总 则
General Provisions
为了高质量推进自然保护区建设，加强对自然保护区的保护和管理，全面推进生态文明和美丽中国建设，加快推进人与自然和谐共生的现代化，制定本条例。
These Regulations are formulated to promote the high-quality construction of nature reserves, strengthen the protection and management of nature reserves, comprehensively advance ecological civilization and the construction of a beautiful China, and accelerate the modernization of harmonious coexistence between humans and nature.
在中华人民共和国领域及管辖的其他海域设立自然保护区、开展自然保护区保护和管理及相关活动，适用本条例。
These Regulations apply to the establishment of nature reserves, the protection and management of nature reserves, and related activities within the territory of the People's Republic of China and other sea areas under its jurisdiction.
本条例所称自然保护区，是指由国务院或者省、自治区、直辖市人民政府批准设立，以保护典型的自然生态系统、珍稀濒危野生动植物物种的天然集中分布区、有特殊意义的自然遗迹等为主要目的，实现自然资源科学保护和合理利用的特定陆地和海洋区域。
For the purposes of these Regulations, 'nature reserve' refers to specific land and sea areas approved by the State Council or the people's government of a province, autonomous region, or municipality directly under the Central Government, with the main purpose of protecting typical natural ecosystems, natural concentrated distribution areas of rare and endangered wild animal and plant species, and natural relics of special significance, and achieving scientific protection and rational utilization of natural resources.
自然保护区建设应当贯彻党和国家路线方针政策、决策部署，践行绿水青山就是金山银山理念，坚持以人民为中心的发展思想，坚持生态保护第一、统筹保护和发展，坚持因地制宜、突出特色，构建政府主导、多方参与、社会共享的机制，实现生态保护、绿色发展、民生改善相统一。
The construction of nature reserves shall implement the Party and national guidelines, policies, decisions, and deployments; practice the concept that lucid waters and lush mountains are invaluable assets; adhere to the people-centered development philosophy; prioritize ecological protection while coordinating protection and development; adapt measures to local conditions and highlight characteristics; and establish a mechanism led by the government, with multi-party participation and social sharing, to achieve the unification of ecological protection, green development, and improvement of people's livelihoods.
国务院和自然保护区所在地县级以上地方人民政府应当加强对自然保护区建设的统筹协调，完善支持自然保护区建设的政策措施，将自然保护区建设纳入国民经济和社会发展相关规划。
The State Council and the local people's governments at or above the county level where the nature reserve is located shall strengthen the overall coordination of nature reserve construction, improve policies and measures to support nature reserve construction, and incorporate nature reserve construction into relevant plans for national economic and social development.
国家建立多元化自然保护区资金保障制度。县级以上人民政府应当按照财政事权与支出责任划分原则将自然保护区管理工作所需经费列入本级预算。
The State establishes a diversified funding guarantee system for nature reserves. People's governments at or above the county level shall include the funds required for the management of nature reserves in their respective budgets in accordance with the principle of division of financial powers and expenditure responsibilities.
国家鼓励通过设立基金、捐赠、资助等方式，为自然保护区建设提供支持。
The State encourages support for nature reserve construction through the establishment of funds, donations, grants, and other means.
国务院林业草原主管部门负责全国自然保护区的监督管理工作。国务院自然资源、生态环境、水行政、农业农村、交通运输等有关部门在各自职责范围内负责自然保护区的有关监督管理工作。
The competent department of forestry and grassland of the State Council is responsible for the supervision and management of nature reserves nationwide. The relevant departments of the State Council, such as natural resources, ecological environment, water administration, agriculture and rural affairs, and transportation, are responsible for the relevant supervision and management of nature reserves within their respective duties.
县级以上地方人民政府林业草原主管部门负责本行政区域内自然保护区的监督管理工作。县级以上地方人民政府其他有关部门在各自职责范围内负责自然保护区的有关监督管理工作。
The competent departments of forestry and grassland of local people's governments at or above the county level are responsible for the supervision and management of nature reserves within their respective administrative regions. Other relevant departments of local people's governments at or above the county level are responsible for the relevant supervision and management of nature reserves within their respective duties.
按照规定设立的各自然保护区管理机构依照本条例和规定的职责，负责各该自然保护区的保护和管理工作。
The management agencies of each nature reserve established in accordance with regulations shall be responsible for the protection and management of that nature reserve in accordance with these Regulations and their prescribed duties.
国务院林业草原主管部门和有关部门按照职责建立健全自然保护区相关技术规范和标准体系，依法组织制定并适时修订自然保护区相关技术规范和标准。
The competent department of forestry and grassland of the State Council and relevant departments shall, in accordance with their duties, establish and improve the relevant technical specifications and standard systems for nature reserves, and organize the formulation and timely revision of relevant technical specifications and standards for nature reserves in accordance with the law.
国家鼓励和支持自然保护区相关科学技术研究开发和应用推广，加强自然保护区相关专业人才培养，强化科技创新对自然保护区建设的支撑作用。
The State encourages and supports scientific and technological research, development, application, and promotion related to nature reserves, strengthens the training of professionals in nature reserves, and enhances the supporting role of scientific and technological innovation in the construction of nature reserves.
