总则
General Provisions
为了加强烟花爆竹安全管理，预防爆炸事故发生，保障公共安全和人身、财产的安全，制定本条例。
These Regulations are formulated to strengthen the safety management of fireworks and firecrackers, prevent explosion accidents, and ensure public safety and the safety of persons and property.
烟花爆竹的生产、经营、运输和燃放，适用本条例。
These Regulations apply to the production, operation, transport, and setting off of fireworks and firecrackers.
本条例所称烟花爆竹，是指烟花爆竹制品和用于生产烟花爆竹的民用黑火药、烟火药、引火线等物品。
For the purposes of these Regulations, fireworks and firecrackers refer to fireworks and firecracker products and items such as civilian black powder, pyrotechnic compositions, and fuse used in the production of fireworks and firecrackers.
国家对烟花爆竹的生产、经营、运输和举办焰火晚会以及其他大型焰火燃放活动，实行许可证制度。
The State implements a licensing system for the production, operation, transport of fireworks and firecrackers, and for holding fireworks displays and other large-scale pyrotechnic events.
未经许可，任何单位或者个人不得生产、经营、运输烟花爆竹，不得举办焰火晚会以及其他大型焰火燃放活动。
Without a license, no unit or individual may produce, operate, or transport fireworks and firecrackers, or hold fireworks displays or other large-scale pyrotechnic events.
安全生产监督管理部门负责烟花爆竹的安全生产监督管理；公安部门负责烟花爆竹的公共安全管理；质量监督检验部门负责烟花爆竹的质量监督和进出口检验。
The work safety supervision and administration department is responsible for the safety supervision and administration of fireworks and firecrackers production; the public security department is responsible for the public safety management of fireworks and firecrackers; the quality supervision and inspection department is responsible for the quality supervision and import/export inspection of fireworks and firecrackers.
公安部门、安全生产监督管理部门、质量监督检验部门、工商行政管理部门应当按照职责分工，组织查处非法生产、经营、储存、运输、邮寄烟花爆竹以及非法燃放烟花爆竹的行为。
The public security department, work safety supervision and administration department, quality supervision and inspection department, and industry and commerce administration department shall, in accordance with their respective duties, organize the investigation and punishment of illegal production, operation, storage, transport, and mailing of fireworks and firecrackers, as well as illegal setting off of fireworks and firecrackers.
烟花爆竹生产、经营、运输企业和焰火晚会以及其他大型焰火燃放活动主办单位的主要负责人，对本单位的烟花爆竹安全工作负责。
The principal responsible persons of enterprises engaged in the production, operation, and transport of fireworks and firecrackers, and of entities hosting fireworks displays and other large-scale pyrotechnic events, shall be responsible for the safety of fireworks and firecrackers within their respective units.
烟花爆竹生产、经营、运输企业和焰火晚会以及其他大型焰火燃放活动主办单位应当建立健全安全责任制，制定各项安全管理制度和操作规程，并对从业人员定期进行安全教育、法制教育和岗位技术培训。
Enterprises engaged in the production, operation, and transportation of fireworks and firecrackers, as well as sponsors of fireworks displays and other large-scale pyrotechnic events, shall establish and improve safety responsibility systems, formulate various safety management systems and operating procedures, and regularly conduct safety education, legal education, and job skills training for employees.
中华全国供销合作总社应当加强对本系统企业烟花爆竹经营活动的管理。
The All China Federation of Supply and Marketing Cooperatives shall strengthen the management of fireworks and firecracker business activities of enterprises within its system.
国家鼓励烟花爆竹生产企业采用提高安全程度和提升行业整体水平的新工艺、新配方和新技术。
The state encourages fireworks and firecracker production enterprises to adopt new processes, new formulations, and new technologies that improve safety levels and enhance the overall level of the industry.
生产安全
Production Safety
生产烟花爆竹的企业，应当具备下列条件：
Enterprises that produce fireworks and firecrackers shall meet the following conditions:
(一)符合当地产业结构规划；
(1) Conform to the local industrial structure planning;
(二)基本建设项目经过批准；
(2) The capital construction project has been approved;
(三)选址符合城乡规划，并与周边建筑、设施保持必要的安全距离；
(3) The site selection complies with urban and rural planning and maintains necessary safety distances from surrounding buildings and facilities;
(四)厂房和仓库的设计、结构和材料以及防火、防爆、防雷、防静电等安全设备、设施符合国家有关标准和规范；
(4) The design, structure, and materials of workshops and warehouses, as well as safety equipment and facilities such as fire prevention, explosion prevention, lightning protection, and static electricity prevention, comply with relevant national standards and specifications;
(五)生产设备、工艺符合安全标准；
(5) Production equipment and processes meet safety standards;
(六)产品品种、规格、质量符合国家标准；
(6) Product variety, specifications, and quality comply with national standards;
(七)有健全的安全生产责任制；
(7) Have a sound production safety responsibility system;
(八)有安全生产管理机构和专职安全生产管理人员；
(8) Have a safety production management organization and full-time safety production management personnel;
(九)依法进行了安全评价；
(9) Have conducted a safety evaluation in accordance with the law;
(十)有事故应急救援预案、应急救援组织和人员，并配备必要的应急救援器材、设备；
(10) Have an accident emergency rescue plan, emergency rescue organization and personnel, and be equipped with necessary emergency rescue equipment and devices;
(十一)法律、法规规定的其他条件。
(11) Other conditions stipulated by laws and regulations.
