总则
General Provisions
为了规范戒毒工作，帮助吸毒成瘾人员戒除毒瘾，维护社会秩序，根据《中华人民共和国禁毒法》，制定本条例。
These Regulations are formulated in accordance with the Narcotics Control Law of the People's Republic of China to standardize drug rehabilitation work, help drug addicts overcome their addiction, and maintain social order.
县级以上人民政府应当建立政府统一领导，禁毒委员会组织、协调、指导，有关部门各负其责，社会力量广泛参与的戒毒工作体制。
People's governments at or above the county level shall establish a drug rehabilitation work system featuring unified leadership by the government, organization, coordination, and guidance by the narcotics control committee, respective responsibilities of relevant departments, and extensive participation of social forces.
戒毒工作坚持以人为本、科学戒毒、综合矫治、关怀救助的原则，采取自愿戒毒、社区戒毒、强制隔离戒毒、社区康复等多种措施，建立戒毒治疗、康复指导、救助服务兼备的工作体系。
Drug rehabilitation work adheres to the principles of people-oriented approach, scientific rehabilitation, comprehensive correction, and care and assistance, and adopts various measures such as voluntary rehabilitation, community rehabilitation, compulsory isolation rehabilitation, and community recovery, establishing a work system that integrates rehabilitation treatment, recovery guidance, and assistance services.
县级以上人民政府应当按照国家有关规定将戒毒工作所需经费列入本级财政预算。
People's governments at or above the county level shall, in accordance with relevant state regulations, include the funds required for drug rehabilitation work in their fiscal budgets at the corresponding level.
县级以上地方人民政府设立的禁毒委员会可以组织公安机关、卫生行政和负责药品监督管理的部门开展吸毒监测、调查，并向社会公开监测、调查结果。
The narcotics control committee established by local people's governments at or above the county level may organize public security organs, health administrative departments, and drug regulatory departments to conduct drug monitoring and investigations, and make the monitoring and investigation results public.
县级以上地方人民政府公安机关负责对涉嫌吸毒人员进行检测，对吸毒人员进行登记并依法实行动态管控，依法责令社区戒毒、决定强制隔离戒毒、责令社区康复，管理公安机关的强制隔离戒毒场所、戒毒康复场所，对社区戒毒、社区康复工作提供指导和支持。
The public security organ of the local people's government at or above the county level is responsible for testing suspected drug users, registering drug users and implementing dynamic control according to law, ordering community rehabilitation, deciding on compulsory isolation rehabilitation, ordering community recovery, managing the compulsory isolation rehabilitation facilities and drug rehabilitation recovery facilities of the public security organ, and providing guidance and support for community rehabilitation and community recovery work.
设区的市级以上地方人民政府司法行政部门负责管理司法行政部门的强制隔离戒毒场所、戒毒康复场所，对社区戒毒、社区康复工作提供指导和支持。
The judicial administrative department of the local people's government at or above the city divided into districts shall manage the compulsory isolation rehabilitation facilities and drug rehabilitation recovery facilities of the judicial administrative department, and provide guidance and support for community rehabilitation and community recovery work.
县级以上地方人民政府卫生行政部门负责戒毒医疗机构的监督管理，会同公安机关、司法行政等部门制定戒毒医疗机构设置规划，对戒毒医疗服务提供指导和支持。
The health administrative department of the local people's government at or above the county level is responsible for the supervision and management of drug rehabilitation medical institutions, formulating plans for the establishment of drug rehabilitation medical institutions together with public security organs and judicial administrative departments, and providing guidance and support for drug rehabilitation medical services.
县级以上地方人民政府民政、人力资源社会保障、教育等部门依据各自的职责，对社区戒毒、社区康复工作提供康复和职业技能培训等指导和支持。
The civil affairs, human resources and social security, education and other departments of the local people's government at or above the county level shall, in accordance with their respective duties, provide guidance and support such as rehabilitation and vocational skills training for community rehabilitation and community recovery work.
乡(镇)人民政府、城市街道办事处负责社区戒毒、社区康复工作。
Town (township) people's governments and sub-district offices are responsible for community rehabilitation and community recovery work.
