为防止拆船污染环境，保护生态平衡，保障人体健康，促进拆船事业的发展，制定本条例。
These Regulations are formulated to prevent environmental pollution from shipbreaking, protect ecological balance, safeguard human health, and promote the development of the shipbreaking industry.
本条例适用于在中华人民共和国管辖水域从事岸边和水上拆船活动的单位和个人。
These Regulations apply to units and individuals engaged in shore-based and water-based shipbreaking activities in waters under the jurisdiction of the People's Republic of China.
本条例所称岸边拆船，指废船停靠拆船码头拆解；废船在船坞拆解；废船冲滩(不包括海难事故中的船舶冲滩)拆解。
For the purposes of these Regulations, 'shore-based shipbreaking' means the dismantling of a waste ship moored at a shipbreaking wharf; the dismantling of a waste ship in a dry dock; and the dismantling of a waste ship beached (excluding ship beaching in maritime accidents).
本条例所称水上拆船，指对完全处于水上的废船进行拆解。
For the purposes of these Regulations, 'water-based shipbreaking' means the dismantling of a waste ship entirely on water.
县级以上人民政府环境保护部门负责组织协调、监督检查拆船业的环境保护工作，并主管港区水域外的岸边拆船环境保护工作。
The environmental protection department of the people's government at or above the county level shall be responsible for organizing coordination, supervision, and inspection of environmental protection work in the shipbreaking industry, and shall be in charge of environmental protection for shore-based shipbreaking outside port waters.
中华人民共和国港务监督(含港航监督，下同)主管水上拆船和综合港港区水域拆船的环境保护工作，并协助环境保护部门监督港区水域外的岸边拆船防止污染工作。
The Maritime Safety Administration of the People's Republic of China (including harbor superintendency, hereinafter the same) shall be in charge of environmental protection for water-based shipbreaking and shipbreaking in comprehensive port waters, and shall assist the environmental protection department in supervising pollution prevention for shore-based shipbreaking outside port waters.
国家渔政渔港监督管理部门主管渔港水域拆船的环境保护工作，负责监督拆船活动对沿岸渔业水域的影响，发现污染损害事故后，会同环境保护部门调查处理。
The national fishery administration and fishing port superintendency department shall be in charge of environmental protection for shipbreaking in fishing port waters, shall be responsible for supervising the impact of shipbreaking activities on coastal fishery waters, and upon discovery of a pollution damage accident, shall investigate and handle it jointly with the environmental protection department.
军队环境保护部门主管军港水域拆船的环境保护工作。
The military environmental protection department shall be in charge of environmental protection for shipbreaking in military port waters.
国家海洋管理部门和重要江河的水资源保护机构，依据《中华人民共和国海洋环境保护法》和《中华人民共和国水污染防治法》确定的职责，协助以上各款所指主管部门监督拆船的防止污染工作。
The national marine management department and the water resources protection agencies of major rivers shall, in accordance with the responsibilities determined by the Marine Environment Protection Law of the People's Republic of China and the Water Pollution Prevention and Control Law of the People's Republic of China, assist the competent departments referred to in the preceding paragraphs in supervising pollution prevention from shipbreaking.
县级以上人民政府的环境保护部门、中华人民共和国港务监督、国家渔政渔港监督管理部门和军队环境保护部门，在主管本条第一、第二、第三、第四款所确定水域的拆船环境保护工作时，简称“监督拆船污染的主管部门”。
The environmental protection department of the people's government at or above the county level, the Maritime Safety Administration of the People's Republic of China, the national fishery administration and fishing port superintendency department, and the military environmental protection department, when in charge of environmental protection for shipbreaking in the waters specified in the first, second, third, and fourth paragraphs of this Article, are hereinafter referred to as 'the competent departments supervising shipbreaking pollution'.
地方人民政府应当根据需要和可能，结合本地区的特点、环境状况和技术条件，统筹规划、合理设置拆船厂。
Local people's governments shall, based on needs and possibilities, and in light of the characteristics, environmental conditions, and technical capabilities of their regions, make overall plans and rationally set up shipbreaking yards.
在饮用水源地、海水淡化取水点、盐场、重要的渔业水域、海水浴场、风景名胜区以及其他需要特殊保护的区域，不得设置拆船厂。
No shipbreaking yard may be established in drinking water source areas, seawater desalination water intake points, salt fields, important fishery waters, seawater bathing beaches, scenic spots, or other areas requiring special protection.
设置拆船厂，必须编制环境影响报告书(表)。其内容包括：拆船厂的地理位置、周围环境状况、拆船规模和条件、拆船工艺、防污措施、预期防治效果等。未依法进行环境影响评价的拆船厂，不得开工建设。
To establish a shipbreaking yard, an environmental impact report (form) must be prepared. Its contents include: the geographical location of the shipbreaking yard, surrounding environmental conditions, shipbreaking scale and conditions, shipbreaking technology, pollution prevention measures, expected prevention effects, etc. No shipbreaking yard that has not conducted environmental impact assessment in accordance with the law may commence construction.
