为了加强对畜禽遗传资源进出境和对外合作研究利用的管理，保护和合理利用畜禽遗传资源，防止畜禽遗传资源流失，促进畜牧业持续健康发展，根据《中华人民共和国畜牧法》，制定本办法。
These Measures are formulated in accordance with the Animal Husbandry Law of the People's Republic of China to strengthen the management of import and export of livestock and poultry genetic resources and foreign cooperative research and utilization, protect and rationally utilize livestock and poultry genetic resources, prevent the loss of livestock and poultry genetic resources, and promote the sustainable and healthy development of animal husbandry.
从境外引进畜禽遗传资源，向境外输出或者在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源，应当遵守《中华人民共和国畜牧法》，并依照本办法的规定办理审批手续。
The import of livestock and poultry genetic resources from abroad, the export to abroad, or the cooperative research and utilization within China with foreign institutions or individuals of livestock and poultry genetic resources listed in the protection list of livestock and poultry genetic resources shall comply with the Animal Husbandry Law of the People's Republic of China and undergo approval procedures in accordance with these Measures.
本办法所称畜禽，是指列入依照《中华人民共和国畜牧法》第十一条规定公布的畜禽遗传资源目录的畜禽。
The term "livestock and poultry" as used in these Measures refers to those listed in the catalog of livestock and poultry genetic resources published in accordance with Article 11 of the Animal Husbandry Law of the People's Republic of China.
本办法所称畜禽遗传资源，是指畜禽及其卵子(蛋)、胚胎、精液、基因物质等遗传材料。
The term "livestock and poultry genetic resources" as used in these Measures refers to livestock and poultry and their genetic materials such as ova (eggs), embryos, semen, and genetic substances.
从境外引进畜禽遗传资源，应当具备下列条件：
The import of livestock and poultry genetic resources from abroad shall meet the following conditions:
(一)引进的目的明确、用途合理；
(1) The purpose of import is clear and the use is reasonable;
(二)符合畜禽遗传资源保护和利用规划；
(2) It conforms to the plan for the protection and utilization of livestock and poultry genetic resources;
(三)引进的畜禽遗传资源来自非疫区；
(3) The imported livestock and poultry genetic resources come from a non-epidemic area;
(四)符合进出境动植物检疫和农业转基因生物安全的有关规定，不对境内畜禽遗传资源和生态环境安全构成威胁。
(4) It complies with the relevant provisions on import and export animal and plant quarantine and agricultural genetically modified organism safety, and does not pose a threat to the safety of domestic livestock and poultry genetic resources and the ecological environment.
拟从境外引进畜禽遗传资源的单位，应当向其所在地的省、自治区、直辖市人民政府畜牧兽医行政主管部门提出申请，并提交畜禽遗传资源买卖合同或者赠与协议。
An entity intending to import livestock and poultry genetic resources from abroad shall submit an application to the competent animal husbandry and veterinary administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located, and submit a contract for the purchase and sale of livestock and poultry genetic resources or a gift agreement.
引进种用畜禽遗传资源的，还应当提交下列资料：
For the import of breeding livestock and poultry genetic resources, the following materials shall also be submitted:
(一)种畜禽生产经营许可证；
(1) The production and operation license for breeding livestock and poultry;
(二)出口国家或者地区法定机构出具的种畜系谱或者种禽代次证明；
(2) The pedigree certificate of breeding livestock or the generation certificate of breeding poultry issued by a statutory body of the exporting country or region;
(三)首次引进的，同时提交种用畜禽遗传资源的产地、分布、培育过程、生态特征、生产性能、群体存在的主要遗传缺陷和特有疾病等资料。
(3) For first-time imports, materials on the origin, distribution, cultivation process, ecological characteristics, production performance, major genetic defects, and specific diseases of the breeding livestock and poultry genetic resources shall also be submitted.
