Regulations on the Inspection of Ships and Offshore Installations
(1993年2月14日中华人民共和国国务院令第109号发布 根据2019年3月2日《国务院关于修改部分行政法规的决定》修订)
(Issued by Decree No. 109 of the State Council of the People's Republic of China on February 14, 1993, and revised in accordance with the Decision of the State Council on Amending Certain Administrative Regulations on March 2, 2019)
总则
General Provisions
为了保证船舶、海上设施和船运货物集装箱具备安全航行、安全作业的技术条件，保障人民生命财产的安全和防止水域环境污染，制定本条例。
These Regulations are formulated to ensure that ships, offshore installations, and freight containers for ship transportation possess the technical conditions for safe navigation and safe operation, to safeguard the safety of people's lives and property, and to prevent pollution of the water environment.
本条例适用于：
These Regulations apply to:
(一)在中华人民共和国登记或者将在中华人民共和国登记的船舶(以下简称中国籍船舶)；
(1) Ships registered or to be registered in the People's Republic of China (hereinafter referred to as Chinese-flag ships);
(二)根据本条例或者国家有关规定申请检验的外国籍船舶；
(2) Foreign-flag ships applying for inspection in accordance with these Regulations or relevant state provisions;
(三)在中华人民共和国沿海水域内设置或者将在中华人民共和国沿海水域内设置的海上设施(以下简称海上设施)；
(3) Offshore installations installed or to be installed in the coastal waters of the People's Republic of China (hereinafter referred to as offshore installations);
(四)在中华人民共和国登记的企业法人所拥有的船运货物集装箱(以下简称集装箱)。
(4) Freight containers for ship transportation owned by enterprises registered in the People's Republic of China (hereinafter referred to as containers).
中华人民共和国船舶检验局(以下简称船检局)是依照本条例规定实施各项检验工作的主管机构。
The Ship Inspection Bureau of the People's Republic of China (hereinafter referred to as the Ship Inspection Bureau) is the competent authority responsible for implementing various inspection work in accordance with these Regulations.
经国务院交通主管部门批准，船检局可以在主要港口和工业区设置船舶检验机构。
With the approval of the competent transport department of the State Council, the Ship Inspection Bureau may establish ship inspection agencies at major ports and industrial areas.
经国务院交通主管部门和省、自治区、直辖市人民政府批准，省、自治区、直辖市人民政府交通主管部门可以在所辖港口设置地方船舶检验机构。
With the approval of the competent transport department of the State Council and the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, the competent transport departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may establish local ship inspection agencies at ports under their jurisdiction.
中国船级社是社会团体性质的船舶检验机构，承办国内外船舶、海上设施和集装箱的入级检验、鉴证检验和公证检验业务；经船检局授权，可以代行法定检验。
China Classification Society is a ship inspection agency of a social organization nature, undertaking classification inspection, certification inspection, and notarial inspection of domestic and foreign ships, offshore installations, and containers; with the authorization of the Ship Inspection Bureau, it may perform statutory inspection on its behalf.
实施本条例规定的各项检验，应当贯彻安全第一、质量第一的原则，鼓励新技术的开发和应用。
The implementation of various inspections under these Regulations shall adhere to the principles of safety first and quality first, and encourage the development and application of new technologies.
船舶检验
Ship Inspection
船舶检验分别由下列机构实施：
Ship inspection shall be carried out respectively by the following agencies:
(一)船检局设置的船舶检验机构；
(1) Ship inspection agencies established by the Ship Inspection Bureau;
(二)省、自治区、直辖市人民政府交通主管部门设置的地方船舶检验机构；
(2) Local ship inspection agencies established by the competent transport departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government;
(三)船检局委托、指定或者认可的检验机构。
(3) Inspection agencies entrusted, designated, or recognized by the Ship Inspection Bureau.
前款所列机构，以下统称船舶检验机构。
The agencies listed in the preceding paragraph are hereinafter collectively referred to as ship inspection agencies.
