Regulations of the People's Republic of China on the Administration of Gold and Silver

(1983年6月15日国务院发布　根据2011年1月8日《国务院关于废止和修改部分行政法规的决定》修订)

(Promulgated by the State Council on June 15, 1983, and revised in accordance with the Decision of the State Council on Repealing and Amending Certain Administrative Regulations on January 8, 2011)

为加强对金银的管理，保证国家经济建设对金银的需要，特制定本条例。

These Regulations are formulated to strengthen the administration of gold and silver and to ensure the needs of national economic construction for gold and silver.

本条例所称金银，包括：

Gold and silver as referred to in these Regulations include:

(一)矿藏生产金银和冶炼副产金银；

(1) Gold and silver produced from mineral deposits and as by-products of smelting;

(二)金银条、块、锭、粉；

(2) Gold and silver bars, ingots, pieces, and powder;

(三)金银铸币；

(3) Gold and silver coins;

(四)金银制品和金基、银基合金制品；

(4) Gold and silver products and products made of gold-based or silver-based alloys;

(五)化工产品中含的金银；

(5) Gold and silver contained in chemical products;

(六)金银边角余料及废渣、废液、废料中含的金银。

(6) Gold and silver in leftover bits and pieces, and in waste residue, waste liquid, and waste materials.

铂(即白金)，按照国家有关规定管理。

Platinum (i.e., white gold) shall be administered in accordance with the relevant provisions of the state.

属于金银质地的文物，按照《中华人民共和国文物保护法》的规定管理。

Cultural relics made of gold or silver shall be administered in accordance with the provisions of the Law of the People's Republic of China on the Protection of Cultural Relics.

国家对金银实行统一管理、统购统配的政策。

The state implements a policy of unified administration, unified purchase, and unified allocation of gold and silver.

中华人民共和国境内的机关、部队、团体、学校、国营企业、事业单位，城乡集体经济组织(以下统称境内机构)的一切金银的收入和支出，都纳入国家金银收支计划。

All income and expenditure of gold and silver by state organs, military units, organizations, schools, state-owned enterprises, institutions, and urban and rural collective economic organizations (hereinafter collectively referred to as domestic institutions) within the territory of the People's Republic of China shall be incorporated into the state gold and silver revenue and expenditure plan.

国家管理金银的主管机关为中国人民银行。

The competent authority for the administration of gold and silver is the People's Bank of China.

中国人民银行负责管理国家金银储备；负责金银的收购与配售；会同国家物价主管机关制定和管理金银收购与配售价格；会同国家有关主管机关审批经营(包括加工、销售)金银制品、含金银化工产品以及从含金银的废渣、废液、废料中回收金银的单位(以下统称经营单位)，管理和检查金银市场；监督本条例的实施。

The People's Bank of China is responsible for managing the state gold and silver reserves; responsible for the purchase and allocation of gold and silver; jointly with the state pricing authority, formulating and managing the purchase and allocation prices of gold and silver; jointly with the relevant state authorities, approving units that engage in the operation (including processing and sale) of gold and silver products, chemical products containing gold and silver, and the recovery of gold and silver from waste residue, waste liquid, and waste materials containing gold and silver (hereinafter collectively referred to as operating units); managing and inspecting the gold and silver market; and supervising the implementation of these Regulations.

境内机构所持的金银，除经中国人民银行许可留用的原材料、设备、器皿、纪念品外，必须全部交售给中国人民银行，不得自行处理、占有。

All gold and silver held by domestic institutions must be sold to the People's Bank of China, except for raw materials, equipment, utensils, and souvenirs that are permitted by the People's Bank of China to be retained. No domestic institution may dispose of or retain gold and silver on its own.

国家保护个人持有合法所得的金银。

The state protects the possession of lawfully obtained gold and silver by individuals.

在中华人民共和国境内，一切单位和个人不得计价使用金银，禁止私相买卖和借贷抵押金银。

Within the territory of the People's Republic of China, no unit or individual may use gold and silver as a means of pricing or circulation, and private buying and selling, lending, and mortgaging of gold and silver are prohibited.

