总 则
General Provisions
为了加强船员管理，提高船员素质，维护船员的合法权益，保障水上交通安全，保护水域环境，制定本条例。
These Regulations are formulated to strengthen the management of seafarers, improve the quality of seafarers, safeguard the legitimate rights and interests of seafarers, ensure water traffic safety, and protect the water environment.
中华人民共和国境内的船员注册、任职、培训、职业保障以及提供船员服务等活动，适用本条例。
These Regulations apply to activities such as seafarer registration, employment, training, professional protection, and provision of seafarer services within the territory of the People's Republic of China.
国务院交通主管部门主管全国船员管理工作。
The competent transport department under the State Council shall be in charge of the national seafarer management.
国家海事管理机构依照本条例负责统一实施船员管理工作。
The National Maritime Safety Administration shall, in accordance with these Regulations, be responsible for the unified implementation of seafarer management.
负责管理中央管辖水域的海事管理机构和负责管理其他水域的地方海事管理机构(以下统称海事管理机构)，依照各自职责具体负责船员管理工作。
The maritime safety administration responsible for managing the central jurisdictional waters and the local maritime safety administration responsible for managing other waters (hereinafter collectively referred to as maritime safety administrations) shall, within their respective responsibilities, be specifically responsible for seafarer management.
船员注册和任职资格
Seafarer Registration and Qualification for Employment
本条例所称船员，是指依照本条例的规定取得船员适任证书的人员，包括船长、高级船员、普通船员。
For the purposes of these Regulations, "seafarer" means a person who has obtained a seafarer competency certificate in accordance with these Regulations, including ship captains, officers, and ratings.
本条例所称船长，是指依照本条例的规定取得船长任职资格，负责管理和指挥船舶的人员。
For the purposes of these Regulations, "ship captain" means a person who has obtained the qualification for employment as a ship captain in accordance with these Regulations and is responsible for managing and commanding the ship.
本条例所称高级船员，是指依照本条例的规定取得相应任职资格的大副、二副、三副、轮机长、大管轮、二管轮、三管轮、通信人员以及其他在船舶上任职的高级技术或者管理人员。
For the purposes of these Regulations, senior seafarers refer to chief mates, second mates, third mates, chief engineers, second engineers, third engineers, fourth engineers, communication personnel, and other senior technical or management personnel serving on board who have obtained corresponding qualifications in accordance with these Regulations.
本条例所称普通船员，是指除船长、高级船员外的其他船员。
For the purposes of these Regulations, ordinary seafarers refer to seafarers other than the master and senior seafarers.
船员应当依照本条例的规定取得相应的船员适任证书。
Seafarers shall obtain corresponding seafarer competency certificates in accordance with these Regulations.
申请船员适任证书，应当具备下列条件：
To apply for a seafarer competency certificate, the following conditions shall be met:
(一)年满18周岁(在船实习、见习人员年满16周岁)且初次申请不超过60周岁；
(1) Being at least 18 years old (16 years old for trainees or interns on board) and not exceeding 60 years old at the time of initial application;
(二)符合船员任职岗位健康要求；
(2) Meeting the health requirements for the seafarer position;
(三)经过船员基本安全培训。
(3) Having undergone basic safety training for seafarers.
参加航行和轮机值班的船员还应当经过相应的船员适任培训、特殊培训，具备相应的船员任职资历，并且任职表现和安全记录良好。
Seafarers engaged in navigation and engine room watchkeeping shall also undergo corresponding competency training and special training, possess relevant seafarer service experience, and have a good record of performance and safety.
国际航行船舶的船员申请适任证书的，还应当通过船员专业外语考试。
Seafarers on international voyage vessels applying for competency certificates shall also pass a professional foreign language examination for seafarers.
申请船员适任证书，可以向任何有相应船员适任证书签发权限的海事管理机构提出书面申请，并附送申请人符合本条例第五条规定条件的证明材料。对符合规定条件并通过国家海事管理机构组织的船员任职考试的，海事管理机构应当发给相应的船员适任证书及船员服务簿。
An application for a seafarer competency certificate may be submitted in writing to any maritime administration agency with the authority to issue such certificates, together with the supporting documents proving that the applicant meets the conditions specified in Article 5 of these Regulations. For those who meet the prescribed conditions and have passed the seafarer competency examination organized by the national maritime administration, the maritime administration agency shall issue the corresponding seafarer competency certificate and seafarer service record book.
船员适任证书应当注明船员适任的航区(线)、船舶类别和等级、职务以及有效期限等事项。
A seaman's competency certificate shall indicate the navigation area (route), ship type and grade, position, and validity period for which the seaman is qualified.
参加航行和轮机值班的船员适任证书的有效期不超过5年。
The validity period of a competency certificate for seamen engaged in navigation and engine room watchkeeping shall not exceed 5 years.
船员服务簿应当载明船员的姓名、住所、联系人、联系方式、履职情况以及其他有关事项。
The seaman's service record shall contain the seaman's name, domicile, contact person, contact information, performance of duties, and other relevant matters.
船员服务簿记载的事项发生变更的，船员应当向海事管理机构办理变更手续。
If the particulars recorded in the seaman's service record change, the seaman shall go through the modification formalities with the maritime administrative agency.
中国籍船舶的船长应当由中国籍船员担任。
The captain of a Chinese vessel shall be a Chinese seaman.
中国籍船舶在境外遇有不可抗力或者其他特殊情况，无法满足船舶最低安全配员要求，需要由本船下一级船员临时担任上一级职务时，应当向海事管理机构提出申请。海事管理机构根据拟担任上一级船员职务船员的任职资历、任职表现和安全记录，出具相应的证明文件。
If a Chinese vessel encounters force majeure or other special circumstances abroad and cannot meet the minimum safe manning requirements, and a lower-level seaman on the same vessel needs to temporarily serve in a higher position, an application shall be submitted to the maritime administrative agency. The maritime administrative agency shall issue a corresponding certification document based on the seaman's service experience, performance, and safety record for the intended higher position.
