Regulations on the Administration of Seismic Safety Evaluation

(Promulgated by Decree No. 323 of the State Council of the People's Republic of China on November 15, 2001; first revised in accordance with the Decision of the State Council on Amending and Repealing Certain Administrative Regulations on March 1, 2017; second revised in accordance with the Decision of the State Council on Amending Certain Administrative Regulations on March 2, 2019)

为了加强对地震安全性评价的管理，防御与减轻地震灾害，保护人民生命和财产安全，根据《中华人民共和国防震减灾法》的有关规定，制定本条例。

These Regulations are formulated in accordance with the relevant provisions of the Law of the People's Republic of China on Protecting Against and Mitigating Earthquake Disasters, with a view to strengthening the administration of seismic safety evaluation, preventing and mitigating earthquake disasters, and protecting the safety of people's lives and property.

在中华人民共和国境内从事地震安全性评价活动，必须遵守本条例。

Any entity engaged in seismic safety evaluation activities within the territory of the People's Republic of China must comply with these Regulations.

新建、扩建、改建建设工程，依照《中华人民共和国防震减灾法》和本条例的规定，需要进行地震安全性评价的，必须严格执行国家地震安全性评价的技术规范，确保地震安全性评价的质量。

For new construction, expansion, or renovation projects that require seismic safety evaluation in accordance with the Law of the People's Republic of China on Protecting Against and Mitigating Earthquake Disasters and these Regulations, the technical specifications for national seismic safety evaluation must be strictly followed to ensure the quality of seismic safety evaluation.

国务院地震工作主管部门负责全国的地震安全性评价的监督管理工作。

The competent department of earthquake affairs under the State Council shall be responsible for the supervision and administration of seismic safety evaluation nationwide.

县级以上地方人民政府负责管理地震工作的部门或者机构负责本行政区域内的地震安全性评价的监督管理工作。

The departments or institutions responsible for earthquake affairs under the people's governments at or above the county level shall be responsible for the supervision and administration of seismic safety evaluation within their respective administrative regions.

国家鼓励、扶持有关地震安全性评价的科技研究，推广应用先进的科技成果，提高地震安全性评价的科技水平。

The State encourages and supports scientific and technological research on seismic safety evaluation, promotes the application of advanced scientific and technological achievements, and improves the scientific and technological level of seismic safety evaluation.

从事地震安全性评价的单位应当具备下列条件：

Units engaged in seismic safety evaluation shall meet the following conditions:

(一)有与从事地震安全性评价相适应的地震学、地震地质学、工程地震学方面的专业技术人员；

(1) Having professional and technical personnel in seismology, seismic geology, and engineering seismology suitable for seismic safety evaluation;

(二)有从事地震安全性评价的技术条件。

(2) Having the technical conditions for conducting seismic safety evaluation.

禁止地震安全性评价单位以其他地震安全性评价单位的名义承揽地震安全性评价业务。禁止地震安全性评价单位允许其他单位以本单位的名义承揽地震安全性评价业务。

Seismic safety evaluation units are prohibited from undertaking seismic safety evaluation business in the name of other seismic safety evaluation units. Seismic safety evaluation units are prohibited from allowing other units to undertake seismic safety evaluation business in their name.

下列建设工程必须进行地震安全性评价：

The following construction projects must undergo seismic safety evaluation:

(一)国家重大建设工程；

(1) Major national construction projects;

(二)受地震破坏后可能引发水灾、火灾、爆炸、剧毒或者强腐蚀性物质大量泄露或者其他严重次生灾害的建设工程，包括水库大坝、堤防和贮油、贮气、贮存易燃易爆、剧毒或者强腐蚀性物质的设施以及其他可能发生严重次生灾害的建设工程；

(2) Construction projects that, if damaged by an earthquake, may cause floods, fires, explosions, large-scale leakage of highly toxic or highly corrosive substances, or other serious secondary disasters, including reservoir dams, dikes, facilities for storing oil, gas, flammable, explosive, highly toxic, or highly corrosive substances, and other construction projects that may cause serious secondary disasters;

(三)受地震破坏后可能引发放射性污染的核电站和核设施建设工程；

(3) Nuclear power plants and nuclear facility construction projects that, if damaged by an earthquake, may cause radioactive contamination;

(四)省、自治区、直辖市认为对本行政区域有重大价值或者有重大影响的其他建设工程。

(4) Other construction projects deemed by provinces, autonomous regions, or municipalities directly under the Central Government to have significant value or significant impact on their administrative regions.

地震安全性评价单位对建设工程进行地震安全性评价后，应当编制该建设工程的地震安全性评价报告。

After conducting a seismic safety evaluation for a construction project, the seismic safety evaluation unit shall prepare a seismic safety evaluation report for that construction project.

地震安全性评价报告应当包括下列内容：

The seismic safety evaluation report shall include the following contents:

(一)工程概况和地震安全性评价的技术要求；

(1) Project overview and technical requirements for seismic safety evaluation;

(二)地震活动环境评价；

(2) Evaluation of the seismic activity environment;

(三)地震地质构造评价；

(3) Evaluation of seismic geological structures;

(四)设防烈度或者设计地震动参数；

(4) Fortification intensity or design ground motion parameters;

(五)地震地质灾害评价；

(5) Seismic geological hazard assessment;

(六)其他有关技术资料。

(6) Other relevant technical materials.