向境外输出列入畜禽遗传资源保护名录的畜禽遗传资源，应当具备下列条件：
The export of livestock and poultry genetic resources listed in the protection list of livestock and poultry genetic resources shall meet the following conditions:
(一)用途明确；
(1) The purpose is clear;
(二)符合畜禽遗传资源保护和利用规划；
(2) It conforms to the plan for the protection and utilization of livestock and poultry genetic resources;
(三)不对境内畜牧业生产和畜禽产品出口构成威胁；
(3) It does not pose a threat to domestic animal husbandry production and the export of livestock and poultry products;
(四)国家共享惠益方案合理。
(4) The national benefit-sharing scheme is reasonable.
拟向境外输出列入畜禽遗传资源保护名录的畜禽遗传资源的单位，应当向其所在地的省、自治区、直辖市人民政府畜牧兽医行政主管部门提出申请，并提交下列资料：
An entity intending to export livestock and poultry genetic resources listed in the protection list of livestock and poultry genetic resources shall submit an application to the competent animal husbandry and veterinary administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located, and submit the following materials:
(一)畜禽遗传资源买卖合同或者赠与协议；
(1) A contract for the purchase and sale of livestock and poultry genetic resources or a gift agreement;
(二)与境外进口方签订的国家共享惠益方案。
(2) A national benefit-sharing scheme signed with the foreign importer.
在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源，应当具备下列条件：
The cooperative research and utilization within China with foreign institutions or individuals of livestock and poultry genetic resources listed in the protection list of livestock and poultry genetic resources shall meet the following conditions:
(一)研究目的、范围和合作期限明确；
(1) The research purpose, scope, and cooperation period are clear;
(二)符合畜禽遗传资源保护和利用规划；
(2) Conform to the plan for the protection and utilization of livestock and poultry genetic resources;
(三)知识产权归属明确、研究成果共享方案合理；
(3) The ownership of intellectual property rights is clear, and the plan for sharing research results is reasonable;
(四)不对境内畜禽遗传资源和生态环境安全构成威胁；
(4) Does not pose a threat to the safety of domestic livestock and poultry genetic resources and the ecological environment;
(五)国家共享惠益方案合理。
(5) The national benefit-sharing plan is reasonable.
在境内与境外机构、个人合作研究利用畜禽遗传资源的单位，应当是依法取得法人资格的中方教育科研机构、中方独资企业。
The unit that conducts cooperative research and utilization of livestock and poultry genetic resources with foreign institutions or individuals within China shall be a Chinese educational or research institution or a wholly Chinese-owned enterprise that has obtained legal person status according to law.
拟在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源的单位，应当向其所在地的省、自治区、直辖市人民政府畜牧兽医行政主管部门提出申请，并提交下列资料：
A unit that intends to conduct cooperative research and utilization of livestock and poultry genetic resources listed in the protection list with foreign institutions or individuals within China shall submit an application to the competent animal husbandry and veterinary administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located, and provide the following materials:
(一)项目可行性研究报告；
(1) Project feasibility study report;
(二)合作研究合同；
(2) Cooperative research contract;
(三)与境外合作者签订的国家共享惠益方案。
(3) National benefit-sharing plan signed with the foreign partner.
禁止向境外输出或者在境内与境外机构、个人合作研究利用我国特有的、新发现未经鉴定的畜禽遗传资源以及国务院畜牧兽医行政主管部门禁止出口的其他畜禽遗传资源。
It is prohibited to export to foreign countries or to conduct cooperative research and utilization within China with foreign institutions or individuals on livestock and poultry genetic resources that are unique to China, newly discovered but not yet identified, or other livestock and poultry genetic resources that the competent animal husbandry and veterinary administrative department of the State Council has prohibited from export.
省、自治区、直辖市人民政府畜牧兽医行政主管部门，应当自收到畜禽遗传资源引进、输出或者对外合作研究利用申请之日起20个工作日内完成审核工作，并将审核意见和申请资料报国务院畜牧兽医行政主管部门审批。
The competent animal husbandry and veterinary administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall complete the review within 20 working days from the date of receiving the application for import, export, or foreign cooperative research and utilization of livestock and poultry genetic resources, and submit the review opinion and application materials to the competent animal husbandry and veterinary administrative department of the State Council for approval.
