总则
General Provisions
为了维护武器装备科研生产秩序，加强武器装备科研生产安全保密管理，保证武器装备质量合格稳定，满足国防建设的需要，制定本条例。
These Regulations are formulated to maintain the order of scientific research and production of weapons and equipment, strengthen the safety and confidentiality management of scientific research and production of weapons and equipment, ensure the quality and stability of weapons and equipment, and meet the needs of national defense construction.
国家对列入武器装备科研生产许可目录(以下简称许可目录)的武器装备科研生产活动实行许可管理。但是，专门的武器装备科学研究活动除外。
The State implements permit management for scientific research and production activities of weapons and equipment listed in the Catalog of Permits for Scientific Research and Production of Weapons and Equipment (hereinafter referred to as the Permit Catalog). However, specialized scientific research activities on weapons and equipment are excluded.
许可目录由国务院国防科技工业主管部门会同中国人民解放军总装备部(以下简称总装备部)和军工电子行业主管部门共同制定，并适时调整。许可目录的制定和调整，应当征求国务院有关部门和军队有关部门的意见。
The Permit Catalog shall be jointly formulated by the competent department of defense science, technology and industry of the State Council, the General Armament Department of the People's Liberation Army (hereinafter referred to as the General Armament Department), and the competent department of the military electronics industry, and shall be adjusted in a timely manner. The formulation and adjustment of the Permit Catalog shall solicit opinions from relevant departments of the State Council and relevant departments of the military.
武器装备科研生产许可，应当在许可目录所确定的范围内实行分类管理。
Permits for scientific research and production of weapons and equipment shall be subject to classified management within the scope determined by the Permit Catalog.
未取得武器装备科研生产许可，不得从事许可目录所列的武器装备科研生产活动。但是，经国务院、中央军事委员会批准的除外。
Without obtaining a permit for scientific research and production of weapons and equipment, no entity may engage in scientific research and production activities of weapons and equipment listed in the Permit Catalog, except as approved by the State Council and the Central Military Commission.
武器装备科研生产许可管理，应当遵循统筹兼顾、合理布局、鼓励竞争、安全保密的原则。
The management of permits for scientific research and production of weapons and equipment shall follow the principles of overall planning, rational layout, encouraging competition, and safety and confidentiality.
国务院国防科技工业主管部门，依照本条例规定对全国的武器装备科研生产许可实施监督管理。
The competent department of defense science, technology and industry of the State Council shall, in accordance with these Regulations, supervise and manage the permits for scientific research and production of weapons and equipment nationwide.
总装备部协同国务院国防科技工业主管部门对全国的武器装备科研生产许可实施监督管理。
The General Armament Department shall cooperate with the competent department of defense science, technology and industry of the State Council in supervising and managing the permits for scientific research and production of weapons and equipment nationwide.
省、自治区、直辖市人民政府负责国防科技工业管理的部门，依照本条例规定对本行政区域的武器装备科研生产许可实施监督管理。
The departments responsible for the management of defense science, technology and industry of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, in accordance with these Regulations, supervise and manage the permits for scientific research and production of weapons and equipment within their respective administrative regions.
取得武器装备科研生产许可的单位，应当在许可范围内从事武器装备科研生产活动，按照国家要求或者合同约定提供合格的科研成果和武器装备。
Entities that have obtained permits for scientific research and production of weapons and equipment shall engage in scientific research and production activities of weapons and equipment within the scope of the permit, and provide qualified scientific research results and weapons and equipment in accordance with national requirements or contractual agreements.
