总 则
General Provisions
为了规范保安服务活动，加强对从事保安服务的单位和保安员的管理，保护人身安全和财产安全，维护社会治安，制定本条例。
These Regulations are formulated to regulate security service activities, strengthen the management of units engaged in security services and security personnel, protect personal and property safety, and maintain public security.
本条例所称保安服务是指：
For the purposes of these Regulations, security services refer to:
(一)保安服务公司根据保安服务合同，派出保安员为客户单位提供的门卫、巡逻、守护、押运、随身护卫、安全检查以及安全技术防范、安全风险评估等服务；
(1) Services provided by security service companies by dispatching security personnel to client units under security service contracts, including gatekeeping, patrol, guarding, escort, personal protection, security inspection, and security technical prevention, security risk assessment, etc.;
(二)机关、团体、企业、事业单位招用人员从事的本单位门卫、巡逻、守护等安全防范工作；
(2) Security prevention work such as gatekeeping, patrol, and guarding conducted by state organs, organizations, enterprises, and institutions by recruiting personnel for their own units;
(三)物业服务企业招用人员在物业管理区域内开展的门卫、巡逻、秩序维护等服务。
(3) Services such as gatekeeping, patrol, and order maintenance provided by property service enterprises by recruiting personnel within the property management area.
前款第(二)项、第(三)项中的机关、团体、企业、事业单位和物业服务企业，统称自行招用保安员的单位。
The state organs, organizations, enterprises, institutions, and property service enterprises mentioned in items (2) and (3) of the preceding paragraph are collectively referred to as units that recruit security personnel on their own.
国务院公安部门负责全国保安服务活动的监督管理工作。县级以上地方人民政府公安机关负责本行政区域内保安服务活动的监督管理工作。
The public security department of the State Council is responsible for the supervision and management of security service activities nationwide. The public security organs of local people's governments at or above the county level are responsible for the supervision and management of security service activities within their respective administrative regions.
保安服务行业协会在公安机关的指导下，依法开展保安服务行业自律活动。
Security service industry associations shall, under the guidance of public security organs, carry out self-discipline activities in the security service industry in accordance with the law.
保安服务公司和自行招用保安员的单位(以下统称保安从业单位)应当建立健全保安服务管理制度、岗位责任制度和保安员管理制度，加强对保安员的管理、教育和培训，提高保安员的职业道德水平、业务素质和责任意识。
Security service companies and entities that employ security guards on their own (hereinafter collectively referred to as security service entities) shall establish and improve a security service management system, a post responsibility system, and a security guard management system, strengthen the management, education, and training of security guards, and enhance the professional ethics, business competence, and sense of responsibility of security guards.
保安从业单位应当依法保障保安员在社会保险、劳动用工、劳动保护、工资福利、教育培训等方面的合法权益。
Security service entities shall, in accordance with the law, protect the legitimate rights and interests of security guards in terms of social insurance, labor employment, labor protection, wages and benefits, and education and training.
保安服务活动应当文明、合法，不得损害社会公共利益或者侵犯他人合法权益。
Security service activities shall be conducted in a civilized and lawful manner, and shall not harm public interests or infringe upon the legitimate rights and interests of others.
保安员依法从事保安服务活动，受法律保护。
Security guards who engage in security service activities in accordance with the law are protected by law.
对在保护公共财产和人民群众生命财产安全、预防和制止违法犯罪活动中有突出贡献的保安从业单位和保安员，公安机关和其他有关部门应当给予表彰、奖励。
Public security organs and other relevant departments shall commend and reward security service entities and security guards who have made outstanding contributions in protecting public property and the safety of people's lives and property, and in preventing and stopping illegal and criminal activities.
保安服务公司
Security Service Companies
保安服务公司应当具备下列条件：
A security service company shall meet the following conditions:
(一)有不低于人民币100万元的注册资本；
(1) Having a registered capital of not less than RMB 1 million;
(二)拟任的保安服务公司法定代表人和主要管理人员应当具备任职所需的专业知识和有关业务工作经验，无被刑事处罚、劳动教养、收容教育、强制隔离戒毒或者被开除公职、开除军籍等不良记录；
(2) The proposed legal representative and key management personnel of the security service company shall possess the professional knowledge and relevant business work experience required for the position, and have no adverse records such as criminal punishment, re-education through labor, shelter and education, compulsory isolation for drug rehabilitation, or being discharged from public office or military service;
(三)有与所提供的保安服务相适应的专业技术人员，其中法律、行政法规有资格要求的专业技术人员，应当取得相应的资格；
(3) Having professional and technical personnel suitable for the security services provided, among which professional and technical personnel for whom laws and administrative regulations have qualification requirements shall obtain the corresponding qualifications.
