为了加强海上航行警告和航行通告的管理，保障船舶、设施的航行和作业安全，根据《中华人民共和国海上交通安全法》有关规定，制定本规定。
These Provisions are formulated in accordance with the relevant provisions of the Maritime Traffic Safety Law of the People's Republic of China to strengthen the administration of maritime navigation warnings and navigational notices and to ensure the safety of navigation and operations of vessels and installations.
本规定适用于在中华人民共和国沿海水域从事影响或者可能影响海上交通安全的各种活动的船舶、设施和人员，以及负责发布海上航行警告、航行通告的有关单位和人员。
These Provisions apply to vessels, installations, and personnel engaged in activities that affect or may affect maritime traffic safety in the coastal waters of the People's Republic of China, as well as to the relevant entities and personnel responsible for issuing maritime navigation warnings and navigational notices.
中华人民共和国港务监督机构(以下简称国家主管机关)主管全国海上航行警告和航行通告的统一发布工作。
The Harbor Superintendency Administration of the People's Republic of China (hereinafter referred to as the National Competent Authority) shall be in charge of the unified issuance of maritime navigation warnings and navigational notices nationwide.
沿海水域港务监督机构(以下简称区域主管机关)主管本管辖区域内海上航行警告和航行通告的统一发布工作。
The harbor superintendency administrations in coastal waters (hereinafter referred to as the Regional Competent Authorities) shall be in charge of the unified issuance of maritime navigation warnings and navigational notices within their respective jurisdictions.
沿海水域港务监督机构的管辖区域由国家主管机关确定。
The jurisdictions of the harbor superintendency administrations in coastal waters shall be determined by the National Competent Authority.
海上航行警告由国家主管机关或者其授权的机关以无线电报或者无线电话的形式发布。
Maritime navigation warnings shall be issued by the National Competent Authority or its authorized agency in the form of radiotelegraphy or radiotelephony.
海上航行通告由国家主管机关或者区域主管机关以书面形式或者通过报纸、广播、电视等新闻媒介发布。
Maritime navigational notices shall be issued by the National Competent Authority or the Regional Competent Authorities in written form or through news media such as newspapers, radio, and television.
在中华人民共和国沿海水域从事下列活动，必须事先向所涉及的海区的区域主管机关申请发布海上航行警告、航行通告：
Any of the following activities conducted in the coastal waters of the People's Republic of China must apply in advance to the Regional Competent Authority of the sea area concerned for the issuance of maritime navigation warnings and navigational notices:
(一)改变航道、航槽；
(1) Altering navigation channels or fairways;
(二)划定、改动或者撤销禁航区、抛泥区、水产养殖区、测速区、水上娱乐区；
(2) Delineating, modifying, or abolishing prohibited anchorage areas, dumping grounds, aquaculture areas, speed trial zones, or water recreation areas;
(三)设置或者撤除公用罗经标、消磁场；
(3) Installing or removing public compass calibration ranges or degaussing ranges;
(四)打捞沉船、沉物；
(4) Salvaging sunken vessels or objects;
(五)铺设、撤除、检修电缆和管道；
(5) Laying, removing, or repairing cables and pipelines;
(六)设置、撤除系船浮筒及其他建筑物；
(6) Installing or removing mooring buoys or other structures;
(七)设置、撤除用于海上勘探开发的设施和其安全区；
(7) Installing or removing facilities for offshore exploration and development and their safety zones;
(八)从事扫海、疏浚、爆破、打桩、拔桩、起重、钻探等作业；
(8) Conducting operations such as sweeping, dredging, blasting, pile driving, pile pulling, hoisting, or drilling;
(九)进行使船舶航行能力受到限制的超长、超高、笨重拖带作业；
(9) Conducting towing operations involving over-length, over-height, or heavy objects that restrict the vessel's maneuverability;
(十)进行有碍海上航行安全的海洋地质调查、勘探和水文测量；
(10) Conducting marine geological surveys, exploration, or hydrographic surveys that may affect maritime navigation safety;
(十一)进行其他影响海上航行和作业安全的活动。
(11) Conducting other activities affecting the safety of maritime navigation and operations.
军事单位划定、改动或者撤销军事禁航区、军事训练区，由国家主管机关或者区域主管机关发布海上航行警告、航行通告。
Where military units delineate, modify, or abolish military prohibited areas or military training areas, the National Competent Authority or the Regional Competent Authority shall issue maritime navigation warnings and navigational notices.
