为了便利外国驻华外交领事机构执行职务，维护中国籍雇员的合法权益，根据《中华人民共和国对外关系法》，制定本条例。
These Regulations are formulated in accordance with the Law of the People's Republic of China on Foreign Relations to facilitate the performance of duties by foreign diplomatic and consular missions in China and to protect the legitimate rights and interests of Chinese employees.
本条例所称外国驻华外交领事机构，是指外国驻中国的外交代表机构、领事机构。
For the purposes of these Regulations, "foreign diplomatic and consular missions in China" means the diplomatic representative missions and consular missions of foreign states in China.
本条例所称中国籍雇员，是指在外国驻华外交领事机构从事辅助性、服务性等工作的中国公民。
For the purposes of these Regulations, "Chinese employees" means Chinese citizens engaged in auxiliary, service, or other work in foreign diplomatic and consular missions in China.
中国政府依法为外国驻华外交领事机构雇用中国籍雇员提供便利。
The Chinese government shall, in accordance with the law, provide facilitation for foreign diplomatic and consular missions in China to employ Chinese employees.
外国驻华外交领事机构应当尊重中国的法律、法规，保障中国籍雇员的合法权益。
Foreign diplomatic and consular missions in China shall respect Chinese laws and regulations and protect the legitimate rights and interests of Chinese employees.
外国驻华外交领事机构雇用中国籍雇员实行归口管理。
The employment of Chinese employees by foreign diplomatic and consular missions in China shall be subject to centralized management.
外交部负责指导、协调全国的中国籍雇员管理工作。
The Ministry of Foreign Affairs shall be responsible for guiding and coordinating the administration of Chinese employees nationwide.
外交部委托的单位和省、自治区、直辖市人民政府外事主管部门(以下统称外事服务主管单位)分别负责外国驻中国的外交代表机构中国籍雇员和本行政区域内外国驻中国的领事机构中国籍雇员管理。
Units designated by the Ministry of Foreign Affairs and the foreign affairs departments of provinces, autonomous regions, and municipalities directly under the Central Government (hereinafter collectively referred to as foreign affairs service competent units) shall be responsible for the administration of Chinese employees of foreign diplomatic representative missions in China and of foreign consular missions within their respective administrative regions.
人力资源社会保障、税务、市场监督管理、公安、国家安全等有关部门在各自职责范围内配合做好中国籍雇员管理相关工作。
Relevant departments such as human resources and social security, taxation, market regulation, public security, and national security shall, within their respective functions, cooperate in the administration of Chinese employees.
外国驻华外交领事机构通过外交部建立的中国籍雇员人力资源平台发布岗位需求信息，根据需要选择拟雇用的中国籍雇员。
Foreign diplomatic and consular missions in China shall publish job vacancy information through the Chinese employee human resources platform established by the Ministry of Foreign Affairs and select Chinese employees to be employed as needed.
外国驻华外交领事机构与所在地外事服务主管单位指定的外事服务机构签订服务协议，明确中国籍雇员权益保障、法律适用、争议解决、外事服务费用等；外事服务机构与中国籍雇员签订劳动合同，明确其在外国驻华外交领事机构从事的辅助性、服务性等工作内容、劳动报酬等。
Foreign diplomatic and consular missions in China shall sign service agreements with foreign affairs service institutions designated by the local foreign affairs service competent unit, specifying the protection of rights and interests of Chinese employees, applicable law, dispute resolution, and foreign affairs service fees; the foreign affairs service institution shall sign labor contracts with Chinese employees, specifying the auxiliary, service, or other work content and labor remuneration to be performed in the foreign diplomatic or consular mission in China.
外事服务主管单位和外事服务机构应当提高管理水平，提升服务质量。
Foreign affairs service competent units and foreign affairs service institutions shall improve management levels and enhance service quality.
外事服务机构与中国籍雇员签订劳动合同后，由外事服务主管单位向中国籍雇员发放中国籍雇员证，作为其工作证件。
After the foreign affairs service institution signs a labor contract with a Chinese employee, the foreign affairs service competent unit shall issue a Chinese Employee Card to the Chinese employee as his or her work certificate.
中国籍雇员证式样由外交部统一规定。
The format of the Chinese Employee Card shall be uniformly prescribed by the Ministry of Foreign Affairs.
中国籍雇员应当遵守中国的法律、法规，履行劳动合同规定的义务，不得实施危害国家安全、损害社会公共利益的行为，不得以外交代表、领事官员身份开展活动。
Chinese employees shall abide by Chinese laws and regulations, perform the obligations stipulated in the labor contract, and shall not engage in acts that endanger national security or harm social public interests, nor shall they carry out activities in the capacity of diplomatic agents or consular officers.
与本条例第六条第一款规定的服务协议有关的争议，按照服务协议约定的方式解决；与劳动合同有关的争议，依照《中华人民共和国劳动争议调解仲裁法》的规定处理。
Disputes relating to the service agreement referred to in the first paragraph of Article 6 shall be resolved in the manner agreed upon in the service agreement; disputes relating to the labor contract shall be handled in accordance with the Law of the People's Republic of China on Mediation and Arbitration of Labor Disputes.
除本条例规定的机构外，任何单位或者个人不得向外国驻华外交领事机构提供中国籍雇员雇用服务。非经本条例规定的程序，中国公民不得私自受雇于外国驻华外交领事机构。
No unit or individual other than the institutions specified in these Regulations may provide employment services for Chinese employees to foreign diplomatic and consular missions in China. No Chinese citizen may be privately employed by a foreign diplomatic or consular mission in China without following the procedures prescribed in these Regulations.
违反本条例规定的，由外事服务主管单位协调有关部门依法予以处理。
Any violation of these Regulations shall be dealt with by the foreign affairs service competent unit in coordination with relevant departments in accordance with the law.
外交部依照本条例制定中国籍雇员管理的具体办法。
The Ministry of Foreign Affairs shall, in accordance with these Regulations, formulate specific measures for the administration of Chinese employees.
本条例自2026年1月1日起施行。
These Regulations shall come into force as of January 1, 2026.
