Regulations of the People's Republic of China on Civil Aviation Security

(Issued by Decree No. 201 of the State Council of the People's Republic of China on July 6, 1996, and revised in accordance with the Decision of the State Council on Repealing and Amending Certain Administrative Regulations on January 8, 2011)

为了防止对民用航空活动的非法干扰，维护民用航空秩序，保障民用航空安全，制定本条例。

These regulations are formulated to prevent unlawful interference with civil aviation activities, maintain civil aviation order, and ensure civil aviation safety.

本条例适用于在中华人民共和国领域内的一切民用航空活动以及与民用航空活动有关的单位和个人。

These regulations apply to all civil aviation activities within the territory of the People's Republic of China and to units and individuals involved in civil aviation activities.

在中华人民共和国领域外从事民用航空活动的具有中华人民共和国国籍的民用航空器适用本条例；但是，中华人民共和国缔结或者参加的国际条约另有规定的除外。

These regulations apply to civil aircraft with the nationality of the People's Republic of China engaged in civil aviation activities outside the territory of the People's Republic of China, unless otherwise provided by international treaties concluded or acceded to by the People's Republic of China.

民用航空安全保卫工作实行统一管理、分工负责的原则。

Civil aviation security work shall follow the principle of unified management and division of responsibilities.

民用航空公安机关(以下简称民航公安机关)负责对民用航空安全保卫工作实施统一管理、检查和监督。

The civil aviation public security organs (hereinafter referred to as civil aviation public security organs) are responsible for unified management, inspection, and supervision of civil aviation security work.

有关地方人民政府与民用航空单位应当密切配合，共同维护民用航空安全。

Relevant local people's governments and civil aviation units shall closely cooperate to jointly maintain civil aviation safety.

旅客、货物托运人和收货人以及其他进入机场的人员，应当遵守民用航空安全管理的法律、法规和规章。

Passengers, cargo consignors and consignees, and other persons entering the airport shall comply with laws, regulations, and rules on civil aviation safety management.

民用机场经营人和民用航空器经营人应当履行下列职责：

Civil airport operators and civil aircraft operators shall perform the following duties:

(一)制定本单位民用航空安全保卫方案，并报国务院民用航空主管部门备案；

(1) Formulate the unit's civil aviation security program and report it to the civil aviation authority of the State Council for record;

(二)严格实行有关民用航空安全保卫的措施；

(2) Strictly implement relevant civil aviation security measures;

(三)定期进行民用航空安全保卫训练，及时消除危及民用航空安全的隐患。

(3) Conduct regular civil aviation security training and promptly eliminate hazards that endanger civil aviation safety.

与中华人民共和国通航的外国民用航空企业，应当向国务院民用航空主管部门报送民用航空安全保卫方案。

Foreign civil aviation enterprises operating flights to and from China shall submit their civil aviation security program to the civil aviation authority of the State Council.

公民有权向民航公安机关举报预谋劫持、破坏民用航空器或者其他危害民用航空安全的行为。

Citizens have the right to report to the civil aviation public security organs any planned hijacking, destruction of civil aircraft, or other acts endangering civil aviation safety.

对维护民用航空安全做出突出贡献的单位或者个人，由有关人民政府或者国务院民用航空主管部门给予奖励。

Units or individuals that make outstanding contributions to maintaining civil aviation safety shall be rewarded by the relevant people's government or the civil aviation authority of the State Council.

民用机场(包括军民合用机场中的民用部分，下同)的新建、改建或者扩建，应当符合国务院民用航空主管部门关于民用机场安全保卫设施建设的规定。

The construction, renovation, or expansion of civil airports (including the civil part of military-civilian airports, the same below) shall comply with the regulations of the civil aviation authority of the State Council on the construction of civil airport security facilities.