组织或者从事本规定第五条第一款所列各项活动的单位，应当在活动开始之日的七天前向该项活动所涉及海区的区域主管机关递交发布海上航行警告、航行通告的书面申请。但是，有特殊情况，经区域主管机关认定，需要立即发布海上航行警告、航行通告的除外。从事本规定第五条第一款第(九)项所列活动的，依照本规定第七条执行。
Entities organizing or conducting any of the activities listed in paragraph 1 of Article 5 shall submit a written application for the issuance of maritime navigation warnings and navigational notices to the Regional Competent Authority of the sea area concerned at least seven days before the start date of the activity, except where special circumstances recognized by the Regional Competent Authority require immediate issuance of maritime navigation warnings and navigational notices. Activities listed in item (9) of paragraph 1 of Article 5 shall be handled in accordance with Article 7.
书面申请应当包括下列内容：
The written application shall include the following:
(一)活动起止日期和每日活动时间；
(1) The start and end dates of the activity and the daily activity time;
(二)活动内容和活动方式；
(2) The content and method of the activity;
(三)参加活动的船舶、设施和单位的名称；
(3) Names of vessels, installations and units participating in the activity;
(四)活动区域；
(4) Activity area;
(五)安全措施。
(5) Safety measures.
船舶从事本规定第五条第(九)项所列活动的，应当在启拖开始之日的三天前向启拖地所在海区的区域主管机关递交发布海上航行警告、航行通告的书面申请。
A vessel engaging in activities listed in Article 5(9) of these Regulations shall submit a written application for issuance of a maritime navigation warning or notice to the regional competent authority at the place of departure three days before the start of towing.
书面申请应当包括下列内容：
The written application shall include the following:
(一)拖船、被拖船或者被拖物的名称；
(1) Names of the tug, the vessel or object being towed;
(二)启拖时间；
(2) Start time of towing;
(三)启始位置、终到位置及主要转向点位置；
(3) Starting position, final position and positions of main turning points;
(四)拖带总长度；
(4) Total length of the tow;
(五)航速。
(5) Speed.
海上航行警告、航行通告发布后，申请人必须在国家主管机关或者区域主管机关核准的时间和区域内进行活动；需要变更活动时间或者改换活动区域的，应当依照本规定，重新申请发布海上航行警告、航行通告。
After a maritime navigation warning or notice is issued, the applicant must carry out the activity within the time and area approved by the national competent authority or regional competent authority; if the activity time or area needs to be changed, a new application for issuance of a maritime navigation warning or notice shall be submitted in accordance with these Regulations.
船舶、设施在海上发现下列情形，应当尽快向就近的区域主管机关报告：
Vessels and installations discovering the following situations at sea shall report to the nearest regional competent authority as soon as possible:
(一)航海图书上未载明的浅滩、礁石；
(1) Shoals or rocks not charted on nautical charts;
(二)异常磁区或者海水变色；
(2) Abnormal magnetic areas or discoloration of seawater;
(三)沉船、沉物、危险物、碍航漂流物；
(3) Shipwrecks, sunken objects, dangerous objects, or drifting obstructions to navigation;
(四)助航标志或者导航设施变异、失常；
(4) Alteration or malfunction of aids to navigation or navigation facilities;
(五)其他有碍海上航行安全的情形。
(5) Other situations that endanger maritime navigation safety.
报告内容应当包括：发现时间、地点和被发现物的状况。
The report shall include: time of discovery, location, and condition of the discovered object.
区域主管机关收到有碍海上航行安全的报告或者发布海上航行警告、航行通告的申请后，应当立即核实有关资料，根据实际需要和接收范围，决定发布海上航行警告、航行通告。
Upon receiving a report of a hazard to maritime navigation safety or an application for issuance of a maritime navigation warning or notice, the regional competent authority shall immediately verify the relevant information and, based on actual needs and reception range, decide whether to issue a maritime navigation warning or notice.
区域主管机关对本管辖区域内的下列情形，应当发布海上航行警告、航行通告：
The regional competent authority shall issue a maritime navigation warning or notice for the following situations within its jurisdiction:
(一)设置、调整或者撤销锚地；
(1) Establishment, adjustment or cancellation of anchorages;
(二)设置或者撤销海难救助区、防污作业区、海上作业重大事故区；
(2) Establishment or cancellation of salvage areas, anti-pollution operation areas, or major maritime accident areas;
(三)设置、变更或者撤销分道通航制；
(3) Establishment, change or cancellation of traffic separation schemes;
(四)设置、撤除、改建、变更或者恢复助航标志和导航设施；
(4) Establishment, removal, reconstruction, change or restoration of aids to navigation and navigation facilities;
(五)其他有碍海上航行和作业安全的情形。
(5) Other situations that endanger the safety of maritime navigation and operations.