县级、设区的市级人民政府需要设置强制隔离戒毒场所、戒毒康复场所的，应当合理布局，报省、自治区、直辖市人民政府批准，并纳入当地国民经济和社会发展规划。
If a people's government at the county level or at the level of a city divided into districts needs to set up compulsory isolation rehabilitation facilities or drug rehabilitation recovery facilities, it shall make a reasonable layout, report to the people's government of the province, autonomous region, or municipality directly under the Central Government for approval, and incorporate them into the local national economic and social development plan.
强制隔离戒毒场所、戒毒康复场所的建设标准，由国务院建设部门、发展改革部门会同国务院公安部门、司法行政部门制定。
The construction standards for compulsory isolation rehabilitation facilities and drug rehabilitation recovery facilities shall be formulated by the construction department and the development and reform department of the State Council together with the public security department and the judicial administrative department of the State Council.
戒毒人员在入学、就业、享受社会保障等方面不受歧视。
Drug rehabilitation personnel shall not be discriminated against in terms of school enrollment, employment, and enjoyment of social security.
对戒毒人员戒毒的个人信息应当依法予以保密。对戒断3年未复吸的人员，不再实行动态管控。
The personal information of drug rehabilitation personnel shall be kept confidential according to law. For those who have been abstinent for three years without relapse, dynamic control shall no longer be implemented.
国家鼓励、扶持社会组织、企业、事业单位和个人参与戒毒科研、戒毒社会服务和戒毒社会公益事业。
The state encourages and supports social organizations, enterprises, institutions, and individuals to participate in drug rehabilitation scientific research, drug rehabilitation social services, and drug rehabilitation social welfare undertakings.
对在戒毒工作中有显著成绩和突出贡献的，按照国家有关规定给予表彰、奖励。
Those who have made remarkable achievements and outstanding contributions in drug rehabilitation work shall be commended and rewarded in accordance with relevant state regulations.
自愿戒毒
Voluntary Drug Rehabilitation
国家鼓励吸毒成瘾人员自行戒除毒瘾。吸毒人员可以自行到戒毒医疗机构接受戒毒治疗。对自愿接受戒毒治疗的吸毒人员，公安机关对其原吸毒行为不予处罚。
The state encourages drug addicts to voluntarily overcome their addiction. Drug users may voluntarily go to drug rehabilitation medical institutions to receive rehabilitation treatment. For drug users who voluntarily accept drug rehabilitation treatment, the public security organ shall not impose penalties for their original drug use.
戒毒医疗机构应当与自愿戒毒人员或者其监护人签订自愿戒毒协议，就戒毒方法、戒毒期限、戒毒的个人信息保密、戒毒人员应当遵守的规章制度、终止戒毒治疗的情形等作出约定，并应当载明戒毒疗效、戒毒治疗风险。
Drug rehabilitation medical institutions shall sign a voluntary drug rehabilitation agreement with the voluntary rehabilitation personnel or their guardians, stipulating matters such as rehabilitation methods, rehabilitation period, confidentiality of personal information of rehabilitation personnel, rules and regulations to be observed by rehabilitation personnel, and circumstances for termination of rehabilitation treatment, and shall specify the efficacy and risks of rehabilitation treatment.
戒毒医疗机构应当履行下列义务：
Drug rehabilitation medical institutions shall perform the following obligations:
(一)对自愿戒毒人员开展艾滋病等传染病的预防、咨询教育；
(1) Conduct prevention and consultation education on infectious diseases such as AIDS for voluntary rehabilitation personnel;
(二)对自愿戒毒人员采取脱毒治疗、心理康复、行为矫治等多种治疗措施，并应当符合国务院卫生行政部门制定的戒毒治疗规范；
(2) Adopt various treatment measures such as detoxification treatment, psychological rehabilitation, and behavioral correction for voluntary rehabilitation personnel, and shall comply with the drug rehabilitation treatment standards formulated by the health administrative department of the State Council;
(三)采用科学、规范的诊疗技术和方法，使用的药物、医院制剂、医疗器械应当符合国家有关规定；
(3) Use scientific and standardized diagnosis and treatment techniques and methods, and the drugs, hospital preparations, and medical devices used shall comply with relevant state regulations;
(四)依法加强药品管理，防止麻醉药品、精神药品流失滥用。
(4) Strengthen drug management according to law to prevent the loss and abuse of narcotic drugs and psychotropic substances.
