总则
General Provisions
为了加强对食盐的管理，保障食盐科学加碘工作的有效实施，确保食盐质量安全和供应安全，保护公民的身体健康，制定本办法。
This Regulation is formulated to strengthen the management of salt, ensure the effective implementation of scientific iodization of salt, guarantee the quality safety and supply safety of salt, and protect the health of citizens.
国家实行食盐专营管理。
The state implements a monopoly management system for salt.
本办法所称食盐，是指直接食用和制作食品所用的盐。
For the purposes of this Regulation, "salt" refers to salt used for direct consumption and for food preparation.
本办法适用于中华人民共和国境内的食盐生产、销售和储备活动。
This Regulation applies to the production, sale, and reserve activities of salt within the territory of the People's Republic of China.
国务院盐业主管部门主管全国盐业工作，负责管理全国食盐专营工作。县级以上地方人民政府确定的盐业主管部门负责管理本行政区域的食盐专营工作。
The salt industry authority of the State Council is responsible for the national salt industry work and manages the national salt monopoly work. The salt industry authority designated by the local people's government at or above the county level is responsible for managing the salt monopoly work within its administrative region.
国务院食品药品监督管理部门负责全国食盐质量安全监督管理。县级以上地方人民政府确定的食盐质量安全监督管理部门负责本行政区域的食盐质量安全监督管理。
The food and drug regulatory authority of the State Council is responsible for the national supervision and management of salt quality safety. The salt quality safety supervision and management authority designated by the local people's government at or above the county level is responsible for the supervision and management of salt quality safety within its administrative region.
盐业主管部门应当加强对工业用盐等非食用盐的管理，防止非食用盐流入食盐市场。
The salt industry authority shall strengthen the management of non-edible salt such as industrial salt, and prevent non-edible salt from entering the salt market.
国务院盐业主管部门应当会同有关部门加强对食盐生产、批发企业及其董事、监事、高级管理人员的信用管理，建立健全信用信息记录、公示制度，提高食盐行业信用水平。
The salt industry authority of the State Council shall, together with relevant departments, strengthen the credit management of salt production and wholesale enterprises and their directors, supervisors, and senior management personnel, establish and improve a credit information recording and disclosure system, and improve the credit level of the salt industry.
依法成立的盐业行业组织依照法律、行政法规和章程，保护企业合法权益，加强行业自律，促进企业守法、诚信经营，引导企业公平竞争。
Salt industry organizations established according to law shall, in accordance with laws, administrative regulations, and their articles of association, protect the legitimate rights and interests of enterprises, strengthen industry self-discipline, promote enterprises to abide by the law and operate in good faith, and guide enterprises to compete fairly.
食盐生产
Salt Production
国家实行食盐定点生产制度。非食盐定点生产企业不得生产食盐。
The state implements a designated production system for salt. Non-designated salt production enterprises shall not produce salt.
省、自治区、直辖市人民政府盐业主管部门按照统一规划、合理布局的要求审批确定食盐定点生产企业，颁发食盐定点生产企业证书，及时向社会公布食盐定点生产企业名单，并报国务院盐业主管部门备案。
The salt industry authority of the people's government of a province, autonomous region, or municipality directly under the Central Government shall, in accordance with the requirements of unified planning and rational layout, approve and determine designated salt production enterprises, issue designated salt production enterprise certificates, promptly publish the list of designated salt production enterprises to the public, and report to the salt industry authority of the State Council for record.
食盐定点生产企业和非食用盐生产企业应当建立生产销售记录制度，如实记录并保存相关凭证。记录和凭证保存期限不得少于2年。
Designated salt production enterprises and non-edible salt production enterprises shall establish a production and sales record system, truthfully record and preserve relevant vouchers. The retention period for records and vouchers shall not be less than 2 years.
食盐应当按照规定在外包装上作出标识，非食用盐的包装、标识应当明显区别于食盐。
Salt shall be labeled on the outer packaging as required. The packaging and labeling of non-edible salt shall be clearly distinguishable from that of salt.
禁止利用井矿盐卤水熬制食盐。
It is prohibited to use well and mine salt brine to boil salt.
食盐销售
Salt Sales
国家实行食盐定点批发制度。非食盐定点批发企业不得经营食盐批发业务。
The state implements a designated wholesale system for salt. Non-designated salt wholesale enterprises shall not engage in salt wholesale business.
省、自治区、直辖市人民政府盐业主管部门按照统一规划、合理布局的要求审批确定食盐定点批发企业，颁发食盐定点批发企业证书，及时向社会公布食盐定点批发企业名单，并报国务院盐业主管部门备案。
The salt industry authority of the people's government of a province, autonomous region, or municipality directly under the Central Government shall, in accordance with the requirements of unified planning and rational layout, approve and determine designated salt wholesale enterprises, issue designated salt wholesale enterprise certificates, promptly publish the list of designated salt wholesale enterprises to the public, and report to the salt industry authority of the State Council for record.
