为了加强国家重点建设项目的管理，保证国家重点建设项目的工程质量和按期竣工，提高投资效益，促进国民经济持续、快速、健康发展，制定本办法。
These Measures are formulated to strengthen the management of national key construction projects, ensure their engineering quality and timely completion, improve investment efficiency, and promote sustained, rapid, and healthy development of the national economy.
本办法所称国家重点建设项目，是指从下列国家大中型基本建设项目中确定的对国民经济和社会发展有重大影响的骨干项目：
For the purposes of these Measures, national key construction projects refer to backbone projects that have a significant impact on the national economy and social development, selected from the following categories of large and medium-sized capital construction projects:
(一)基础设施、基础产业和支柱产业中的大型项目；
(1) Large projects in infrastructure, basic industries, and pillar industries;
(二)高科技并能带动行业技术进步的项目；
(2) High-tech projects that can drive technological progress in the industry;
(三)跨地区并对全国经济发展或者区域经济发展有重大影响的项目；
(3) Cross-regional projects that have a significant impact on national or regional economic development;
(四)对社会发展有重大影响的项目；
(4) Projects that have a significant impact on social development;
(五)其他骨干项目。
(5) Other backbone projects.
国家重点建设项目的确定，根据国家产业政策、国民经济和社会发展的需要和可能，实行突出重点、量力而行、留有余地、防止资金分散、保证投资落实和资金供应的原则。
The determination of national key construction projects shall follow the principles of highlighting priorities, acting within capacity, leaving room for contingencies, preventing fund dispersion, and ensuring investment implementation and fund supply, based on the national industrial policy and the needs and possibilities of national economic and social development.
国家重点建设项目由国务院计划主管部门商国务院有关主管部门确定。
National key construction projects shall be determined by the competent department of planning under the State Council in consultation with the relevant competent departments under the State Council.
省、自治区、直辖市以及计划单列市的人民政府计划主管部门和国务院有关主管部门(公司)，按照本办法第二条规定的范围和第三条规定的原则，对本地区、本部门的基本建设项目进行平衡后，每年可以向国务院计划主管部门提出列为国家重点建设项目的申请。
The competent departments of planning of the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, and cities with independent planning status, as well as the relevant competent departments (companies) under the State Council, may, after balancing the capital construction projects within their respective regions or departments in accordance with the scope specified in Article 2 and the principles specified in Article 3, submit applications to the competent department of planning under the State Council each year for projects to be listed as national key construction projects.
国务院计划主管部门收到申请后，应当征求国务院有关主管部门的意见，进行综合平衡，在所申请项目的可行性研究报告批准后，确定国家重点建设预备项目；在所申请项目批准开工后，正式确定国家重点建设项目。
Upon receiving the applications, the competent department of planning under the State Council shall solicit opinions from the relevant competent departments under the State Council, conduct comprehensive balancing, and after the feasibility study report of the applied project is approved, determine the preparatory national key construction project; after the applied project is approved for commencement, formally determine it as a national key construction project.
国家重点建设项目和国家重点建设预备项目确定后，由国务院计划主管部门公布。
After the national key construction projects and preparatory national key construction projects are determined, they shall be announced by the competent department of planning under the State Council.
国务院计划主管部门和有关地方人民政府计划主管部门，应当按照国家重点建设项目的建设工期，安排国家重点建设项目的年度投资计划。
The competent department of planning under the State Council and the competent departments of planning of relevant local people's governments shall arrange the annual investment plans for national key construction projects in accordance with their construction periods.
国家重点建设项目，实行建设项目法人责任制；国家另有规定的，从其规定。
National key construction projects shall implement a project legal person responsibility system; where the state has other provisions, those provisions shall prevail.
建设项目法人负责国家重点建设项目的筹划、筹资、建设、生产经营、偿还债务和资产的保值增值，依照国家有关规定对国家重点建设项目的建设资金、建设工期、工程质量、生产安全等进行严格管理。
The project legal person shall be responsible for the planning, financing, construction, production and operation, debt repayment, and asset preservation and appreciation of the national key construction project, and shall strictly manage the construction funds, construction period, engineering quality, and production safety of the national key construction project in accordance with relevant state regulations.
