总则
General Provisions
为了防治畜禽养殖污染，推进畜禽养殖废弃物的综合利用和无害化处理，保护和改善环境，保障公众身体健康，促进畜牧业持续健康发展，制定本条例。
This Regulation is formulated for the purposes of preventing and controlling pollution from livestock and poultry breeding, promoting the comprehensive utilization and harmless treatment of livestock and poultry breeding waste, protecting and improving the environment, safeguarding public health, and promoting the sustainable and healthy development of the animal husbandry industry.
本条例适用于畜禽养殖场、养殖小区的养殖污染防治。
This Regulation applies to the prevention and control of pollution from livestock and poultry farms and breeding communities.
畜禽养殖场、养殖小区的规模标准根据畜牧业发展状况和畜禽养殖污染防治要求确定。
The scale standards for livestock and poultry farms and breeding communities shall be determined based on the development status of the animal husbandry industry and the requirements for pollution prevention and control from livestock and poultry breeding.
牧区放牧养殖污染防治，不适用本条例。
This Regulation does not apply to the prevention and control of pollution from grazing livestock and poultry in pastoral areas.
畜禽养殖污染防治，应当统筹考虑保护环境与促进畜牧业发展的需要，坚持预防为主、防治结合的原则，实行统筹规划、合理布局、综合利用、激励引导。
The prevention and control of pollution from livestock and poultry breeding shall take into overall consideration the need to protect the environment and promote the development of the animal husbandry industry, adhere to the principles of prevention first and combining prevention with control, and implement overall planning, rational layout, comprehensive utilization, and incentive guidance.
各级人民政府应当加强对畜禽养殖污染防治工作的组织领导，采取有效措施，加大资金投入，扶持畜禽养殖污染防治以及畜禽养殖废弃物综合利用。
People's governments at all levels shall strengthen organizational leadership over the prevention and control of pollution from livestock and poultry breeding, take effective measures, increase financial input, and support the prevention and control of pollution from livestock and poultry breeding and the comprehensive utilization of livestock and poultry breeding waste.
县级以上人民政府环境保护主管部门负责畜禽养殖污染防治的统一监督管理。
The environmental protection administrative department of the people's government at or above the county level shall be responsible for the unified supervision and management of the prevention and control of pollution from livestock and poultry breeding.
县级以上人民政府农牧主管部门负责畜禽养殖废弃物综合利用的指导和服务。
The agriculture administrative department of the people's government at or above the county level shall be responsible for the guidance and service for the comprehensive utilization of livestock and poultry breeding waste.
县级以上人民政府循环经济发展综合管理部门负责畜禽养殖循环经济工作的组织协调。
The comprehensive department for the development of the circular economy of the people's government at or above the county level shall be responsible for the organization and coordination of the circular economy work in livestock and poultry breeding.
县级以上人民政府其他有关部门依照本条例规定和各自职责，负责畜禽养殖污染防治相关工作。
Other relevant departments of the people's government at or above the county level shall, in accordance with the provisions of this Regulation and their respective duties, be responsible for the work related to the prevention and control of pollution from livestock and poultry breeding.
乡镇人民政府应当协助有关部门做好本行政区域的畜禽养殖污染防治工作。
Township people's governments shall assist the relevant departments in carrying out the work of preventing and controlling pollution from livestock and poultry breeding within their respective administrative regions.
从事畜禽养殖以及畜禽养殖废弃物综合利用和无害化处理活动，应当符合国家有关畜禽养殖污染防治的要求，并依法接受有关主管部门的监督检查。
Entities engaged in livestock and poultry breeding and in the comprehensive utilization and harmless treatment of livestock and poultry breeding waste shall comply with the national requirements for the prevention and control of pollution from livestock and poultry breeding and shall, in accordance with the law, accept the supervision and inspection of the relevant competent departments.
国家鼓励和支持畜禽养殖污染防治以及畜禽养殖废弃物综合利用和无害化处理的科学技术研究和装备研发。各级人民政府应当支持先进适用技术的推广，促进畜禽养殖污染防治水平的提高。
The State encourages and supports scientific and technological research and equipment development for the prevention and control of pollution from livestock and poultry breeding and for the comprehensive utilization and harmless treatment of livestock and poultry breeding waste. People's governments at all levels shall support the promotion of advanced and applicable technologies to improve the level of pollution prevention and control in livestock and poultry breeding.