国务院畜牧兽医行政主管部门，应当自收到畜禽遗传资源引进、输出或者对外合作研究利用审核意见和申请资料之日起20个工作日内，对具备本办法第四条、第六条、第八条规定条件的，签发审批表；对不具备条件的，书面通知申请人，并说明理由。其中，对输出或者在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源，或者首次引进畜禽遗传资源的，国务院畜牧兽医行政主管部门应当自收到审核意见和申请资料之日起3个工作日内，将审核意见和申请资料送国家畜禽遗传资源委员会评估或者评审。评估或者评审时间不计入审批期限。
The competent animal husbandry and veterinary administrative department of the State Council shall, within 20 working days from the date of receiving the review opinion and application materials for import, export, or foreign cooperative research and utilization of livestock and poultry genetic resources, issue an approval form if the conditions specified in Articles 4, 6, and 8 of these Measures are met; if the conditions are not met, it shall notify the applicant in writing and state the reasons. Among them, for the export or cooperative research and utilization within China with foreign institutions or individuals of livestock and poultry genetic resources listed in the protection list, or for the first import of livestock and poultry genetic resources, the competent animal husbandry and veterinary administrative department of the State Council shall, within 3 working days from the date of receiving the review opinion and application materials, submit the review opinion and application materials to the National Livestock and Poultry Genetic Resources Committee for evaluation or review. The evaluation or review time shall not be counted in the approval period.
国务院畜牧兽医行政主管部门在20个工作日内不能做出审批决定的，经本部门负责人批准，可以延长10个工作日。延长期限的理由应当告知申请人。
If the competent animal husbandry and veterinary administrative department of the State Council cannot make an approval decision within 20 working days, it may extend the period by 10 working days with the approval of the head of the department. The reason for the extension shall be notified to the applicant.
畜禽遗传资源引进、输出审批表的有效期为6个月；需要延续的，申请人应当在有效期届满10个工作日前向原审批机关申请延续。延续期不得超过3个月。
The approval form for the import or export of livestock and poultry genetic resources is valid for 6 months; if an extension is needed, the applicant shall apply to the original approving authority for an extension 10 working days before the expiration of the validity period. The extension period shall not exceed 3 months.
从境外引进畜禽遗传资源、向境外输出列入畜禽遗传资源保护名录的畜禽遗传资源的单位，凭审批表办理检疫手续。海关凭出入境检验检疫部门出具的进出境货物通关单办理验放手续。从境外引进畜禽遗传资源、向境外输出列入畜禽遗传资源保护名录的畜禽遗传资源的单位，应当自海关放行之日起10个工作日内，将实际引进、输出畜禽遗传资源的数量报国务院畜牧兽医行政主管部门备案。国务院畜牧兽医行政主管部门应当定期将有关资料抄送国务院环境保护行政主管部门。
The unit that imports livestock and poultry genetic resources from abroad or exports livestock and poultry genetic resources listed in the protection list shall handle quarantine procedures with the approval form. The customs shall handle release procedures based on the customs clearance certificate for imported and exported goods issued by the entry-exit inspection and quarantine department. The unit that imports livestock and poultry genetic resources from abroad or exports livestock and poultry genetic resources listed in the protection list shall, within 10 working days from the date of customs release, report the actual quantity of imported or exported livestock and poultry genetic resources to the competent animal husbandry and veterinary administrative department of the State Council for record. The competent animal husbandry and veterinary administrative department of the State Council shall periodically send relevant materials to the competent environmental protection administrative department of the State Council.
在对外合作研究利用过程中需要更改研究目的和范围、合作期限、知识产权归属、研究成果共享方案或者国家共享惠益方案的，在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源的单位，应当按照原申请程序重新办理审批手续。
If, during the process of foreign cooperative research and utilization, it is necessary to change the research purpose and scope, cooperation period, ownership of intellectual property rights, plan for sharing research results, or national benefit-sharing plan, the unit that conducts cooperative research and utilization of livestock and poultry genetic resources listed in the protection list with foreign institutions or individuals within China shall re-handle the approval procedures according to the original application process.