(四)有住所和提供保安服务所需的设施、装备；
(4) Have a place of business and the facilities and equipment necessary for providing security services;
(五)有健全的组织机构和保安服务管理制度、岗位责任制度、保安员管理制度。
(5) Have a sound organizational structure and a security service management system, a post responsibility system, and a security guard management system.
申请设立保安服务公司，应当向所在地设区的市级人民政府公安机关提交申请书以及能够证明其符合本条例第八条规定条件的材料。
To apply for the establishment of a security service company, an application letter and materials proving that it meets the conditions set forth in Article 8 of these Regulations shall be submitted to the public security organ of the people's government of the city divided into districts where the company is located.
受理的公安机关应当自收到申请材料之日起15日内进行审核，并将审核意见报所在地的省、自治区、直辖市人民政府公安机关。省、自治区、直辖市人民政府公安机关应当自收到审核意见之日起15日内作出决定，对符合条件的，核发保安服务许可证；对不符合条件的，书面通知申请人并说明理由。
The public security organ that accepts the application shall conduct a review within 15 days from the date of receiving the application materials, and submit the review opinion to the public security organ of the people's government of the province, autonomous region, or municipality directly under the Central Government where the company is located. The public security organ of the province, autonomous region, or municipality directly under the Central Government shall make a decision within 15 days from the date of receiving the review opinion. If the conditions are met, it shall issue a security service license; if not, it shall notify the applicant in writing and explain the reasons.
从事武装守护押运服务的保安服务公司，应当符合国务院公安部门对武装守护押运服务的规划、布局要求，具备本条例第八条规定的条件，并符合下列条件：
A security service company engaged in armed escort services shall meet the planning and layout requirements of the public security department of the State Council for armed escort services, possess the conditions set forth in Article 8 of these Regulations, and also meet the following conditions:
(一)有不低于人民币1000万元的注册资本；
(1) Have a registered capital of not less than RMB 10 million;
(二)国有独资或者国有资本占注册资本总额的51%以上；
(2) Be wholly state-owned or have state-owned capital accounting for more than 51% of the total registered capital;
(三)有符合《专职守护押运人员枪支使用管理条例》规定条件的守护押运人员；
(3) Have escort personnel who meet the conditions stipulated in the Regulations on the Administration of the Use of Firearms by Full-time Escort Personnel;
(四)有符合国家标准或者行业标准的专用运输车辆以及通信、报警设备。
(4) Have specialized transport vehicles and communication and alarm equipment that meet national standards or industry standards.
申请设立从事武装守护押运服务的保安服务公司，应当向所在地设区的市级人民政府公安机关提交申请书以及能够证明其符合本条例第八条、第十条规定条件的材料。保安服务公司申请增设武装守护押运业务的，无需再次提交证明其符合本条例第八条规定条件的材料。
To apply for the establishment of a security service company engaged in armed escort services, an application letter and materials proving that it meets the conditions set forth in Articles 8 and 10 of these Regulations shall be submitted to the public security organ of the people's government of the city divided into districts where the company is located. If a security service company applies to add armed escort services, it does not need to submit materials proving that it meets the conditions set forth in Article 8 of these Regulations again.
受理的公安机关应当自收到申请材料之日起15日内进行审核，并将审核意见报所在地的省、自治区、直辖市人民政府公安机关。省、自治区、直辖市人民政府公安机关应当自收到审核意见之日起15日内作出决定，对符合条件的，核发从事武装守护押运业务的保安服务许可证或者在已有的保安服务许可证上增注武装守护押运服务；对不符合条件的，书面通知申请人并说明理由。
The public security organ that accepts the application shall conduct a review within 15 days from the date of receiving the application materials, and submit the review opinion to the public security organ of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located. The public security organ of the people's government of the province, autonomous region, or municipality directly under the Central Government shall make a decision within 15 days from the date of receiving the review opinion. For those that meet the conditions, it shall issue a security guard service license for armed escort and guard services or annotate the existing security guard service license with armed escort and guard services; for those that do not meet the conditions, it shall notify the applicant in writing and explain the reasons.
取得保安服务许可证的申请人，凭保安服务许可证到工商行政管理机关办理工商登记。取得保安服务许可证后超过6个月未办理工商登记的，取得的保安服务许可证失效。
An applicant who has obtained the security guard service license shall, with the security guard service license, go to the administrative authority for industry and commerce to handle industrial and commercial registration. If the applicant fails to complete industrial and commercial registration within 6 months after obtaining the security guard service license, the obtained security guard service license shall become invalid.
