总则
General Provisions
为了加强对武器装备质量的监督管理，提高武器装备质量水平，根据《中华人民共和国国防法》和《中华人民共和国产品质量法》，制定本条例。
This Regulation is formulated in accordance with the National Defense Law of the People's Republic of China and the Product Quality Law of the People's Republic of China to strengthen the supervision and management of the quality of weaponry and equipment and to improve the quality level of weaponry and equipment.
本条例所称武器装备，是指实施和保障军事行动的武器、武器系统和军事技术器材。
For the purposes of this Regulation, 'weaponry and equipment' refers to weapons, weapon systems, and military technical equipment used to implement and support military operations.
武器装备以及用于武器装备的计算机软件、专用元器件、配套产品、原材料的质量管理，适用本条例。
The quality management of weaponry and equipment, as well as computer software, special components, supporting products, and raw materials used for weaponry and equipment, shall be governed by this Regulation.
武器装备质量管理的基本任务是依照有关法律、法规，对武器装备质量特性的形成、保持和恢复等过程实施控制和监督，保证武器装备性能满足规定或者预期要求。
The basic task of weaponry and equipment quality management is to implement control and supervision over the formation, maintenance, and restoration of quality characteristics of weaponry and equipment in accordance with relevant laws and regulations, ensuring that the performance of weaponry and equipment meets specified or expected requirements.
武器装备论证、研制、生产、试验和维修单位应当建立健全质量管理体系，对其承担的武器装备论证、研制、生产、试验和维修任务实行有效的质量管理，确保武器装备质量符合要求。
Units undertaking the demonstration, development, production, testing, and maintenance of weaponry and equipment shall establish and improve a quality management system, implement effective quality management for the tasks they undertake, and ensure that the quality of weaponry and equipment meets requirements.
武器装备论证、研制、生产、试验和维修应当执行军用标准以及其他满足武器装备质量要求的国家标准、行业标准和企业标准；鼓励采用适用的国际标准和国外先进标准。
The demonstration, development, production, testing, and maintenance of weaponry and equipment shall implement military standards and other national standards, industry standards, and enterprise standards that meet the quality requirements of weaponry and equipment; the adoption of applicable international standards and advanced foreign standards is encouraged.
武器装备研制、生产、试验和维修单位应当依照计量法律、法规和其他有关规定，实施计量保障和监督，确保武器装备和检测设备的量值准确和计量单位统一。
Units undertaking the development, production, testing, and maintenance of weaponry and equipment shall, in accordance with metrology laws, regulations, and other relevant provisions, implement metrological assurance and supervision to ensure the accuracy of measurement values and the uniformity of measurement units for weaponry and equipment and testing equipment.
武器装备论证、研制、生产、试验和维修单位应当建立武器装备质量信息系统和信息交流制度，及时记录、收集、分析、上报、反馈、交流武器装备的质量信息，实现质量信息资源共享，并确保质量信息安全，做好保密工作。
Units undertaking the demonstration, development, production, testing, and maintenance of weaponry and equipment shall establish a weaponry and equipment quality information system and an information exchange system, promptly record, collect, analyze, report, provide feedback, and exchange quality information on weaponry and equipment, achieve the sharing of quality information resources, ensure the security of quality information, and maintain confidentiality.
国务院国防科技工业主管部门、国务院有关部门和中国人民解放军总装备部(以下简称总装备部)，在各自的职责范围内负责武器装备质量的监督管理工作。
The competent department of national defense science, technology, and industry under the State Council, the relevant departments under the State Council, and the General Armament Department of the People's Liberation Army (hereinafter referred to as the General Armament Department) shall, within their respective responsibilities, be responsible for the supervision and management of the quality of weaponry and equipment.
国家鼓励采用先进的科学技术和管理方法提高武器装备质量，并对保证和提高武器装备质量作出突出贡献的单位和个人，给予表彰和奖励。
The State encourages the adoption of advanced scientific and technological methods and management techniques to improve the quality of weaponry and equipment, and shall commend and reward units and individuals that have made outstanding contributions to ensuring and improving the quality of weaponry and equipment.
论证质量管理
Quality Management of Demonstration
武器装备论证质量管理的任务是保证论证科学、合理、可行，论证结果满足作战任务需求。
The task of quality management in the demonstration of weaponry and equipment is to ensure that the demonstration is scientific, reasonable, and feasible, and that the demonstration results meet the requirements of combat missions.