国务院林业草原主管部门和有关部门、自然保护区所在地县级以上地方人民政府及其有关部门、自然保护区管理机构应当组织开展多种形式的自然保护区保护宣传教育活动。
The competent department of forestry and grassland of the State Council and relevant departments, the local people's governments at or above the county level where the nature reserve is located and their relevant departments, and the management agencies of nature reserves shall organize and carry out various forms of publicity and education activities on nature reserve protection.
新闻媒体应当开展自然保护区保护公益宣传，依法进行舆论监督。
News media shall carry out public welfare publicity on nature reserve protection and exercise public opinion supervision in accordance with the law.
国家通过多种方式，支持和促进自然保护区领域的国际交流合作。
The State supports and promotes international exchanges and cooperation in the field of nature reserves through various means.
自然保护区的设立
Establishment of Nature Reserves
设立自然保护区应当具有下列条件之一：
The establishment of a nature reserve shall meet one of the following conditions:
(一)典型的自然地理区域、自然生态系统区域以及已经遭受破坏但经保护和修复能够恢复的同类自然生态系统区域；
(1) Typical natural geographical areas, natural ecosystem areas, and similar natural ecosystem areas that have been damaged but can be restored through protection and restoration;
(二)珍稀濒危野生动植物物种的天然集中分布区；
(2) Natural concentrated distribution areas of rare and endangered wild animal and plant species;
(三)具有特殊保护价值的海域、海岸、岛屿、湿地、内陆水域、森林、草原和荒漠；
(3) Sea areas, coasts, islands, wetlands, inland waters, forests, grasslands, and deserts with special protection value;
(四)具有重大科学文化价值的地质剖面、地质构造、古生物化石集中分布区、地貌景观、地质灾变遗迹等自然遗迹；
(4) Natural relics such as geological sections, geological structures, concentrated distribution areas of paleontological fossils, landform landscapes, and geological disaster relics with significant scientific and cultural value;
(五)需要予以特殊保护的其他自然区域。
(5) Other natural areas requiring special protection.
设立自然保护区，应当充分听取有关方面意见，妥善处理与当地经济社会发展和居民生产生活的关系。
When establishing a nature reserve, opinions from relevant parties shall be fully solicited, and the relationship with local economic and social development and the production and living of residents shall be properly handled.
自然保护区分为国家级自然保护区和省级自然保护区。
Nature reserves are divided into national nature reserves and provincial nature reserves.
在国内外有典型意义、在科学上有重大国际影响或者有特殊科学研究价值的自然保护区，以及涉及国家海洋权益的自然保护区，列为国家级自然保护区。其他自然保护区列为省级自然保护区。
Nature reserves that are typical at home and abroad, have significant international scientific impact, or have special scientific research value, as well as nature reserves involving national maritime rights and interests, shall be classified as national nature reserves. Other nature reserves shall be classified as provincial nature reserves.
拟设立国家级自然保护区的，由拟设立的自然保护区所在地省、自治区、直辖市人民政府或者国务院有关部门提出申请，由国务院林业草原主管部门会同有关部门组织评审后，提出审批建议，报国务院批准。
To establish a national nature reserve, an application shall be submitted by the people's government of the province, autonomous region, or municipality directly under the Central Government where the proposed nature reserve is located, or by a relevant department of the State Council. After the competent department of forestry and grassland of the State Council, together with relevant departments, organizes an evaluation and proposes an approval recommendation, it shall be submitted to the State Council for approval.
拟设立省级自然保护区的，由拟设立的自然保护区所在地设区的市、县级人民政府提出申请，由省、自治区、直辖市人民政府林业草原主管部门会同有关部门组织评审后，提出审批建议，报省、自治区、直辖市人民政府批准，并抄送国务院林业草原主管部门和有关部门。
To establish a provincial nature reserve, an application shall be submitted by the people's government of the city divided into districts or county where the proposed nature reserve is located. After the competent department of forestry and grassland of the province, autonomous region, or municipality directly under the Central Government, together with relevant departments, organizes an evaluation and proposes an approval recommendation, it shall be submitted to the people's government of the province, autonomous region, or municipality directly under the Central Government for approval, and a copy shall be sent to the competent department of forestry and grassland of the State Council and relevant departments.
拟设立的自然保护区跨两个以上行政区域的，除由国务院有关部门提出申请的外，由有关行政区域人民政府协商一致后提出申请，按照本条第一款或者第二款规定的程序审批。
If the proposed nature reserve spans two or more administrative regions, unless the application is submitted by a relevant department of the State Council, the application shall be submitted by the people's governments of the relevant administrative regions after reaching consensus, and shall be examined and approved in accordance with the procedures specified in the first or second paragraph of this Article.
国家级自然保护区以所在地地名加“国家级自然保护区”命名；省级自然保护区以所在地地名加“省级自然保护区”命名。有特殊保护对象的自然保护区，可以在所在地地名后加特殊保护对象的名称。
National nature reserves shall be named by adding 'National Nature Reserve' after the place name of the location; provincial nature reserves shall be named by adding 'Provincial Nature Reserve' after the place name of the location. For nature reserves with special protection objects, the name of the special protection object may be added after the place name of the location.