保安服务公司设立分公司的，应当向分公司所在地设区的市级人民政府公安机关备案。备案应当提供总公司的保安服务许可证和工商营业执照，总公司法定代表人、分公司负责人和保安员的基本情况。
If a security guard service company establishes a branch, it shall file a record with the public security organ of the people's government of the city divided into districts where the branch is located. The record shall provide the security guard service license and industrial and commercial business license of the parent company, and the basic information of the legal representative of the parent company, the person in charge of the branch, and the security guards.
保安服务公司的法定代表人变更的，应当经原审批公安机关审核，持审核文件到工商行政管理机关办理变更登记。
If the legal representative of a security guard service company changes, it shall be reviewed by the original approving public security organ, and then go to the administrative authority for industry and commerce to handle the change registration with the review document.
自行招用保安员的单位
Units that Employ Security Guards on Their Own
自行招用保安员的单位应当具有法人资格，有符合本条例规定条件的保安员，有健全的保安服务管理制度、岗位责任制度和保安员管理制度。
A unit that employs security guards on its own shall have legal person status, have security guards who meet the conditions prescribed in these Regulations, and have a sound security guard service management system, post responsibility system, and security guard management system.
娱乐场所应当依照《娱乐场所管理条例》的规定，从保安服务公司聘用保安员，不得自行招用保安员。
Entertainment venues shall, in accordance with the provisions of the Regulations on the Administration of Entertainment Venues, hire security guards from security guard service companies and shall not employ security guards on their own.
自行招用保安员的单位，应当自开始保安服务之日起30日内向所在地设区的市级人民政府公安机关备案，备案应当提供下列材料：
A unit that employs security guards on its own shall, within 30 days from the date of starting security guard services, file a record with the public security organ of the people's government of the city divided into districts where it is located. The record shall provide the following materials:
(一)法人资格证明；
(1) Proof of legal person status;
(二)法定代表人(主要负责人)、分管负责人和保安员的基本情况；
(2) Basic information of the legal representative (principal responsible person), the responsible person in charge, and the security guards.
(三)保安服务区域的基本情况；
(3) Basic information of the security service area;
(四)建立保安服务管理制度、岗位责任制度、保安员管理制度的情况。
(4) The establishment of security service management system, post responsibility system, and security guard management system.
自行招用保安员的单位不再招用保安员进行保安服务的，应当自停止保安服务之日起30日内到备案的公安机关撤销备案。
If a unit that employs security guards on its own no longer employs security guards to provide security services, it shall cancel the record with the public security authority where it was filed within 30 days from the date of cessation of security services.
自行招用保安员的单位不得在本单位以外或者物业管理区域以外提供保安服务。
A unit that employs security guards on its own shall not provide security services outside its own unit or outside the property management area.
保 安 员
Security Guards
年满18周岁，身体健康，品行良好，具有初中以上学历的中国公民可以申领保安员证，从事保安服务工作。申请人经设区的市级人民政府公安机关考试、审查合格并留存指纹等人体生物信息的，发给保安员证。
A Chinese citizen who has reached the age of 18, is in good health, has good conduct, and has at least a junior high school education may apply for a security guard certificate to engage in security guard services. The applicant shall be issued a security guard certificate after passing the examination and review conducted by the public security authority of the city divided into districts and having fingerprints and other human biological information retained.
提取、留存保安员指纹等人体生物信息的具体办法，由国务院公安部门规定。
The specific measures for collecting and retaining fingerprints and other human biological information of security guards shall be prescribed by the public security department of the State Council.
有下列情形之一的，不得担任保安员：
A person under any of the following circumstances shall not serve as a security guard:
(一)曾被收容教育、强制隔离戒毒、劳动教养或者3次以上行政拘留的；
(1) Has been subjected to shelter and education, compulsory isolation for drug rehabilitation, reeducation through labor, or administrative detention three times or more;
(二)曾因故意犯罪被刑事处罚的；
(2) Has been criminally punished for intentional crime;
(三)被吊销保安员证未满3年的；
(3) The security guard certificate has been revoked for less than 3 years;
(四)曾两次被吊销保安员证的。
(4) The security guard certificate has been revoked twice.
保安从业单位应当招用符合保安员条件的人员担任保安员，并与被招用的保安员依法签订劳动合同。保安从业单位及其保安员应当依法参加社会保险。
Security service entities shall employ persons who meet the conditions for security guards as security guards, and shall lawfully conclude labor contracts with the employed security guards. Security service entities and their security guards shall participate in social insurance in accordance with the law.
保安从业单位应当根据保安服务岗位需要定期对保安员进行法律、保安专业知识和技能培训。
Security service entities shall, based on the needs of security service posts, regularly provide training to security guards on laws, security expertise, and skills.
