总则
General Provisions
为了防治地质灾害，避免和减轻地质灾害造成的损失，维护人民生命和财产安全，促进经济和社会的可持续发展，制定本条例。
This Regulation is formulated for the purpose of preventing and controlling geological disasters, avoiding and mitigating the losses caused by geological disasters, safeguarding the safety of people's lives and property, and promoting sustainable economic and social development.
本条例所称地质灾害，包括自然因素或者人为活动引发的危害人民生命和财产安全的山体崩塌、滑坡、泥石流、地面塌陷、地裂缝、地面沉降等与地质作用有关的灾害。
For the purposes of this Regulation, geological disasters include disasters related to geological processes, such as mountain collapses, landslides, debris flows, ground subsidence, ground fissures, and land subsidence, caused by natural factors or human activities that endanger the safety of people's lives and property.
地质灾害防治工作，应当坚持预防为主、避让与治理相结合和全面规划、突出重点的原则。
The work of preventing and controlling geological disasters shall adhere to the principles of combining prevention with avoidance and control, comprehensive planning, and highlighting key points.
地质灾害按照人员伤亡、经济损失的大小，分为四个等级：
Geological disasters are classified into four grades according to the magnitude of casualties and economic losses:
(一)特大型：因灾死亡30人以上或者直接经济损失1000万元以上的；
(1) Extra-large: causing 30 or more deaths or direct economic losses of 10 million yuan or more;
(二)大型：因灾死亡10人以上30人以下或者直接经济损失500万元以上1000万元以下的；
(2) Large: causing 10 to 29 deaths or direct economic losses of 5 million to less than 10 million yuan;
(三)中型：因灾死亡3人以上10人以下或者直接经济损失100万元以上500万元以下的；
(3) Medium: causing 3 to 9 deaths or direct economic losses of 1 million to less than 5 million yuan;
(四)小型：因灾死亡3人以下或者直接经济损失100万元以下的。
(4) Small: causing fewer than 3 deaths or direct economic losses of less than 1 million yuan.
地质灾害防治工作，应当纳入国民经济和社会发展计划。
The work of geological disaster prevention and control shall be incorporated into the national economic and social development plan.
因自然因素造成的地质灾害的防治经费，在划分中央和地方事权和财权的基础上，分别列入中央和地方有关人民政府的财政预算。具体办法由国务院财政部门会同国务院国土资源主管部门制定。
Funding for the prevention and control of geological disasters caused by natural factors shall, on the basis of dividing central and local affairs and financial powers, be respectively included in the fiscal budgets of the relevant central and local people's governments. Specific measures shall be formulated by the finance department of the State Council jointly with the competent department of land and resources of the State Council.
因工程建设等人为活动引发的地质灾害的治理费用，按照谁引发、谁治理的原则由责任单位承担。
The cost of controlling geological disasters caused by human activities such as engineering construction shall be borne by the responsible unit in accordance with the principle of 'who causes, who controls'.
县级以上人民政府应当加强对地质灾害防治工作的领导，组织有关部门采取措施，做好地质灾害防治工作。
People's governments at or above the county level shall strengthen leadership over geological disaster prevention and control, organize relevant departments to take measures, and do a good job in geological disaster prevention and control.
县级以上人民政府应当组织有关部门开展地质灾害防治知识的宣传教育，增强公众的地质灾害防治意识和自救、互救能力。
People's governments at or above the county level shall organize relevant departments to carry out publicity and education on geological disaster prevention and control knowledge, enhance the public's awareness of geological disaster prevention and their ability to self-rescue and mutual rescue.
国务院国土资源主管部门负责全国地质灾害防治的组织、协调、指导和监督工作。国务院其他有关部门按照各自的职责负责有关的地质灾害防治工作。
The competent department of land and resources of the State Council is responsible for the organization, coordination, guidance, and supervision of national geological disaster prevention and control. Other relevant departments of the State Council shall be responsible for related geological disaster prevention and control work according to their respective duties.
县级以上地方人民政府国土资源主管部门负责本行政区域内地质灾害防治的组织、协调、指导和监督工作。县级以上地方人民政府其他有关部门按照各自的职责负责有关的地质灾害防治工作。
The competent department of land and resources of local people's governments at or above the county level shall be responsible for the organization, coordination, guidance, and supervision of geological disaster prevention and control within their administrative regions. Other relevant departments of local people's governments at or above the county level shall be responsible for related geological disaster prevention and control work according to their respective duties.
国家鼓励和支持地质灾害防治科学技术研究，推广先进的地质灾害防治技术，普及地质灾害防治的科学知识。
The state encourages and supports scientific and technological research on geological disaster prevention and control, promotes advanced geological disaster prevention and control technologies, and popularizes scientific knowledge of geological disaster prevention and control.
任何单位和个人对地质灾害防治工作中的违法行为都有权检举和控告。
Any unit or individual has the right to report and accuse illegal acts in geological disaster prevention and control work.
