Regulations on Teacher Qualifications

为了提高教师素质，加强教师队伍建设，依据《中华人民共和国教师法》(以下简称教师法)，制定本条例。

This Regulation is formulated in accordance with the Teachers Law of the People's Republic of China (hereinafter referred to as the Teachers Law) to improve the quality of teachers and strengthen the construction of the teaching force.

中国公民在各级各类学校和其他教育机构中专门从事教育教学工作，应当依法取得教师资格。

Chinese citizens who are engaged in education and teaching work in schools of various types and levels and other educational institutions shall obtain teacher qualifications in accordance with the law.

国务院教育行政部门主管全国教师资格工作。

The administrative department of education under the State Council shall be responsible for the national teacher qualification work.

教师资格分为：

Teacher qualifications are divided into:

(一)幼儿园教师资格；

(1) Kindergarten teacher qualification;

(二)小学教师资格；

(2) Primary school teacher qualification;

(三)初级中学教师和初级职业学校文化课、专业课教师资格(以下统称初级中学教师资格)；

(3) Junior secondary school teacher and junior vocational school academic and specialized course teacher qualification (hereinafter collectively referred to as junior secondary school teacher qualification);

(四)高级中学教师资格；

(4) Senior secondary school teacher qualification;

(五)中等专业学校、技工学校、职业高级中学文化课、专业课教师资格(以下统称中等职业学校教师资格)；

(5) Specialized secondary school, technical school, and vocational senior secondary school academic and specialized course teacher qualification (hereinafter collectively referred to as secondary vocational school teacher qualification);

(六)中等专业学校、技工学校、职业高级中学实习指导教师资格(以下统称中等职业学校实习指导教师资格)；

(6) Specialized secondary school, technical school, and vocational senior secondary school internship guidance teacher qualification (hereinafter collectively referred to as secondary vocational school internship guidance teacher qualification);

(七)高等学校教师资格。

(7) Higher education institution teacher qualification.

成人教育的教师资格，按照成人教育的层次，依照上款规定确定类别。

Teacher qualifications for adult education shall be determined by category according to the level of adult education, in accordance with the provisions of the preceding paragraph.

取得教师资格的公民，可以在本级及其以下等级的各类学校和其他教育机构担任教师；但是，取得中等职业学校实习指导教师资格的公民只能在中等专业学校、技工学校、职业高级中学或者初级职业学校担任实习指导教师。

A citizen who has obtained a teacher qualification may serve as a teacher in schools of various types and levels at or below the corresponding level and in other educational institutions; however, a citizen who has obtained a secondary vocational school internship guidance teacher qualification may only serve as an internship guidance teacher in specialized secondary schools, technical schools, vocational senior secondary schools, or junior vocational schools.

高级中学教师资格与中等职业学校教师资格相互通用。

Senior secondary school teacher qualification and secondary vocational school teacher qualification are mutually interchangeable.

教师资格条件依照教师法第十条第二款的规定执行，其中“有教育教学能力”应当包括符合国家规定的从事教育教学工作的身体条件。

The conditions for teacher qualifications shall be implemented in accordance with the provisions of Article 10, Paragraph 2 of the Teachers Law, where 'having the ability to educate and teach' shall include meeting the physical conditions prescribed by the state for engaging in education and teaching work.

取得教师资格应当具备的相应学历，依照教师法第十一条的规定执行。

The corresponding academic qualifications required to obtain a teacher qualification shall be implemented in accordance with the provisions of Article 11 of the Teachers Law.

取得中等职业学校实习指导教师资格，应当具备国务院教育行政部门规定的学历，并应当具有相当助理工程师以上专业技术职务或者中级以上工人技术等级。

To obtain a secondary vocational school internship guidance teacher qualification, one shall possess the academic qualifications prescribed by the administrative department of education under the State Council and shall have a professional technical position equivalent to assistant engineer or above, or a technical grade of intermediate worker or above.

不具备教师法规定的教师资格学历的公民，申请获得教师资格，应当通过国家举办的或者认可的教师资格考试。

Citizens who do not possess the academic qualifications for teacher qualifications as prescribed by the Teachers Law and who apply to obtain teacher qualifications shall pass the teacher qualification examination organized or recognized by the state.

教师资格考试科目、标准和考试大纲由国务院教育行政部门审定。

The subjects, standards, and examination syllabi for the teacher qualification examination shall be approved by the administrative department of education under the State Council.

教师资格考试试卷的编制、考务工作和考试成绩证明的发放，属于幼儿园、小学、初级中学、高级中学、中等职业学校教师资格考试和中等职业学校实习指导教师资格考试的，由县级以上人民政府教育行政部门组织实施；属于高等学校教师资格考试的，由国务院教育行政部门或者省、自治区、直辖市人民政府教育行政部门委托的高等学校组织实施。

The preparation of examination papers, examination affairs, and issuance of score certificates for the teacher qualification examination, for examinations concerning kindergarten, primary school, junior secondary school, senior secondary school, secondary vocational school teacher qualifications, and secondary vocational school internship guidance teacher qualifications, shall be organized and implemented by the administrative departments of education of people's governments at or above the county level; for examinations concerning higher education institution teacher qualifications, they shall be organized and implemented by higher education institutions entrusted by the administrative department of education under the State Council or the administrative departments of education of people's governments of provinces, autonomous regions, or municipalities directly under the Central Government.

