总则
General Provisions
为了保障人民警察依法履行职责，正确使用警械和武器，及时有效地制止违法犯罪行为，维护公共安全和社会秩序，保护公民的人身安全和合法财产，保护公共财产，根据《中华人民共和国人民警察法》和其他有关法律的规定，制定本条例。
These Regulations are formulated in accordance with the People's Police Law of the People's Republic of China and other relevant laws, with a view to ensuring that the People's Police perform their duties according to law, correctly use police implements and weapons, promptly and effectively stop illegal and criminal acts, maintain public safety and social order, protect the personal safety and lawful property of citizens, and protect public property.
人民警察制止违法犯罪行为，可以采取强制手段；根据需要，可以依照本条例的规定使用警械；使用警械不能制止，或者不使用武器制止，可能发生严重危害后果的，可以依照本条例的规定使用武器。
The People's Police may take coercive measures to stop illegal and criminal acts; they may use police implements in accordance with the provisions of these Regulations as necessary; if the use of police implements cannot stop the act, or if failure to use weapons may cause serious harmful consequences, they may use weapons in accordance with the provisions of these Regulations.
本条例所称警械，是指人民警察按照规定装备的警棍、催泪弹、高压水枪、特种防暴枪、手铐、脚镣、警绳等警用器械；所称武器，是指人民警察按照规定装备的枪支、弹药等致命性警用武器。
For the purposes of these Regulations, 'police implements' refer to police batons, tear gas, water cannons, special anti-riot guns, handcuffs, leg irons, police ropes, and other police instruments equipped according to regulations; 'weapons' refer to firearms, ammunition, and other lethal police weapons equipped according to regulations.
人民警察使用警械和武器，应当以制止违法犯罪行为，尽量减少人员伤亡、财产损失为原则。
The People's Police shall use police implements and weapons with the principle of stopping illegal and criminal acts while minimizing casualties and property losses.
人民警察依法使用警械和武器的行为，受法律保护。
The lawful use of police implements and weapons by the People's Police is protected by law.
人民警察不得违反本条例的规定使用警械和武器。
The People's Police shall not use police implements and weapons in violation of the provisions of these Regulations.
人民警察使用警械和武器前，应当命令在场无关人员躲避；在场无关人员应当服从人民警察的命令，避免受到伤害或者其他损失。
Before using police implements and weapons, the People's Police shall order irrelevant persons at the scene to take shelter; irrelevant persons at the scene shall obey the orders of the People's Police to avoid injury or other losses.
警械的使用
Use of Police Implements
人民警察遇有下列情形之一，经警告无效的，可以使用警棍、催泪弹、高压水枪、特种防暴枪等驱逐性、制服性警械：
The People's Police may use expelling and subduing police implements such as police batons, tear gas, water cannons, and special anti-riot guns in any of the following circumstances, if a warning is ineffective:
(一)结伙斗殴、殴打他人、寻衅滋事、侮辱妇女或者进行其他流氓活动的；
(1) Engaging in gang fights, assaulting others, creating disturbances, insulting women, or engaging in other hooligan activities;
(二)聚众扰乱车站、码头、民用航空站、运动场等公共场所秩序的；
(2) Gathering a crowd to disturb order at stations, docks, civil aviation stations, sports venues, or other public places;
(三)非法举行集会、游行、示威的；
(3) Illegally holding assemblies, processions, or demonstrations;
(四)强行冲越人民警察为履行职责设置的警戒线的；
(4) Forcibly crossing cordons set up by the People's Police in the performance of their duties;
(五)以暴力方法抗拒或者阻碍人民警察依法履行职责的；
(5) Resisting or obstructing the People's Police in the lawful performance of their duties by violent means;
(六)袭击人民警察的；
(6) Assaulting the People's Police;
(七)危害公共安全、社会秩序和公民人身安全的其他行为，需要当场制止的；
(7) Other acts that endanger public safety, social order, or the personal safety of citizens, which need to be stopped on the spot;
(八)法律、行政法规规定可以使用警械的其他情形。
(8) Other circumstances where the use of police implements is permitted by laws or administrative regulations.
人民警察依照前款规定使用警械，应当以制止违法犯罪行为为限度；当违法犯罪行为得到制止时，应当立即停止使用。
When using police implements in accordance with the preceding paragraph, the People's Police shall limit the use to stopping the illegal or criminal act; when the illegal or criminal act has been stopped, the use shall be immediately discontinued.
