为了规范碳排放权交易及相关活动，加强对温室气体排放的控制，积极稳妥推进碳达峰碳中和，促进经济社会绿色低碳发展，推进生态文明建设，制定本条例。
These Regulations are formulated to regulate carbon emissions trading and related activities, strengthen the control of greenhouse gas emissions, actively and steadily promote carbon peak and carbon neutrality, facilitate green and low-carbon economic and social development, and advance ecological civilization.
本条例适用于全国碳排放权交易市场的碳排放权交易及相关活动。
These Regulations apply to carbon emissions trading and related activities in the national carbon emissions trading market.
碳排放权交易及相关活动的管理，应当坚持中国共产党的领导，贯彻党和国家路线方针政策和决策部署，坚持温室气体排放控制与经济社会发展相适应，坚持政府引导与市场调节相结合，遵循公开、公平、公正的原则。
The management of carbon emissions trading and related activities shall adhere to the leadership of the Communist Party of China, implement the Party and national guidelines, policies, and decisions, maintain compatibility between greenhouse gas emission control and economic and social development, combine government guidance with market regulation, and follow the principles of openness, fairness, and justice.
国家加强碳排放权交易领域的国际合作与交流。
The State shall strengthen international cooperation and exchanges in the field of carbon emissions trading.
国务院生态环境主管部门负责碳排放权交易及相关活动的监督管理工作。国务院有关部门按照职责分工，负责碳排放权交易及相关活动的有关监督管理工作。
The competent department of ecological environment under the State Council shall be responsible for the supervision and management of carbon emissions trading and related activities. The relevant departments under the State Council shall, in accordance with their respective functions and duties, be responsible for the relevant supervision and management of carbon emissions trading and related activities.
地方人民政府生态环境主管部门负责本行政区域内碳排放权交易及相关活动的监督管理工作。地方人民政府有关部门按照职责分工，负责本行政区域内碳排放权交易及相关活动的有关监督管理工作。
The competent departments of ecological environment of local people's governments shall be responsible for the supervision and management of carbon emissions trading and related activities within their respective administrative regions. The relevant departments of local people's governments shall, in accordance with their respective functions and duties, be responsible for the relevant supervision and management of carbon emissions trading and related activities within their respective administrative regions.
全国碳排放权注册登记机构按照国家有关规定，负责碳排放权交易产品登记，提供交易结算等服务。全国碳排放权交易机构按照国家有关规定，负责组织开展碳排放权集中统一交易。登记和交易的收费应当合理，收费项目、收费标准和管理办法应当向社会公开。
The national carbon emissions registration institution shall, in accordance with relevant state regulations, be responsible for the registration of carbon emissions trading products and provide services such as trading settlement. The national carbon emissions trading institution shall, in accordance with relevant state regulations, be responsible for organizing and carrying out centralized and unified carbon emissions trading. The fees for registration and trading shall be reasonable, and the fee items, fee standards, and management measures shall be disclosed to the public.
全国碳排放权注册登记机构和全国碳排放权交易机构应当按照国家有关规定，完善相关业务规则，建立风险防控和信息披露制度。
The national carbon emissions registration institution and the national carbon emissions trading institution shall, in accordance with relevant state regulations, improve relevant business rules and establish risk prevention and control and information disclosure systems.
国务院生态环境主管部门会同国务院市场监督管理部门、中国人民银行和国务院银行业监督管理机构，对全国碳排放权注册登记机构和全国碳排放权交易机构进行监督管理，并加强信息共享和执法协作配合。
The competent department of ecological environment under the State Council, together with the market supervision and administration department under the State Council, the People's Bank of China, and the banking regulatory authority under the State Council, shall supervise and manage the national carbon emissions registration institution and the national carbon emissions trading institution, and strengthen information sharing and law enforcement coordination.
碳排放权交易应当逐步纳入统一的公共资源交易平台体系。
Carbon emissions trading shall be gradually integrated into the unified public resource trading platform system.