自然保护区区域范围的划定应当统筹考虑自然生态系统等保护对象分布区域的完整性、管理可行性和周边经济社会发展的需要，坚持实事求是、科学合理，经过充分调查和科学论证。
The delineation of the area scope of a nature reserve shall comprehensively consider the integrity of the distribution area of protection objects such as natural ecosystems, management feasibility, and the needs of surrounding economic and social development, adhere to seeking truth from facts and being scientific and reasonable, and undergo full investigation and scientific demonstration.
自然保护区区域范围内不再保留自然公园类自然保护地。自然保护区全部划入国家公园区域范围的，不再保留；部分划入的，未划入部分经科学评估并按照规定程序批准，予以整合或者撤销。
No natural park-type protected areas shall be retained within the area scope of a nature reserve. If a nature reserve is entirely included in the area scope of a national park, it shall no longer be retained; if partially included, the unincluded part shall be integrated or revoked after scientific evaluation and approval in accordance with prescribed procedures.
自然保护区划分为核心保护区和一般控制区，实行分区管控。
Nature reserves are divided into core protection zones and general control zones, with differentiated management and control.
自然保护区的下列区域应当划为核心保护区：
The following areas within a nature reserve shall be designated as core protection zones:
(一)自然生态系统保存完整或者生态脆弱需要休养生息的区域；
(1) Areas where natural ecosystems are well-preserved or ecologically fragile and need to recuperate;
(二)珍稀濒危野生动植物物种的关键分布区域以及生态廊道重要节点；
(2) Key distribution areas of rare and endangered wild animal and plant species and important nodes of ecological corridors;
(三)重要自然遗迹的集中分布区域；
(3) Concentrated distribution areas of important natural relics;
(四)其他需要重点保护的区域。
(4) Other areas requiring key protection.
核心保护区以外的区域划为一般控制区。
Areas outside the core protection zone shall be designated as general control zones.
设立自然保护区后，自然保护区所在地省、自治区、直辖市人民政府应当按照有关规定及时组织完成自然保护区勘界；涉及国家海洋权益的自然保护区，由国务院有关部门组织完成勘界。自然保护区管理机构应当根据保护和管理需要及时设置自然保护区界碑界桩、电子标识或者电子围栏等界线标志。
After the establishment of a nature reserve, the people's government of the province, autonomous region, or municipality directly under the Central Government where the nature reserve is located shall promptly organize the completion of the boundary delimitation of the nature reserve in accordance with relevant regulations; for nature reserves involving national maritime rights and interests, the relevant departments of the State Council shall organize the completion of the boundary delimitation. The management agency of the nature reserve shall, based on the needs of protection and management, promptly set up boundary markers such as boundary monuments, boundary posts, electronic markers, or electronic fences.
禁止损毁、涂改、遮挡或者擅自拆除、移动自然保护区界线标志。
It is prohibited to damage, alter, obscure, or unauthorizedly dismantle or move boundary markers of nature reserves.
国家级自然保护区、省级自然保护区的名称、区域范围、管控分区分别由国务院和所在地省、自治区、直辖市人民政府在批准设立时一并批复，并分别由国务院林业草原主管部门和所在地省、自治区、直辖市人民政府林业草原主管部门依法公布。
The names, area scopes, and management and control zones of national nature reserves and provincial nature reserves shall be approved together by the State Council and the people's government of the province, autonomous region, or municipality directly under the Central Government where they are located at the time of approval, and shall be publicly announced by the competent department of forestry and grassland of the State Council and the competent department of forestry and grassland of the province, autonomous region, or municipality directly under the Central Government, respectively, in accordance with the law.
国务院林业草原主管部门和省、自治区、直辖市人民政府林业草原主管部门应当与有关部门共享自然保护区区域范围、管控分区坐标等信息。
The competent department of forestry and grassland of the State Council and the competent departments of forestry and grassland of provinces, autonomous regions, and municipalities directly under the Central Government shall share information such as the area scope and coordinates of management and control zones of nature reserves with relevant departments.
因自然保护区主要保护对象生存环境发生重大改变，确需调整自然保护区区域范围的，应当按照自然保护区设立的程序，经原批准设立该自然保护区的人民政府批准。自然保护区变更名称，按照前述程序办理。
If the living environment of the main protection objects of a nature reserve undergoes significant changes, and it is truly necessary to adjust the area scope of the nature reserve, it shall be approved by the people's government that originally approved the establishment of the nature reserve in accordance with the procedures for establishing a nature reserve. The change of name of a nature reserve shall be handled in accordance with the aforementioned procedures.
国家级自然保护区、省级自然保护区调整管控分区，应当分别经国务院林业草原主管部门和所在地省、自治区、直辖市人民政府林业草原主管部门会同同级有关部门组织评审后批准。
Adjustments to the management and control zones of national nature reserves and provincial nature reserves shall be approved after evaluation organized by the competent department of forestry and grassland of the State Council and the competent department of forestry and grassland of the province, autonomous region, or municipality directly under the Central Government, respectively, together with relevant departments at the same level.