符合参加戒毒药物维持治疗条件的戒毒人员，由本人申请，并经登记，可以参加戒毒药物维持治疗。登记参加戒毒药物维持治疗的戒毒人员的信息应当及时报公安机关备案。
Drug addicts who meet the conditions for participating in drug maintenance treatment may apply and, upon registration, participate in drug maintenance treatment. Information on drug addicts registered for drug maintenance treatment shall be promptly reported to the public security organ for record.
戒毒药物维持治疗的管理办法，由国务院卫生行政部门会同国务院公安部门、药品监督管理部门制定。
The administrative measures for drug maintenance treatment shall be formulated by the health administrative department of the State Council jointly with the public security department and the drug regulatory department of the State Council.
社区戒毒
Community Drug Rehabilitation
对吸毒成瘾人员，县级、设区的市级人民政府公安机关可以责令其接受社区戒毒，并出具责令社区戒毒决定书，送达本人及其家属，通知本人户籍所在地或者现居住地乡(镇)人民政府、城市街道办事处。
For drug addicts, the public security organ of the people's government at the county level or the city divided into districts may order them to undergo community drug rehabilitation and issue a decision order for community drug rehabilitation, which shall be served to the individual and their family members, and notify the township (town) people's government or urban sub-district office of the place of registered residence or current residence.
社区戒毒人员应当自收到责令社区戒毒决定书之日起15日内到社区戒毒执行地乡(镇)人民政府、城市街道办事处报到，无正当理由逾期不报到的，视为拒绝接受社区戒毒。
A person undergoing community drug rehabilitation shall report to the township (town) people's government or urban sub-district office of the place of execution of community drug rehabilitation within 15 days from the date of receiving the decision order for community drug rehabilitation. Failure to report without justifiable reasons within the time limit shall be deemed as refusal to accept community drug rehabilitation.
社区戒毒的期限为3年，自报到之日起计算。
The term of community drug rehabilitation is 3 years, calculated from the date of reporting.
乡(镇)人民政府、城市街道办事处应当根据工作需要成立社区戒毒工作领导小组，配备社区戒毒专职工作人员，制定社区戒毒工作计划，落实社区戒毒措施。
The township (town) people's government or urban sub-district office shall, based on work needs, establish a community drug rehabilitation work leading group, assign full-time community drug rehabilitation staff, formulate community drug rehabilitation work plans, and implement community drug rehabilitation measures.
乡(镇)人民政府、城市街道办事处，应当在社区戒毒人员报到后及时与其签订社区戒毒协议，明确社区戒毒的具体措施、社区戒毒人员应当遵守的规定以及违反社区戒毒协议应承担的责任。
The township (town) people's government or urban sub-district office shall, promptly after the person undergoing community drug rehabilitation reports, sign a community drug rehabilitation agreement with them, specifying the specific measures of community drug rehabilitation, the rules to be observed by the person undergoing community drug rehabilitation, and the responsibilities for violating the community drug rehabilitation agreement.
社区戒毒专职工作人员、社区民警、社区医务人员、社区戒毒人员的家庭成员以及禁毒志愿者共同组成社区戒毒工作小组具体实施社区戒毒。
Full-time community drug rehabilitation staff, community police officers, community medical personnel, family members of the person undergoing community drug rehabilitation, and anti-drug volunteers shall jointly form a community drug rehabilitation work group to specifically implement community drug rehabilitation.
乡(镇)人民政府、城市街道办事处和社区戒毒工作小组应当采取下列措施管理、帮助社区戒毒人员：
The township (town) people's government or urban sub-district office and the community drug rehabilitation work group shall take the following measures to manage and assist the person undergoing community drug rehabilitation:
(一)戒毒知识辅导；
(1) Guidance on drug rehabilitation knowledge;
(二)教育、劝诫；
(2) Education and admonition;
(三)职业技能培训，职业指导，就学、就业、就医援助；
(3) Vocational skills training, career guidance, assistance in schooling, employment, and medical treatment;
(四)帮助戒毒人员戒除毒瘾的其他措施。
(4) Other measures to help drug addicts overcome drug addiction.
社区戒毒人员应当遵守下列规定：
A person undergoing community drug rehabilitation shall observe the following rules:
(一)履行社区戒毒协议；
(1) Fulfill the community drug rehabilitation agreement;
(二)根据公安机关的要求，定期接受检测；
(2) Undergo regular testing as required by the public security organ;
(三)离开社区戒毒执行地所在县(市、区)3日以上的，须书面报告。
(3) If leaving the county (city, district) where the community drug rehabilitation is executed for more than 3 days, a written report must be submitted.