保安从业单位应当定期对保安员进行考核，发现保安员不合格或者严重违反管理制度，需要解除劳动合同的，应当依法办理。
Security service entities shall regularly assess security guards. If a security guard is found to be unqualified or has seriously violated management regulations, and the labor contract needs to be terminated, it shall be handled in accordance with the law.
保安从业单位应当根据保安服务岗位的风险程度为保安员投保意外伤害保险。
Security service entities shall, based on the risk level of security service posts, purchase accident insurance for security guards.
保安员因工伤亡的，依照国家有关工伤保险的规定享受工伤保险待遇；保安员牺牲被批准为烈士的，依照国家有关烈士褒扬的规定享受抚恤优待。
If a security guard is injured or dies due to work, they shall enjoy work-related injury insurance benefits in accordance with the state's regulations on work-related injury insurance; if a security guard dies in the line of duty and is approved as a martyr, they shall enjoy pension and preferential treatment in accordance with the state's regulations on martyr commendation.
保安服务
Security Services
保安服务公司提供保安服务应当与客户单位签订保安服务合同，明确规定服务的项目、内容以及双方的权利义务。保安服务合同终止后，保安服务公司应当将保安服务合同至少留存2年备查。
When providing security services, a security service company shall sign a security service contract with the client unit, clearly specifying the items and content of the service as well as the rights and obligations of both parties. After the termination of the security service contract, the security service company shall retain the security service contract for at least 2 years for future reference.
保安服务公司应当对客户单位要求提供的保安服务的合法性进行核查，对违法的保安服务要求应当拒绝，并向公安机关报告。
A security service company shall verify the legality of the security services requested by the client unit, shall reject illegal security service requests, and shall report to the public security organ.
设区的市级以上地方人民政府确定的关系国家安全、涉及国家秘密等治安保卫重点单位不得聘请外商投资的保安服务公司提供保安服务。
Key public security units designated by local people's governments at or above the level of a city divided into districts, which relate to national security or state secrets, shall not engage foreign-invested security service companies to provide security services.
保安服务公司派出保安员跨省、自治区、直辖市为客户单位提供保安服务的，应当向服务所在地设区的市级人民政府公安机关备案。备案应当提供保安服务公司的保安服务许可证和工商营业执照、保安服务合同、服务项目负责人和保安员的基本情况。
Where a security service company dispatches security guards across provinces, autonomous regions, or municipalities directly under the Central Government to provide services to a client, it shall file a record with the public security organ of the local people's government at the level of a city divided into districts where the service is provided. The record shall include the security service company's security service permit and business license, the security service contract, and basic information on the project leader and security guards.
保安服务公司应当按照保安服务业服务标准提供规范的保安服务，保安服务公司派出的保安员应当遵守客户单位的有关规章制度。客户单位应当为保安员从事保安服务提供必要的条件和保障。
A security service company shall provide standardized security services in accordance with the service standards of the security service industry. Security guards dispatched by the security service company shall comply with the relevant rules and regulations of the client. The client shall provide necessary conditions and guarantees for security guards to engage in security services.
保安服务中使用的技术防范产品，应当符合有关的产品质量要求。保安服务中安装监控设备应当遵守国家有关技术规范，使用监控设备不得侵犯他人合法权益或者个人隐私。
Technical prevention products used in security services shall meet relevant product quality requirements. The installation of surveillance equipment in security services shall comply with relevant national technical specifications, and the use of surveillance equipment shall not infringe upon the lawful rights and interests or personal privacy of others.
保安服务中形成的监控影像资料、报警记录，应当至少留存30日备查，保安从业单位和客户单位不得删改或者扩散。
Surveillance video materials and alarm records formed in security services shall be retained for at least 30 days for future reference, and security service entities and clients shall not delete or disseminate them.
保安从业单位对保安服务中获知的国家秘密、商业秘密以及客户单位明确要求保密的信息，应当予以保密。
Security service entities shall keep confidential any state secrets, trade secrets, and information that the client explicitly requires to be kept confidential that are obtained during the provision of security services.
保安从业单位不得指使、纵容保安员阻碍依法执行公务、参与追索债务、采用暴力或者以暴力相威胁的手段处置纠纷。
Security service entities shall not instruct or condone security guards to obstruct the lawful execution of official duties, participate in debt recovery, or use violence or threats of violence to handle disputes.