碳排放权交易覆盖的温室气体种类和行业范围，由国务院生态环境主管部门会同国务院发展改革等有关部门根据国家温室气体排放控制目标研究提出，报国务院批准后实施。
The types of greenhouse gases and industry scopes covered by carbon emissions trading shall be researched and proposed by the competent department of ecological environment under the State Council together with the development and reform and other relevant departments under the State Council based on the national greenhouse gas emission control targets, and implemented after approval by the State Council.
碳排放权交易产品包括碳排放配额和经国务院批准的其他现货交易产品。
Carbon emissions trading products include carbon emission allowances and other spot trading products approved by the State Council.
纳入全国碳排放权交易市场的温室气体重点排放单位(以下简称重点排放单位)以及符合国家有关规定的其他主体，可以参与碳排放权交易。
Key greenhouse gas emitting units included in the national carbon emissions trading market (hereinafter referred to as key emitting units) and other entities that meet relevant state regulations may participate in carbon emissions trading.
生态环境主管部门、其他对碳排放权交易及相关活动负有监督管理职责的部门(以下简称其他负有监督管理职责的部门)、全国碳排放权注册登记机构、全国碳排放权交易机构以及本条例规定的技术服务机构的工作人员，不得参与碳排放权交易。
Staff members of the competent departments of ecological environment, other departments responsible for the supervision and management of carbon emissions trading and related activities (hereinafter referred to as other departments with supervision and management responsibilities), the national carbon emissions registration institution, the national carbon emissions trading institution, and the technical service institutions specified in these Regulations shall not participate in carbon emissions trading.
国务院生态环境主管部门会同国务院有关部门，根据国家温室气体排放控制目标，制定重点排放单位的确定条件。省、自治区、直辖市人民政府(以下统称省级人民政府)生态环境主管部门会同同级有关部门，按照重点排放单位的确定条件制定本行政区域年度重点排放单位名录。
The competent department of ecological environment under the State Council, together with the relevant departments under the State Council, shall formulate the criteria for determining key emitting units based on the national greenhouse gas emission control targets. The competent departments of ecological environment of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government (hereinafter collectively referred to as provincial people's governments) shall, together with the relevant departments at the same level, formulate the annual list of key emitting units in their respective administrative regions in accordance with the criteria for determining key emitting units.
重点排放单位的确定条件和年度重点排放单位名录应当向社会公布。
The criteria for determining key emitting units and the annual list of key emitting units shall be disclosed to the public.
国务院生态环境主管部门会同国务院有关部门，根据国家温室气体排放控制目标，综合考虑经济社会发展、产业结构调整、行业发展阶段、历史排放情况、市场调节需要等因素，制定年度碳排放配额总量和分配方案，并组织实施。碳排放配额实行免费分配，并根据国家有关要求逐步推行免费和有偿相结合的分配方式。
The competent department of ecological environment under the State Council, together with the relevant departments under the State Council, shall formulate the total annual carbon emission allowance and allocation plan based on the national greenhouse gas emission control targets, taking into account factors such as economic and social development, industrial structure adjustment, industry development stage, historical emission situation, and market regulation needs, and organize its implementation. Carbon emission allowances shall be allocated free of charge, and a combination of free and paid allocation methods shall be gradually implemented in accordance with relevant state requirements.
省级人民政府生态环境主管部门会同同级有关部门，根据年度碳排放配额总量和分配方案，向本行政区域内的重点排放单位发放碳排放配额，不得违反年度碳排放配额总量和分配方案发放或者调剂碳排放配额。
The competent departments of ecological environment of provincial people's governments shall, together with the relevant departments at the same level, issue carbon emission allowances to key emitting units within their respective administrative regions in accordance with the total annual carbon emission allowance and allocation plan, and shall not issue or adjust carbon emission allowances in violation of the total annual carbon emission allowance and allocation plan.