社区戒毒人员在社区戒毒期间，逃避或者拒绝接受检测3次以上，擅自离开社区戒毒执行地所在县(市、区)3次以上或者累计超过30日的，属于《中华人民共和国禁毒法》规定的“严重违反社区戒毒协议”。
If a person undergoing community drug rehabilitation evades or refuses testing 3 times or more, or leaves the county (city, district) where the community drug rehabilitation is executed without authorization 3 times or more or for a cumulative total exceeding 30 days during the community drug rehabilitation period, it constitutes a 'serious violation of the community drug rehabilitation agreement' as stipulated in the Drug Control Law of the People's Republic of China.
社区戒毒人员拒绝接受社区戒毒，在社区戒毒期间又吸食、注射毒品，以及严重违反社区戒毒协议的，社区戒毒专职工作人员应当及时向当地公安机关报告。
If a person undergoing community drug rehabilitation refuses to accept community drug rehabilitation, or uses or injects drugs again during the community drug rehabilitation period, or seriously violates the community drug rehabilitation agreement, the full-time community drug rehabilitation staff shall promptly report to the local public security organ.
社区戒毒人员的户籍所在地或者现居住地发生变化，需要变更社区戒毒执行地的，社区戒毒执行地乡(镇)人民政府、城市街道办事处应当将有关材料转送至变更后的乡(镇)人民政府、城市街道办事处。
If the place of registered residence or current residence of a person undergoing community drug rehabilitation changes, requiring a change in the place of execution of community drug rehabilitation, the township (town) people's government or urban sub-district office of the original place of execution shall transfer the relevant materials to the changed township (town) people's government or urban sub-district office.
社区戒毒人员应当自社区戒毒执行地变更之日起15日内前往变更后的乡(镇)人民政府、城市街道办事处报到，社区戒毒时间自报到之日起连续计算。
The person undergoing community drug rehabilitation shall report to the changed township (town) people's government or urban sub-district office within 15 days from the date of change of the place of execution of community drug rehabilitation, and the time of community drug rehabilitation shall be calculated continuously from the date of reporting.
变更后的乡(镇)人民政府、城市街道办事处，应当按照本条例第十六条的规定，与社区戒毒人员签订新的社区戒毒协议，继续执行社区戒毒。
The changed township (town) people's government or urban sub-district office shall, in accordance with Article 16 of these Regulations, sign a new community drug rehabilitation agreement with the person undergoing community drug rehabilitation and continue to execute community drug rehabilitation.
社区戒毒自期满之日起解除。社区戒毒执行地公安机关应当出具解除社区戒毒通知书送达社区戒毒人员本人及其家属，并在7日内通知社区戒毒执行地乡(镇)人民政府、城市街道办事处。
Community drug rehabilitation shall be terminated from the date of expiration. The public security organ of the place of execution of community drug rehabilitation shall issue a notice of termination of community drug rehabilitation, serve it to the person undergoing community drug rehabilitation and their family members, and notify the township (town) people's government or urban sub-district office of the place of execution of community drug rehabilitation within 7 days.
社区戒毒人员被依法收监执行刑罚、采取强制性教育措施的，社区戒毒终止。
If a person undergoing community drug rehabilitation is lawfully taken into custody to serve a criminal sentence or subjected to compulsory educational measures, the community drug rehabilitation shall be terminated.
社区戒毒人员被依法拘留、逮捕的，社区戒毒中止，由羁押场所给予必要的戒毒治疗，释放后继续接受社区戒毒。
If a person undergoing community drug rehabilitation is lawfully detained or arrested, the community drug rehabilitation shall be suspended, and the detention facility shall provide necessary drug treatment. After release, the person shall continue to receive community drug rehabilitation.
强制隔离戒毒
Compulsory Isolation Drug Rehabilitation
吸毒成瘾人员有《中华人民共和国禁毒法》第三十八条第一款所列情形之一的，由县级、设区的市级人民政府公安机关作出强制隔离戒毒的决定。
For drug addicts who fall under any of the circumstances listed in Article 38, paragraph 1 of the Drug Control Law of the People's Republic of China, the public security organ of the people's government at the county level or the city divided into districts shall make a decision on compulsory isolation drug rehabilitation.