食盐定点生产企业申请经营食盐批发业务的，省、自治区、直辖市人民政府盐业主管部门应当确定其为食盐定点批发企业并颁发食盐定点批发企业证书。
If a designated salt production enterprise applies to engage in salt wholesale business, the salt industry authority of the people's government of the province, autonomous region, or municipality directly under the Central Government shall designate it as a designated salt wholesale enterprise and issue a designated salt wholesale enterprise certificate.
食盐定点批发企业应当从食盐定点生产企业或者其他食盐定点批发企业购进食盐，在国家规定的范围内销售。
Designated salt wholesale enterprises shall purchase salt from designated salt production enterprises or other designated salt wholesale enterprises, and sell within the scope prescribed by the state.
食盐定点批发企业在国家规定的范围内销售食盐，任何单位或者个人不得阻止或者限制。
When designated salt wholesale enterprises sell salt within the scope prescribed by the state, no unit or individual may prevent or restrict such sales.
食盐定点批发企业应当建立采购销售记录制度，如实记录并保存相关凭证。记录和凭证保存期限不得少于2年。
Designated salt wholesale enterprises shall establish a purchase and sales record system, truthfully record and preserve relevant vouchers. The retention period for records and vouchers shall not be less than 2 years.
食盐零售单位应当从食盐定点批发企业购进食盐。
Salt retail units shall purchase salt from designated salt wholesale enterprises.
食盐价格由经营者自主确定。
The price of edible salt shall be determined independently by the operator.
县级以上地方人民政府价格主管部门应当加强对食盐零售价格的市场日常监测。当食盐价格显著上涨或者有可能显著上涨时，省、自治区、直辖市人民政府可以依法采取价格干预或者其他应急措施。
The pricecompetent authority of the local people's government at or above the county level shall strengthen daily market monitoring of retail prices of edible salt. When the price of edible salt rises significantly or is likely to rise significantly, the people's government of a province, autonomous region, or municipality directly under the Central Government may take price intervention or other emergency measures in accordance with the law.
县级以上地方人民政府应当根据实际情况，采取必要措施，保障边远地区和民族地区的食盐供应。
The local people's government at or above the county level shall, based on actual circumstances, take necessary measures to ensure the supply of edible salt in remote areas and ethnic minority areas.
禁止销售不符合食品安全标准的食盐。
It is prohibited to sell edible salt that does not meet food safety standards.
禁止将下列产品作为食盐销售：
It is prohibited to sell the following products as edible salt:
(一)液体盐(含天然卤水)；
(1) Liquid salt (including natural brine);
(二)工业用盐和其他非食用盐；
(2) Industrial salt and other non-edible salt;
(三)利用盐土、硝土或者工业废渣、废液制作的盐；
(3) Salt made from salt soil, nitrate soil, or industrial waste residue or waste liquid;
(四)利用井矿盐卤水熬制的盐；
(4) Salt boiled from well and mine salt brine;
(五)外包装上无标识或者标识不符合国家有关规定的盐。
(5) Salt without labeling on the outer packaging or with labeling that does not comply with relevant national regulations.
食盐的储备和应急管理
Reserve and Emergency Management of Edible Salt
省、自治区、直辖市人民政府盐业主管部门应当根据本行政区域食盐供需情况，建立健全食盐储备制度，承担政府食盐储备责任。
The salt industrycompetent authority of the people's government of a province, autonomous region, or municipality directly under the Central Government shall, based on the supply and demand of edible salt in its administrative region, establish and improve the edible salt reserve system and assume the government's responsibility for edible salt reserves.
食盐定点生产企业和食盐定点批发企业应当按照食盐储备制度要求，承担企业食盐储备责任，保持食盐的合理库存。
Designated edible salt production enterprises and designated edible salt wholesale enterprises shall, in accordance with the requirements of the edible salt reserve system, assume the enterprise's responsibility for edible salt reserves and maintain reasonable inventory of edible salt.
盐业主管部门应当会同有关部门制定食盐供应应急预案，在发生突发事件时协调、保障食盐供应。
The salt industrycompetent authority shall, together with relevant departments, formulate emergency plans for edible salt supply, and coordinate and ensure the supply of edible salt in the event of emergencies.