环境保护部门在批准环境影响报告书(表)前，应当征求各有关部门的意见。
Before approving the environmental impact report (form), the environmental protection department shall seek opinions from relevant departments.
监督拆船污染的主管部门有权对拆船单位的拆船活动进行检查，被检查单位必须如实反映情况，提供必要的资料。
The competent departments supervising shipbreaking pollution have the right to inspect the shipbreaking activities of shipbreaking units, and the inspected units must truthfully reflect the situation and provide necessary information.
监督拆船污染的主管部门有义务为被检查单位保守技术和业务秘密。
The competent departments supervising shipbreaking pollution have the obligation to keep technical and business secrets for the inspected units.
对严重污染环境的拆船单位，限期治理。
Shipbreaking units that seriously pollute the environment shall be ordered to rectify within a specified time limit.
对拆船单位的限期治理，由监督拆船污染的主管部门提出意见，通过批准环境影响报告书(表)的环境保护部门，报同级人民政府决定。
The order for rectification within a specified time limit for a shipbreaking unit shall be proposed by the competent department supervising shipbreaking pollution, submitted through the environmental protection department that approved the environmental impact report (form), and decided by the people's government at the same level.
拆船单位应当健全环境保护规章制度，认真组织实施。
Shipbreaking units shall establish and improve environmental protection rules and regulations, and implement them conscientiously.
拆船单位必须配备或者设置防止拆船污染必需的拦油装置、废油接收设备、含油污水接收处理设施或者设备、废弃物回收处置场等，并经批准环境影响报告书(表)的环境保护部门验收合格，发给验收合格证后，方可进船拆解。
Shipbreaking units must be equipped with or set up oil containment devices, waste oil receiving equipment, oily wastewater receiving and treatment facilities or equipment, waste recycling and disposal sites, etc., necessary to prevent shipbreaking pollution, and after passing the acceptance inspection by the environmental protection department that approved the environmental impact report (form) and receiving an acceptance certificate, may proceed to bring in ships for dismantling.
拆船单位在废船拆解前，必须清除易燃、易爆和有毒物质；关闭海底阀和封闭可能引起油污水外溢的管道。垃圾、残油、废油、油泥、含油污水和易燃易爆物品等废弃物必须送到岸上集中处理，并不得采用渗坑、渗井的处理方式。
Before dismantling a waste ship, the shipbreaking unit must remove flammable, explosive, and toxic substances; close the sea valves and seal pipelines that may cause overflow of oily wastewater. Waste such as garbage, residual oil, waste oil, oil sludge, oily wastewater, and flammable and explosive items must be sent to shore for centralized treatment, and treatment methods such as seepage pits or seepage wells shall not be used.
废油船在拆解前，必须进行洗舱、排污、清舱、测爆等工作。
Before dismantling a waste oil tanker, tank washing, sewage discharge, tank cleaning, and gas-free testing must be carried out.
在水上进行拆船作业的拆船单位和个人，必须事先采取有效措施，严格防止溢出、散落水中的油类和其他漂浮物扩散。
Shipbreaking units and individuals conducting shipbreaking operations on water must take effective measures in advance to strictly prevent the spread of oil and other floating substances that spill or fall into the water.
在水上进行拆船作业，一旦出现溢出、散落水中的油类和其他漂浮物，必须及时收集处理。
During shipbreaking operations on water, once oil and other floating substances spill or fall into the water, they must be promptly collected and treated.
排放洗舱水、压舱水和舱底水，必须符合国家和地方规定的排放标准；排放未经处理的洗舱水、压舱水和舱底水，还必须经过监督拆船污染的主管部门批准。
Discharge of tank washing water, ballast water, and bilge water must comply with national and local discharge standards; discharge of untreated tank washing water, ballast water, and bilge water must also be approved by the competent department supervising shipbreaking pollution.
监督拆船污染的主管部门接到拆船单位申请排放未经处理的洗舱水、压舱水和舱底水的报告后，应当抓紧办理，及时审批。
Upon receiving a report from a shipbreaking unit applying for discharge of untreated tank washing water, ballast water, and bilge water, the competent department supervising shipbreaking pollution shall handle it promptly and grant approval in a timely manner.
拆下的船舶部件或者废弃物，不得投弃或者存放水中；带有污染物的船舶部件或者废弃物，严禁进入水体。未清洗干净的船底和油柜必须拖到岸上拆解。
Dismantled ship parts or waste shall not be discarded or stored in water; ship parts or waste containing pollutants are strictly prohibited from entering water bodies. Unclean ship bottoms and oil tanks must be towed to shore for dismantling.
