为了规范和加强政府参事工作，保障参事依法履行职责，发挥参事参政议政、建言献策、咨询国是、民主监督、统战联谊的作用，制定本条例。
These Regulations are formulated to standardize and strengthen the work of government counselors, ensure that counselors perform their duties in accordance with the law, and give full play to the role of counselors in participating in the deliberation and administration of state affairs, offering suggestions, consulting on state affairs, democratic supervision, and united front work.
国务院和省、自治区、直辖市以及设区的市人民政府设立的参事工作机构，主管本级人民政府的参事工作。上级人民政府参事工作机构指导下级人民政府参事工作机构的工作。
The counselor work institutions established by the State Council and the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, and cities with districts shall be in charge of the counselor work of the respective people's governments. The counselor work institution of the higher-level people's government shall guide the work of the counselor work institution of the lower-level people's government.
参事实行聘任制。国务院参事由国务院总理聘任，省、自治区、直辖市人民政府参事分别由省长、自治区主席、市长聘任，设区的市人民政府参事由市长聘任。
Counselors shall be appointed on a contract basis. Counselors of the State Council shall be appointed by the Premier of the State Council; counselors of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall be appointed by the governor, chairman of the autonomous region, or mayor, respectively; counselors of the people's governments of cities with districts shall be appointed by the mayor.
参事主要从民主党派成员和无党派人士中聘任，也可以从中国共产党党员专家学者中聘任。
Counselors shall be mainly appointed from members of democratic parties and persons without party affiliation, but may also be appointed from experts and scholars who are members of the Communist Party of China.
参事应当符合下列条件：
Counselors shall meet the following conditions:
(一)拥护中华人民共和国宪法；
(1) Uphold the Constitution of the People's Republic of China;
(二)具有一定的代表性、较大的社会影响和较高的知名度；
(2) Have a certain representativeness, significant social influence, and high visibility;
(三)具有较强的参政咨询能力；
(3) Have strong ability to participate in consultation and provide advice;
(四)具备履行职责的身体条件和意愿。
(4) Have the physical conditions and willingness to perform duties.
参事的首聘年龄不得低于55周岁，不得高于65周岁。参事任职的最高年龄不得超过70周岁。
The age at first appointment of a counselor shall not be less than 55 years old and shall not exceed 65 years old. The maximum age for a counselor to hold office shall not exceed 70 years old.
聘任参事应当依照下列程序：
The appointment of counselors shall follow the following procedures:
(一)本级人民政府领导人员和各有关单位向参事工作机构推荐参事人选；
(1) Leaders of the people's government at the same level and relevant units recommend candidates for counselors to the counselor work institution;
(二)参事工作机构会同有关部门根据本条例第五条规定的条件，研究确定考察人选并进行考察；
(2) The counselor work institution, together with relevant departments, shall determine candidates for investigation and conduct investigations in accordance with the conditions specified in Article 5 of these Regulations;
(三)参事工作机构与有关部门根据考察情况研究确定参事拟聘人选，报本级人民政府审定；
(3) The counselor work institution, together with relevant departments, shall determine the proposed candidates for appointment based on the investigation results and report to the people's government at the same level for approval;
(四)本级人民政府主要负责人签发聘书。
(4) The principal responsible person of the people's government at the same level shall issue the letter of appointment.
参事每届任期不超过5年。政府工作需要且符合本条例第五条规定条件的，可以续聘。
The term of office of a counselor shall not exceed five years. If the work of the government requires and the conditions specified in Article 5 of these Regulations are met, the counselor may be reappointed.
参事在任期内不再符合本条例第五条规定的条件或者不能继续履行职责的，参事工作机构应当及时报本级人民政府主要负责人予以解聘。
If a counselor no longer meets the conditions specified in Article 5 of these Regulations during the term of office or is unable to continue performing duties, the counselor work institution shall promptly report to the principal responsible person of the people's government at the same level for dismissal.
参事在任期内可以向参事工作机构申请离任。参事申请离任的，由参事工作机构报本级人民政府批准。
A counselor may apply to the counselor work institution for resignation during the term of office. If a counselor applies for resignation, the counselor work institution shall report to the people's government at the same level for approval.
参事履行下列职责：
Counselors shall perform the following duties:
(一)围绕本级人民政府的中心工作开展调查研究，了解、反映社情民意；
(1) Conduct investigation and research around the central work of the people's government at the same level, understand and reflect social conditions and public opinion;
(二)对本级人民政府的工作进行监督，提出意见、建议和批评；
(2) Supervise the work of the people's government at the same level, and put forward opinions, suggestions, and criticisms;
(三)对有关法律文件草案、本级人民政府工作报告稿和其他重要文件草案提出修改意见和建议；
(3) Put forward revision opinions and suggestions on draft legal documents, draft work reports of the people's government at the same level, and other important document drafts;
(四)参加爱国统一战线工作；
(4) Participate in the work of the patriotic united front;
(五)承担本级人民政府交办的其他工作。
(5) Undertake other work assigned by the people's government at the same level.
