Regulations of the People's Republic of China on the Nationality Registration of Civil Aircraft

(Issued by Decree No. 232 of the State Council of the People's Republic of China on October 21, 1997, and revised in accordance with the Decision of the State Council on Amending and Repealing Certain Administrative Regulations on November 29, 2020)

为了加强对民用航空器国籍的管理，保障民用航空活动安全，维护民用航空活动秩序，根据《中华人民共和国民用航空法》的规定，制定本条例。

These Regulations are formulated in accordance with the provisions of the Civil Aviation Law of the People's Republic of China for the purpose of strengthening the administration of the nationality of civil aircraft, ensuring the safety of civil aviation activities, and maintaining the order of civil aviation activities.

下列民用航空器应当依照本条例进行国籍登记：

The following civil aircraft shall undergo nationality registration in accordance with these Regulations:

(一)中华人民共和国国家机构的民用航空器；

(1) Civil aircraft of state organs of the People's Republic of China;

(二)依照中华人民共和国法律设立的企业法人的民用航空器；

(2) Civil aircraft of enterprise legal persons established in accordance with the laws of the People's Republic of China;

(三)国务院民用航空主管部门准予登记的其他民用航空器。

(3) Other civil aircraft approved for registration by the competent civil aviation authority under the State Council.

自境外租赁的民用航空器，承租人符合前款规定，该民用航空器的机组人员由承租人配备的，可以申请登记中华人民共和国国籍；但是，必须先予注销该民用航空器原国籍登记。

For civil aircraft leased from abroad, if the lessee meets the provisions of the preceding paragraph and the crew of the civil aircraft is provided by the lessee, the lessee may apply for registration of the nationality of the People's Republic of China; however, the original nationality registration of the civil aircraft must first be cancelled.

民用航空器经依法登记，取得中华人民共和国国籍。

A civil aircraft that has undergone registration in accordance with the law acquires the nationality of the People's Republic of China.

民用航空器不得具有双重国籍。未注销外国国籍的民用航空器，不得在中华人民共和国办理国籍登记；未注销中华人民共和国国籍的民用航空器，不得在外国办理国籍登记。

A civil aircraft shall not have dual nationality. A civil aircraft that has not cancelled its foreign nationality shall not undergo nationality registration in the People's Republic of China; a civil aircraft that has not cancelled its nationality of the People's Republic of China shall not undergo nationality registration in a foreign country.

国务院民用航空主管部门主管中华人民共和国民用航空器国籍登记工作，设立中华人民共和国民用航空器国籍登记簿，统一记载民用航空器的国籍登记事项。

The competent civil aviation authority under the State Council is responsible for the nationality registration of civil aircraft of the People's Republic of China, establishes the Nationality Register of Civil Aircraft of the People's Republic of China, and uniformly records the nationality registration matters of civil aircraft.

民用航空器国籍登记，不得作为民用航空器所有权的证据。

The nationality registration of a civil aircraft shall not serve as evidence of ownership of the civil aircraft.

申请中华人民共和国民用航空器国籍登记的，申请人应当按照国务院民用航空主管部门规定的格式如实填写民用航空器国籍登记申请书，并向国务院民用航空主管部门提交下列文件：

An applicant applying for nationality registration of a civil aircraft of the People's Republic of China shall truthfully fill in the Application Form for Nationality Registration of Civil Aircraft in the format prescribed by the competent civil aviation authority under the State Council, and submit the following documents to the competent civil aviation authority under the State Council:

(一)证明申请人合法身份的文件；

(1) Documents proving the legal identity of the applicant;

(二)作为取得民用航空器所有权证明的购买合同和交接文书，或者作为占有民用航空器证明的租赁合同和交接文书；

(2) The purchase contract and delivery documents serving as proof of acquisition of ownership of the civil aircraft, or the lease contract and delivery documents serving as proof of possession of the civil aircraft;

(三)未在外国登记国籍或者已注销外国国籍的证明；

(3) Proof that the civil aircraft is not registered in a foreign country or that its foreign nationality has been cancelled;

(四)国务院民用航空主管部门要求提交的其他有关文件。

(4) Other relevant documents required by the competent civil aviation authority under the State Council.

