为了加强对监控化学品的管理，保障公民的人身安全和保护环境，制定本条例。
These Regulations are formulated to strengthen the administration of controlled chemicals, ensure the personal safety of citizens, and protect the environment.
在中华人民共和国境内从事监控化学品的生产、经营和使用活动，必须遵守本条例。
All activities involving the production, operation, and use of controlled chemicals within the territory of the People's Republic of China must comply with these Regulations.
本条例所称监控化学品，是指下列各类化学品：
For the purposes of these Regulations, controlled chemicals refer to the following categories of chemicals:
第一类：可作为化学武器的化学品；
Category 1: Chemicals that can be used as chemical weapons;
第二类：可作为生产化学武器前体的化学品；
Category 2: Chemicals that can be used as precursors for the production of chemical weapons;
第三类：可作为生产化学武器主要原料的化学品；
Category 3: Chemicals that can be used as main raw materials for the production of chemical weapons;
第四类：除炸药和纯碳氢化合物外的特定有机化学品。
Category 4: Specific organic chemicals other than explosives and pure hydrocarbons.
前款各类监控化学品的名录由国务院化学工业主管部门提出，报国务院批准后公布。
The list of the various categories of controlled chemicals mentioned in the preceding paragraph shall be proposed by the competent chemical industry department under the State Council and published after approval by the State Council.
国务院化学工业主管部门负责全国监控化学品的管理工作。省、自治区、直辖市人民政府化学工业主管部门负责本行政区域内监控化学品的管理工作。
The competent chemical industry department under the State Council shall be responsible for the administration of controlled chemicals nationwide. The competent chemical industry departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for the administration of controlled chemicals within their respective administrative regions.
生产、经营或者使用监控化学品的，应当依照本条例和国家有关规定向国务院化学工业主管部门或者省、自治区、直辖市人民政府化学工业主管部门申报生产、经营或者使用监控化学品的有关资料、数据和使用目的，接受化学工业主管部门的检查监督。
Entities that produce, operate, or use controlled chemicals shall, in accordance with these Regulations and relevant state provisions, report relevant materials, data, and purposes of use concerning the production, operation, or use of controlled chemicals to the competent chemical industry department under the State Council or the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government, and shall accept inspection and supervision by the competent chemical industry department.
国家严格控制第一类监控化学品的生产。
The state strictly controls the production of Category 1 controlled chemicals.
为科研、医疗、制造药物或者防护目的需要生产第一类监控化学品的，应当报国务院化学工业主管部门批准，并在国务院化学工业主管部门指定的小型设施中生产。
If it is necessary to produce Category 1 controlled chemicals for scientific research, medical treatment, pharmaceutical manufacturing, or protective purposes, approval shall be obtained from the competent chemical industry department under the State Council, and production shall be carried out in small-scale facilities designated by the competent chemical industry department under the State Council.
严禁在未经国务院化学工业主管部门指定的设施中生产第一类监控化学品。
It is strictly prohibited to produce Category 1 controlled chemicals in facilities not designated by the competent chemical industry department under the State Council.
国家对第二类、第三类监控化学品和第四类监控化学品中含磷、硫、氟的特定有机化学品的生产，实行特别许可制度；未经特别许可的，任何单位和个人均不得生产。特别许可办法，由国务院化学工业主管部门制定。
The state implements a special licensing system for the production of Category 2 and Category 3 controlled chemicals, as well as specific organic chemicals containing phosphorus, sulfur, or fluorine under Category 4 controlled chemicals; without special permission, no unit or individual may produce them. The special licensing measures shall be formulated by the competent chemical industry department under the State Council.
