These Regulations apply to navigation aids set up within the territory of the People's Republic of China and other maritime areas under its jurisdiction.

For the purposes of these Regulations, "navigation aids" refer to aids to navigation used for ship positioning, navigation, or other special purposes, including visual aids, radio navigation facilities, and sound signals.

国务院交通行政主管部门负责管理和保护除军用航标和渔业航标以外的航标。国务院交通行政主管部门设立的流域航道管理机构、海区港务监督机构和县级以上地方人民政府交通行政主管部门,负责管理和保护本辖区内军用航标和渔业航标以外的航标。交通行政主管部门和国务院交通行政主管部门设立的流域航道管理机构、海区港务监督机构统称航标管理机关。

TranslationArticle 3

The competent administrative department of transportation under the State Council is responsible for the management and protection of navigation aids other than military navigation aids and fishery navigation aids. The river basin waterway management agencies, maritime port superintendency agencies established by the competent administrative department of transportation under the State Council, and the competent administrative departments of transportation of local people's governments at or above the county level are responsible for the management and protection of navigation aids other than military navigation aids and fishery navigation aids within their respective jurisdictions. The competent administrative departments of transportation, the river basin waterway management agencies, and the maritime port superintendency agencies established by the competent administrative department of transportation under the State Council are collectively referred to as the navigation aid management authorities.

Navigation aids shall be uniformly set up by the navigation aid management authorities, except for the navigation aids specified in paragraph 2 of this Article.

When the navigation aid management authorities set up, remove, relocate, or otherwise change the condition of navigation aids, they shall promptly notify the relevant departments.

任何单位或者个人发现航标损坏、失常、移位或者漂失时,应当立即向航标管理机关报告。

TranslationArticle 10

Any unit or individual that discovers a navigation aid is damaged, malfunctioning, displaced, or adrift shall immediately report to the navigation aid management authorities.

任何单位和个人不得在航标附近设置可能被误认为航标或者影响航标工作效能的灯光或者音响装置。

TranslationArticle 11

No unit or individual may set up near a navigation aid any light or sound device that may be mistaken for a navigation aid or affect the working efficiency of the navigation aid.

因施工作业需要搬迁、拆除航标的,应当征得航标管理机关同意,在采取替补措施后方可搬迁、拆除。搬迁、拆除航标所需的费用,由施工作业单位或者个人承担。

If relocation or removal of a navigation aid is necessary due to construction operations, the consent of the navigation aid management authorities shall be obtained, and the relocation or removal may only be carried out after alternative measures have been taken. The costs required for the relocation or removal of the navigation aid shall be borne by the construction unit or individual.

在视觉航标的通视方向或者无线电导航设施的发射方向,不得构筑影响航标正常工作效能的建筑物、构筑物,不得种植影响航标正常工作效能的植物。

In the line of sight of visual aids or the emission direction of radio navigation facilities, no buildings or structures that affect the normal working efficiency of the navigation aids may be constructed, and no plants that affect the normal working efficiency of the navigation aids may be planted.

禁止破坏航标辅助设施的行为。

前款所称航标辅助设施,是指为航标及其管理人员提供能源、水和其他所需物资而设置的各类设施,包括航标场地、直升机平台、登陆点、码头、趸船、水塔、储水池、水井、油(水)泵房、电力设施、业务用房以及专用道路、仓库等。

The term 'navigation aid auxiliary facilities' as mentioned in the preceding paragraph refers to various facilities set up to provide energy, water, and other necessary supplies for navigation aids and their management personnel, including navigation aid sites, helipads, landing points, docks, pontoons, water towers, reservoirs, wells, oil (water) pump houses, electrical facilities, operational buildings, and dedicated roads, warehouses, etc.