国务院民用航空主管部门应当自收到民用航空器国籍登记申请之日起7个工作日内，对申请书及有关证明文件进行审查；经审查，符合本条例规定的，应当向申请人颁发中华人民共和国民用航空器国籍登记证书。

The competent civil aviation authority under the State Council shall, within 7 working days from the date of receipt of the application for nationality registration of a civil aircraft, examine the application form and relevant supporting documents; if upon examination they comply with the provisions of these Regulations, it shall issue a Certificate of Nationality Registration of Civil Aircraft of the People's Republic of China to the applicant.

国务院民用航空主管部门应当在民用航空器国籍登记簿中载明下列事项：

The competent civil aviation authority under the State Council shall record the following items in the Nationality Register of Civil Aircraft:

(一)民用航空器国籍标志和登记标志；

(1) The nationality mark and registration mark of the civil aircraft;

(二)民用航空器制造人名称；

(2) The name of the manufacturer of the civil aircraft;

(三)民用航空器型号；

(3) The model of the civil aircraft;

(四)民用航空器出厂序号；

(4) The serial number of the civil aircraft;

(五)民用航空器所有人名称及其地址；

(5) The name and address of the owner of the civil aircraft;

(六)民用航空器占有人名称及其地址；

(6) The name and address of the possessor of the civil aircraft;

(七)民用航空器登记日期；

(7) The date of registration of the civil aircraft;

(八)民用航空器国籍登记证书签发人姓名。

(8) The name of the person who issued the Certificate of Nationality Registration of the civil aircraft.

民用航空器国籍登记证书应当放置于民用航空器内显著位置，以备查验。

The Certificate of Nationality Registration of a civil aircraft shall be placed in a conspicuous position inside the civil aircraft for inspection.

取得中华人民共和国国籍的民用航空器，遇有下列情形之一时，应当申请办理变更登记：

A civil aircraft that has acquired the nationality of the People's Republic of China shall apply for modification of registration in any of the following circumstances:

(一)民用航空器所有人或其地址变更；

(1) Change of the owner of the civil aircraft or its address;

(二)民用航空器占有人或其地址变更；

(2) Change of the possessor of the civil aircraft or its address;

(三)国务院民用航空主管部门规定需要办理变更登记的其他情形。

(3) Other circumstances requiring modification of registration as prescribed by the competent civil aviation authority under the State Council.

取得中华人民共和国国籍的民用航空器，遇有下列情形之一时，应当申请办理注销登记：

A civil aircraft that has acquired the nationality of the People's Republic of China shall apply for cancellation of registration in any of the following circumstances:

(一)民用航空器所有权依法转移境外并已办理出口适航证的；

(1) The ownership of the civil aircraft is legally transferred abroad and an export airworthiness certificate has been obtained;

(二)民用航空器退出使用或者报废的；

(2) The civil aircraft is withdrawn from use or scrapped;

(三)民用航空器失事或者失踪并停止搜寻的；

(3) The civil aircraft is wrecked or missing and the search has been terminated;

(四)符合本条例第二条第二款规定的民用航空器租赁合同终止的；

(4) The lease contract for the civil aircraft that meets the provisions of Article 2, paragraph 2 of these Regulations is terminated;

(五)国务院民用航空主管部门规定需要办理注销登记的其他情形。

(5) Other circumstances requiring cancellation of registration as prescribed by the competent civil aviation authority under the State Council.

申请人办理民用航空器国籍登记，应当缴纳登记费。登记费的收费标准由国务院民用航空主管部门会同国务院价格主管部门制定。

An applicant for nationality registration of a civil aircraft shall pay a registration fee. The fee standard for registration shall be formulated by the competent civil aviation authority under the State Council jointly with the competent price authority under the State Council.