任何单位和个人对违反本条例规定的行为，有权向县级以上人民政府环境保护等有关部门举报。接到举报的部门应当及时调查处理。
Any unit or individual has the right to report to the environmental protection administrative department of the people's government at or above the county level or other relevant departments any act that violates the provisions of this Regulation. The department receiving the report shall promptly investigate and handle the matter.
对在畜禽养殖污染防治中作出突出贡献的单位和个人，按照国家有关规定给予表彰和奖励。
Units and individuals that have made outstanding contributions to the prevention and control of pollution from livestock and poultry breeding shall be commended and rewarded in accordance with the relevant provisions of the State.
预防
Prevention
县级以上人民政府农牧主管部门编制畜牧业发展规划，报本级人民政府或者其授权的部门批准实施。畜牧业发展规划应当统筹考虑环境承载能力以及畜禽养殖污染防治要求，合理布局，科学确定畜禽养殖的品种、规模、总量。
The agriculture administrative department of the people's government at or above the county level shall formulate an animal husbandry development plan, which shall be submitted to the people's government at the same level or its authorized department for approval and implementation. The animal husbandry development plan shall take into overall consideration the environmental carrying capacity and the requirements for pollution prevention and control from livestock and poultry breeding, rationally lay out, and scientifically determine the breed, scale, and total quantity of livestock and poultry breeding.
县级以上人民政府环境保护主管部门会同农牧主管部门编制畜禽养殖污染防治规划，报本级人民政府或者其授权的部门批准实施。畜禽养殖污染防治规划应当与畜牧业发展规划相衔接，统筹考虑畜禽养殖生产布局，明确畜禽养殖污染防治目标、任务、重点区域，明确污染治理重点设施建设，以及废弃物综合利用等污染防治措施。
The environmental protection administrative department of the people's government at or above the county level shall, in conjunction with the agriculture administrative department, formulate a plan for the prevention and control of pollution from livestock and poultry breeding, which shall be submitted to the people's government at the same level or its authorized department for approval and implementation. The plan for the prevention and control of pollution from livestock and poultry breeding shall be aligned with the animal husbandry development plan, take into overall consideration the production layout of livestock and poultry breeding, specify the objectives, tasks, and key areas for the prevention and control of pollution from livestock and poultry breeding, and clarify the construction of key facilities for pollution control and measures for pollution prevention such as comprehensive utilization of waste.
禁止在下列区域内建设畜禽养殖场、养殖小区：
It is prohibited to construct livestock and poultry farms or breeding communities in the following areas:
(一)饮用水水源保护区，风景名胜区；
(1) Drinking water source protection areas and scenic spots;
(二)自然保护区的核心区和缓冲区；
(2) Core areas and buffer areas of nature reserves;
(三)城镇居民区、文化教育科学研究区等人口集中区域；
(3) Urban residential areas, cultural, educational, and scientific research areas, and other densely populated areas;
(四)法律、法规规定的其他禁止养殖区域。
(4) Other areas where breeding is prohibited as stipulated by laws and regulations.
新建、改建、扩建畜禽养殖场、养殖小区，应当符合畜牧业发展规划、畜禽养殖污染防治规划，满足动物防疫条件，并进行环境影响评价。对环境可能造成重大影响的大型畜禽养殖场、养殖小区，应当编制环境影响报告书；其他畜禽养殖场、养殖小区应当填报环境影响登记表。大型畜禽养殖场、养殖小区的管理目录，由国务院环境保护主管部门商国务院农牧主管部门确定。
The construction, reconstruction, or expansion of livestock and poultry farms or breeding communities shall comply with the animal husbandry development plan and the plan for the prevention and control of pollution from livestock and poultry breeding, meet the animal epidemic prevention conditions, and undergo environmental impact assessment. For large-scale livestock and poultry farms or breeding communities that may have a significant impact on the environment, an environmental impact report shall be prepared; for other livestock and poultry farms or breeding communities, an environmental impact registration form shall be filled out. The management catalog of large-scale livestock and poultry farms and breeding communities shall be determined by the environmental protection administrative department of the State Council in consultation with the agriculture administrative department of the State Council.