许可程序
Permit Procedures
申请武器装备科研生产许可的单位，应当符合下列条件：
An entity applying for a permit for scientific research and production of weapons and equipment shall meet the following conditions:
(一)具有法人资格；
(1) Having legal personality;
(二)有与申请从事的武器装备科研生产活动相适应的专业技术人员；
(2) Having professional and technical personnel suitable for the applied scientific research and production activities of weapons and equipment;
(三)有与申请从事的武器装备科研生产活动相适应的科研生产条件和检验检测、试验手段；
(3) Having scientific research and production conditions, inspection, testing, and experimentation means suitable for the applied scientific research and production activities of weapons and equipment;
(四)有与申请从事的武器装备科研生产活动相适应的技术和工艺；
(4) Having technologies and processes suitable for the applied scientific research and production activities of weapons and equipment;
(五)经评定合格的质量管理体系；
(5) Having a quality management system that has been evaluated as qualified;
(六)与申请从事的武器装备科研生产活动相适应的安全生产条件；
(6) Having production safety conditions suitable for the applied scientific research and production activities of weapons and equipment;
(七)有与申请从事的武器装备科研生产活动相适应的保密资格。
(7) Having confidentiality qualifications suitable for the applied scientific research and production activities of weapons and equipment.
申请武器装备科研生产许可的单位，应当向所在地的省、自治区、直辖市人民政府负责国防科技工业管理的部门提出申请。
An entity applying for a permit for scientific research and production of weapons and equipment shall submit an application to the department responsible for the management of defense science, technology and industry of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located.
许可目录规定应当向国务院国防科技工业主管部门申请武器装备科研生产许可的，应当直接向国务院国防科技工业主管部门提出申请，并将申请材料同时报送总装备部。
If the Permit Catalog stipulates that an application for a permit for scientific research and production of weapons and equipment shall be submitted to the competent department of defense science, technology and industry of the State Council, the application shall be submitted directly to the competent department of defense science, technology and industry of the State Council, and the application materials shall be simultaneously submitted to the General Armament Department.
国务院国防科技工业主管部门和省、自治区、直辖市人民政府负责国防科技工业管理的部门收到申请后，应当依照《中华人民共和国行政许可法》规定的程序办理。
Upon receiving an application, the competent department of defense science, technology and industry of the State Council and the departments responsible for the management of defense science, technology and industry of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall handle the matter in accordance with the procedures stipulated in the Administrative Permit Law of the People's Republic of China.
省、自治区、直辖市人民政府负责国防科技工业管理的部门组织对申请单位进行审查，应当征求中国人民解放军派驻的军事代表机构(以下简称军事代表机构)的意见，并自受理申请之日起30日内完成审查，将审查意见和全部申请材料报送国务院国防科技工业主管部门，同时报送总装备部。
The department responsible for the management of defense science, technology and industry of the people's government of a province, autonomous region, or municipality directly under the Central Government shall organize the review of the applicant entity, shall solicit opinions from the military representative office dispatched by the People's Liberation Army (hereinafter referred to as the military representative office), and shall complete the review within 30 days from the date of accepting the application, and submit the review opinions and all application materials to the competent department of defense science, technology and industry of the State Council, while simultaneously submitting them to the General Armament Department.
国务院国防科技工业主管部门受理申请后，应当进行审查，并自受理申请之日起60日内或者自收到省、自治区、直辖市人民政府负责国防科技工业管理的部门报送的审查意见和全部申请材料之日起30日内，做出决定。做出准予许可决定的，应当自做出决定之日起10日内向提出申请的单位颁发武器装备科研生产许可证；做出不准予许可决定的，应当书面通知提出申请的单位，并说明理由。
After accepting an application, the competent department of science, technology and industry for national defense of the State Council shall conduct a review and make a decision within 60 days from the date of accepting the application, or within 30 days from the date of receiving the review opinion and all application materials submitted by the department responsible for the administration of science, technology and industry for national defense of the people's government of the province, autonomous region, or municipality directly under the Central Government. If a decision to grant the permit is made, a weapons and equipment scientific research and production permit shall be issued to the applicant unit within 10 days from the date of the decision; if a decision not to grant the permit is made, the applicant unit shall be notified in writing with reasons stated.
