Regulations on Power Grid Dispatching Management

(Issued by Decree No. 115 of the State Council of the People's Republic of China on June 29, 1993, and revised in accordance with the Decision of the State Council on Repealing and Amending Certain Administrative Regulations on January 8, 2011)

为了加强电网调度管理，保障电网安全，保护用户利益，适应经济建设和人民生活的需要，制定本条例。

These Regulations are formulated to strengthen the management of power grid dispatching, ensure the safety of the power grid, protect the interests of users, and meet the needs of economic construction and people's lives.

本条例所称电网调度，是指电网调度机构(以下简称调度机构)为保障电网的安全、优质、经济运行，对电网运行进行的组织、指挥、指导和协调。

For the purposes of these Regulations, power grid dispatching refers to the organization, command, guidance, and coordination of power grid operation by the power grid dispatching institution (hereinafter referred to as the dispatching institution) to ensure the safe, high-quality, and economic operation of the power grid.

电网调度应当符合社会主义市场经济的要求和电网运行的客观规律。

Power grid dispatching shall conform to the requirements of the socialist market economy and the objective laws of power grid operation.

中华人民共和国境内的发电、供电、用电单位以及其他有关单位和个人，必须遵守本条例。

All power generation, power supply, and power consumption units and other relevant units and individuals within the territory of the People's Republic of China must comply with these Regulations.

电网运行实行统一调度、分级管理的原则。

The operation of the power grid shall adhere to the principles of unified dispatching and hierarchical management.

任何单位和个人不得超计划分配电力和电量，不得超计划使用电力和电量；遇有特殊情况，需要变更计划的，须经用电计划下达部门批准。

No unit or individual may allocate or use electricity and electric energy beyond the plan; in case of special circumstances requiring changes to the plan, approval must be obtained from the department that issued the electricity consumption plan.

国务院电力行政主管部门主管电网调度工作。

The administrative department of electric power under the State Council shall be in charge of power grid dispatching work.

调度机构的职权及其调度管辖范围的划分原则，由国务院电力行政主管部门确定。

The functions and powers of the dispatching institution and the principles for dividing its dispatching jurisdiction shall be determined by the administrative department of electric power under the State Council.

调度机构直接调度的发电厂的划定原则，由国务院电力行政主管部门确定。

The principles for designating power plants directly dispatched by the dispatching institution shall be determined by the administrative department of electric power under the State Council.

调度系统包括各级调度机构和电网内的发电厂、变电站的运行值班单位。

The dispatching system includes dispatching institutions at all levels and the operational duty units of power plants and substations within the power grid.

下级调度机构必须服从上级调度机构的调度。

Lower-level dispatching institutions must obey the dispatching of higher-level dispatching institutions.

调度机构调度管辖范围内的发电厂、变电站的运行值班单位，必须服从该级调度机构的调度。

The operational duty units of power plants and substations within the dispatching jurisdiction of a dispatching institution must obey the dispatching of that dispatching institution.

调度机构分为五级：国家调度机构，跨省、自治区、直辖市调度机构，省、自治区、直辖市级调度机构，省辖市级调度机构，县级调度机构。

Dispatching institutions are divided into five levels: national dispatching institution, cross-provincial, autonomous region, and municipality dispatching institution, provincial, autonomous region, and municipality-level dispatching institution, provincial-level city dispatching institution, and county-level dispatching institution.

调度系统值班人员须经培训、考核并取得合格证书方得上岗。

Dispatching system duty personnel must undergo training, assessment, and obtain a qualification certificate before taking up their posts.

调度系统值班人员的培训、考核办法由国务院电力行政主管部门制定。

The training and assessment methods for dispatching system duty personnel shall be formulated by the administrative department of electric power under the State Council.

跨省电网管理部门和省级电网管理部门应当编制发电、供电计划，并将发电、供电计划报送国务院电力行政主管部门备案。

Cross-provincial power grid management departments and provincial power grid management departments shall prepare power generation and supply plans and submit them to the administrative department of electric power under the State Council for record.

调度机构应当编制下达发电、供电调度计划。

The dispatching institution shall prepare and issue power generation and supply dispatching plans.

值班调度人员可以按照有关规定，根据电网运行情况，调整日发电、供电调度计划。值班调度人员调整日发电、供电调度计划时，必须填写调度值班日志。

Duty dispatchers may, in accordance with relevant regulations, adjust daily power generation and supply dispatching plans based on the operation of the power grid. When adjusting daily power generation and supply dispatching plans, duty dispatchers must fill in the dispatching duty log.

跨省电网管理部门和省级电网管理部门编制发电、供电计划，调度机构编制发电、供电调度计划时，应当根据国家下达的计划、有关的供电协议和并网协议、电网的设备能力，并留有备用容量。

When cross-provincial power grid management departments and provincial power grid management departments prepare power generation and supply plans, and when dispatching institutions prepare power generation and supply dispatching plans, they shall do so based on the plans issued by the state, relevant power supply agreements and grid connection agreements, the equipment capacity of the power grid, and shall reserve reserve capacity.