拆船作业产生的电石渣及其废水，必须收集处理，不得流入水中。
Calcium carbide slag and its wastewater generated from shipbreaking operations must be collected and treated, and shall not flow into water.
船舶拆解完毕，拆船单位和个人应当及时清理拆船现场。
After the ship is completely dismantled, the shipbreaking unit or individual shall promptly clean up the shipbreaking site.
发生拆船污染损害事故时，拆船单位或者个人必须立即采取消除或者控制污染的措施，并迅速报告监督拆船污染的主管部门。
When a pollution damage accident occurs during shipbreaking, the shipbreaking unit or individual must immediately take measures to eliminate or control the pollution, and promptly report to the competent department supervising shipbreaking pollution.
污染损害事故发生后，拆船单位必须向监督拆船污染的主管部门提交《污染事故报告书》，报告污染发生的原因、经过、排污数量、采取的抢救措施、已造成和可能造成的污染损害后果等，并接受调查处理。
After a pollution damage accident occurs, the shipbreaking unit must submit a 'Pollution Accident Report' to the competent department supervising shipbreaking pollution, reporting the cause, process, quantity of pollutants discharged, rescue measures taken, pollution damage consequences that have been caused or may be caused, etc., and accept investigation and handling.
拆船单位关闭或者搬迁后，必须及时清理原厂址遗留的污染物，并由监督拆船污染的主管部门检查验收。
After a shipbreaking unit is closed or relocated, it must promptly clean up the pollutants left at the original site, and the competent department supervising shipbreaking pollution shall inspect and accept the cleanup.
违反本条例规定，有下列情形之一的，监督拆船污染的主管部门除责令其限期纠正外，还可以根据不同情节，处以1万元以上10万元以下的罚款：
In any of the following circumstances violating these Regulations, the competent department supervising shipbreaking pollution shall, in addition to ordering rectification within a specified time limit, also impose a fine of not less than 10,000 yuan but not more than 100,000 yuan depending on the circumstances:
(一)发生污染损害事故，不向监督拆船污染的主管部门报告也不采取消除或者控制污染措施的；
(1) A pollution damage accident occurs, and the unit neither reports to the competent department supervising shipbreaking pollution nor takes measures to eliminate or control the pollution;
(二)废油船未经洗舱、排污、清舱和测爆即行拆解的；
(2) A waste oil tanker is dismantled without tank washing, sewage discharge, tank cleaning, and gas-free testing;
(三)任意排放或者丢弃污染物造成严重污染的。
(3) Pollutants are discharged or discarded arbitrarily, causing serious pollution.
违反本条例规定，擅自在第五条第二款所指的区域设置拆船厂并进行拆船的，按照分级管理的原则，由县级以上人民政府责令限期关闭或者搬迁。
Where, in violation of these Regulations, a shipbreaking yard is established without authorization in the areas specified in the second paragraph of Article 5 and shipbreaking is carried out, the people's government at or above the county level shall, in accordance with the principle of graded management, order closure or relocation within a specified time limit.
拆船厂未依法进行环境影响评价擅自开工建设的，依照《中华人民共和国环境保护法》的规定处罚。
Where a shipbreaking yard commences construction without conducting environmental impact assessment in accordance with the law, penalties shall be imposed in accordance with the provisions of the Environmental Protection Law of the People's Republic of China.
违反本条例规定，有下列情形之一的，监督拆船污染的主管部门除责令其限期纠正外，还可以根据不同情节，给予警告或者处以1万元以下的罚款：
In any of the following circumstances violating these Regulations, the competent department supervising shipbreaking pollution shall, in addition to ordering rectification within a specified time limit, also give a warning or impose a fine of not more than 10,000 yuan depending on the circumstances:
(一)拒绝或者阻挠监督拆船污染的主管部门进行现场检查或者在被检查时弄虚作假的；
(1) Refusing or obstructing on-site inspection by the competent department supervising shipbreaking pollution, or practicing fraud during inspection;
(二)未按规定要求配备和使用防污设施、设备和器材，造成环境污染的；
(2) Failing to equip and use pollution prevention facilities, equipment, and devices as required, causing environmental pollution;
(三)发生污染损害事故，虽采取消除或者控制污染措施，但不向监督拆船污染的主管部门报告的；
(3) A pollution damage accident occurs, and although measures to eliminate or control the pollution are taken, the unit fails to report to the competent department supervising shipbreaking pollution;
(四)拆船单位关闭、搬迁后，原厂址的现场清理不合格的。
(4) After a shipbreaking unit is closed or relocated, the site cleanup at the original location is not up to standard.
罚款全部上缴国库。
All fines shall be turned over to the State Treasury.
拆船单位和个人在受到罚款后，并不免除其对本条例规定义务的履行，已造成污染危害的，必须及时排除危害。
Shipbreaking units and individuals, after being fined, are not exempted from fulfilling their obligations under these Regulations; if pollution damage has been caused, they must promptly eliminate the damage.