保安员上岗应当着保安员服装，佩带全国统一的保安服务标志。保安员服装和保安服务标志应当与人民解放军、人民武装警察和人民警察、工商税务等行政执法机关以及人民法院、人民检察院工作人员的制式服装、标志服饰有明显区别。
Security guards on duty shall wear security guard uniforms and bear the nationally unified security service insignia. The security guard uniforms and insignia shall be clearly distinguishable from the uniforms and insignia of the People's Liberation Army, the People's Armed Police, the People's Police, administrative law enforcement organs such as industry and commerce and taxation, and the staff of the People's Courts and People's Procuratorates.
保安员服装由全国保安服务行业协会推荐式样，由保安服务从业单位在推荐式样范围内选用。保安服务标志式样由全国保安服务行业协会确定。
The styles of security guard uniforms are recommended by the National Security Service Industry Association, and security service entities shall select from the recommended styles. The style of the security service insignia is determined by the National Security Service Industry Association.
保安从业单位应当根据保安服务岗位的需要为保安员配备所需的装备。保安服务岗位装备配备标准由国务院公安部门规定。
Security service entities shall equip security guards with necessary equipment according to the needs of the security service posts. The standards for equipping security service posts shall be prescribed by the public security department of the State Council.
在保安服务中，为履行保安服务职责，保安员可以采取下列措施：
In security services, to fulfill security service duties, security guards may take the following measures:
(一)查验出入服务区域的人员的证件，登记出入的车辆和物品；
(1) Check the credentials of persons entering and leaving the service area, and register vehicles and articles entering and leaving;
(二)在服务区域内进行巡逻、守护、安全检查、报警监控；
(2) Conduct patrols, guarding, security checks, and alarm monitoring within the service area;
(三)在机场、车站、码头等公共场所对人员及其所携带的物品进行安全检查，维护公共秩序；
(3) Conduct security checks on persons and their carried articles in public places such as airports, railway stations, and docks, to maintain public order;
(四)执行武装守护押运任务，可以根据任务需要设立临时隔离区，但应当尽可能减少对公民正常活动的妨碍。
(4) When performing armed escort and guard tasks, may set up temporary isolation zones as needed, but shall minimize interference with citizens' normal activities.
保安员应当及时制止发生在服务区域内的违法犯罪行为，对制止无效的违法犯罪行为应当立即报警，同时采取措施保护现场。
Security guards shall promptly stop illegal and criminal acts occurring within the service area; if such acts cannot be stopped, they shall immediately report to the police and take measures to protect the scene.
从事武装守护押运服务的保安员执行武装守护押运任务使用枪支，依照《专职守护押运人员枪支使用管理条例》的规定执行。
Security guards engaged in armed escort and guard services who use firearms when performing armed escort and guard tasks shall comply with the provisions of the Regulations on the Administration of the Use of Firearms by Full-time Escort and Guard Personnel.
保安员不得有下列行为：
Security guards shall not engage in the following acts:
(一)限制他人人身自由、搜查他人身体或者侮辱、殴打他人；
(1) Restrict others' personal freedom, search others' bodies, or insult, beat, or assault others;
(二)扣押、没收他人证件、财物；
(2) Confiscate or impound others' identification documents or property;
(三)阻碍依法执行公务；
(3) Obstructing the lawful execution of official duties;
(四)参与追索债务、采用暴力或者以暴力相威胁的手段处置纠纷；
(4) Participating in debt recovery, using violence or threats of violence to handle disputes;
(五)删改或者扩散保安服务中形成的监控影像资料、报警记录；
(5) Deleting or disseminating surveillance video footage or alarm records generated during security services;
(六)侵犯个人隐私或者泄露在保安服务中获知的国家秘密、商业秘密以及客户单位明确要求保密的信息；
(6) Infringing on personal privacy or disclosing state secrets, trade secrets, or information that the client unit explicitly requires to be kept confidential, obtained during security services;
(七)违反法律、行政法规的其他行为。
(7) Other acts that violate laws or administrative regulations.
保安员有权拒绝执行保安从业单位或者客户单位的违法指令。保安从业单位不得因保安员不执行违法指令而解除与保安员的劳动合同，降低其劳动报酬和其他待遇，或者停缴、少缴依法应当为其缴纳的社会保险费。
Security guards have the right to refuse to execute illegal instructions from the security service employer or client unit. The security service employer shall not terminate the labor contract with the security guard, reduce their labor remuneration or other benefits, or stop or reduce the social insurance premiums that should be paid for them, because the security guard refuses to execute illegal instructions.
保安培训单位
Security Training Units
保安培训单位应当具备下列条件：
A security training unit shall meet the following conditions:
(一)是依法设立的具有法人资格的学校、职业培训机构；
(1) It is a legally established school or vocational training institution with legal personality;
(二)有保安培训所需的专兼职师资力量；
(2) It has full-time and part-time teaching staff required for security training;
(三)有保安培训所需的场所、设施等教学条件。
(3) Have the necessary teaching conditions such as venues and facilities for security training.