中国籍船舶的所有人或者经营人，必须向船舶检验机构申请下列检验：
The owner or operator of a Chinese-flag ship must apply to a ship inspection agency for the following inspections:
(一)建造或者改建船舶时，申请建造检验；
(1) When building or rebuilding a ship, apply for construction inspection;
(二)营运中的船舶，申请定期检验；
(2) For ships in service, apply for periodic inspection;
(三)由外国籍船舶改为中国籍船舶的，申请初次检验。
(3) When a foreign-flag ship is converted to a Chinese-flag ship, apply for initial inspection.
中国籍船舶所使用的有关海上交通安全的和防止水域环境污染的重要设备、部件和材料，须经船舶检验机构按照有关规定检验。
Important equipment, components and materials used by Chinese-flagged ships related to maritime traffic safety and prevention of environmental pollution by water shall be inspected by the ship inspection agency in accordance with relevant regulations.
中国籍船舶须由船舶检验机构测定总吨位和净吨位，核定载重线和乘客定额。
Chinese-flagged ships shall have their gross tonnage and net tonnage measured, and their load lines and passenger quotas verified by the ship inspection agency.
在中国沿海水域从事钻探、开发作业的外国籍钻井船、移动式平台的所有人或者经营人，必须向船检局设置或者指定的船舶检验机构申请下列检验：
Owners or operators of foreign-flagged drilling ships and mobile platforms engaged in drilling or development operations in the coastal waters of China must apply to the ship inspection agency established or designated by the Ship Inspection Bureau for the following inspections:
(一)作业前检验；
(1) Pre-operation inspection;
(二)作业期间的定期检验。
(2) Periodic inspection during operation.
中国沿海水域内的移动式平台、浮船坞和其他大型设施进行拖带航行，起拖前必须向船检局设置的或者指定的船舶检验机构申请拖航检验。
Before towing mobile platforms, floating docks and other large installations in the coastal waters of China, the owner or operator must apply to the ship inspection agency established or designated by the Ship Inspection Bureau for a towing inspection.
中国籍船舶有下列情形之一的，船舶所有人或者经营人必须向船舶检验机构申请临时检验：
If a Chinese-flagged ship falls under any of the following circumstances, the shipowner or operator must apply to the ship inspection agency for a temporary inspection:
(一)因发生事故，影响船舶适航性能的；
(1) An accident occurs that affects the ship's seaworthiness;
(二)改变船舶证书所限定的用途或者航区的；
(2) The use or navigation area specified in the ship's certificate is changed;
(三)船舶检验机构签发的证书失效的；
(3) The certificate issued by the ship inspection agency becomes invalid;
(四)海上交通安全或者环境保护主管机关责成检验的。
(4) The maritime traffic safety or environmental protection authority orders an inspection.
在中国港口内的外国籍船舶，有前款(一)、(四)项所列情形之一的，必须向船检局设置或者指定的船舶检验机构申请临时检验。
Foreign-flagged ships in Chinese ports that fall under items (1) or (4) of the preceding paragraph must apply to the ship inspection agency established or designated by the Ship Inspection Bureau for a temporary inspection.
下列中国籍船舶，必须向中国船级社申请入级检验：
The following Chinese-flagged ships must apply to the China Classification Society for classification inspection:
(一)从事国际航行的船舶；
(1) Ships engaged in international voyages;
(二)在海上航行的乘客定额一百人以上的客船；
(2) Passenger ships with a passenger capacity of 100 or more navigating at sea;
(三)载重量一千吨以上的油船；
(3) Oil tankers with a deadweight tonnage of 1,000 tons or more;
(四)滚装船、液化气体运输船和散装化学品运输船；
(4) Roll-on/roll-off ships, liquefied gas carriers and bulk chemical carriers;
(五)船舶所有人或者经营人要求入级的其他船舶。
(5) Other ships for which the shipowner or operator requests classification.