国务院国防科技工业主管部门在做出决定前，应当书面征求总装备部的意见，总装备部应当在10日内回复意见。
Before making a decision, the competent department of science, technology and industry for national defense of the State Council shall seek the opinion of the General Armaments Department in writing, and the General Armaments Department shall reply within 10 days.
国务院国防科技工业主管部门根据国家武器装备科研生产能力布局的要求，按照武器装备科研生产的实际需要，经征求总装备部意见，可以对有特殊要求的武器装备科研生产许可做出数量限制。
The competent department of science, technology and industry for national defense of the State Council may, in accordance with the requirements of the national weapons and equipment scientific research and production capacity layout and the actual needs of weapons and equipment scientific research and production, and after soliciting the opinion of the General Armaments Department, impose quantity restrictions on permits for scientific research and production of weapons and equipment with special requirements.
武器装备科研生产许可证应当载明单位名称、法定代表人、许可专业或者产品名称、证书编号、发证日期、有效期等相关内容。
A weapons and equipment scientific research and production permit shall contain the unit name, legal representative, permitted specialty or product name, certificate number, issuance date, validity period, and other relevant content.
武器装备科研生产许可证格式由国务院国防科技工业主管部门规定。
The format of the weapons and equipment scientific research and production permit shall be prescribed by the competent department of science, technology and industry for national defense of the State Council.
取得武器装备科研生产许可的单位应当妥善保管武器装备科研生产许可证，严格保密管理，不得泄露武器装备科研生产许可证载明的相关内容。
Units that have obtained a weapons and equipment scientific research and production permit shall properly keep the permit, strictly manage confidentiality, and shall not disclose the relevant content contained in the permit.
取得武器装备科研生产许可的单位应当在武器装备科研生产合同、产品出厂证书上标注武器装备科研生产许可证编号。
Units that have obtained a weapons and equipment scientific research and production permit shall mark the permit number on weapons and equipment scientific research and production contracts and product certificates offactory delivery.
任何单位和个人不得伪造、变造武器装备科研生产许可证。取得武器装备科研生产许可的单位不得出租、出借或者以其他方式转让武器装备科研生产许可证。
No unit or individual may forge or alter a weapons and equipment scientific research and production permit. Units that have obtained a weapons and equipment scientific research and production permit shall not rent, lend, or transfer the permit by other means.
国务院国防科技工业主管部门和省、自治区、直辖市人民政府负责国防科技工业管理的部门，应当将办理武器装备科研生产许可的有关材料及时归档，并妥善保存，严格保密。
The competent department of science, technology and industry for national defense of the State Council and the department responsible for the administration of science, technology and industry for national defense of the people's government of the province, autonomous region, or municipality directly under the Central Government shall promptly archive the relevant materials for handling weapons and equipment scientific research and production permits, properly keep them, and strictly maintain confidentiality.
取得武器装备科研生产许可并承担武器装备科研生产任务的单位，应当接受军事代表机构的监督。
Units that have obtained a weapons and equipment scientific research and production permit and undertake weapons and equipment scientific research and production tasks shall accept the supervision of military representative offices.
保密管理
Confidentiality Management
取得武器装备科研生产许可的单位应当遵守国家保密法律、法规和有关规定，建立健全保密管理制度，按照积极防范、突出重点、严格标准、明确责任的原则，对落实保密管理制度的情况进行定期或者不定期的检查，及时研究解决保密工作中的问题。
Units that have obtained a weapons and equipment scientific research and production permit shall comply with national confidentiality laws, regulations, and relevant provisions, establish and improve confidentiality management systems, conduct regular or irregular inspections on the implementation of confidentiality management systems in accordance with the principles of active prevention, highlighting key points, strict standards, and clear responsibilities, and promptly study and solve problems in confidentiality work.
取得武器装备科研生产许可的单位应当建立保密管理领导责任制，其主要负责人应当加强对本单位保密工作的组织领导，切实履行保密职责和义务。
Units that have obtained a weapons and equipment scientific research and production permit shall establish a leadership responsibility system for confidentiality management, and their principal responsible persons shall strengthen the organization and leadership of the unit's confidentiality work and earnestly fulfill confidentiality duties and obligations.