依照本条例第六条、第八条、第九条的规定研究提出碳排放权交易覆盖的温室气体种类和行业范围、制定重点排放单位的确定条件以及年度碳排放配额总量和分配方案，应当征求省级人民政府、有关行业协会、企业事业单位、专家和公众等方面的意见。
When researching and proposing the types of greenhouse gases and industry scopes covered by carbon emissions trading, formulating the criteria for determining key emitting units, and the total annual carbon emission allowance and allocation plan in accordance with Articles 6, 8, and 9 of these Regulations, opinions shall be solicited from provincial people's governments, relevant industry associations, enterprises and institutions, experts, and the public.
重点排放单位应当采取有效措施控制温室气体排放，按照国家有关规定和国务院生态环境主管部门制定的技术规范，制定并严格执行温室气体排放数据质量控制方案，使用依法经计量检定合格或者校准的计量器具开展温室气体排放相关检验检测，如实准确统计核算本单位温室气体排放量，编制上一年度温室气体排放报告(以下简称年度排放报告)，并按照规定将排放统计核算数据、年度排放报告报送其生产经营场所所在地省级人民政府生态环境主管部门。
Key emitting units shall take effective measures to control greenhouse gas emissions, formulate and strictly implement a quality control plan for greenhouse gas emission data in accordance with relevant state regulations and technical specifications formulated by the competent department of ecological environment under the State Council, use measuring instruments that have passed metrological verification or calibration according to law to carry out relevant inspection and testing of greenhouse gas emissions, truthfully and accurately calculate and account for the greenhouse gas emissions of the unit, prepare the greenhouse gas emission report for the previous year (hereinafter referred to as the annual emission report), and submit the emission statistical accounting data and annual emission report to the competent department of ecological environment of the provincial people's government where the production and operation site is located in accordance with regulations.
重点排放单位应当对其排放统计核算数据、年度排放报告的真实性、完整性、准确性负责。
Key emitting units shall be responsible for the truthfulness, completeness, and accuracy of their emission statistical accounting data and annual emission report.
重点排放单位应当按照国家有关规定，向社会公开其年度排放报告中的排放量、排放设施、统计核算方法等信息。年度排放报告所涉数据的原始记录和管理台账应当至少保存5年。
Key emitting units shall, in accordance with relevant state regulations, disclose to the public information such as the emission amount, emission facilities, and statistical accounting methods in their annual emission report. The original records and management ledgers of the data involved in the annual emission report shall be kept for at least 5 years.
重点排放单位可以委托依法设立的技术服务机构开展温室气体排放相关检验检测、编制年度排放报告。
Key emitting units may entrust a legally established technical service institution to carry out inspection and testing related to greenhouse gas emissions and prepare the annual emission report.
省级人民政府生态环境主管部门应当对重点排放单位报送的年度排放报告进行核查，确认其温室气体实际排放量。核查工作应当在规定的时限内完成，并自核查完成之日起7个工作日内向重点排放单位反馈核查结果。核查结果应当向社会公开。
The competent department of ecological environment of the provincial people's government shall verify the annual emission report submitted by the key emitting unit to confirm its actual greenhouse gas emissions. The verification work shall be completed within the prescribed time limit, and the verification results shall be provided to the key emitting unit within 7 working days from the completion of the verification. The verification results shall be disclosed to the public.
省级人民政府生态环境主管部门可以通过政府购买服务等方式，委托依法设立的技术服务机构对年度排放报告进行技术审核。重点排放单位应当配合技术服务机构开展技术审核工作，如实提供有关数据和资料。
The competent department of ecological environment of the provincial people's government may, through government procurement of services and other means, entrust a legally established technical service institution to conduct technical review of the annual emission report. Key emitting entities shall cooperate with the technical service institution in carrying out the technical review and truthfully provide relevant data and materials.