新建、扩建或者改建用于生产第二类、第三类监控化学品和第四类监控化学品中含磷、硫、氟的特定有机化学品的设施，应当向所在地省、自治区、直辖市人民政府化学工业主管部门提出申请，经省、自治区、直辖市人民政府化学工业主管部门审查签署意见，报国务院化学工业主管部门批准后，方可开工建设；工程竣工后，经所在地省、自治区、直辖市人民政府化学工业主管部门验收合格，并报国务院化学工业主管部门批准后，方可投产使用。
For the construction, expansion, or renovation of facilities used to produce Category 2 and Category 3 controlled chemicals, as well as specific organic chemicals containing phosphorus, sulfur, or fluorine under Category 4 controlled chemicals, an application shall be submitted to the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the facility is located. After review and endorsement by the competent chemical industry department of the province, autonomous region, or municipality directly under the Central Government, and approval by the competent chemical industry department under the State Council, construction may commence; after completion of the project, upon acceptance inspection by the competent chemical industry department of the province, autonomous region, or municipality directly under the Central Government where the facility is located, and approval by the competent chemical industry department under the State Council, the facility may be put into operation.
新建、扩建或者改建用于生产第四类监控化学品中不含磷、硫、氟的特定有机化学品的设施，应当在开工生产前向所在地省、自治区、直辖市人民政府化学工业主管部门备案。
For the construction, expansion, or renovation of facilities used to produce specific organic chemicals under Category 4 controlled chemicals that do not contain phosphorus, sulfur, or fluorine, the entity shall file a record with the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the facility is located before commencing production.
监控化学品应当在专用的化工仓库中储存，并设专人管理。监控化学品的储存条件应当符合国家有关规定。
Controlled chemicals shall be stored in dedicated chemical warehouses with designated personnel for management. The storage conditions for controlled chemicals shall comply with relevant state provisions.
储存监控化学品的单位，应当建立严格的出库、入库检查制度和登记制度；发现丢失、被盗时，应当立即报告当地公安机关和所在地省、自治区、直辖市人民政府化学工业主管部门；省、自治区、直辖市人民政府化学工业主管部门应当积极配合公安机关进行查处。
Units storing controlled chemicals shall establish strict inspection and registration systems for outgoing and incoming storage; if loss or theft is discovered, they shall immediately report to the local public security organ and the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the unit is located; the competent chemical industry department of the province, autonomous region, or municipality directly under the Central Government shall actively cooperate with the public security organ in investigation and handling.
对变质或者过期失效的监控化学品，应当及时处理。处理方案报所在地省、自治区、直辖市人民政府化学工业主管部门批准后实施。
Controlled chemicals that have deteriorated or expired shall be disposed of in a timely manner. The disposal plan shall be implemented after approval by the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the unit is located.
为科研、医疗、制造药物或者防护目的需要使用第一类监控化学品的，应当向国务院化学工业主管部门提出申请，经国务院化学工业主管部门审查批准后，凭批准文件同国务院化学工业主管部门指定的生产单位签订合同，并将合同副本报送国务院化学工业主管部门备案。
If it is necessary to use Category 1 controlled chemicals for scientific research, medical treatment, pharmaceutical manufacturing, or protective purposes, an application shall be submitted to the competent chemical industry department under the State Council. After examination and approval by the competent chemical industry department under the State Council, a contract shall be signed with the production unit designated by the competent chemical industry department under the State Council based on the approval document, and a copy of the contract shall be submitted to the competent chemical industry department under the State Council for record.
需要使用第二类监控化学品的，应当向所在地省、自治区、直辖市人民政府化学工业主管部门提出申请，经省、自治区、直辖市人民政府化学工业主管部门审查批准后，凭批准文件同国务院化学工业主管部门指定的经销单位签订合同，并将合同副本报送所在地省、自治区、直辖市人民政府化学工业主管部门备案。
If it is necessary to use Category 2 controlled chemicals, an application shall be submitted to the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the unit is located. After examination and approval by the competent chemical industry department of the province, autonomous region, or municipality directly under the Central Government, a contract shall be signed with the distribution unit designated by the competent chemical industry department under the State Council based on the approval document, and a copy of the contract shall be submitted to the competent chemical industry department of the province, autonomous region, or municipality directly under the Central Government where the unit is located for record.
