Provisions of the People's Republic of China on Search and Rescue of Civil Aircraft

为了及时有效地搜寻援救遇到紧急情况的民用航空器，避免或者减少人员伤亡和财产损失，制定本规定。

These Provisions are formulated for the purpose of timely and effective search and rescue of civil aircraft in emergency situations, and to avoid or reduce casualties and property losses.

本规定适用于中华人民共和国领域内以及中华人民共和国缔结或者参加的国际条约规定由中国承担搜寻援救工作的公海区域内搜寻援救民用航空器的活动。

These Provisions apply to search and rescue activities for civil aircraft within the territory of the People's Republic of China and in the high seas areas where China undertakes search and rescue responsibilities under international treaties concluded or acceded to by the People's Republic of China.

海上搜寻援救民用航空器，除适用本规定外，并应当遵守国务院有关海上搜寻援救的规定。

Maritime search and rescue of civil aircraft shall, in addition to these Provisions, comply with the relevant provisions of the State Council on maritime search and rescue.

搜寻援救民用航空器按照下列规定分工负责：

Search and rescue of civil aircraft shall be carried out with division of responsibilities according to the following provisions:

(一)中国民用航空局(以下简称民航局)负责统一指导全国范围的搜寻援救民用航空器的工作；

(1) The Civil Aviation Administration of China (hereinafter referred to as CAAC) shall be responsible for unified guidance of search and rescue of civil aircraft nationwide;

(二)省、自治区、直辖市人民政府负责本行政区域内陆地搜寻援救民用航空器的工作，民用航空地区管理局(以下简称地区管理局)予以协助；

(2) The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for land search and rescue of civil aircraft within their respective administrative regions, with the assistance of the regional civil aviation administration (hereinafter referred to as the regional administration);

(三)国家海上搜寻援救组织负责海上搜寻援救民用航空器工作，有关部门予以配合。

(3) The national maritime search and rescue organization shall be responsible for maritime search and rescue of civil aircraft, with relevant departments providing coordination.

民航局搜寻援救协调中心和地区管理局搜寻援救协调中心承担陆上搜寻援救民用航空器的协调工作。

The CAAC Search and Rescue Coordination Center and the regional administration search and rescue coordination centers shall undertake the coordination of land search and rescue of civil aircraft.

中华人民共和国领域内以及中华人民共和国缔结或者参加的国际条约规定由中国承担搜寻援救工作的公海区域内为中华人民共和国民用航空搜寻援救区，该区域内划分若干地区民用航空搜寻援救区，具体地区划分范围由民航局公布。

The area within the territory of the People's Republic of China and the high seas areas where China undertakes search and rescue responsibilities under international treaties concluded or acceded to by the People's Republic of China shall be the civil aviation search and rescue region of the People's Republic of China. This region shall be divided into several regional civil aviation search and rescue areas, with specific regional boundaries to be published by CAAC.

使用航空器执行搜寻援救任务，以民用航空力量为主，民用航空搜寻援救力量不足的，由军队派出航空器给予支援。

Aircraft used for search and rescue missions shall primarily be civil aviation assets. When civil aviation search and rescue resources are insufficient, the military shall provide aircraft for support.

为执行搜寻援救民用航空器的紧急任务，有关地方、部门、单位和人员必须积极行动，互相配合，努力完成任务；对执行搜寻援救任务成绩突出的单位和个人，由其上级机关给予奖励。

For the purpose of carrying out emergency search and rescue missions for civil aircraft, relevant localities, departments, units, and personnel must act actively, cooperate with each other, and strive to complete the mission. Units and individuals with outstanding achievements in search and rescue missions shall be rewarded by their superior authorities.

各地区管理局应当拟定在陆上使用航空器搜寻援救民用航空器的方案，经民航局批准后，报有关省、自治区、直辖市人民政府备案。

Each regional administration shall formulate plans for land-based search and rescue of civil aircraft using aircraft, which shall be submitted to CAAC for approval and then filed with the relevant provincial, autonomous region, or municipal people's government.

沿海省、自治区、直辖市海上搜寻援救组织，应当拟定在海上使用船舶、航空器搜寻援救民用航空器的方案，经国家海上搜寻援救组织批准后，报省、自治区、直辖市人民政府和民航局备案，同时抄送有关地区管理局。

Maritime search and rescue organizations in coastal provinces, autonomous regions, and municipalities directly under the Central Government shall formulate plans for maritime search and rescue of civil aircraft using ships and aircraft, which shall be submitted to the national maritime search and rescue organization for approval, then filed with the provincial, autonomous region, or municipal people's government and CAAC, with a copy sent to the relevant regional administration.