军队有关装备部门组织武器装备的论证，并对武器装备论证质量负责。
The relevant equipment departments of the military organize the demonstration of weaponry and equipment and are responsible for the quality of the demonstration.
武器装备论证单位应当制定并执行论证工作程序和规范，实施论证过程的质量管理。
Units undertaking the demonstration of weaponry and equipment shall formulate and implement demonstration work procedures and norms, and implement quality management throughout the demonstration process.
武器装备论证单位应当根据论证任务需求，统筹考虑武器装备性能(含功能特性、可靠性、维修性、保障性、测试性和安全性等，下同)、研制进度和费用，提出相互协调的武器装备性能的定性定量要求、质量保证要求和保障要求。
Units undertaking the demonstration of weaponry and equipment shall, based on the requirements of the demonstration task, comprehensively consider the performance (including functional characteristics, reliability, maintainability, supportability, testability, and safety, etc., hereinafter the same), development schedule, and cost of the weaponry and equipment, and propose mutually coordinated qualitative and quantitative requirements for the performance of the weaponry and equipment, quality assurance requirements, and support requirements.
武器装备论证单位应当征求作战、训练、运输等部门和武器装备研制、生产、试验、使用、维修等单位的意见，确认各种需求和约束条件，并在论证结果中落实。
Units undertaking the demonstration of weaponry and equipment shall solicit opinions from departments such as combat, training, and transportation, as well as units involved in the development, production, testing, use, and maintenance of weaponry and equipment, confirm various requirements and constraints, and implement them in the demonstration results.
武器装备论证单位应当对论证结果进行风险分析，提出降低或者控制风险的措施。武器装备研制总体方案应当优先选用成熟技术，对采用的新技术和关键技术，应当经过试验或者验证。
Units undertaking the demonstration of weaponry and equipment shall conduct risk analysis on the demonstration results and propose measures to reduce or control risks. The overall development plan for weaponry and equipment shall prioritize the adoption of mature technologies, and new technologies and key technologies adopted shall be tested or verified.
武器装备论证单位应当拟制多种备选的武器装备研制总体方案，并提出优选方案。
Units undertaking the demonstration of weaponry and equipment shall prepare multiple alternative overall development plans for weaponry and equipment and propose a preferred plan.
军队有关装备部门应当按照规定的程序，组织作战、训练、运输等部门和武器装备研制、生产、试验、使用、维修等单位对武器装备论证结果进行评审。
The relevant equipment departments of the military shall, in accordance with prescribed procedures, organize departments such as combat, training, and transportation, as well as units involved in the development, production, testing, use, and maintenance of weaponry and equipment, to review the demonstration results.
研制、生产与试验质量管理
Quality Management of Development, Production, and Testing
武器装备研制、生产与试验质量管理的任务是保证武器装备质量符合研制总要求和合同要求。
The task of quality management in the development, production, and testing of weaponry and equipment is to ensure that the quality of weaponry and equipment meets the overall development requirements and contract requirements.
武器装备研制、生产单位对其研制、生产的武器装备质量负责；武器装备试验单位对其承担的武器装备试验结论的正确性和准确性负责。
Units undertaking the development and production of weaponry and equipment are responsible for the quality of the weaponry and equipment they develop and produce; units undertaking the testing of weaponry and equipment are responsible for the correctness and accuracy of the test conclusions they produce.
中央管理的企业对所属单位承担的武器装备研制、生产质量实施监督管理。
Enterprises under central management shall supervise and manage the quality of weaponry and equipment development and production undertaken by their subordinate units.
订立武器装备研制、生产合同应当明确规定武器装备的性能指标、质量保证要求、依据的标准、验收准则和方法以及合同双方的质量责任。
When concluding a weapons and equipment development or production contract, the performance indicators, quality assurance requirements, applicable standards, acceptance criteria and methods, and the quality responsibilities of both parties shall be clearly specified.
武器装备研制、生产涉及若干单位的，其质量保证工作由任务总体单位或者总承包单位负责组织。
If the development or production of weapons and equipment involves multiple units, the quality assurance work shall be organized by the overall task unit or the general contractor unit.
武器装备研制、生产单位应当根据合同要求和研制、生产程序制定武器装备研制、生产项目质量计划，并将其纳入研制、生产和条件保障计划。
Weapons and equipment development and production units shall, based on contract requirements and development/production procedures, formulate quality plans for weapons and equipment development and production projects, and incorporate them into the development, production, and condition assurance plans.