省、自治区、直辖市人民政府畜牧兽医行政主管部门应当对引进的畜禽遗传资源进行跟踪评价，组织专家对引进的畜禽遗传资源的生产性能、健康状况、适应性以及对生态环境和本地畜禽遗传资源的影响等进行测定、评估，并及时将测定、评估结果报国务院畜牧兽医行政主管部门。
The competent animal husbandry and veterinary administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall conduct follow-up evaluation of imported livestock and poultry genetic resources, organize experts to measure and evaluate the production performance, health status, adaptability, and impact on the ecological environment and local livestock and poultry genetic resources of the imported livestock and poultry genetic resources, and promptly report the measurement and evaluation results to the competent animal husbandry and veterinary administrative department of the State Council.
发现引进的畜禽遗传资源对境内畜禽遗传资源、生态环境有危害或者可能产生危害的，国务院畜牧兽医行政主管部门应当商有关主管部门，采取相应的安全控制措施。
If it is found that imported livestock and poultry genetic resources cause or may cause harm to domestic livestock and poultry genetic resources or the ecological environment, the competent animal husbandry and veterinary administrative department of the State Council shall consult with relevant competent departments and take corresponding safety control measures.
在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源的单位，应当于每年12月31日前，将合作研究利用畜禽遗传资源的情况报所在地的省、自治区、直辖市人民政府畜牧兽医行政主管部门。省、自治区、直辖市人民政府畜牧兽医行政主管部门应当对合作研究利用情况提出审核意见，一并报国务院畜牧兽医行政主管部门备案。
The unit that conducts cooperative research and utilization of livestock and poultry genetic resources listed in the protection list with foreign institutions or individuals within China shall, before December 31 each year, report the situation of cooperative research and utilization of livestock and poultry genetic resources to the competent animal husbandry and veterinary administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where it is located. The competent animal husbandry and veterinary administrative department of the province, autonomous region, or municipality directly under the Central Government shall provide a review opinion on the cooperative research and utilization situation and submit it together to the competent animal husbandry and veterinary administrative department of the State Council for record.
与畜禽遗传资源引进、输出和对外合作研究利用的单位以及与境外机构或者个人有利害关系的人员，不得参与对有关申请的评估、评审以及对进境畜禽遗传资源的测定、评估工作。
Personnel who have an interest in the unit that imports, exports, or conducts foreign cooperative research and utilization of livestock and poultry genetic resources or in foreign institutions or individuals shall not participate in the evaluation or review of relevant applications or in the measurement and evaluation of imported livestock and poultry genetic resources.
我国的畜禽遗传资源信息，包括重要的畜禽遗传家系和特定地区遗传资源及其数据、资料、样本等，未经国务院畜牧兽医行政主管部门许可，任何单位或者个人不得向境外机构和个人转让。
Information on China's livestock and poultry genetic resources, including important livestock and poultry genetic lineages and genetic resources of specific regions and their data, materials, samples, etc., shall not be transferred to foreign institutions or individuals by any unit or individual without the permission of the competent animal husbandry and veterinary administrative department of the State Council.
畜牧兽医行政主管部门工作人员在畜禽遗传资源引进、输出和对外合作研究利用审批过程中玩忽职守、滥用职权、徇私舞弊的，依法给予处分；构成犯罪的，依法追究刑事责任。
If staff members of the competent animal husbandry and veterinary administrative department neglect their duties, abuse their power, or engage in malpractice for personal gain during the approval process of import, export, and foreign cooperative research and utilization of livestock and poultry genetic resources, they shall be given disciplinary sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law.