曾经在军用船舶、渔业船舶上工作的人员，或者持有其他国家、地区船员适任证书的船员，依照本条例的规定申请船员适任证书的，海事管理机构可以免除船员培训和考试的相应内容。具体办法由国务院交通主管部门另行规定。
For persons who have worked on military vessels or fishing vessels, or seamen holding competency certificates from other countries or regions, when applying for a seaman's competency certificate in accordance with these Regulations, the maritime administrative agency may exempt the corresponding content of seaman training and examination. Specific measures shall be separately prescribed by the competent transport department of the State Council.
以海员身份出入国境和在国外船舶上从事工作的中国籍船员，应当向国家海事管理机构指定的海事管理机构申请中华人民共和国海员证。
Chinese seamen who enter or leave the country as seamen or work on foreign vessels shall apply to the maritime administrative agency designated by the national maritime administrative agency for a People's Republic of China Seaman's Passport.
申请中华人民共和国海员证，应当符合下列条件：
To apply for a People's Republic of China Seaman's Passport, the following conditions shall be met:
(一)是中华人民共和国公民；
(1) Be a citizen of the People's Republic of China;
(二)持有国际航行船舶船员适任证书或者有确定的船员出境任务；
(2) Hold a seafarer competency certificate for international voyage vessels or have a confirmed seafarer assignment abroad;
(三)无法律、行政法规规定禁止出境的情形。
(3) No circumstances prohibited by laws or administrative regulations for exit.
海事管理机构应当自受理申请之日起7日内做出批准或者不予批准的决定。予以批准的，发给中华人民共和国海员证；不予批准的，应当书面通知申请人并说明理由。
The maritime administrative agency shall make a decision to approve or disapprove within 7 days from the date of receiving the application. If approved, it shall issue the People's Republic of China Seafarer's Passport; if disapproved, it shall notify the applicant in writing and state the reasons.
中华人民共和国海员证是中国籍船员在境外执行任务时表明其中华人民共和国公民身份的证件。中华人民共和国海员证遗失、被盗或者损毁的，应当向海事管理机构申请补发。船员在境外的，应当向中华人民共和国驻外使馆、领馆申请补发。
The People's Republic of China Seafarer's Passport is a document certifying the Chinese citizenship of a Chinese seafarer when performing duties abroad. If the People's Republic of China Seafarer's Passport is lost, stolen, or damaged, a replacement shall be applied for from the maritime administrative agency. If the seafarer is abroad, a replacement shall be applied for from the embassy or consulate of the People's Republic of China.
中华人民共和国海员证的有效期不超过5年。
The validity period of the People's Republic of China Seafarer's Passport shall not exceed 5 years.
持有中华人民共和国海员证的船员，在其他国家、地区享有按照当地法律、有关国际条约以及中华人民共和国与有关国家签订的海运或者航运协定规定的权利和通行便利。
Seafarers holding the People's Republic of China Seafarer's Passport shall enjoy the rights and transit facilities stipulated by local laws, relevant international treaties, and the maritime or shipping agreements signed between the People's Republic of China and the relevant countries in other countries or regions.
在中国籍船舶上工作的外国籍船员，应当依照法律、行政法规和国家其他有关规定取得就业许可，并持有国务院交通主管部门规定的相应证书和其所属国政府签发的相关身份证件。
Foreign seafarers working on Chinese vessels shall obtain employment permits in accordance with laws, administrative regulations, and other relevant provisions of the state, and hold the corresponding certificates prescribed by the competent transport department of the State Council and relevant identity documents issued by their home country governments.
在中华人民共和国管辖水域航行、停泊、作业的外国籍船舶上任职的外国籍船员，应当持有中华人民共和国缔结或者加入的国际条约规定的相应证书和其所属国政府签发的相关身份证件。
Foreign seafarers serving on foreign vessels navigating, mooring, or operating in the waters under the jurisdiction of the People's Republic of China shall hold the corresponding certificates prescribed by international treaties concluded or acceded to by the People's Republic of China and relevant identity documents issued by their home country governments.
船员职责
Seafarer Duties
船员在船工作期间，应当符合下列要求：
During the period of service on board, seafarers shall meet the following requirements:
(一)携带本条例规定的有效证件；
(1) Carry valid certificates as prescribed in these Regulations;
(二)掌握船舶的适航状况和航线的通航保障情况，以及有关航区气象、海况等必要的信息；
(2) Be aware of the ship's seaworthiness, navigational support conditions of the route, and necessary information such as weather and sea conditions in the relevant navigation area;
(三)遵守船舶的管理制度和值班规定，按照水上交通安全和防治船舶污染的操作规则操纵、控制和管理船舶，如实填写有关船舶法定文书，不得隐匿、篡改或者销毁有关船舶法定证书、文书；
(3) Comply with the ship's management system and watchkeeping regulations, operate, control and manage the ship in accordance with the operational rules for maritime traffic safety and prevention of ship pollution, truthfully fill in relevant ship statutory documents, and shall not conceal, alter or destroy relevant ship statutory certificates and documents;
(四)参加船舶应急训练、演习，按照船舶应急部署的要求，落实各项应急预防措施；
(4) Participate in ship emergency training and drills, and implement various emergency prevention measures in accordance with the requirements of the ship's emergency deployment plan;
(五)遵守船舶报告制度，发现或者发生险情、事故、保安事件或者影响航行安全的情况，应当及时报告；
(5) Comply with the ship reporting system, and promptly report when discovering or encountering dangers, accidents, security incidents, or situations affecting navigation safety;
(六)在不严重危及自身安全的情况下，尽力救助遇险人员；
(6) Make every effort to rescue persons in distress without seriously endangering their own safety;
(七)不得利用船舶私载旅客、货物，不得携带违禁物品。
(7) Shall not use the ship to privately carry passengers or cargo, nor carry prohibited articles.