武器装备研制、生产单位应当运用可靠性、维修性、保障性、测试性和安全性等工程技术方法，优化武器装备的设计方案和保障方案。
Weapons and equipment development and production units shall use engineering technical methods such as reliability, maintainability, supportability, testability, and safety to optimize the design scheme and support scheme of weapons and equipment.
武器装备研制单位应当在满足武器装备研制总要求和合同要求的前提下，优先采用成熟技术和通用化、系列化、组合化的产品。
Weapons and equipment development units shall, on the premise of meeting the overall requirements of weapons and equipment development and contract requirements, give priority to adopting mature technologies and products that are generalized, serialized, and combined.
武器装备研制单位对设计方案采用的新技术、新材料、新工艺应当进行充分的论证、试验和鉴定，并按照规定履行审批手续。
For new technologies, new materials, and new processes adopted in the design scheme, the weapons and equipment development unit shall conduct sufficient demonstration, testing, and appraisal, and go through the approval procedures as prescribed.
武器装备研制单位应当对计算机软件开发实施工程化管理，对影响武器装备性能和安全的计算机软件进行独立的测试和评价。
Weapons and equipment development units shall implement engineering management for computer software development, and conduct independent testing and evaluation of computer software that affects the performance and safety of weapons and equipment.
武器装备研制、生产单位应当对武器装备的研制、生产过程严格实施技术状态管理。更改技术状态应当按照规定履行审批手续；对可能影响武器装备性能和合同要求的技术状态的更改，应当充分论证和验证，并经原审批部门批准。
Weapons and equipment development and production units shall strictly implement technical state management during the development and production process of weapons and equipment. Changes to the technical state shall go through approval procedures as prescribed; for changes that may affect the performance of weapons and equipment and contract requirements, sufficient demonstration and verification shall be conducted, and approval from the original approving department shall be obtained.
武器装备研制、生产单位应当严格执行设计评审、工艺评审和产品质量评审制度。对技术复杂、质量要求高的产品，应当进行可靠性、维修性、保障性、测试性和安全性以及计算机软件、元器件、原材料等专题评审。
Weapons and equipment development and production units shall strictly implement the systems of design review, process review, and product quality review. For products with complex technology and high quality requirements, special reviews on reliability, maintainability, supportability, testability, and safety, as well as computer software, components, and raw materials, shall be conducted.
军队有关装备部门应当按照武器装备研制程序，组织转阶段审查，确认达到规定的质量要求后，方可批准转入下一研制阶段。
The relevant military equipment departments shall, in accordance with the weapons and equipment development procedures, organize phase transition reviews, and only after confirming that the specified quality requirements are met, may they approve the transition to the next development phase.
武器装备研制、生产单位应当实行图样和技术资料的校对、审核、批准的审签制度，工艺和质量会签制度以及标准化审查制度。
Weapons and equipment development and production units shall implement a review and approval system for drawings and technical data, including proofreading, review, and approval, a process and quality countersigning system, and a standardization review system.
武器装备研制、生产单位应当对产品的关键件或者关键特性、重要件或者重要特性、关键工序、特种工艺编制质量控制文件，并对关键件、重要件进行首件鉴定。
Weapons and equipment development and production units shall prepare quality control documents for key parts or key characteristics, important parts or important characteristics, key processes, and special processes, and conduct first-article inspection for key parts and important parts.
武器装备研制、生产和试验单位应当建立故障的报告、分析和纠正措施系统。对武器装备研制、生产和试验过程中出现的故障，应当及时采取纠正和预防措施。
Weapons and equipment development, production, and testing units shall establish a system for reporting, analyzing, and taking corrective actions for failures. For failures occurring during the development, production, and testing of weapons and equipment, timely corrective and preventive measures shall be taken.
武器装备研制单位组织实施研制试验，应当编制试验大纲或者试验方案，明确试验质量保证要求，对试验过程进行质量控制。
When organizing and conducting development tests, weapons and equipment development units shall prepare test outlines or test plans, specify test quality assurance requirements, and implement quality control over the test process.
承担武器装备定型试验的单位应当根据武器装备定型有关规定，拟制试验大纲，明确试验项目质量要求以及保障条件，对试验过程进行质量控制，保证试验数据真实、准确和试验结论完整、正确。
Units undertaking weapons and equipment finalization tests shall, in accordance with relevant provisions on weapons and equipment finalization, draft test outlines, specify test item quality requirements and support conditions, implement quality control over the test process, and ensure that test data are true and accurate and test conclusions are complete and correct.