接受委托开展温室气体排放相关检验检测的技术服务机构，应当遵守国家有关技术规程和技术规范要求，对其出具的检验检测报告承担相应责任，不得出具不实或者虚假的检验检测报告。重点排放单位应当按照国家有关规定制作和送检样品，对样品的代表性、真实性负责。
Technical service institutions entrusted to carry out inspection and testing related to greenhouse gas emissions shall comply with the relevant national technical procedures and technical specifications, bear corresponding responsibility for the inspection and testing reports they issue, and shall not issue false or fraudulent inspection and testing reports. Key emitting entities shall prepare and submit samples in accordance with relevant national regulations and be responsible for the representativeness and authenticity of the samples.
接受委托编制年度排放报告、对年度排放报告进行技术审核的技术服务机构，应当按照国家有关规定，具备相应的设施设备、技术能力和技术人员，建立业务质量管理制度，独立、客观、公正开展相关业务，对其出具的年度排放报告和技术审核意见承担相应责任，不得篡改、伪造数据资料，不得使用虚假的数据资料或者实施其他弄虚作假行为。年度排放报告编制和技术审核的具体管理办法由国务院生态环境主管部门会同国务院有关部门制定。
Technical service institutions entrusted to prepare annual emission reports or conduct technical review of annual emission reports shall, in accordance with relevant national regulations, have the corresponding facilities, equipment, technical capabilities, and technical personnel, establish a business quality management system, conduct relevant business independently, objectively, and impartially, bear corresponding responsibility for the annual emission reports and technical review opinions they issue, and shall not tamper with or falsify data or materials, use false data or materials, or engage in other fraudulent activities. The specific management measures for the preparation and technical review of annual emission reports shall be formulated by the competent department of ecological environment of the State Council jointly with relevant departments of the State Council.
技术服务机构在同一省、自治区、直辖市范围内不得同时从事年度排放报告编制业务和技术审核业务。
A technical service institution shall not concurrently engage in the preparation of annual emission reports and technical review business within the same province, autonomous region, or municipality directly under the Central Government.
重点排放单位应当根据省级人民政府生态环境主管部门对年度排放报告的核查结果，按照国务院生态环境主管部门规定的时限，足额清缴其碳排放配额。
Key emitting entities shall, based on the verification results of the annual emission report by the competent department of ecological environment of the provincial people's government, and within the time limit prescribed by the competent department of ecological environment of the State Council, fully surrender their carbon emission quotas.
重点排放单位可以通过全国碳排放权交易市场购买或者出售碳排放配额，其购买的碳排放配额可以用于清缴。
Key emitting entities may purchase or sell carbon emission quotas through the national carbon emissions trading market, and the carbon emission quotas they purchase may be used for surrender.
重点排放单位可以按照国家有关规定，购买经核证的温室气体减排量用于清缴其碳排放配额。
Key emitting entities may, in accordance with relevant national regulations, purchase certified greenhouse gas emission reductions to surrender their carbon emission quotas.
碳排放权交易可以采取协议转让、单向竞价或者符合国家有关规定的其他现货交易方式。
Carbon emissions trading may adopt methods such as negotiated transfer, unilateral auction, or other spot trading methods that comply with relevant national regulations.
禁止任何单位和个人通过欺诈、恶意串通、散布虚假信息等方式操纵全国碳排放权交易市场或者扰乱全国碳排放权交易市场秩序。
No unit or individual shall manipulate the national carbon emissions trading market or disrupt the order of the national carbon emissions trading market through fraud, malicious collusion, dissemination of false information, or other means.
国务院生态环境主管部门建立全国碳排放权交易市场管理平台，加强对碳排放配额分配、清缴以及重点排放单位温室气体排放情况等的全过程监督管理，并与国务院有关部门实现信息共享。
The competent department of ecological environment of the State Council shall establish a national carbon emissions trading market management platform to strengthen the whole-process supervision and management of carbon emission quota allocation, surrender, and greenhouse gas emissions of key emitting entities, and share information with relevant departments of the State Council.