对于吸毒成瘾严重，通过社区戒毒难以戒除毒瘾的人员，县级、设区的市级人民政府公安机关可以直接作出强制隔离戒毒的决定。
For drug addicts with severe addiction who cannot be rehabilitated through community drug rehabilitation, the public security organ of the people's government at the county level or the city divided into districts may directly make a decision on compulsory isolation drug rehabilitation.
吸毒成瘾人员自愿接受强制隔离戒毒的，经强制隔离戒毒场所所在地县级、设区的市级人民政府公安机关同意，可以进入强制隔离戒毒场所戒毒。强制隔离戒毒场所应当与其就戒毒治疗期限、戒毒治疗措施等作出约定。
If a drug addict voluntarily accepts compulsory isolation drug rehabilitation, with the consent of the public security organ of the people's government at the county level or the city divided into districts where the compulsory isolation drug rehabilitation facility is located, the person may enter the facility for rehabilitation. The facility shall reach an agreement with the person on the treatment period and treatment measures.
对依照《中华人民共和国禁毒法》第三十九条第一款规定不适用强制隔离戒毒的吸毒成瘾人员，县级、设区的市级人民政府公安机关应当作出社区戒毒的决定，依照本条例第三章的规定进行社区戒毒。
For drug addicts who are not subject to compulsory isolation drug rehabilitation in accordance with Article 39, paragraph 1 of the Drug Control Law of the People's Republic of China, the public security organ of the people's government at the county level or the city divided into districts shall make a decision on community drug rehabilitation, and community drug rehabilitation shall be carried out in accordance with Chapter III of these Regulations.
强制隔离戒毒的期限为2年，自作出强制隔离戒毒决定之日起计算。
The period of compulsory isolation drug rehabilitation shall be two years, calculated from the date of the decision on compulsory isolation drug rehabilitation.
被强制隔离戒毒的人员在公安机关的强制隔离戒毒场所执行强制隔离戒毒3个月至6个月后，转至司法行政部门的强制隔离戒毒场所继续执行强制隔离戒毒。
A person subjected to compulsory isolation drug rehabilitation shall serve the compulsory isolation in a facility under the public security organ for three to six months, and then be transferred to a facility under the judicial administration department to continue serving the compulsory isolation.
执行前款规定不具备条件的省、自治区、直辖市，由公安机关和司法行政部门共同提出意见报省、自治区、直辖市人民政府决定具体执行方案，但在公安机关的强制隔离戒毒场所执行强制隔离戒毒的时间不得超过12个月。
In provinces, autonomous regions, or municipalities directly under the Central Government where the conditions for implementing the preceding paragraph are not met, the public security organ and the judicial administration department shall jointly submit opinions to the people's government of the province, autonomous region, or municipality directly under the Central Government to decide on the specific implementation plan. However, the time served in a compulsory isolation drug rehabilitation facility under the public security organ shall not exceed 12 months.
强制隔离戒毒场所对强制隔离戒毒人员的身体和携带物品进行检查时发现的毒品等违禁品，应当依法处理；对生活必需品以外的其他物品，由强制隔离戒毒场所代为保管。
When a compulsory isolation drug rehabilitation facility inspects the body and belongings of a person subjected to compulsory isolation drug rehabilitation, any drugs or other prohibited items discovered shall be handled according to law; items other than daily necessities shall be kept in custody by the facility.
女性强制隔离戒毒人员的身体检查，应当由女性工作人员进行。
Body searches of female persons subjected to compulsory isolation drug rehabilitation shall be conducted by female staff.
强制隔离戒毒场所设立戒毒医疗机构应当经所在地省、自治区、直辖市人民政府卫生行政部门批准。强制隔离戒毒场所应当配备设施设备及必要的管理人员，依法为强制隔离戒毒人员提供科学规范的戒毒治疗、心理治疗、身体康复训练和卫生、道德、法制教育，开展职业技能培训。
A compulsory isolation drug rehabilitation facility that establishes a drug treatment medical institution shall obtain approval from the health administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government. The facility shall be equipped with facilities, equipment, and necessary management personnel, and shall provide scientific and standardized drug treatment, psychological treatment, physical rehabilitation training, and education on hygiene, morality, and legal system, as well as carry out vocational skills training for persons subjected to compulsory isolation drug rehabilitation according to law.
