Regulations on the Establishment and Staffing of Administrative Institutions of the State Council

为了规范国务院行政机构的设置，加强编制管理，提高行政效率，根据宪法和国务院组织法，制定本条例。

These Regulations are formulated in accordance with the Constitution and the Organic Law of the State Council to standardize the establishment of administrative institutions of the State Council, strengthen staffing management, and improve administrative efficiency.

国务院行政机构设置和编制管理应当适应国家政治、经济、社会发展的需要，遵循精简、统一、高效的原则。

The establishment and staffing management of administrative institutions of the State Council shall meet the needs of national political, economic, and social development, and follow the principles of simplification, unity, and efficiency.

国务院根据宪法和国务院组织法的规定，行使国务院行政机构设置和编制管理职权。

The State Council shall exercise the authority over the establishment and staffing management of its administrative institutions in accordance with the Constitution and the Organic Law of the State Council.

国务院机构编制管理机关在国务院领导下，负责国务院行政机构设置和编制管理的具体工作。

The State Council's institution staffing management authority shall, under the leadership of the State Council, be responsible for the specific work of establishing and managing the staffing of the State Council's administrative institutions.

国务院行政机构的设置以职能的科学配置为基础，做到职能明确、分工合理、机构精简，有利于提高行政效能。

The establishment of administrative institutions of the State Council shall be based on the scientific allocation of functions, ensuring clear functions, reasonable division of labor, and streamlined institutions, conducive to improving administrative efficiency.

国务院根据国民经济和社会发展的需要，适应社会主义市场经济体制的要求，适时调整国务院行政机构；但是，在一届政府任期内，国务院组成部门应当保持相对稳定。

The State Council shall, in light of the needs of national economic and social development and the requirements of the socialist market economy system, timely adjust its administrative institutions; however, during the term of one government, the constituent departments of the State Council shall remain relatively stable.

国务院行政机构的设立、撤销或者合并，由国务院机构编制管理机关事先组织有关部门和专家进行评估和论证。

The establishment, abolition, or merger of administrative institutions of the State Council shall be subject to prior evaluation and demonstration by the State Council's institution staffing management authority, which shall organize relevant departments and experts.

国务院行政机构根据职能分为国务院办公厅、国务院组成部门、国务院直属机构、国务院办事机构、国务院组成部门管理的国家行政机构和国务院议事协调机构。

Administrative institutions of the State Council are divided, according to their functions, into the General Office of the State Council, constituent departments of the State Council, institutions directly under the State Council, offices of the State Council, state administrative institutions managed by constituent departments of the State Council, and deliberative and coordinating bodies of the State Council.

国务院办公厅协助国务院领导处理国务院日常工作。

The General Office of the State Council assists the State Council leaders in handling the daily work of the State Council.

国务院组成部门依法分别履行国务院基本的行政管理职能。国务院组成部门包括各部、各委员会、中国人民银行和审计署。

Constituent departments of the State Council shall, in accordance with the law, respectively perform the basic administrative functions of the State Council. Constituent departments of the State Council include various ministries, commissions, the People's Bank of China, and the National Audit Office.

国务院直属机构主管国务院的某项专门业务，具有独立的行政管理职能。

Institutions directly under the State Council are in charge of specific specialized businesses of the State Council and have independent administrative functions.

国务院办事机构协助国务院总理办理专门事项，不具有独立的行政管理职能。

Offices of the State Council assist the Premier of the State Council in handling specific matters and do not have independent administrative functions.

国务院组成部门管理的国家行政机构由国务院组成部门管理，主管特定业务，行使行政管理职能。

State administrative institutions managed by constituent departments of the State Council are managed by the constituent departments of the State Council, are in charge of specific businesses, and exercise administrative functions.