环境影响评价的重点应当包括：畜禽养殖产生的废弃物种类和数量，废弃物综合利用和无害化处理方案和措施，废弃物的消纳和处理情况以及向环境直接排放的情况，最终可能对水体、土壤等环境和人体健康产生的影响以及控制和减少影响的方案和措施等。
The focus of the environmental impact assessment shall include: the types and quantities of waste generated from livestock and poultry breeding, the plan and measures for comprehensive utilization and harmless treatment of waste, the situation of waste disposal and treatment and direct discharge into the environment, the potential impact on the environment such as water bodies and soil and human health, and the plan and measures to control and reduce the impact.
畜禽养殖场、养殖小区应当根据养殖规模和污染防治需要，建设相应的畜禽粪便、污水与雨水分流设施，畜禽粪便、污水的贮存设施，粪污厌氧消化和堆沤、有机肥加工、制取沼气、沼渣沼液分离和输送、污水处理、畜禽尸体处理等综合利用和无害化处理设施。已经委托他人对畜禽养殖废弃物代为综合利用和无害化处理的，可以不自行建设综合利用和无害化处理设施。
Livestock and poultry farms and breeding communities shall, based on the breeding scale and pollution prevention needs, construct corresponding facilities for the separation of livestock and poultry manure, sewage, and rainwater, storage facilities for livestock and poultry manure and sewage, and facilities for comprehensive utilization and harmless treatment such as anaerobic digestion and composting of manure, organic fertilizer processing, biogas production, separation and transportation of biogas residue and slurry, sewage treatment, and disposal of livestock and poultry carcasses. If the comprehensive utilization and harmless treatment of livestock and poultry breeding waste have been entrusted to others, the farm or community may not construct its own comprehensive utilization and harmless treatment facilities.
未建设污染防治配套设施、自行建设的配套设施不合格，或者未委托他人对畜禽养殖废弃物进行综合利用和无害化处理的，畜禽养殖场、养殖小区不得投入生产或者使用。
If no pollution prevention supporting facilities have been constructed, the self-constructed supporting facilities are unqualified, or no entrustment has been made to others for the comprehensive utilization and harmless treatment of livestock and poultry breeding waste, the livestock and poultry farm or breeding community shall not commence production or use.
畜禽养殖场、养殖小区自行建设污染防治配套设施的，应当确保其正常运行。
If livestock and poultry farms or breeding communities construct their own pollution prevention supporting facilities, they shall ensure their normal operation.
从事畜禽养殖活动，应当采取科学的饲养方式和废弃物处理工艺等有效措施，减少畜禽养殖废弃物的产生量和向环境的排放量。
Entities engaged in livestock and poultry breeding activities shall adopt scientific feeding methods and waste treatment processes and other effective measures to reduce the amount of livestock and poultry breeding waste generated and discharged into the environment.
综合利用与治理
Comprehensive Utilization and Treatment
国家鼓励和支持采取粪肥还田、制取沼气、制造有机肥等方法，对畜禽养殖废弃物进行综合利用。
The State encourages and supports the comprehensive utilization of livestock and poultry breeding waste through methods such as returning manure to fields, producing biogas, and manufacturing organic fertilizers.
国家鼓励和支持采取种植和养殖相结合的方式消纳利用畜禽养殖废弃物，促进畜禽粪便、污水等废弃物就地就近利用。
The State encourages and supports the combination of planting and breeding to absorb and utilize livestock and poultry breeding waste, promoting the on-site or nearby utilization of waste such as livestock and poultry manure and sewage.
国家鼓励和支持沼气制取、有机肥生产等废弃物综合利用以及沼渣沼液输送和施用、沼气发电等相关配套设施建设。
The State encourages and supports the construction of supporting facilities for comprehensive utilization of waste such as biogas production and organic fertilizer production, as well as for the transportation and application of biogas residue and slurry, and biogas power generation.
