总则
General Provisions
为了加强国家对船舶的监督管理，保障船舶登记有关各方的合法权益，制定本条例。
These Regulations are formulated to strengthen the state's supervision and management of ships and to protect the legitimate rights and interests of all parties involved in ship registration.
下列船舶应当依照本条例规定进行登记：
The following ships shall be registered in accordance with these Regulations:
(一)在中华人民共和国境内有住所或者主要营业所的中国公民的船舶。
(1) Ships owned by Chinese citizens who have their domicile or principal place of business within the territory of the People's Republic of China.
(二)依据中华人民共和国法律设立的主要营业所在中华人民共和国境内的企业法人的船舶。但是，在该法人的注册资本中有外商出资的，中方投资人的出资额不得低于50%。
(2) Ships owned by enterprise legal persons established in accordance with the laws of the People's Republic of China whose principal place of business is within the territory of the People's Republic of China. However, if the registered capital of such legal person includes foreign investment, the capital contribution of the Chinese investor shall not be less than 50%.
(三)中华人民共和国政府公务船舶和事业法人的船舶。
(3) Government service ships of the People's Republic of China and ships owned by institutional legal persons.
(四)中华人民共和国港务监督机构认为应当登记的其他船舶。
(4) Other ships that the port superintendency agency of the People's Republic of China deems should be registered.
军事船舶、渔业船舶和体育运动船艇的登记依照有关法规的规定办理。
The registration of military vessels, fishing vessels, and sports boats shall be handled in accordance with relevant regulations.
船舶经依法登记，取得中华人民共和国国籍，方可悬挂中华人民共和国国旗航行；未经登记的，不得悬挂中华人民共和国国旗航行。
A ship that has been legally registered and has obtained the nationality of the People's Republic of China may fly the national flag of the People's Republic of China while navigating; a ship that has not been registered shall not fly the national flag of the People's Republic of China.
船舶不得具有双重国籍。凡在外国登记的船舶，未中止或者注销原登记国国籍的，不得取得中华人民共和国国籍。
A ship shall not have dual nationality. A ship registered in a foreign country shall not acquire the nationality of the People's Republic of China unless it has suspended or cancelled its nationality in the original country of registration.
船舶所有权的取得、转让和消灭，应当向船舶登记机关登记；未经登记的，不得对抗第三人。
The acquisition, transfer, and extinction of ship ownership shall be registered with the ship registration authority; without registration, it shall not be used to oppose a third party.
船舶由二个以上的法人或者个人共有的，应当向船舶登记机关登记；未经登记的，不得对抗第三人。
If a ship is co-owned by two or more legal persons or individuals, it shall be registered with the ship registration authority; without registration, it shall not be used to oppose a third party.
船舶抵押权、光船租赁权的设定、转移和消灭，应当向船舶登记机关登记；未经登记的，不得对抗第三人。
The creation, transfer, and extinction of ship mortgages and bareboat charter rights shall be registered with the ship registration authority; without registration, they shall not be used to oppose a third party.
中国籍船舶上应持适任证书的船员，必须持有相应的中华人民共和国船员适任证书。
Crew members on Chinese-flagged ships who are required to hold certificates of competency must hold the corresponding crew certificate of competency of the People's Republic of China.
中华人民共和国港务监督机构是船舶登记主管机关。
The port superintendency agency of the People's Republic of China is the competent authority for ship registration.
各港的港务监督机构是具体实施船舶登记的机关(以下简称船舶登记机关)，其管辖范围由中华人民共和国港务监督机构确定。
The port superintendency agencies at each port are the authorities that specifically implement ship registration (hereinafter referred to as ship registration authorities), and their jurisdiction shall be determined by the port superintendency agency of the People's Republic of China.
船舶登记港为船籍港。
The port of ship registration is the port of registry.
船舶登记港由船舶所有人依据其住所或者主要营业所所在地就近选择，但是不得选择2个或者2个以上的船舶登记港。
The port of ship registration shall be chosen by the shipowner based on the location of his domicile or principal place of business, but no more than one port of ship registration may be chosen.
一艘船舶只准使用一个名称。
A ship may use only one name.
船名由船籍港船舶登记机关核定。船名不得与登记在先的船舶重名或者同音。
The ship's name shall be approved by the ship registration authority of the port of registry. The ship's name shall not be the same as or homophonic with a ship name already registered.
船舶登记机关应当建立船舶登记簿。
The ship registration authority shall establish a ship register.
船舶登记机关应当允许利害关系人查阅船舶登记簿。
The ship registration authority shall allow interested parties to inspect the ship register.
国家所有的船舶由国家授予具有法人资格的全民所有制企业经营管理的，本条例有关船舶所有人的规定适用于该法人。
If a state-owned ship is operated and managed by a legal person owned by the whole people with legal personality granted by the state, the provisions of these Regulations concerning the shipowner shall apply to that legal person.
船舶所有权登记
Registration of Ship Ownership
船舶所有人申请船舶所有权登记，应当向船籍港船舶登记机关交验足以证明其合法身份的文件，并提供有关船舶技术资料和船舶所有权取得的证明文件的正本、副本。
When applying for registration of ship ownership, the shipowner shall submit to the ship registration authority of the port of registry documents sufficient to prove his legal identity, and provide the original and duplicate copies of relevant ship technical data and documents proving the acquisition of ship ownership.