生态环境主管部门和其他负有监督管理职责的部门，可以在各自职责范围内对重点排放单位等交易主体、技术服务机构进行现场检查。
The competent department of ecological environment and other departments with supervisory responsibilities may, within their respective scopes of duties, conduct on-site inspections of trading entities such as key emitting entities and technical service institutions.
生态环境主管部门和其他负有监督管理职责的部门进行现场检查，可以采取查阅、复制相关资料，查询、检查相关信息系统等措施，并可以要求有关单位和个人就相关事项作出说明。被检查者应当如实反映情况、提供资料，不得拒绝、阻碍。
When conducting on-site inspections, the competent department of ecological environment and other departments with supervisory responsibilities may take measures such as reviewing and copying relevant materials, inquiring and inspecting relevant information systems, and may require relevant units and individuals to provide explanations on relevant matters. The inspected party shall truthfully reflect the situation, provide materials, and shall not refuse or obstruct.
进行现场检查，检查人员不得少于2人，并应当出示执法证件。检查人员对检查中知悉的国家秘密、商业秘密，依法负有保密义务。
When conducting on-site inspections, there shall be no fewer than 2 inspectors, and they shall present their law enforcement credentials. Inspectors shall be legally obligated to keep confidential any state secrets or trade secrets learned during the inspection.
任何单位和个人对违反本条例规定的行为，有权向生态环境主管部门和其他负有监督管理职责的部门举报。接到举报的部门应当依法及时处理，按照国家有关规定向举报人反馈处理结果，并为举报人保密。
Any unit or individual has the right to report violations of these regulations to the competent department of ecological environment and other departments with supervisory responsibilities. The department receiving the report shall handle it in a timely manner in accordance with the law, provide feedback on the handling results to the whistleblower in accordance with relevant national regulations, and keep the whistleblower's identity confidential.
生态环境主管部门或者其他负有监督管理职责的部门的工作人员在碳排放权交易及相关活动的监督管理工作中滥用职权、玩忽职守、徇私舞弊的，应当依法给予处分。
If staff members of the competent department of ecological environment or other departments with supervisory responsibilities abuse their power, neglect their duties, or engage in malpractice for personal gain in the supervision and management of carbon emissions trading and related activities, they shall be given sanctions in accordance with the law.
生态环境主管部门、其他负有监督管理职责的部门、全国碳排放权注册登记机构、全国碳排放权交易机构以及本条例规定的技术服务机构的工作人员参与碳排放权交易的，由国务院生态环境主管部门责令依法处理持有的碳排放配额等交易产品，没收违法所得，可以并处所交易碳排放配额等产品的价款等值以下的罚款；属于国家工作人员的，还应当依法给予处分。
If staff members of the competent department of ecological environment, other departments with supervisory responsibilities, the national carbon emissions registration institution, the national carbon emissions trading institution, or the technical service institutions specified in these regulations participate in carbon emissions trading, the competent department of ecological environment of the State Council shall order them to lawfully dispose of the carbon emission quotas and other trading products they hold, confiscate illegal gains, and may impose a fine of not more than the equivalent value of the carbon emission quotas and other trading products traded; if they are state functionaries, sanctions shall also be imposed in accordance with the law.
重点排放单位有下列情形之一的，由生态环境主管部门责令改正，处5万元以上50万元以下的罚款；拒不改正的，可以责令停产整治：
If a key emitting entity falls under any of the following circumstances, the competent department of ecological environment shall order it to correct, impose a fine of not less than 50,000 yuan but not more than 500,000 yuan; if it refuses to correct, it may be ordered to suspend production for remediation:
(一)未按照规定制定并执行温室气体排放数据质量控制方案；
(1) Failing to formulate and implement a greenhouse gas emission data quality control plan in accordance with regulations;
(二)未按照规定报送排放统计核算数据、年度排放报告；
(2) Failing to submit emission statistical accounting data and annual emission reports in accordance with regulations;
(三)未按照规定向社会公开年度排放报告中的排放量、排放设施、统计核算方法等信息；
(3) Failing to publicly disclose information such as emission amounts, emission facilities, and statistical accounting methods in the annual emission report in accordance with regulations;
(四)未按照规定保存年度排放报告所涉数据的原始记录和管理台账。
(4) Failing to preserve the original records and management ledgers of the data involved in the annual emission report in accordance with regulations.
