(Promulgated by Decree No. 62 of the State Council of the People's Republic of China on June 25, 1990; first revised in accordance with the Decision of the State Council on Amending the Regulations of the People's Republic of China on the Administration of the Prevention and Control of Pollution Damage to the Marine Environment by Coastal Engineering Construction Projects on September 25, 2007; second revised in accordance with the Decision of the State Council on Amending and Repealing Certain Administrative Regulations on March 1, 2017; third revised in accordance with the Decision of the State Council on Amending and Repealing Certain Administrative Regulations on March 19, 2018)
为加强海岸工程建设项目的环境保护管理，严格控制新的污染，保护和改善海洋环境，根据《中华人民共和国海洋环境保护法》，制定本条例。
These Regulations are formulated in accordance with the Marine Environment Protection Law of the People's Republic of China for the purposes of strengthening the environmental protection management of coastal engineering construction projects, strictly controlling new pollution, and protecting and improving the marine environment.
本条例所称海岸工程建设项目，是指位于海岸或者与海岸连接，工程主体位于海岸线向陆一侧，对海洋环境产生影响的新建、改建、扩建工程项目。具体包括：
For the purposes of these Regulations, "coastal engineering construction projects" refer to new construction, renovation, and expansion projects that are located on the coast or connected to the coast, with the main body of the project located on the landward side of the coastline, and that have an impact on the marine environment. Specifically, they include:
(一)港口、码头、航道、滨海机场工程项目；
(1) Ports, wharves, waterways, and coastal airport engineering projects;
(二)造船厂、修船厂；
(2) Shipyards and ship repair yards;
(三)滨海火电站、核电站、风电站；
(3) Coastal thermal power plants, nuclear power plants, and wind power plants;
(四)滨海物资存储设施工程项目；
(4) Coastal material storage facility engineering projects;
(五)滨海矿山、化工、轻工、冶金等工业工程项目；
(5) Coastal industrial engineering projects such as mining, chemical, light industry, and metallurgy;
(六)固体废弃物、污水等污染物处理处置排海工程项目；
(6) Engineering projects for the treatment, disposal, and discharge of pollutants such as solid waste and sewage into the sea;
(七)滨海大型养殖场；
(7) Coastal large-scale aquaculture farms;
(八)海岸防护工程、砂石场和入海河口处的水利设施；
(8) Coastal protection works, sand and gravel yards, and water conservancy facilities at the mouths of rivers entering the sea;
(九)滨海石油勘探开发工程项目；
(9) Coastal petroleum exploration and development engineering projects;
(十)国务院环境保护主管部门会同国家海洋主管部门规定的其他海岸工程项目。
(10) Other coastal engineering projects as prescribed by the competent department of environmental protection under the State Council jointly with the competent national marine department.
本条例适用于在中华人民共和国境内兴建海岸工程建设项目的一切单位和个人。
These Regulations apply to all units and individuals that construct coastal engineering construction projects within the territory of the People's Republic of China.
拆船厂建设项目的环境保护管理，依照《防止拆船污染环境管理条例》执行。
The environmental protection management of shipbreaking yard construction projects shall be implemented in accordance with the Regulations on the Administration of Prevention of Environmental Pollution by Shipbreaking.
建设海岸工程建设项目，应当符合所在经济区的区域环境保护规划的要求。
The construction of coastal engineering construction projects shall comply with the requirements of the regional environmental protection plan of the economic zone in which they are located.
国务院环境保护主管部门，主管全国海岸工程建设项目的环境保护工作。
The competent department of environmental protection under the State Council shall be in charge of the environmental protection work of coastal engineering construction projects nationwide.
沿海县级以上地方人民政府环境保护主管部门，主管本行政区域内的海岸工程建设项目的环境保护工作。
The competent departments of environmental protection of the local people's governments at or above the county level along the coast shall be in charge of the environmental protection work of coastal engineering construction projects within their respective administrative regions.
新建、改建、扩建海岸工程建设项目，应当遵守国家有关建设项目环境保护管理的规定。
The new construction, renovation, or expansion of coastal engineering construction projects shall comply with the relevant state provisions on the environmental protection management of construction projects.