对具有综合效益的水电厂(站)的水库，应当根据批准的水电厂(站)的设计文件，并考虑防洪、灌溉、发电、环保、航运等要求，合理运用水库蓄水。

For reservoirs of hydropower plants (stations) with comprehensive benefits, the reservoir water storage shall be reasonably utilized based on the approved design documents of the hydropower plant (station) and taking into account requirements such as flood control, irrigation, power generation, environmental protection, and navigation.

跨省电网管理部门和省级电网管理部门遇有下列情形之一，需要调整发电、供电计划时，应当通知有关地方人民政府的有关部门：

When cross-provincial power grid management departments and provincial power grid management departments encounter any of the following circumstances and need to adjust power generation and supply plans, they shall notify the relevant departments of the local people's government:

(一)大中型水电厂(站)入库水量不足；

(1) Insufficient inflow into large and medium-sized hydropower plants (stations);

(二)火电厂的燃料短缺；

(2) Fuel shortage at thermal power plants;

(三)其他需要调整发电、供电计划的情形。

(3) Other circumstances requiring adjustment of power generation and supply plans.

调度机构必须执行国家下达的供电计划，不得克扣电力、电量，并保证供电质量。

The dispatching institution must implement the power supply plan issued by the state, shall not withhold electric power or energy, and shall ensure the quality of power supply.

发电厂必须按照调度机构下达的调度计划和规定的电压范围运行，并根据调度指令调整功率和电压。

Power plants must operate in accordance with the dispatching plan and the specified voltage range issued by the dispatching institution, and adjust power and voltage according to dispatching instructions.

发电、供电设备的检修，应当服从调度机构的统一安排。

The maintenance of power generation and supply equipment shall be subject to the unified arrangement of the dispatching institution.

出现下列紧急情况之一的，值班调度人员可以调整日发电、供电调度计划，发布限电、调整发电厂功率、开或者停发电机组等指令；可以向本电网内的发电厂、变电站的运行值班单位发布调度指令：

In the event of any of the following emergency situations, the dispatcher on duty may adjust the daily power generation and supply dispatching plan, issue instructions such as load shedding, adjusting power plant output, starting or stopping generator sets; and may issue dispatching instructions to the operation duty units of power plants and substations within the grid:

(一)发电、供电设备发生重大事故或者电网发生事故；

(1) Major accidents in power generation or supply equipment or accidents in the power grid;

(二)电网频率或者电压超过规定范围；

(2) Grid frequency or voltage exceeding the specified range;

(三)输变电设备负载超过规定值；

(3) Load on transmission and transformation equipment exceeding the specified value;

(四)主干线路功率值超过规定的稳定限额；

(4) Power flow on main transmission lines exceeding the specified stability limit;

(五)其他威胁电网安全运行的紧急情况。

(5) Other emergency situations threatening the safe operation of the power grid.

省级电网管理部门、省辖市级电网管理部门、县级电网管理部门应当根据本级人民政府的生产调度部门的要求、用户的特点和电网安全运行的需要，提出事故及超计划用电的限电序位表，经本级人民政府的生产调度部门审核，报本级人民政府批准后，由调度机构执行。

Provincial, prefecture-level, and county-level grid management departments shall, based on the requirements of the production dispatching department of the corresponding people's government, the characteristics of users, and the needs for safe grid operation, propose a load shedding priority list for accidents and over-plan power usage. After review by the production dispatching department of the corresponding people's government and approval by the corresponding people's government, the list shall be implemented by the dispatching institution.

限电及整个电网调度工作应当逐步实现自动化管理。

Load shedding and overall grid dispatching work shall gradually achieve automated management.

未经值班调度人员许可，任何人不得操作调度机构调度管辖范围内的设备。

Without the permission of the dispatcher on duty, no one may operate equipment within the dispatching jurisdiction of the dispatching institution.

电网运行遇有危及人身及设备安全的情况时，发电厂、变电站的运行值班单位的值班人员可以按照有关规定处理，处理后应当立即报告有关调度机构的值班人员。

When grid operation encounters situations endangering personal or equipment safety, the duty personnel of the operation duty unit of the power plant or substation may handle the situation in accordance with relevant regulations, and shall immediately report to the dispatcher on duty of the relevant dispatching institution after handling.

值班调度人员必须按照规定发布各种调度指令。

Dispatchers on duty must issue various dispatching instructions in accordance with regulations.

在调度系统中，必须执行调度指令。调度系统的值班人员认为执行调度指令将危及人身及设备安全的，应当立即向发布指令的值班调度人员报告，由其决定调度指令的执行或者撤销。

In the dispatching system, dispatching instructions must be executed. If the duty personnel of the dispatching system believe that executing a dispatching instruction will endanger personal or equipment safety, they shall immediately report to the dispatcher on duty who issued the instruction, who shall decide whether to execute or revoke the instruction.