重点排放单位有下列情形之一的，由生态环境主管部门责令改正，没收违法所得，并处违法所得5倍以上10倍以下的罚款；没有违法所得或者违法所得不足50万元的，处50万元以上200万元以下的罚款；对其直接负责的主管人员和其他直接责任人员处5万元以上20万元以下的罚款；拒不改正的，按照50%以上100%以下的比例核减其下一年度碳排放配额，可以责令停产整治：
If a key emitting entity falls under any of the following circumstances, the competent department of ecological environment shall order it to correct, confiscate illegal gains, and impose a fine of not less than 5 times but not more than 10 times the illegal gains; if there are no illegal gains or the illegal gains are less than 500,000 yuan, a fine of not less than 500,000 yuan but not more than 2 million yuan shall be imposed; the directly responsible supervisors and other directly responsible personnel shall be fined not less than 50,000 yuan but not more than 200,000 yuan; if it refuses to correct, its carbon emission quota for the next year shall be reduced by a proportion of not less than 50% but not more than 100%, and it may be ordered to suspend production for remediation:
(一)未按照规定统计核算温室气体排放量；
(1) Failing to statistically account for greenhouse gas emissions in accordance with regulations;
(二)编制的年度排放报告存在重大缺陷或者遗漏，在年度排放报告编制过程中篡改、伪造数据资料，使用虚假的数据资料或者实施其他弄虚作假行为；
(2) The prepared annual emission report has major defects or omissions, or during the preparation of the annual emission report, data or materials are tampered with or falsified, false data or materials are used, or other fraudulent activities are carried out;
(三)未按照规定制作和送检样品。
(3) Failing to prepare and submit samples in accordance with regulations.
技术服务机构出具不实或者虚假的检验检测报告的，由生态环境主管部门责令改正，没收违法所得，并处违法所得5倍以上10倍以下的罚款；没有违法所得或者违法所得不足2万元的，处2万元以上10万元以下的罚款；情节严重的，由负责资质认定的部门取消其检验检测资质。
If a technical service provider issues an untrue or false inspection and testing report, the ecological environment authority shall order correction, confiscate illegal income, and impose a fine of 5 to 10 times the illegal income; if there is no illegal income or the illegal income is less than 20,000 yuan, a fine of 20,000 to 100,000 yuan shall be imposed; if the circumstances are serious, the qualification certification authority shall revoke its inspection and testing qualification.
技术服务机构出具的年度排放报告或者技术审核意见存在重大缺陷或者遗漏，在年度排放报告编制或者对年度排放报告进行技术审核过程中篡改、伪造数据资料，使用虚假的数据资料或者实施其他弄虚作假行为的，由生态环境主管部门责令改正，没收违法所得，并处违法所得5倍以上10倍以下的罚款；没有违法所得或者违法所得不足20万元的，处20万元以上100万元以下的罚款；情节严重的，禁止其从事年度排放报告编制和技术审核业务。
If the annual emission report or technical review opinion issued by a technical service provider has major defects or omissions, or if it falsifies or forges data materials during the preparation of the annual emission report or technical review, uses false data materials, or engages in other fraudulent activities, the ecological environment authority shall order correction, confiscate illegal income, and impose a fine of 5 to 10 times the illegal income; if there is no illegal income or the illegal income is less than 200,000 yuan, a fine of 200,000 to 1,000,000 yuan shall be imposed; if the circumstances are serious, it shall be prohibited from engaging in annual emission report preparation and technical review business.