海岸工程建设项目的建设单位，应当依法编制环境影响报告书(表)，报环境保护主管部门审批。
The construction unit of a coastal engineering construction project shall, in accordance with the law, prepare an environmental impact report (form) and submit it to the competent department of environmental protection for approval.
环境保护主管部门在批准海岸工程建设项目的环境影响报告书(表)之前，应当征求海洋、海事、渔业主管部门和军队环境保护部门的意见。
Before approving the environmental impact report (form) of a coastal engineering construction project, the competent department of environmental protection shall solicit opinions from the competent departments of marine affairs, maritime affairs, fisheries, and the environmental protection department of the military.
禁止在天然港湾有航运价值的区域、重要苗种基地和养殖场所及水面、滩涂中的鱼、虾、蟹、贝、藻类的自然产卵场、繁殖场、索饵场及重要的洄游通道围海造地。
It is prohibited to reclaim land from the sea in areas of natural harbors with navigational value, important seedling bases and aquaculture sites, and natural spawning grounds, breeding grounds, feeding grounds, and important migration channels of fish, shrimp, crab, shellfish, and algae in waters and tidal flats.
海岸工程建设项目环境影响报告书的内容，除按有关规定编制外，还应当包括：
The contents of the environmental impact report for a coastal engineering construction project shall, in addition to being prepared in accordance with relevant regulations, also include:
(一)所在地及其附近海域的环境状况；
(1) The environmental status of the location and its adjacent sea areas;
(二)建设过程中和建成后可能对海洋环境造成的影响；
(2) The possible impact on the marine environment during and after construction;
(三)海洋环境保护措施及其技术、经济可行性论证结论；
(3) Marine environmental protection measures and their technical and economic feasibility conclusions;
(四)建设项目海洋环境影响评价结论。
(4) The marine environmental impact assessment conclusion of the construction project.
海岸工程建设项目环境影响报告表，应当参照前款规定填报。
The environmental impact report form for a coastal engineering construction project shall be completed by reference to the preceding paragraph.
禁止兴建向中华人民共和国海域及海岸转嫁污染的中外合资经营企业、中外合作经营企业和外资企业；海岸工程建设项目引进技术和设备，应当有相应的防治污染措施，防止转嫁污染。
It is prohibited to establish Sino-foreign equity joint ventures, Sino-foreign contractual joint ventures, and wholly foreign-owned enterprises that transfer pollution to the sea areas and coasts of the People's Republic of China; where technology and equipment are introduced for coastal engineering construction projects, corresponding pollution prevention measures shall be in place to prevent the transfer of pollution.
在海洋特别保护区、海上自然保护区、海滨风景游览区、盐场保护区、海水浴场、重要渔业水域和其他需要特殊保护的区域内不得建设污染环境、破坏景观的海岸工程建设项目；在其区域外建设海岸工程建设项目的，不得损害上述区域的环境质量。法律法规另有规定的除外。
No coastal engineering construction projects that pollute the environment or damage the landscape may be constructed in marine special protected areas, marine nature reserves, coastal scenic tourist areas, salt field protection areas, seawater bathing beaches, important fishery waters, and other areas requiring special protection; where coastal engineering construction projects are constructed outside such areas, they shall not damage the environmental quality of the aforementioned areas, unless otherwise provided by laws and regulations.
海岸工程建设项目竣工验收时，建设项目的环境保护设施经验收合格后，该建设项目方可正式投入生产或者使用。
Upon completion and acceptance of a coastal engineering construction project, the project may only be formally put into production or use after the environmental protection facilities of the construction project have passed acceptance inspection.
县级以上人民政府环境保护主管部门，按照项目管理权限，可以会同有关部门对海岸工程建设项目进行现场检查，被检查者应当如实反映情况、提供资料。检查者有责任为被检查者保守技术秘密和业务秘密。法律法规另有规定的除外。
The competent departments of environmental protection of the people's governments at or above the county level may, in accordance with the authority of project management, conduct on-site inspections of coastal engineering construction projects jointly with relevant departments; the inspected party shall truthfully reflect the situation and provide materials. The inspector has the obligation to keep the technical secrets and business secrets of the inspected party confidential, unless otherwise provided by laws and regulations.