就购买取得的船舶申请船舶所有权登记的，应当提供下列文件：
For a ship acquired by purchase, the following documents shall be provided when applying for registration of ship ownership:
(一)购船发票或者船舶的买卖合同和交接文件；
(1) The ship purchase invoice or the ship sale and purchase contract and the delivery document;
(二)原船籍港船舶登记机关出具的船舶所有权登记注销证明书；
(2) The certificate of cancellation of ship ownership registration issued by the ship registration authority of the original port of registry;
(三)未进行抵押的证明文件或者抵押权人同意被抵押船舶转让他人的文件。
(3) A document proving that the ship is not mortgaged, or a document from the mortgagee consenting to the transfer of the mortgaged ship to another person.
就新造船舶申请船舶所有权登记的，应当提供船舶建造合同和交接文件。但是，就建造中的船舶申请船舶所有权登记的，仅需提供船舶建造合同；就自造自用船舶申请船舶所有权登记的，应当提供足以证明其所有权取得的文件。
For a newly built ship applying for registration of ship ownership, the shipbuilding contract and the delivery document shall be provided. However, for a ship under construction applying for registration of ship ownership, only the shipbuilding contract need be provided; for a self-built and self-used ship applying for registration of ship ownership, documents sufficient to prove the acquisition of ownership shall be provided.
就因继承、赠与、依法拍卖以及法院判决取得的船舶申请船舶所有权登记的，应当提供具有相应法律效力的船舶所有权取得的证明文件。
For a ship acquired by inheritance, gift, judicial auction, or court judgment applying for registration of ship ownership, documents proving the acquisition of ship ownership with corresponding legal effect shall be provided.
船籍港船舶登记机关应当对船舶所有权登记申请进行审查核实；对符合本条例规定的，应当自收到申请之日起7日内向船舶所有人颁发船舶所有权登记证书，授予船舶登记号码，并在船舶登记簿中载明下列事项：
The ship registration authority of the port of registry shall examine and verify the application for registration of ship ownership; if it complies with these Regulations, it shall, within 7 days from the date of receipt of the application, issue a certificate of registration of ship ownership to the shipowner, grant a ship registration number, and record the following items in the ship register:
(一)船舶名称、船舶呼号；
(1) Ship name and ship call sign;
(二)船籍港和登记号码、登记标志；
(2) Port of registry, registration number, and registration mark;
(三)船舶所有人的名称、地址及其法定代表人的姓名；
(3) Name and address of the shipowner and the name of its legal representative;
(四)船舶所有权的取得方式和取得日期；
(4) Method and date of acquisition of ship ownership;
(五)船舶所有权登记日期；
(5) Date of registration of ship ownership;
(六)船舶建造商名称、建造日期和建造地点；
(6) Name of shipbuilder, date of construction, and place of construction;
(七)船舶价值、船体材料和船舶主要技术数据；
(7) Ship value, hull material, and main technical data of the ship;
(八)船舶的曾用名、原船籍港以及原船舶登记的注销或者中止的日期；
(8) Former name of the ship, former port of registry, and the date of cancellation or suspension of the original ship registration;
(九)船舶为数人共有的，还应当载明船舶共有人的共有情况；
(9) If the ship is co-owned by several persons, the co-ownership status of the co-owners shall also be recorded;
(十)船舶所有人不实际使用和控制船舶的，还应当载明光船承租人或者船舶经营人的名称、地址及其法定代表人的姓名；
(10) If the shipowner does not actually use and control the ship, the name and address of the bareboat charterer or ship operator and the name of its legal representative shall also be recorded;
(十一)船舶已设定抵押权的，还应当载明船舶抵押权的设定情况。
(11) If a mortgage has been created on the ship, the details of the ship mortgage shall also be recorded.
船舶登记机关对不符合本条例规定的，应当自收到申请之日起7日内书面通知船舶所有人。
If the ship registration authority finds that the application does not comply with these Regulations, it shall notify the shipowner in writing within 7 days from the date of receipt of the application.
船舶国籍
Ship Nationality
船舶所有人申请船舶国籍，除应当交验依照本条例取得的船舶所有权登记证书外，还应当按照船舶航区相应交验下列文件：
When applying for ship nationality, the shipowner shall, in addition to submitting the certificate of registration of ship ownership obtained in accordance with these Regulations, also submit the following documents according to the navigation area of the ship:
(一)航行国际航线的船舶，船舶所有人应当根据船舶的种类交验法定的船舶检验机构签发的下列有效船舶技术证书：
(1) For ships navigating on international routes, the shipowner shall, according to the type of ship, submit the following valid ship technical certificates issued by the statutory ship inspection authority:
1．国际吨位丈量证书；
1. International Tonnage Certificate;
2．国际船舶载重线证书；
2. International Load Line Certificate;
3．货船构造安全证书；
3. Cargo Ship Safety Construction Certificate;
4．货船设备安全证书；
4. Cargo Ship Safety Equipment Certificate;
5．乘客定额证书；
5. Passenger Ship Safety Certificate;
6．客船安全证书；
6. Passenger Ship Safety Certificate;
7．货船无线电报安全证书；
7. Cargo Ship Safety Radiotelegraphy Certificate;
8．国际防止油污证书；
8. International Oil Pollution Prevention Certificate;
9．船舶航行安全证书；
9. Ship Navigation Safety Certificate;
10．其他有关技术证书。
10. Other relevant technical certificates.
(二)国内航行的船舶，船舶所有人应当根据船舶的种类交验法定的船舶检验机构签发的船舶检验证书簿和其他有效船舶技术证书。
(2) For ships navigating domestically, the shipowner shall, according to the type of ship, submit the ship inspection certificate book and other valid ship technical certificates issued by the statutory ship inspection authority.