自然保护区设立后，原则上不得撤销；因特殊情形失去保护价值的，经原批准设立该自然保护区的人民政府批准，可以撤销。
After a nature reserve is established, it shall generally not be revoked; if it loses its protection value due to special circumstances, it may be revoked with the approval of the people's government that originally approved its establishment.
自然保护区的保护和管理
Protection and Management of Nature Reserves
国家坚持山水林田湖草沙一体化保护，按照自然生态系统特性和内在规律，对自然保护区实行整体保护、系统修复、综合治理。
The State adheres to the integrated protection of mountains, waters, forests, farmlands, lakes, grasslands, and deserts, and implements overall protection, systematic restoration, and comprehensive management of nature reserves in accordance with the characteristics and inherent laws of natural ecosystems.
自然保护区管理机构在综合科学考察和专项调查的基础上，根据需要组织编制所管理自然保护区的相关规划(以下称自然保护区规划)，明确保护和管理的目标任务、保护对象、管理要求、保护措施等事项，并对原有居民生产生活活动等作出安排。组织编制自然保护区规划，应当广泛听取有关方面意见、深入论证。
The management agency of a nature reserve shall, based on comprehensive scientific surveys and special investigations, organize the preparation of relevant plans for the nature reserve under its management (hereinafter referred to as nature reserve plans) as needed, specifying the objectives, tasks, protection objects, management requirements, protection measures, and other matters for protection and management, and making arrangements for the production and living activities of original residents. When organizing the preparation of nature reserve plans, opinions from relevant parties shall be widely solicited and in-depth demonstration shall be conducted.
国家级自然保护区规划经所在地省、自治区、直辖市人民政府林业草原主管部门审查同意后，报国务院林业草原主管部门批准实施；涉及国家海洋权益的自然保护区规划，经国务院有关部门审查同意后，报国务院林业草原主管部门批准实施。省级自然保护区规划报所在地省、自治区、直辖市人民政府林业草原主管部门批准实施。规划审批前，应当征求同级有关部门意见。
The plan for a national nature reserve shall be submitted to the competent department of forestry and grassland of the State Council for approval after being reviewed and approved by the competent department of forestry and grassland of the province, autonomous region, or municipality directly under the Central Government where it is located; for nature reserves involving national maritime rights and interests, the plan shall be submitted to the competent department of forestry and grassland of the State Council for approval after being reviewed and approved by the relevant department of the State Council. The plan for a provincial nature reserve shall be submitted to the competent department of forestry and grassland of the province, autonomous region, or municipality directly under the Central Government where it is located for approval. Before the plan is approved, opinions from relevant departments at the same level shall be solicited.
自然保护区规划应当与国民经济和社会发展规划、国土空间总体规划等相衔接，并纳入国土空间规划实施监督信息系统，接受统一监管。自然保护区规划应当依法公开。
Nature reserve plans shall be coordinated with national economic and social development plans, overall territorial space plans, etc., and shall be incorporated into the territorial space planning implementation supervision information system for unified supervision. Nature reserve plans shall be publicly disclosed in accordance with the law.
自然保护区管理机构应当依据法律、法规、国家有关规定和自然保护区规划，健全完善自然保护区保护和管理的规章制度，加强自然保护区日常保护和管理工作。
The management agency of a nature reserve shall, in accordance with laws, regulations, relevant national provisions, and nature reserve plans, establish and improve the rules and regulations for the protection and management of the nature reserve, and strengthen the daily protection and management of the nature reserve.
自然保护区区域内的单位、个人以及进入自然保护区的人员，应当遵守法律、法规、自然保护区保护和管理的规章制度，接受自然保护区管理机构的管理。
Units and individuals within the area of the nature reserve, as well as persons entering the nature reserve, shall comply with laws, regulations, and the rules and regulations for the protection and management of the nature reserve, and accept the management of the nature reserve management agency.
对自然保护区区域内的自然资源，按照国家自然资源确权登记有关规定进行确权登记，确权登记时应当将自然保护区作为独立登记单元。
Natural resources within the area of a nature reserve shall be registered in accordance with the relevant provisions on the registration of natural resources rights, and the nature reserve shall be treated as an independent registration unit during registration.
国家加强自然保护区监测网络体系建设，充分发挥各类监测站点的作用，运用信息化手段加强监测数据集成分析、共享和综合应用，全面掌握自然生态系统构成、分布、动态变化和生物多样性状况以及生态环境质量、人为活动干扰情况，及时评估和预警生态风险。
The State strengthens the construction of a monitoring network system for nature reserves, fully utilizes the role of various monitoring stations, uses information technology to strengthen the integrated analysis, sharing, and comprehensive application of monitoring data, comprehensively grasps the composition, distribution, dynamic changes, and biodiversity status of natural ecosystems, as well as the quality of the ecological environment and the interference of human activities, and promptly assesses and provides early warning of ecological risks.