从事保安培训的单位，应当自开展保安培训之日起30日内向所在地设区的市级人民政府公安机关备案，提交能够证明其符合本条例第三十二条规定条件的材料。
A unit engaged in security training shall, within 30 days from the date of commencing security training, file a record with the public security organ of the people's government at the city divided into districts level where it is located, and submit materials proving that it meets the conditions specified in Article 32 of these Regulations.
保安培训单位出资人、法定代表人（主要负责人）、住所、名称发生变化的，应当到原备案公安机关办理变更。
If the contributor, legal representative (principal responsible person), domicile, or name of a security training unit changes, it shall go through the change procedures with the original public security organ where the record was filed.
保安培训单位终止培训的，应当自终止培训之日起30日内到原备案公安机关撤销备案。
If a security training unit terminates training, it shall cancel the record with the original public security organ where the record was filed within 30 days from the date of termination.
从事武装守护押运服务的保安员的枪支使用培训，应当由人民警察院校、人民警察培训机构负责。承担培训工作的人民警察院校、人民警察培训机构应当向所在地的省、自治区、直辖市人民政府公安机关备案。
The firearms use training for security guards engaged in armed escort and transport services shall be conducted by people's police colleges or people's police training institutions. The people's police colleges or people's police training institutions undertaking the training shall file a record with the public security organ of the people's government of the province, autonomous region, or municipality directly under the Central Government where they are located.
保安培训单位应当按照保安员培训教学大纲制订教学计划，对接受培训的人员进行法律、保安专业知识和技能培训以及职业道德教育。
A security training unit shall formulate a teaching plan in accordance with the security guard training syllabus, and provide training on laws, security professional knowledge and skills, as well as professional ethics education to the persons receiving training.
保安员培训教学大纲由国务院公安部门审定。
The security guard training syllabus shall be approved by the public security department of the State Council.
监督管理
Supervision and Administration
公安机关应当指导保安从业单位建立健全保安服务管理制度、岗位责任制度、保安员管理制度和紧急情况应急预案，督促保安从业单位落实相关管理制度。
Public security organs shall guide security service units to establish and improve the security service management system, post responsibility system, security guard management system, and emergency plans, and urge security service units to implement relevant management systems.
保安从业单位、保安培训单位和保安员应当接受公安机关的监督检查。
Security service units, security training units, and security guards shall accept the supervision and inspection of public security organs.
公安机关建立保安服务监督管理信息系统，记录保安从业单位、保安培训单位和保安员的相关信息。
The public security organs shall establish a security service supervision and management information system to record relevant information about security service units, security training units, and security personnel.
公安机关应当对提取、留存的保安员指纹等人体生物信息予以保密。
The public security organs shall keep confidential the biometric information such as fingerprints collected and retained from security personnel.
公安机关的人民警察对保安从业单位、保安培训单位实施监督检查应当出示证件，对监督检查中发现的问题，应当督促其整改。监督检查的情况和处理结果应当如实记录，并由公安机关的监督检查人员和保安从业单位、保安培训单位的有关负责人签字。
People's police of the public security organs shall present their credentials when conducting supervision and inspection of security service units and security training units, and shall urge them to rectify any problems found during the inspection. The circumstances of the inspection and the results of the handling shall be truthfully recorded and signed by the supervising and inspecting personnel of the public security organ and the relevant responsible persons of the security service unit or security training unit.
县级以上人民政府公安机关应当公布投诉方式，受理社会公众对保安从业单位、保安培训单位和保安员的投诉。接到投诉的公安机关应当及时调查处理，并反馈查处结果。
The public security organs of the people's governments at or above the county level shall publish complaint methods and accept complaints from the public against security service units, security training units, and security personnel. The public security organ that receives a complaint shall promptly investigate and handle it, and provide feedback on the results of the investigation.
国家机关及其工作人员不得设立保安服务公司，不得参与或者变相参与保安服务公司的经营活动。
State organs and their staff shall not establish security service companies, nor participate or indirectly participate in the business activities of security service companies.