从境外购买具有外国国籍的船舶，船舶所有人在申请船舶国籍时，还应当提供原船籍港船舶登记机关出具的注销原国籍的证明书或者将于重新登记时立即注销原国籍的证明书。
For a ship purchased from abroad with foreign nationality, the shipowner shall also provide a certificate of cancellation of the original nationality issued by the ship registration authority of the original port of registry, or a certificate stating that the original nationality will be cancelled immediately upon re-registration.
对经审查符合本条例规定的船舶，船籍港船舶登记机关予以核准并发给船舶国籍证书。
For a ship that, upon examination, complies with these Regulations, the ship registration authority of the port of registry shall approve and issue a ship nationality certificate.
依照本条例第十三条规定申请登记的船舶，经核准后，船舶登记机关发给船舶国籍证书。船舶国籍证书的有效期为5年。
For a ship registered in accordance with Article 13 of these Regulations, upon approval, the ship registration authority shall issue a ship nationality certificate. The ship nationality certificate is valid for 5 years.
向境外出售新造的船舶，船舶所有人应当持船舶所有权取得的证明文件和有效船舶技术证书，到建造地船舶登记机关申请办理临时船舶国籍证书。
For a newly built ship sold abroad, the shipowner shall, holding the documents proving the acquisition of ship ownership and valid ship technical certificates, apply to the ship registration authority at the place of construction for a provisional ship nationality certificate.
从境外购买新造的船舶，船舶所有人应当持船舶所有权取得的证明文件和有效船舶技术证书，到中华人民共和国驻外大使馆、领事馆申请办理临时船舶国籍证书。
For a newly built ship purchased from abroad, the shipowner shall, holding the documents proving the acquisition of ship ownership and valid ship technical certificates, apply to the embassy or consulate of the People's Republic of China in that country for a provisional ship nationality certificate.
境内异地建造船舶，需要办理临时船舶国籍证书的，船舶所有人应当持船舶建造合同和交接文件以及有效船舶技术证书，到建造地船舶登记机关申请办理临时船舶国籍证书。
For a ship built in a different domestic location, if a provisional ship nationality certificate is required, the shipowner shall, holding the shipbuilding contract, the delivery document, and valid ship technical certificates, apply to the ship registration authority at the place of construction for a provisional ship nationality certificate.
在境外建造船舶，船舶所有人应当持船舶建造合同和交接文件以及有效船舶技术证书，到中华人民共和国驻外大使馆、领事馆申请办理临时船舶国籍证书。
For a ship built abroad, the shipowner shall, holding the shipbuilding contract, the delivery document, and valid ship technical certificates, apply to the embassy or consulate of the People's Republic of China in that country for a provisional ship nationality certificate.
以光船条件从境外租进船舶，光船承租人应当持光船租赁合同和原船籍港船舶登记机关出具的中止或者注销原国籍的证明书，或者将于重新登记时立即中止或者注销原国籍的证明书到船舶登记机关申请办理临时船舶国籍证书。
For a ship chartered in from abroad on a bareboat basis, the bareboat charterer shall, holding the bareboat charter party and a certificate of suspension or cancellation of the original nationality issued by the ship registration authority of the original port of registry, or a certificate stating that the original nationality will be suspended or cancelled immediately upon re-registration, apply to the ship registration authority for a provisional ship nationality certificate.
对经审查符合本条例规定的船舶，船舶登记机关或者中华人民共和国驻外大使馆、领事馆予以核准并发给临时船舶国籍证书。
For a ship that, upon examination, complies with these Regulations, the ship registration authority or the embassy or consulate of the People's Republic of China shall approve and issue a provisional ship nationality certificate.
临时船舶国籍证书的有效期一般不超过1年。
The validity period of a provisional ship nationality certificate generally does not exceed 1 year.
以光船租赁条件从境外租进的船舶，临时船舶国籍证书的期限可以根据租期确定，但是最长不得超过2年。光船租赁合同期限超过2年的，承租人应当在证书有效期内，到船籍港船舶登记机关申请换发临时船舶国籍证书。
For a ship chartered in from abroad on a bareboat basis, the period of the provisional ship nationality certificate may be determined according to the charter period, but shall not exceed 2 years at most. If the bareboat charter period exceeds 2 years, the charterer shall, within the validity period of the certificate, apply to the ship registration authority of the port of registry for a replacement provisional ship nationality certificate.
临时船舶国籍证书和船舶国籍证书具有同等法律效力。
A provisional ship nationality certificate has the same legal effect as a ship nationality certificate.
船舶抵押权登记
Registration of Ship Mortgages
对20总吨以上的船舶设定抵押权时，抵押权人和抵押人应当持下列文件到船籍港船舶登记机关申请办理船舶抵押权登记：
When creating a mortgage on a ship of 20 gross tons or more, the mortgagee and mortgagor shall hold the following documents and apply to the ship registration authority of the port of registry for registration of the ship mortgage:
(一)双方签字的书面申请书；
(1) A written application signed by both parties;
(二)船舶所有权登记证书或者船舶建造合同；
(2) The certificate of registration of ship ownership or the shipbuilding contract;
(三)船舶抵押合同。
(3) The ship mortgage contract.