国务院议事协调机构承担跨国务院行政机构的重要业务工作的组织协调任务。国务院议事协调机构议定的事项，经国务院同意，由有关的行政机构按照各自的职责负责办理。在特殊或者紧急的情况下，经国务院同意，国务院议事协调机构可以规定临时性的行政管理措施。

Deliberative and coordinating bodies of the State Council undertake the task of organizing and coordinating important business work across administrative institutions of the State Council. Matters decided by deliberative and coordinating bodies of the State Council shall, with the consent of the State Council, be handled by the relevant administrative institutions in accordance with their respective responsibilities. In special or emergency circumstances, with the consent of the State Council, deliberative and coordinating bodies of the State Council may prescribe temporary administrative measures.

依照国务院组织法的规定，国务院设立办公厅。

In accordance with the provisions of the Organic Law of the State Council, the State Council shall establish the General Office.

国务院组成部门的设立、撤销或者合并由国务院机构编制管理机关提出方案，经国务院常务会议讨论通过后，由国务院总理提请全国人民代表大会决定；在全国人民代表大会闭会期间，提请全国人民代表大会常务委员会决定。

The establishment, abolition, or merger of constituent departments of the State Council shall be proposed by the State Council's institution staffing management authority, discussed and adopted at an executive meeting of the State Council, and then submitted by the Premier of the State Council to the National People's Congress for decision; when the National People's Congress is not in session, it shall be submitted to the Standing Committee of the National People's Congress for decision.

国务院直属机构、国务院办事机构和国务院组成部门管理的国家行政机构的设立、撤销或者合并由国务院机构编制管理机关提出方案，报国务院决定。

The establishment, abolition, or merger of institutions directly under the State Council, offices of the State Council, and state administrative institutions managed by constituent departments of the State Council shall be proposed by the State Council's institution staffing management authority and reported to the State Council for decision.

设立国务院组成部门、国务院直属机构、国务院办事机构和国务院组成部门管理的国家行政机构的方案，应当包括下列事项：

A proposal for the establishment of a constituent department of the State Council, an institution directly under the State Council, an office of the State Council, or a state administrative institution managed by a constituent department of the State Council shall include the following items:

(一)设立机构的必要性和可行性；

(1) The necessity and feasibility of establishing the institution;

(二)机构的类型、名称和职能；

(2) The type, name, and functions of the institution;

(三)司级内设机构的名称和职能；

(3) The names and functions of its internal directorate-level bodies;

(四)与业务相近的国务院行政机构职能的划分；

(4) The division of functions with administrative institutions of the State Council that have similar functions;

(五)机构的编制。

(5) Staffing of the organ.

撤销或者合并前款所列机构的方案，应当包括下列事项：

A plan for the dissolution or merger of the organs listed in the preceding paragraph shall include the following items:

(一)撤销或者合并的理由；

(1) Reasons for dissolution or merger;

(二)撤销或者合并机构后职能的消失、转移情况；

(2) Disappearance or transfer of functions after dissolution or merger;

(三)撤销或者合并机构后编制的调整和人员的分流。

(3) Adjustment of staffing and placement of personnel after dissolution or merger.

设立国务院议事协调机构，应当严格控制；可以交由现有机构承担职能的或者由现有机构进行协调可以解决问题的，不另设立议事协调机构。

The establishment of State Council coordination bodies shall be strictly controlled; if the functions can be undertaken by existing organs or problems can be resolved through coordination by existing organs, no separate coordination body shall be established.

设立国务院议事协调机构，应当明确规定承担办事职能的具体工作部门；为处理一定时期内某项特定工作设立的议事协调机构，还应当明确规定其撤销的条件或者撤销的期限。

When establishing a State Council coordination body, the specific working department responsible for its executive functions shall be clearly specified; for coordination bodies established to handle specific work within a certain period, the conditions or time limit for its dissolution shall also be clearly specified.

国务院议事协调机构的设立、撤销或者合并，由国务院机构编制管理机关提出方案，报国务院决定。

The establishment, dissolution, or merger of State Council coordination bodies shall be proposed by the State Council's organ for staffing management and submitted to the State Council for decision.