在地质灾害防治工作中做出突出贡献的单位和个人，由人民政府给予奖励。
Units and individuals that have made outstanding contributions in geological disaster prevention and control work shall be rewarded by the people's government.
地质灾害防治规划
Geological Disaster Prevention and Control Planning
国家实行地质灾害调查制度。
The state implements a geological disaster survey system.
国务院国土资源主管部门会同国务院建设、水利、铁路、交通等部门结合地质环境状况组织开展全国的地质灾害调查。
The competent department of land and resources under the State Council shall, together with the competent departments of construction, water conservancy, railway, and transportation under the State Council, organize a national geological disaster survey based on the geological environment conditions.
县级以上地方人民政府国土资源主管部门会同同级建设、水利、交通等部门结合地质环境状况组织开展本行政区域的地质灾害调查。
The competent department of land and resources under the local people's government at or above the county level shall, together with the competent departments of construction, water conservancy, and transportation at the same level, organize a geological disaster survey within its administrative region based on the geological environment conditions.
国务院国土资源主管部门会同国务院建设、水利、铁路、交通等部门，依据全国地质灾害调查结果，编制全国地质灾害防治规划，经专家论证后报国务院批准公布。
The competent department of land and resources under the State Council shall, together with the competent departments of construction, water conservancy, railway, and transportation under the State Council, prepare a national geological disaster prevention and control plan based on the results of the national geological disaster survey, which shall be submitted to the State Council for approval and publication after expert demonstration.
县级以上地方人民政府国土资源主管部门会同同级建设、水利、交通等部门，依据本行政区域的地质灾害调查结果和上一级地质灾害防治规划，编制本行政区域的地质灾害防治规划，经专家论证后报本级人民政府批准公布，并报上一级人民政府国土资源主管部门备案。
The competent department of land and resources under the local people's government at or above the county level shall, together with the competent departments of construction, water conservancy, and transportation at the same level, prepare a geological disaster prevention and control plan for its administrative region based on the results of the geological disaster survey within its administrative region and the geological disaster prevention and control plan at the next higher level, which shall be submitted to the people's government at the same level for approval and publication after expert demonstration, and shall be reported to the competent department of land and resources under the people's government at the next higher level for record.
修改地质灾害防治规划，应当报经原批准机关批准。
Any amendment to a geological disaster prevention and control plan shall be subject to approval by the original approving authority.
地质灾害防治规划包括以下内容：
A geological disaster prevention and control plan shall include the following contents:
(一)地质灾害现状和发展趋势预测；
(1) Current status of geological disasters and prediction of development trends;
(二)地质灾害的防治原则和目标；
(2) Principles and objectives for geological disaster prevention and control;
(三)地质灾害易发区、重点防治区；
(3) Geological disaster-prone areas and key prevention areas;
(四)地质灾害防治项目；
(4) Geological disaster prevention projects;
(五)地质灾害防治措施等。
(5) Geological disaster prevention measures, etc.
县级以上人民政府应当将城镇、人口集中居住区、风景名胜区、大中型工矿企业所在地和交通干线、重点水利电力工程等基础设施作为地质灾害重点防治区中的防护重点。
People's governments at or above the county level shall designate towns, densely populated areas, scenic spots, locations of large and medium-sized industrial and mining enterprises, and infrastructure such as transportation arteries and key water conservancy and power projects as protection priorities within key geological disaster prevention areas.
编制和实施土地利用总体规划、矿产资源规划以及水利、铁路、交通、能源等重大建设工程项目规划，应当充分考虑地质灾害防治要求，避免和减轻地质灾害造成的损失。
The formulation and implementation of overall land use plans, mineral resource plans, and plans for major construction projects such as water conservancy, railways, transportation, and energy shall fully consider the requirements for geological disaster prevention and control, and avoid or mitigate losses caused by geological disasters.
编制城市总体规划、村庄和集镇规划，应当将地质灾害防治规划作为其组成部分。
When formulating overall urban plans and village and town plans, the geological disaster prevention plan shall be incorporated as a component.
地质灾害预防
Geological Disaster Prevention
国家建立地质灾害监测网络和预警信息系统。
The state establishes a geological disaster monitoring network and an early warning information system.
县级以上人民政府国土资源主管部门应当会同建设、水利、交通等部门加强对地质灾害险情的动态监测。
The competent departments of land and resources of people's governments at or above the county level shall, in conjunction with departments of construction, water conservancy, transportation, etc., strengthen dynamic monitoring of geological disaster risks.
因工程建设可能引发地质灾害的，建设单位应当加强地质灾害监测。
If engineering construction may trigger geological disasters, the construction unit shall strengthen geological disaster monitoring.
地质灾害易发区的县、乡、村应当加强地质灾害的群测群防工作。在地质灾害重点防范期内，乡镇人民政府、基层群众自治组织应当加强地质灾害险情的巡回检查，发现险情及时处理和报告。
Counties, townships, and villages in areas prone to geological disasters shall strengthen mass monitoring and prevention efforts. During the key prevention period for geological disasters, township people's governments and grassroots self-governing organizations shall strengthen patrol inspections of geological disaster risks, and promptly handle and report any discovered risks.