民用航空器没有或者未携带民用航空器国籍登记证书的，国务院民用航空主管部门或者其授权的地区民用航空管理机构可以禁止该民用航空器起飞。

If a civil aircraft does not have or does not carry its Certificate of Nationality Registration, the competent civil aviation authority under the State Council or its authorized regional civil aviation administration may prohibit the civil aircraft from taking off.

中华人民共和国民用航空器的国籍标志为罗马体大写字母B。

The nationality mark of a civil aircraft of the People's Republic of China is the capital letter B in Roman type.

中华人民共和国民用航空器的登记标志为阿拉伯数字、罗马体大写字母或者二者的组合。

The registration mark of a civil aircraft of the People's Republic of China is Arabic numerals, capital letters in Roman type, or a combination thereof.

中华人民共和国民用航空器的国籍标志置于登记标志之前，国籍标志和登记标志之间加一短横线。

The nationality mark of a civil aircraft of the People's Republic of China is placed before the registration mark, with a hyphen between the nationality mark and the registration mark.

取得中华人民共和国国籍的民用航空器，应当将国籍标志和登记标志喷涂在民用航空器上或者用其他能够保持同等耐久性的方法附着在民用航空器上，并保持清晰可见。

A civil aircraft that has acquired the nationality of the People's Republic of China shall have the nationality mark and registration mark painted on the civil aircraft or affixed to the civil aircraft by other methods of equal durability, and kept clearly visible.

国籍标志和登记标志在民用航空器上的位置、尺寸和字体，由国务院民用航空主管部门规定。

The position, size, and font of the nationality mark and registration mark on the civil aircraft shall be prescribed by the competent civil aviation authority under the State Council.

任何单位或者个人不得在民用航空器上喷涂、粘贴易与国籍标志和登记标志相混淆的图案、标记或者符号。

No unit or individual may paint or affix on a civil aircraft any patterns, marks, or symbols that are easily confused with the nationality mark and registration mark.

取得中华人民共和国国籍的民用航空器，应当载有一块刻有国籍标志和登记标志并用耐火金属或者其他耐火材料制成的识别牌。

A civil aircraft that has acquired the nationality of the People's Republic of China shall carry an identification plate engraved with the nationality mark and registration mark and made of fire-resistant metal or other fire-resistant material.

对未取得民用航空器国籍登记证书的民用航空器，申请人应当在进行下列飞行前30日内，按照国务院民用航空主管部门规定的格式如实填写申请书，并向国务院民用航空主管部门提交有关证明文件，办理临时登记：

For a civil aircraft that has not obtained a Certificate of Nationality Registration, the applicant shall, within 30 days prior to conducting any of the following flights, truthfully fill in an application form in the format prescribed by the competent civil aviation authority under the State Council, submit relevant supporting documents to the competent civil aviation authority under the State Council, and undergo temporary registration:

(一)验证试验飞行、生产试验飞行；

(1) Verification test flights and production test flights;

(二)表演飞行；

(2) Demonstration flights;

(三)为交付或者出口的调机飞行；

(3) Ferry flights for delivery or export;

(四)其他必要的飞行。

(4) Other necessary flights.

前款申请人是指民用航空器制造人、销售人或者国务院民用航空主管部门认可的其他申请人。

The applicant referred to in the preceding paragraph means the manufacturer, seller, or other applicant approved by the competent civil aviation authority under the State Council.

国务院民用航空主管部门准予临时登记的，应当确定临时登记标志，颁发临时登记证书。

If the competent civil aviation authority under the State Council approves temporary registration, it shall determine a temporary registration mark and issue a temporary registration certificate.

取得临时登记标志的民用航空器出口时，可以使用易于去除的材料将临时登记标志附着在民用航空器上，并应当完全覆盖外方要求预先喷涂的外国国籍标志和登记标志。

When a civil aircraft that has obtained a temporary registration mark is exported, the temporary registration mark may be affixed to the civil aircraft using easily removable materials, and shall completely cover any foreign nationality mark and registration mark that the foreign party requires to be pre-painted.

本条例自发布之日起施行。

These Regulations shall come into force as of the date of promulgation.