国务院地震工作主管部门负责下列地震安全性评价报告的审定：

The seismic administration department of the State Council is responsible for the review of the following seismic safety evaluation reports:

(一)国家重大建设工程；

(1) National key construction projects;

(二)跨省、自治区、直辖市行政区域的建设工程；

(2) Construction projects spanning provinces, autonomous regions, or municipalities directly under the Central Government;

(三)核电站和核设施建设工程。

(3) Nuclear power plants and nuclear facility construction projects.

省、自治区、直辖市人民政府负责管理地震工作的部门或者机构负责除前款规定以外的建设工程地震安全性评价报告的审定。

The department or institution responsible for earthquake management under the people's government of a province, autonomous region, or municipality directly under the Central Government is responsible for the review of seismic safety evaluation reports for construction projects other than those specified in the preceding paragraph.

国务院地震工作主管部门和省、自治区、直辖市人民政府负责管理地震工作的部门或者机构，应当自收到地震安全性评价报告之日起15日内进行审定，确定建设工程的抗震设防要求。

The seismic administration department of the State Council and the department or institution responsible for earthquake management under the people's government of a province, autonomous region, or municipality directly under the Central Government shall, within 15 days from the date of receiving the seismic safety evaluation report, conduct a review and determine the seismic fortification requirements for the construction project.

国务院地震工作主管部门或者省、自治区、直辖市人民政府负责管理地震工作的部门或者机构，在确定建设工程抗震设防要求后，应当以书面形式通知建设单位，并告知建设工程所在地的市、县人民政府负责管理地震工作的部门或者机构。

After determining the seismic fortification requirements for a construction project, the seismic administration department of the State Council or the department or institution responsible for earthquake management under the people's government of a province, autonomous region, or municipality directly under the Central Government shall notify the construction unit in writing and inform the department or institution responsible for earthquake management under the people's government of the city or county where the construction project is located.

省、自治区、直辖市人民政府负责管理地震工作的部门或者机构应当将其确定的建设工程抗震设防要求报国务院地震工作主管部门备案。

The department or institution responsible for earthquake management under the people's government of a province, autonomous region, or municipality directly under the Central Government shall report the determined seismic fortification requirements for the construction project to the seismic administration department of the State Council for record.

县级以上人民政府负责项目审批的部门，应当将抗震设防要求纳入建设工程可行性研究报告的审查内容。对可行性研究报告中未包含抗震设防要求的项目，不予批准。

The department responsible for project approval at or above the county level shall incorporate seismic fortification requirements into the review content of the feasibility study report of the construction project. Projects that do not include seismic fortification requirements in the feasibility study report shall not be approved.

国务院建设行政主管部门和国务院铁路、交通、民用航空、水利和其他有关专业主管部门制定的抗震设计规范，应当明确规定按照抗震设防要求进行抗震设计的方法和措施。

The seismic design codes formulated by the construction administrative department of the State Council and the relevant specialized departments of the State Council for railways, transportation, civil aviation, water resources, and other relevant industries shall clearly specify the methods and measures for seismic design in accordance with seismic fortification requirements.

建设工程设计单位应当按照抗震设防要求和抗震设计规范，进行抗震设计。

The design unit of a construction project shall carry out seismic design in accordance with seismic fortification requirements and seismic design codes.

国务院地震工作主管部门和县级以上地方人民政府负责管理地震工作的部门或者机构，应当会同有关专业主管部门，加强对地震安全性评价工作的监督检查。

The seismic administration department of the State Council and the department or institution responsible for earthquake management under the local people's government at or above the county level shall, together with relevant specialized departments, strengthen supervision and inspection of seismic safety evaluation work.

违反本条例的规定，地震安全性评价单位有下列行为之一的，由国务院地震工作主管部门或者县级以上地方人民政府负责管理地震工作的部门或者机构依据职权，责令改正，没收违法所得，并处1万元以上5万元以下的罚款：

In violation of the provisions of these regulations, if a seismic safety evaluation unit commits any of the following acts, the seismic administration department of the State Council or the department or institution responsible for earthquake management under the local people's government at or above the county level shall, within its authority, order correction, confiscate illegal gains, and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan:

(一)以其他地震安全性评价单位的名义承揽地震安全性评价业务的；

(1) Undertaking seismic safety evaluation business in the name of another seismic safety evaluation unit;

(二)允许其他单位以本单位名义承揽地震安全性评价业务的。

(2) Allowing another unit to undertake seismic safety evaluation business in its own name.

违反本条例的规定，国务院地震工作主管部门或者省、自治区、直辖市人民政府负责管理地震工作的部门或者机构不履行审定地震安全性评价报告职责，国务院地震工作主管部门或者县级以上地方人民政府负责管理地震工作的部门或者机构不履行监督管理职责，或者发现违法行为不予查处，致使公共财产、国家和人民利益遭受重大损失的，依法追究有关责任人的刑事责任；没有造成严重后果，尚不构成犯罪的，对部门或者机构负有责任的主管人员和其他直接责任人员给予降级或者撤职的处分。

In violation of the provisions of these regulations, if the seismic administration department of the State Council or the department or institution responsible for earthquake management under the people's government of a province, autonomous region, or municipality directly under the Central Government fails to perform its duty of reviewing seismic safety evaluation reports, or the seismic administration department of the State Council or the department or institution responsible for earthquake management under the local people's government at or above the county level fails to perform its supervision and management duties, or fails to investigate and deal with illegal acts upon discovery, thereby causing significant losses to public property, the state, or the people's interests, criminal liability of the responsible persons shall be pursued according to law; if no serious consequences are caused and the act does not constitute a crime, the responsible supervisors and other directly responsible personnel of the department or institution shall be given demotion or removal from office.

本条例自2002年1月1日起施行。

These Regulations shall come into force as of January 1, 2002.