船长在其职权范围内发布的命令，船舶上所有人员必须执行。
All persons on board must execute orders issued by the master within the scope of his authority.
高级船员应当组织下属船员执行船长命令，督促下属船员履行职责。
Senior officers shall organize subordinate crew members to execute the master's orders and supervise subordinate crew members in performing their duties.
船长管理和指挥船舶时，应当符合下列要求：
When managing and commanding the ship, the master shall meet the following requirements:
(一)保证船舶和船员携带符合法定要求的证书、文书以及有关航行资料；
(1) Ensure that the ship and crew carry certificates, documents, and relevant navigational information that meet statutory requirements;
(二)制订船舶应急计划并保证其有效实施；
(2) Formulate the ship's emergency plan and ensure its effective implementation;
(三)保证船舶和船员在开航时处于适航、适任状态，按照规定保障船舶的最低安全配员，保证船舶的正常值班；
(3) Ensure that the ship and crew are in a seaworthy and competent condition at the time of departure, guarantee the minimum safe manning of the ship in accordance with regulations, and ensure normal watchkeeping on board;
(四)执行海事管理机构有关水上交通安全和防治船舶污染的指令，船舶发生水上交通事故或者污染事故的，向海事管理机构提交事故报告；
(4) Execute the instructions of the maritime administrative agency concerning maritime traffic safety and prevention of ship-source pollution; in the event of a maritime traffic accident or pollution accident, submit an accident report to the maritime administrative agency;
(五)对本船船员进行日常训练和考核，在本船船员的船员服务簿内如实记载船员的履职情况；
(5) Conduct daily training and assessment of the ship's crew, and truthfully record the crew's performance of duties in their seaman's service book;
(六)船舶进港、出港、靠泊、离泊，通过交通密集区、危险航区等区域，或者遇有恶劣天气和海况，或者发生水上交通事故、船舶污染事故、船舶保安事件以及其他紧急情况时，应当在驾驶台值班，必要时应当直接指挥船舶；
(6) When the ship enters or leaves port, berths or unberths, passes through areas such as heavy traffic zones or dangerous navigation areas, or encounters severe weather and sea conditions, or in the event of a maritime traffic accident, ship pollution accident, ship security incident, or other emergency situations, the master shall be on duty on the bridge and, if necessary, directly command the ship;
(七)保障船舶上人员和临时上船人员的安全；
(7) Ensure the safety of persons on board and persons temporarily boarding the ship;
(八)船舶发生事故，危及船舶上人员和财产安全时，应当组织船员和船舶上其他人员尽力施救；
(8) In the event of a ship accident endangering the safety of persons and property on board, organize the crew and other persons on board to make every effort to rescue;
(九)弃船时，应当采取一切措施，首先组织旅客安全离船，然后安排船员离船，船长应当最后离船，在离船前，船长应当指挥船员尽力抢救航海日志、机舱日志、油类记录簿、无线电台日志、本航次使用过的航行图和文件，以及贵重物品、邮件和现金。
(9) When abandoning ship, take all measures to first organize the safe disembarkation of passengers, then arrange for the crew to disembark; the master shall be the last to leave the ship. Before leaving the ship, the master shall direct the crew to make every effort to salvage the deck log, engine room log, oil record book, radio log, navigational charts and documents used during the current voyage, as well as valuable items, mail, and cash.
船长、高级船员在航次中，不得擅自辞职、离职或者中止职务。
The master and senior officers shall not resign, leave their posts, or suspend their duties during a voyage.
船长在保障水上人身与财产安全、船舶保安、防治船舶污染水域方面，具有独立决定权，并负有最终责任。
The shipmaster has independent decision-making power and bears ultimate responsibility for ensuring the safety of human life and property on water, ship security, and prevention of water pollution.
船长为履行职责，可以行使下列权力：
In performing duties, the shipmaster may exercise the following powers:
(一)决定船舶的航次计划，对不具备船舶安全航行条件的，可以拒绝开航或者续航；
(1) Decide the voyage plan of the ship; if conditions for safe navigation are not met, may refuse to depart or continue the voyage;
(二)对船员用人单位或者船舶所有人下达的违法指令，或者可能危及有关人员、财产和船舶安全或者可能造成水域环境污染的指令，可以拒绝执行；
(2) Refuse to execute illegal orders issued by the crew employer or shipowner, or orders that may endanger relevant personnel, property, or ship safety, or may cause water environment pollution;
(三)发现引航员的操纵指令可能对船舶航行安全构成威胁或者可能造成水域环境污染时，应当及时纠正、制止，必要时可以要求更换引航员；
(3) When discovering that a pilot's maneuvering instructions may threaten the safety of ship navigation or may cause water environment pollution, shall promptly correct and stop them, and if necessary, may request a replacement pilot;
(四)当船舶遇险并严重危及船舶上人员的生命安全时，船长可以决定撤离船舶；
(4) When the ship is in distress and seriously endangers the safety of persons on board, the shipmaster may decide to evacuate the ship;
(五)在船舶的沉没、毁灭不可避免的情况下，船长可以决定弃船，但是，除紧急情况外，应当报经船舶所有人同意；
(5) When the sinking or destruction of the ship is unavoidable, the shipmaster may decide to abandon the ship; however, except in emergency situations, the consent of the shipowner shall be obtained;
(六)对不称职的船员，可以责令其离岗。
(6) Order incompetent crew members to leave their posts.