设置向海域排放废水设施的，应当合理利用海水自净能力，选择好排污口的位置。采用暗沟或者管道方式排放的，出水管口位置应当在低潮线以下。
Where facilities for discharging wastewater into the sea are installed, the self-purification capacity of seawater shall be reasonably utilized, and the location of the discharge outlet shall be properly selected. Where discharge is carried out by means of underground ditches or pipelines, the outlet pipe shall be located below the low tide line.
建设港口、码头，应当设置与其吞吐能力和货物种类相适应的防污设施。
When constructing ports and wharves, anti-pollution facilities commensurate with their throughput capacity and the type of goods shall be installed.
港口、油码头、化学危险品码头，应当配备海上重大污染损害事故应急设备和器材。
Ports, oil terminals, and chemical dangerous goods terminals shall be equipped with emergency equipment and materials for major pollution damage accidents at sea.
现有港口、码头未达到前两款规定要求的，由环境保护主管部门会同港口、码头主管部门责令其限期设置或者配备。
Where existing ports and wharves fail to meet the requirements of the preceding two paragraphs, the competent department of environmental protection shall, jointly with the competent department of ports and wharves, order them to install or equip them within a specified period.
建设岸边造船厂、修船厂，应当设置与其性质、规模相适应的残油、废油接收处理设施，含油废水接收处理设施，拦油、收油、消油设施，工业废水接收处理设施，工业和船舶垃圾接收处理设施等。
When constructing coastal shipyards and ship repair yards, facilities for receiving and treating residual oil and waste oil, facilities for receiving and treating oily wastewater, facilities for oil containment, oil recovery, and oil dispersant, facilities for receiving and treating industrial wastewater, and facilities for receiving and treating industrial and ship garbage shall be installed, commensurate with their nature and scale.
建设滨海核电站和其他核设施，应当严格遵守国家有关核环境保护和放射防护的规定及标准。
When constructing coastal nuclear power plants and other nuclear facilities, the relevant state regulations and standards on nuclear environmental protection and radiation protection shall be strictly observed.
建设岸边油库，应当设置含油废水接收处理设施，库场地面冲刷废水的集接、处理设施和事故应急设施；输油管线和储油设施应当符合国家关于防渗漏、防腐蚀的规定。
When constructing coastal oil depots, facilities for receiving and treating oily wastewater, facilities for collecting and treating ground flushing wastewater from the depot yard, and emergency facilities shall be installed; oil pipelines and oil storage facilities shall comply with state regulations on anti-leakage and anti-corrosion.
建设滨海矿山，在开采、选矿、运输、贮存、冶炼和尾矿处理等过程中，应当按照有关规定采取防止污染损害海洋环境的措施。
When constructing coastal mines, measures shall be taken in accordance with relevant regulations to prevent pollution damage to the marine environment during the processes of mining, beneficiation, transportation, storage, smelting, and tailings treatment.
建设滨海垃圾场或者工业废渣填埋场，应当建造防护堤坝和场底封闭层，设置渗液收集、导出、处理系统和可燃性气体防爆装置。
When constructing coastal landfills or industrial waste residue landfills, protective embankments and bottom sealing layers shall be constructed, and systems for collecting,export, and treating leachate, as well as combustible gas explosion-proof devices, shall be installed.
修筑海岸防护工程，在入海河口处兴建水利设施、航道或者综合整治工程，应当采取措施，不得损害生态环境及水产资源。
When constructing coastal protection works, water conservancy facilities, waterways, or comprehensive improvement projects at the mouths of rivers entering the sea, measures shall be taken to avoid damaging the ecological environment and aquatic resources.
兴建海岸工程建设项目，不得改变、破坏国家和地方重点保护的野生动植物的生存环境。不得兴建可能导致重点保护的野生动植物生存环境污染和破坏的海岸工程建设项目；确需兴建的，应当征得野生动植物行政主管部门同意，并由建设单位负责组织采取易地繁育等措施，保证物种延续。
When constructing coastal engineering construction projects, the living environment of wild animals and plants under special state or local protection shall not be altered or destroyed. No coastal engineering construction project that may cause pollution and damage to the living environment of wild animals and plants under special protection may be constructed; if construction is truly necessary, the consent of the competent department of wild animals and plants shall be obtained, and the construction unit shall be responsible for organizing measures such as ex situ breeding to ensure the continuation of the species.