民用机场开放使用，应当具备下列安全保卫条件：

A civil airport shall meet the following security conditions before being opened for use:

(一)设有机场控制区并配备专职警卫人员；

(1) Have an airport control area and be equipped with full-time security personnel;

(二)设有符合标准的防护围栏和巡逻通道；

(2) Equipped with protective fences and patrol passages that meet the standards;

(三)设有安全保卫机构并配备相应的人员和装备；

(3) Have a security organization with corresponding personnel and equipment;

(四)设有安全检查机构并配备与机场运输量相适应的人员和检查设备；

(4) Have a security inspection organization with personnel and inspection equipment commensurate with the airport traffic volume;

(五)设有专职消防组织并按照机场消防等级配备人员和设备；

(5) Have a dedicated firefighting organization with personnel and equipment according to the airport fire rating;

(六)订有应急处置方案并配备必要的应急援救设备。

(6) Have an emergency response plan and necessary emergency rescue equipment.

机场控制区应当根据安全保卫的需要，划定为候机隔离区、行李分检装卸区、航空器活动区和维修区、货物存放区等，并分别设置安全防护设施和明显标志。

The airport control area shall be divided into passenger screening areas, baggage sorting and loading areas, aircraft movement and maintenance areas, cargo storage areas, etc., according to security needs, and shall be equipped with security facilities and clear markings respectively.

机场控制区应当有严密的安全保卫措施，实行封闭式分区管理。具体管理办法由国务院民用航空主管部门制定。

The airport control area shall have strict security measures and implement closed-off zone management. Specific management measures shall be formulated by the competent civil aviation authority under the State Council.

人员与车辆进入机场控制区，必须佩带机场控制区通行证并接受警卫人员的检查。

Personnel and vehicles entering the airport control area must wear airport control area passes and accept inspection by security personnel.

机场控制区通行证，由民航公安机关按照国务院民用航空主管部门的有关规定制发和管理。

Airport control area passes shall be issued and managed by the civil aviation public security organs in accordance with the relevant regulations of the competent civil aviation authority under the State Council.

在航空器活动区和维修区内的人员、车辆必须按照规定路线行进，车辆、设备必须在指定位置停放，一切人员、车辆必须避让航空器。

Personnel and vehicles in the aircraft movement and maintenance areas must proceed along prescribed routes; vehicles and equipment must be parked in designated locations; all personnel and vehicles must give way to aircraft.

停放在机场的民用航空器必须有专人警卫；各有关部门及其工作人员必须严格执行航空器警卫交接制度。

Civil aircraft parked at an airport must be guarded by dedicated personnel; all relevant departments and their staff must strictly implement the aircraft guard handover system.

机场内禁止下列行为：

The following acts are prohibited within the airport:

(一)攀(钻)越、损毁机场防护围栏及其他安全防护设施；

(1) Climbing over, drilling through, or damaging airport perimeter fences and other security protection facilities;

(二)在机场控制区内狩猎、放牧、晾晒谷物、教练驾驶车辆；

(2) Hunting, grazing, drying grain, or teaching driving within the airport control area;

(三)无机场控制区通行证进入机场控制区；

(3) Entering the airport control area without a valid airport control area pass;

(四)随意穿越航空器跑道、滑行道；

(4) Crossing aircraft runways or taxiways without authorization;

(五)强行登、占航空器；

(5) Forcibly boarding or occupying an aircraft;

(六)谎报险情，制造混乱；

(6) Falsely reporting emergencies or creating disturbances;

(七)扰乱机场秩序的其他行为。

(7) Other acts that disrupt airport order.

承运人及其代理人出售客票，必须符合国务院民用航空主管部门的有关规定；对不符合规定的，不得售予客票。

When selling tickets, carriers and their agents must comply with the relevant provisions of the civil aviation authority under the State Council; tickets shall not be sold to those who do not meet the requirements.

承运人办理承运手续时，必须核对乘机人和行李。

When handling check-in procedures, carriers must verify the passenger and their baggage.

旅客登机时，承运人必须核对旅客人数。

When passengers board the aircraft, the carrier must verify the number of passengers.