船舶在海上航行时，船长为保障船舶上人员和船舶的安全，可以依照法律的规定对在船舶上进行违法、犯罪活动的人采取禁闭或者其他必要措施。
When the ship is navigating at sea, the shipmaster may, in order to ensure the safety of persons and the ship on board, take confinement or other necessary measures against persons engaged in illegal or criminal activities on board in accordance with the provisions of the law.
船员职业保障
Occupational Protection of Seafarers
船员用人单位和船员应当按照国家有关规定参加工伤保险、医疗保险、养老保险、失业保险以及其他社会保险，并依法按时足额缴纳各项保险费用。
Seafarer employers and seafarers shall participate in work-related injury insurance, medical insurance, old-age insurance, unemployment insurance, and other social insurance in accordance with national regulations, and shall pay all insurance premiums in full and on time according to law.
船员用人单位应当为在驶往或者驶经战区、疫区或者运输有毒、有害物质的船舶上工作的船员，办理专门的人身、健康保险，并提供相应的防护措施。
Seafarer employers shall arrange special personal and health insurance for seafarers working on ships sailing to or through war zones, epidemic areas, or transporting toxic or hazardous substances, and shall provide corresponding protective measures.
船舶上船员生活和工作的场所，应当符合国家船舶检验规范中有关船员生活环境、作业安全和防护的要求。
The living and working spaces for seafarers on ships shall meet the requirements of national ship inspection specifications concerning the living environment, operational safety, and protection of seafarers.
船员用人单位应当为船员提供必要的生活用品、防护用品、医疗用品，建立船员健康档案，并为船员定期进行健康检查，防治职业疾病。
Seafarer employers shall provide seafarers with necessary daily necessities, protective equipment, and medical supplies, establish health records for seafarers, conduct regular health examinations, and prevent occupational diseases.
船员在船工作期间患病或者受伤的，船员用人单位应当及时给予救治；船员失踪或者死亡的，船员用人单位应当及时做好相应的善后工作。
If a seafarer falls ill or is injured during work on board, the seafarer employer shall provide timely medical treatment; if a seafarer goes missing or dies, the seafarer employer shall promptly handle the corresponding aftermath.
船员用人单位应当依照有关劳动合同的法律、法规和中华人民共和国缔结或者加入的有关船员劳动与社会保障国际条约的规定，与船员订立劳动合同。
Seafarer employers shall conclude labor contracts with seafarers in accordance with relevant labor contract laws and regulations and the provisions of international treaties on seafarer labor and social security that the People's Republic of China has concluded or acceded to.
船员用人单位不得招用未取得本条例规定证件的人员上船工作。
Seafarer employers shall not recruit persons who have not obtained the certificates required by these Regulations to work on board.
船员工会组织应当加强对船员合法权益的保护，指导、帮助船员与船员用人单位订立劳动合同。
Seafarer trade union organizations shall strengthen the protection of the legitimate rights and interests of seafarers, and guide and assist seafarers in concluding labor contracts with seafarer employers.
船员用人单位应当根据船员职业的风险性、艰苦性、流动性等因素，向船员支付合理的工资，并按时足额发放给船员。任何单位和个人不得克扣船员的工资。
Seafarer employers shall pay seafarers reasonable wages based on factors such as the risk, hardship, and mobility of the seafarer profession, and shall pay them in full and on time. No unit or individual may deduct seafarers' wages.
船员用人单位应当向在劳动合同有效期内的待派船员，支付不低于船员用人单位所在地人民政府公布的最低工资。
Seafarer employers shall pay seafarers who are awaiting assignment during the validity period of the labor contract no less than the minimum wage published by the local people's government where the seafarer employer is located.
船员在船工作时间应当符合国务院交通主管部门规定的标准，不得疲劳值班。
The working hours of a seafarer on board a ship shall comply with the standards prescribed by the competent transport department of the State Council, and no seafarer shall be on duty while fatigued.
船员除享有国家法定节假日的假期外，还享有在船舶上每工作2个月不少于5日的年休假。
In addition to the holidays prescribed by the state, a seafarer shall be entitled to an annual leave of not less than 5 days for every 2 months of work on board a ship.
船员用人单位应当在船员年休假期间，向其支付不低于该船员在船工作期间平均工资的报酬。
The seafarer's employer shall, during the seafarer's annual leave, pay the seafarer remuneration not less than the average wage of the seafarer during the period of work on board the ship.
船员在船工作期间，有下列情形之一的，可以要求遣返：
During the period of work on board a ship, a seafarer may request repatriation under any of the following circumstances:
(一)船员的劳动合同终止或者依法解除的；
(1) The seafarer's labor contract is terminated or lawfully dissolved;
(二)船员不具备履行船上岗位职责能力的；
(2) The seafarer is no longer capable of performing the duties of the position on board;
(三)船舶灭失的；
(3) The ship is lost;
(四)未经船员同意，船舶驶往战区、疫区的；
(4) The ship sails to a war zone or epidemic area without the seafarer's consent;
(五)由于破产、变卖船舶、改变船舶登记或者其他原因，船员用人单位、船舶所有人不能继续履行对船员的法定或者约定义务的。
(5) Due to bankruptcy, sale of the ship, change of ship registration, or other reasons, the seafarer's employer or shipowner is unable to continue fulfilling statutory or contractual obligations to the seafarer.
船员可以从下列地点中选择遣返地点：
A seafarer may choose a repatriation location from the following:
(一)船员接受招用的地点或者上船任职的地点；
(1) The place where the seafarer is recruited or the place where the seafarer boards the ship for duty;
(二)船员的居住地、户籍所在地或者船籍登记国；
(2) The seafarer's place of residence, place of household registration, or the country of ship registration;
(三)船员与船员用人单位或者船舶所有人约定的地点。
(3) The place agreed upon by the seafarer and the seafarer's employer or the shipowner.