国家主管机关或者区域主管机关在发布海上航行警告、航行通告以及收到本规定第九条规定的各项报告时，应当及时向海军航海保证部门提供有关资料并通报有关情况。
When issuing maritime navigation warnings or navigational notices, or upon receiving reports as specified in Article 9 of these Provisions, the competent national authority or regional competent authority shall promptly provide relevant materials to the naval navigation support department and notify it of the relevant circumstances.
海岸电台负责并按照规定的时间、频率和要求播发海上航行警告。播发的程序和办法由国务院交通主管部门另行制定。
Coast radio stations are responsible for broadcasting maritime navigation warnings in accordance with the prescribed times, frequencies, and requirements. The procedures and methods for broadcasting shall be separately formulated by the competent transportation authority under the State Council.
船舶、设施的有关人员必须按照规定抄收海岸电台播发的海上航行警告。
Relevant personnel on ships and installations must, in accordance with regulations, receive maritime navigation warnings broadcast by coast radio stations.
有关单位收到海上航行通告后，必须采取有效手段，及时通知所属船舶、设施。
Upon receiving a navigational notice, the relevant entity must take effective measures to promptly notify its subordinate ships and installations.
对于执行本规定做出显著成绩的单位和个人，由国家主管机关或者区域主管机关给予奖励。
Units and individuals that achieve significant results in implementing these Provisions shall be rewarded by the competent national authority or regional competent authority.
违反本规定第五条第一款、第八条规定的，由国家主管机关或者区域主管机关责令其停止活动，并可以处二千元以下罚款。
Anyone violating the provisions of Article 5, paragraph 1, or Article 8 of these Provisions shall be ordered by the competent national authority or regional competent authority to cease the activity and may be fined not more than 2,000 yuan.
未依照本规定第六条、第七条规定的时间申请发布海上航行警告、航行通告的，国家主管机关或者区域主管机关可以给予警告，可以并处八百元以下罚款。
If an application for the issuance of a maritime navigation warning or navigational notice is not made within the time limits specified in Articles 6 and 7 of these Provisions, the competent national authority or regional competent authority may issue a warning and may concurrently impose a fine of not more than 800 yuan.
对违反本规定第十四条规定的责任人员，根据情节，国家主管机关或者区域主管机关可以给予警告、扣留职务证书或者吊销职务证书。
For responsible personnel who violate the provisions of Article 14 of these Provisions, the competent national authority or regional competent authority may, depending on the circumstances, issue a warning, detain their professional certificate, or revoke their professional certificate.
违反本规定，造成海上交通事故的，除依法承担民事赔偿责任外，国家主管机关或者区域主管机关可以根据情节给予罚款、扣留职务证书或者吊销职务证书；构成犯罪的，依法追究刑事责任。
Anyone violating these Provisions and causing a maritime traffic accident shall, in addition to bearing civil liability for compensation in accordance with the law, be subject to a fine, detention of professional certificate, or revocation of professional certificate by the competent national authority or regional competent authority depending on the circumstances; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law.
当事人对罚款、扣留职务证书或者吊销职务证书的处罚决定不服的，可以自接到处罚决定通知之日起十五日内向中华人民共和国港务监督机构申请复议，也可以直接向人民法院提起诉讼；期满不申请复议也不提起诉讼又不履行的，作出处罚决定的主管机关可以申请人民法院强制执行。
If a party disagrees with a decision on a fine, detention of professional certificate, or revocation of professional certificate, it may, within 15 days from the date of receipt of the notice of the penalty decision, apply for reconsideration to the Harbor Superintendency Administration of the People's Republic of China, or directly file a lawsuit with a people's court; if the party neither applies for reconsideration nor files a lawsuit within the time limit and fails to comply with the decision, the competent authority that made the penalty decision may apply to the people's court for compulsory enforcement.
在渔港水域内新建、改建、扩建各种设施或者进行其他施工作业，由渔政渔港监督管理机关根据本规定和国家其他有关规定发布海上航行通告。
For the construction, renovation, or expansion of various facilities or other construction operations within fishery port waters, the fishery administration and fishery port superintendency authority shall issue maritime navigational notices in accordance with these Provisions and other relevant state regulations.
军事单位涉及海上航行警告、航行通告事宜的管理办法。根据《中华人民共和国海上交通安全法》有关规定，另行制定。
Administrative measures for military units concerning maritime navigation warnings and navigational notices shall be separately formulated in accordance with the relevant provisions of the Maritime Traffic Safety Law of the People's Republic of China.
本规定由交通部负责解释。
These Provisions shall be interpreted by the Ministry of Communications.
本规定自一九九三年二月一日起施行。
These Provisions shall come into effect as of February 1, 1993.