对经限期治理逾期未完成治理任务的拆船单位，可以根据其造成的危害后果，责令停业整顿或者关闭。
For a shipbreaking unit that fails to complete the rectification task within the specified time limit, it may be ordered to suspend operations for rectification or be closed down based on the consequences of the damage caused.
前款所指拆船单位的停业整顿或者关闭，由作出限期治理决定的人民政府决定。责令国务院有关部门直属的拆船单位停业整顿或者关闭，由国务院环境保护部门会同有关部门批准。
The suspension of operations for rectification or closure of the shipbreaking unit referred to in the preceding paragraph shall be decided by the people's government that made the decision on rectification within a specified time limit. The suspension of operations for rectification or closure of a shipbreaking unit directly under a department of the State Council shall be approved by the environmental protection department of the State Council in conjunction with the relevant department.
对造成污染损害后果负有责任的或者有第十八条第(一)项所指行为的拆船单位负责人和直接责任者，可以根据不同情节，由其所在单位或者上级主管机关给予行政处分。
For the person in charge and the directly responsible person of a shipbreaking unit who bear responsibility for causing pollution damage consequences or who commit the act specified in Article 18(1), administrative sanctions may be imposed by their unit or the competent authority at a higher level depending on the circumstances.
当事人对行政处罚决定不服的，可以在收到处罚决定通知之日起15日内，向人民法院起诉；期满不起诉又不履行的，由作出处罚决定的主管部门申请人民法院强制执行。
If a party is dissatisfied with an administrative penalty decision, it may file a lawsuit with the people's court within 15 days from the date of receipt of the penalty decision notice; if no lawsuit is filed within the time limit and the decision is not complied with, the competent department that made the penalty decision shall apply to the people's court for compulsory enforcement.
因拆船污染直接遭受损害的单位或者个人，有权要求造成污染损害方赔偿损失。造成污染损害方有责任对直接遭受危害的单位或者个人赔偿损失。
Units or individuals that have directly suffered damage from shipbreaking pollution have the right to claim compensation for losses from the party causing the pollution damage. The party causing the pollution damage is responsible for compensating the losses of the units or individuals directly harmed.
赔偿责任和赔偿金额的纠纷，可以根据当事人的请求，由监督拆船污染的主管部门处理；当事人对处理决定不服的，可以向人民法院起诉。
Disputes over liability for compensation and the amount of compensation may, upon request of the parties, be handled by the competent department supervising shipbreaking pollution; if a party is dissatisfied with the handling decision, it may file a lawsuit with the people's court.
当事人也可以直接向人民法院起诉。
The parties may also directly file a lawsuit with the people's court.
凡直接遭受拆船污染损害，要求赔偿损失的单位和个人，应当提交《污染索赔报告书》。报告书应当包括以下内容：
Units and individuals that have directly suffered shipbreaking pollution damage and claim compensation for losses shall submit a 'Pollution Compensation Claim Report'. The report shall include the following contents:
(一)受拆船污染损害的时间、地点、范围、对象，以及当时的气象、水文条件；
(1) The time, location, scope, and object of the shipbreaking pollution damage, as well as the meteorological and hydrological conditions at the time;
(二)受拆船污染损害的损失清单，包括品名、数量、单价、计算方法等；
(2) A list of losses from the shipbreaking pollution damage, including item names, quantities, unit prices, calculation methods, etc.;
(三)有关监测部门的鉴定。
(3) Appraisal by relevant monitoring departments.
因不可抗拒的自然灾害，并经及时采取防范和抢救措施，仍然不能避免造成污染损害的，免予承担赔偿责任。
If pollution damage cannot be avoided despite timely preventive and rescue measures due to irresistible natural disasters, liability for compensation shall be exempted.
对检举、揭发拆船单位隐瞒不报或者谎报污染损害事故，以及积极采取措施制止或者减轻污染损害的单位和个人，给予表扬和奖励。
Units and individuals that report or expose shipbreaking units that conceal or falsely report pollution damage accidents, or that actively take measures to stop or mitigate pollution damage, shall be given commendation and rewards.
监督拆船污染的主管部门的工作人员玩忽职守、滥用职权、徇私舞弊的，由其所在单位或者上级主管机关给予行政处分；对国家和人民利益造成重大损失、构成犯罪的，依法追究刑事责任。
Staff members of the competent departments supervising shipbreaking pollution who neglect their duties, abuse their power, or engage in malpractice for personal gain shall be given administrative sanctions by their unit or the competent authority at a higher level; if significant losses are caused to the state and people's interests and a crime is constituted, criminal liability shall be pursued in accordance with the law.
本条例自1988年6月1日起施行。
These Regulations shall come into effect as of June 1, 1988.
