These Regulations are formulated in accordance with the Water Law of the People's Republic of China, the Law on the Prevention and Control of Water Pollution of the People's Republic of China, and other laws, for the purposes of strengthening groundwater management, preventing and controlling groundwater over-extraction and pollution, ensuring groundwater quality and sustainable utilization, and promoting ecological civilization.

The water administrative department of the State Council shall be responsible for the unified supervision and management of groundwater nationwide. The ecological environment department of the State Council shall be responsible for the supervision and management of groundwater pollution prevention and control nationwide. The natural resources department and other relevant departments of the State Council shall perform their duties related to groundwater investigation, monitoring, and other work according to their respective functions.

Local people's governments at or above the county level shall be responsible for groundwater management within their respective administrative regions, and shall incorporate groundwater management into their national economic and social development plans, and take measures such as controlling extraction volume and preventing pollution to maintain reasonable groundwater levels and protect groundwater quality.

The water administrative departments of local people's governments at or above the county level shall, according to their management authority, be responsible for the unified supervision and management of groundwater within their respective administrative regions. People's governments at or above the county level shall organize water administrative, natural resources, ecological environment, and other competent departments to carry out groundwater condition survey and evaluation work. The survey and evaluation results are important bases for formulating plans for groundwater protection, utilization, and pollution prevention, as well as for groundwater management. The survey and evaluation results shall be disclosed to the public in accordance with the law.

The water administrative department of the State Council shall, together with the natural resources, development and reform, and other relevant departments of the State Council, provide guidance, coordination, and supervision over groundwater reserve work.

The water administrative department of the State Council, together with the natural resources department of the State Council, shall formulate and issue total groundwater extraction control indicators for each province, autonomous region, or municipality directly under the Central Government, based on the exploitable groundwater volume and surface water resource conditions of each province, autonomous region, or municipality directly under the Central Government.

The water administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government shall, together with the relevant departments of the same level government, formulate total groundwater extraction control indicators and groundwater level control indicators for the administrative regions at or above the county level within its jurisdiction, based on the total groundwater extraction control indicators issued by the state. These indicators shall be submitted to the people's government of the province, autonomous region, or municipality directly under the Central Government for approval before implementation, and shall be reported to the water administrative department of the State Council or its authorized river basin management agency for record.

When the water administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government formulates the total groundwater extraction control indicators and groundwater level control indicators within its administrative region, if it involves inter-provincial boundary areas that belong to the same hydrogeological unit, it shall consult and reach an agreement with the water administrative departments of the neighboring provinces, autonomous regions, or municipalities directly under the Central Government. If consultation fails, the water administrative department of the State Council shall, together with the relevant departments of the State Council, make the determination.

The water administrative department of the local people's government at or above the county level shall, based on the total groundwater extraction control indicators, groundwater level control indicators, and scientifically analyzed and calculated groundwater demand and water use structure within its administrative region, formulate an annual groundwater extraction plan, implement total control over the annual groundwater extraction within its administrative region, and report it to the water administrative department of the people's government at the next higher level for record.

Entities and individuals extracting groundwater shall comply with total extraction control and quota management requirements, use advanced water-saving technologies, processes, and equipment, and adopt measures such as water recycling, comprehensive utilization, and wastewater treatment and reuse to carry out technical transformation and reduce water consumption.

In areas where groundwater is used as an irrigation source, local people's governments at or above the county level shall take measures such as ensuring construction investment, increasing credit support for enterprises, and establishing a grassroots water conservancy service system to encourage the development of water-saving agriculture, promote water-saving irrigation technologies such as sprinkler irrigation, micro-irrigation, pipeline irrigation, and canal seepage control irrigation, as well as advanced agricultural machinery, agronomy, and biotechnology, to improve agricultural water use efficiency and save agricultural water.

The State Council, based on the needs of national economic and social development, shall pilot the collection of a water resource tax on entities and individuals extracting groundwater. The groundwater water resource tax shall implement differential tax rates based on local groundwater resource conditions, types of water extraction and use, and economic development, and reasonably increase the collection standard. Where the water resource tax is collected, the collection of water resource fees shall cease.

建设单位和个人应当采取措施防止地下工程建设对地下水补给、径流、排泄等造成重大不利影响。对开挖达到一定深度或者达到一定排水规模的地下工程,建设单位和个人应当于工程开工前,将工程建设方案和防止对地下水产生不利影响的措施方案报有管理权限的水行政主管部门备案。开挖深度和排水规模由省、自治区、直辖市人民政府制定、公布。

Construction units and individuals shall take measures to prevent underground engineering from causing significant adverse impacts on groundwater recharge, runoff, and discharge. For underground projects that reach a certain depth or a certain drainage scale, the construction unit or individual shall, before the project commences, submit the construction plan and the plan for measures to prevent adverse impacts on groundwater to the water administrative department with jurisdiction for filing. The excavation depth and drainage scale shall be formulated and published by the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government.

Urban and rural construction shall take into account the needs for groundwater conservation and recharge, and in accordance with the requirements of sponge city construction, promote sponge-type buildings, roads, squares, parks, and green spaces, gradually improving the rainwater collection and utilization system that integrates retention, infiltration, storage, and drainage. River and lake remediation shall also consider groundwater conservation, strengthening the protection and restoration of natural water body morphology.

The water administrative department of the relevant local people's government at or above the county level shall, together with the relevant departments of the same level, prepare protection plans for important spring areas, specifying the scope of protection and protection measures, and implement them after approval by the people's government at the same level.

TranslationArticle 32

The water administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government shall, together with the natural resources and other relevant departments of the same level, organize the designation of groundwater prohibited extraction zones and restricted extraction zones within its administrative region, taking into comprehensive consideration factors such as the designation of groundwater over-extraction zones, groundwater utilization conditions, and geological environment conditions. The designation shall be approved by the people's government of the province, autonomous region, or municipality directly under the Central Government, publicly announced, and reported to the water administrative department of the State Council for recordation.
