When preparing river basin plans, water conservancy and hydropower project plans related to navigation, and conducting the design of such projects, the competent water conservancy and hydropower departments at all levels must have the participation of the competent transport departments at the same level.

Navigable channels shall be classified into technical grades. The classification of technical grades of navigable channels shall be proposed by the competent transport departments of provinces, autonomous regions, and municipalities directly under the Central Government or the management agencies stationed by the Ministry of Transport in water systems based on navigation standards. Grades 1 to 4 navigable channels shall be studied and approved by the Ministry of Transport jointly with the Ministry of Water Resources and Electric Power and other relevant departments, and reported to the State Council for record; navigable channels below grade 4 shall be approved by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, and reported to the Ministry of Transport for record.

航道和航道设施受国家保护,任何单位和个人均不得侵占或者破坏。交通部门应当加强对航道的养护,保证航道畅通。

TranslationArticle 13

Navigable channels and channel facilities are protected by the state, and no unit or individual may encroach upon or damage them. The transportation department shall strengthen the maintenance of navigable channels to ensure their unimpeded condition.

The construction of facilities related to navigation, or the regulation of rivers, or the diversion of water for irrigation, must comply with the national standards and technical requirements for navigation, and the opinions of the competent transportation department shall be sought in advance.

Translation

If the provisions of the preceding paragraph are violated, resulting in the interruption or deterioration of navigable conditions, the construction unit or individual shall compensate for the losses and shall be responsible for restoring navigation within a specified period.

TranslationArticle 15

When constructing permanent river-crossing dams or sluices on navigable rivers, the construction unit must, in accordance with the design and construction plan, simultaneously construct appropriately sized structures for the passage of ships, timber, and fish, and resolve the issue of navigation for ships and rafts during the construction period. The construction costs of the ship-passing, timber-passing, and fish-passing structures shall be borne by the construction unit.

If a dam or sluice constructed on a non-navigable river or artificial channel can later become navigable, the construction unit shall simultaneously construct appropriately sized ship-passing structures; if simultaneous construction is not possible, a location for the future construction of ship-passing structures shall be reserved. If temporary dams or sluices need to be constructed on navigable rivers due to urgent drought relief needs, approval must be obtained from the people's government at or above the county level. After the drought is alleviated, the unit that constructed the dam or sluice must promptly remove it and restore navigable conditions.

For dams, sluices, bridges, and other structures that obstruct navigation on navigable rivers, as well as channel siltation caused by such structures, the local people's government shall, in accordance with the principle of 'whoever causes the obstruction shall restore navigation,' instruct the relevant department to modify the obstructive structures or construct ship-passing, timber-passing, and fish-passing structures within a specified period, remove siltation, and restore navigation.

TranslationArticle 18

When constructing water conservancy projects on navigable river sections or upstream to control or divert water sources, the construction unit shall ensure the navigable flow required for the channel and ship locks. In special circumstances, if controlling water sources or diverting large amounts of water affects navigation, the construction unit shall take corresponding engineering measures, and the local people's government shall organize relevant departments to negotiate and reasonably allocate water quantities.

When the management department of water conservancy and hydropower projects formulates dispatch and operation plans involving navigable flow, water levels, and navigation safety, it shall consult with the competent transportation department in advance. If consultation fails to reach an agreement, the matter shall be decided by the people's government at or above the county level.

Penalty Provisions

对违反本条例规定的单位和个人,县以上交通主管部门可以视情节轻重给予警告、罚款的处罚。

TranslationArticle 27

For units or individuals that violate the provisions of these Regulations, the competent transportation department at or above the county level may, depending on the severity of the circumstances, impose penalties such as warnings or fines.

当事人对交通主管部门的处罚不服的,可以向上级交通主管部门提出申诉;对上级交通主管部门的处理不服的,可以在接到处理决定书之日起15日内向人民法院起诉。逾期不起诉又不履行的,交通主管部门可以申请人民法院强制执行。

If a party disagrees with the penalty imposed by the competent transportation department, it may appeal to the superior competent transportation department; if it disagrees with the decision of the superior competent transportation department, it may file a lawsuit with the people's court within 15 days from the date of receipt of the decision. If the party neither files a lawsuit nor complies within the time limit, the competent transportation department may apply to the people's court for compulsory enforcement.

"Navigable channel" refers to the waters along the coast, rivers, lakes, and canals of the People's Republic of China where vessels and rafts can navigate.

“国家航道”是指:(一)构成国家航道网、可以通航五百吨级以上船舶的内河干线航道;(二)跨省、自治区、直辖市,可以常年通航三百吨级以上船舶的内河干线航道;(三)沿海干线航道和主要海港航道;(四)国家指定的重要航道。

Translation

"National channel" refers to: (1) inland trunk channels that form the national navigable channel network and can accommodate vessels of 500 deadweight tons or more; (2) inland trunk channels that cross provinces, autonomous regions, or municipalities directly under the Central Government and can accommodate vessels of 300 deadweight tons or more year-round; (3) coastal trunk channels and major seaport channels; (4) important channels designated by the state.