对已经办理登机手续而未登机的旅客的行李，不得装入或者留在航空器内。

Baggage of passengers who have checked in but not boarded the aircraft shall not be loaded or left on the aircraft.

旅客在航空器飞行中途中止旅行时，必须将其行李卸下。

If a passenger terminates their journey during flight, their baggage must be unloaded.

承运人对承运的行李、货物，在地面存储和运输期间，必须有专人监管。

Carriers must assign dedicated personnel to supervise the baggage and cargo they carry during ground storage and transportation.

配制、装载供应品的单位对装入航空器的供应品，必须保证其安全性。

Units that prepare or load supplies must ensure the safety of the supplies loaded onto the aircraft.

航空器在飞行中的安全保卫工作由机长统一负责。

The captain has overall responsibility for security work during flight.

航空安全员在机长领导下，承担安全保卫的具体工作。

Air security officers, under the leadership of the captain, undertake specific security tasks.

机长、航空安全员和机组其他成员，应当严格履行职责，保护民用航空器及其所载人员和财产的安全。

The captain, air security officers, and other crew members shall strictly perform their duties to protect the safety of the civil aircraft and the persons and property on board.

机长在执行职务时，可以行使下列权力：

When performing duties, the aircraft captain may exercise the following powers:

(一)在航空器起飞前，发现有关方面对航空器未采取本条例规定的安全措施的，拒绝起飞；

(1) Before the aircraft takes off, if it is discovered that the relevant party has not taken the security measures prescribed in these Regulations for the aircraft, refuse to take off;

(二)在航空器飞行中，对扰乱航空器内秩序，干扰机组人员正常工作而不听劝阻的人，采取必要的管束措施；

(2) During flight, take necessary restraint measures against persons who disrupt order in the aircraft, interfere with the normal work of the crew, and do not heeddissuade;

(三)在航空器飞行中，对劫持、破坏航空器或者其他危及安全的行为，采取必要的措施；

(3) During flight, take necessary measures against acts of hijacking, damaging the aircraft, or other acts that endanger safety;

(四)在航空器飞行中遇到特殊情况时，对航空器的处置作最后决定。

(4) When encountering special circumstances during flight, make the final decision on the handling of the aircraft.

禁止下列扰乱民用航空营运秩序的行为：

The following acts that disrupt the order of civil aviation operations are prohibited:

(一)倒卖购票证件、客票和航空运输企业的有效订座凭证；

(1) Scalping ticket purchase documents, passenger tickets, and valid reservation vouchers of air transport enterprises;

(二)冒用他人身份证件购票、登机；

(2) Using another person's identity document to purchase tickets or board the aircraft;

(三)利用客票交运或者捎带非旅客本人的行李物品；

(3) Using passenger tickets to consign or carry baggage items not belonging to the passenger himself;

(四)将未经安全检查或者采取其他安全措施的物品装入航空器。

(4) Loading items that have not undergone security checks or other security measures into the aircraft.

航空器内禁止下列行为：

The following acts are prohibited on aircraft:

(一)在禁烟区吸烟；

(1) Smoking in no-smoking areas;

(二)抢占座位、行李舱(架)；

(2) Grabbing seats or luggage compartments (racks);

(三)打架、酗酒、寻衅滋事；

(3) Fighting, excessive drinking, or creating disturbances;

(四)盗窃、故意损坏或者擅自移动救生物品和设备；

(4) Stealing, intentionally damaging, or unauthorized moving of life-saving items and equipment;

(五)危及飞行安全和扰乱航空器内秩序的其他行为。

(5) Other acts that endanger flight safety or disrupt order on the aircraft.

乘坐民用航空器的旅客和其他人员及其携带的行李物品，必须接受安全检查；但是，国务院规定免检的除外。

Passengers and other persons boarding civil aircraft, as well as their carry-on baggage and items, must undergo security checks, except those exempted by State Council regulations.

拒绝接受安全检查的，不准登机，损失自行承担。

Those who refuse to undergo security checks shall not be allowed to board, and any losses incurred shall be borne by themselves.