自然保护区区域内受损自然生态系统修复、生态廊道连通、重要栖息地恢复等应当坚持自然恢复为主；确有必要开展种群调控、树种更新等人工修复活动的，应当充分听取有关方面意见，按照有关规定制定科学合理的修复方案并依法实施。
The restoration of damaged natural ecosystems, the connection of ecological corridors, and the restoration of important habitats within the area of a nature reserve shall adhere to the principle of natural restoration as the main approach; if it is truly necessary to carry out artificial restoration activities such as population regulation and tree species renewal, opinions from relevant parties shall be fully solicited, and a scientific and reasonable restoration plan shall be formulated and implemented in accordance with relevant regulations.
自然保护区管理机构应当采取措施，加强对外来物种入侵的防范和应对，维护生态系统安全，提高生态系统质量。
The management agency of a nature reserve shall take measures to strengthen the prevention and response to the invasion of alien species, maintain the safety of the ecosystem, and improve the quality of the ecosystem.
除下列活动外，自然保护区核心保护区内禁止人为活动：
Except for the following activities, human activities are prohibited in the core protection zone of a nature reserve:
(一)为保护自然保护区开展的调查监测、生态修复、管护巡护等活动，科研观测、基础测绘、文物和其他文化遗产保护、防灾减灾、应急救援活动，以及国家机关依法履行执法职责确需开展的活动；
(1) Activities such as survey and monitoring, ecological restoration, management and patrol for the purpose of protecting the nature reserve, scientific research observation, basic surveying and mapping, cultural relics and other cultural heritage protection, disaster prevention and mitigation, emergency rescue activities, and activities that state organs truly need to carry out in performing their law enforcement duties;
(二)原有居民必要的生产生活活动，以及确需保留、无法避让的已有重要基础设施的运行、维护、改造；
(2) Necessary production and living activities of original residents, as well as the operation, maintenance, and renovation of existing important infrastructure that must be retained and cannot be avoided;
(三)必须且无法避让、以生态环境无害化方式穿越地下、水下或者空中的线性基础设施建设；
(3) Linear infrastructure construction that is necessary and unavoidable, and that passes through underground, underwater, or air in an ecologically harmless manner;
(四)为维护国家安全、实施国家重大战略确需开展的活动，以及无法避让的国家重大项目建设；
(4) Activities that are truly necessary to maintain national security and implement major national strategies, as well as major national projects that cannot be avoided;
(五)法律、行政法规规定或者国务院批准的其他活动。
(5) Other activities stipulated by laws, administrative regulations, or approved by the State Council.
自然保护区一般控制区内仅允许开展下列人为活动：
Only the following human activities are allowed in the general control zone of a nature reserve:
(一)核心保护区允许开展的活动；
(1) Activities allowed in the core protection zone;
(二)符合国土空间规划且无法避让的重要基础设施的建设、运行和维护；
(2) Construction, operation, and maintenance of important infrastructure that conforms to the territorial space plan and cannot be avoided;
(三)古生物化石调查发掘，基础地质调查，战略性矿产资源远景调查和规定范围内的战略性矿产资源勘查；
(3) Investigation and excavation of paleontological fossils, basic geological surveys, prospective surveys of strategic mineral resources, and exploration of strategic mineral resources within specified scopes;
(四)珍稀濒危野生动植物的野化、繁殖，非破坏性的标本采集活动；
(4) Rewilding and breeding of rare and endangered wild animals and plants, and non-destructive specimen collection activities;
(五)与自然保护区保护目标一致的人工商品林抚育、树种更新等森林经营活动；
(5) Forest management activities such as tending and tree species renewal of artificial commercial forests consistent with the protection objectives of the nature reserve;
(六)科普宣传、生态旅游、教育文化体育等公共服务活动；
(6) Public service activities such as science popularization, ecological tourism, education, culture, and sports;
(七)法律、行政法规规定或者国务院批准的其他活动。
(7) Other activities stipulated by laws, administrative regulations, or approved by the State Council.
对下列情形的自然保护区，经科学论证，在确保主要保护对象安全和不损害生态功能的前提下，可以实行差别化管控措施：
For nature reserves in the following circumstances, after scientific demonstration, and on the premise of ensuring the safety of the main protection objects and not damaging ecological functions, differentiated management and control measures may be implemented:
(一)主要保护对象为自然遗迹的自然保护区，可以在核心保护区建设必要的防护、陈列、展示等设施，开展古生物化石调查发掘以及适度的科普宣传、生态旅游、教育文化体育等公共服务活动；
(1) For nature reserves whose main protection objects are natural relics, necessary facilities for protection, display, and exhibition may be built in the core protection zone, and activities such as investigation and excavation of paleontological fossils, as well as appropriate public service activities such as science popularization, ecological tourism, education, culture, and sports may be carried out;
(二)主要保护对象位于地下的自然保护区，其核心保护区地上部分可以按照一般控制区保护和管理；
(2) For nature reserves whose main protection objects are located underground, the above-ground part of the core protection zone may be protected and managed in accordance with the general control zone;
(三)自然生态过程、主要保护对象生息繁衍具有明显季节性变化规律的自然保护区，可以实行季节性差别管控措施。
(3) For nature reserves where the natural ecological processes and the reproduction and migration of main protection objects have obvious seasonal variation patterns, seasonal differentiated management and control measures may be implemented.