电网管理部门的负责人，调度机构的负责人以及发电厂、变电站的负责人，对上级调度机构的值班人员发布的调度指令有不同意见时，可以向上级电网电力行政主管部门或者上级调度机构提出，但是在其未作出答复前，调度系统的值班人员必须按照上级调度机构的值班人员发布的调度指令执行。

If the person in charge of the grid management department, the person in charge of the dispatching institution, or the person in charge of a power plant or substation disagrees with a dispatching instruction issued by the dispatcher on duty of a higher-level dispatching institution, they may raise the issue with the higher-level grid electric power administrative department or the higher-level dispatching institution. However, before a response is received, the duty personnel of the dispatching system must execute the dispatching instruction issued by the dispatcher on duty of the higher-level dispatching institution.

任何单位和个人不得违反本条例干预调度系统的值班人员发布或者执行调度指令；调度系统的值班人员依法执行公务，有权拒绝各种非法干预。

No unit or individual may, in violation of these regulations, intervene in the issuance or execution of dispatching instructions by the duty personnel of the dispatching system; the duty personnel of the dispatching system, in performing their official duties according to law, have the right to refuse any illegal intervention.

并网运行的发电厂或者电网，必须服从调度机构的统一调度。

Power plants or grids connected to the grid must be subject to the unified dispatching of the dispatching institution.

需要并网运行的发电厂与电网之间以及电网与电网之间，应当在并网前根据平等互利、协商一致的原则签订并网协议并严格执行。

Before interconnection, power plants and grids, as well as grids and grids, that need to be connected to the grid shall sign an interconnection agreement based on the principles of equality, mutual benefit, and consensus through consultation, and strictly implement it.

违反本条例规定，有下列行为之一的，对主管人员和直接责任人员由其所在单位或者上级机关给予行政处分：

In violation of these Regulations, any of the following acts shall result in administrative sanctions against the responsible persons and directly responsible personnel by their unit or superior authority:

(一)未经上级调度机构许可，不按照上级调度机构下达的发电、供电调度计划执行的；

(1) Without permission from the superior dispatching authority, failing to execute the power generation and supply dispatching plan issued by the superior dispatching authority;

(二)不执行有关调度机构批准的检修计划的；

(2) Failing to execute the maintenance plan approved by the relevant dispatching authority;

(三)不执行调度指令和调度机构下达的保证电网安全的措施的；

(3) Failing to execute dispatching instructions and measures issued by the dispatching authority to ensure grid safety;

(四)不如实反映电网运行情况的；

(4) Failing to truthfully report the operation status of the power grid;

(五)不如实反映执行调度指令情况的；

(5) Failing to truthfully report the execution of dispatching instructions;

(六)调度系统的值班人员玩忽职守、徇私舞弊，尚不构成犯罪的。

(6) The dispatcher on duty neglects duty or engages in malpractice for personal gain, which does not constitute a crime.

调度机构对于超计划用电的用户应当予以警告；经警告，仍未按照计划用电的，调度机构可以发布限电指令，并可以强行扣还电力、电量；当超计划用电威胁电网安全运行时，调度机构可以部分或者全部暂时停止供电。

The dispatching authority shall warn users who consume electricity beyond the plan; if after warning they still do not consume according to plan, the dispatching authority may issue a power curtailment order and may forcibly deduct the excess electricity and capacity; when over-plan consumption threatens the safe operation of the grid, the dispatching authority may partially or fully temporarily suspend power supply.

违反本条例规定，未按照计划供电或者无故调整供电计划的，电网应当根据用户的需要补给少供的电力、电量。

In violation of these Regulations, if power supply is not provided according to plan or the supply plan is adjusted without cause, the grid shall compensate for the shortfall in power and capacity according to the user's needs.

违反本条例规定，构成违反治安管理行为的，依照《中华人民共和国治安管理处罚法》的有关规定给予处罚；构成犯罪的，依法追究刑事责任。

In violation of these Regulations, if the act constitutes a violation of public security administration, punishment shall be imposed in accordance with the relevant provisions of the Public Security Administration Punishments Law of the People's Republic of China; if it constitutes a crime, criminal liability shall be pursued according to law.

国务院电力行政主管部门可以根据本条例制定实施办法。

The electric power administrative department of the State Council may formulate implementation rules based on these Regulations.

省、自治区、直辖市人民政府可以根据本条例制定小电网管理办法。

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate management measures for small power grids based on these Regulations.

本条例由国务院电力行政主管部门负责解释。

These Regulations shall be interpreted by the electric power administrative department of the State Council.

本条例自1993年11月1日起施行。

These Regulations shall come into force as of November 1, 1993.