技术服务机构因本条第一款、第二款规定的违法行为受到处罚的，对其直接负责的主管人员和其他直接责任人员处2万元以上20万元以下的罚款，5年内禁止从事温室气体排放相关检验检测、年度排放报告编制和技术审核业务；情节严重的，终身禁止从事前述业务。
If a technical service provider is punished for the illegal acts specified in the first or second paragraph of this article, the directly responsible supervisor and other directly responsible personnel shall be fined 20,000 to 200,000 yuan, and shall be prohibited from engaging in greenhouse gas emission-related inspection and testing, annual emission report preparation, and technical review business for 5 years; if the circumstances are serious, they shall be permanently prohibited from engaging in the aforementioned business.
重点排放单位未按照规定清缴其碳排放配额的，由生态环境主管部门责令改正，处未清缴的碳排放配额清缴时限前1个月市场交易平均成交价格5倍以上10倍以下的罚款；拒不改正的，按照未清缴的碳排放配额等量核减其下一年度碳排放配额，可以责令停产整治。
If a key emission unit fails to surrender its carbon emission quotas as required, the ecological environment authority shall order correction and impose a fine of 5 to 10 times the average market transaction price one month before the surrender deadline for the uns surrendered quotas; if it refuses to correct, its carbon emission quotas for the next year shall be reduced by an amount equal to the uns surrendered quotas, and it may be ordered to suspend production for remediation.
操纵全国碳排放权交易市场的，由国务院生态环境主管部门责令改正，没收违法所得，并处违法所得1倍以上10倍以下的罚款；没有违法所得或者违法所得不足50万元的，处50万元以上500万元以下的罚款。单位因前述违法行为受到处罚的，对其直接负责的主管人员和其他直接责任人员给予警告，并处10万元以上100万元以下的罚款。
If anyone manipulates the national carbon emissions trading market, the State Council ecological environment authority shall order correction, confiscate illegal income, and impose a fine of 1 to 10 times the illegal income; if there is no illegal income or the illegal income is less than 500,000 yuan, a fine of 500,000 to 5,000,000 yuan shall be imposed. If a unit is punished for the aforementioned illegal act, the directly responsible supervisor and other directly responsible personnel shall be given a warning and fined 100,000 to 1,000,000 yuan.
扰乱全国碳排放权交易市场秩序的，由国务院生态环境主管部门责令改正，没收违法所得，并处违法所得1倍以上10倍以下的罚款；没有违法所得或者违法所得不足10万元的，处10万元以上100万元以下的罚款。单位因前述违法行为受到处罚的，对其直接负责的主管人员和其他直接责任人员给予警告，并处5万元以上50万元以下的罚款。
If anyone disrupts the order of the national carbon emissions trading market, the State Council ecological environment authority shall order correction, confiscate illegal income, and impose a fine of 1 to 10 times the illegal income; if there is no illegal income or the illegal income is less than 100,000 yuan, a fine of 100,000 to 1,000,000 yuan shall be imposed. If a unit is punished for the aforementioned illegal act, the directly responsible supervisor and other directly responsible personnel shall be given a warning and fined 50,000 to 500,000 yuan.
拒绝、阻碍生态环境主管部门或者其他负有监督管理职责的部门依法实施监督检查的，由生态环境主管部门或者其他负有监督管理职责的部门责令改正，处2万元以上20万元以下的罚款。
If anyone refuses or obstructs the ecological environment authority or other supervisory authorities from conducting supervision and inspection according to law, the ecological environment authority or other supervisory authority shall order correction and impose a fine of 20,000 to 200,000 yuan.