国家鼓励单位和个人提供地质灾害前兆信息。
The State encourages units and individuals to provide precursor information on geological disasters.
国家保护地质灾害监测设施。任何单位和个人不得侵占、损毁、损坏地质灾害监测设施。
The State protects geological disaster monitoring facilities. No unit or individual may occupy, damage, or destroy geological disaster monitoring facilities.
国家实行地质灾害预报制度。预报内容主要包括地质灾害可能发生的时间、地点、成灾范围和影响程度等。
The State implements a geological disaster forecast system. The forecast content mainly includes the possible time, location, disaster range, and impact degree of geological disasters.
地质灾害预报由县级以上人民政府国土资源主管部门会同气象主管机构发布。
Geological disaster forecasts shall be issued by the competent department of land and resources of the people's government at or above the county level jointly with the meteorological authority.
任何单位和个人不得擅自向社会发布地质灾害预报。
No unit or individual may issue geological disaster forecasts to the public without authorization.
县级以上地方人民政府国土资源主管部门会同同级建设、水利、交通等部门依据地质灾害防治规划，拟订年度地质灾害防治方案，报本级人民政府批准后公布。
The competent department of land and resources of the local people's government at or above the county level shall, jointly with the departments of construction, water conservancy, transportation, etc., draft an annual geological disaster prevention plan based on the geological disaster prevention plan, and submit it to the people's government at the same level for approval before publication.
年度地质灾害防治方案包括下列内容：
The annual geological disaster prevention plan includes the following contents:
(一)主要灾害点的分布；
(1) Distribution of major disaster points;
(二)地质灾害的威胁对象、范围；
(2) Objects and scope threatened by geological disasters;
(三)重点防范期；
(3) Key prevention periods;
(四)地质灾害防治措施；
(4) Geological disaster prevention measures;
(五)地质灾害的监测、预防责任人。
(5) Persons responsible for monitoring and prevention of geological disasters.
对出现地质灾害前兆、可能造成人员伤亡或者重大财产损失的区域和地段，县级人民政府应当及时划定为地质灾害危险区，予以公告，并在地质灾害危险区的边界设置明显警示标志。
For areas and sections where precursors of geological disasters appear and may cause casualties or significant property losses, the county-level people's government shall promptly delineate them as geological hazard danger zones, announce them, and set up obvious warning signs at the boundaries of the geological hazard danger zones.
在地质灾害危险区内，禁止爆破、削坡、进行工程建设以及从事其他可能引发地质灾害的活动。
Within geological hazard danger zones, blasting, slope cutting, engineering construction, and other activities that may trigger geological disasters are prohibited.
县级以上人民政府应当组织有关部门及时采取工程治理或者搬迁避让措施，保证地质灾害危险区内居民的生命和财产安全。
The people's government at or above the county level shall organize relevant departments to promptly take engineering treatment or relocation and avoidance measures to ensure the life and property safety of residents within geological hazard danger zones.
地质灾害险情已经消除或者得到有效控制的，县级人民政府应当及时撤销原划定的地质灾害危险区，并予以公告。
When the geological hazard danger has been eliminated or effectively controlled, the county-level people's government shall promptly revoke the originally delineated geological hazard danger zone and announce it.
在地质灾害易发区内进行工程建设应当在可行性研究阶段进行地质灾害危险性评估，并将评估结果作为可行性研究报告的组成部分；可行性研究报告未包含地质灾害危险性评估结果的，不得批准其可行性研究报告。
For engineering construction in areas prone to geological disasters, a geological hazard risk assessment shall be conducted during the feasibility study stage, and the assessment results shall be included as a component of the feasibility study report; if the feasibility study report does not include the geological hazard risk assessment results, the feasibility study report shall not be approved.
编制地质灾害易发区内的城市总体规划、村庄和集镇规划时，应当对规划区进行地质灾害危险性评估。
When preparing the overall urban plan and village and town plans within areas prone to geological disasters, a geological hazard risk assessment shall be conducted for the planning area.
国家对从事地质灾害危险性评估的单位实行资质管理制度。地质灾害危险性评估单位应当具备下列条件，经省级以上人民政府国土资源主管部门资质审查合格，取得国土资源主管部门颁发的相应等级的资质证书后，方可在资质等级许可的范围内从事地质灾害危险性评估业务：
The state implements a qualification management system for units engaged in geological hazard risk assessment. A geological hazard risk assessment unit shall meet the following conditions, pass the qualification review by the competent department of land and resources of the people's government at or above the provincial level, and obtain a qualification certificate of the corresponding grade issued by the competent department of land and resources before it can engage in geological hazard risk assessment business within the scope permitted by the qualification grade:
(一)有独立的法人资格；
(1) Have independent legal personality;
(二)有一定数量的工程地质、环境地质和岩土工程等相应专业的技术人员；
(2) Have a certain number of professional technical personnel in corresponding specialties such as engineering geology, environmental geology, and geotechnical engineering;
(三)有相应的技术装备。
(3) Have corresponding technical equipment.