幼儿园、小学、初级中学、高级中学、中等职业学校的教师资格考试和中等职业学校实习指导教师资格考试，每年进行一次。

The teacher qualification examinations for kindergartens, primary schools, junior secondary schools, senior secondary schools, secondary vocational schools, and the internship guidance teacher qualification examination for secondary vocational schools are held once a year.

参加前款所列教师资格考试，考试科目全部及格的，发给教师资格考试合格证明；当年考试不及格的科目，可以在下一年度补考；经补考仍有一门或者一门以上科目不及格的，应当重新参加全部考试科目的考试。

For those who take the teacher qualification examinations listed in the preceding paragraph and pass all subjects, a teacher qualification examination pass certificate shall be issued; subjects that are failed in the current year may be retaken in the following year; if after retaking, one or more subjects are still failed, the person shall retake all subjects of the examination.

高等学校教师资格考试根据需要举行。

The teacher qualification examination for institutions of higher education is held as needed.

申请参加高等学校教师资格考试的，应当学有专长，并有两名相关专业的教授或者副教授推荐。

Those who apply to take the teacher qualification examination for institutions of higher education shall have specialized expertise and be recommended by two professors or associate professors in relevant fields.

具备教师法规定的学历或者经教师资格考试合格的公民，可以依照本条例的规定申请认定其教师资格。

Citizens who meet the academic qualifications prescribed by the Teachers Law or have passed the teacher qualification examination may apply for certification of their teacher qualifications in accordance with these Regulations.

幼儿园、小学和初级中学教师资格，由申请人户籍所在地或者申请人任教学校所在地的县级人民政府教育行政部门认定。高级中学教师资格，由申请人户籍所在地或者申请人任教学校所在地的县级人民政府教育行政部门审查后，报上一级教育行政部门认定。中等职业学校教师资格和中等职业学校实习指导教师资格，由申请人户籍所在地或者申请人任教学校所在地的县级人民政府教育行政部门审查后，报上一级教育行政部门认定或者组织有关部门认定。

Teacher qualifications for kindergartens, primary schools, and junior secondary schools shall be certified by the education administrative department of the people's government at the county level where the applicant's registered residence or the school where the applicant teaches is located. Teacher qualifications for senior secondary schools shall be certified by the education administrative department at the next higher level after review by the education administrative department of the people's government at the county level where the applicant's registered residence or the school where the applicant teaches is located. Teacher qualifications for secondary vocational schools and internship guidance teacher qualifications for secondary vocational schools shall be certified by the education administrative department at the next higher level or organized by relevant departments after review by the education administrative department of the people's government at the county level where the applicant's registered residence or the school where the applicant teaches is located.

受国务院教育行政部门或者省、自治区、直辖市人民政府教育行政部门委托的高等学校，负责认定在本校任职的人员和拟聘人员的高等学校教师资格。

Institutions of higher education entrusted by the education administrative department of the State Council or the education administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government shall be responsible for certifying the teacher qualifications of persons employed or to be employed in their own institutions.

在未受国务院教育行政部门或者省、自治区、直辖市人民政府教育行政部门委托的高等学校任职的人员和拟聘人员的高等学校教师资格，按照学校行政隶属关系，由国务院教育行政部门认定或者由学校所在地的省、自治区、直辖市人民政府教育行政部门认定。

For persons employed or to be employed in institutions of higher education that are not entrusted by the education administrative department of the State Council or the education administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government, their teacher qualifications shall be certified by the education administrative department of the State Council or by the education administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the institution is located, according to the administrative affiliation of the institution.

认定教师资格，应当由本人提出申请。

Certification of teacher qualifications shall be applied for by the individual.

教育行政部门和受委托的高等学校每年春季、秋季各受理一次教师资格认定申请。具体受理期限由教育行政部门或者受委托的高等学校规定，并以适当形式公布。申请人应当在规定的受理期限内提出申请。

The education administrative departments and entrusted institutions of higher education shall accept applications for teacher qualification certification once each in spring and autumn each year. The specific acceptance period shall be prescribed by the education administrative department or the entrusted institution of higher education and announced in an appropriate manner. Applicants shall submit their applications within the prescribed acceptance period.

申请认定教师资格，应当提交教师资格认定申请表和下列证明或者材料：

To apply for teacher qualification certification, a teacher qualification certification application form and the following certificates or materials shall be submitted:

(一)身份证明；

(1) Identity certificate;

(二)学历证书或者教师资格考试合格证明；

(2) Academic qualification certificate or teacher qualification examination pass certificate;

(三)教育行政部门或者受委托的高等学校指定的医院出具的体格检查证明；

(3) Physical examination certificate issued by a hospital designated by the education administrative department or the entrusted institution of higher education;

(四)户籍所在地的街道办事处、乡人民政府或者工作单位、所毕业的学校对其思想品德、有无犯罪记录等方面情况的鉴定及证明材料。

(4) Appraisal and certification materials on the applicant's ideological and moral character and whether there is any criminal record, issued by the sub-district office or township people's government of the registered residence, or the work unit, or the school from which the applicant graduated.