强制隔离戒毒场所应当根据强制隔离戒毒人员的性别、年龄、患病等情况对强制隔离戒毒人员实行分别管理；对吸食不同种类毒品的，应当有针对性地采取必要的治疗措施；根据戒毒治疗的不同阶段和强制隔离戒毒人员的表现，实行逐步适应社会的分级管理。
A compulsory isolation drug rehabilitation facility shall implement separate management for persons subjected to compulsory isolation drug rehabilitation based on gender, age, illness, and other circumstances; for those who abuse different types of drugs, targeted necessary treatment measures shall be taken; based on different stages of drug treatment and the performance of the persons subjected to compulsory isolation drug rehabilitation, graded management that gradually adapts to society shall be implemented.
强制隔离戒毒人员患严重疾病，不出所治疗可能危及生命的，经强制隔离戒毒场所主管机关批准，并报强制隔离戒毒决定机关备案，强制隔离戒毒场所可以允许其所外就医。所外就医的费用由强制隔离戒毒人员本人承担。
If a person subjected to compulsory isolation drug rehabilitation suffers from a serious illness and not leaving the facility for treatment may be life-threatening, with the approval of the competent authority of the compulsory isolation drug rehabilitation facility and reporting to the authority that made the compulsory isolation decision for record, the facility may allow the person to receive medical treatment outside the facility. The expenses for medical treatment outside the facility shall be borne by the person subjected to compulsory isolation drug rehabilitation.
所外就医期间，强制隔离戒毒期限连续计算。对于健康状况不再适宜回所执行强制隔离戒毒的，强制隔离戒毒场所应当向强制隔离戒毒决定机关提出变更为社区戒毒的建议，强制隔离戒毒决定机关应当自收到建议之日起7日内，作出是否批准的决定。经批准变更为社区戒毒的，已执行的强制隔离戒毒期限折抵社区戒毒期限。
During the period of medical treatment outside the facility, the period of compulsory isolation drug rehabilitation shall be calculated continuously. If the person's health condition is no longer suitable for returning to the facility to serve compulsory isolation drug rehabilitation, the facility shall propose to the authority that made the compulsory isolation decision to change to community drug rehabilitation. The authority that made the compulsory isolation decision shall, within seven days from the date of receiving the proposal, decide whether to approve it. If the change to community drug rehabilitation is approved, the period of compulsory isolation drug rehabilitation already served shall be offset against the period of community drug rehabilitation.
强制隔离戒毒人员脱逃的，强制隔离戒毒场所应当立即通知所在地县级人民政府公安机关，并配合公安机关追回脱逃人员。被追回的强制隔离戒毒人员应当继续执行强制隔离戒毒，脱逃期间不计入强制隔离戒毒期限。被追回的强制隔离戒毒人员不得提前解除强制隔离戒毒。
If a person subjected to compulsory isolation drug rehabilitation escapes, the compulsory isolation drug rehabilitation facility shall immediately notify the public security organ of the people's government at the county level where the facility is located, and cooperate with the public security organ in recovering the escapee. The recovered person shall continue to serve compulsory isolation drug rehabilitation, and the period of escape shall not be counted toward the period of compulsory isolation drug rehabilitation. The recovered person shall not be released early from compulsory isolation drug rehabilitation.
对强制隔离戒毒场所依照《中华人民共和国禁毒法》第四十七条第二款、第三款规定提出的提前解除强制隔离戒毒、延长戒毒期限的意见，强制隔离戒毒决定机关应当自收到意见之日起7日内，作出是否批准的决定。对提前解除强制隔离戒毒或者延长强制隔离戒毒期限的，批准机关应当出具提前解除强制隔离戒毒决定书或者延长强制隔离戒毒期限决定书，送达被决定人，并在送达后24小时以内通知被决定人的家属、所在单位以及其户籍所在地或者现居住地公安派出所。
With respect to the opinions on early release from compulsory isolation drug rehabilitation or extension of the drug rehabilitation period submitted by the compulsory isolation drug rehabilitation facility in accordance with Article 47, paragraphs 2 and 3 of the Drug Control Law of the People's Republic of China, the authority that made the compulsory isolation decision shall, within seven days from the date of receiving the opinions, decide whether to approve them. If early release from compulsory isolation drug rehabilitation or extension of the compulsory isolation drug rehabilitation period is approved, the approving authority shall issue a decision on early release from compulsory isolation drug rehabilitation or a decision on extension of the compulsory isolation drug rehabilitation period, serve it on the person concerned, and notify the person's family members, employer, and the public security police station at the place of household registration or current residence within 24 hours after service.