自然保护区区域内原有居民的生产生活活动，应当以不超出现有规模和利用强度、合理改善生产生活条件为前提。
The production and living activities of original residents within the area of a nature reserve shall be based on the premise of not exceeding the existing scale and intensity of use and reasonably improving production and living conditions.
根据保护和管理需要，自然保护区区域内原有居民确有必要迁出的，由有关地方人民政府妥善安置。
If it is truly necessary to relocate original residents within the area of a nature reserve based on protection and management needs, the relevant local people's government shall make proper arrangements.
未经批准，外国人不得在自然保护区区域内从事标本采集等活动。
Without approval, foreigners are prohibited from engaging in activities such as specimen collection within the area of a nature reserve.
在自然保护区开展本条例第二十六条、第二十七条、第二十八条规定的活动，依法需要办理相关手续的，有关单位和个人应当依法办理；涉及修筑设施的，还应当经国务院林业草原主管部门或者所在地省、自治区、直辖市人民政府林业草原主管部门同意，但原有居民必要的生产生活活动、原有线性基础设施的运行维护活动以及自然保护区管理机构依据自然保护区规划修筑管护巡护、科研观测、科普宣传、防灾减灾等设施的除外。
When carrying out activities specified in Articles 26, 27, and 28 of these Regulations within a nature reserve, if relevant procedures are required to be handled in accordance with the law, the relevant units and individuals shall handle them in accordance with the law; if the construction of facilities is involved, the consent of the competent department of forestry and grassland of the State Council or the competent department of forestry and grassland of the province, autonomous region, or municipality directly under the Central Government where it is located shall also be obtained, except for necessary production and living activities of original residents, operation and maintenance activities of existing linear infrastructure, and the construction of facilities such as management and patrol, scientific research observation, science popularization, and disaster prevention and mitigation by the nature reserve management agency in accordance with the nature reserve plan.
在自然保护区开展调查监测、科研观测、标本采集的单位和个人，应当按照自然保护区管理机构的要求，提交相关活动成果。在自然保护区开展本条例第二十六条、第二十七条、第二十八条规定的活动，应当采取必要措施，避免或者减少对自然生态系统、生态廊道、重要栖息地以及自然和人文景观的不利影响。自然保护区管理机构应当根据实际情况和需要，明确开展相关活动的边界、强度以及应当采取的保护性措施等。
Units and individuals carrying out survey and monitoring, scientific research observation, and specimen collection within a nature reserve shall submit relevant activity results in accordance with the requirements of the nature reserve management agency. When carrying out activities specified in Articles 26, 27, and 28 of these Regulations within a nature reserve, necessary measures shall be taken to avoid or reduce adverse impacts on natural ecosystems, ecological corridors, important habitats, and natural and cultural landscapes. The nature reserve management agency shall, based on actual conditions and needs, specify the boundaries, intensity, and protective measures to be taken for carrying out relevant activities.
自然保护区管理机构应当建立日常巡护制度，合理配备巡护人员和巡护装备，加强巡护站点建设。巡护人员应当观察和记录主要保护对象生境状况及其变化情况，对违反自然保护区保护和管理规定的行为予以劝阻、制止并及时报告。
The management agency of a nature reserve shall establish a daily patrol system, reasonably equip patrol personnel and patrol equipment, and strengthen the construction of patrol stations. Patrol personnel shall observe and record the habitat status and changes of the main protection objects, and dissuade, stop, and promptly report any violations of the protection and management regulations of the nature reserve.
自然保护区管理机构应当制定自然保护区突发事件应急预案，加强与所在地人民政府有关部门的协作配合，做好防灾减灾、安全管理和应急保障相关工作，提升应急保障能力。
The management agency of a nature reserve shall formulate an emergency response plan for the nature reserve, strengthen coordination and cooperation with relevant departments of the local people's government, do a good job in disaster prevention and mitigation, safety management, and emergency support related work, and enhance emergency support capabilities.
自然保护区管理机构应当在确保生态得到保护的前提下，完善自然保护区公共服务体系，提升公共服务功能。自然保护区一般控制区可以划定适当区域，设置必要的辅助设施设备，为开展相关科学研究、科普宣传、生态旅游、教育文化体育等公共服务活动提供支持。
The management agency of a nature reserve shall, on the premise of ensuring ecological protection, improve the public service system of the nature reserve and enhance public service functions. In the general control zone of a nature reserve, appropriate areas may be delineated and necessary auxiliary facilities and equipment may be set up to provide support for carrying out public service activities such as relevant scientific research, science popularization, ecological tourism, education, culture, and sports.
自然保护区管理机构应当加强自然保护区访客管理和服务，合理确定访客容量，明确访客行为规范，按照国家有关规定提供必要的无障碍服务，完善访客安全保障和紧急救助等相关机制。
The management agency of a nature reserve shall strengthen visitor management and services in the nature reserve, reasonably determine visitor capacity, specify visitor behavior norms, provide necessary barrier-free services in accordance with relevant national regulations, and improve relevant mechanisms for visitor safety and emergency rescue.
自然保护区区域内不得开设与保护目标不一致的参观、旅游等项目。
No visits, tourism, or other projects inconsistent with the protection objectives shall be opened within the area of a nature reserve.