申请人提交的证明或者材料不全的，教育行政部门或者受委托的高等学校应当及时通知申请人于受理期限终止前补齐。

If the certificates or materials submitted by the applicant are incomplete, the education administrative department or the entrusted institution of higher education shall promptly notify the applicant to complete them before the end of the acceptance period.

教师资格认定申请表由国务院教育行政部门统一格式。

The teacher qualification certification application form shall be in a unified format prescribed by the education administrative department of the State Council.

教育行政部门或者受委托的高等学校在接到公民的教师资格认定申请后，应当对申请人的条件进行审查；对符合认定条件的，应当在受理期限终止之日起30日内颁发相应的教师资格证书；对不符合认定条件的，应当在受理期限终止之日起30日内将认定结论通知本人。

After receiving a citizen's application for teacher qualification certification, the education administrative department or the entrusted institution of higher education shall examine the applicant's conditions; for those who meet the certification conditions, the corresponding teacher qualification certificate shall be issued within 30 days from the end of the acceptance period; for those who do not meet the certification conditions, the certification conclusion shall be notified to the person within 30 days from the end of the acceptance period.

非师范院校毕业或者教师资格考试合格的公民申请认定幼儿园、小学或者其他教师资格的，应当进行面试和试讲，考察其教育教学能力；根据实际情况和需要，教育行政部门或者受委托的高等学校可以要求申请人补修教育学、心理学等课程。

Citizens who have graduated from non-normal colleges or have passed the teacher qualification examination and apply for certification of kindergarten, primary school, or other teacher qualifications shall undergo an interview and trial lecture to assess their education and teaching ability; according to the actual situation and needs, the education administrative department or the entrusted institution of higher education may require the applicant to take supplementary courses such as pedagogy and psychology.

教师资格证书在全国范围内适用。教师资格证书由国务院教育行政部门统一印制。

Teacher qualification certificates are applicable nationwide. Teacher qualification certificates shall be uniformly printed by the education administrative department of the State Council.

已取得教师资格的公民拟取得更高等级学校或者其他教育机构教师资格的，应当通过相应的教师资格考试或者取得教师法规定的相应学历，并依照本章规定，经认定合格后，由教育行政部门或者受委托的高等学校颁发相应的教师资格证书。

A citizen who has obtained a teacher qualification and intends to obtain a teacher qualification for a higher-level school or other educational institution shall pass the corresponding teacher qualification examination or obtain the corresponding academic qualifications prescribed by the Teachers Law, and after being certified as qualified in accordance with this Chapter, the education administrative department or the entrusted institution of higher education shall issue the corresponding teacher qualification certificate.

依照教师法第十四条的规定丧失教师资格的，不能重新取得教师资格，其教师资格证书由县级以上人民政府教育行政部门收缴。

A person who loses teacher qualification in accordance with Article 14 of the Teachers Law cannot regain teacher qualification, and their teacher qualification certificate shall be confiscated by the education administrative department of the people's government at or above the county level.

有下列情形之一的，由县级以上人民政府教育行政部门撤销其教师资格：

Under any of the following circumstances, the education administrative department of the people's government at or above the county level shall revoke the teacher qualification:

(一) 弄虚作假、骗取教师资格的；

(1) Obtaining teacher qualification through fraud or deception;

(二) 品行不良、侮辱学生，影响恶劣的。

(2) Having bad conduct, insulting students, with severe negative impact.

被撤销教师资格的，自撤销之日起5年内不得重新申请认定教师资格，其教师资格证书由县级以上人民政府教育行政部门收缴。

A person whose teacher qualification is revoked shall not reapply for teacher qualification recognition within 5 years from the date of revocation, and their teacher qualification certificate shall be confiscated by the education administrative department of the people's government at or above the county level.

参加教师资格考试有作弊行为的，其考试成绩作废，3年内不得再次参加教师资格考试。

Anyone who cheats in the teacher qualification examination shall have their examination results invalidated and shall not take the teacher qualification examination again within 3 years.

教师资格考试命题人员和其他有关人员违反保密规定，造成试题、参考答案及评分标准泄露的，依法追究法律责任。

Persons who set examination questions for the teacher qualification examination and other relevant personnel who violate confidentiality regulations, causing the leakage of examination questions, reference answers, and scoring standards, shall be investigated for legal responsibility according to law.

在教师资格认定工作中玩忽职守、徇私舞弊，对教师资格认定工作造成损失的，由教育行政部门依法给予行政处分；构成犯罪的，依法追究刑事责任。

Those who neglect their duties, engage in malpractice for personal gain, or cause losses to the teacher qualification recognition work during the teacher qualification recognition process shall be given administrative sanctions by the education administrative department according to law; if a crime is constituted, criminal liability shall be pursued according to law.

本条例自发布之日起施行。

These Regulations shall come into force on the date of promulgation.