搜寻援救民用航空器方案应当包括下列内容：

Search and rescue plans for civil aircraft shall include the following contents:

(一)使用航空器、船舶执行搜寻援救任务的单位，航空器、船舶的类型，以及日常准备工作的规定；

(1) Units assigned to carry out search and rescue missions using aircraft and ships, types of aircraft and ships, and provisions for routine preparations;

(二)航空器使用的机场和船舶使用的港口，担任搜寻援救的区域和有关保障工作方面的规定；

(2) Airports to be used by aircraft and ports to be used by ships, designated search and rescue areas, and provisions for related support work;

(三)执行海上搜寻援救任务的船舶、航空器协同配合方面的规定；

(3) Provisions for coordination between ships and aircraft carrying out maritime search and rescue missions;

(四)民用航空搜寻援救力量不足的，商请当地驻军派出航空器、舰艇支援的规定。

(4) Provisions for requesting support from local military forces by dispatching aircraft and vessels when civil aviation search and rescue resources are insufficient.

地区管理局和沿海省、自治区、直辖市海上搜寻援救组织应当按照批准的方案定期组织演习。

Regional administrations and maritime search and rescue organizations in coastal provinces, autonomous regions, and municipalities directly under the Central Government shall organize regular exercises in accordance with the approved plans.

搜寻援救民用航空器的通信联络，应当符合下列规定：

Communications for search and rescue of civil aircraft shall comply with the following provisions:

(一)民用航空空中交通管制单位和担任搜寻援救任务的航空器，应当配备121.5兆赫航空紧急频率的通信设备，并逐步配备243兆赫航空紧急频率的通信设备；

(1) Civil aviation air traffic control units and aircraft assigned to search and rescue missions shall be equipped with communication equipment for the aeronautical emergency frequency 121.5 MHz, and shall gradually be equipped with communication equipment for the aeronautical emergency frequency 243 MHz;

(二)担任海上搜寻援救任务的航空器，应当配备2182千赫海上遇险频率的通信设备；

(2) Aircraft assigned to maritime search and rescue missions shall be equipped with communication equipment for the maritime distress frequency 2182 kHz;

(三)担任搜寻援救任务的部分航空器，应当配备能够向遇险民用航空器所发出的航空器紧急示位信标归航设备，以及在156.8兆赫(调频)频率上同搜寻援救船舶联络的通信设备。

(3) Some aircraft assigned to search and rescue missions shall be equipped with homing devices capable of locating the emergency locator transmitters emitted by civil aircraft in distress, and communication equipment for contacting search and rescue vessels on the frequency of 156.8 MHz (FM).

地区管理局搜寻援救协调中心应当同有关省、自治区、直辖市海上搜寻援救组织建立直接的通信联络。

The regional administration search and rescue coordination center shall establish direct communication links with the relevant provincial, autonomous region, or municipality maritime search and rescue organizations.

向遇险待救人员空投救生物品，由执行搜寻援救任务的单位按照下列规定负责准备：

Airdropping of rescue supplies to persons in distress awaiting rescue shall be prepared by the unit performing the search and rescue mission according to the following provisions:

(一)药物和急救物品为红色；

(1) Medicines and first aid items shall be red;

(二)食品和水为蓝色；

(2) Food and water shall be blue;

(三)防护服装和毯子为黄色；

(3) Protective clothing and blankets shall be yellow;

(四)其他物品为黑色；

(4) Other items shall be black;

(五)一个容器或者包装内，装有上述多种物品时为混合色。

(5) If a container or package contains multiple types of the above items, it shall be of mixed color.

每一容器或者包装内，应当装有用汉语、英语和另选一种语言的救生物品使用说明。

Each container or package shall contain instructions for use of the rescue items in Chinese, English, and one additional language.

发现或者收听到民用航空器遇到紧急情况的单位或者个人，应当立即通知有关地区管理局搜寻援救协调中心；发现失事的民用航空器，其位置在陆地的，并应当同时通知当地政府；其位置在海上的，并应当同时通知当地海上搜寻援救组织。

Any unit or individual that discovers or hears of a civil aircraft in an emergency situation shall immediately notify the relevant regional administration search and rescue coordination center; if the location of the crashed civil aircraft is on land, they shall also notify the local government; if the location is at sea, they shall also notify the local maritime search and rescue organization.

地区管理局搜寻援救协调中心收到民用航空器紧急情况的信息后，必须立即做出判断，分别按照本规定第十九条、第二十条、第二十一条的规定，采取搜寻援救措施，并及时向民航局搜寻援救协调中心以及有关单位报告或者通报。

Upon receiving information about an emergency situation of a civil aircraft, the regional administration search and rescue coordination center must immediately make a judgment and take search and rescue measures in accordance with Articles 19, 20, and 21 of these Provisions, and promptly report or notify the Civil Aviation Administration search and rescue coordination center and relevant units.