金银的收购，统一由中国人民银行办理。除经中国人民银行许可、委托的以外，任何单位和个人不得收购金银。

The purchase of gold and silver shall be handled uniformly by the People's Bank of China. No unit or individual may purchase gold and silver without the permission or entrustment of the People's Bank of China.

从事金银生产(包括矿藏生产和冶炼副产)的厂矿企业、农村社队、部队和个人所采炼的金银，必须全部交售给中国人民银行，不得自行销售、交换和留用。

All gold and silver mined and smelted by factories, mines, rural communes and production brigades, military units, and individuals engaged in gold and silver production (including production from mineral deposits and as by-products of smelting) must be sold to the People's Bank of China. No unit or individual may sell, exchange, or retain such gold and silver on its own.

前款所列生产单位，对生产过程中的金银成品和半成品，必须按照有关规定加强管理，不得私自销售和处理。

The production units mentioned in the preceding paragraph must strengthen the management of gold and silver finished and semi-finished products during the production process in accordance with relevant provisions, and may not sell or dispose of them privately.

国家鼓励经营单位和使用金银的单位，从伴生金银的矿种和含金银的废渣、废液、废料中回收金银。

The state encourages operating units and units that use gold and silver to recover gold and silver from mineral deposits containing associated gold and silver and from waste residue, waste liquid, and waste materials containing gold and silver.

前款所列单位必须将回收的金银交售给中国人民银行，不得自行销售、交换和留用。但是，经中国人民银行许可，使用金银的单位将回收的金银重新利用的除外。

The units mentioned in the preceding paragraph must sell the recovered gold and silver to the People's Bank of China, and may not sell, exchange, or retain it on their own. However, units that use gold and silver may reuse the recovered gold and silver if permitted by the People's Bank of China.

境内机构从国外进口的金银和矿产品中采炼的副产金银，除经中国人民银行允许留用的或者按照规定用于进料加工复出口的金银以外，一律交售给中国人民银行，不得自行销售、交换和留用。

Gold and silver imported from abroad by domestic institutions and by-product gold and silver from mining and smelting of mineral products, except for those permitted by the People's Bank of China to be retained or used for processing imported materials for re-export according to regulations, must all be sold to the People's Bank of China. They may not be sold, exchanged, or retained on their own.

个人出售金银，必须卖给中国人民银行。

Individuals selling gold and silver must sell them to the People's Bank of China.

一切出土无主金银，均为国家所有，任何单位和个人不得熔化、销毁或占有。

All unearthed gold and silver without an owner shall be owned by the state. No unit or individual may melt, destroy, or possess them.

单位和个人发现的出土无主金银，经当地文化行政管理部门鉴定，除有历史文物价值的按照《中华人民共和国文物保护法》的规定办理外，必须交给中国人民银行收兑，价款上缴国库。

Unearthed gold and silver without an owner discovered by units or individuals, after appraisal by the local cultural administrative department, except for those with historical and cultural value to be handled in accordance with the provisions of the Law of the People's Republic of China on the Protection of Cultural Relics, must be turned over to the People's Bank of China for purchase, and the proceeds shall be turned over to the state treasury.

公安、司法、海关、工商行政管理、税务等国家机关依法没收的金银，一律交售给中国人民银行，不得自行处理或者以其他实物顶替。没收的金银价款按照有关规定上缴国库。

Gold and silver confiscated by state organs such as public security, judicial, customs, industrial and commercial administration, and taxation according to law must all be sold to the People's Bank of China. They may not be disposed of on their own or replaced with other physical objects. The proceeds from confiscated gold and silver shall be turned over to the state treasury in accordance with relevant regulations.

凡需用金银的单位，必须按照规定程序向中国人民银行提出申请使用金银的计划，由中国人民银行审批、供应。

Any unit that needs to use gold and silver must, in accordance with the prescribed procedures, submit an application to the People's Bank of China for a plan to use gold and silver, which shall be approved and supplied by the People's Bank of China.

中国人民银行应当按照批准的计划供应，不得随意减售或拖延。

The People's Bank of China shall supply according to the approved plan and may not arbitrarily reduce sales or delay.