依照本办法的规定参与评估、评审、测定的专家，利用职务上的便利收取他人财物或者谋取其他利益，或者出具虚假意见的，没收违法所得，依法给予处分；构成犯罪的，依法追究刑事责任。
If experts participating in evaluation, review, or measurement according to these Measures use their positions to accept property from others or seek other benefits, or issue false opinions, their illegal gains shall be confiscated, and they shall be given disciplinary sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law.
申请从境外引进畜禽遗传资源，向境外输出或者在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源的单位，隐瞒有关情况或者提供虚假资料的，由省、自治区、直辖市人民政府畜牧兽医行政主管部门给予警告，3年内不再受理该单位的同类申请。
If a unit applying to import livestock and poultry genetic resources from abroad, export to foreign countries, or conduct cooperative research and utilization within China with foreign institutions or individuals of livestock and poultry genetic resources listed in the protection list conceals relevant information or provides false materials, the competent animal husbandry and veterinary administrative department of the province, autonomous region, or municipality directly under the Central Government shall give a warning, and no similar application from the unit shall be accepted within 3 years.
以欺骗、贿赂等不正当手段取得批准从境外引进畜禽遗传资源，向境外输出或者在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源的，由国务院畜牧兽医行政主管部门撤销批准决定，没收有关畜禽遗传资源和违法所得，并处以1万元以上5万元以下罚款，10年内不再受理该单位的同类申请；构成犯罪的，依法追究刑事责任。
If approval to import livestock and poultry genetic resources from abroad, export to foreign countries, or conduct cooperative research and utilization within China with foreign institutions or individuals of livestock and poultry genetic resources listed in the protection list is obtained by improper means such as deception or bribery, the competent animal husbandry and veterinary administrative department of the State Council shall revoke the approval decision, confiscate the relevant livestock and poultry genetic resources and illegal gains, impose a fine of not less than 10,000 yuan but not more than 50,000 yuan, and no similar application from the unit shall be accepted within 10 years; if a crime is constituted, criminal liability shall be pursued according to law.
未经审核批准，从境外引进畜禽遗传资源，或者在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源，或者在境内与境外机构、个人合作研究利用未经国家畜禽遗传资源委员会鉴定的新发现的畜禽遗传资源的，依照《中华人民共和国畜牧法》的有关规定追究法律责任。
If, without review and approval, livestock and poultry genetic resources are imported from abroad, or if cooperative research or utilization is conducted within China with foreign institutions or individuals using livestock and poultry genetic resources listed in the protection catalog, or if cooperative research or utilization is conducted within China with foreign institutions or individuals using newly discovered livestock and poultry genetic resources that have not been identified by the National Livestock and Poultry Genetic Resources Committee, legal liability shall be pursued in accordance with the relevant provisions of the Animal Husbandry Law of the People's Republic of China.
未经审核批准，向境外输出列入畜禽遗传资源保护名录的畜禽遗传资源的，依照《中华人民共和国海关法》的有关规定追究法律责任。海关应当将扣留的畜禽遗传资源移送省、自治区、直辖市人民政府畜牧兽医行政主管部门处理。
If, without review and approval, livestock and poultry genetic resources listed in the protection catalog are exported abroad, legal liability shall be pursued in accordance with the relevant provisions of the Customs Law of the People's Republic of China. The customs shall transfer the detained livestock and poultry genetic resources to the competent animal husbandry and veterinary administrative department of the provincial, autonomous region, or municipality directly under the Central Government for handling.
向境外输出或者在境内与境外机构、个人合作研究利用列入畜禽遗传资源保护名录的畜禽遗传资源，违反国家保密规定的，依照《中华人民共和国保守国家秘密法》的有关规定追究法律责任。
If, when exporting livestock and poultry genetic resources listed in the protection catalog abroad or conducting cooperative research or utilization within China with foreign institutions or individuals using such resources, state secrecy provisions are violated, legal liability shall be pursued in accordance with the relevant provisions of the Law of the People's Republic of China on Guarding State Secrets.
本办法自2008年10月1日起施行。
These Measures shall come into effect as of October 1, 2008.