国务院化学工业主管部门会同国务院对外经济贸易主管部门指定的单位(以下简称被指定单位)，可以从事第一类监控化学品和第二类、第三类监控化学品及其生产技术、专用设备的进出口业务。
Units designated by the competent chemical industry department under the State Council in conjunction with the competent department of foreign trade and economic cooperation under the State Council (hereinafter referred to as designated units) may engage in the import and export of Category 1 controlled chemicals, Category 2 and Category 3 controlled chemicals, and their production technologies and specialized equipment.
需要进口或者出口第一类监控化学品和第二类、第三类监控化学品及其生产技术、专用设备的，应当委托被指定单位代理进口或者出口。除被指定单位外，任何单位和个人均不得从事这类进出口业务。
If it is necessary to import or export Category 1 controlled chemicals, Category 2 and Category 3 controlled chemicals, and their production technologies and specialized equipment, the entity shall entrust a designated unit to act as an agent for import or export. Except for designated units, no unit or individual may engage in such import or export business.
国家严格控制第一类监控化学品的进口和出口。非为科研、医疗、制造药物或者防护目的，不得进口第一类监控化学品。
The state strictly controls the import and export of Category 1 controlled chemicals. Category 1 controlled chemicals shall not be imported unless for scientific research, medical treatment, pharmaceutical manufacturing, or protective purposes.
接受委托进口第一类监控化学品的被指定单位，应当向国务院化学工业主管部门提出申请，并提交产品最终用途的说明和证明；经国务院化学工业主管部门审查签署意见后，报国务院审查批准。被指定单位凭国务院的批准文件向国务院对外经济贸易主管部门申请领取进口许可证。
The designated unit entrusted to import first-category controlled chemicals shall submit an application to the competent chemical industry department of the State Council, along with a description and proof of the final use of the product; after review and endorsement by the competent chemical industry department of the State Council, it shall be submitted to the State Council for examination and approval. The designated unit shall apply to the competent foreign trade and economic cooperation department of the State Council for an import license based on the approval document of the State Council.
接受委托进口第二类、第三类监控化学品及其生产技术、专用设备的被指定单位，应当向国务院化学工业主管部门提出申请，并提交所进口的化学品、生产技术或者专用设备最终用途的说明和证明；经国务院化学工业主管部门审查批准后，被指定单位凭国务院化学工业主管部门的批准文件向国务院对外经济贸易主管部门申请领取进口许可证。
The designated unit entrusted to import second-category and third-category controlled chemicals and their production technologies and special equipment shall submit an application to the competent chemical industry department of the State Council, along with a description and proof of the final use of the imported chemicals, production technologies, or special equipment; after review and approval by the competent chemical industry department of the State Council, the designated unit shall apply to the competent foreign trade and economic cooperation department of the State Council for an import license based on the approval document of the competent chemical industry department of the State Council.
接受委托出口第一类监控化学品的被指定单位，应当向国务院化学工业主管部门提出申请，并提交进口国政府或者政府委托机构出具的所进口的化学品仅用于科研、医疗、制造药物或者防护目的和不转口第三国的保证书；经国务院化学工业主管部门审查签署意见后，报国务院审查批准。被指定单位凭国务院的批准文件向国务院对外经济贸易主管部门申请领取出口许可证。
The designated unit entrusted to export first-category controlled chemicals shall submit an application to the competent chemical industry department of the State Council, along with a guarantee letter issued by the government of the importing country or an agency authorized by the government, stating that the imported chemicals are only used for scientific research, medical treatment, drug manufacturing, or protection purposes and will not be re-exported to a third country; after review and endorsement by the competent chemical industry department of the State Council, it shall be submitted to the State Council for examination and approval. The designated unit shall apply to the competent foreign trade and economic cooperation department of the State Council for an export license based on the approval document of the State Council.
