Measures for the Implementation of Negotiable Instrument Administration

This regulation specifies the administration of negotiable instruments within the People's Republic of China, including the roles of the People's Bank of China, requirements for issuers and endorsers, and rules for signatures and seals.

为了加强票据管理,维护金融秩序,根据《中华人民共和国票据法》(以下简称票据法)的规定,制定本办法。

The issuer of a check shall be an enterprise, other organization, or individual that has opened a check deposit account with a bank, urban credit cooperative, or rural credit cooperative approved by the People's Bank of China to handle check deposit business.

票据法所称“保证人”,是指具有代为清偿票据债务能力的法人、其他组织或者个人。

The term "guarantor" as used in the Negotiable Instrument Law refers to a legal person, other organization, or individual that has the capacity to repay negotiable instrument debts on behalf of another.

If the drawer's signature or seal on an instrument does not comply with the Negotiable Instruments Law and these Measures, the instrument is invalid; if the endorser, acceptor, or guarantor's signature or seal does not comply, that signature or seal is invalid, but it does not affect the validity of other signatures or seals on the instrument.

付款人或者代理付款人收到挂失止付通知书,应当立即暂停支付。付款人或者代理付款人自收到挂失止付通知书之日起12日内没有收到人民法院的止付通知书的,自第13日起,挂失止付通知书失效。

A guarantor shall record the guarantee matters on the instrument or its allonge in accordance with the Negotiable Instruments Law. If the guarantor guarantees for the drawer, payer, or acceptor, the guarantee matters shall be recorded on the front of the instrument; if the guarantor guarantees for the endorser, the guarantee matters shall be recorded on the back of the instrument or its allonge.

If a staff member of a financial institution neglects their duty in negotiable instrument business and accepts, pays, guarantees, or discounts instruments that violate the provisions of the Negotiable Instruments Law and these Measures, the directly responsible person in charge and other directly responsible persons shall be given sanctions such as warning, demerit recording, removal from office, or dismissal; if significant losses are caused and a crime is constituted, criminal liability shall be pursued according to law.

If the payer of a negotiable instrument intentionally delays payment or postpones payment for an instrument payable on sight or at maturity, the People's Bank of China shall impose a fine of 0.7‰ of the daily instrument amount for the period of delay; the directly responsible person in charge and other directly responsible persons shall be given sanctions such as warning, demerit recording, removal from office, or dismissal.

违反中国人民银行规定,擅自印制票据的,由中国人民银行责令改正,处以1万元以上20万元以下的罚款;情节严重的,中国人民银行有权提请有关部门吊销其营业执照。

TranslationArticle 34

Whoever prints negotiable instruments without authorization in violation of the regulations of the People's Bank of China shall be ordered by the People's Bank of China to make corrections and be fined not less than 10,000 yuan but not more than 200,000 yuan; if the circumstances are serious, the People's Bank of China has the right to request the relevant department to revoke its business license.

The format, number of copies, color, specifications, anti-counterfeiting technical requirements, and printing of negotiable instruments shall be prescribed by the People's Bank of China.

本办法自1997年10月1日起施行。