县级以上人民政府林业草原主管部门，自然资源、生态环境、水行政、农业农村等有关部门，以及自然保护区管理机构，应当依据职责加强对自然保护区保护情况的监督检查，依法查处违法行为。
The competent departments of forestry and grassland of people's governments at or above the county level, relevant departments such as natural resources, ecological environment, water administration, and agriculture and rural affairs, as well as the management agencies of nature reserves, shall, in accordance with their duties, strengthen the supervision and inspection of the protection of nature reserves, and investigate and deal with illegal acts in accordance with the law.
海警机构依照《中华人民共和国海警法》的规定，在职责范围内对自然保护区区域内海岸线向海一侧的保护情况进行监督检查，依法查处违法行为。
The coast guard agency shall, in accordance with the provisions of the Coast Guard Law of the People's Republic of China, supervise and inspect the protection of the seaward side of the coastline within the area of the nature reserve within its duties, and investigate and deal with illegal acts in accordance with the law.
监督检查人员开展监督检查，应当主动出示执法证件。被检查单位和个人应当予以配合，不得拒绝、阻碍。
Inspectors conducting supervision and inspection shall proactively present their law enforcement credentials. The units and individuals being inspected shall cooperate and shall not refuse or obstruct.
公安机关可以根据需要在自然保护区设置工作站点，开展生态警务工作。
Public security organs may set up workstations within nature reserves as needed to carry out ecological policing work.
有关国家机关依法在自然保护区履行法定职责的，自然保护区管理机构应当提供必要便利。
When relevant state organs perform their statutory duties within a nature reserve in accordance with the law, the nature reserve management agency shall provide necessary convenience.
对违反自然保护区保护和管理规定的行为，任何单位和个人有权向自然保护区管理机构或者有关部门举报，接到举报的自然保护区管理机构和有关部门应当依法及时处理。
Any unit or individual has the right to report violations of the protection and management regulations of a nature reserve to the nature reserve management agency or relevant departments. The nature reserve management agency or relevant department that receives the report shall handle it promptly in accordance with the law.
自然保护区管理机构应当依法及时公开自然保护区保护和管理等工作情况，自觉接受社会监督和舆论监督。
The management agency of a nature reserve shall promptly disclose information on the protection and management of the nature reserve in accordance with the law, and consciously accept social supervision and public opinion supervision.
法 律 责 任
Legal Liability
自然保护区管理机构、县级以上地方人民政府及其有关部门、国务院有关部门工作人员在自然保护区保护和管理等工作中滥用职权、玩忽职守、徇私舞弊的，依法给予处分。
If staff members of the management agency of a nature reserve, local people's governments at or above the county level and their relevant departments, or relevant departments of the State Council abuse their power, neglect their duties, or engage in malpractice for personal gain in the protection and management of nature reserves, they shall be given sanctions in accordance with the law.
损毁、涂改、遮挡或者擅自拆除、移动自然保护区界线标志的，由自然保护区管理机构责令停止违法行为、采取补救措施，可以处2万元以下的罚款；造成损失的，依法承担赔偿责任。
Anyone who damages, alters, obscures, or unauthorizedly dismantles or moves boundary markers of a nature reserve shall be ordered by the nature reserve management agency to cease the illegal act and take remedial measures, and may be fined up to 20,000 yuan; if losses are caused, compensation shall be paid in accordance with the law.
在自然保护区开展调查监测、科研观测、标本采集的单位和个人，未向自然保护区管理机构提交相关活动成果的，由自然保护区管理机构责令改正，可以处5000元以下的罚款。
If units or individuals carrying out survey and monitoring, scientific research observation, or specimen collection within a nature reserve fail to submit relevant activity results to the nature reserve management agency, the nature reserve management agency shall order them to make corrections and may impose a fine of up to 5,000 yuan.
在自然保护区核心保护区内开展本条例第二十六条规定以外的活动的，由县级以上人民政府林业草原、自然资源、生态环境、水行政、农业农村等有关部门按照职责分工责令停止违法行为，没收违法所得，可以处10万元以下的罚款；属于违法修筑设施或者进行工程建设的，责令限期拆除、恢复原状，处10万元以上100万元以下的罚款；造成生态破坏的，责令限期修复或者采取其他补救措施，处100万元以上500万元以下的罚款。
Anyone who carries out activities other than those specified in Article 26 of these Regulations within the core protection zone of a nature reserve shall be ordered by the relevant department of the people's government at or above the county level, such as forestry and grassland, natural resources, ecological environment, water administration, or agriculture and rural affairs, in accordance with their respective duties, to cease the illegal act, confiscate the illegal gains, and may be fined up to 100,000 yuan; if the act involves the unauthorized construction of facilities or engineering construction, the person shall be ordered to dismantle them within a time limit and restore the original state, and shall be fined between 100,000 yuan and 1,000,000 yuan; if ecological damage is caused, the person shall be ordered to restore the ecology within a time limit or take other remedial measures, and shall be fined between 1,000,000 yuan and 5,000,000 yuan.