船舶经检验合格后，船舶检验机构应当按照规定签发相应的检验证书。
After a ship passes inspection, the ship inspection agency shall issue the corresponding inspection certificate in accordance with regulations.
海上设施检验
Inspection of Offshore Installations
海上设施的所有人或者经营人，必须向船检局设置或者指定的船舶检验机构申请下列检验，但是本条例第三十一条规定的除外：
Owners or operators of offshore installations must apply to the ship inspection agency established or designated by the Ship Inspection Bureau for the following inspections, except as provided in Article 31 of these Regulations:
(一)建造或者改建海上设施时，申请建造检验；
(1) When constructing or converting an offshore installation, apply for construction inspection;
(二)使用中的海上设施，申请定期检验；
(2) For offshore installations in service, apply for periodic inspection;
(三)因发生事故影响海上设施安全性能的，申请临时检验；
(3) If an accident occurs affecting the safety performance of the offshore installation, apply for temporary inspection;
(四)海上交通安全或者环境保护主管机关责成检验的，申请临时检验。
(4) If the maritime traffic safety or environmental protection authority orders an inspection, apply for temporary inspection.
海上设施经检验合格后，船舶检验机构应当按照规定签发相应的检验证书。
After an offshore installation has passed the survey, the ship survey agency shall issue the corresponding survey certificate in accordance with the provisions.
集装箱检验
Container Survey
集装箱的所有人或者经营人，必须向船检局设置或者指定的船舶检验机构申请下列检验：
The owner or operator of a container must apply to the ship survey agency established or designated by the Ship Survey Bureau for the following surveys:
(一)制造集装箱时，申请制造检验；
(1) When manufacturing a container, apply for a manufacturing survey;
(二)使用中的集装箱，申请定期检验。
(2) For containers in use, apply for periodic surveys.
集装箱经检验合格后，船舶检验机构应当按照规定签发相应的检验证书。
After a container has passed the survey, the ship survey agency shall issue the corresponding survey certificate in accordance with the provisions.
检验管理
Survey Management
船舶、海上设施、集装箱的检验制度和技术规范，除本条例第三十一条规定的外，由船检局制订，经国务院交通主管部门批准后公布施行。
The survey systems and technical specifications for ships, offshore installations, and containers, except as provided in Article 31 of these Regulations, shall be formulated by the Ship Survey Bureau and promulgated for implementation after approval by the competent transport authority under the State Council.
船舶检验机构的检验人员，必须具备相应的专业知识和检验技能，并经考核合格。
Survey personnel of ship survey agencies must possess the necessary professional knowledge and survey skills and pass the relevant examinations.
检验人员执行检验任务或者对事故进行技术分析调查时，有关单位应当提供必要的条件。
When survey personnel perform survey tasks or conduct technical analysis and investigation of accidents, the relevant units shall provide the necessary conditions.
船舶检验机构实施检验，按照规定收取费用。收费办法由国务院交通主管部门会同国务院物价主管部门、国务院财政主管部门制定。
Ship survey agencies shall charge fees for conducting surveys in accordance with the provisions. The fee collection measures shall be formulated by the competent transport authority under the State Council jointly with the competent pricing authority and the competent financial authority under the State Council.
当事人对船舶检验机构的检验结论有异议的，可以向上一级检验机构申请复验；对复验结论仍有异议的，可以向船检局提出再复验，由船检局组织技术专家组进行检验、评议，作出最终结论。
If a party disagrees with the survey conclusion of a ship survey agency, it may apply to the higher-level survey agency for a re-survey; if it still disagrees with the re-survey conclusion, it may apply to the Ship Survey Bureau for a further re-survey, and the Ship Survey Bureau shall organize a technical expert group to conduct the survey and evaluation and make a final conclusion.