地质灾害危险性评估单位进行评估时，应当对建设工程遭受地质灾害危害的可能性和该工程建设中、建成后引发地质灾害的可能性做出评价，提出具体的预防治理措施，并对评估结果负责。
When conducting an assessment, a geological disaster risk assessment unit shall evaluate the possibility of the construction project suffering from geological disaster hazards and the possibility of the construction project inducing geological disasters during and after construction, propose specific prevention and control measures, and be responsible for the assessment results.
禁止地质灾害危险性评估单位超越其资质等级许可的范围或者以其他地质灾害危险性评估单位的名义承揽地质灾害危险性评估业务。
Geological disaster risk assessment units are prohibited from undertaking geological disaster risk assessment business beyond the scope permitted by their qualification grade or under the name of other geological disaster risk assessment units.
禁止地质灾害危险性评估单位允许其他单位以本单位的名义承揽地质灾害危险性评估业务。
Geological disaster risk assessment units are prohibited from allowing other units to undertake geological disaster risk assessment business in their name.
禁止任何单位和个人伪造、变造、买卖地质灾害危险性评估资质证书。
Any unit or individual is prohibited from forging, altering, or trading geological disaster risk assessment qualification certificates.
对经评估认为可能引发地质灾害或者可能遭受地质灾害危害的建设工程，应当配套建设地质灾害治理工程。地质灾害治理工程的设计、施工和验收应当与主体工程的设计、施工、验收同时进行。
For construction projects that are assessed as likely to induce geological disasters or likely to suffer from geological disaster hazards, supporting geological disaster control projects shall be constructed. The design, construction, and acceptance of geological disaster control projects shall be carried out simultaneously with the design, construction, and acceptance of the main project.
配套的地质灾害治理工程未经验收或者经验收不合格的，主体工程不得投入生产或者使用。
If the supporting geological disaster control project has not been accepted or has failed acceptance, the main project shall not be put into production or use.
地质灾害应急
Geological Disaster Emergency Response
国务院国土资源主管部门会同国务院建设、水利、铁路、交通等部门拟订全国突发性地质灾害应急预案，报国务院批准后公布。
The competent department of land and resources under the State Council shall, together with the competent departments of construction, water conservancy, railways, and transportation under the State Council, draft a national emergency plan for sudden geological disasters, which shall be submitted to the State Council for approval before publication.
县级以上地方人民政府国土资源主管部门会同同级建设、水利、交通等部门拟订本行政区域的突发性地质灾害应急预案，报本级人民政府批准后公布。
The competent department of land and resources under the local people's government at or above the county level shall, together with the competent departments of construction, water conservancy, and transportation at the same level, draft an emergency plan for sudden geological disasters within their administrative region, which shall be submitted to the people's government at the same level for approval before publication.
突发性地质灾害应急预案包括下列内容：
The emergency plan for sudden geological disasters shall include the following contents:
(一)应急机构和有关部门的职责分工；
(1) Division of responsibilities between emergency agencies and relevant departments;
(二)抢险救援人员的组织和应急、救助装备、资金、物资的准备；
(2) Organization of rescue and relief personnel, and preparation of emergency and rescue equipment, funds, and materials;
(三)地质灾害的等级与影响分析准备；
(3) Preparation for grading and impact analysis of geological disasters;
(四)地质灾害调查、报告和处理程序；
(4) Procedures for investigation, reporting, and handling of geological disasters;
(五)发生地质灾害时的预警信号、应急通信保障；
(5) Early warning signals and emergency communication support in the event of a geological disaster;
(六)人员财产撤离、转移路线、医疗救治、疾病控制等应急行动方案。
(6) Emergency action plans such as evacuation of personnel and property, transfer routes, medical treatment, and disease control.
发生特大型或者大型地质灾害时，有关省、自治区、直辖市人民政府应当成立地质灾害抢险救灾指挥机构。必要时，国务院可以成立地质灾害抢险救灾指挥机构。
When an extremely large or large geological disaster occurs, the relevant people's government of a province, autonomous region, or municipality directly under the Central Government shall establish a geological disaster rescue and relief command organization. When necessary, the State Council may establish a geological disaster rescue and relief command organization.
发生其他地质灾害或者出现地质灾害险情时，有关市、县人民政府可以根据地质灾害抢险救灾工作的需要，成立地质灾害抢险救灾指挥机构。
When other geological disasters occur or geological disaster risks appear, the relevant city or county people's government may establish a geological disaster rescue command organization based on the needs of geological disaster rescue and relief work.
地质灾害抢险救灾指挥机构由政府领导负责、有关部门组成，在本级人民政府的领导下，统一指挥和组织地质灾害的抢险救灾工作。
The geological disaster rescue command organization shall be led by government officials and composed of relevant departments. Under the leadership of the people's government at the same level, it shall uniformly command and organize the rescue and relief work for geological disasters.