取得武器装备科研生产许可的单位应当设立保密工作机构，配备保密管理人员。
Units that have obtained a weapons and equipment scientific research and production permit shall establish a confidentiality work organization and be equipped with confidentiality management personnel.
保密管理人员应当熟悉国家保密法律、法规和有关规定，具备保密管理工作能力，掌握保密技术基础知识，并经过必要的培训、考核。
Confidentiality management personnel shall be familiar with national confidentiality laws, regulations, and relevant provisions, possess the ability to manage confidentiality work, master basic knowledge of confidentiality technology, and undergo necessary training and assessment.
取得武器装备科研生产许可的单位应当与承担武器装备科研生产任务的涉及国家秘密人员签订岗位保密责任书，明确岗位保密责任，并对其进行经常性的保密教育培训。
Units that have obtained a weapons and equipment scientific research and production permit shall sign a post confidentiality responsibility letter with personnel involved in state secrets who undertake weapons and equipment scientific research and production tasks, specifying post confidentiality responsibilities, and provide them with regular confidentiality education and training.
涉及国家秘密人员应当熟悉国家保密法律、法规和有关规定，严格按照岗位保密责任书的要求，履行保密义务。
Personnel involved in state secrets shall be familiar with national confidentiality laws, regulations, and relevant provisions, and strictly fulfill confidentiality obligations in accordance with the requirements of the post confidentiality responsibility letter.
取得武器装备科研生产许可的单位应当依照国家保密法律、法规和有关规定，制作、收发、传递、使用、复制、保存和销毁国家秘密载体，严格控制接触国家秘密载体的人员范围。
Units that have obtained a weapons and equipment scientific research and production permit shall, in accordance with national confidentiality laws, regulations, and relevant provisions, produce, send, transmit, use, copy, store, and destroy state secret carriers, and strictly control the scope of personnel who have access to state secret carriers.
取得武器装备科研生产许可的单位应当采取措施，在涉及国家秘密的要害部门、部位设置安全可靠的保密防护设施。
Units that have obtained a weapons and equipment scientific research and production permit shall take measures to set up safe and reliable confidentiality protection facilities in key departments and locations involving state secrets.
取得武器装备科研生产许可的单位应当依照国家保密法律、法规和有关规定对涉及国家秘密的计算机和信息系统采取安全保密防护措施，不得使用无安全保密保障的设备处理、传输、存储国家秘密信息。
Units that have obtained a weapons and equipment scientific research and production permit shall, in accordance with national confidentiality laws, regulations, and relevant provisions, adopt security and confidentiality protection measures for computers and information systems involving state secrets, and shall not use equipment without security and confidentiality guarantees to process, transmit, or store state secret information.
取得武器装备科研生产许可的单位举办涉及国家秘密的重大会议或者活动，应当制订专项保密工作方案，并确定专人负责保密工作。涉及国家秘密的会议必须在有安全保密保障措施的场所进行，并严格控制与会人员的范围。
Units that have obtained a weapons and equipment scientific research and production permit that hold major meetings or activities involving state secrets shall formulate a special confidentiality work plan and designate a person responsible for confidentiality work. Meetings involving state secrets must be held in venues with security and confidentiality protection measures, and the scope of participants shall be strictly controlled.
取得武器装备科研生产许可的单位在对外交流、合作和谈判等活动中，应当保守国家秘密，对外提供有关文件资料和实物样品，必须按照规定的程序事先经过批准。
Units that have obtained a weapons and equipment scientific research and production permit shall maintain state secrets during foreign exchanges, cooperation, negotiations, and other activities. Providing relevant documents, materials, and physical samples to foreign parties must be approved in advance in accordance with prescribed procedures.