该船舶设定有其他抵押权的，还应当提供有关证明文件。
If other mortgages have been created on the ship, relevant supporting documents shall also be provided.
船舶共有人就共有船舶设定抵押权时，还应当提供2/3以上份额或者约定份额的共有人的同意证明文件。
When co-owners of a ship create a mortgage on the co-owned ship, they shall also provide a document of consent from co-owners representing two-thirds or more of the shares or the agreed share.
对经审查符合本条例规定的，船籍港船舶登记机关应当自收到申请之日起7日内将有关抵押人、抵押权人和船舶抵押情况以及抵押登记日期载入船舶登记簿和船舶所有权登记证书，并向抵押权人核发船舶抵押权登记证书。
If, upon examination, it complies with these Regulations, the ship registration authority of the port of registry shall, within 7 days from the date of receipt of the application, record the relevant information of the mortgagor, mortgagee, ship mortgage, and the date of mortgage registration in the ship register and the certificate of registration of ship ownership, and issue a certificate of registration of ship mortgage to the mortgagee.
船舶抵押权登记，包括下列主要事项：
Registration of a ship mortgage includes the following main items:
(一)抵押权人和抵押人的姓名或者名称、地址；
(1) The name or title and address of the mortgagee and mortgagor;
(二)被抵押船舶的名称、国籍，船舶所有权登记证书的颁发机关和号码；
(2) The name and nationality of the mortgaged ship, and the issuing authority and number of the certificate of registration of ship ownership;
(三)所担保的债权数额、利息率、受偿期限。
(3) The amount of the secured claim, interest rate, and repayment period.
船舶登记机关应当允许公众查询船舶抵押权的登记状况。
The ship registration authority shall allow the public to inspect the registration status of ship mortgages.
船舶抵押权转移时，抵押权人和承转人应当持船舶抵押权转移合同到船籍港船舶登记机关申请办理抵押权转移登记。
When a ship mortgage is transferred, the mortgagee and the transferee shall hold the ship mortgage transfer contract and apply to the ship registration authority of the port of registry for registration of the mortgage transfer.
对经审查符合本条例规定的，船籍港船舶登记机关应当将承转人作为抵押权人载入船舶登记簿和船舶所有权登记证书，并向承转人核发船舶抵押权登记证书，封存原船舶抵押权登记证书。
If, upon examination, it complies with these Regulations, the ship registration authority of the port of registry shall record the transferee as the mortgagee in the ship register and the certificate of registration of ship ownership, issue a certificate of registration of ship mortgage to the transferee, and seal the original certificate of registration of ship mortgage.
办理船舶抵押权转移前，抵押权人应当通知抵押人。
Before handling the transfer of a ship mortgage, the mortgagee shall notify the mortgagor.
同一船舶设定2个以上抵押权的，船舶登记机关应当按照抵押权登记申请日期的先后顺序进行登记，并在船舶登记簿上载明登记日期。
If two or more mortgages are created on the same ship, the ship registration authority shall register them in the order of the dates of application for mortgage registration, and record the registration dates in the ship register.
登记申请日期为登记日期；同日申请的，登记日期应当相同。
The date of application for registration is the date of registration; if applications are made on the same day, the registration dates shall be the same.
光船租赁登记
Registration of Bareboat Charter
有下列情形之一的，出租人、承租人应当办理光船租赁登记：
In any of the following circumstances, the lessor and lessee shall register the bareboat charter:
(一)中国籍船舶以光船条件出租给本国企业的；
(1) A Chinese-flagged ship is chartered out on a bareboat basis to a domestic enterprise;
(二)中国企业以光船条件租进外国籍船舶的；
(2) A Chinese enterprise charters in a foreign-flagged ship on a bareboat basis;
(三)中国籍船舶以光船条件出租境外的。
(3) A Chinese-flagged ship is chartered out abroad on a bareboat basis.
船舶在境内出租时，出租人和承租人应当在船舶起租前，持船舶所有权登记证书、船舶国籍证书和光船租赁合同正本、副本，到船籍港船舶登记机关申请办理光船租赁登记。
When a ship is chartered domestically, the lessor and lessee shall, before the commencement of the charter, hold the certificate of registration of ship ownership, the ship nationality certificate, and the original and duplicate copies of the bareboat charter party, and apply to the ship registration authority of the port of registry for registration of the bareboat charter.
对经审查符合本条例规定的，船籍港船舶登记机关应当将船舶租赁情况分别载入船舶所有权登记证书和船舶登记簿，并向出租人、承租人核发光船租赁登记证明书各1份。
If, upon examination, it complies with these Regulations, the ship registration authority of the port of registry shall record the charter details in the certificate of registration of ship ownership and the ship register, and issue one copy of the certificate of registration of bareboat charter to each of the lessor and lessee.
船舶以光船条件出租境外时，出租人应当持本条例第二十六条规定的文件到船籍港船舶登记机关申请办理光船租赁登记。
When a ship is chartered out abroad on a bareboat basis, the lessor shall hold the documents specified in Article 26 of these Regulations and apply to the ship registration authority of the port of registry for registration of the bareboat charter.
