总则
General Provisions
为了加强对大型群众性活动的安全管理，保护公民生命和财产安全，维护社会治安秩序和公共安全，制定本条例。
These Regulations are formulated to strengthen the safety management of large-scale mass activities, protect the lives and property of citizens, and maintain social order and public security.
本条例所称大型群众性活动，是指法人或者其他组织面向社会公众举办的每场次预计参加人数达到1000人以上的下列活动：
For the purposes of these Regulations, 'large-scale mass activities' refer to the following activities organized by legal persons or other organizations for the public, with an expected attendance of 1,000 or more persons per session:
(一)体育比赛活动；
(1) Sports competitions;
(二)演唱会、音乐会等文艺演出活动；
(2) Concerts, music performances, and other artistic performances;
(三)展览、展销等活动；
(3) Exhibitions, trade fairs, and similar events;
(四)游园、灯会、庙会、花会、焰火晚会等活动；
(4) Garden parties, lantern festivals, temple fairs, flower fairs, fireworks displays, and similar events;
(五)人才招聘会、现场开奖的彩票销售等活动。
(5) Job fairs, on-site lottery draws, and similar events.
影剧院、音乐厅、公园、娱乐场所等在其日常业务范围内举办的活动，不适用本条例的规定。
Activities held by cinemas, concert halls, parks, entertainment venues, etc., within their daily business scope are not subject to these Regulations.
大型群众性活动的安全管理应当遵循安全第一、预防为主的方针，坚持承办者负责、政府监管的原则。
The safety management of large-scale mass activities shall follow the principles of safety first and prevention-oriented, adhering to the principle of organizer responsibility and government supervision.
县级以上人民政府公安机关负责大型群众性活动的安全管理工作。
The public security organs of people's governments at or above the county level shall be responsible for the safety management of large-scale mass activities.
县级以上人民政府其他有关主管部门按照各自的职责，负责大型群众性活动的有关安全工作。
Other relevant competent departments of people's governments at or above the county level shall, in accordance with their respective duties, be responsible for the relevant safety work of large-scale mass activities.
安全责任
Safety Responsibilities
大型群众性活动的承办者(以下简称承办者)对其承办活动的安全负责，承办者的主要负责人为大型群众性活动的安全责任人。
The organizer of a large-scale mass activity (hereinafter referred to as the 'organizer') shall be responsible for the safety of the activity it organizes, and the principal responsible person of the organizer shall be the safety responsible person for the large-scale mass activity.
举办大型群众性活动，承办者应当制订大型群众性活动安全工作方案。
To hold a large-scale mass activity, the organizer shall formulate a safety work plan for the large-scale mass activity.
大型群众性活动安全工作方案包括下列内容：
The safety work plan for a large-scale mass activity shall include the following:
(一)活动的时间、地点、内容及组织方式；
(1) The time, location, content, and organization method of the activity;
(二)安全工作人员的数量、任务分配和识别标志；
(2) The number of security personnel, task assignments, and identification marks;
(三)活动场所消防安全措施；
(3) Fire safety measures for the activity venue;
(四)活动场所可容纳的人员数量以及活动预计参加人数；
(4) The maximum capacity of the activity venue and the expected number of participants;
(五)治安缓冲区域的设定及其标识；
(5) The establishment and signage of security buffer zones;
(六)入场人员的票证查验和安全检查措施；
(6) Ticket verification and security check measures for entrants;
(七)车辆停放、疏导措施；
(7) Vehicle parking and traffic diversion measures;
(八)现场秩序维护、人员疏导措施；
(8) On-site order maintenance and crowd evacuation measures;
(九)应急救援预案。
(9) Emergency rescue plan.
承办者具体负责下列安全事项：
The organizer is specifically responsible for the following safety matters:
(一)落实大型群众性活动安全工作方案和安全责任制度，明确安全措施、安全工作人员岗位职责，开展大型群众性活动安全宣传教育；
(1) Implement the safety work plan and safety responsibility system for the large-scale mass activity, clarify safety measures and the job responsibilities of safety personnel, and carry out safety publicity and education for the large-scale mass activity;
(二)保障临时搭建的设施、建筑物的安全，消除安全隐患；
(2) Ensure the safety of temporarily constructed facilities and buildings, and eliminate safety hazards;
(三)按照负责许可的公安机关的要求，配备必要的安全检查设备，对参加大型群众性活动的人员进行安全检查，对拒不接受安全检查的，承办者有权拒绝其进入；
(3) Equip necessary safety inspection equipment as required by the public security authority responsible for licensing, conduct safety inspections on persons participating in the large-scale mass activity, and have the right to refuse entry to those who refuse to undergo safety inspection;
(四)按照核准的活动场所容纳人员数量、划定的区域发放或者出售门票；
(4) Issue or sell tickets in accordance with the approved capacity of the activity venue and the designated areas;
(五)落实医疗救护、灭火、应急疏散等应急救援措施并组织演练；
(5) Implement emergency rescue measures such as medical rescue, firefighting, and emergency evacuation, and conduct drills;
(六)对妨碍大型群众性活动安全的行为及时予以制止，发现违法犯罪行为及时向公安机关报告；
(6) Timely stop acts that hinder the safety of the large-scale mass activity, and promptly report illegal or criminal acts to the public security authority;
(七)配备与大型群众性活动安全工作需要相适应的专业保安人员以及其他安全工作人员；
(7) Equip professional security personnel and other safety staff commensurate with the safety work needs of the large-scale mass activity;
(八)为大型群众性活动的安全工作提供必要的保障。
(8) Provide necessary guarantees for the safety work of the large-scale mass activity.