国务院行政机构设立后，需要对职能进行调整的，由国务院机构编制管理机关提出方案，报国务院决定。

After the establishment of a State Council administrative organ, if adjustments to its functions are needed, the State Council's organ for staffing management shall propose a plan and submit it to the State Council for decision.

国务院办公厅、国务院组成部门、国务院直属机构、国务院办事机构在职能分解的基础上设立司、处两级内设机构；国务院组成部门管理的国家行政机构根据工作需要可以设立司、处两级内设机构，也可以只设立处级内设机构。

The General Office of the State Council, constituent departments of the State Council, directly affiliated agencies of the State Council, and working offices of the State Council shall establish internal structures at the department (Department) and division (Office) levels based on the decomposition of functions; state administrative organs managed by constituent departments of the State Council may, as needed, establish internal structures at the department and division levels, or only at the division level.

国务院行政机构的司级内设机构的增设、撤销或者合并，经国务院机构编制管理机关审核方案，报国务院批准。

The addition, dissolution, or merger of department-level internal structures of State Council administrative organs shall be reviewed by the State Council's organ for staffing management and submitted to the State Council for approval.

国务院行政机构的处级内设机构的设立、撤销或者合并，由国务院行政机构根据国家有关规定决定，按年度报国务院机构编制管理机关备案。

The establishment, dissolution, or merger of division-level internal structures of State Council administrative organs shall be decided by the State Council administrative organ in accordance with relevant state regulations and reported annually to the State Council's organ for staffing management for record.

增设国务院行政机构的司级内设机构的方案，应当包括下列事项：

A plan for adding a department-level internal structure of a State Council administrative organ shall include the following items:

(一)增设机构的必要性；

(1) Necessity for adding the structure;

(二)增设机构的名称和职能；

(2) Name and functions of the added structure;

(三)与业务相近的司级内设机构职能的划分。

(3) Division of functions with related department-level internal structures.

撤销或者合并前款所列机构的方案，应当包括下列事项：

A plan for the dissolution or merger of the structures listed in the preceding paragraph shall include the following items:

(一)撤销或者合并机构的理由；

(1) Reasons for dissolution or merger;

(二)撤销或者合并机构后职能的消失、转移情况；

(2) Disappearance or transfer of functions after dissolution or merger;

(三)撤销或者合并机构后编制的调整。

(3) Adjustment of staffing after dissolution or merger.

国务院行政机构及其司级内设机构的名称应当规范、明确，并与该机构的类型和职能相称。

The names of State Council administrative organs and their department-level internal structures shall be standardized, clear, and commensurate with the type and functions of the organ.

国务院行政机构及其司级内设机构不得擅自变更名称。

State Council administrative organs and their department-level internal structures shall not change their names without authorization.

国务院行政机构的编制依据职能配置和职位分类，按照精简的原则确定。

The staffing of State Council administrative organs shall be determined based on functional allocation and job classification, in accordance with the principle of streamlining.

前款所称编制，包括人员的数量定额和领导职数。

The term 'staffing' as used in the preceding paragraph includes the fixed number of personnel and the number of leadership positions.

国务院行政机构的编制在国务院行政机构设立时确定。

The staffing of an administrative institution of the State Council shall be determined at the time of its establishment.

国务院行政机构的编制方案，应当包括下列事项：

The staffing plan of an administrative institution of the State Council shall include the following items:

(一)机构人员定额和人员结构比例；

(1) The personnel quota and the ratio of personnel structure;

(二)机构领导职数和司级内设机构领导职数。

(2) The number of leadership positions in the institution and the number of leadership positions in its department-level internal organs.

国务院行政机构增加或者减少编制，由国务院机构编制管理机关审核方案，报国务院批准。

Any increase or decrease in the staffing of an administrative institution of the State Council shall be subject to review of the plan by the State Council's administrative institution staffing management authority and approval by the State Council.