法律责任
Legal Liability
任何组织或者个人未经许可，擅自从事保安服务的，依法给予治安管理处罚，并没收违法所得；构成犯罪的，依法追究刑事责任。
Any organization or individual that engages in security services without permission shall be given a public security penalty in accordance with the law, and the illegal gains shall be confiscated; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
保安从业单位有下列情形之一的，责令限期改正，给予警告；情节严重的，并处1万元以上5万元以下的罚款；有违法所得的，没收违法所得：
If a security service unit has any of the following circumstances, it shall be ordered to make corrections within a time limit and given a warning; if the circumstances are serious, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall also be imposed; if there are illegal gains, the illegal gains shall be confiscated:
(一)保安服务公司法定代表人变更未经公安机关审核的；
(1) The change of the legal representative of a security service company has not been reviewed by the public security organ;
(二)未按照本条例的规定进行备案或者撤销备案的；
(2) Failure to file or cancel the filing in accordance with the provisions of these Regulations;
(三)自行招用保安员的单位在本单位以外或者物业管理区域以外开展保安服务的；
(3) A unit that employs security guards on its own provides security services outside its own premises or outside the property management area;
(四)招用不符合本条例规定条件的人员担任保安员的；
(4) Employing persons who do not meet the conditions prescribed in these Regulations as security guards;
(五)保安服务公司未对客户单位要求提供的保安服务的合法性进行核查的，或者未将违法的保安服务要求向公安机关报告的；
(5) A security service company fails to verify the legality of the security service requested by the client unit, or fails to report illegal security service requests to the public security organ;
(六)保安服务公司未按照本条例的规定签订、留存保安服务合同的；
(6) A security service company fails to sign or retain a security service contract in accordance with these Regulations;
(七)未按照本条例的规定留存保安服务中形成的监控影像资料、报警记录的。
(7) Failing to retain surveillance video materials and alarm records formed in the provision of security services in accordance with these Regulations.
客户单位未按照本条例的规定留存保安服务中形成的监控影像资料、报警记录的，依照前款规定处罚。
If a client unit fails to retain surveillance video materials and alarm records formed in the provision of security services in accordance with these Regulations, it shall be punished in accordance with the preceding paragraph.
保安从业单位有下列情形之一的，责令限期改正，处2万元以上10万元以下的罚款；违反治安管理的，依法给予治安管理处罚；构成犯罪的，依法追究直接负责的主管人员和其他直接责任人员的刑事责任：
If a security service entity has any of the following circumstances, it shall be ordered to make corrections within a time limit and be fined not less than 20,000 yuan but not more than 100,000 yuan; if it violates public security administration, it shall be given a public security administration penalty according to law; if a crime is constituted, the directly responsible supervisor and other directly responsible personnel shall be investigated for criminal liability according to law:
(一)泄露在保安服务中获知的国家秘密、商业秘密以及客户单位明确要求保密的信息的；
(1) Disclosing state secrets, commercial secrets, or information that the client unit explicitly requires to be kept confidential that were learned during the provision of security services;
(二)使用监控设备侵犯他人合法权益或者个人隐私的；
(2) Using surveillance equipment to infringe upon the lawful rights and interests or personal privacy of others;
(三)删改或者扩散保安服务中形成的监控影像资料、报警记录的；
(3) Deleting, modifying, or disseminating surveillance video materials or alarm records formed during the provision of security services;
(四)指使、纵容保安员阻碍依法执行公务、参与追索债务、采用暴力或者以暴力相威胁的手段处置纠纷的；
(4) Directing or condoning security guards to obstruct lawful official duties, participate in debt recovery, or use violence or threats of violence to handle disputes;
(五)对保安员疏于管理、教育和培训，发生保安员违法犯罪案件，造成严重后果的。
(5) Neglecting management, education, and training of security guards, resulting in serious consequences due to security guards' illegal or criminal acts.
客户单位删改或者扩散保安服务中形成的监控影像资料、报警记录的，依照前款规定处罚。
If a client unit deletes or disseminates surveillance video footage or alarm records generated during security services, it shall be penalized according to the preceding paragraph.
保安从业单位因保安员不执行违法指令而解除与保安员的劳动合同，降低其劳动报酬和其他待遇，或者停缴、少缴依法应当为其缴纳的社会保险费的，对保安从业单位的处罚和对保安员的赔偿依照有关劳动合同和社会保险的法律、行政法规的规定执行。
If a security service unit terminates a labor contract, reduces labor remuneration or other benefits, or stops or reduces social insurance contributions for a security guard because the guard refused to execute an illegal instruction, the penalties for the security service unit and compensation to the security guard shall be determined in accordance with labor contract and social insurance laws and administrative regulations.