禁止下列影响航标工作效能的行为:

The following acts that affect the operational effectiveness of navigation aids are prohibited:

(一)在航标周围20米内或者在埋有航标地下管道、线路的地面钻孔、挖坑、采掘土石、堆放物品或者进行明火作业;

(1) Drilling, digging, excavating soil or rock, stacking items, or conducting open-flame operations within 20 meters around a navigation aid or on the ground where underground pipelines or cables for navigation aids are buried;

对有下列行为之一的单位和个人,由航标管理机关给予奖励:

Units or individuals that engage in any of the following acts shall be rewarded by the navigation aid management authority:

(一)检举、控告危害航标的行为,对破案有功的;

(1) Reporting or accusing acts that endanger navigation aids, and making meritorious contributions to solving cases;

(二)及时制止危害航标的行为,防止事故发生或者减少损失的;

(2) Promptly stopping acts that endanger navigation aids, preventing accidents or reducing losses;

(三)捞获水上漂流航标,主动送交航标管理机关的。

(3) Salvaging floating navigation aids on water and voluntarily delivering them to the navigation aid management authority.

违反本条例第六条第二款的规定,擅自设置、撤除、移动专用航标或者改变专用航标的其他状况的,由航标管理机关责令限期拆除、重新设置、调整专用航标。

TranslationArticle 19

Whoever, in violation of the provisions of the second paragraph of Article 6 of these Regulations, sets up, removes, moves a special navigation aid or changes other conditions of a special navigation aid without authorization shall be ordered by the navigation aid management authority to dismantle, re-set, or adjust the special navigation aid within a specified time limit.

有下列行为之一的,由航标管理机关责令限期改正或者采取相应的补救措施:

Any of the following acts shall be ordered by the navigation aid management authority to make corrections within a specified time limit or take corresponding remedial measures:

(一)违反本条例第十一条的规定,在航标附近设置灯光或者音响装置的;

(1) Violating the provisions of Article 11 of these Regulations by setting up lights or sound devices near navigation aids;

(二)违反本条例第十三条的规定,构筑建筑物、构筑物或者种植植物的。

船舶违反本条例第十四条第二款的规定,触碰航标不报告的,航标管理机关可以根据情节处以2万元以下的罚款;造成损失的,应当依法赔偿。

TranslationArticle 21

If a vessel, in violation of the provisions of the second paragraph of Article 14 of these Regulations, collides with a navigation aid and fails to report, the navigation aid management authority may impose a fine of not more than 20,000 yuan depending on the circumstances; if losses are caused, compensation shall be made according to law.

违反本条例第十五条、第十六条、第十七条的规定,危害航标及其辅助设施或者影响航标工作效能的,由航标管理机关责令其限期改正,给予警告,可以并处2000元以下的罚款;造成损失的,应当依法赔偿。

TranslationArticle 22

Whoever, in violation of the provisions of Articles 15, 16, and 17 of these Regulations, endangers navigation aids or their auxiliary facilities or affects the operational effectiveness of navigation aids shall be ordered by the navigation aid management authority to make corrections within a specified time limit, given a warning, and may be concurrently fined not more than 2,000 yuan; if losses are caused, compensation shall be made according to law.

违反本条例,危害军用航标及其辅助设施或者影响军用航标工作效能,应当处以罚款的,由军队的航标管理机构移交航标管理机关处罚。

TranslationArticle 23

Whoever, in violation of these Regulations, endangers military navigation aids or their auxiliary facilities or affects the operational effectiveness of military navigation aids and should be fined, shall be transferred by the military navigation aid management authority to the navigation aid management authority for punishment.

违反本条例规定,构成违反治安管理行为的,由公安机关依照《中华人民共和国治安管理处罚法》予以处罚;构成犯罪的,依法追究刑事责任。

TranslationArticle 24

Whoever, in violation of these Regulations, constitutes a violation of public security administration shall be punished by the public security organ in accordance with the 'Public Security Administration Punishments Law of the People's Republic of China'; if a crime is constituted, criminal liability shall be investigated according to law.