将畜禽粪便、污水、沼渣、沼液等用作肥料的，应当与土地的消纳能力相适应，并采取有效措施，消除可能引起传染病的微生物，防止污染环境和传播疫病。
When using livestock and poultry manure, sewage, biogas residue, or biogas slurry as fertilizer, it shall be adapted to the land's absorption capacity, and effective measures shall be taken to eliminate microorganisms that may cause infectious diseases, preventing environmental pollution and the spread of epidemics.
从事畜禽养殖活动和畜禽养殖废弃物处理活动，应当及时对畜禽粪便、畜禽尸体、污水等进行收集、贮存、清运，防止恶臭和畜禽养殖废弃物渗出、泄漏。
Entities engaged in livestock and poultry breeding activities and waste treatment activities shall promptly collect, store, and transport livestock and poultry manure, carcasses, and sewage to prevent odor and leakage or seepage of livestock and poultry breeding waste.
向环境排放经过处理的畜禽养殖废弃物，应当符合国家和地方规定的污染物排放标准和总量控制指标。畜禽养殖废弃物未经处理，不得直接向环境排放。
The discharge of treated livestock and poultry breeding waste into the environment shall comply with the national and local pollutant discharge standards and total pollutant discharge control indicators. Livestock and poultry breeding waste shall not be directly discharged into the environment without treatment.
染疫畜禽以及染疫畜禽排泄物、染疫畜禽产品、病死或者死因不明的畜禽尸体等病害畜禽养殖废弃物，应当按照有关法律、法规和国务院农牧主管部门的规定，进行深埋、化制、焚烧等无害化处理，不得随意处置。
Diseased livestock and poultry, their excreta, products, and carcasses of dead or unknown cause, and other diseased livestock and poultry breeding waste shall be subjected to harmless treatment such as deep burial, rendering, or incineration in accordance with relevant laws, regulations, and the provisions of the agriculture administrative department of the State Council, and shall not be disposed of arbitrarily.
畜禽养殖场、养殖小区应当定期将畜禽养殖品种、规模以及畜禽养殖废弃物的产生、排放和综合利用等情况，报县级人民政府环境保护主管部门备案。环境保护主管部门应当定期将备案情况抄送同级农牧主管部门。
Livestock and poultry farms and breeding communities shall periodically report to the environmental protection administrative department of the county people's government for record the breed, scale, and the generation, discharge, and comprehensive utilization of livestock and poultry breeding waste. The environmental protection administrative department shall periodically send a copy of the record to the agriculture administrative department at the same level.
县级以上人民政府环境保护主管部门应当依据职责对畜禽养殖污染防治情况进行监督检查，并加强对畜禽养殖环境污染的监测。
The environmental protection administrative department of the people's government at or above the county level shall, in accordance with its duties, supervise and inspect the prevention and control of pollution from livestock and poultry breeding, and strengthen the monitoring of environmental pollution from livestock and poultry breeding.
乡镇人民政府、基层群众自治组织发现畜禽养殖环境污染行为的，应当及时制止和报告。
Township people's governments and grassroots self-governing organizations shall promptly stop and report any environmental pollution from livestock and poultry breeding that they discover.
对污染严重的畜禽养殖密集区域，市、县人民政府应当制定综合整治方案，采取组织建设畜禽养殖废弃物综合利用和无害化处理设施、有计划搬迁或者关闭畜禽养殖场所等措施，对畜禽养殖污染进行治理。
For areas with dense livestock and poultry breeding that are heavily polluted, the city or county people's government shall formulate a comprehensive remediation plan, and take measures such as organizing the construction of facilities for comprehensive utilization and harmless treatment of livestock and poultry breeding waste, and planned relocation or closure of livestock and poultry breeding sites, to treat the pollution from livestock and poultry breeding.
因畜牧业发展规划、土地利用总体规划、城乡规划调整以及划定禁止养殖区域，或者因对污染严重的畜禽养殖密集区域进行综合整治，确需关闭或者搬迁现有畜禽养殖场所，致使畜禽养殖者遭受经济损失的，由县级以上地方人民政府依法予以补偿。
If the closure or relocation of existing livestock and poultry breeding sites is necessary due to adjustments in the animal husbandry development plan, land use master plan, urban and rural planning, or the designation of prohibited breeding areas, or due to comprehensive remediation of heavily polluted dense breeding areas, causing economic losses to livestock and poultry breeders, the local people's government at or above the county level shall provide compensation in accordance with the law.