发现地质灾害险情或者灾情的单位和个人，应当立即向当地人民政府或者国土资源主管部门报告。其他部门或者基层群众自治组织接到报告的，应当立即转报当地人民政府。
Any unit or individual that discovers a geological disaster risk or disaster shall immediately report to the local people's government or the competent department of land and resources. If another department or a grassroots self-governing organization receives the report, it shall immediately forward it to the local people's government.
当地人民政府或者县级人民政府国土资源主管部门接到报告后，应当立即派人赶赴现场，进行现场调查，采取有效措施，防止灾害发生或者灾情扩大，并按照国务院国土资源主管部门关于地质灾害灾情分级报告的规定，向上级人民政府和国土资源主管部门报告。
After receiving the report, the local people's government or the competent department of land and resources of the county people's government shall immediately send personnel to the scene, conduct on-site investigations, take effective measures to prevent the disaster from occurring or the disaster situation from expanding, and report to the higher-level people's government and the competent department of land and resources in accordance with the provisions of the competent department of land and resources of the State Council on the classification and reporting of geological disaster situations.
接到地质灾害险情报告的当地人民政府、基层群众自治组织应当根据实际情况，及时动员受到地质灾害威胁的居民以及其他人员转移到安全地带；情况紧急时，可以强行组织避灾疏散。
Upon receiving a report of a geological disaster risk, the local people's government and grassroots self-governing organizations shall, based on the actual situation, promptly mobilize residents and other persons threatened by the geological disaster to move to safe areas; in an emergency, they may forcibly organize evacuation to avoid the disaster.
地质灾害发生后，县级以上人民政府应当启动并组织实施相应的突发性地质灾害应急预案。有关地方人民政府应当及时将灾情及其发展趋势等信息报告上级人民政府。
After a geological disaster occurs, the people's government at or above the county level shall activate and implement the corresponding emergency plan for sudden geological disasters. The relevant local people's government shall promptly report information on the disaster situation and its development trend to the higher-level people's government.
禁止隐瞒、谎报或者授意他人隐瞒、谎报地质灾害灾情。
It is prohibited to conceal, falsely report, or instruct others to conceal or falsely report the situation of a geological disaster.
县级以上人民政府有关部门应当按照突发性地质灾害应急预案的分工，做好相应的应急工作。
The relevant departments of the people's government at or above the county level shall perform corresponding emergency work in accordance with the division of labor in the emergency plan for sudden geological disasters.
国土资源主管部门应当会同同级建设、水利、交通等部门尽快查明地质灾害发生原因、影响范围等情况，提出应急治理措施，减轻和控制地质灾害灾情。
The competent department of land and resources shall, together with the departments of construction, water resources, transportation, etc. at the same level, promptly ascertain the cause of the geological disaster, the scope of impact, and other circumstances, propose emergency control measures, and mitigate and control the geological disaster situation.
民政、卫生、食品药品监督管理、商务、公安部门，应当及时设置避难场所和救济物资供应点，妥善安排灾民生活，做好医疗救护、卫生防疫、药品供应、社会治安工作；气象主管机构应当做好气象服务保障工作；通信、航空、铁路、交通部门应当保证地质灾害应急的通信畅通和救灾物资、设备、药物、食品的运送。
The civil affairs, health, food and drug supervision and administration, commerce, and public security departments shall promptly set up shelters and relief supply points, properly arrange the lives of disaster victims, and provide medical rescue, epidemic prevention, drug supply, and public security work; the meteorological authority shall provide meteorological service support; the communications, aviation, railway, and transportation departments shall ensure smooth communication for geological disaster emergencies and the transportation of relief materials, equipment, drugs, and food.