本规定所指民用航空器的紧急情况分为以下三个阶段：

The emergency situations of civil aircraft referred to in these Provisions are divided into the following three phases:

(一)情况不明阶段是指民用航空器的安全出现下列令人疑虑的情况：

(1) Uncertainty phase refers to the following situations where the safety of a civil aircraft is in doubt:

1．空中交通管制部门在规定的时间内同民用航空器没有取得联络；

1. Air traffic control has not established contact with the civil aircraft within the specified time;

2．民用航空器在规定的时间内没有降落，并且没有其他信息。

2. The civil aircraft has not landed within the specified time and no other information is available.

(二)告警阶段是指民用航空器的安全出现下列令人担忧的情况：

(2) Alert phase refers to the following situations where the safety of a civil aircraft is a cause for concern:

1．对情况不明阶段的民用航空器，仍然不能同其沟通联络；

1. Communication with the civil aircraft in the uncertainty phase still cannot be established;

2．民用航空器的飞行能力受到损害，但是尚未达到迫降的程度；

2. The flight capability of the civil aircraft is impaired but has not yet reached the point of forced landing;

3．与已经允许降落的民用航空器失去通信联络，并且该民用航空器在预计降落时间后五分钟内没有降落。

3. Communication is lost with a civil aircraft that has been cleared to land, and the aircraft has not landed within five minutes after the estimated landing time.

(三)遇险阶段是指确信民用航空器遇到下列紧急和严重危险，需要立即进行援救的情况：

(3) Distress phase refers to the following situations where a civil aircraft is believed to be in imminent and serious danger requiring immediate rescue:

1．根据油量计算，告警阶段的民用航空器难以继续飞行；

1. Based on fuel calculation, the civil aircraft in the alert phase cannot continue flying;

2．民用航空器的飞行能力受到严重损害，达到迫降程度；

2. The flight capability of the civil aircraft is severely impaired to the extent of forced landing;

3．民用航空器已经迫降或者坠毁。

3. The civil aircraft has made a forced landing or crashed.

对情况不明阶段的民用航空器，地区管理局搜寻援救协调中心应当：

For a civil aircraft in the uncertainty phase, the regional administration search and rescue coordination center shall:

(一)根据具体情况，确定搜寻的区域；

(1) Determine the search area based on specific circumstances;

(二)通知开放有关的航空电台、导航台、定向台和雷达等设施，搜寻掌握该民用航空器的空中位置；

(2) Notify the activation of relevant aeronautical radio stations, navigation stations, direction finders, radar and other facilities to search for the airborne position of the civil aircraft;

(三)尽速同该民用航空器沟通联络，进行有针对性的处置。

(3) Establish communication with the civil aircraft as soon as possible and take targeted measures.

对告警阶段的民用航空器，地区管理局搜寻援救协调中心应当：

For a civil aircraft in the alert phase, the regional administration search and rescue coordination center shall:

(一)立即向有关单位发出告警通知；

(1) Immediately issue an alert notification to relevant units;

(二)要求担任搜寻援救任务的航空器、船舶立即进入待命执行任务状态；

(2) Require aircraft and vessels assigned to search and rescue missions to immediately enter standby status for mission execution;

(三)督促检查各种电子设施，对情况不明的民用航空器继续进行联络和搜寻；

(3) Supervise and inspect various electronic facilities to continue communication and search for the civil aircraft whose situation is unknown;

(四)根据该民用航空器飞行能力受损情况和机长的意见，组织引导其在就近机场降落；

(4) Based on the extent of damage to the civil aircraft's flight capability and the captain's opinion, organize and guide it to land at the nearest airport;

(五)会同接受降落的机场，迅速查明预计降落时间后五分钟内还没有降落的民用航空器的情况并进行处理。

(5) In coordination with the receiving airport, promptly ascertain the situation of a civil aircraft that has not landed within five minutes after the estimated landing time and take action.

对遇险阶段的民用航空器，地区管理局搜寻援救协调中心应当：

For a civil aircraft in the distress phase, the regional administration search and rescue coordination center shall:

(一)立即向有关单位发出民用航空器遇险的通知；

(1) Immediately issue a distress notification for the civil aircraft to relevant units;

(二)对燃油已尽，位置仍然不明的民用航空器，分析其可能遇险的区域，并通知搜寻援救单位派人或者派航空器、船舶，立即进行搜寻援救；

(2) For a civil aircraft whose fuel is exhausted and position remains unknown, analyze its possible distress area and notify search and rescue units to dispatch personnel, aircraft, or vessels for immediate search and rescue;

(三)对飞行能力受到严重损害、达到迫降程度的民用航空器，通知搜寻援救单位派航空器进行护航，或者根据预定迫降地点，派人或者派航空器、船舶前往援救；

(3) For a civil aircraft whose flight capability is severely damaged to the extent of forced landing, notify search and rescue units to dispatch aircraft for escort, or based on the predetermined forced landing site, dispatch personnel, aircraft, or vessels for rescue;

(四)对已经迫降或者失事的民用航空器，其位置在陆地的，立即报告省、自治区、直辖市人民政府；其位置在海上的，立即通报沿海有关省、自治区、直辖市的海上搜寻援救组织。

(4) For a civil aircraft that has made a forced landing or crashed, if its location is on land, immediately report to the provincial, autonomous region, or municipality people's government; if its location is at sea, immediately notify the maritime search and rescue organization of the relevant coastal province, autonomous region, or municipality.

