根据《中华人民共和国海商法》第一百一十七条、第二百一十一条的规定，制定本规定。
These Provisions are formulated in accordance with Articles 117 and 211 of the Maritime Code of the People's Republic of China.
本规定适用于中华人民共和国港口之间海上旅客运输。
These Provisions apply to the carriage of passengers by sea between ports of the People's Republic of China.
承运人在每次海上旅客运输中的赔偿责任限额，按照下列规定执行：
The limits of liability of the carrier for each carriage of passengers by sea shall be implemented in accordance with the following provisions:
(一)旅客人身伤亡的，每名旅客不超过4万元人民币；
(1) For personal injury or death of a passenger, the limit shall not exceed 40,000 RMB per passenger;
(二)旅客自带行李灭失或者损坏的，每名旅客不超过800元人民币；
(2) For loss of or damage to the passenger's cabin luggage, the limit shall not exceed 800 RMB per passenger;
(三)旅客车辆包括该车辆所载行李灭失或者损坏的，每一车辆不超过3200元人民币；
(3) For loss of or damage to the passenger's vehicle, including luggage carried in the vehicle, the limit shall not exceed 3,200 RMB per vehicle;
(四)本款第(二)项、第(三)项以外的旅客其他行李灭失或者损坏的，每千克不超过20元人民币。
(4) For loss of or damage to other luggage of the passenger other than those specified in subparagraphs (2) and (3) of this paragraph, the limit shall not exceed 20 RMB per kilogram.
承运人和旅客可以书面约定高于本条第一款规定的赔偿责任限额。
The carrier and the passenger may agree in writing on a higher limit of liability than that specified in the preceding paragraph.
海上旅客运输的旅客人身伤亡赔偿责任限制，按照4万元人民币乘以船舶证书规定的载客定额计算赔偿限额，但是最高不超过2100万元人民币。
The limitation of liability for personal injury or death of passengers in the carriage of passengers by sea shall be calculated as 40,000 RMB multiplied by the passenger capacity specified in the ship's certificate, but shall not exceed 21,000,000 RMB.
向外籍旅客、华侨和港、澳、台胞旅客给付的赔偿金，可以兑换成该外国或者地区的货币。其汇率按照赔偿金给付之日中华人民共和国外汇管理部门公布的外汇牌价确定。
Compensation paid to foreign passengers, overseas Chinese, and passengers from Hong Kong, Macao, and Taiwan may be converted into the currency of that foreign country or region. The exchange rate shall be determined according to the foreign exchange rate published by the foreign exchange administration department of the People's Republic of China on the date of payment of the compensation.
本规定由中华人民共和国交通部负责解释。
These Provisions shall be interpreted by the Ministry of Communications of the People's Republic of China.
本规定自一九九四年一月一日起施行。
These Provisions shall come into force as of January 1, 1994.