人民警察依法执行下列任务，遇有违法犯罪分子可能脱逃、行凶、自杀、自伤或者有其他危险行为的，可以使用手铐、脚镣、警绳等约束性警械：
When lawfully performing any of the following tasks, the People's Police may use restraining police implements such as handcuffs, leg irons, and police ropes if there is a possibility that the offender or suspect may escape, commit assault, commit suicide, self-harm, or engage in other dangerous acts:
(一)抓获违法犯罪分子或者犯罪重大嫌疑人的；
(1) Apprehending offenders or major criminal suspects;
(二)执行逮捕、拘留、看押、押解、审讯、拘传、强制传唤的；
(2) Executing arrests, detentions, custody, escort, interrogation, summons by force, or compulsory summons;
(三)法律、行政法规规定可以使用警械的其他情形。
(3) Other circumstances where the use of police implements is permitted by laws or administrative regulations.
人民警察依照前款规定使用警械，不得故意造成人身伤害。
When using police implements in accordance with the preceding paragraph, the People's Police shall not intentionally cause personal injury.
武器的使用
Use of Weapons
人民警察判明有下列暴力犯罪行为的紧急情形之一，经警告无效的，可以使用武器：
The People's Police may use weapons when they determine that any of the following violent criminal emergencies exist and a warning has been given without effect:
(一)放火、决水、爆炸等严重危害公共安全的；
(1) Arson, breaching dikes, explosions, or other acts seriously endangering public safety;
(二)劫持航空器、船舰、火车、机动车或者驾驶车、船等机动交通工具，故意危害公共安全的；
(2) Hijacking aircraft, ships, trains, motor vehicles, or driving vehicles, ships, or other motorized means of transport intentionally endangering public safety;
(三)抢夺、抢劫枪支弹药、爆炸、剧毒等危险物品，严重危害公共安全的；
(3) Seizing or robbing firearms, ammunition, explosives, poisons, or other dangerous articles, seriously endangering public safety;
(四)使用枪支、爆炸、剧毒等危险物品实施犯罪或者以使用枪支、爆炸、剧毒等危险物品相威胁实施犯罪的；
(4) Using firearms, explosives, poisons, or other dangerous articles to commit crimes, or threatening to use such articles to commit crimes;
(五)破坏军事、通讯、交通、能源、防险等重要设施，足以对公共安全造成严重、紧迫危险的；
(5) Destroying important facilities such as military, communications, transportation, energy, or flood prevention facilities, sufficient to cause serious and imminent danger to public safety;
(六)实施凶杀、劫持人质等暴力行为，危及公民生命安全的；
(6) Committing violent acts such as murder or hostage-taking, endangering the lives of citizens;
(七)国家规定的警卫、守卫、警戒的对象和目标受到暴力袭击、破坏或者有受到暴力袭击、破坏的紧迫危险的；
(7) The objects or targets of state-designated guard, security, or surveillance duties are under violent attack or destruction, or there is an imminent danger of such attack or destruction;
(八)结伙抢劫或者持械抢劫公私财物的；
(8) Gang robbery or armed robbery of public or private property;
(九)聚众械斗、暴乱等严重破坏社会治安秩序，用其他方法不能制止的；
(9) Mass armed fighting, riots, or other acts seriously disrupting public order, which cannot be stopped by other means;
(十)以暴力方法抗拒或者阻碍人民警察依法履行职责或者暴力袭击人民警察，危及人民警察生命安全的；
(10) Using violent means to resist or obstruct the People's Police in lawfully performing their duties, or violently attacking the People's Police, endangering the life of the police;
(十一)在押人犯、罪犯聚众骚乱、暴乱、行凶或者脱逃的；
(11) Detainees or criminals engaging in mass disturbance, riot, assault, or escape;
(十二)劫夺在押人犯、罪犯的；
(12) Forcibly rescuing detainees or criminals;
(十三)实施放火、决水、爆炸、凶杀、抢劫或者其他严重暴力犯罪行为后拒捕、逃跑的；
(13) After committing arson, breaching dikes, explosion, murder, robbery, or other serious violent crimes, resisting arrest or fleeing;
(十四)犯罪分子携带枪支、爆炸、剧毒等危险物品拒捕、逃跑的；
(14) Criminals carrying firearms, explosives, poisons, or other dangerous articles while resisting arrest or fleeing;
(十五)法律、行政法规规定可以使用武器的其他情形。
(15) Other circumstances provided by laws or administrative regulations where weapons may be used.