激励措施
Incentive Measures
县级以上人民政府应当采取示范奖励等措施，扶持规模化、标准化畜禽养殖，支持畜禽养殖场、养殖小区进行标准化改造和污染防治设施建设与改造，鼓励分散饲养向集约饲养方式转变。
People's governments at or above the county level shall adopt measures such as demonstration rewards to support large-scale and standardized livestock and poultry breeding, support the standardization renovation of livestock and poultry farms and breeding communities and the construction and renovation of pollution prevention facilities, and encourage the transition from scattered feeding to intensive feeding.
县级以上地方人民政府在组织编制土地利用总体规划过程中，应当统筹安排，将规模化畜禽养殖用地纳入规划，落实养殖用地。
When organizing the formulation of the land use master plan, the local people's government at or above the county level shall make overall arrangements, incorporate land for large-scale livestock and poultry breeding into the plan, and ensure the implementation of breeding land.
国家鼓励利用废弃地和荒山、荒沟、荒丘、荒滩等未利用地开展规模化、标准化畜禽养殖。
The State encourages the use of abandoned land and unused land such as barren hills, gullies, mounds, and beaches for large-scale and standardized livestock and poultry breeding.
畜禽养殖用地按农用地管理，并按照国家有关规定确定生产设施用地和必要的污染防治等附属设施用地。
Land for livestock and poultry breeding shall be managed as agricultural land, and the land for production facilities and necessary ancillary facilities for pollution prevention shall be determined in accordance with the relevant provisions of the State.
建设和改造畜禽养殖污染防治设施，可以按照国家规定申请包括污染治理贷款贴息补助在内的环境保护等相关资金支持。
The construction and renovation of pollution prevention facilities for livestock and poultry breeding may apply for relevant environmental protection and other financial support, including subsidies for pollution control loan interest, in accordance with the provisions of the State.
进行畜禽养殖污染防治，从事利用畜禽养殖废弃物进行有机肥产品生产经营等畜禽养殖废弃物综合利用活动的，享受国家规定的相关税收优惠政策。
Entities engaged in the prevention and control of pollution from livestock and poultry breeding and in activities for comprehensive utilization of livestock and poultry breeding waste, such as the production and operation of organic fertilizer products using livestock and poultry breeding waste, shall enjoy the relevant tax preferential policies stipulated by the State.
利用畜禽养殖废弃物生产有机肥产品的，享受国家关于化肥运力安排等支持政策；购买使用有机肥产品的，享受不低于国家关于化肥的使用补贴等优惠政策。
Entities that produce organic fertilizer products using livestock and poultry breeding waste shall enjoy the State's support policies such as the arrangement of transportation capacity for chemical fertilizers; entities that purchase and use organic fertilizer products shall enjoy preferential policies such as subsidies not lower than those for the use of chemical fertilizers.
畜禽养殖场、养殖小区的畜禽养殖污染防治设施运行用电执行农业用电价格。
The electricity used for the operation of pollution prevention facilities in livestock and poultry farms and breeding communities shall be charged at agricultural electricity prices.
国家鼓励和支持利用畜禽养殖废弃物进行沼气发电，自发自用、多余电量接入电网。电网企业应当依照法律和国家有关规定为沼气发电提供无歧视的电网接入服务，并全额收购其电网覆盖范围内符合并网技术标准的多余电量。
The State encourages and supports the use of livestock and poultry breeding waste for biogas power generation, self-consumption with surplus electricity connected to the grid. Grid enterprises shall, in accordance with the law and the relevant provisions of the State, provide non-discriminatory grid connection services for biogas power generation and purchase in full the surplus electricity within their coverage that meets the grid connection technical standards.
利用畜禽养殖废弃物进行沼气发电的，依法享受国家规定的上网电价优惠政策。利用畜禽养殖废弃物制取沼气或进而制取天然气的，依法享受新能源优惠政策。
Entities using livestock and poultry breeding waste for biogas power generation shall enjoy the preferential on-grid electricity price policies stipulated by the State. Entities using livestock and poultry breeding waste to produce biogas or further produce natural gas shall enjoy the preferential policies for new energy.