试验单位所用的试验装备及其配套的检测设备应当符合使用要求，并依法定期进行检定、校准，保持完好的技术状态；对一次性使用的试验装备，应当进行试验前的检定、校准。
The test equipment and its supporting testing equipment used by the test unit shall meet the use requirements, and shall be regularly verified and calibrated according to law to maintain a good technical state; for single-use test equipment, verification and calibration shall be conducted before testing.
提交武器装备设计定型审查的图样、技术资料应当正确、完整，试验报告的数据应当全面、准确，结论明确。
The drawings and technical data submitted for weapons and equipment design finalization review shall be correct and complete, and the data in the test reports shall be comprehensive and accurate with clear conclusions.
提交武器装备生产定型审查的图样、技术资料应当符合规定要求；试验报告和部队试用报告的数据应当全面、准确，结论明确。
The drawings and technical data submitted for weapons and equipment production finalization review shall meet the specified requirements; the data in the test reports and military trial reports shall be comprehensive and accurate with clear conclusions.
武器装备研制、生产单位应当对其外购、外协产品的质量负责，对采购过程实施严格控制，对供应单位的质量保证能力进行评定和跟踪，并编制合格供应单位名录。未经检验合格的外购、外协产品，不得投入使用。
Weapons and equipment development and production units shall be responsible for the quality of their outsourced and externally purchased products, implement strict control over the procurement process, evaluate and track the quality assurance capabilities of suppliers, and compile a list of qualified suppliers. Outsourced and externally purchased products that have not passed inspection shall not be put into use.
武器装备的生产应当符合下列要求：
The production of weapons and equipment shall meet the following requirements:
(一)工艺文件和质量控制文件经审查批准；
(1) Process documents and quality control documents have been reviewed and approved;
(二)制造、测量、试验设备和工艺装置依法经检定或者测试合格；
(2) Manufacturing, measuring, and testing equipment and process equipment have been verified or tested as qualified according to law;
(三)元器件、原材料、外协件、成品件经检验合格；
(3) Components, raw materials, outsourced parts, and finished parts have passed inspection;
(四)工作环境符合规定要求；
(4) The working environment meets the specified requirements;
(五)操作人员经培训并考核合格；
(5) Operators have been trained and assessed as qualified.
(六)法律、法规规定的其他要求。
(6) Other requirements stipulated by laws and regulations.
武器装备研制、生产单位应当建立产品批次管理制度和产品标识制度，严格实行工艺流程控制，保证产品质量原始记录的真实和完整。
Weapons and equipment development and production units shall establish product batch management systems and product identification systems, strictly implement process flow control, and ensure the authenticity and completeness of original quality records.
武器装备研制、生产单位应当按照标准和程序要求进行进货检验、工序检验和最终产品检验；对首件产品应当进行规定的检验；对实行军检的项目，应当按照规定提交军队派驻的军事代表(以下简称军事代表)检验。
Weapons and equipment development and production units shall conduct incoming inspection, in-process inspection, and final product inspection in accordance with standards and procedures; the first article shall undergo specified inspection; for items subject to military inspection, inspection shall be submitted to the military representative (hereinafter referred to as military representative) stationed by the military as required.
武器装备研制、生产单位应当建立不合格产品处置制度。
Weapons and equipment development and production units shall establish a nonconforming product disposition system.
武器装备研制、生产单位应当运用统计技术，分析工序能力，改进过程质量控制，保证产品质量的一致性和稳定性。
Weapons and equipment development and production units shall use statistical techniques to analyze process capability, improve process quality control, and ensure the consistency and stability of product quality.
武器装备研制、生产单位交付的武器装备及其配套的设备、备件和技术资料应当经检验合格；交付的技术资料应当满足使用单位对武器装备的使用和维修要求。新型武器装备交付前，武器装备研制、生产单位还应当完成对使用和维修单位的技术培训。
Weapons and equipment delivered by development and production units, along with supporting equipment, spare parts, and technical documentation, shall pass inspection; the delivered technical documentation shall meet the user unit's requirements for use and maintenance of the weapons and equipment. Before delivery of new types of weapons and equipment, the development and production units shall also complete technical training for the user and maintenance units.