国务院议事协调机构不单独确定编制，所需要的编制由承担具体工作的国务院行政机构解决。

The coordinating bodies of the State Council shall not have separate staffing; the staffing required shall be provided by the administrative institution of the State Council that undertakes the specific work.

国务院办公厅、国务院组成部门、国务院直属机构和国务院办事机构的领导职数，按照国务院组织法的规定确定。国务院组成部门管理的国家行政机构的领导职数，参照国务院组织法关于国务院直属机构领导职数的规定确定。

The number of leadership positions in the General Office of the State Council, the constituent departments of the State Council, the directly affiliated institutions of the State Council, and the offices of the State Council shall be determined in accordance with the provisions of the Organic Law of the State Council. The number of leadership positions in the national administrative institutions managed by the constituent departments of the State Council shall be determined by reference to the provisions of the Organic Law of the State Council on the number of leadership positions in the directly affiliated institutions of the State Council.

国务院办公厅、国务院组成部门、国务院直属机构、国务院办事机构的司级内设机构的领导职数为一正二副；国务院组成部门管理的国家行政机构的司级内设机构的领导职数根据工作需要为一正二副或者一正一副。

The number of leadership positions in the department-level internal organs of the General Office of the State Council, the constituent departments of the State Council, the directly affiliated institutions of the State Council, and the offices of the State Council shall be one chief and two deputies; the number of leadership positions in the department-level internal organs of the national administrative institutions managed by the constituent departments of the State Council shall be one chief and two deputies or one chief and one deputy, depending on the needs of the work.

国务院行政机构的处级内设机构的领导职数，按照国家有关规定确定。

The number of leadership positions in the division-level internal organs of the administrative institutions of the State Council shall be determined in accordance with the relevant provisions of the state.

国务院机构编制管理机关应当对国务院行政机构的机构设置和编制执行情况进行监督检查。

The State Council's administrative institution staffing management authority shall conduct supervision and inspection of the establishment and staffing implementation of the administrative institutions of the State Council.

国务院行政机构应当每年向国务院机构编制管理机关提供其机构设置和编制管理情况的报告。

The administrative institutions of the State Council shall annually provide a report on their establishment and staffing management to the State Council's administrative institution staffing management authority.

国务院行政机构违反本条例规定，有下列行为之一的，由国务院机构编制管理机关责令限期纠正；逾期不纠正的，由国务院机构编制管理机关建议国务院或者国务院有关部门对负有直接责任的主管人员和其他直接责任人员依法给予行政处分：

If an administrative institution of the State Council violates the provisions of these Regulations by committing any of the following acts, the State Council's administrative institution staffing management authority shall order it to rectify within a specified time limit; if it fails to rectify within the time limit, the State Council's administrative institution staffing management authority shall recommend that the State Council or the relevant department of the State Council impose administrative sanctions on the directly responsible supervisors and other directly responsible personnel in accordance with the law:

(一)擅自设立司级内设机构的；

(1) Unauthorized establishment of department-level internal organs;

(二)擅自扩大职能的；

(2) Unauthorized expansion of functions;

(三)擅自变更机构名称的；

(3) Unauthorized change of the institution's name;

(四)擅自超过核定的编制使用工作人员的；

(4) Unauthorized employment of personnel exceeding the approved staffing quota;

(五)有违反机构设置和编制管理法律、行政法规的其他行为的。

(5) Other acts that violate laws and administrative regulations on institution establishment and staffing management.

地方各级人民政府行政机构的设置和编制管理办法另行制定。

Measures for the establishment and staffing management of administrative institutions of local people's governments at various levels shall be formulated separately.

国务院行政机构不得干预地方各级人民政府的行政机构设置和编制管理工作，不得要求地方各级人民政府设立与其业务对口的行政机构。

Administrative institutions of the State Council shall not interfere with the establishment and staffing management of administrative institutions of local people's governments at various levels, and shall not require local people's governments at various levels to establish administrative institutions corresponding to their functions.

本条例自发布之日起施行。

These Regulations shall come into force on the date of promulgation.