地方各级人民政府可以根据本地区实际，对畜禽养殖场、养殖小区支出的建设项目环境影响咨询费用给予补助。
Local people's governments at all levels may, based on the actual conditions of their regions, provide subsidies for the expenses incurred by livestock and poultry farms and breeding communities for environmental impact consultation fees for construction projects.
国家鼓励和支持对染疫畜禽、病死或者死因不明畜禽尸体进行集中无害化处理，并按照国家有关规定对处理费用、养殖损失给予适当补助。
The State encourages and supports the centralized harmless treatment of diseased livestock and poultry, carcasses of dead or unknown cause, and shall provide appropriate subsidies for treatment costs and breeding losses in accordance with the relevant provisions of the State.
畜禽养殖场、养殖小区排放污染物符合国家和地方规定的污染物排放标准和总量控制指标，自愿与环境保护主管部门签订进一步削减污染物排放量协议的，由县级人民政府按照国家有关规定给予奖励，并优先列入县级以上人民政府安排的环境保护和畜禽养殖发展相关财政资金扶持范围。
If livestock and poultry farms or breeding communities discharge pollutants that meet the national and local pollutant discharge standards and total pollutant discharge control indicators, and voluntarily sign an agreement with the environmental protection administrative department to further reduce pollutant discharge, the county people's government shall give rewards in accordance with the relevant provisions of the State, and give priority to including them in the scope of financial support for environmental protection and livestock and poultry breeding development arranged by the people's government at or above the county level.
畜禽养殖户自愿建设综合利用和无害化处理设施、采取措施减少污染物排放的，可以依照本条例规定享受相关激励和扶持政策。
Livestock and poultry breeders who voluntarily construct comprehensive utilization and harmless treatment facilities and take measures to reduce pollutant discharge may enjoy the relevant incentive and support policies in accordance with the provisions of this Regulation.
法律责任
Legal Liability
各级人民政府环境保护主管部门、农牧主管部门以及其他有关部门未依照本条例规定履行职责的，对直接负责的主管人员和其他直接责任人员依法给予处分；直接负责的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任。
If the environmental protection administrative department, the agriculture administrative department, or other relevant departments of the people's government at any level fail to perform their duties in accordance with the provisions of this Regulation, the directly responsible person in charge and other directly responsible personnel shall be given sanctions in accordance with the law; if the directly responsible person in charge and other directly responsible personnel constitute a crime, criminal liability shall be pursued in accordance with the law.
违反本条例规定，在禁止养殖区域内建设畜禽养殖场、养殖小区的，由县级以上地方人民政府环境保护主管部门责令停止违法行为；拒不停止违法行为的，处3万元以上10万元以下的罚款，并报县级以上人民政府责令拆除或者关闭。在饮用水水源保护区建设畜禽养殖场、养殖小区的，由县级以上地方人民政府环境保护主管部门责令停止违法行为，处10万元以上50万元以下的罚款，并报经有批准权的人民政府批准，责令拆除或者关闭。
In violation of the provisions of this Regulation, if a livestock and poultry farm or breeding community is constructed in a prohibited breeding area, the environmental protection administrative department of the local people's government at or above the county level shall order the cessation of the illegal act; if the illegal act is not ceased, a fine of not less than 30,000 yuan but not more than 100,000 yuan shall be imposed, and the matter shall be reported to the people's government at or above the county level for an order to demolish or close the facility. If a livestock and poultry farm or breeding community is constructed in a drinking water source protection area, the environmental protection administrative department of the local people's government at or above the county level shall order the cessation of the illegal act, impose a fine of not less than 100,000 yuan but not more than 500,000 yuan, and report to the people's government with approval authority for approval to order demolition or closure.
违反本条例规定，畜禽养殖场、养殖小区依法应当进行环境影响评价而未进行的，由有权审批该项目环境影响评价文件的环境保护主管部门责令停止建设，限期补办手续；逾期不补办手续的，处5万元以上20万元以下的罚款。
In violation of the provisions of this Regulation, if a livestock and poultry farm or breeding community should have conducted an environmental impact assessment but did not, the environmental protection administrative department with the authority to approve the environmental impact assessment document for the project shall order the cessation of construction and require the completion of the procedures within a specified period; if the procedures are not completed within the specified period, a fine of not less than 50,000 yuan but not more than 200,000 yuan shall be imposed.