根据地质灾害应急处理的需要，县级以上人民政府应当紧急调集人员，调用物资、交通工具和相关的设施、设备；必要时，可以根据需要在抢险救灾区域范围内采取交通管制等措施。
According to the needs of emergency response to geological disasters，the people's governments at or above the county level shall urgently mobilize personnel，requisition materials、means of transport and related facilities、and equipment；When necessary，they may take measures such as traffic control within the disaster relief area as needed。
因救灾需要，临时调用单位和个人的物资、设施、设备或者占用其房屋、土地的，事后应当及时归还；无法归还或者造成损失的，应当给予相应的补偿。
For the needs of disaster relief，if materials、facilities、equipment of units or individuals are temporarily requisitioned or their houses、or land are occupied，they shall be returned in a timely manner afterwards；If they cannot be returned or losses are caused，corresponding compensation shall be given。
县级以上地方人民政府应当根据地质灾害灾情和地质灾害防治需要，统筹规划、安排受灾地区的重建工作。
The local people's governments at or above the county level shall, based on the geological disaster situation and the needs of prevention and control，make overall plans、and arrange the reconstruction work in the disaster-stricken areas。
地质灾害治理
Geological Disaster Control
因自然因素造成的特大型地质灾害，确需治理的，由国务院国土资源主管部门会同灾害发生地的省、自治区、直辖市人民政府组织治理。
For extra-large geological disasters caused by natural factors，if control is indeed necessary，the competent department of land and resources of the State Council shall, together with the people's governments of the province、autonomous region、or municipality directly under the Central Government where the disaster occurred, organize the control。
因自然因素造成的其他地质灾害，确需治理的，在县级以上地方人民政府的领导下，由本级人民政府国土资源主管部门组织治理。
For other geological disasters caused by natural factors，if control is indeed necessary，under the leadership of the local people's government at or above the county level，the competent department of land and resources of the same level people's government shall organize the control。
因自然因素造成的跨行政区域的地质灾害，确需治理的，由所跨行政区域的地方人民政府国土资源主管部门共同组织治理。
For geological disasters caused by natural factors that cross administrative regions，if control is indeed necessary，the competent departments of land and resources of the local people's governments of the crossed administrative regions shall jointly organize the control。
因工程建设等人为活动引发的地质灾害，由责任单位承担治理责任。
For geological disasters caused by human activities such as engineering construction，the responsible unit shall bear the control responsibility。
责任单位由地质灾害发生地的县级以上人民政府国土资源主管部门负责组织专家对地质灾害的成因进行分析论证后认定。
The responsible unit shall be determined by the competent department of land and resources of the people's government at or above the county level where the geological disaster occurred after organizing experts to analyze and demonstrate the cause of the geological disaster。
对地质灾害的治理责任认定结果有异议的，可以依法申请行政复议或者提起行政诉讼。
If there is any objection to the determination result of the control responsibility for the geological disaster，an application for administrative reconsideration may be filed or an administrative lawsuit may be initiated in accordance with the law。
地质灾害治理工程的确定，应当与地质灾害形成的原因、规模以及对人民生命和财产安全的危害程度相适应。
The determination of geological disaster control projects shall be commensurate with the cause, scale, and degree of threat to people's lives and property safety posed by the geological disaster.
承担专项地质灾害治理工程勘查、设计、施工和监理的单位，应当具备下列条件，经省级以上人民政府国土资源主管部门资质审查合格，取得国土资源主管部门颁发的相应等级的资质证书后，方可在资质等级许可的范围内从事地质灾害治理工程的勘查、设计、施工和监理活动，并承担相应的责任：
Units undertaking survey, design, construction, and supervision of special geological disaster control projects shall meet the following conditions, and after passing qualification review by the competent department of land and resources at or above the provincial level, obtain a qualification certificate of the corresponding grade issued by the competent department of land and resources, before they may engage in survey, design, construction, and supervision activities of geological disaster control projects within the scope permitted by the qualification grade, and bear corresponding responsibilities:
(一)有独立的法人资格；
(1) Have independent legal personality;
(二)有一定数量的水文地质、环境地质、工程地质等相应专业的技术人员；
(2) Have a certain number of technical personnel in corresponding specialties such as hydrogeology, environmental geology, and engineering geology;
(三)有相应的技术装备；
(3) Have corresponding technical equipment;
(四)有完善的工程质量管理制度。
(4) Have a sound project quality management system.
地质灾害治理工程的勘查、设计、施工和监理应当符合国家有关标准和技术规范。
The survey, design, construction, and supervision of geological disaster control projects shall comply with relevant national standards and technical specifications.
禁止地质灾害治理工程勘查、设计、施工和监理单位超越其资质等级许可的范围或者以其他地质灾害治理工程勘查、设计、施工和监理单位的名义承揽地质灾害治理工程勘查、设计、施工和监理业务。
It is prohibited for units undertaking survey, design, construction, and supervision of geological disaster control projects to exceed the scope permitted by their qualification grade or to undertake survey, design, construction, and supervision business of geological disaster control projects in the name of other units.
禁止地质灾害治理工程勘查、设计、施工和监理单位允许其他单位以本单位的名义承揽地质灾害治理工程勘查、设计、施工和监理业务。
It is prohibited for units undertaking survey, design, construction, and supervision of geological disaster control projects to allow other units to undertake survey, design, construction, and supervision business of geological disaster control projects in their name.
禁止任何单位和个人伪造、变造、买卖地质灾害治理工程勘查、设计、施工和监理资质证书。
It is prohibited for any unit or individual to forge, alter, or trade qualification certificates for survey, design, construction, and supervision of geological disaster control projects.
政府投资的地质灾害治理工程竣工后，由县级以上人民政府国土资源主管部门组织竣工验收。其他地质灾害治理工程竣工后，由责任单位组织竣工验收；竣工验收时，应当有国土资源主管部门参加。
After the completion of a geological disaster control project invested by the government, the competent department of land and resources of the people's government at or above the county level shall organize the completion acceptance. After the completion of other geological disaster control projects, the responsible entity shall organize the completion acceptance; during the completion acceptance, the competent department of land and resources shall participate.
