Interim Provisions on Certain Issues Concerning the Retirement of Senior Experts

为了充分发挥高级专家的作用，为社会主义建设事业多作贡献，并有利于新生力量的成长和队伍的更新，特制定本规定。
In order to fully utilize the role of senior experts, make greater contributions to the socialist construction cause, and facilitate the growth of new forces and the renewal of the team, these provisions are hereby formulated.
本规定所称高级专家，系指：正副教授、正副研究员、高级工程师、高级农艺师、正副主任医师、正副编审、正副译审、正副研究馆员、高级经济师、高级统计师、高级会计师、特级记者、高级记者、高级工艺美术师，以及文艺六级以上的专家。
The term "senior experts" as used in these Provisions refers to: full professors and associate professors, full researchers and associate researchers, senior engineers, senior agronomists, chief physicians and deputy chief physicians, senior editors and associate senior editors, senior translators and associate senior translators, senior research librarians and associate senior research librarians, senior economists, senior statisticians, senior accountants, special-grade journalists, senior journalists, senior industrial artists, and experts at or above the sixth grade in the arts.
高级专家离休退休年龄，一般应按国家统一规定执行。对其中少数高级专家，确因工作需要，身体能够坚持正常工作，征得本人同意，经下述机关批准，其离休退休年龄可以适当延长：
The retirement age for senior experts shall generally be implemented in accordance with the unified provisions of the State. For a small number of senior experts who are indeed needed for work, can persist in normal work physically, and with their consent, their retirement age may be appropriately extended upon approval by the following authorities:
副教授、副研究员以及相当这一级职称的高级专家，经所在单位报请上一级主管机关批准，可以适当延长离休退休年龄，但最长不超过六十五周岁；
For associate professors, associate researchers, and senior experts with equivalent professional titles, upon application by their unit to the next higher competent authority for approval, the retirement age may be appropriately extended, but shall not exceed 65 years of age at the latest;
教授、研究员以及相当这一级职称的高级专家，经所在单位报请省、市、自治区人民政府或中央、国家机关的部委批准，可以延长离休退休年龄，但最长不超过七十周岁；
For professors, researchers, and senior experts with equivalent professional titles, upon application by their unit to the people's government of the province, autonomous region, or municipality directly under the Central Government, or to the ministry or commission of the Central or State organs for approval, the retirement age may be extended, but shall not exceed 70 years of age at the latest;
学术上造诣高深、在国内外有重大影响的杰出高级专家，经国务院批准，可以暂缓离休退休，继续从事研究或著述工作。
For outstanding senior experts with profound academic attainments and significant influence at home and abroad, upon approval by the State Council, retirement may be postponed, allowing them to continue research or writing work.
延长离休退休年龄的高级专家中，担任行政领导职务或管理职务的，在达到国家统一规定的离休退休年龄时，应当免去其行政领导职务或管理职务，使他们集中精力继续从事科学技术或文化艺术等工作。特殊情况经过任免机关批准的除外。
Among senior experts whose retirement age is extended, those holding administrative leadership or management positions shall, upon reaching the unified retirement age prescribed by the State, be relieved of their administrative leadership or management positions so that they can concentrate on continuing scientific, technological, or cultural and artistic work. Exceptions are made for special circumstances approved by the appointing authority.
高级专家离休退休的待遇，按国家统一规定办理。符合以下情况的，退休费标准可以适当提高：
The retirement benefits for senior experts shall be handled in accordance with the unified provisions of the State. Where the following circumstances apply, the pension standard may be appropriately increased:
(一)有重大贡献的高级专家，经省、市、自治区人民政府或中央、国家机关的部委批准，其退休费标准可以酌情提高5%—15%。提高标准后的退休费，不得超过本人原标准工资。
(1) For senior experts with major contributions, upon approval by the people's government of the province, autonomous region, or municipality directly under the Central Government, or by the ministry or commission of the Central or State organs, their pension standard may be increased by 5% to 15% as appropriate. The pension after the increase shall not exceed their original standard salary.
(二)建国后从国外或者从香港、澳门、台湾回来定居工作的高级专家，其退休费均按建国后参加革命工作退休干部的最高标准发给。其中有重大贡献的，再按本条(一)项规定提高退休费。
(2) For senior experts who settled down to work after returning from abroad or from Hong Kong, Macao, or Taiwan after the founding of the People's Republic of China, their pension shall be paid at the highest standard for retired cadres who participated in revolutionary work after the founding of the People's Republic of China. Among them, those with major contributions shall have their pension further increased in accordance with paragraph (1) of this Article.
高级专家离休退休后，如身体尚好，可以接受部门或单位的聘请，担任科学技术或文化艺术顾问，也可以直接承担业务工作。聘请离休退休高级专家应签订聘请合同，聘请条件和受聘人员待遇按国家有关规定办理。
After retirement, if senior experts are in good health, they may accept invitations from departments or units to serve as scientific, technological, or cultural and artistic consultants, or may directly undertake professional work. The engagement of retired senior experts shall be subject to a signed engagement contract, and the engagement conditions and remuneration of the engaged personnel shall be handled in accordance with the relevant provisions of the State.
各单位和各部门要认真执行国务院关于干部离休退休后政治、生活待遇的有关规定，对离休退休的高级专家应体贴关怀，热情爱护；要积极主动地帮助他们继续进行科学研究、资料整理、著书立说等工作，为他们的业务活动提供必要的方便。
All units and departments shall conscientiously implement the relevant provisions of the State Council on the political and living treatment of retired cadres, and shall show care and warm concern for retired senior experts; they shall actively help them continue scientific research, data collation, writing, and other work, and provide necessary convenience for their professional activities.
本规定自发布之日起施行。本规定发布以前，已经离休退休的高级专家，不再复职。
These Provisions shall come into force on the date of promulgation. Senior experts who have already retired before the promulgation of these Provisions shall not be reinstated.
本规定由劳动人事部负责解释。
These Provisions shall be interpreted by the Ministry of Labor and Personnel.