违反本条例规定，未建设污染防治配套设施或者自行建设的配套设施不合格，也未委托他人对畜禽养殖废弃物进行综合利用和无害化处理，畜禽养殖场、养殖小区即投入生产、使用，或者建设的污染防治配套设施未正常运行的，由县级以上人民政府环境保护主管部门责令停止生产或者使用，可以处10万元以下的罚款。
In violation of the provisions of this Regulation, if no pollution prevention supporting facilities have been constructed, or the self-constructed supporting facilities are unqualified, and no entrustment has been made to others for the comprehensive utilization and harmless treatment of livestock and poultry breeding waste, and the livestock and poultry farm or breeding community has already commenced production or use, or if the constructed pollution prevention supporting facilities are not operated normally, the environmental protection administrative department of the people's government at or above the county level shall order the cessation of production or use, and may impose a fine of not more than 100,000 yuan.
违反本条例规定，有下列行为之一的，由县级以上地方人民政府环境保护主管部门责令停止违法行为，限期采取治理措施消除污染，依照《中华人民共和国水污染防治法》、《中华人民共和国固体废物污染环境防治法》的有关规定予以处罚：
In violation of the provisions of this Regulation, if any of the following acts occurs, the environmental protection administrative department of the local people's government at or above the county level shall order the cessation of the illegal act, require the adoption of treatment measures within a specified period to eliminate pollution, and impose penalties in accordance with the relevant provisions of the Water Pollution Prevention and Control Law of the People's Republic of China and the Law on the Prevention and Control of Environmental Pollution by Solid Waste:
(一)将畜禽养殖废弃物用作肥料，超出土地消纳能力，造成环境污染的；
(1) Using livestock and poultry breeding waste as fertilizer beyond the land's absorption capacity, causing environmental pollution;
(二)从事畜禽养殖活动或者畜禽养殖废弃物处理活动，未采取有效措施，导致畜禽养殖废弃物渗出、泄漏的。
(2) Engaging in livestock and poultry breeding activities or waste treatment activities without taking effective measures, resulting in leakage or seepage of livestock and poultry breeding waste.
排放畜禽养殖废弃物不符合国家或者地方规定的污染物排放标准或者总量控制指标，或者未经无害化处理直接向环境排放畜禽养殖废弃物的，由县级以上地方人民政府环境保护主管部门责令限期治理，可以处5万元以下的罚款。县级以上地方人民政府环境保护主管部门作出限期治理决定后，应当会同同级人民政府农牧等有关部门对整改措施的落实情况及时进行核查，并向社会公布核查结果。
If the discharge of livestock and poultry breeding waste does not meet the national or local pollutant discharge standards or total pollutant discharge control indicators, or if livestock and poultry breeding waste is directly discharged into the environment without harmless treatment, the environmental protection administrative department of the local people's government at or above the county level shall order treatment within a specified period and may impose a fine of not more than 50,000 yuan. After making the decision on treatment within a specified period, the environmental protection administrative department of the local people's government at or above the county level shall, in conjunction with the agriculture and other relevant departments of the people's government at the same level, promptly verify the implementation of the rectification measures and make the verification results public.
未按照规定对染疫畜禽和病害畜禽养殖废弃物进行无害化处理的，由动物卫生监督机构责令无害化处理，所需处理费用由违法行为人承担，可以处3000元以下的罚款。
If harmless treatment is not carried out in accordance with the regulations for diseased livestock and poultry and diseased livestock and poultry breeding waste, the animal health supervision institution shall order harmless treatment, and the required treatment costs shall be borne by the violator, and a fine of not more than 3,000 yuan may be imposed.
附则
Supplementary Provisions
畜禽养殖场、养殖小区的具体规模标准由省级人民政府确定，并报国务院环境保护主管部门和国务院农牧主管部门备案。
The specific scale standards for livestock and poultry farms and breeding communities shall be determined by the provincial people's government and reported to the environmental protection administrative department of the State Council and the agriculture administrative department of the State Council for record.
本条例自2014年1月1日起施行。
This Regulation shall come into force as of January 1, 2014.