军事代表应当按照合同和验收技术要求对交付的武器装备及其配套的设备、备件和技术资料进行检验、验收，并监督新型武器装备使用和维修技术培训的实施。
Military representatives shall inspect and accept the delivered weapons and equipment, supporting equipment, spare parts, and technical documentation in accordance with the contract and acceptance technical requirements, and supervise the implementation of technical training for the use and maintenance of new types of weapons and equipment.
武器装备研制、生产单位对暂停生产的武器装备图样和技术资料应当按照规定归档并妥善保管，不得擅自销毁。
Weapons and equipment development and production units shall archive and properly preserve the drawings and technical documentation of suspended production weapons and equipment in accordance with regulations, and shall not destroy them without authorization.
维修质量管理
Maintenance Quality Management
武器装备维修质量管理的任务是保持和恢复武器装备性能。
The task of weapons and equipment maintenance quality management is to maintain and restore the performance of weapons and equipment.
武器装备维修单位对武器装备维修质量负责。
Weapons and equipment maintenance units are responsible for the quality of weapons and equipment maintenance.
武器装备维修单位应当落实质量责任制，严格执行各项规章制度，如实记录武器装备维修质量状态，及时报告发现的质量问题。
Weapons and equipment maintenance units shall implement quality responsibility systems, strictly enforce various rules and regulations, truthfully record the quality status of weapons and equipment maintenance, and promptly report discovered quality issues.
军队有关装备部门应当定期组织武器装备质量评估，将武器装备质量问题及时反馈武器装备研制、生产、维修单位，并督促其采取纠正措施。
Relevant military equipment departments shall regularly organize quality assessments of weapons and equipment, promptly feedback quality issues to weapons and equipment development, production, and maintenance units, and urge them to take corrective actions.
武器装备研制、生产和维修单位发现武器装备存在质量缺陷的，应当及时、主动通报军队有关装备部门及有关单位，采取纠正措施，解决武器装备质量问题，防止类似质量缺陷重复发生。
Weapons and equipment development, production, and maintenance units, upon discovering quality defects in weapons and equipment, shall promptly and proactively notify the relevant military equipment departments and relevant units, take corrective actions to resolve the quality issues, and prevent the recurrence of similar quality defects.
武器装备研制、生产和维修单位应当建立健全售(修)后服务保障机制，依据合同组织武器装备售(修)后技术服务，及时解决武器装备交付后出现的质量问题，协助武器装备使用单位培训技术骨干，并对武器装备的退役和报废工作提供技术支持。
Weapons and equipment development, production, and maintenance units shall establish and improve after-sale (after-maintenance) service support mechanisms, organize technical services after sale (maintenance) of weapons and equipment in accordance with contracts, promptly resolve quality issues arising after delivery, assist user units in training technical personnel, and provide technical support for the retirement and disposal of weapons and equipment.
部队执行作战和重大任务时，武器装备研制、生产和维修单位应当依照法律、法规的要求组织伴随保障和应急维修保障，协助部队保持、恢复武器装备的质量水平。
When troops carry out combat and major missions, weapons and equipment development, production, and maintenance units shall organize accompanying support and emergency maintenance support in accordance with laws and regulations, and assist troops in maintaining and restoring the quality level of weapons and equipment.
质量监督
Quality Supervision
国务院国防科技工业主管部门和总装备部联合组织对承担武器装备研制、生产、维修任务单位的质量管理体系实施认证，对用于武器装备的通用零(部)件、重要元器件和原材料实施认证。
The State Administration of Science, Technology and Industry for National Defense and the General Armament Department jointly organize the certification of quality management systems for units undertaking weapons and equipment development, production, and maintenance tasks, and implement certification for general parts (components), important components, and raw materials used in weapons and equipment.
国务院国防科技工业主管部门和总装备部在各自的职责范围内，组织对武器装备测试和校准试验室实施认可，对质量专业人员实施资格管理。
The State Administration of Science, Technology and Industry for National Defense and the General Armament Department, within their respective responsibilities, organize the accreditation of weapons and equipment testing and calibration laboratories, and implement qualification management for quality professionals.
未通过质量管理体系认证的单位，不得承担武器装备研制、生产、维修任务。
Units that have not passed quality management system certification shall not undertake weapons and equipment development, production, or maintenance tasks.