在鱼、虾、蟹、贝类的洄游通道建闸、筑坝，对渔业资源有严重影响的，建设单位应当建造过鱼设施或者采取其他补救措施。
Where sluice gates or dams are built on the migration channels of fish, shrimp, crab, and shellfish, and this has a serious impact on fishery resources, the construction unit shall build fish passage facilities or take other remedial measures.
集体所有制单位或者个人在全民所有的水域、海涂，建设构不成基本建设项目的养殖工程的，应当在县级以上地方人民政府规划的区域内进行。
Where collective-owned units or individuals construct aquaculture projects that do not constitute capital construction projects in waters or tidal flats owned by the whole people, they shall do so within the areas planned by the local people's governments at or above the county level.
集体所有制单位或者个人零星经营性采挖砂石，应当在县级以上地方人民政府指定的区域内采挖。
Where collective-owned units or individuals engage in sporadic commercial extraction of sand and gravel, they shall do so within the areas designated by the local people's governments at or above the county level.
禁止在红树林和珊瑚礁生长的地区，建设毁坏红树林和珊瑚礁生态系统的海岸工程建设项目。
It is prohibited to construct coastal engineering construction projects that destroy the mangrove and coral reef ecosystems in areas where mangroves and coral reefs grow.
兴建海岸工程建设项目，应当防止导致海岸非正常侵蚀。
When constructing coastal engineering construction projects, abnormal coastal erosion shall be prevented.
禁止在海岸保护设施管理部门规定的海岸保护设施的保护范围内从事爆破、采挖砂石、取土等危害海岸保护设施安全的活动。非经国务院授权的有关主管部门批准，不得占用或者拆除海岸保护设施。
It is prohibited to engage in activities such as blasting, extracting sand and gravel, and quarrying that endanger the safety of coastal protection facilities within the protection scope of coastal protection facilities as prescribed by the competent department of coastal protection facilities. Without the approval of the relevant competent department authorized by the State Council, coastal protection facilities shall not be occupied or dismantled.
未持有经审核和批准的环境影响报告书(表)，兴建海岸工程建设项目的，依照《中华人民共和国海洋环境保护法》第七十九条的规定予以处罚。
Where a coastal engineering construction project is constructed without holding an approved environmental impact report (form), penalties shall be imposed in accordance with Article 79 of the Marine Environment Protection Law of the People's Republic of China.
拒绝、阻挠环境保护主管部门进行现场检查，或者在被检查时弄虚作假的，由县级以上人民政府环境保护主管部门依照《中华人民共和国海洋环境保护法》第七十五条的规定予以处罚。
Where a party refuses or obstructs an on-site inspection by the competent department of environmental protection, or practices fraud during the inspection, the competent department of environmental protection of the people's government at or above the county level shall impose penalties in accordance with Article 75 of the Marine Environment Protection Law of the People's Republic of China.
海岸工程建设项目的环境保护设施未建成或者未达到规定要求，该项目即投入生产、使用的，依照《中华人民共和国海洋环境保护法》第八十条的规定予以处罚。
Where the environmental protection facilities of a coastal engineering construction project are not completed or do not meet the specified requirements, and the project is put into production or use, penalties shall be imposed in accordance with Article 80 of the Marine Environment Protection Law of the People's Republic of China.
环境保护主管部门工作人员滥用职权、玩忽职守、徇私舞弊的，由其所在单位或者上级主管机关给予行政处分；构成犯罪的，依法追究刑事责任。
Where staff members of the competent department of environmental protection abuse their power, neglect their duties, or engage in malpractice for personal gain, disciplinary sanctions shall be imposed by their unit or the competent authority at a higher level; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
本条例自1990年8月1日起施行。
These Regulations shall come into force as of August 1, 1990.