船员的遣返费用由船员用人单位支付。遣返费用包括船员乘坐交通工具的费用、旅途中合理的食宿及医疗费用和30公斤行李的运输费用。
The repatriation costs of a seafarer shall be paid by the seafarer's employer. Repatriation costs include the seafarer's transportation expenses, reasonable accommodation and medical expenses during the journey, and the transport costs of 30 kilograms of luggage.
船员的遣返权利受到侵害的，船员当时所在地民政部门或者中华人民共和国驻境外领事机构，应当向船员提供援助；必要时，可以直接安排船员遣返。民政部门或者中华人民共和国驻境外领事机构为船员遣返所垫付的费用，船员用人单位应当及时返还。
If a seafarer's right to repatriation is infringed, the civil affairs department at the seafarer's current location or the consular office of the People's Republic of China abroad shall provide assistance to the seafarer; if necessary, they may directly arrange for the seafarer's repatriation. The expenses advanced by the civil affairs department or the consular office of the People's Republic of China abroad for the seafarer's repatriation shall be promptly reimbursed by the seafarer's employer.

Seafarer Training and Seafarer Services
申请在船舶上工作的船员，应当按照国务院交通主管部门的规定，完成相应的船员基本安全培训、船员适任培训。
Seafarers applying to work on a ship shall complete the corresponding basic safety training and competency training for seafarers in accordance with the provisions of the competent transport department of the State Council.
在危险品船、客船等特殊船舶上工作的船员，还应当完成相应的特殊培训。
Seafarers working on special ships such as dangerous goods ships and passenger ships shall also complete the corresponding special training.
依法设立的培训机构从事船员培训，应当符合下列条件：
Training institutions established in accordance with the law that engage in seafarer training shall meet the following conditions:
(一)有符合船员培训要求的场地、设施和设备；
(1) Having premises, facilities, and equipment that meet the requirements for seafarer training;
(二)有与船员培训相适应的教学人员、管理人员；
(2) Have teaching and management personnel suitable for seafarer training;
(三)有健全的船员培训管理制度、安全防护制度；
(3) Have a sound seafarer training management system and safety protection system;
(四)有符合国务院交通主管部门规定的船员培训质量控制体系。
(4) Have a seafarer training quality control system that meets the requirements of the competent transport department of the State Council.
依法设立的培训机构从事船员培训业务，应当向国家海事管理机构提出申请，并附送符合本条例第三十二条规定条件的证明材料。
A training institution established according to law that engages in seafarer training shall apply to the national maritime administration and attach the supporting materials that meet the conditions specified in Article 32 of these Regulations.
国家海事管理机构应当自受理申请之日起30日内，做出批准或者不予批准的决定。予以批准的，发给船员培训许可证；不予批准的，书面通知申请人并说明理由。
The national maritime administration shall make a decision to approve or disapprove within 30 days from the date of accepting the application. If approved, a seafarer training permit shall be issued; if not approved, the applicant shall be notified in writing and the reasons shall be stated.
从事船员培训业务的机构，应当按照国务院交通主管部门规定的船员培训大纲和水上交通安全、防治船舶污染、船舶保安等要求，在核定的范围内开展船员培训，确保船员培训质量。
An institution engaged in seafarer training shall carry out seafarer training within the approved scope in accordance with the seafarer training syllabus prescribed by the competent transport department of the State Council and the requirements for maritime traffic safety, prevention of pollution from ships, and ship security, ensuring the quality of seafarer training.
从事向中国籍船舶派遣船员业务的机构，应当按照《中华人民共和国劳动合同法》的规定取得劳务派遣许可。
An institution engaged in dispatching seafarers to Chinese-flagged ships shall obtain a labor dispatch permit in accordance with the provisions of the Labor Contract Law of the People's Republic of China.
从事代理船员办理申请培训、考试、申领证书(包括外国海洋船舶船员证书)等有关手续，代理船员用人单位管理船员事务，提供船舶配员等船员服务业务的机构(以下简称船员服务机构)应当建立船员档案，加强船舶配员管理，掌握船员的培训、任职资历、安全记录、健康状况等情况并将上述情况定期报监管机构备案。关于船员劳务派遣业务的信息报劳动保障行政部门备案，关于其他业务的信息报海事管理机构备案。
An institution engaged in providing seafarer services, such as handling procedures for seafarers' applications for training, examinations, and certificate issuance (including foreign ocean-going ship seafarer certificates), managing seafarer affairs on behalf of seafarer employers, and providing ship manning (hereinafter referred to as seafarer service agency), shall establish seafarer files, strengthen ship manning management, keep track of seafarers' training, service history, safety records, health status, and other information, and regularly report the above information to the regulatory authority for record. Information on seafarer labor dispatch business shall be reported to the labor and social security administrative department for record, and information on other business shall be reported to the maritime administrative agency for record.
船员用人单位直接招用船员的，应当遵守前款的规定。
If a seafarer employer directly employs seafarers, it shall comply with the provisions of the preceding paragraph.
船员服务机构应当向社会公布服务项目和收费标准。
A seafarer service agency shall publicly disclose its service items and fee standards to the public.
船员服务机构为船员提供服务，应当诚实守信，不得提供虚假信息，不得损害船员的合法权益。
Seafarer service agencies shall provide services to seafarers in good faith, shall not provide false information, and shall not harm the lawful rights and interests of seafarers.
船员服务机构为船员用人单位提供船舶配员服务，应当按照相关法律、行政法规的规定订立合同。
Seafarer service agencies providing crew manning services to seafarer employers shall conclude contracts in accordance with relevant laws and administrative regulations.