大型群众性活动的场所管理者具体负责下列安全事项：
The venue manager of a large-scale mass activity is specifically responsible for the following safety matters:
(一)保障活动场所、设施符合国家安全标准和安全规定；
(1) Ensure that the activity venue and facilities comply with national safety standards and safety regulations;
(二)保障疏散通道、安全出口、消防车通道、应急广播、应急照明、疏散指示标志符合法律、法规、技术标准的规定；
(2) Ensure that evacuation routes, safety exits, fire engine access, emergency broadcasting, emergency lighting, and evacuation signages comply with laws, regulations, and technical standards;
(三)保障监控设备和消防设施、器材配置齐全、完好有效；
(3) Ensure that monitoring equipment and fire-fighting facilities and equipment are fully equipped, intact, and effective;
(四)提供必要的停车场地，并维护安全秩序。
(4) Provide necessary parking spaces and maintain safety order.
参加大型群众性活动的人员应当遵守下列规定：
Persons participating in a large-scale mass activity shall comply with the following provisions:
(一)遵守法律、法规和社会公德，不得妨碍社会治安、影响社会秩序；
(1) Comply with laws, regulations, and social ethics, and shall not disrupt public security or affect social order;
(二)遵守大型群众性活动场所治安、消防等管理制度，接受安全检查，不得携带爆炸性、易燃性、放射性、毒害性、腐蚀性等危险物质或者非法携带枪支、弹药、管制器具；
(2) Comply with the public security, fire safety, and other management systems of the large-scale mass activity venue, accept safety inspections, and shall not carry explosive, flammable, radioactive, toxic, corrosive, or other dangerous substances, or illegally carry firearms, ammunition, or controlled instruments;
(三)服从安全管理，不得展示侮辱性标语、条幅等物品，不得围攻裁判员、运动员或者其他工作人员，不得投掷杂物。
(3) Submit to safety management, shall not display insulting slogans, banners, or other items, shall not besiege referees, athletes, or other staff, and shall not throw objects.
公安机关应当履行下列职责：
Public security authorities shall perform the following duties:
(一)审核承办者提交的大型群众性活动申请材料，实施安全许可；
(1) Review the application materials for the large-scale mass activity submitted by the organizer and implement safety licensing;
(二)制订大型群众性活动安全监督方案和突发事件处置预案；
(2) Formulate safety supervision plans and emergency response plans for the large-scale mass activity;
(三)指导对安全工作人员的教育培训；
(3) Guide the education and training of safety personnel;
(四)在大型群众性活动举办前，对活动场所组织安全检查，发现安全隐患及时责令改正；
(4) Before the large-scale mass activity is held, organize safety inspections of the activity venue, and promptly order corrections if safety hazards are found;
(五)在大型群众性活动举办过程中，对安全工作的落实情况实施监督检查，发现安全隐患及时责令改正；
(5) During the holding of the large-scale mass activity, supervise and inspect the implementation of safety work, and promptly order corrections if safety hazards are found.
(六)依法查处大型群众性活动中的违法犯罪行为，处置危害公共安全的突发事件。
(6) Investigate and handle illegal and criminal acts in large-scale mass activities according to law, and handle emergencies that endanger public safety.
安全管理
Safety Management
公安机关对大型群众性活动实行安全许可制度。《营业性演出管理条例》对演出活动的安全管理另有规定的，从其规定。
The public security organ implements a safety permit system for large-scale mass activities. Where the Regulations on the Administration of Commercial Performances have other provisions on the safety management of performance activities, those provisions shall prevail.
举办大型群众性活动应当符合下列条件：
Holding a large-scale mass activity shall meet the following conditions:
(一)承办者是依照法定程序成立的法人或者其他组织；
(1) The organizer is a legal person or other organization established in accordance with legal procedures;
(二)大型群众性活动的内容不得违反宪法、法律、法规的规定，不得违反社会公德；
(2) The content of the large-scale mass activity shall not violate the provisions of the Constitution, laws, or regulations, nor violate social morality;
(三)具有符合本条例规定的安全工作方案，安全责任明确、措施有效；
(3) There is a safety work plan that complies with these Regulations, with clear safety responsibilities and effective measures;
(四)活动场所、设施符合安全要求。
(4) The activity venue and facilities meet safety requirements.