保安员有下列行为之一的，由公安机关予以训诫；情节严重的，吊销其保安员证；违反治安管理的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任：
If a security guard commits any of the following acts, the public security organ shall give a reprimand; if the circumstances are serious, the security guard's certificate shall be revoked; if the act violates public security administration, a public security penalty shall be imposed according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)限制他人人身自由、搜查他人身体或者侮辱、殴打他人的；
(1) Restricting others' personal freedom, searching others' bodies, or insulting or beating others;
(二)扣押、没收他人证件、财物的；
(2) Seizing or confiscating others' documents or property;
(三)阻碍依法执行公务的；
(3) Obstructing lawful official duties;
(四)参与追索债务、采用暴力或者以暴力相威胁的手段处置纠纷的；
(4) Participating in debt recovery, or using violence or threats of violence to handle disputes;
(五)删改或者扩散保安服务中形成的监控影像资料、报警记录的；
(5) Deleting or disseminating surveillance video footage or alarm records generated during security services;
(六)侵犯个人隐私或者泄露在保安服务中获知的国家秘密、商业秘密以及客户单位明确要求保密的信息的；
(6) Infringing upon personal privacy or disclosing state secrets, commercial secrets, or information that the client unit explicitly requires to be kept confidential, which is obtained during security services;
(七)有违反法律、行政法规的其他行为的。
(7) Other acts that violate laws or administrative regulations.
从事武装守护押运的保安员违反规定使用枪支的，依照《专职守护押运人员枪支使用管理条例》的规定处罚。
If a security guard engaged in armed escort and guard duties uses firearms in violation of regulations, punishment shall be imposed in accordance with the provisions of the Regulations on the Management of the Use of Firearms by Full-time Escort and Guard Personnel.
保安员在保安服务中造成他人人身伤亡、财产损失的，由保安从业单位赔付；保安员有故意或者重大过失的，保安从业单位可以依法向保安员追偿。
If a security guard causes personal injury or property loss to others during security services, the security service employing unit shall compensate; if the security guard acted intentionally or with gross negligence, the security service employing unit may seek recourse from the security guard in accordance with the law.
从事保安培训的单位有下列情形之一的，责令限期改正，给予警告；情节严重的，并处1万元以上5万元以下的罚款：
If a unit engaged in security training falls under any of the following circumstances, it shall be ordered to make corrections within a specified period and given a warning; if the circumstances are serious, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall also be imposed:
（一）未按照本条例的规定进行备案或者办理变更的；
(1) Failing to file for record or handle changes in accordance with the provisions of these Regulations;
（二）不符合本条例规定条件的；
(2) Not meeting the conditions prescribed by these Regulations;
（三）隐瞒有关情况、提供虚假材料或者拒绝提供反映其活动情况的真实材料的；
(3) Concealing relevant information, providing false materials, or refusing to provide true materials reflecting its activities;
（四）未按照本条例规定开展保安培训的。
(4) Failing to conduct security training in accordance with the provisions of these Regulations.
以保安培训为名进行诈骗活动的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
If fraudulent activities are carried out under the guise of security training, public security penalties shall be imposed in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
国家机关及其工作人员设立保安服务公司，参与或者变相参与保安服务公司经营活动的，对直接负责的主管人员和其他直接责任人员依法给予处分。
Where state organs and their staff establish a security service company, or participate in or covertly participate in the business activities of a security service company, the directly responsible supervisors and other directly responsible personnel shall be given sanctions according to law.
公安机关的人民警察在保安服务活动监督管理工作中滥用职权、玩忽职守、徇私舞弊的，依法给予处分；构成犯罪的，依法追究刑事责任。
Where people's police of the public security organs abuse their powers, neglect their duties, or engage in malpractice for personal gain in the supervision and administration of security service activities, they shall be given sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law.
附 则
Supplementary Provisions
保安服务许可证、保安员证的式样由国务院公安部门规定。
The format of the security service license and the security guard certificate shall be prescribed by the public security department of the State Council.
本条例施行前已经设立的保安服务公司，应当自本条例施行之日起6个月内重新申请保安服务许可证。本条例施行前自行招用保安员的单位，应当自本条例施行之日起3个月内向公安机关备案。
Security service companies already established before the implementation of these Regulations shall re-apply for a security service license within six months from the date of implementation of these Regulations. Units that have already recruited security guards on their own before the implementation of these Regulations shall file a record with the public security organ within three months from the date of implementation of these Regulations.
本条例施行前已经从事保安服务的保安员，自本条例施行之日起1年内由保安员所在单位组织培训，经设区的市级人民政府公安机关考试、审查合格并留存指纹等人体生物信息的，发给保安员证。
Security guards who have already engaged in security services before the implementation of these Regulations shall, within one year from the date of implementation of these Regulations, be organized for training by the unit where they work, and after passing the examination and review conducted by the public security organ of the city divided into districts and having their fingerprints and other human biological information collected, shall be issued a security guard certificate.
本条例自2010年1月1日起施行。
These Regulations shall come into force as of January 1, 2010.