解除强制隔离戒毒的，强制隔离戒毒场所应当在解除强制隔离戒毒3日前通知强制隔离戒毒决定机关，出具解除强制隔离戒毒证明书送达戒毒人员本人，并通知其家属、所在单位、其户籍所在地或者现居住地公安派出所将其领回。
When a person is released from compulsory isolation drug rehabilitation, the compulsory isolation drug rehabilitation facility shall notify the authority that made the compulsory isolation decision three days before the release, issue a certificate of release from compulsory isolation drug rehabilitation to the person, and notify the person's family members, employer, and the public security police station at the place of household registration or current residence to take the person back.
强制隔离戒毒诊断评估办法由国务院公安部门、司法行政部门会同国务院卫生行政部门制定。
The diagnostic assessment measures for compulsory isolation drug rehabilitation shall be formulated by the public security department and the judicial administration department of the State Council jointly with the health administrative department of the State Council.
强制隔离戒毒人员被依法收监执行刑罚、采取强制性教育措施或者被依法拘留、逮捕的，由监管场所、羁押场所给予必要的戒毒治疗，强制隔离戒毒的时间连续计算；刑罚执行完毕时、解除强制性教育措施时或者释放时强制隔离戒毒尚未期满的，继续执行强制隔离戒毒。
If a person subjected to compulsory isolation drug rehabilitation is lawfully taken into custody to serve a criminal sentence, subjected to compulsory educational measures, or lawfully detained or arrested, the custodial or detention facility shall provide necessary drug treatment, and the period of compulsory isolation drug rehabilitation shall be calculated continuously; if the compulsory isolation drug rehabilitation period has not expired when the criminal sentence is completed, the compulsory educational measures are lifted, or the person is released, the compulsory isolation drug rehabilitation shall continue.
社区康复
Community Recovery
对解除强制隔离戒毒的人员，强制隔离戒毒的决定机关可以责令其接受不超过3年的社区康复。
For persons released from compulsory isolation drug rehabilitation, the authority that made the compulsory isolation decision may order them to undergo community recovery for a period not exceeding three years.
社区康复在当事人户籍所在地或者现居住地乡(镇)人民政府、城市街道办事处执行，经当事人同意，也可以在戒毒康复场所中执行。
Community recovery shall be carried out by the township (town) people's government or sub-district office at the person's place of household registration or current residence. With the person's consent, it may also be carried out in a drug rehabilitation recovery facility.
被责令接受社区康复的人员，应当自收到责令社区康复决定书之日起15日内到户籍所在地或者现居住地乡(镇)人民政府、城市街道办事处报到，签订社区康复协议。
A person ordered to undergo community recovery shall, within 15 days from the date of receiving the decision on community recovery, report to the township (town) people's government or sub-district office at the place of household registration or current residence and sign a community recovery agreement.
被责令接受社区康复的人员拒绝接受社区康复或者严重违反社区康复协议，并再次吸食、注射毒品被决定强制隔离戒毒的，强制隔离戒毒不得提前解除。
If a person ordered to undergo community rehabilitation refuses to accept community rehabilitation or seriously violates the community rehabilitation agreement, and again uses or injects drugs and is ordered to undergo compulsory isolation detoxification, the compulsory isolation detoxification shall not be lifted early.
负责社区康复工作的人员应当为社区康复人员提供必要的心理治疗和辅导、职业技能培训、职业指导以及就学、就业、就医援助。
Personnel responsible for community rehabilitation work shall provide necessary psychological treatment and counseling, vocational skills training, career guidance, and assistance in schooling, employment, and medical treatment for community rehabilitation personnel.
社区康复自期满之日起解除。社区康复执行地公安机关出具解除社区康复通知书送达社区康复人员本人及其家属，并在7日内通知社区康复执行地乡(镇)人民政府、城市街道办事处。
Community rehabilitation shall be terminated from the date of expiration. The public security organ at the place where community rehabilitation is implemented shall issue a notice of termination of community rehabilitation and deliver it to the community rehabilitation person and their family members, and notify the township (town) people's government or urban sub-district office at the place of implementation within 7 days.