政府投资的地质灾害治理工程经竣工验收合格后，由县级以上人民政府国土资源主管部门指定的单位负责管理和维护；其他地质灾害治理工程经竣工验收合格后，由负责治理的责任单位负责管理和维护。
After the completion acceptance of a geological disaster control project invested by the government is passed, the unit designated by the competent department of land and resources of the people's government at or above the county level shall be responsible for management and maintenance; after the completion acceptance of other geological disaster control projects is passed, the responsible entity that undertook the control shall be responsible for management and maintenance.
任何单位和个人不得侵占、损毁、损坏地质灾害治理工程设施。
No unit or individual may occupy, damage, or destroy the facilities of geological disaster control projects.
法律责任
Legal Liability
违反本条例规定，有关县级以上地方人民政府、国土资源主管部门和其他有关部门有下列行为之一的，对直接负责的主管人员和其他直接责任人员，依法给予降级或者撤职的行政处分；造成地质灾害导致人员伤亡和重大财产损失的，依法给予开除的行政处分；构成犯罪的，依法追究刑事责任：
In violation of these regulations, if the relevant local people's government at or above the county level, the competent department of land and resources, or other relevant departments commits any of the following acts, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions of demotion or removal from office according to law; if the act causes geological disasters resulting in casualties and significant property losses, administrative sanctions of dismissal shall be given according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)未按照规定编制突发性地质灾害应急预案，或者未按照突发性地质灾害应急预案的要求采取有关措施、履行有关义务的；
(1) Failing to prepare a sudden geological disaster emergency response plan as required, or failing to take relevant measures or perform relevant obligations as required by the sudden geological disaster emergency response plan;
(二)在编制地质灾害易发区内的城市总体规划、村庄和集镇规划时，未按照规定对规划区进行地质灾害危险性评估的；
(2) When preparing the overall urban plan, village plan, or town plan for an area prone to geological disasters, failing to conduct a geological disaster risk assessment on the planned area as required;
(三)批准未包含地质灾害危险性评估结果的可行性研究报告的；
(3) Approving a feasibility study report that does not include the results of a geological disaster risk assessment;
(四)隐瞒、谎报或者授意他人隐瞒、谎报地质灾害灾情，或者擅自发布地质灾害预报的；
(4) Concealing, falsely reporting, or instructing others to conceal or falsely report geological disaster conditions, or releasing geological disaster forecasts without authorization;
(五)给不符合条件的单位颁发地质灾害危险性评估资质证书或者地质灾害治理工程勘查、设计、施工、监理资质证书的；
(5) Issuing a geological disaster risk assessment qualification certificate or a geological disaster control project survey, design, construction, or supervision qualification certificate to a unit that does not meet the conditions.
(六)在地质灾害防治工作中有其他渎职行为的。
(6) Other dereliction of duty in geological disaster prevention and control work.
违反本条例规定，建设单位有下列行为之一的，由县级以上地方人民政府国土资源主管部门责令限期改正；逾期不改正的，责令停止生产、施工或者使用，处10万元以上50万元以下的罚款；构成犯罪的，依法追究刑事责任：
In violation of these Regulations, if a construction entity commits any of the following acts, the competent department of land and resources of the local people's government at or above the county level shall order correction within a time limit; if correction is not made within the time limit, it shall order cessation of production, construction or use, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if a crime is constituted, criminal liability shall be pursued according to law:
(一)未按照规定对地质灾害易发区内的建设工程进行地质灾害危险性评估的；
(1) Failure to conduct geological hazard risk assessment for construction projects in areas prone to geological hazards as required;
(二)配套的地质灾害治理工程未经验收或者经验收不合格，主体工程即投入生产或者使用的。
(2) The supporting geological hazard control project has not been accepted or has failed acceptance, and the main project is put into production or use.
违反本条例规定，对工程建设等人为活动引发的地质灾害不予治理的，由县级以上人民政府国土资源主管部门责令限期治理；逾期不治理或者治理不符合要求的，由责令限期治理的国土资源主管部门组织治理，所需费用由责任单位承担，处10万元以上50万元以下的罚款；给他人造成损失的，依法承担赔偿责任。
In violation of these Regulations, if geological hazards caused by human activities such as engineering construction are not controlled, the competent department of land and resources of the local people's government at or above the county level shall order control within a time limit; if control is not carried out within the time limit or the control does not meet the requirements, the competent department of land and resources that ordered the control shall organize the control, and the costs shall be borne by the responsible unit, and a fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed; if losses are caused to others, compensation liability shall be borne according to law.
违反本条例规定，在地质灾害危险区内爆破、削坡、进行工程建设以及从事其他可能引发地质灾害活动的，由县级以上地方人民政府国土资源主管部门责令停止违法行为，对单位处5万元以上20万元以下的罚款，对个人处l万元以上5万元以下的罚款；构成犯罪的，依法追究刑事责任；给他人造成损失的，依法承担赔偿责任。
In violation of these Regulations, if blasting, slope cutting, engineering construction or other activities that may trigger geological hazards are carried out in geological hazard danger zones, the competent department of land and resources of the local people's government at or above the county level shall order cessation of the illegal act, impose a fine of not less than 50,000 yuan but not more than 200,000 yuan on the unit, and a fine of not less than 10,000 yuan but not more than 50,000 yuan on the individual; if a crime is constituted, criminal liability shall be pursued according to law; if losses are caused to others, compensation liability shall be borne according to law.