对经审查符合本条例规定的，船籍港船舶登记机关应当依照本条例第四十二条规定中止或者注销其船舶国籍，并发给光船租赁登记证明书一式2份。
If, upon examination, it complies with these Regulations, the ship registration authority of the port of registry shall suspend or cancel the ship's nationality in accordance with Article 42 of these Regulations, and issue a certificate of registration of bareboat charter in duplicate.
以光船条件从境外租进船舶，承租人应当比照本条例第九条规定确定船籍港，并在船舶起租前持下列文件，到船舶登记机关申请办理光船租赁登记：
When chartering in a ship from abroad on a bareboat basis, the lessee shall determine the port of registry by reference to Article 9 of these Regulations, and before the commencement of the charter, hold the following documents and apply to the ship registration authority for registration of the bareboat charter:
(一)光船租赁合同正本、副本；
(1) The original and duplicate copies of the bareboat charter party;
(二)法定的船舶检验机构签发的有效船舶技术证书；
(2) Valid ship technical certificates issued by the statutory ship inspection authority;
(三)原船籍港船舶登记机关出具的中止或者注销船舶国籍证明书，或者将于重新登记时立即中止或者注销船舶国籍的证明书。
(3) A certificate of suspension or cancellation of ship nationality issued by the ship registration authority of the original port of registry, or a certificate stating that the ship nationality will be suspended or cancelled immediately upon re-registration.
对经审查符合本条例规定的，船舶登记机关应当发给光船租赁登记证明书，并应当依照本条例第十七条的规定发给临时船舶国籍证书，在船舶登记簿上载明原登记国。
If, upon examination, it complies with these Regulations, the ship registration authority shall issue a certificate of registration of bareboat charter, and shall issue a provisional ship nationality certificate in accordance with Article 17 of these Regulations, and record the original country of registration in the ship register.
需要延长光船租赁期限的，出租人、承租人应当在光船租赁合同期满前15日，持光船租赁登记证明书和续租合同正本、副本，到船舶登记机关申请办理续租登记。
If the bareboat charter period needs to be extended, the lessor and lessee shall, 15 days before the expiry of the bareboat charter party, hold the certificate of registration of bareboat charter and the original and duplicate copies of the renewal charter party, and apply to the ship registration authority for registration of the charter renewal.
在光船租赁期间，未经出租人书面同意，承租人不得申请光船转租登记。
During the bareboat charter period, the lessee shall not apply for registration of a sub-bareboat charter without the written consent of the lessor.
船舶标志和公司旗
Ship Marks and Company Flags
船舶应当具有下列标志：
A ship shall bear the following marks:
(一)船首两舷和船尾标明船名；
(1) The ship's name marked on both sides of the bow and on the stern;
(二)船尾船名下方标明船籍港；
(2) The port of registry marked below the ship's name on the stern;
(三)船名、船籍港下方标明汉语拼音；
(3) The Chinese phonetic alphabet marked below the ship's name and port of registry;
(四)船首和船尾两舷标明吃水标尺；
(4) Draft marks on both sides of the bow and stern;
(五)船舶中部两舷标明载重线。
(5) Load line marks on both sides amidships.
受船型或者尺寸限制不能在前款规定的位置标明标志的船舶，应当在船上显著位置标明船名和船籍港。
For ships that cannot bear marks in the positions specified in the preceding paragraph due to ship type or size limitations, the ship's name and port of registry shall be marked in a conspicuous place on the ship.
船舶所有人设置船舶烟囱标志、公司旗，可以向船籍港船舶登记机关申请登记，并按照规定提供标准设计图纸。
A shipowner may apply to the ship registration authority of the port of registry for registration of a funnel mark or company flag for the ship, and provide standard design drawings as required.
同一公司的船舶只准使用一个船舶烟囱标志、公司旗。
Ships of the same company may use only one funnel mark and one company flag.
船舶烟囱标志、公司旗由船籍港船舶登记机关审核。
The funnel mark and company flag shall be examined and approved by the ship registration authority of the port of registry.

The funnel mark and company flag shall not be identical or similar to those already registered.
船籍港船舶登记机关对经核准予以登记的船舶烟囱标志、公司旗应当予以公告。
The ship registration authority of the port of registry shall publish a notice of funnel marks and company flags that have been approved for registration.
业经登记的船舶烟囱标志、公司旗属登记申请人专用，其他船舶或者公司不得使用。
Registered funnel marks and company flags are exclusively used by the applicant for registration, and other ships or companies shall not use them.
变更登记和注销登记
Registration of Changes and Cancellation Registration
船舶登记项目发生变更时，船舶所有人应当持船舶登记的有关证明文件和变更证明文件，到船籍港船舶登记机关办理变更登记。
When a registered item of a ship changes, the shipowner shall hold the relevant supporting documents for ship registration and the documents evidencing the change, and apply to the ship registration authority of the port of registry for registration of the change.
船舶变更船籍港时，船舶所有人应当持船舶国籍证书和变更证明文件，到原船籍港船舶登记机关申请办理船籍港变更登记。对经审查符合本条例规定的，原船籍港船舶登记机关应当在船舶国籍证书签证栏内注明，并将船舶有关登记档案转交新船籍港船舶登记机关，船舶所有人再到新船籍港船舶登记机关办理登记。
When a ship changes its port of registry, the shipowner shall hold the ship nationality certificate and the documents evidencing the change, and apply to the ship registration authority of the original port of registry for registration of the change of port of registry. If, upon examination, it complies with these Regulations, the ship registration authority of the original port of registry shall note it in the endorsement column of the ship nationality certificate, and transfer the relevant ship registration files to the ship registration authority of the new port of registry, and the shipowner shall then go to the ship registration authority of the new port of registry to complete the registration.