中华人民共和国境内的外资企业、中外合资企业以及外商，订购金银制品或者加工其他含金银产品，要求在国内供应金银者，必须按照规定程序提出申请，由中国人民银行审批予以供应。

Foreign-invested enterprises, Sino-foreign joint ventures, and foreign businessmen within the territory of the People's Republic of China who order gold and silver products or process other products containing gold and silver and require domestic supply of gold and silver must submit an application in accordance with the prescribed procedures, which shall be approved and supplied by the People's Bank of China.

使用金银的单位，必须建立使用制度，严格做到专项使用、结余交回。未经中国人民银行许可，不得把金银原料(包括半成品)转让或者移作他用。

Units using gold and silver must establish a usage system, strictly ensure dedicated use, and return any surplus. Without the permission of the People's Bank of China, gold and silver materials (including semi-finished products) may not be transferred or used for other purposes.

在本条例规定范围内，中国人民银行有权对使用金银的单位进行监督和检查。使用金银的单位应当向中国人民银行据实提供有关使用金银的情况和资料。

Within the scope of these regulations, the People's Bank of China has the right to supervise and inspect units using gold and silver. Units using gold and silver shall truthfully provide the People's Bank of China with relevant information and materials concerning their use of gold and silver.

申请经营(包括加工、销售)金银制品、含金银化工产品以及从含金银的废渣、废液、废料中回收金银的单位，必须按照国家有关规定和审批程序，经中国人民银行和有关主管机关审查批准，在工商行政管理机关登记发给营业执照后，始得营业。

Units applying to engage in the business (including processing and sales) of gold and silver products, chemical products containing gold and silver, and the recovery of gold and silver from waste residues, waste liquids, and waste materials containing gold and silver must, in accordance with relevant state regulations and approval procedures, be examined and approved by the People's Bank of China and relevant competent authorities, and registered with the administrative authority for industry and commerce to obtain a business license before commencing operations.

经营单位必须按照批准的金银业务范围从事经营，不得擅自改变经营范围，不得在经营中克扣、挪用和套购金银。

Business units must operate within the approved scope of gold and silver business and may not change the business scope without authorization, nor may they shortchange, misappropriate, or illegally purchase gold and silver in the course of business.

金银质地纪念币的铸造、发行由中国人民银行办理，其他任何单位不得铸造、仿造和发行。

The minting and issuance of gold and silver commemorative coins shall be handled by the People's Bank of China. No other unit may mint, imitate, or issue them.

金银质地纪念章(牌)的出口经营，由中国人民银行和中华人民共和国对外经济贸易部分别办理。

The export business of gold and silver commemorative medals (plaques) shall be handled separately by the People's Bank of China and the Ministry of Foreign Economic Relations and Trade of the People's Republic of China.

委托、寄售商店，不得收购或者寄售金银制品、金银器材。珠宝商店可以收购供出口销售的带有金银镶嵌的珠宝饰品，但是不得收购、销售金银制品和金银器材。金银制品由中国人民银行收购并负责供应外贸出口。

Consignment and second-hand stores may not purchase or consign gold and silver products or gold and silver materials. Jewelry stores may purchase jewelry with gold and silver inlay for export sale, but may not purchase or sell gold and silver products or gold and silver materials. Gold and silver products shall be purchased by the People's Bank of China and supplied for foreign trade export.

边疆少数民族地区和沿海侨眷比较集中地区的个体银匠，经县或者县级以上中国人民银行以及工商行政管理机关批准，可以从事代客加工和修理金银制品的业务，但不得收购和销售金银制品。

Individual silversmiths in border minority areas and areas with a high concentration of overseas Chinese relatives, upon approval by the People's Bank of China at or above the county level and the administrative authority for industry and commerce, may engage in the business of processing and repairing gold and silver products on behalf of customers, but may not purchase or sell gold and silver products.

国家允许个人邮寄金银饰品，具体管理办法由中国人民银行会同中华人民共和国邮电部制定。

The state permits individuals to mail gold and silver ornaments. Specific management measures shall be formulated by the People's Bank of China jointly with the Ministry of Posts and Telecommunications of the People's Republic of China.