任何单位和个人不得涂改、伪造检验证书，不得擅自更改船舶检验机构勘划的船舶载重线。
No unit or individual may alter or forge survey certificates, or arbitrarily change the ship's load line marked by the ship survey agency.
关于外国船舶检验机构在中国境内设置常驻代表机构或者派驻检验人员的管理办法，由国务院交通主管部门制定。
The administrative measures for foreign ship survey agencies to set up permanent representative offices or station survey personnel in China shall be formulated by the competent transport authority under the State Council.
罚则
Penalty Provisions
涂改检验证书、擅自更改船舶载重线或者以欺骗行为获取检验证书的，船检局或者其委托的检验机构有权撤销已签发的相应证书，并可以责令改正或者补办有关手续。
If a survey certificate is altered, the ship's load line is arbitrarily changed, or a survey certificate is obtained by fraudulent means, the Ship Survey Bureau or its authorized survey agency has the right to revoke the corresponding certificate already issued and may order corrections or require the relevant procedures to be completed.
伪造船舶检验证书或者擅自更改船舶载重线的，由有关行政主管机关给予通报批评，并可以处以相当于相应的检验费一倍至五倍的罚款；构成犯罪的，由司法机关依法追究刑事责任。
If a ship survey certificate is forged or the ship's load line is arbitrarily changed, the relevant administrative authority shall give a notice of criticism and may impose a fine of one to five times the corresponding survey fee; if the act constitutes a crime, the judicial authority shall pursue criminal liability in accordance with the law.
船舶检验机构的检验人员滥用职权、徇私舞弊、玩忽职守、严重失职的，由所在单位或者上级机关给予行政处分或者撤销其检验资格；情节严重，构成犯罪的，由司法机关依法追究刑事责任。
If survey personnel of a ship survey agency abuse their power, engage in malpractice for personal gain, neglect their duties, or are seriously derelict, the unit they belong to or the superior authority shall give administrative sanctions or revoke their survey qualification; if the circumstances are serious and constitute a crime, the judicial authority shall pursue criminal liability in accordance with the law.
附则
Supplementary Provisions
本条例下列用语的定义：
Definitions of the following terms in these Regulations:
(一)船舶，是指各类排水或者非排水船、艇、水上飞机、潜水器和移动式平台。
(1) "Ship" means various types of waterborne or non-waterborne vessels, boats, seaplanes, submersibles, and mobile platforms.
(二)海上设施，是指水上水下各种固定或者浮动建筑、装置和固定平台。
(2) "Offshore installation" means various fixed or floating structures, devices, and fixed platforms above or under water.
(三)沿海水域，是指中华人民共和国沿海的港口、内水和领海以及国家管辖的一切其他海域。
(3) "Coastal waters" means the ports, internal waters, and territorial seas of the People's Republic of China along the coast, as well as all other sea areas under national jurisdiction.
除从事国际航行的渔业辅助船舶依照本条例进行检验外，其他渔业船舶的检验，由国务院交通运输主管部门按照相关渔业船舶检验的行政法规执行。
Except for fishery auxiliary ships engaged in international voyages, which shall be surveyed in accordance with these Regulations, the survey of other fishery ships shall be carried out by the competent transport authority under the State Council in accordance with the relevant administrative regulations on fishery ship survey.
海上设施中的海上石油天然气生产设施的检验，由国务院石油主管部门会同国务院交通主管部门另行规定。
The survey of offshore oil and natural gas production facilities among offshore installations shall be separately prescribed by the competent petroleum authority under the State Council jointly with the competent transport authority under the State Council.
下列船舶不适用本条例：
The following ships are not subject to these Regulations:
(一)军用舰艇、公安船艇和体育运动船艇；
(1) Military vessels, public security vessels, and sports boats;
(二)按照船舶登记规定，不需要登记的船舶。
(2) Ships that are not required to be registered according to the provisions on ship registration.
本条例自发布之日起施行。
These Regulations shall come into force as of the date of promulgation.