违反本条例规定，有下列行为之一的，由县级以上人民政府国土资源主管部门或者其他部门依据职责责令停止违法行为，对地质灾害危险性评估单位、地质灾害治理工程勘查、设计或者监理单位处合同约定的评估费、勘查费、设计费或者监理酬金1倍以上2倍以下的罚款，对地质灾害治理工程施工单位处工程价款2%以上4%以下的罚款，并可以责令停业整顿，降低资质等级；有违法所得的，没收违法所得；情节严重的，吊销其资质证书；构成犯罪的，依法追究刑事责任；给他人造成损失的，依法承担赔偿责任：
In violation of these Regulations, if any of the following acts is committed, the competent department of land and resources of the local people's government at or above the county level or other departments shall, according to their functions, order cessation of the illegal act, impose a fine of not less than one time but not more than two times the contractually agreed assessment fee, survey fee, design fee or supervision fee on the geological hazard risk assessment unit, geological hazard control engineering survey, design or supervision unit, and impose a fine of not less than 2% but not more than 4% of the project price on the geological hazard control engineering construction unit, and may order suspension of business for rectification and downgrade of qualification grade; if there is illegal income, the illegal income shall be confiscated; if the circumstances are serious, the qualification certificate shall be revoked; if a crime is constituted, criminal liability shall be pursued according to law; if losses are caused to others, compensation liability shall be borne according to law:
(一)在地质灾害危险性评估中弄虚作假或者故意隐瞒地质灾害真实情况的；
(1) Fraud in geological hazard risk assessment or intentional concealment of the true situation of geological hazards;
(二)在地质灾害治理工程勘查、设计、施工以及监理活动中弄虚作假、降低工程质量的；
(2) Fraud or reduction of project quality in geological hazard control engineering survey, design, construction and supervision activities;
(三)无资质证书或者超越其资质等级许可的范围承揽地质灾害危险性评估、地质灾害治理工程勘查、设计、施工及监理业务的；
(3) Undertaking geological hazard risk assessment, geological hazard control engineering survey, design, construction and supervision business without a qualification certificate or beyond the scope permitted by the qualification grade.
(四)以其他单位的名义或者允许其他单位以本单位的名义承揽地质灾害危险性评估、地质灾害治理工程勘查、设计、施工和监理业务的。
(4) Undertaking geological disaster risk assessment, geological disaster control engineering survey, design, construction, and supervision business in the name of another unit or allowing another unit to undertake such business in the name of the unit.
违反本条例规定，伪造、变造、买卖地质灾害危险性评估资质证书、地质灾害治理工程勘查、设计、施工和监理资质证书的，由省级以上人民政府国土资源主管部门收缴或者吊销其资质证书，没收违法所得，并处5万元以上10万元以下的罚款；构成犯罪的，依法追究刑事责任。
Whoever, in violation of these Regulations, forges, alters, buys or sells qualification certificates for geological disaster risk assessment, geological disaster control engineering survey, design, construction and supervision, the competent department of land and resources of the people's government at or above the provincial level shall confiscate or revoke the qualification certificate, confiscate the illegal gains, and impose a fine of not less than 50,000 yuan but not more than 100,000 yuan; if a crime is constituted, criminal liability shall be investigated according to law.
违反本条例规定，侵占、损毁、损坏地质灾害监测设施或者地质灾害治理工程设施的，由县级以上地方人民政府国土资源主管部门责令停止违法行为，限期恢复原状或者采取补救措施，可以处5万元以下的罚款；构成犯罪的，依法追究刑事责任。
Whoever, in violation of these Regulations, encroaches upon, damages or destroys geological disaster monitoring facilities or geological disaster control engineering facilities, the competent department of land and resources of the local people's government at or above the county level shall order the cessation of the illegal act, restore the original state or take remedial measures within a time limit, and may impose a fine of not more than 50,000 yuan; if a crime is constituted, criminal liability shall be investigated according to law.
附则
Supplementary Provisions
在地质灾害防治工作中形成的地质资料，应当按照《地质资料管理条例》的规定汇交。
Geological data formed in the work of geological disaster prevention and control shall be submitted in accordance with the provisions of the Regulations on the Administration of Geological Data.
地震灾害的防御和减轻依照防震减灾的法律、行政法规的规定执行。
The prevention and mitigation of earthquake disasters shall be implemented in accordance with the laws and administrative regulations on earthquake prevention and disaster reduction.
防洪法律、行政法规对洪水引发的崩塌、滑坡、泥石流的防治有规定的，从其规定。
Where flood control laws and administrative regulations have provisions on the prevention and control of collapses, landslides, and debris flows caused by floods, those provisions shall prevail.
本条例自2004年3月1日起施行。
These Regulations shall come into force as of March 1, 2004.