监督管理
Supervision and Administration
盐业主管部门依法履行监督检查职责，可以采取下列措施：
The salt industrycompetent authority, when performing supervision and inspection duties in accordance with the law, may take the following measures:
(一)向有关单位和个人了解情况；
(1) Inquire about the situation from relevant units and individuals;
(二)查阅或者复制有关合同、票据、账簿、购销记录及其他有关资料；
(2) Review or copy relevant contracts, bills, account books, purchase and sale records, and other relevant materials;
(三)查封、扣押与涉嫌盐业违法行为有关的食盐及原材料，以及用于违法生产或者销售食盐的工具、设备；
(3) Seal up or seize edible salt and raw materials related to suspected salt industry violations, as well as tools and equipment used for illegal production or sale of edible salt;
(四)查封涉嫌违法生产或者销售食盐的场所。
(4) Seal up premises suspected of illegal production or sale of edible salt.
采取前款第三项、第四项规定的措施，应当向盐业主管部门主要负责人书面报告，并经批准。
Taking the measures specified in items (3) and (4) of the preceding paragraph shall be reported in writing to the main person in charge of the salt industrycompetent authority and approved.
盐业主管部门调查涉嫌盐业违法行为，应当遵守《中华人民共和国行政强制法》和其他有关法律、行政法规的规定。
When investigating suspected salt industry violations, the salt industrycompetent authority shall comply with the Administrative Compulsion Law of the People's Republic of China and other relevant laws and administrative regulations.
盐业主管部门、食盐质量安全监督管理部门应当各司其职，加强协作，相互配合，通过政务信息系统等实现信息共享，建立健全行政执法协作配合制度。
The salt industrycompetent authority and the edible salt quality and safety supervision and administration department shall perform their respective duties, strengthen collaboration, cooperate with each other, achieve information sharing through government information systems, and establish and improve the administrative law enforcement cooperation and coordination system.
盐业主管部门、食盐质量安全监督管理部门在监督管理工作中发现依法不属于本部门处理权限的涉嫌违法行为，应当及时移交有权处理的部门；有权处理的部门应当依法及时处理，并及时反馈处理结果。
If, during supervision and administration, the salt industrycompetent authority or the edible salt quality and safety supervision and administration department discovers suspected violations that are not within its jurisdiction, it shall promptly transfer the case to the department with authority; the department with authority shall handle it promptly in accordance with the law and provide feedback on the handling results.
盐业主管部门、食盐质量安全监督管理部门应当向社会公布本部门的联系方式，方便公众举报违法行为。
The salt industrycompetent authority and the edible salt quality and safety supervision and administration department shall publicly disclose their contact information to facilitate public reporting of violations.
盐业主管部门、食盐质量安全监督管理部门接到举报，应当及时依法调查处理。对实名举报，盐业主管部门、食盐质量安全监督管理部门应当为举报人保密，并将处理结果告知举报人。
The salt industrycompetent authority and the salt quality safety supervision and management department, upon receiving a report, shall promptly investigate and handle it in accordance with the law. For real-name reports, the salt industrycompetent authority and the salt quality safety supervision and management department shall keep the reporter confidential and inform the reporter of the handling result.
法律责任
Legal Liability
有下列情形之一的，由县级以上地方人民政府盐业主管部门予以取缔，没收违法生产经营的食盐和违法所得。违法生产经营的食盐货值金额不足1万元的，可以处5万元以下的罚款；货值金额1万元以上的，并处货值金额5倍以上10倍以下的罚款：
Under any of the following circumstances, the salt industrycompetent authority of the local people's government at or above the county level shall ban the operation, confiscate the illegally produced and operated salt and illegal gains. If the value of the illegally produced and operated salt is less than 10,000 yuan, a fine of not more than 50,000 yuan may be imposed; if the value is 10,000 yuan or more, a fine of not less than 5 times but not more than 10 times the value of the goods shall be imposed:
(一)非食盐定点生产企业生产食盐；
(1) Non-edible salt designated production enterprises produce edible salt;
(二)非食盐定点批发企业经营食盐批发业务。
(2) Non-edible salt designated wholesale enterprises engage in edible salt wholesale business.
有下列情形之一的，由县级以上地方人民政府盐业主管部门责令改正，处5000元以上5万元以下的罚款；情节严重的，责令停产停业整顿，直至吊销食盐定点生产、食盐定点批发企业证书：
Under any of the following circumstances, the salt industrycompetent authority of the local people's government at or above the county level shall order correction, impose a fine of not less than 5,000 yuan but not more than 50,000 yuan; if the circumstances are serious, order suspension of production and business for rectification, up to revocation of the edible salt designated production or edible salt designated wholesale enterprise certificate:
(一)食盐定点生产企业、非食用盐生产企业未按照本办法规定保存生产销售记录；
(1) Edible salt designated production enterprises or non-edible salt production enterprises fail to keep production and sales records as required by these regulations;
(二)食盐定点批发企业未按照本办法规定保存采购销售记录；
(2) Edible salt designated wholesale enterprises fail to keep procurement and sales records as required by these regulations;
(三)食盐定点批发企业超出国家规定的范围销售食盐；
(3) Edible salt designated wholesale enterprises sell edible salt beyond the scope prescribed by the state;
(四)将非食用盐产品作为食盐销售。
(4) Selling non-edible salt products as edible salt.