接受委托出口第二类、第三类监控化学品及其生产技术、专用设备的被指定单位，应当向国务院化学工业主管部门提出申请，并提交进口国政府或者政府委托机构出具的所进口的化学品、生产技术、专用设备不用于生产化学武器和不转口第三国的保证书；经国务院化学工业主管部门审查批准后，被指定单位凭国务院化学工业主管部门的批准文件向国务院对外经济贸易主管部门申请领取出口许可证。
The designated unit entrusted to export second-category and third-category controlled chemicals and their production technologies and special equipment shall submit an application to the competent chemical industry department of the State Council, along with a guarantee letter issued by the government of the importing country or an agency authorized by the government, stating that the imported chemicals, production technologies, and special equipment will not be used for the production of chemical weapons and will not be re-exported to a third country; after review and approval by the competent chemical industry department of the State Council, the designated unit shall apply to the competent foreign trade and economic cooperation department of the State Council for an export license based on the approval document of the competent chemical industry department of the State Council.
使用监控化学品的，应当与其申报的使用目的相一致；需要改变使用目的的，应当报原审批机关批准。
The use of controlled chemicals shall be consistent with the declared purpose of use; if the purpose of use needs to be changed, approval from the original approving authority shall be obtained.
使用第一类、第二类监控化学品的，应当按照国家有关规定，定期向所在地省、自治区、直辖市人民政府化学工业主管部门报告消耗此类监控化学品的数量和使用此类监控化学品生产最终产品的数量。
Users of first-category and second-category controlled chemicals shall, in accordance with relevant state regulations, periodically report to the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government where they are located, the quantity of such controlled chemicals consumed and the quantity of final products produced using such controlled chemicals.
违反本条例规定，生产监控化学品的，由省、自治区、直辖市人民政府化学工业主管部门责令限期改正；逾期不改正的，可以处20万元以下的罚款；情节严重的，可以提请省、自治区、直辖市人民政府责令停产整顿。
Whoever, in violation of these Regulations, produces controlled chemicals shall be ordered by the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government to make corrections within a specified time limit; if no correction is made within the time limit, a fine of not more than 200,000 yuan may be imposed; if the circumstances are serious, the competent chemical industry department may request the people's government of the province, autonomous region, or municipality directly under the Central Government to order a suspension of production for rectification.
违反本条例规定，使用监控化学品的，由省、自治区、直辖市人民政府化学工业主管部门责令限期改正；逾期不改正的，可以处5万元以下的罚款。
Whoever, in violation of these Regulations, uses controlled chemicals shall be ordered by the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government to make corrections within a specified time limit; if no correction is made within the time limit, a fine of not more than 50,000 yuan may be imposed.
违反本条例规定，经营监控化学品的，由省、自治区、直辖市人民政府化学工业主管部门没收其违法经营的监控化学品和违法所得，可以并处违法经营额1倍以上2倍以下的罚款。
Whoever, in violation of these Regulations, operates controlled chemicals shall, by the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government, have the illegally operated controlled chemicals and illegal gains confiscated, and may also be imposed a fine of not less than one time but not more than two times the amount of the illegal business turnover.
违反本条例规定，隐瞒、拒报有关监控化学品的资料、数据，或者妨碍、阻挠化学工业主管部门依照本条例的规定履行检查监督职责的，由省、自治区、直辖市人民政府化学工业主管部门处以5万元以下的罚款。
Whoever, in violation of these Regulations, conceals or refuses to report relevant information or data on controlled chemicals, or obstructs or hinders the competent chemical industry department from performing its inspection and supervision duties in accordance with these Regulations, shall be imposed a fine of not more than 50,000 yuan by the competent chemical industry department of the people's government of the province, autonomous region, or municipality directly under the Central Government.
违反本条例规定，构成违反治安管理行为的，依照《中华人民共和国治安管理处罚法》的有关规定处罚；构成犯罪的，依法追究刑事责任。
Whoever, in violation of these Regulations, constitutes a violation of public security administration shall be punished in accordance with the relevant provisions of the Public Security Administration Punishments Law of the People's Republic of China; if a crime is constituted, criminal liability shall be investigated in accordance with the law.
在本条例施行前已经从事生产、经营或者使用监控化学品的，应当依照本条例的规定，办理有关手续。
Those who have already engaged in the production, operation, or use of controlled chemicals before the implementation of these Regulations shall go through the relevant procedures in accordance with the provisions of these Regulations.
本条例自发布之日起施行。
These Regulations shall come into force as of the date of promulgation.