在自然保护区一般控制区内开展本条例第二十七条规定以外的活动的，由县级以上人民政府林业草原、自然资源、生态环境、水行政、农业农村等有关部门按照职责分工责令停止违法行为，没收违法所得，可以处5万元以下的罚款；属于违法修筑设施或者进行工程建设的，责令限期拆除、恢复原状，处5万元以上50万元以下的罚款；造成生态破坏的，责令限期修复或者采取其他补救措施，处50万元以上200万元以下的罚款。
Anyone who carries out activities other than those specified in Article 27 of these Regulations within the general control zone of a nature reserve shall be ordered by the relevant department of the people's government at or above the county level, such as forestry and grassland, natural resources, ecological environment, water administration, or agriculture and rural affairs, in accordance with their respective duties, to cease the illegal act, confiscate the illegal gains, and may be fined up to 50,000 yuan; if the act involves the unauthorized construction of facilities or engineering construction, the person shall be ordered to dismantle them within a time limit and restore the original state, and shall be fined between 50,000 yuan and 500,000 yuan; if ecological damage is caused, the person shall be ordered to restore the ecology within a time limit or take other remedial measures, and shall be fined between 500,000 yuan and 2,000,000 yuan.
自然保护区区域内原有居民违反本条例第二十九条第一款规定开展生产生活活动的，由自然保护区管理机构责令改正，根据情节轻重可以处2000元以下的罚款。
If original residents within the area of a nature reserve carry out production and living activities in violation of the provisions of the first paragraph of Article 29 of these Regulations, the nature reserve management agency shall order them to make corrections and may impose a fine of up to 2,000 yuan depending on the severity of the circumstances.
在自然保护区区域内开展本条例第二十六条、第二十七条、第二十八条规定的活动，未采取必要措施避免或者减少对自然生态系统、生态廊道、重要栖息地以及自然和人文景观的不利影响的，由县级以上人民政府林业草原、自然资源、生态环境、水行政、农业农村等有关部门按照职责分工责令改正，可以处10万元以下的罚款；造成生态破坏的，责令限期修复或者采取其他补救措施，相关活动在核心保护区开展的，处10万元以上50万元以下的罚款，在一般控制区开展的，处5万元以上20万元以下的罚款。
If, when carrying out activities specified in Articles 26, 27, and 28 of these Regulations within a nature reserve, necessary measures are not taken to avoid or reduce adverse impacts on natural ecosystems, ecological corridors, important habitats, and natural and cultural landscapes, the relevant department of the people's government at or above the county level, such as forestry and grassland, natural resources, ecological environment, water administration, or agriculture and rural affairs, shall, in accordance with their respective duties, order corrections and may impose a fine of up to 100,000 yuan; if ecological damage is caused, the person shall be ordered to restore the ecology within a time limit or take other remedial measures, and if the relevant activity is carried out in the core protection zone, a fine of between 100,000 yuan and 500,000 yuan shall be imposed; if carried out in the general control zone, a fine of between 50,000 yuan and 200,000 yuan shall be imposed.
本条例第四十条、第四十一条、第四十三条规定的违法行为，发生在自然保护区区域内海岸线向海一侧的，海警机构在职责范围内依法实施处罚。
For illegal acts specified in Articles 40, 41, and 43 of these Regulations that occur on the seaward side of the coastline within the area of a nature reserve, the coast guard agency shall impose penalties within its duties in accordance with the law.
对本条例第四十条、第四十一条、第四十三条规定的违法行为，有关行政法规规定的罚款数额高于本条例规定的，适用其规定。
For illegal acts specified in Articles 40, 41, and 43 of these Regulations, if the amount of fine stipulated by relevant administrative regulations is higher than that stipulated in these Regulations, the former shall apply.
自然保护区区域内的单位、个人以及进入自然保护区的人员不服从自然保护区管理机构管理的，自然保护区管理机构有权予以劝阻、制止；构成扰乱公共秩序等违反治安管理行为的，由公安机关依法给予治安管理处罚。
If units, individuals within the area of a nature reserve, or persons entering the nature reserve do not comply with the management of the nature reserve management agency, the nature reserve management agency has the right to dissuade and stop them; if the act constitutes a violation of public security management such as disturbing public order, the public security organ shall impose public security penalties in accordance with the law.
违反本条例规定，破坏自然资源或者污染环境、破坏生态的，依法承担民事责任；构成犯罪的，依法追究刑事责任。
Anyone who, in violation of these Regulations, damages natural resources or pollutes the environment or damages the ecology shall bear civil liability in accordance with the law; if a crime is constituted, criminal liability shall be investigated in accordance with the law.
附 则
Supplementary Provisions
涉及国家海洋权益的自然保护区，由国务院林业草原主管部门会同有关部门根据本条例制定具体管理办法。
For nature reserves involving national maritime rights and interests, the competent department of forestry and grassland of the State Council shall, together with relevant departments, formulate specific management measures in accordance with these Regulations.
省、自治区、直辖市人民政府可以根据本条例，制定实施办法。
People's governments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate implementation measures in accordance with these Regulations.
本条例自2026年3月15日起施行。
These Regulations shall come into force on March 15, 2026.
