砂规划组织采砂的；
(1) Failing to implement the approved Yangtze River sand mining plan, modifying the Yangtze River sand mining plan without authorization, or organizing sand mining in violation of the Yangtze River sand mining plan;
(二)不按照规定审批发放河道采砂许可证或者其他批准文件的；
(2) Failing to approve and issue river channel sand mining permits or other approval documents in accordance with regulations;
(三)不履行本条例规定的监督检查职责，造成长江采砂秩序混乱或者造成重大责任事故的。
(3) Failing to perform the supervision and inspection duties stipulated in these Regulations, resulting in disorder in Yangtze River sand mining or causing a major liability accident.
本条例自2002年1月1日起施行。
These Regulations shall come into force as of January 1, 2002.