船舶共有情况发生变更时，船舶所有人应当持船舶所有权登记证书和有关船舶共有情况变更的证明文件，到船籍港船舶登记机关办理有关变更登记。
When the co-ownership status of a ship changes, the shipowner shall hold the certificate of registration of ship ownership and the documents evidencing the change in co-ownership status, and apply to the ship registration authority of the port of registry for registration of the change.
船舶抵押合同变更时，抵押权人和抵押人应当持船舶所有权登记证书、船舶抵押权登记证书和船舶抵押合同变更的证明文件，到船籍港船舶登记机关办理变更登记。
When a ship mortgage contract changes, the mortgagee and mortgagor shall hold the certificate of registration of ship ownership, the certificate of registration of ship mortgage, and the documents evidencing the change in the ship mortgage contract, and apply to the ship registration authority of the port of registry for registration of the change.
对经审查符合本条例规定的，船籍港船舶登记机关应当在船舶所有权登记证书和船舶抵押权登记证书以及船舶登记簿上注明船舶抵押合同的变更事项。
If, upon examination, it complies with these Regulations, the ship registration authority of the port of registry shall note the changes to the ship mortgage contract in the certificate of registration of ship ownership, the certificate of registration of ship mortgage, and the ship register.
船舶所有权发生转移时，原船舶所有人应当持船舶所有权登记证书、船舶国籍证书和其他有关证明文件到船籍港船舶登记机关办理注销登记。
When ship ownership is transferred, the original shipowner shall hold the certificate of registration of ship ownership, the ship nationality certificate, and other relevant supporting documents, and apply to the ship registration authority of the port of registry for cancellation registration.
对经审查符合本条例规定的，船籍港船舶登记机关应当注销该船舶在船舶登记簿上的所有权登记以及与之相关的登记，收回有关登记证书，并向船舶所有人出具相应的船舶登记注销证明书。向境外出售的船舶，船舶登记机关可以根据具体情况出具注销国籍的证明书或者将于重新登记时立即注销国籍的证明书。
If, upon examination, it complies with these Regulations, the ship registration authority of the port of registry shall cancel the ownership registration and related registrations of the ship in the ship register, retrieve the relevant registration certificates, and issue a corresponding certificate of cancellation of ship registration to the shipowner. For a ship sold abroad, the ship registration authority may, depending on the specific circumstances, issue a certificate of cancellation of nationality or a certificate stating that the nationality will be cancelled immediately upon re-registration.
船舶灭失(含船舶拆解、船舶沉没)和船舶失踪，船舶所有人应当自船舶灭失(含船舶拆解、船舶沉没)或者船舶失踪之日起3个月内持船舶所有权登记证书、船舶国籍证书和有关船舶灭失(含船舶拆解、船舶沉没)、船舶失踪的证明文件，到船籍港船舶登记机关办理注销登记。经审查核实，船籍港船舶登记机关应当注销该船舶在船舶登记簿上的登记，收回有关登记证书，并向船舶所有人出具船舶登记注销证明书。
If a ship is lost (including ship scrapping, ship sinking) or missing, the shipowner shall, within 3 months from the date of the loss (including ship scrapping, ship sinking) or missing, hold the certificate of registration of ship ownership, the ship nationality certificate, and the documents evidencing the loss (including ship scrapping, ship sinking) or missing of the ship, and apply to the ship registration authority of the port of registry for cancellation registration. Upon examination and verification, the ship registration authority of the port of registry shall cancel the registration of the ship in the ship register, retrieve the relevant registration certificates, and issue a certificate of cancellation of ship registration to the shipowner.
船舶抵押合同解除，抵押权人和抵押人应当持船舶所有权登记证书、船舶抵押权登记证书和经抵押权人签字的解除抵押合同的文件，到船籍港船舶登记机关办理注销登记。对经审查符合本条例规定的，船籍港船舶登记机关应当注销其在船舶所有权登记证书和船舶登记簿上的抵押登记的记录。
When a ship mortgage contract is terminated, the mortgagee and mortgagor shall hold the certificate of registration of ship ownership, the certificate of registration of ship mortgage, and the document of termination of the mortgage contract signed by the mortgagee, and apply to the ship registration authority of the port of registry for cancellation registration. If, upon examination, it complies with these Regulations, the ship registration authority of the port of registry shall cancel the record of the mortgage registration in the certificate of registration of ship ownership and the ship register.
以光船条件出租到境外的船舶，出租人除依照本条例第二十七条规定办理光船租赁登记外，还应当办理船舶国籍的中止或者注销登记。船籍港船舶登记机关应当封存原船舶国籍证书，发给中止或者注销船舶国籍证明书。特殊情况下，船籍港船舶登记机关可以发给将于重新登记时立即中止或者注销船舶国籍的证明书。
For a ship chartered out abroad on a bareboat basis, the lessor shall, in addition to handling the registration of the bareboat charter in accordance with Article 27 of these Regulations, also handle the suspension or cancellation of the ship's nationality. The ship registration authority of the port of registry shall seal the original ship nationality certificate and issue a certificate of suspension or cancellation of ship nationality. In special circumstances, the ship registration authority of the port of registry may issue a certificate stating that the nationality will be suspended or cancelled immediately upon re-registration.