取得武器装备科研生产许可的单位应当依照国家保密法律、法规和有关规定建立保密档案制度，对涉及国家秘密人员的管理、泄密事件查处等情况进行记录，及时归档，并对涉及国家秘密的档案实施有效管理。
Units that have obtained a weapons and equipment scientific research and production permit shall, in accordance with national confidentiality laws, regulations, and relevant provisions, establish a confidentiality archive system, record the management of personnel involved in state secrets and the investigation of leakage incidents, promptly archive them, and effectively manage archives involving state secrets.
法律责任
Legal Liability
未依照本条例规定申请取得武器装备科研生产许可，擅自从事许可目录范围内武器装备科研生产活动的，责令停止违法行为，没收违法生产的产品，并处违法生产产品货值金额1倍以上3倍以下罚款；有违法所得的，没收违法所得。
Anyone who engages in scientific research and production activities of weapons and equipment within the scope of the permit catalog without applying for and obtaining a weapons and equipment scientific research and production permit in accordance with these Regulations shall be ordered to cease the illegal act, the illegally produced products shall be confiscated, and a fine of not less than one time but not more than three times the value of the illegally produced products shall be imposed; if there is illegal income, the illegal income shall be confiscated.
取得武器装备科研生产许可的单位，出租、出借或者以其他方式转让武器装备科研生产许可证的，处10万元罚款；情节严重的，吊销武器装备科研生产许可证。违法接受并使用他人提供的武器装备科研生产许可证的，责令停止武器装备生产活动，没收违法生产的产品，并处违法生产产品货值金额1倍以上3倍以下罚款；有违法所得的，没收违法所得。
If a unit that has obtained a weapons and equipment scientific research and production permit leases, lends, or otherwise transfers the permit, it shall be fined 100,000 yuan; if the circumstances are serious, the permit shall be revoked. If a unit illegally accepts and uses another's permit, it shall be ordered to stop production activities, the illegally produced products shall be confiscated, and a fine of 1 to 3 times the value of the illegally produced products shall be imposed; if there is illegal income, the illegal income shall be confiscated.
伪造、变造武器装备科研生产许可证的，责令停止违法行为，处10万元罚款；有违法所得的，没收违法所得。
If a weapons and equipment scientific research and production permit is forged or altered, the illegal act shall be ordered to cease, a fine of 100,000 yuan shall be imposed; if there is illegal income, the illegal income shall be confiscated.
以欺骗、贿赂等不正当手段取得武器装备科研生产许可的，处5万元以上20万元以下罚款，并依照《中华人民共和国行政许可法》的有关规定处理。
If a weapons and equipment scientific research and production permit is obtained by improper means such as fraud or bribery, a fine of 50,000 to 200,000 yuan shall be imposed, and the matter shall be handled in accordance with the relevant provisions of the Administrative License Law of the People's Republic of China.
国务院国防科技工业主管部门和省、自治区、直辖市人民政府负责国防科技工业管理的部门及其工作人员违反本条例规定，有下列情形之一的，由同级监察机关责令改正；情节严重的，对直接负责的主管人员和其他直接责任人员依法给予处分：
If the State Administration of Science, Technology and Industry for National Defense and the departments responsible for the administration of science, technology and industry for national defense of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, and their staff, violate these regulations in any of the following circumstances, the supervisory authority at the same level shall order correction; if the circumstances are serious, the directly responsible supervisors and other directly responsible personnel shall be given sanctions according to law:
(一)对符合本条例规定条件的申请不予受理的；
(1) Failing to accept an application that meets the conditions specified in these regulations;
(二)未依法说明不准予许可的理由的。
(2) Failing to explain the reasons for not granting the permit according to law.