船员服务机构为船员用人单位提供的船员受伤、失踪或者死亡的，船员服务机构应当配合船员用人单位做好善后工作。
If a seafarer provided by a seafarer service agency to a seafarer employer is injured, missing, or dies, the seafarer service agency shall cooperate with the seafarer employer in handling the aftermath.
监督检查
Supervision and Inspection
海事管理机构应当建立健全船员管理的监督检查制度，重点加强对船员注册、任职资格、履行职责、安全记录，船员培训机构培训质量，船员服务机构诚实守信以及船员用人单位保护船员合法权益等情况的监督检查，督促船员用人单位、船舶所有人以及相关的机构建立健全船员在船舶上的人身安全、卫生、健康和劳动安全保障制度，落实相应的保障措施。
Maritime administrative agencies shall establish and improve the supervision and inspection system for seafarer management, focusing on strengthening the supervision and inspection of seafarer registration, qualification for positions, performance of duties, safety records, training quality of seafarer training institutions, good faith of seafarer service agencies, and protection of seafarers' lawful rights and interests by seafarer employers, and urge seafarer employers, shipowners, and relevant institutions to establish and improve systems for the personal safety, hygiene, health, and labor safety of seafarers on board ships, and implement corresponding safeguard measures.
海事管理机构对船员实施监督检查时，应当查验船员必须携带的证件的有效性，检查船员履行职责的情况，必要时可以进行现场考核。
When conducting supervision and inspection of seafarers, maritime administrative agencies shall verify the validity of the documents that seafarers must carry, inspect the performance of their duties, and may conduct on-site assessments when necessary.
依照本条例的规定，取得船员适任证书、中华人民共和国海员证的船员以及取得从事船员培训业务许可的机构，不再具备规定条件的，由海事管理机构责令限期改正；拒不改正或者无法改正的，海事管理机构应当撤销相应的行政许可决定，并依法办理有关行政许可的注销手续。
If seafarers who have obtained seafarer competency certificates or Seaman's Books of the People's Republic of China, or institutions that have obtained permission to engage in seafarer training business, no longer meet the prescribed conditions, the maritime administrative agency shall order them to rectify within a time limit; if they refuse to rectify or cannot rectify, the maritime administrative agency shall revoke the corresponding administrative permission decision and handle the cancellation procedures for the relevant administrative permission in accordance with the law.
海事管理机构对有违反水上交通安全和防治船舶污染水域法律、行政法规行为的船员，除依法给予行政处罚外，实行累计记分制度。海事管理机构对累计记分达到规定分值的船员，应当扣留船员适任证书，责令其参加水上交通安全、防治船舶污染等有关法律、行政法规的培训并进行相应的考试；考试合格的，发还其船员适任证书。
For seafarers who violate laws and administrative regulations on water traffic safety and prevention of ship-source pollution, maritime administrative agencies shall, in addition to imposing administrative penalties according to law, implement a cumulative demerit point system. For seafarers whose cumulative demerit points reach a specified value, the maritime administrative agency shall detain their seafarer competency certificate, order them to participate in training on relevant laws and administrative regulations such as water traffic safety and prevention of ship-source pollution, and take corresponding examinations; if they pass the examinations, their seafarer competency certificate shall be returned.
船舶违反本条例和有关法律、行政法规规定的，海事管理机构应当责令限期改正；在规定期限内未能改正的，海事管理机构可以禁止船舶离港或者限制船舶航行、停泊、作业。
If a ship violates the provisions of these Regulations and relevant laws and administrative regulations, the maritime administrative agency shall order it to rectify within a time limit; if it fails to rectify within the specified time limit, the maritime administrative agency may prohibit the ship from leaving port or restrict the ship's navigation, berthing, or operations.
海事管理机构实施监督检查时，应当有2名以上执法人员参加，并出示有效的执法证件。
When conducting supervision and inspection, maritime administrative agencies shall have at least two law enforcement personnel participating and present valid law enforcement documents.
海事管理机构实施监督检查，可以询问当事人，向有关单位或者个人了解情况，查阅、复制有关资料，并保守被调查单位或者个人的商业秘密。
When carrying out supervision and inspection, the maritime administrative agency may question the parties concerned, inquire about the situation from relevant entities or individuals, consult and copy relevant materials, and keep confidential the business secrets of the investigated entities or individuals.
接受海事管理机构监督检查的有关单位或者个人，应当如实提供有关资料或者情况。
The relevant entities or individuals subject to supervision and inspection by the maritime administrative agency shall truthfully provide relevant materials or information.
海事管理机构应当公开管理事项、办事程序、举报电话号码、通信地址、电子邮件信箱等信息，自觉接受社会的监督。
The maritime administrative agency shall disclose management matters, procedures, complaint telephone numbers, correspondence addresses, email addresses, and other information, and consciously accept social supervision.
劳动保障行政部门应当加强对船员用人单位遵守劳动和社会保障的法律、法规和国家其他有关规定情况的监督检查。
The labor security administrative department shall strengthen supervision and inspection of the compliance of seaman employers with labor and social security laws, regulations, and other relevant provisions of the state.
海事管理机构在日常监管中发现船员用人单位或者船员服务机构存在违反劳动和社会保障法律、行政法规规定的行为的，应当及时通报劳动保障行政部门。
If, during daily supervision, the maritime administrative agency discovers that a seaman employer or seaman service agency has violated labor and social security laws or administrative regulations, it shall promptly notify the labor security administrative department.
法律责任
Legal Liability
违反本条例的规定，以欺骗、贿赂等不正当手段取得船员适任证书、船员培训合格证书、中华人民共和国海员证的，由海事管理机构吊销有关证件，并处2000元以上2万元以下罚款。
In violation of these Regulations, if a seaman's certificate of competency, seaman's training certificate, or People's Republic of China Seaman's Book is obtained by improper means such as fraud or bribery, the maritime administrative agency shall revoke the relevant certificate and impose a fine of not less than 2,000 yuan but not more than 20,000 yuan.