光船租赁合同期满或者光船租赁关系终止，出租人应当自光船租赁合同期满或者光船租赁关系终止之日起15日内，持船舶所有权登记证书、光船租赁合同或者终止光船租赁关系的证明文件，到船籍港船舶登记机关办理光船租赁注销登记。
When a bareboat charter party expires or the bareboat charter relationship terminates, the lessor shall, within 15 days from the date of expiry of the bareboat charter party or termination of the bareboat charter relationship, hold the certificate of registration of ship ownership, the bareboat charter party or the document evidencing the termination of the bareboat charter relationship, and apply to the ship registration authority of the port of registry for cancellation of the bareboat charter registration.
以光船条件出租到境外的船舶，出租人还应当提供承租人所在地船舶登记机关出具的注销船舶国籍证明书或者将于重新登记时立即注销船舶国籍的证明书。
For a ship chartered out abroad on a bareboat basis, the lessor shall also provide a certificate of cancellation of ship nationality issued by the ship registration authority of the lessee's location, or a certificate stating that the nationality will be cancelled immediately upon re-registration.
经核准后，船籍港船舶登记机关应当注销其在船舶所有权登记证书和船舶登记簿上的光船租赁登记的记录，并发还原船舶国籍证书。
Upon approval, the ship registration authority of the port of registry shall cancel the record of the bareboat charter registration in the certificate of registration of ship ownership and the ship register, and return the original ship nationality certificate.
以光船条件租进的船舶，承租人应当自光船租赁合同期满或者光船租赁关系终止之日起15日内，持光船租赁合同、终止光船租赁关系的证明文件，到船籍港船舶登记机关办理注销登记。
For a ship chartered in on a bareboat basis, the lessee shall, within 15 days from the date of expiry of the bareboat charter party or termination of the bareboat charter relationship, hold the bareboat charter party and the document evidencing the termination of the bareboat charter relationship, and apply to the ship registration authority of the port of registry for cancellation registration.
以光船条件从境外租进的船舶，还应当提供临时船舶国籍证书。
For a ship chartered in from abroad on a bareboat basis, the provisional ship nationality certificate shall also be provided.
经核准后，船籍港船舶登记机关应当注销其在船舶登记簿上的光船租赁登记，收回临时船舶国籍证书，并出具光船租赁登记注销证明书和临时船舶国籍注销证明书。
Upon approval, the ship registration authority of the port of registry shall cancel the bareboat charter registration in the ship register, retrieve the provisional ship nationality certificate, and issue a certificate of cancellation of bareboat charter registration and a certificate of cancellation of provisional ship nationality.
船舶所有权登记证书、船舶国籍证书的换发和补发
Replacement and Reissuance of Certificate of Registration of Ship Ownership and Ship Nationality Certificate
船舶国籍证书有效期届满前1年内，船舶所有人应当持船舶国籍证书和有效船舶技术证书，到船籍港船舶登记机关办理证书换发手续。
Within 1 year before the expiry of the validity period of the ship nationality certificate, the shipowner shall hold the ship nationality certificate and valid ship technical certificates, and apply to the ship registration authority of the port of registry for replacement of the certificate.
船舶所有权登记证书、船舶国籍证书污损不能使用的，持证人应当向船籍港船舶登记机关申请换发。
If the certificate of registration of ship ownership or the ship nationality certificate becomes defaced and unusable, the holder shall apply to the ship registration authority of the port of registry for replacement.
船舶所有权登记证书、船舶国籍证书遗失的，持证人应当书面叙明理由，附具有关证明文件，向船籍港船舶登记机关申请补发。
If the certificate of registration of ship ownership or the ship nationality certificate is lost, the holder shall state the reasons in writing, attach relevant supporting documents, and apply to the ship registration authority of the port of registry for reissuance.
船籍港船舶登记机关应当在当地报纸上公告声明原证书作废。
The ship registration authority of the port of registry shall publish a notice in a local newspaper declaring the original certificate void.
船舶所有人在境外发现船舶国籍证书遗失或者污损时，应当向中华人民共和国驻外大使馆、领事馆申请办理临时船舶国籍证书，但是必须在抵达本国第一个港口后及时向船籍港船舶登记机关申请换发船舶国籍证书。
If a shipowner discovers abroad that the ship nationality certificate is lost or defaced, he shall apply to the embassy or consulate of the People's Republic of China in that country for a provisional ship nationality certificate, but must, after arriving at the first domestic port, promptly apply to the ship registration authority of the port of registry for a replacement ship nationality certificate.

Legal Liability
假冒中华人民共和国国籍，悬挂中华人民共和国国旗航行的，由船舶登记机关依法没收该船舶。
If a ship falsely assumes the nationality of the People's Republic of China and flies the national flag of the People's Republic of China, the ship registration authority shall confiscate the ship in accordance with the law.
中国籍船舶假冒外国国籍，悬挂外国国旗航行的，适用前款规定。
If a Chinese-flagged ship falsely assumes a foreign nationality and flies a foreign flag, the preceding paragraph shall apply.