军工产品定型工作机构应当按照国务院、中央军事委员会的有关规定，全面考核新型武器装备质量，确认其达到武器装备研制总要求和规定标准的质量要求。
The military product finalization working body shall, in accordance with the relevant regulations of the State Council and the Central Military Commission, comprehensively assess the quality of new types of weapons and equipment, and confirm that they meet the quality requirements specified in the general requirements for weapons and equipment development and the prescribed standards.
军事代表依照国务院、中央军事委员会的有关规定和武器装备合同要求，对武器装备研制、生产、维修的质量和质量管理工作实施监督。
Military representatives shall, in accordance with the relevant regulations of the State Council and the Central Military Commission and the contract requirements for weapons and equipment, supervise the quality and quality management of weapons and equipment development, production, and maintenance.
国务院国防科技工业主管部门、总装备部会同国务院有关部门查处武器装备研制、生产、维修过程中制造、销售和使用假冒伪劣产品的违法行为。省级人民政府及其有关部门应当积极配合查处工作。
The State Administration of Science, Technology and Industry for National Defense and the General Armament Department, together with relevant departments of the State Council, investigate and deal with illegal acts of manufacturing, selling, and using counterfeit and shoddy products during the development, production, and maintenance of weapons and equipment. People's governments at the provincial level and their relevant departments shall actively cooperate in the investigation and handling work.
武器装备研制、生产、试验、使用和维修过程中发生质量事故时，有关单位应当及时向上级主管部门报告，不得隐瞒不报、谎报或者延误报告。负责武器装备质量监督管理的部门对重大质量事故应当及时调查处理。
When a quality accident occurs during the development, production, testing, use, or maintenance of weapons and equipment, the relevant unit shall promptly report to the higher competent department, and shall not conceal, falsely report, or delay the report. The department responsible for quality supervision and management of weapons and equipment shall promptly investigate and handle major quality accidents.
任何单位和个人对违反本条例的行为，有权向负责武器装备质量监督管理的部门以及其他有关部门举报。
Any unit or individual has the right to report violations of these regulations to the department responsible for quality supervision and management of weapons and equipment and other relevant departments.
法律责任
Legal Liability
违反本条例规定，在武器装备论证工作中弄虚作假，或者违反武器装备论证工作程序，造成严重后果的，对直接负责的主管人员和其他直接责任人员，依照有关规定给予处分；构成犯罪的，依法追究刑事责任。
Whoever, in violation of these Regulations, engages in fraud in the demonstration of weaponry and equipment, or violates the procedures for weaponry and equipment demonstration, causing serious consequences, shall be punished in accordance with relevant provisions; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，有下列情形之一的，由国务院国防科技工业主管部门、国务院有关部门依照有关法律、法规的规定处罚；属于军队的武器装备研制、生产、试验和维修单位，由军队有关部门按照有关规定处理：
Whoever, in violation of these Regulations, commits any of the following acts shall be punished by the competent department of science, technology and industry for national defense of the State Council or the relevant department of the State Council in accordance with relevant laws and regulations; if the unit is a military unit engaged in the development, production, testing or maintenance of weaponry and equipment, it shall be dealt with by the relevant military department in accordance with relevant provisions:
(一)因管理不善、工作失职，导致发生武器装备重大质量事故的；
(1) Causing a major quality accident of weaponry and equipment due to poor management or dereliction of duty;
(二)对武器装备重大质量事故隐瞒不报、谎报或者延误报告，造成严重后果的；
(2) Concealing, falsely reporting or delaying the report of a major quality accident of weaponry and equipment, causing serious consequences;
(三)在武器装备试验中出具虚假试验数据，造成严重后果的；
(3) Providing false test data in weaponry and equipment testing, causing serious consequences;
(四)将不合格的武器装备交付部队使用的。
(4) Delivering non-conforming weaponry and equipment to the military for use.
