Issued by the State Council on April 6, 1981
为了适当解决国家机关工作人员病假期间的生活困难问题，有利于病休人员早日恢复健康，根据按劳分配的原则，对国家机关工作人员病假期间生活待遇，作如下规定：
In order to appropriately solve the living difficulties of state organ staff during sick leave and to facilitate their early recovery, in accordance with the principle of distribution according to work, the following provisions are made regarding the living treatment of state organ staff during sick leave:
一、工作人员病假在两个月以内的，发给原工资。
Staff whose sick leave does not exceed two months shall receive their full original salary.
二、工作人员病假超过两个月的，从第三个月起按照下列标准发给病假期间工资：
Staff whose sick leave exceeds two months shall, starting from the third month, receive sick leave salary according to the following standards:
(一)工作年限不满十年的，发给本人工资的百分之九十；
For those with less than ten years of service, 90% of their personal salary shall be paid.
(二)工作年限满十年的，工资照发。
For those with ten or more years of service, full salary shall be paid.
三、工作人员病假超过六个月的，从第七个月起按照下列标准发给病假期间工资：
Staff whose sick leave exceeds six months shall, starting from the seventh month, receive sick leave salary according to the following standards:
(一)工作年限不满十年的，发给本人工资的百分之七十；
For those with less than ten years of service, 70% of their personal salary shall be paid.
(二)工作年限满十年和十年以上的，发给本人工资的百分之八十；
For those with ten or more years of service, 80% of their personal salary shall be paid.
(三)一九四五年九月二日以前参加革命工作的人员，发给本人工资的百分之九十。
For those who joined revolutionary work before September 2, 1945, 90% of their personal salary shall be paid.
上述(一)、(二)、(三)项工作人员中，获得省、市、自治区人民政府和国务院各部门授予的劳动英雄、劳动模范称号，仍然保持荣誉的，病假期间的工资，经过省、市、自治区人民政府和国务院各部门批准，可以适当提高。
Among the staff mentioned in items (1), (2), and (3) above, those who have been awarded the title of Labor Hero or Labor Model by the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, or various departments of the State Council and still maintain the honor may, upon approval by the said governments or departments, have their sick leave salary appropriately increased.
四、一九四九年九月底以前参加革命工作的行政公署副专员及相当职务或行政十四级以上的干部，一九四五年九月二日以前参加革命工作的县人民政府正副县长及相当职务或行政十八级以上的干部，一九三七年七月六日以前参加革命工作的工作人员，在病假期间工资照发。
The following personnel shall receive full salary during sick leave: deputy commissioners of administrative offices and equivalent positions or cadres at administrative level 14 or above who joined revolutionary work before the end of September 1949; county magistrates and deputy magistrates of people's governments of counties and equivalent positions or cadres at administrative level 18 or above who joined revolutionary work before September 2, 1945; and staff who joined revolutionary work before July 6, 1937.
五、病假期间工资低于三十元的按三十元发给，原工资低于三十元的发给原工资。
If the sick leave salary is lower than 30 yuan, it shall be paid at 30 yuan; if the original salary is lower than 30 yuan, the original salary shall be paid.
六、工作人员在病假期间，可以继续享受所在单位的生活福利待遇。
Staff during sick leave may continue to enjoy the living welfare benefits of their work unit.
七、工作人员病假期间享受本规定的生活待遇，应有医疗机构证明，并经主管领导机关批准。
To enjoy the living treatment under these provisions during sick leave, staff must have a medical certificate and obtain approval from the competent leading authority.
八、工作人员工作年限的计算，按照国务院现行有关规定办理。
The calculation of staff service years shall be handled in accordance with the relevant current provisions of the State Council.
九、国家机关所属事业单位可参照本规定执行。
Institutions affiliated with state organs may implement these provisions by reference.
十、本规定由国家人事局负责解释。
These provisions shall be interpreted by the State Personnel Bureau.
十一、本规定从发布之日起施行。一九五五年十二月二十九日国务院发布的《国家机关工作人员病假期间生活待遇试行办法》同时废止。
These provisions shall come into effect on the date of issuance. The "Interim Measures for Living Treatment of State Organ Staff During Sick Leave" issued by the State Council on December 29, 1955, shall be simultaneously abolished.