安全检查人员应当查验旅客客票、身份证件和登机牌，使用仪器或者手工对旅客及其行李物品进行安全检查，必要时可以从严检查。

Security check personnel shall verify passengers' tickets, identity documents, and boarding passes, and conduct security checks on passengers and their baggage and items using instruments or manual methods, and may conduct stricter checks when necessary.

已经安全检查的旅客应当在候机隔离区等待登机。

Passengers who have undergone security check shall wait for boarding in the sterile area.

进入候机隔离区的工作人员(包括机组人员)及其携带的物品，应当接受安全检查。

Staff members (including crew members) entering the sterile area and their carried items shall undergo security check.

接送旅客的人员和其他人员不得进入候机隔离区。

Persons accompanying or seeing off passengers and other persons shall not enter the sterile area.

外交邮袋免予安全检查。外交信使及其随身携带的其他物品应当接受安全检查；但是，中华人民共和国缔结或者参加的国际条约另有规定的除外。

Diplomatic pouches are exempt from security check. Diplomatic couriers and their other carried items shall undergo security check, unless otherwise provided by international treaties concluded or acceded to by the People's Republic of China.

空运的货物必须经过安全检查或者对其采取的其他安全措施。

Air cargo must undergo security check or other security measures.

货物托运人不得伪报品名托运或者在货物中夹带危险物品。

Cargo consignors shall not falsely declare the item name or conceal dangerous items in the cargo.

航空邮件必须经过安全检查。发现可疑邮件时，安全检查部门应当会同邮政部门开包查验处理。

Air mail must undergo security check. When suspicious mail is found, the security check department shall, together with the postal department, open the package for inspection and handling.

除国务院另有规定的外，乘坐民用航空器的，禁止随身携带或者交运下列物品：

Unless otherwise provided by the State Council, passengers on civil aircraft are prohibited from carrying or checking the following items:

(一)枪支、弹药、军械、警械；

(1) Firearms, ammunition, military equipment, police equipment;

(二)管制刀具；

(2) Controlled knives;

(三)易燃、易爆、有毒、腐蚀性、放射性物品；

(3) Flammable, explosive, toxic, corrosive, and radioactive items;

(四)国家规定的其他禁运物品。

(4) Other prohibited items as stipulated by the state.

除本条例第三十二条规定的物品外，其他可以用于危害航空安全的物品，旅客不得随身携带，但是可以作为行李交运或者按照国务院民用航空主管部门的有关规定由机组人员带到目的地后交还。

Except for the items specified in Article 32 of these Regulations, other items that can be used to endanger aviation safety shall not be carried by passengers on their person, but may be checked as baggage or handed over to the crew for return after arrival at the destination in accordance with the relevant provisions of the competent civil aviation authority under the State Council.

对含有易燃物质的生活用品实行限量携带。限量携带的物品及其数量，由国务院民用航空主管部门规定。

Daily necessities containing flammable substances shall be carried in limited quantities. The items subject to quantity limits and their quantities shall be prescribed by the competent civil aviation authority under the State Council.

违反本条例第十四条的规定或者有本条例第十六条、第二十四条第一项、第二十五条所列行为，构成违反治安管理行为的，由民航公安机关依照《中华人民共和国治安管理处罚法》有关规定予以处罚；有本条例第二十四条第二项所列行为的，由民航公安机关依照《中华人民共和国居民身份证法》有关规定予以处罚。

Whoever violates the provisions of Article 14 of these Regulations or commits any of the acts listed in Article 16, Item 1 of Article 24, or Article 25, which constitutes a violation of public security administration, shall be punished by the civil aviation public security organ in accordance with the relevant provisions of the Public Security Administration Punishments Law of the People's Republic of China; whoever commits any of the acts listed in Item 2 of Article 24 shall be punished by the civil aviation public security organ in accordance with the relevant provisions of the Resident Identity Card Law of the People's Republic of China.