国务院国防科技工业主管部门和省、自治区、直辖市人民政府负责国防科技工业管理的部门有下列情形之一的，由同级监察机关责令改正，对直接负责的主管人员和其他直接责任人员依法给予处分：
If the State Administration of Science, Technology and Industry for National Defense and the departments responsible for the administration of science, technology and industry for national defense of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government have any of the following circumstances, the supervisory authority at the same level shall order correction, and the directly responsible supervisors and other directly responsible personnel shall be given sanctions according to law:
(一)对不符合本条例规定条件的申请人准予许可或者超越法定职权做出准予许可决定的；
(1) Granting a permit to an applicant who does not meet the conditions specified in these regulations or making a decision to grant a permit beyond the statutory authority;
(二)对符合本条例规定条件的申请人不准予许可或者不在法定期限内做出准予许可决定的；
(2) Failing to grant a permit to an applicant who meets the conditions specified in these regulations or failing to make a decision to grant a permit within the statutory time limit;
(三)发现未依照本条例规定申请取得武器装备科研生产许可而擅自从事列入许可目录的武器装备科研生产活动，不及时依法查处的。
(3) Discovering that a unit has engaged in weapons and equipment scientific research and production activities included in the permit catalog without applying for a permit in accordance with these regulations, and failing to investigate and deal with it in a timely manner according to law.
取得武器装备科研生产许可的单位违反本条例第十九条、第二十条、第二十一条、第二十二条、第二十八条规定的，责令限期改正；逾期未改正的，处5万元以上20万元以下罚款，对直接负责的主管人员和其他直接责任人员依法给予处分。
If a unit that has obtained a weapons and equipment scientific research and production permit violates the provisions of Articles 19, 20, 21, 22, and 28 of these regulations, it shall be ordered to correct within a time limit; if it fails to correct within the time limit, a fine of 50,000 to 200,000 yuan shall be imposed, and the directly responsible supervisors and other directly responsible personnel shall be given sanctions according to law.
取得武器装备科研生产许可的单位违反本条例第二十三条、第二十四条、第二十五条、第二十六条、第二十七条规定的，责令改正，处5万元以上20万元以下罚款，对直接负责的主管人员和其他直接责任人员依法给予处分；情节严重的，责令停业整顿直至吊销武器装备科研生产许可证。
If a unit that has obtained a weapons and equipment scientific research and production permit violates the provisions of Articles 23, 24, 25, 26, and 27 of these regulations, it shall be ordered to correct, a fine of 50,000 to 200,000 yuan shall be imposed, and the directly responsible supervisors and other directly responsible personnel shall be given sanctions according to law; if the circumstances are serious, it shall be ordered to suspend operations for rectification until the weapons and equipment scientific research and production permit is revoked.
取得武器装备科研生产许可的单位违反本条例规定，被吊销武器装备科研生产许可证的，在3年内不得再次申请武器装备科研生产许可。
If a unit that has obtained a weapons and equipment scientific research and production permit violates these regulations and its permit is revoked, it shall not apply for a weapons and equipment scientific research and production permit again within 3 years.
本条例规定的行政处罚，由国务院国防科技工业主管部门实施。
The administrative penalties specified in these regulations shall be implemented by the State Administration of Science, Technology and Industry for National Defense.
违反本条例规定，构成犯罪的，依法追究刑事责任。
If a violation of these regulations constitutes a crime, criminal liability shall be pursued according to law.
附则
Supplementary Provisions
依照本条例规定实施武器装备科研生产许可，不得收取任何费用。
No fees shall be charged for implementing the weapons and equipment scientific research and production permit in accordance with these regulations.
本条例施行前已经从事武器装备科研生产活动的单位应当自本条例施行之日起，在国务院国防科技工业主管部门规定的期限内，依照本条例规定申请取得武器装备科研生产许可。
Units that have already engaged in weapons and equipment scientific research and production activities before the implementation of these regulations shall, within the time limit prescribed by the State Administration of Science, Technology and Industry for National Defense from the date of implementation of these regulations, apply for a weapons and equipment scientific research and production permit in accordance with these regulations.
军工电子行业科研生产许可管理，由其主管部门参照本条例规定执行。
The administration of scientific research and production permits for the military electronics industry shall be implemented by its competent department with reference to these regulations.
本条例自2008年4月1日起施行。
These regulations shall come into force on April 1, 2008.