大型群众性活动的预计参加人数在1000人以上5000人以下的，由活动所在地县级人民政府公安机关实施安全许可；预计参加人数在5000人以上的，由活动所在地设区的市级人民政府公安机关或者直辖市人民政府公安机关实施安全许可；跨省、自治区、直辖市举办大型群众性活动的，由国务院公安部门实施安全许可。
If the estimated number of participants in a large-scale mass activity is between 1,000 and 5,000, the public security organ of the county-level people's government where the activity is located shall implement the safety permit; if the estimated number of participants is 5,000 or more, the public security organ of the city with districts or the municipality directly under the Central Government where the activity is located shall implement the safety permit; if the large-scale mass activity is held across provinces, autonomous regions, or municipalities directly under the Central Government, the public security department of the State Council shall implement the safety permit.
承办者应当在活动举办日的20日前提出安全许可申请，申请时，应当提交下列材料：
The organizer shall submit an application for a safety permit 20 days before the date of the activity. When applying, the following materials shall be submitted:
(一)承办者合法成立的证明以及安全责任人的身份证明；
(1) Proof of the legal establishment of the organizer and the identity certificate of the person responsible for safety;
(二)大型群众性活动方案及其说明，2个或者2个以上承办者共同承办大型群众性活动的，还应当提交联合承办的协议；
(2) The plan for the large-scale mass activity and its description; if two or more organizers jointly hold the activity, a joint hosting agreement shall also be submitted;
(三)大型群众性活动安全工作方案；
(3) The safety work plan for the large-scale mass activity;
(四)活动场所管理者同意提供活动场所的证明。
(4) Proof that the venue manager agrees to provide the venue.
依照法律、行政法规的规定，有关主管部门对大型群众性活动的承办者有资质、资格要求的，还应当提交有关资质、资格证明。
If, according to laws and administrative regulations, the relevant competent authorities have qualification requirements for the organizer of the large-scale mass activity, relevant qualification certificates shall also be submitted.
公安机关收到申请材料应当依法做出受理或者不予受理的决定。对受理的申请，应当自受理之日起7日内进行审查，对活动场所进行查验，对符合安全条件的，做出许可的决定；对不符合安全条件的，做出不予许可的决定，并书面说明理由。
The public security organ shall, upon receiving the application materials, make a decision to accept or reject the application according to law. For an accepted application, it shall review it within 7 days from the date of acceptance, inspect the activity venue, and if safety conditions are met, make a decision to grant the permit; if safety conditions are not met, make a decision not to grant the permit and provide reasons in writing.
对经安全许可的大型群众性活动，承办者不得擅自变更活动的时间、地点、内容或者扩大大型群众性活动的举办规模。
For a large-scale mass activity that has been granted a safety permit, the organizer shall not unilaterally change the time, location, or content of the activity, or expand the scale of the large-scale mass activity.
承办者变更大型群众性活动时间的，应当在原定举办活动时间之前向做出许可决定的公安机关申请变更，经公安机关同意方可变更。
If the organizer changes the time of the large-scale mass activity, it shall apply to the public security organ that granted the permit for a change before the originally scheduled activity time, and the change may only be made with the consent of the public security organ.
承办者变更大型群众性活动地点、内容以及扩大大型群众性活动举办规模的，应当依照本条例的规定重新申请安全许可。
If the organizer changes the location or content of the large-scale mass activity, or expands the scale of the large-scale mass activity, it shall re-apply for a safety permit in accordance with these Regulations.
承办者取消举办大型群众性活动的，应当在原定举办活动时间之前书面告知做出安全许可决定的公安机关，并交回公安机关颁发的准予举办大型群众性活动的安全许可证件。
If the organizer cancels the large-scale mass activity, it shall notify the public security organ that granted the safety permit in writing before the originally scheduled activity time, and return the safety permit document issued by the public security organ for holding the large-scale mass activity.
对经安全许可的大型群众性活动，公安机关根据安全需要组织相应警力，维持活动现场周边的治安、交通秩序，预防和处置突发治安事件，查处违法犯罪活动。
For a large-scale mass activity that has been granted a safety permit, the public security organ shall, based on safety needs, organize corresponding police forces to maintain public security and traffic order around the activity site, prevent and handle sudden public security incidents, and investigate and deal with illegal and criminal activities.
在大型群众性活动现场负责执行安全管理任务的公安机关工作人员，凭值勤证件进入大型群众性活动现场，依法履行安全管理职责。
Public security organ personnel responsible for executing safety management tasks at the site of a large-scale mass activity may enter the site with their duty credentials and perform safety management duties according to law.