违反本条例的规定，伪造、变造或者买卖船员服务簿、船员培训合格证书、中华人民共和国海员证的，由海事管理机构收缴有关证件，处2万元以上10万元以下罚款，有违法所得的，还应当没收违法所得。
In violation of these Regulations, if a seaman's service record, seaman's training certificate, or People's Republic of China Seaman's Book is forged, altered, or bought/sold, the maritime administrative agency shall confiscate the relevant certificate, impose a fine of not less than 20,000 yuan but not more than 100,000 yuan, and if there is illegal income, the illegal income shall also be confiscated.
违反本条例的规定，船员服务簿记载的事项发生变更，船员未办理变更手续的，由海事管理机构责令改正，可以处1000元以下罚款。
In violation of these Regulations, if the items recorded in the seaman's service record have changed and the seaman has not gone through the alteration procedures, the maritime administrative agency shall order correction and may impose a fine of not more than 1,000 yuan.
违反本条例的规定，船员有下列情形之一的，由海事管理机构处1000元以上1万元以下罚款；情节严重的，并给予暂扣船员适任证书6个月以上2年以下直至吊销船员适任证书的处罚：
In violation of these Regulations, if a seaman falls under any of the following circumstances, the maritime administrative agency shall impose a fine of not less than 1,000 yuan but not more than 10,000 yuan; if the circumstances are serious, the seaman's certificate of competency shall be suspended for not less than six months but not more than two years, or even revoked.
(一)未遵守值班规定擅自离开工作岗位的；
(1) Leaving the post without authorization in violation of watchkeeping regulations;
(二)未按照水上交通安全和防治船舶污染操作规则操纵、控制和管理船舶的；
(2) Failing to operate, control, and manage the ship in accordance with water traffic safety and ship pollution prevention operational rules;
(三)发现或者发生险情、事故、保安事件或者影响航行安全的情况未及时报告的；
(3) Failing to promptly report the discovery or occurrence of a danger, accident, security incident, or situation affecting navigation safety;
(四)未如实填写或者记载有关船舶、船员法定文书的；
(4) Failing to truthfully fill in or record statutory documents concerning the ship or seamen;
(五)隐匿、篡改或者销毁有关船舶、船员法定证书、文书的；
(5) Concealing, altering, or destroying statutory certificates or documents concerning the ship or seamen;
(六)不依法履行救助义务或者肇事逃逸的；
(6) Failing to perform rescue duties according to law or fleeing after causing an accident;
(七)利用船舶私载旅客、货物或者携带违禁物品的。
(7) Using the ship to privately carry passengers, cargo, or transport prohibited articles.
违反本条例的规定，船长有下列情形之一的，由海事管理机构处2000元以上2万元以下罚款；情节严重的，并给予暂扣船员适任证书6个月以上2年以下直至吊销船员适任证书的处罚：
In violation of these Regulations, if a master has any of the following circumstances, the maritime administrative agency shall impose a fine of not less than 2,000 yuan but not more than 20,000 yuan; if the circumstances are serious, the master's seaman's certificate of competency shall be suspended for not less than 6 months but not more than 2 years, or even revoked:
(一)未保证船舶和船员携带符合法定要求的文书以及有关航行资料的；
(1) Failing to ensure that the ship and seamen carry statutory documents and relevant navigation materials;
(二)未保证船舶和船员在开航时处于适航、适任状态，或者未按照规定保障船舶的最低安全配员，或者未保证船舶的正常值班的；
(2) Failing to ensure that the ship and seamen are in a seaworthy and competent condition at the time of departure, or failing to ensure the minimum safe manning of the ship in accordance with regulations, or failing to ensure normal watchkeeping on the ship;
(三)未在船员服务簿内如实记载船员的履职情况的；
(3) Failing to truthfully record the seaman's performance of duties in the seaman's service record book;
(四)船舶进港、出港、靠泊、离泊，通过交通密集区、危险航区等区域，或者遇有恶劣天气和海况，或者发生水上交通事故、船舶污染事故、船舶保安事件以及其他紧急情况时，未在驾驶台值班的；
(4) Failing to stand watch on the bridge when the ship enters or leaves port, berths, unberths, passes through areas with heavy traffic, dangerous navigation areas, or encounters severe weather and sea conditions, or when a maritime traffic accident, ship pollution accident, ship security incident, or other emergency occurs;
(五)在弃船或者撤离船舶时未最后离船的。
(5) Failing to be the last to leave the ship when abandoning or evacuating the ship.
船员适任证书被吊销的，自被吊销之日起2年内，不得申请船员适任证书。
If a seaman's certificate of competency is revoked, the seaman shall not apply for a certificate of competency within two years from the date of revocation.
违反本条例的规定，船员用人单位、船舶所有人有下列行为之一的，由海事管理机构责令改正，处3万元以上15万元以下罚款：
In violation of these Regulations, if a seaman employer or shipowner commits any of the following acts, the maritime administrative agency shall order correction and impose a fine of not less than 30,000 yuan but not more than 150,000 yuan:
(一)中国籍船舶擅自招用外国籍船员担任船长的；
(1) A Chinese-flagged ship employs a foreign seaman as captain without authorization;
(二)船员在船舶上生活和工作的场所不符合国家船舶检验规范中有关船员生活环境、作业安全和防护要求的；
(2) The seaman's living and working spaces on board do not meet the national ship inspection specifications regarding the seaman's living environment, operational safety, and protection requirements;
(三)不履行遣返义务的；
(3) Failing to fulfill the repatriation obligation;
(四)船员在船工作期间患病或者受伤，未及时给予救治的。
(4) Failing to provide timely medical treatment when a seaman falls ill or is injured during the period of service on board.