隐瞒在境内或者境外的登记事实，造成双重国籍的，由船籍港船舶登记机关吊销其船舶国籍证书，并视情节处以下列罚款：
If a ship conceals the fact of registration in China or abroad, resulting in dual nationality, the ship registration authority of the port of registry shall revoke its ship nationality certificate and, depending on the circumstances, impose the following fines:
(一)500总吨以下的船舶，处2000元以上、1万元以下的罚款；
(1) For ships of less than 500 gross tons, a fine of not less than RMB 2,000 but not more than RMB 10,000;
(二)501总吨以上、10000总吨以下的船舶，处以1万元以上、5万元以下的罚款；
(2) For ships of 501 to 10,000 gross tons, a fine of not less than RMB 10,000 but not more than RMB 50,000;
(三)10001总吨以上的船舶，处以5万元以上、20万元以下的罚款。
(3) For ships of 10,001 gross tons or more, a fine of not less than RMB 50,000 but not more than RMB 200,000.
违反本条例规定，有下列情形之一的，船籍港船舶登记机关可以视情节给予警告、根据船舶吨位处以本条例第五十条规定的罚款数额的50%直至没收船舶登记证书：
If, in violation of these Regulations, any of the following circumstances occurs, the ship registration authority of the port of registry may, depending on the circumstances, give a warning, impose a fine of 50% of the amount specified in Article 50 of these Regulations based on the ship's tonnage, or even confiscate the ship registration certificate:
(一)在办理登记手续时隐瞒真实情况、弄虚作假的；
(1) Concealing the true situation or practicing fraud when going through registration procedures;
(二)隐瞒登记事实，造成重复登记的；
(2) Concealing the fact of registration, resulting in duplicate registration;
(三)伪造、涂改船舶登记证书的。
(3) Forging or altering a ship registration certificate.
不按照规定办理变更或者注销登记的，或者使用过期的船舶国籍证书或者临时船舶国籍证书的，由船籍港船舶登记机关责令其补办有关登记手续；情节严重的，可以根据船舶吨位处以本条例第五十条规定的罚款数额的10%。
If a person fails to go through the procedures for registration of a change or cancellation as required, or uses an expired ship nationality certificate or provisional ship nationality certificate, the ship registration authority of the port of registry shall order him to complete the relevant registration procedures; if the circumstances are serious, a fine of 10% of the amount specified in Article 50 of these Regulations may be imposed based on the ship's tonnage.
违反本条例规定，使用他人业经登记的船舶烟囱标志、公司旗的，由船籍港船舶登记机关责令其改正；拒不改正的，可以根据船舶吨位处以本条例第五十条规定的罚款数额的10%；情节严重的，并可以吊销其船舶国籍证书或者临时船舶国籍证书。
If, in violation of these Regulations, a person uses another person's registered funnel mark or company flag, the ship registration authority of the port of registry shall order him to correct the situation; if he refuses to correct, a fine of 10% of the amount specified in Article 50 of these Regulations may be imposed based on the ship's tonnage; if the circumstances are serious, his ship nationality certificate or provisional ship nationality certificate may also be revoked.
船舶登记机关的工作人员滥用职权、徇私舞弊、玩忽职守、严重失职的，由所在单位或者上级机关给予行政处分；构成犯罪的，依法追究刑事责任。
If a staff member of a ship registration authority abuses his power, engages in malpractice for personal gain, neglects his duty, or is seriously derelict, the unit to which he belongs or the superior authority shall impose administrative sanctions; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
当事人对船舶登记机关的具体行政行为不服的，可以依照国家有关法律、行政法规的规定申请复议或者提起行政诉讼。
If a party is dissatisfied with a specific administrative act of a ship registration authority, he may apply for reconsideration or initiate an administrative lawsuit in accordance with relevant state laws and administrative regulations.
附则
Supplementary Provisions
本条例下列用语的含义是：
The meanings of the following terms in these Regulations are:
(一)“船舶”系指各类机动、非机动船舶以及其他水上移动装置，但是船舶上装备的救生艇筏和长度小于5米的艇筏除外。
(1) "Ship" refers to various types of motorized and non-motorized ships and other mobile offshore installations, but excludes lifeboats and rafts equipped on ships and boats less than 5 meters in length.
(二)“渔业船舶”系指从事渔业生产的船舶以及属于水产系统为渔业生产服务的船舶。
(2) "Fishing vessel" refers to ships engaged in fishing production and ships belonging to the fishery system that serve fishing production.
(三)“公务船舶”系指用于政府行政管理目的的船舶。
(3) "Government service ship" refers to ships used for government administrative management purposes.
除公务船舶外，船舶登记机关按照规定收取船舶登记费。船舶登记费的收费标准和管理办法，由国务院财政部门、物价行政主管部门会同国务院交通行政主管部门制定。
Except for government service ships, the ship registration authority shall collect ship registration fees in accordance with regulations. The fee standards and management measures for ship registration fees shall be formulated by the financial department and the price administration department of the State Council together with the transportation administration department of the State Council.
船舶登记簿、船舶国籍证书、临时船舶国籍证书、船舶所有权登记证书、船舶抵押权登记证书、光船租赁登记证明书、申请书以及其他证明书的格式，由中华人民共和国港务监督机构统一制定。
The formats of the ship register, ship nationality certificate, provisional ship nationality certificate, certificate of registration of ship ownership, certificate of registration of ship mortgage, certificate of registration of bareboat charter, application forms, and other certificates shall be uniformly formulated by the port superintendency agency of the People's Republic of China.
本条例自1995年1月1日起施行。
These Regulations shall come into effect as of January 1, 1995.