携带金银进入中华人民共和国国境，数量不受限制，但是必须向入境地中华人民共和国海关申报登记。

Carrying gold and silver into the territory of the People's Republic of China is not subject to quantity restrictions, but must be declared and registered with the Customs of the People's Republic of China at the place of entry.

携带或者复带金银出境，中华人民共和国海关凭中国人民银行出具的证明或者原入境时的申报单登记的数量查验放行；不能提供证明的或者超过原入境时申报登记数量的，不许出境。

For carrying or re-carrying gold and silver out of the country, the Customs of the People's Republic of China shall inspect and release based on the certificate issued by the People's Bank of China or the quantity registered on the original entry declaration form. If no certificate can be provided or the quantity exceeds that registered upon entry, exit shall not be permitted.

携带在中华人民共和国境内供应旅游者购买的金银饰品(包括镶嵌饰品、工艺品、器皿等)出境，中华人民共和国海关凭国内经营金银制品的单位开具的特种发货票查验放行。无凭据的，不许出境。

For carrying out of the country gold and silver ornaments (including inlaid ornaments, handicrafts, vessels, etc.) purchased by tourists within the territory of the People's Republic of China, the Customs of the People's Republic of China shall inspect and release based on the special invoice issued by domestic units operating gold and silver products. Without such documentation, exit shall not be permitted.

在中华人民共和国境内的中国人、外国侨民和无国籍人出境定居，每人携带金银的限额为：黄金饰品1市两(31.25克)，白银饰品10市两(312.50克)，银质器皿20市两(625克)。经中华人民共和国海关查验符合规定限额的放行。

For Chinese citizens, foreign nationals, and stateless persons within the territory of the People's Republic of China who leave the country for permanent residence, the limits for carrying gold and silver per person are: gold ornaments 1 liang (31.25 grams), silver ornaments 10 liang (312.50 grams), and silver vessels 20 liang (625 grams). The Customs of the People's Republic of China shall release those that comply with the prescribed limits after inspection.

中华人民共和国境内的外资企业、中外合资企业，从国外进口金银作产品原料的，其数量不限；出口含金银量较高的产品，须经中国人民银行核准后放行。未经核准或者超过核准出口数量的，不许出境。

For foreign-invested enterprises and Sino-foreign joint ventures within the territory of the People's Republic of China that import gold and silver from abroad as raw materials for products, the quantity is not limited. For products with a relatively high gold and silver content to be exported, approval from the People's Bank of China is required before release. Without approval or exceeding the approved export quantity, exit shall not be permitted.

有下列事迹的单位或者个人，国家给予表彰或者适当的物质奖励：

The state shall give commendation or appropriate material rewards to units or individuals with the following deeds:

(一)认真执行国家金银政策法令，在金银回收或者管理工作中做出显著成绩的；

(1) Those who conscientiously implement the state's gold and silver policies and decrees and have made remarkable achievements in gold and silver recovery or management work;

(二)为保护国家金银与有关违法犯罪行为坚决斗争，事迹突出的；

(2) Those who resolutely fight against illegal acts related to gold and silver to protect state gold and silver, with outstanding deeds;

(三)发现出土无主金银及时上报或者上交，对国家有贡献的；

(3) Those who promptly report or hand over unearthed gold and silver without an owner, making contributions to the state;

(四)将个人收藏的金银捐献给国家的。

(4) Those who donate gold and silver in their personal collection to the state.

违反本条例的下列行为，根据情节轻重，分别由中国人民银行、工商行政管理机关和海关按照各自的职责权限给予以下处罚：

For the following acts violating these Regulations, the People's Bank of China, the administrative authorities for industry and commerce, and the customs shall, according to their respective functions and powers, impose the following penalties depending on the seriousness of the case:

(一)违反本条例第八、九、十、十一条规定，擅自收购、销售、交换和留用金银的，由中国人民银行或者工商行政管理机关予以强制收购或者贬值收购。情节严重的，工商行政管理机关可并处以罚款，或者单处以没收。

(1) For those who, in violation of Articles 8, 9, 10, and 11 of these Regulations, purchase, sell, exchange, or retain gold and silver without authorization, the People's Bank of China or the administrative authority for industry and commerce shall enforce compulsory purchase or devalued purchase. If the case is serious, the administrative authority for industry and commerce may also impose a fine or solely order confiscation.