建设项目法人的组织形式、组织机构，依照《中华人民共和国公司法》和国家有关规定执行。
The organizational form and structure of the project legal person shall be implemented in accordance with the Company Law of the People's Republic of China and relevant state regulations.
根据国家重点建设项目的年度投资计划和合同，负有拨付建设资金责任的国务院有关主管部门、有关地方人民政府、银行和企业事业单位，应当按照项目的建设进度，保证拨付建设资金。
The relevant competent departments under the State Council, relevant local people's governments, banks, and enterprises and institutions that are responsible for allocating construction funds in accordance with the annual investment plan and contracts of national key construction projects shall ensure the allocation of construction funds in accordance with the project construction progress.
国家重点建设项目的设备储备资金，各有关银行和部门应当优先安排。
Relevant banks and departments shall give priority to arranging equipment reserve funds for national key construction projects.
国务院计划主管部门和有关地方人民政府计划主管部门，在安排国家重点建设项目的年度投资计划时，应当预留一定比例的资金，用于国家重点建设项目建设过程中的特殊需要。
When arranging the annual investment plans for national key construction projects, the competent department of planning under the State Council and the competent departments of planning of relevant local people's governments shall reserve a certain proportion of funds to meet special needs during the construction of national key construction projects.
任何单位和个人不得挪用、截留国家重点建设项目的建设资金以及设备储备资金。
No unit or individual may misappropriate or withhold the construction funds or equipment reserve funds of national key construction projects.
地方人民政府负责与国家重点建设项目征地有关的协调工作，并提供必要的便利条件。土地管理部门应当依法保证国家重点建设项目的建设用地。
Local people's governments shall be responsible for coordination work related to land acquisition for national key construction projects and provide necessary conveniences. The land administration departments shall ensure the construction land for national key construction projects in accordance with the law.
国家重点建设项目主体工程的设计、施工、监理、设备采购，由建设项目法人依法公开进行招标，择优选定中标单位；但是，按照规定经批准可以议标、邀请招标的除外。
The design, construction, supervision, and equipment procurement of the main works of national key construction projects shall be conducted by the project legal person through open bidding in accordance with the law, selecting the winning bidder based on merit; however, this does not apply where negotiated bidding or invited bidding is approved in accordance with regulations.
国家重点建设项目的投标单位应当具有国家规定的甲级(一级)资格(资质)。
Bidders for national key construction projects shall have the Grade A (Class I) qualifications (credentials) as prescribed by the state.
国家重点建设项目的中标单位，未经建设项目法人的同意，不得将合同转包或者分包。
The winning bidder of a national key construction project shall not transfer or subcontract the contract without the consent of the project legal person.
国务院计划主管部门会同国务院有关主管部门、有关地方人民政府、银行，对国家重点建设项目的招标投标工作进行监督检查。
The competent department of planning under the State Council, together with the relevant competent departments under the State Council, relevant local people's governments, and banks, shall supervise and inspect the bidding and tendering work of national key construction projects.
电力、交通、邮电、供水、供热等单位，应当优先保证国家重点建设项目对施工和生产用电、物资运输、邮电通信和用水、用热等方面的需要，按照合同的约定履行义务。
Units such as electric power, transportation, post and telecommunications, water supply, and heat supply shall give priority to meeting the needs of national key construction projects for construction and production electricity, material transportation, post and telecommunications, water and heat, and shall perform their obligations in accordance with the contract.
有关企业事业单位应当优先供应国家重点建设项目所需的设备、材料，按照合同的约定履行义务。
Relevant enterprises and institutions shall give priority to supplying the equipment and materials required for national key construction projects and shall perform their obligations in accordance with the contract.
任何单位和个人不得向国家重点建设项目收取费用；但是，法律或者国务院另有规定的，从其规定。
No unit or individual may charge fees for national key construction projects; however, if laws or the State Council provide otherwise, those provisions shall prevail.
建设项目法人应当按照国家有关规定，向国务院计划主管部门报送国家重点建设项目的建设情况和资料，并抄报有关主管部门和银行。
The project legal person shall, in accordance with the relevant provisions of the state, submit the construction status and materials of the national key construction project to the competent department of planning under the State Council, and copy them to the relevant competent departments and banks.