人民警察依照前款规定使用武器，来不及警告或者警告后可能导致更为严重危害后果的，可以直接使用武器。
If the People's Police use weapons in accordance with the preceding paragraph and there is no time to give a warning, or if giving a warning may lead to more serious harmful consequences, weapons may be used directly.
人民警察遇有下列情形之一的，不得使用武器：
The People's Police shall not use weapons in any of the following circumstances:
(一)发现实施犯罪的人为怀孕妇女、儿童的，但是使用枪支、爆炸、剧毒等危险物品实施暴力犯罪的除外；
(1) When the person committing the crime is found to be a pregnant woman or a child, except where they are using firearms, explosives, poisons, or other dangerous articles to commit violent crimes;
(二)犯罪分子处于群众聚集的场所或者存放大量易燃、易爆、剧毒、放射性等危险物品的场所的，但是不使用武器予以制止，将发生更为严重危害后果的除外。
(2) When the criminal is in a place where people are gathered or in a place storing large quantities of flammable, explosive, toxic, radioactive, or other dangerous articles, except where failure to use weapons to stop the crime would result in more serious harmful consequences.
人民警察遇有下列情形之一的，应当立即停止使用武器：
The People's Police shall immediately cease using weapons in any of the following circumstances:
(一)犯罪分子停止实施犯罪，服从人民警察命令的；
(1) The criminal stops committing the crime and obeys the orders of the People's Police;
(二)犯罪分子失去继续实施犯罪能力的。
(2) The criminal loses the ability to continue committing the crime.
人民警察使用武器造成犯罪分子或者无辜人员伤亡的，应当及时抢救受伤人员，保护现场，并立即向当地公安机关或者该人民警察所属机关报告。
If the use of weapons by the People's Police causes injury or death to a criminal or an innocent person, the police shall promptly rescue the injured, protect the scene, and immediately report to the local public security organ or the organ to which the police officer belongs.
当地公安机关或者该人民警察所属机关接到报告后，应当及时进行勘验、调查，并及时通知当地人民检察院。
Upon receiving the report, the local public security organ or the organ to which the People's Police officer belongs shall promptly conduct an inspection and investigation, and promptly notify the local People's Procuratorate.
当地公安机关或者该人民警察所属机关应当将犯罪分子或者无辜人员的伤亡情况，及时通知其家属或者其所在单位。
The local public security organ or the organ to which the People's Police officer belongs shall promptly notify the family members or the unit of the criminals or innocent persons of the casualties.
人民警察使用武器的，应当将使用武器的情况如实向所属机关书面报告。
When a People's Police officer uses a weapon, he shall truthfully report in writing the circumstances of the use of the weapon to the organ to which he belongs.
法律责任
Legal Liability
人民警察违法使用警械、武器，造成不应有的人员伤亡、财产损失，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分；对受到伤亡或者财产损失的人员，由该人民警察所属机关依照《中华人民共和国国家赔偿法》的有关规定给予赔偿。
If a People's Police officer illegally uses police implements or weapons, causing undue casualties or property damage, and if the act constitutes a crime, criminal liability shall be pursued according to law; if it does not constitute a crime, administrative sanctions shall be imposed according to law; for persons who suffer casualties or property damage, compensation shall be paid by the organ to which the People's Police officer belongs in accordance with the relevant provisions of the State Compensation Law of the People's Republic of China.
人民警察依法使用警械、武器，造成无辜人员伤亡或者财产损失的，由该人民警察所属机关参照《中华人民共和国国家赔偿法》的有关规定给予补偿。
If a People's Police officer lawfully uses police implements or weapons, causing casualties or property damage to innocent persons, compensation shall be paid by the organ to which the People's Police officer belongs by reference to the relevant provisions of the State Compensation Law of the People's Republic of China.
附则
Supplementary Provisions
中国人民武装警察部队执行国家赋予的安全保卫任务时使用警械和武器，适用本条例的有关规定。
When the Chinese People's Armed Police Force performs security tasks entrusted by the state and uses police implements and weapons, the relevant provisions of these Regulations shall apply.
本条例自发布之日起施行。1980年7月5日公布施行的《人民警察使用武器和警械的规定》同时废止。
These Regulations shall come into force as of the date of promulgation. The Provisions on the Use of Weapons and Police Implements by the People's Police promulgated and implemented on July 5, 1980, shall be abolished simultaneously.