违反本条例的有关规定，由民航公安机关按照下列规定予以处罚：

Whoever violates the relevant provisions of these Regulations shall be punished by the civil aviation public security organ in accordance with the following provisions:

(一)有本条例第二十四条第四项所列行为的，可以处以警告或者3000元以下的罚款；

(1) For any act listed in Item 4 of Article 24, a warning or a fine of not more than 3,000 yuan may be imposed;

(二)有本条例第二十四条第三项所列行为的，可以处以警告、没收非法所得或者5000元以下罚款；

(2) For any act listed in Item 3 of Article 24, a warning, confiscation of illegal gains, or a fine of not more than 5,000 yuan may be imposed;

(三)违反本条例第三十条第二款、第三十二条的规定，尚未构成犯罪的，可以处以5000元以下罚款、没收或者扣留非法携带的物品。

(3) For violation of the provisions of Paragraph 2 of Article 30 or Article 32, if the act does not constitute a crime, a fine of not more than 5,000 yuan, confiscation or detention of the illegally carried items may be imposed.

违反本条例的规定，有下列情形之一的，民用航空主管部门可以对有关单位处以警告、停业整顿或者5万元以下的罚款；民航公安机关可以对直接责任人员处以警告或者500元以下的罚款：

In violation of the provisions of these Regulations, under any of the following circumstances, the competent civil aviation authority may impose a warning, order suspension of business, or a fine of not more than 50,000 yuan on the relevant unit; the civil aviation public security organ may impose a warning or a fine of not more than 500 yuan on the directly responsible person:

(一)违反本条例第十五条的规定，造成航空器失控的；

(1) Violating the provisions of Article 15 of these Regulations, causing loss of control of an aircraft;

(二)违反本条例第十七条的规定，出售客票的；

(2) Violating the provisions of Article 17 of these Regulations, selling tickets;

(三)违反本条例第十八条的规定，承运人办理承运手续时，不核对乘机人和行李的；

(3) Violating the provisions of Article 18 of these Regulations, when the carrier handles the carriage procedures, failing to verify the passenger and baggage;

(四)违反本条例第十九条的规定的；

(4) Violating the provisions of Article 19 of these Regulations;

(五)违反本条例第二十条、第二十一条、第三十条第一款、第三十一条的规定，对收运、装入航空器的物品不采取安全措施的。

(5) Violating the provisions of Articles 20, 21, the first paragraph of Article 30, and Article 31 of these Regulations, failing to take safety measures for items accepted for carriage or loaded onto the aircraft.

违反本条例的有关规定，构成犯罪的，依法追究刑事责任。

Violating the relevant provisions of these Regulations, if a crime is constituted, criminal liability shall be pursued according to law.

违反本条例规定的，除依照本章的规定予以处罚外，给单位或者个人造成财产损失的，应当依法承担赔偿责任。

In violation of the provisions of these Regulations, in addition to being punished in accordance with the provisions of this Chapter, if property losses are caused to units or individuals, compensation liability shall be borne according to law.

本条例下列用语的含义：

The meanings of the following terms used in these Regulations:

“机场控制区”，是指根据安全需要在机场内划定的进出受到限制的区域。

"Airport control zone" refers to an area within the airport designated for security purposes where access is restricted.

“候机隔离区”，是指根据安全需要在候机楼(室)内划定的供已经安全检查的出港旅客等待登机的区域及登机通道、摆渡车。

"Sterile waiting area" refers to an area within the terminal building designated for security purposes where outbound passengers who have undergone security screening wait to board, including boarding passages and shuttle buses.

“航空器活动区”，是指机场内用于航空器起飞、着陆以及与此有关的地面活动区域，包括跑道、滑行道、联络道、客机坪。

"Aircraft movement area" refers to the area within the airport used for aircraft takeoff, landing, and related ground activities, including runways, taxiways, link taxiways, and aircraft parking aprons.

本条例自发布之日起施行。

These Regulations shall come into force on the date of promulgation.