省、自治区、直辖市人民政府或者沿海省、自治区、直辖市海上搜寻援救组织收到关于民用航空器迫降或者失事的报告或者通报后，应当立即组织有关方面和当地驻军进行搜寻援救，并指派现场负责人。

Upon receiving a report or notification of a forced landing or crash of a civil aircraft, the provincial, autonomous region, or municipality people's government or the maritime search and rescue organization of the coastal province, autonomous region, or municipality shall immediately organize relevant parties and local military forces to conduct search and rescue, and designate an on-site commander.

现场负责人的主要职责是：

The main responsibilities of the on-site commander are:

(一)组织抢救幸存人员；

(1) Organize the rescue of survivors;

(二)对民用航空器采取措施防火、灭火；

(2) Take measures to prevent and extinguish fires on the civil aircraft;

(三)保护好民用航空器失事现场；为抢救人员或者灭火必须变动现场时，应当进行拍照或者录相；

(3) Protect the crash site of the civil aircraft; if the site must be altered for rescue or firefighting, photographs or video recordings shall be taken;

(四)保护好失事的民用航空器及机上人员的财物。

(4) Protect the crashed civil aircraft and the property of persons on board.

指派的现场负责人未到达现场的，由第一个到达现场的援救单位的有关人员担任现场临时负责人，行使本规定第二十三条规定的职责，并负责向到达后的现场负责人移交工作。

If the designated on-site commander has not arrived at the scene, the relevant personnel from the first rescue unit to arrive shall serve as the temporary on-site commander, exercising the duties specified in Article 23 of these Provisions, and shall be responsible for handing over work to the on-site commander upon their arrival.

对处于紧急情况下的民用航空器，地区管理局搜寻援救协调中心应当设法将已经采取的援救措施通报该民用航空器机组。

For a civil aircraft in an emergency situation, the regional administration search and rescue coordination center shall endeavor to communicate the rescue measures already taken to the crew of that civil aircraft.

执行搜寻援救任务的航空器与船舶、遇险待救人员、搜寻援救工作组之间，应当使用无线电进行联络。条件不具备或者无线电联络失效的，应当依照本规定附录规定的国际通用的《搜寻援救的信号》进行联络。

Aircraft and vessels performing search and rescue missions, persons in distress awaiting rescue, and search and rescue work groups shall use radio for communication. If conditions are not available or radio communication fails, communication shall be conducted in accordance with the internationally recognized "Search and Rescue Signals" specified in the appendix to these Provisions.

民用航空器的紧急情况已经不存在或者可以结束搜寻援救工作的，地区管理局搜寻援救协调中心应当按照规定程序及时向有关单位发出解除紧急情况的通知。

If the emergency situation of a civil aircraft no longer exists or the search and rescue work can be concluded, the regional administration search and rescue coordination center shall promptly issue a notice to relevant units to cancel the emergency situation in accordance with the prescribed procedures.

对违反本规定，有下列行为之一的人员，由其所在单位或者上级机关给予行政处分；构成犯罪的，依法追究刑事责任：

Any person who violates these provisions and commits any of the following acts shall be given administrative sanctions by his or her unit or superior authority; if the act constitutes a crime, criminal liability shall be pursued according to law:

(一)不积极行动配合完成搜寻援救任务，造成重大损失的；

(1) Failing to actively cooperate in completing search and rescue missions, causing significant losses;

(二)不积极履行职责或者不服从指挥，致使损失加重的；

(2) Failing to actively perform duties or disobeying commands, thereby aggravating losses;

(三)玩忽职守，对民用航空器紧急情况判断、处置不当，贻误时机，造成损失的。

(3) Dereliction of duty, improperly judging or handling civil aircraft emergency situations, missing opportunities, and causing losses.

航空器执行搜寻援救任务所需经费，国家可以给予一定补贴。具体补贴办法由有关部门会同财政部门协商解决。

The state may provide certain subsidies for the expenses required by aircraft in performing search and rescue missions. Specific subsidy measures shall be negotiated and resolved by relevant departments together with financial departments.

本规定由民航局负责解释。

These Provisions shall be interpreted by the Civil Aviation Administration.

本规定自发布之日起施行。

These Provisions shall come into force as of the date of promulgation.