参事享有下列权利：
Counselors shall enjoy the following rights:
(一)直接向本级人民政府领导人员反映情况，提出意见和建议；
(1) Directly report situations and provide opinions and suggestions to the leading personnel of the people's government at the same level;
(二)根据履行职责的需要，向本级和下级人民政府有关部门了解情况；
(2) As required for performing duties, inquire about situations from relevant departments of the people's government at the same level and lower levels;
(三)应邀参加本级人民政府有关会议；
(3) Be invited to attend relevant meetings of the people's government at the same level;
(四)享受国家规定的工作待遇。
(4) Enjoy the working benefits stipulated by the state.
参事应当履行工作职责，遵守工作纪律，保守国家秘密，遵守廉政规定，不得利用职务之便谋取不正当利益。
Counselors shall perform their work duties, abide by work discipline, protect state secrets, comply with integrity regulations, and shall not use their positions to seek improper benefits.
设立参事工作机构的人民政府应当为本级人民政府参事工作提供经费保障，为参事依法履行职责提供便利条件。
The people's government that establishes a counselor work institution shall provide financial guarantees for the counselor work at the same level and provide convenient conditions for counselors to perform their duties according to law.
设立参事工作机构的人民政府应当根据科学民主依法决策的需要，安排本级人民政府参事开展参政咨询工作的重点任务，定期向参事通报政府重大决策、工作部署和经济社会发展情况，采取座谈会、论证会等方式直接听取参事的意见和建议，接受参事对政府工作的民主监督。
The people's government that establishes a counselor work institution shall, based on the needs of scientific, democratic, and lawful decision-making, arrange key tasks for counselors at the same level to participate in political consultation and advice, regularly inform counselors of major government decisions, work deployments, and economic and social development situations, adopt methods such as symposiums and demonstration meetings to directly listen to counselors' opinions and suggestions, and accept counselors' democratic supervision of government work.
设立参事工作机构的人民政府有关部门和下级人民政府应当支持、配合参事的工作，及时办理参事建议并向参事工作机构反馈办理情况。
Relevant departments of the people's government that establishes a counselor work institution and people's governments at lower levels shall support and cooperate with the work of counselors, promptly handle counselors' suggestions, and provide feedback on the handling situation to the counselor work institution.
参事工作机构负责对本级人民政府参事的组织管理和服务，履行下列职责：
The counselor work institution is responsible for the organization, management, and services of counselors of the people's government at the same level, and performs the following duties:
(一)组织参事学习党和国家的方针政策；
(1) Organize counselors to study the policies and guidelines of the Party and the state;
(二)组织参事围绕本级人民政府的中心工作开展调查研究；
(2) Organize counselors to conduct investigations and research around the central work of the people's government at the same level;
(三)组织参事开展同外国政府咨询机构的交流与合作；
(3) Organize counselors to carry out exchanges and cooperation with foreign government advisory institutions;
(四)组织参事参加爱国统一战线工作；
(4) Organize counselors to participate in the patriotic united front work;
(五)为参事依法履行职责提供保障和服务；
(5) Provide guarantees and services for counselors to perform their duties according to law;
(六)对参事履行职责的情况进行考评；
(6) Evaluate the performance of counselors in performing their duties;
(七)承办本级人民政府交办的其他事项。
(7) Undertake other matters assigned by the people's government at the same level.
参事的人事关系所在单位应当为参事履行职责提供必要的工作条件，落实国家规定的待遇。
The unit where the counselor's personnel relationship is located shall provide necessary working conditions for the counselor to perform duties and implement the benefits stipulated by the state.
参事的人事关系在党政机关、事业单位的，其编制管理按照国家有关规定执行。
If the counselor's personnel relationship is in a Party or government organ or public institution, the establishment management shall be implemented in accordance with relevant state regulations.
参事在参事工作中成绩显著、为政府科学民主依法决策做出突出贡献的，由本级人民政府给予表彰奖励。
Counselors who achieve remarkable results in counselor work and make outstanding contributions to the government's scientific, democratic, and lawful decision-making shall be commended and rewarded by the people's government at the same level.
参事不依法履行职责或者从事与参事身份不符的活动、造成不良后果的，参事工作机构应当报本级人民政府主要负责人予以辞聘。
If a counselor fails to perform duties according to law or engages in activities inconsistent with the counselor status, causing adverse consequences, the counselor work institution shall report to the main responsible person of the people's government at the same level for dismissal.
本条例自2010年1月1日起施行。
These Regulations shall come into force on January 1, 2010.