自愿戒毒人员、社区戒毒、社区康复的人员可以自愿与戒毒康复场所签订协议，到戒毒康复场所戒毒康复、生活和劳动。
Voluntary detoxification persons, community detoxification persons, and community rehabilitation persons may voluntarily sign an agreement with a drug rehabilitation facility to undergo drug rehabilitation, live, and work at the facility.
戒毒康复场所应当配备必要的管理人员和医务人员，为戒毒人员提供戒毒康复、职业技能培训和生产劳动条件。
Drug rehabilitation facilities shall be equipped with necessary management personnel and medical staff to provide drug rehabilitation, vocational skills training, and production labor conditions for drug addicts.
戒毒康复场所应当加强管理，严禁毒品流入，并建立戒毒康复人员自我管理、自我教育、自我服务的机制。
Drug rehabilitation facilities shall strengthen management, strictly prohibit the entry of drugs, and establish a mechanism for self-management, self-education, and self-service for drug rehabilitation personnel.
戒毒康复场所组织戒毒人员参加生产劳动，应当参照国家劳动用工制度的规定支付劳动报酬。
When drug rehabilitation facilities organize drug rehabilitation personnel to participate in production labor, they shall pay labor remuneration in accordance with the provisions of the national labor employment system.
法律责任
Legal Liability
公安、司法行政、卫生行政等有关部门工作人员泄露戒毒人员个人信息的，依法给予处分；构成犯罪的，依法追究刑事责任。
If staff members of public security, judicial administration, health administration, and other relevant departments disclose personal information of drug addicts, they shall be given sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law.
乡(镇)人民政府、城市街道办事处负责社区戒毒、社区康复工作的人员有下列行为之一的，依法给予处分：
If personnel of township (town) people's governments or urban sub-district offices responsible for community detoxification and community rehabilitation work commit any of the following acts, they shall be given sanctions according to law:
(一)未与社区戒毒、社区康复人员签订社区戒毒、社区康复协议，不落实社区戒毒、社区康复措施的；
(1) Failing to sign a community detoxification or community rehabilitation agreement with community detoxification or community rehabilitation personnel, or failing to implement community detoxification or community rehabilitation measures;
(二)不履行本条例第二十一条规定的报告义务的；
(2) Failing to fulfill the reporting obligations as stipulated in Article 21 of these Regulations;
(三)其他不履行社区戒毒、社区康复监督职责的行为。
(3) Other failures to perform the supervision duties of community detoxification or community rehabilitation.
强制隔离戒毒场所的工作人员有下列行为之一的，依法给予处分；构成犯罪的，依法追究刑事责任：
If staff members of compulsory isolation detoxification facilities commit any of the following acts, they shall be given sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)侮辱、虐待、体罚强制隔离戒毒人员的；
(1) Insulting, abusing, or physically punishing compulsory isolation detoxification personnel;
(二)收受、索要财物的；
(2) Accepting or soliciting property;
(三)擅自使用、损毁、处理没收或者代为保管的财物的；
(3) Unauthorized use, damage, or disposal of confiscated or custodial property;
(四)为强制隔离戒毒人员提供麻醉药品、精神药品或者违反规定传递其他物品的；
(4) Providing narcotic drugs or psychotropic substances to compulsory isolation detoxification personnel, or transferring other items in violation of regulations;
(五)在强制隔离戒毒诊断评估工作中弄虚作假的；
(5) Engaging in fraud in the diagnostic assessment of compulsory isolation detoxification;
(六)私放强制隔离戒毒人员的；
(6) Releasing compulsory isolation detoxification personnel without authorization;
(七)其他徇私舞弊、玩忽职守、不履行法定职责的行为。
(7) Other acts of engaging in malpractice for personal gain, dereliction of duty, or failing to perform statutory duties.
附则
Supplementary Provisions
本条例自公布之日起施行。1995年1月12日国务院发布的《强制戒毒办法》同时废止。
These Regulations shall come into force on the date of promulgation. The Measures on Compulsory Detoxification promulgated by the State Council on January 12, 1995 shall be abolished simultaneously.
