Interim Provisions on Calculating the Length of Service for Retirement and Resignation of State Organ Staff

一、国家机关工作人员(以下简称工作人员)在中华人民共和国国家机关工作的时间，一律计算为工作年限。
1. The time that state organ staff (hereinafter referred to as staff) have worked in state organs of the People's Republic of China shall all be calculated as length of service.
二、工作人员在中华人民共和国成立以前，参加人民民主革命政权机关工作的时间，应当计算为工作年限。
2. The time that staff worked in the organs of the people's democratic revolutionary regime before the founding of the People's Republic of China shall be calculated as length of service.
三、工作人员在参加国家机关工作以前，参加下列工作的时间，可以连续计算为工作年限：
3. The time that staff participated in the following work before joining state organs may be continuously calculated as length of service:
(一)在中国共产党的机关工作的时间，或者接受党的决定以社会职业为掩护而实际做革命工作的时间；
(1) Time worked in the organs of the Chinese Communist Party, or time spent actually doing revolutionary work under the Party's decision while using a social occupation as cover;
(二)在民主党派的机关工作的时间，或者民主党派成员和无党派的民主人士以社会职业为掩护而实际做民主革命工作的时间；
(2) Time worked in the organs of democratic parties, or time spent by members of democratic parties and non-party democrats actually doing democratic revolutionary work while using a social occupation as cover;
(三)在中国工农红军时期、抗日战争时期和解放战争时期，参加革命军队工作的时间；
(3) Time spent participating in revolutionary army work during the Chinese Workers' and Peasants' Red Army period, the Anti-Japanese War period, and the War of Liberation period;
(四)在革命根据地、解放区和中华人民共和国成立以后的人民团体的机关工作的时间；
(4) Time worked in the organs of mass organizations in revolutionary base areas, liberated areas, and after the founding of the People's Republic of China;
(五)在革命根据地、解放区政权所属的事业单位和中华人民共和国国家机关所属的事业单位工作的时间；
(5) Time worked in institutions affiliated with the regimes of revolutionary base areas and liberated areas, and in institutions affiliated with state organs of the People's Republic of China;
(六)在革命根据地、解放区政权所属的企业单位和中华人民共和国国营、合作社营、公私合营的企业单位工作的时间。
(6) Time worked in enterprises affiliated with the regimes of revolutionary base areas and liberated areas, and in state-owned, cooperative, and joint state-private enterprises of the People's Republic of China.
四、工作人员被抽调参加各种干部学校、训练班学习的时间，或者在革命根据地的抗日军政大学、陕北公学、中国女子大学等学校学习的时间，都可以计算为工作年限。
4. Time spent by staff members being seconded to study at various cadre schools or training classes, or time spent studying at schools such as the Anti-Japanese Military and Political University, Northern Shaanxi Public School, and China Women's University in revolutionary base areas, may be counted as length of service.
五、工作人员退职或复员后又参加工作的，前后工作的时间可以合并计算工作年限。
5. If a staff member resigns or is demobilized and later re-enters work, the periods of work before and after may be combined to calculate the length of service.
六、起义人员参加国家机关工作的，从起义之日起计算工作年限；曾经资遣回家以后参加国家机关工作的，从参加国家机关工作之日起计算年限。
6. For uprising personnel who join state organs, the length of service shall be calculated from the date of the uprising; for those who were previously sent home with severance pay and later join state organs, the length of service shall be calculated from the date of joining the state organ.
七、新招收的工作人员，试用期间，可以计算为工作年限。
7. For newly recruited staff members, the probation period may be counted as length of service.
八、工作人员受过开除处分或者刑事处分的，应当从重新参加工作之日起计算工作年限；但是情节较轻，并且经过任免机关批准的，他受处分以前工作的时间，也可以合并计算工作年限。
8. If a staff member has been subjected to disciplinary dismissal or criminal punishment, the length of service shall be calculated from the date of re-employment; however, if the circumstances are minor and approved by the appointing authority, the time worked before the punishment may also be combined to calculate the length of service.
九、工作人员的工作年限按周年计算。在计算退职金、退休金时，按周年计算后剩余的月数，超过六个月的，按一年计算；六个月和不满六个月的，按半年计算。
9. The length of service of a staff member shall be calculated in full years. When calculating resignation pay or retirement pension, any remaining months after full-year calculation: if more than six months, it shall be counted as one year; if six months or less, it shall be counted as half a year.