前款规定的违法行为情节严重的，由国务院国防科技工业主管部门和军队有关部门依法取消其武器装备研制、生产、试验和维修的资格；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任。
If the illegal act specified in the preceding paragraph is serious, the competent department of science, technology and industry for national defense of the State Council and the relevant military department shall revoke its qualification for the development, production, testing and maintenance of weaponry and equipment according to law; if losses are caused, it shall bear compensation liability according to law; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，泄露武器装备质量信息秘密的，由国务院国防科技工业主管部门、国务院有关部门依照《中华人民共和国保守国家秘密法》等有关法律、法规的规定处罚；属于军队的武器装备研制、生产、试验和维修单位，由军队有关部门按照有关规定处理；构成犯罪的，依法追究刑事责任。
Whoever, in violation of these Regulations, divulges secrets of weaponry and equipment quality information shall be punished by the competent department of science, technology and industry for national defense of the State Council or the relevant department of the State Council in accordance with the Law of the People's Republic of China on Guarding State Secrets and other relevant laws and regulations; if the unit is a military unit engaged in the development, production, testing or maintenance of weaponry and equipment, it shall be dealt with by the relevant military department in accordance with relevant provisions; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，阻碍、干扰武器装备质量监督管理工作，情节严重的，由国务院国防科技工业主管部门、国务院有关部门依照有关法律、法规的规定处罚；属于军队的武器装备研制、生产、试验和维修单位，由军队有关部门按照有关规定处理；构成犯罪的，依法追究刑事责任。
Whoever, in violation of these Regulations, obstructs or interferes with the supervision and management of weaponry and equipment quality, if the circumstances are serious, shall be punished by the competent department of science, technology and industry for national defense of the State Council or the relevant department of the State Council in accordance with relevant laws and regulations; if the unit is a military unit engaged in the development, production, testing or maintenance of weaponry and equipment, it shall be dealt with by the relevant military department in accordance with relevant provisions; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，为武器装备研制、生产、试验和维修单位提供元器件、原材料以及其他产品，以次充好、以假充真的，由国务院国防科技工业主管部门、国务院有关部门依照《中华人民共和国产品质量法》等有关法律、法规的规定处罚；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任。
Whoever, in violation of these Regulations, provides components, raw materials or other products for units engaged in the development, production, testing or maintenance of weaponry and equipment, passing off inferior products as high-quality ones or passing off fakes as genuine ones, shall be punished by the competent department of science, technology and industry for national defense of the State Council or the relevant department of the State Council in accordance with the Product Quality Law of the People's Republic of China and other relevant laws and regulations; if losses are caused, it shall bear compensation liability according to law; if a crime is constituted, criminal liability shall be pursued according to law.
武器装备质量检验机构、认证机构与武器装备研制、生产单位恶意串通，弄虚作假，或者伪造检验、认证结果，出具虚假证明的，取消其检验、认证资格，并由国务院国防科技工业主管部门、国务院有关部门依照《中华人民共和国认证认可条例》的有关规定处罚；属于军队的武器装备质量检验机构、认证机构，由军队有关部门按照有关规定处理；构成犯罪的，依法追究刑事责任。
If a weaponry and equipment quality inspection institution or certification institution maliciously colludes with a weaponry and equipment development or production unit, engages in fraud, or forges inspection or certification results, or issues false certificates, its inspection or certification qualification shall be revoked, and it shall be punished by the competent department of science, technology and industry for national defense of the State Council or the relevant department of the State Council in accordance with the Regulations of the People's Republic of China on Certification and Accreditation; if it is a military weaponry and equipment quality inspection institution or certification institution, it shall be dealt with by the relevant military department in accordance with relevant provisions; if a crime is constituted, criminal liability shall be pursued according to law.
武器装备质量监督管理人员玩忽职守、滥用职权、徇私舞弊的，由所在单位或者上级主管部门依法给予处分；构成犯罪的，依法追究刑事责任。
If a supervisor or manager of weaponry and equipment quality neglects his duty, abuses his power, or engages in malpractice for personal gain, he shall be given a sanction by the unit to which he belongs or the competent authority at a higher level according to law; if a crime is constituted, criminal liability shall be pursued according to law.
附则
Supplementary Provisions
武器装备预先研究、专项工程的质量管理工作，参照本条例执行。
The quality management of preliminary research on weaponry and equipment and special projects shall be implemented with reference to these Regulations.
中国人民武装警察部队和民兵的武器装备质量管理工作，参照本条例执行。
The quality management of weaponry and equipment of the Chinese People's Armed Police Force and the militia shall be implemented with reference to these Regulations.
本条例自2010年11月1日起施行。1987年5月25日国务院、中央军事委员会批准，1987年6月5日国防科工委发布的《军工产品质量管理条例》同时废止。
These Regulations shall come into force as of November 1, 2010. The Regulations on the Quality Management of Military Products, approved by the State Council and the Central Military Commission on May 25, 1987, and promulgated by the Commission of Science, Technology and Industry for National Defense on June 5, 1987, shall be abolished simultaneously.