公安机关和其他有关主管部门及其工作人员不得向承办者索取门票。
Public security organs and other relevant competent authorities and their staff shall not demand tickets from the organizer.
承办者发现进入活动场所的人员达到核准数量时，应当立即停止验票；发现持有划定区域以外的门票或者持假票的人员，应当拒绝其入场并向活动现场的公安机关工作人员报告。
When the organizer finds that the number of people entering the activity venue has reached the approved capacity, it shall immediately stop ticket checking; if it finds persons holding tickets for areas outside the designated area or holding fake tickets, it shall refuse their entry and report to the public security organ personnel at the activity site.
在大型群众性活动举办过程中发生公共安全事故、治安案件的，安全责任人应当立即启动应急救援预案，并立即报告公安机关。
If a public safety accident or public security incident occurs during the holding of a large-scale mass activity, the person responsible for safety shall immediately activate the emergency rescue plan and immediately report to the public security organ.
法律责任
Legal Liability
承办者擅自变更大型群众性活动的时间、地点、内容或者擅自扩大大型群众性活动的举办规模的，由公安机关处1万元以上5万元以下罚款；有违法所得的，没收违法所得。
If an organizer unilaterally changes the time, location, or content of a large-scale mass activity, or unilaterally expands the scale of the activity, the public security organ shall impose a fine of not less than 10,000 yuan but not more than 50,000 yuan; if there is illegal income, the illegal income shall be confiscated.
未经公安机关安全许可的大型群众性活动由公安机关予以取缔，对承办者处10万元以上30万元以下罚款。
A large-scale mass activity that has not obtained safety permission from the public security organ shall be banned by the public security organ, and the organizer shall be fined not less than 100,000 yuan but not more than 300,000 yuan.
承办者或者大型群众性活动场所管理者违反本条例规定致使发生重大伤亡事故、治安案件或者造成其他严重后果构成犯罪的，依法追究刑事责任；尚不构成犯罪的，对安全责任人和其他直接责任人员依法给予处分、治安管理处罚，对单位处1万元以上5万元以下罚款。
If an organizer or a venue manager of a large-scale mass activity violates the provisions of these Regulations, resulting in a major casualty accident, public security case, or other serious consequences that constitute a crime, criminal liability shall be pursued according to law; if it does not constitute a crime, the safety responsible person and other directly responsible personnel shall be given sanctions or public security penalties according to law, and the unit shall be fined not less than 10,000 yuan but not more than 50,000 yuan.
在大型群众性活动举办过程中发生公共安全事故，安全责任人不立即启动应急救援预案或者不立即向公安机关报告的，由公安机关对安全责任人和其他直接责任人员处5000元以上5万元以下罚款。
If a public safety accident occurs during the holding of a large-scale mass activity, and the safety responsible person fails to immediately initiate the emergency rescue plan or fails to immediately report to the public security organ, the public security organ shall impose a fine of not less than 5,000 yuan but not more than 50,000 yuan on the safety responsible person and other directly responsible personnel.
参加大型群众性活动的人员有违反本条例第九条规定行为的，由公安机关给予批评教育；有危害社会治安秩序、威胁公共安全行为的，公安机关可以将其强行带离现场，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
If a participant in a large-scale mass activity commits an act violating the provisions of Article 9 of these Regulations, the public security organ shall give criticism and education; if there is an act endangering social security order or threatening public safety, the public security organ may forcibly remove the person from the scene and impose public security penalties according to law; if a crime is constituted, criminal liability shall be pursued according to law.
有关主管部门的工作人员和直接负责的主管人员在履行大型群众性活动安全管理职责中，有滥用职权、玩忽职守、徇私舞弊行为的，依法给予处分；构成犯罪的，依法追究刑事责任。
If a staff member of a relevant competent department or a directly responsible person in charge commits acts of abuse of power, dereliction of duty, or favoritism and malpractice in performing safety management duties for large-scale mass activities, sanctions shall be given according to law; if a crime is constituted, criminal liability shall be pursued according to law.
附则
Supplementary Provisions
县级以上各级人民政府、国务院部门直接举办的大型群众性活动的安全保卫工作，由举办活动的人民政府、国务院部门负责，不实行安全许可制度，但应当按照本条例的有关规定，责成或者会同有关公安机关制订更加严格的安全保卫工作方案，并组织实施。
For large-scale mass activities directly hosted by people's governments at or above the county level or departments of the State Council, the security work shall be the responsibility of the people's government or department of the State Council hosting the activity, and the safety permission system shall not apply. However, in accordance with the relevant provisions of these Regulations, a more stringent security work plan shall be formulated and implemented by instructing or cooperating with the relevant public security organs.
本条例自2007年10月1日起施行。
These Regulations shall come into force as of October 1, 2007.