违反本条例的规定，未取得船员培训许可证擅自从事船员培训的，由海事管理机构责令改正，处5万元以上25万元以下罚款，有违法所得的，还应当没收违法所得。
In violation of these Regulations, if a person engages in seaman training without obtaining a seaman training license, the maritime administrative agency shall order correction and impose a fine of not less than 50,000 yuan but not more than 250,000 yuan; if there is illegal income, the illegal income shall also be confiscated.
违反本条例的规定，船员培训机构不按照国务院交通主管部门规定的培训大纲和水上交通安全、防治船舶污染等要求，进行培训的，由海事管理机构责令改正，可以处2万元以上10万元以下罚款；情节严重的，给予暂扣船员培训许可证6个月以上2年以下直至吊销船员培训许可证的处罚。
In violation of the provisions of these Regulations, if a seaman training institution fails to conduct training in accordance with the training syllabus prescribed by the competent transport department under the State Council and the requirements for water traffic safety and prevention of ship pollution, the maritime administration agency shall order correction and may impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; if the circumstances are serious, the penalty of suspending the seaman training license for not less than six months but not more than two years or even revoking the seaman training license shall be imposed.
违反本条例的规定，船员服务机构和船员用人单位未将其招用或者管理的船员的有关情况定期报海事管理机构或者劳动保障行政部门备案的，由海事管理机构或者劳动保障行政部门责令改正，处5000元以上2万元以下罚款。
In violation of the provisions of these Regulations, if a seaman service agency or seaman employer fails to periodically report the relevant information of the seamen it employs or manages to the maritime administration agency or the labor and social security administrative department for record, the maritime administration agency or the labor and social security administrative department shall order correction and impose a fine of not less than 5,000 yuan but not more than 20,000 yuan.
违反本条例的规定，船员服务机构在提供船员服务时，提供虚假信息，欺诈船员的，由海事管理机构或者劳动保障行政部门依据职责责令改正，处3万元以上15万元以下罚款；情节严重的，并给予暂停船员服务6个月以上2年以下直至吊销相关业务经营许可的处罚。
In violation of the provisions of these Regulations, if a seaman service agency provides false information or defrauds seamen when providing seaman services, the maritime administration agency or the labor and social security administrative department shall, within its respective functions and duties, order correction and impose a fine of not less than 30,000 yuan but not more than 150,000 yuan; if the circumstances are serious, the penalty of suspending seaman services for not less than six months but not more than two years or even revoking the relevant business operation license shall be imposed.
违反本条例规定，船员服务机构从事船员劳务派遣业务时未依法与相关劳动者或者船员用人单位订立合同的，由劳动保障行政部门按照相关劳动法律、行政法规的规定处罚。
In violation of the provisions of these Regulations, if a seaman service agency fails to conclude a contract with the relevant worker or seaman employer in accordance with the law when engaging in seaman labor dispatch business, the labor and social security administrative department shall impose penalties in accordance with the provisions of relevant labor laws and administrative regulations.
海事管理机构工作人员有下列情形之一的，依法给予处分：
If a staff member of the maritime administration agency falls under any of the following circumstances, disciplinary action shall be taken in accordance with the law:
(一)违反规定签发船员适任证书、中华人民共和国海员证，或者违反规定批准船员培训机构从事相关活动的；
(1) Issuing a seaman's certificate of competency or a Seaman's Book of the People's Republic of China in violation of regulations, or approving a seaman training institution to engage in relevant activities in violation of regulations;
(二)不依法履行监督检查职责的；
(2) Failing to perform supervision and inspection duties in accordance with the law;
(三)不依法实施行政强制或者行政处罚的；
(3) Failing to implement administrative compulsion or administrative penalties in accordance with the law;
(四)滥用职权、玩忽职守的其他行为。
(4) Other acts of abuse of power or dereliction of duty.
违反本条例的规定，情节严重，构成犯罪的，依法追究刑事责任。
In violation of the provisions of these Regulations, if the circumstances are serious and constitute a crime, criminal liability shall be investigated in accordance with the law.
附 则
Supplementary Provisions
申请参加取得船员适任证书考试，应当按照国家有关规定交纳考试费用。
Those who apply to take the examination for obtaining a seaman's competency certificate shall pay the examination fees in accordance with the relevant provisions of the state.
引航员的培训依照本条例有关船员培训的规定执行。引航员管理的具体办法由国务院交通主管部门制订。
The training of pilots shall be carried out in accordance with the provisions of these Regulations on seaman training. The specific measures for the administration of pilots shall be formulated by the competent department of transportation under the State Council.
军用船舶船员的管理，按照国家和军队有关规定执行。
The management of crew members of military vessels shall be carried out in accordance with the relevant provisions of the state and the military.
渔业船员的管理由国务院渔业行政主管部门负责，具体管理办法由国务院渔业行政主管部门参照本条例另行规定。
The management of fishery crew members shall be the responsibility of the competent department of fisheries administration under the State Council, and the specific management measures shall be separately formulated by the competent department of fisheries administration under the State Council with reference to these Regulations.
除本条例对船员用人单位及船员的劳动和社会保障有特别规定外，船员用人单位及船员应当执行有关劳动和社会保障的法律、行政法规以及国家有关规定。
Except for the special provisions of these Regulations on the labor and social security of seaman employers and seamen, seaman employers and seamen shall implement the laws, administrative regulations, and relevant provisions of the state on labor and social security.
船员专业技术职称的取得和专业技术职务的聘任工作，按照国家有关规定实施。
The acquisition of professional technical titles and the appointment of professional technical positions for seamen shall be implemented in accordance with the relevant provisions of the state.
本条例自2007年9月1日起施行。
These Regulations shall come into force as of September 1, 2007.