为国家重点建设项目直接配套的项目，应当按照国家重点建设项目的建设进度，同步进行建设。为配套的项目提供建设资金的部门和单位，应当保证按照项目的建设进度拨付建设资金。
Projects directly supporting national key construction projects shall be constructed synchronously in accordance with the construction progress of the national key construction project. The departments and units providing construction funds for supporting projects shall ensure that construction funds are allocated in accordance with the project construction progress.
国家重点建设项目建成并经过试运营，应当按照批准的设计文件和其他有关文件，由建设项目法人及时组织设计、施工等单位进行初步验收。
After a national key construction project is completed and undergoes trial operation, the project legal person shall promptly organize design, construction and other units to conduct a preliminary acceptance in accordance with the approved design documents and other relevant documents.
初步验收合格的，由国务院计划主管部门或者其委托的机构，组织有关单位进行竣工验收。
If the preliminary acceptance is qualified, the competent department of planning under the State Council or its entrusted institution shall organize relevant units to conduct the final acceptance.
国家重点建设项目竣工验收合格的，经过运营，应当按照国家有关规定进行项目后评价。
After a national key construction project passes the final acceptance and undergoes operation, a post-project evaluation shall be conducted in accordance with the relevant provisions of the state.
国务院计划主管部门会同国务院有关主管部门、有关地方人民政府，对国家重点建设项目的建设进行协调、指导和监督。
The competent department of planning under the State Council, together with the relevant competent departments under the State Council and relevant local people's governments, shall coordinate, guide and supervise the construction of national key construction projects.
未按照规定拨付国家重点建设项目资金的，由国务院计划主管部门予以通报批评，并提请有关主管部门对负有直接责任的主管人员和其他责任人员依法给予行政处分；地方投资的部分连续两年未按照规定拨付的，国务院计划主管部门有权停止审批该地方下一年度的新开工项目。
If the funds for a national key construction project are not allocated in accordance with the provisions, the competent department of planning under the State Council shall circulate a notice of criticism and request the relevant competent department to impose administrative sanctions on the directly responsible persons in charge and other responsible persons according to law; if the local investment part fails to be allocated in accordance with the provisions for two consecutive years, the competent department of planning under the State Council has the right to suspend the approval of new projects in that locality for the following year.
未按照合同约定拨付国家重点建设项目资金的，应当承担相应的违约责任。
If the funds for a national key construction project are not allocated in accordance with the contract, the corresponding liability for breach of contract shall be borne.
挪用、截留国家重点建设项目资金的，由审计机关、财政机关追还被挪用、截留的资金，予以通报批评，并提请有关主管部门对负有直接责任的主管人员和其他责任人员依法给予行政处分；构成犯罪的，依法追究刑事责任。
If funds for a national key construction project are misappropriated or intercepted, the audit authority or financial authority shall recover the misappropriated or intercepted funds, circulate a notice of criticism, and request the relevant competent department to impose administrative sanctions on the directly responsible persons in charge and other responsible persons according to law; if a crime is constituted, criminal liability shall be pursued according to law.
扰乱国家重点建设项目建设、生产经营秩序，致使其不能正常进行的，依照《中华人民共和国治安管理处罚法》的规定给予处罚；构成犯罪的，依法追究刑事责任。
If anyone disrupts the construction or production and operation order of a national key construction project, causing it to fail to proceed normally, punishment shall be imposed in accordance with the provisions of the Public Security Administration Punishments Law of the People's Republic of China; if a crime is constituted, criminal liability shall be pursued according to law.
国家重点建设项目工程因管理不善、弄虚作假，造成严重超概算、质量低劣、损失浪费或者责任事故的，由国务院计划主管部门予以通报批评，并提请有关主管部门对负有直接责任的主管人员和其他责任人员依法给予行政处分；构成犯罪的，依法追究刑事责任。
If a national key construction project suffers from serious budget overruns, low quality, losses and waste, or liability accidents due to poor management or fraud, the competent department of planning under the State Council shall circulate a notice of criticism and request the relevant competent department to impose administrative sanctions on the directly responsible persons in charge and other responsible persons according to law; if a crime is constituted, criminal liability shall be pursued according to law.
本办法自发布之日起施行。
These Measures shall come into force as of the date of promulgation.