国务院生态环境主管部门会同国务院有关部门建立重点排放单位等交易主体、技术服务机构信用记录制度，将重点排放单位等交易主体、技术服务机构因违反本条例规定受到行政处罚等信息纳入国家有关信用信息系统，并依法向社会公布。
The State Council ecological environment authority, together with other relevant departments of the State Council, shall establish a credit record system for key emission units and other trading entities and technical service providers, and incorporate information on administrative penalties imposed on key emission units and other trading entities and technical service providers for violations of these regulations into the national credit information system, and make it public according to law.
违反本条例规定，给他人造成损害的，依法承担民事责任；构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
Anyone who violates these regulations and causes harm to others shall bear civil liability according to law; if the act constitutes a violation of public security administration, public security administration penalties shall be imposed according to law; if the act constitutes a crime, criminal liability shall be investigated according to law.
对本条例施行前建立的地方碳排放权交易市场，应当参照本条例的规定健全完善有关管理制度，加强监督管理。
For local carbon emissions trading markets established before the implementation of these regulations, the relevant management systems shall be improved and strengthened in accordance with the provisions of these regulations.
本条例施行后，不再新建地方碳排放权交易市场，重点排放单位不再参与相同温室气体种类和相同行业的地方碳排放权交易市场的碳排放权交易。
After the implementation of these regulations, no new local carbon emissions trading markets shall be established, and key emission units shall no longer participate in carbon emissions trading in local carbon emissions trading markets for the same types of greenhouse gases and the same industries.
本条例下列用语的含义：
The meanings of the following terms in these regulations are:
(一)温室气体，是指大气中吸收和重新放出红外辐射的自然和人为的气态成分，包括二氧化碳、甲烷、氧化亚氮、氢氟碳化物、全氟化碳、六氟化硫和三氟化氮。
(1) Greenhouse gases refer to natural and anthropogenic gaseous components in the atmosphere that absorb and re-emit infrared radiation, including carbon dioxide, methane, nitrous oxide, hydrofluorocarbons, perfluorocarbons, sulfur hexafluoride, and nitrogen trifluoride.
(二)碳排放配额，是指分配给重点排放单位规定时期内的二氧化碳等温室气体的排放额度。1个单位碳排放配额相当于向大气排放1吨的二氧化碳当量。
(2) Carbon emission quota refers to the emission allowance of carbon dioxide and other greenhouse gases allocated to key emission units for a specified period. One unit of carbon emission quota is equivalent to emitting one ton of carbon dioxide equivalent into the atmosphere.
(三)清缴，是指重点排放单位在规定的时限内，向生态环境主管部门缴纳等同于其经核查确认的上一年度温室气体实际排放量的碳排放配额的行为。
(3) Surrender refers to the act of a key emission unit paying to the ecological environment authority, within the prescribed time limit, carbon emission quotas equivalent to its verified actual greenhouse gas emissions for the previous year.
重点排放单位消费非化石能源电力的，按照国家有关规定对其碳排放配额和温室气体排放量予以相应调整。
If a key emission unit consumes electricity from non-fossil energy sources, its carbon emission quotas and greenhouse gas emissions shall be adjusted accordingly in accordance with relevant state regulations.
国务院生态环境主管部门会同国务院民用航空等主管部门可以依照本条例规定的原则，根据实际需要，结合民用航空等行业温室气体排放控制的特点，对民用航空等行业的重点排放单位名录制定、碳排放配额发放与清缴、温室气体排放数据统计核算和年度排放报告报送与核查等制定具体管理办法。
The State Council ecological environment authority, together with the civil aviation authority and other relevant authorities of the State Council, may, in accordance with the principles set forth in these regulations and based on actual needs, taking into account the characteristics of greenhouse gas emission control in the civil aviation and other industries, formulate specific management measures for the establishment of the list of key emission units in the civil aviation and other industries, the allocation and surrender of carbon emission quotas, the statistical accounting of greenhouse gas emission data, and the submission and verification of annual emission reports.
本条例自2024年5月1日起施行。
These regulations shall take effect on May 1, 2024.