有下列情形之一的，由县级以上地方人民政府盐业主管部门责令改正，没收违法购进的食盐，可以处违法购进的食盐货值金额3倍以下的罚款：
Under any of the following circumstances, the salt industrycompetent authority of the local people's government at or above the county level shall order correction, confiscate the illegally purchased salt, and may impose a fine of not more than 3 times the value of the illegally purchased salt:
(一)食盐定点批发企业从除食盐定点生产企业、其他食盐定点批发企业以外的单位或者个人购进食盐；
(1) Edible salt designated wholesale enterprises purchase edible salt from units or individuals other than edible salt designated production enterprises or other edible salt designated wholesale enterprises;
(二)食盐零售单位从食盐定点批发企业以外的单位或者个人购进食盐。
(2) Edible salt retail units purchase edible salt from units or individuals other than edible salt designated wholesale enterprises.
未按照本办法第十条的规定作出标识的，由有关主管部门依据职责分工，责令改正，可以处5万元以下的罚款。
If labeling is not made in accordance with Article 10 of these regulations, the relevant competent department shall, according to its division of responsibilities, order correction and may impose a fine of not more than 50,000 yuan.
经营者的行为违反本办法的规定同时违反《中华人民共和国食品安全法》的，由县级以上地方人民政府食盐质量安全监督管理部门依照《中华人民共和国食品安全法》进行处罚。
If an operator's conduct violates these regulations and also violates the Food Safety Law of the People's Republic of China, the salt quality safety supervision and management department of the local people's government at or above the county level shall impose penalties in accordance with the Food Safety Law of the People's Republic of China.
食盐定点生产企业、食盐定点批发企业违反本办法的规定，被处以吊销食盐定点生产、食盐定点批发企业证书行政处罚的，其法定代表人、直接负责的主管人员和其他直接责任人员自处罚决定作出之日起5年内不得从事食盐生产经营管理活动，不得担任食盐定点生产企业、食盐定点批发企业的董事、监事或者高级管理人员。
If an edible salt designated production enterprise or edible salt designated wholesale enterprise violates these regulations and is subject to the administrative penalty of revocation of the edible salt designated production or edible salt designated wholesale enterprise certificate, its legal representative, directly responsible supervisors, and other directly responsible personnel shall not engage in edible salt production and operation management activities within 5 years from the date of the penalty decision, and shall not serve as directors, supervisors, or senior managers of edible salt designated production enterprises or edible salt designated wholesale enterprises.
食盐定点生产企业、食盐定点批发企业违反前款规定聘用人员的，由盐业主管部门责令改正；拒不改正的，吊销其食盐定点生产、食盐定点批发企业证书。
If an edible salt designated production enterprise or edible salt designated wholesale enterprise employs personnel in violation of the preceding paragraph, the salt industrycompetent authority shall order correction; if it refuses to correct, its edible salt designated production or edible salt designated wholesale enterprise certificate shall be revoked.
违反本办法的规定，构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
If a violation of these regulations constitutes a violation of public security administration, public security administration penalties shall be imposed in accordance with the law; if a crime is constituted, criminal liability shall be investigated in accordance with the law.
盐业主管部门以及其他有关部门的工作人员滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予处分。
If staff members of the salt industrycompetent authority and other relevant departments abuse their power, neglect their duties, or engage in malpractice for personal gain, if a crime is constituted, criminal liability shall be investigated in accordance with the law; if no crime is constituted, administrative sanctions shall be imposed in accordance with the law.
附则
Supplementary Provisions
除本办法的规定外，食盐质量安全监督管理、食盐加碘工作还应当依照有关法律、行政法规的规定执行。
In addition to the provisions of these regulations, the supervision and management of edible salt quality safety and the work of salt iodization shall also be implemented in accordance with the provisions of relevant laws and administrative regulations.
渔业、畜牧用盐管理办法，由国务院盐业主管部门会同国务院农业行政主管部门另行制定。
Measures for the management of fishery and livestock salt shall be separately formulated by the salt industrycompetent authority of the State Council in conjunction with the agricultural administrative department of the State Council.
本办法自公布之日起施行。1990年3月2日国务院发布的《盐业管理条例》同时废止。
These regulations shall come into effect on the date of promulgation. The Salt Industry Management Regulations promulgated by the State Council on March 2, 1990 shall be simultaneously abolished.