违反本条例第八、九、十、十一条规定的，工商行政管理机关可另处以吊销营业执照。

For those violating Articles 8, 9, 10, and 11 of these Regulations, the administrative authority for industry and commerce may additionally revoke the business license.

(二)违反本条例第十三条规定，私自熔化、销毁、占有出土无主金银的，由中国人民银行追回实物或者由工商行政管理机关处以罚款。

(2) For those who, in violation of Article 13 of these Regulations, privately melt, destroy, or possess unearthed gold and silver without an owner, the People's Bank of China shall recover the physical objects or the administrative authority for industry and commerce shall impose a fine.

(三)违反本条例第十七条规定擅自改变使用用途或者转让金银原材料的，由中国人民银行予以警告，或者追回已配售的金银。情节严重的，处以罚款直至停止供应。

(3) For those who, in violation of Article 17 of these Regulations, change the intended use or transfer gold and silver raw materials without authorization, the People's Bank of China shall issue a warning or recover the gold and silver already allocated. If the case is serious, a fine shall be imposed until supply is stopped.

(四)违反本条例第十九、二十、二十一、二十二、二十三条规定，未经批准私自经营的，或者擅自改变经营范围的，或者套购、挪用、克扣金银的，由工商行政管理机关处以罚款或者没收。情节严重的，可并处以吊销营业执照、责令停业。

(4) For those who, in violation of Articles 19, 20, 21, 22, and 23 of these Regulations, operate without authorization, change the scope of business without authorization, or engage in arbitrage, misappropriation, or withholding of gold and silver, the administrative authority for industry and commerce shall impose a fine or confiscation. If the case is serious, it may also revoke the business license or order suspension of business.

(五)违反本条例第七条规定，将金银计价使用、私相买卖、借贷抵押的，由中国人民银行或者工商行政管理机关予以强制收购或者贬值收购。情节严重的，由工商行政管理机关处以罚款或者没收。

(5) For those who, in violation of Article 7 of these Regulations, use gold and silver as a means of pricing and payment, privately trade, or lend or mortgage gold and silver, the People's Bank of China or the administrative authority for industry and commerce shall enforce compulsory purchase or devalued purchase. If the case is serious, the administrative authority for industry and commerce shall impose a fine or confiscation.

(六)违反本条例第五章有关金银进出国境管理规定或者用各种方法偷运金银出境的，由海关依据本条例和国家海关法规处理。

(6) For those who violate the provisions of Chapter V of these Regulations on the administration of gold and silver entering or leaving the country or smuggle gold and silver out of the country by various means, the customs shall handle the matter in accordance with these Regulations and the state customs laws.

(七)违反本条例第十四条规定的，由中国人民银行予以收兑。对直接责任人员由有关单位追究行政责任。

(7) For those who violate Article 14 of these Regulations, the People's Bank of China shall purchase the gold and silver. The directly responsible persons shall be subject to administrative liability by the relevant units.

违反本条例规定，已构成犯罪行为的，由司法机关依法追究刑事责任。

For those who violate these Regulations and have constituted a criminal act, the judicial organs shall investigate criminal liability according to law.

本条例的施行细则，由中国人民银行会同国务院有关部门制定。

The implementing rules for these Regulations shall be formulated by the People's Bank of China in conjunction with the relevant departments of the State Council.

边疆少数民族地区的金银管理需要作某些变通规定的，由有关省、自治区人民政府会同中国人民银行根据本条例制定。

If certain flexible provisions are needed for the administration of gold and silver in border minority areas, the relevant provincial or autonomous region people's government shall, in conjunction with the People's Bank of China, formulate them in accordance with these Regulations.

本条例自发布之日起施行。过去有关部门制定的金银管理办法即行废止。

These Regulations shall come into force on the date of promulgation. The previous measures for the administration of gold and silver formulated by the relevant departments shall be abolished simultaneously.