生产烟花爆竹的企业，应当在投入生产前向所在地设区的市人民政府安全生产监督管理部门提出安全审查申请，并提交能够证明符合本条例第八条规定条件的有关材料。设区的市人民政府安全生产监督管理部门应当自收到材料之日起20日内提出安全审查初步意见，报省、自治区、直辖市人民政府安全生产监督管理部门审查。省、自治区、直辖市人民政府安全生产监督管理部门应当自受理申请之日起45日内进行安全审查，对符合条件的，核发《烟花爆竹安全生产许可证》；对不符合条件的，应当说明理由。
An enterprise producing fireworks and firecrackers shall, before putting into production, submit a safety review application to the safety production supervision and management department of the people's government of the city divided into districts where it is located, and submit relevant materials that can prove compliance with the conditions stipulated in Article 8 of these Regulations. The safety production supervision and management department of the people's government of the city divided into districts shall, within 20 days from the date of receiving the materials, put forward preliminary safety review opinions and report them to the safety production supervision and management department of the people's government of the province, autonomous region, or municipality directly under the Central Government for review. The safety production supervision and management department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall conduct a safety review within 45 days from the date of accepting the application. For those that meet the conditions, it shall issue a "Fireworks and Firecrackers Production Safety License"; for those that do not meet the conditions, it shall state the reasons.
生产烟花爆竹的企业为扩大生产能力进行基本建设或者技术改造的，应当依照本条例的规定申请办理安全生产许可证。
An enterprise producing fireworks and firecrackers that carries out capital construction or technological transformation to expand production capacity shall apply for a production safety license in accordance with the provisions of these Regulations.
生产烟花爆竹的企业，持《烟花爆竹安全生产许可证》到工商行政管理部门办理登记手续后，方可从事烟花爆竹生产活动。
An enterprise producing fireworks and firecrackers may engage in fireworks and firecracker production activities only after holding the "Fireworks and Firecrackers Production Safety License" and completing registration procedures with the administrative department for industry and commerce.
生产烟花爆竹的企业，应当按照安全生产许可证核定的产品种类进行生产，生产工序和生产作业应当执行有关国家标准和行业标准。
An enterprise producing fireworks and firecrackers shall produce according to the product categories approved in the production safety license, and the production processes and operations shall comply with relevant national standards and industry standards.
生产烟花爆竹的企业，应当对生产作业人员进行安全生产知识教育，对从事药物混合、造粒、筛选、装药、筑药、压药、切引、搬运等危险工序的作业人员进行专业技术培训。从事危险工序的作业人员经设区的市人民政府安全生产监督管理部门考核合格，方可上岗作业。
Enterprises that produce fireworks shall provide safety knowledge education to production workers, and provide professional technical training to workers engaged in dangerous processes such as drug mixing, granulation, screening, charging, ramming, pressing, fuse cutting, and handling. Workers engaged in dangerous processes may only work after passing the assessment of the safety production supervision and management department of the city with districts.
生产烟花爆竹使用的原料，应当符合国家标准的规定。生产烟花爆竹使用的原料，国家标准有用量限制的，不得超过规定的用量。不得使用国家标准规定禁止使用或者禁忌配伍的物质生产烟花爆竹。
Raw materials used in the production of fireworks shall comply with the provisions of national standards. If national standards impose usage limits on raw materials used in fireworks production, the prescribed limits shall not be exceeded. Substances prohibited by national standards or incompatible for use shall not be used in the production of fireworks.
生产烟花爆竹的企业，应当按照国家标准的规定，在烟花爆竹产品上标注燃放说明，并在烟花爆竹包装物上印制易燃易爆危险物品警示标志。
Enterprises that produce fireworks shall, in accordance with national standards, label fireworks products with discharge instructions and print flammable and explosive dangerous goods warning signs on fireworks packaging.
生产烟花爆竹的企业，应当对黑火药、烟火药、引火线的保管采取必要的安全技术措施，建立购买、领用、销售登记制度，防止黑火药、烟火药、引火线丢失。黑火药、烟火药、引火线丢失的，企业应当立即向当地安全生产监督管理部门和公安部门报告。
Enterprises that produce fireworks shall take necessary safety technical measures for the storage of black powder, pyrotechnic compositions, and fuses, and establish a registration system for purchase, requisition, and sales to prevent the loss of black powder, pyrotechnic compositions, and fuses. If black powder, pyrotechnic compositions, or fuses are lost, the enterprise shall immediately report to the local safety production supervision and management department and the public security department.
经营安全
Operational Safety
烟花爆竹的经营分为批发和零售。
The operation of fireworks is divided into wholesale and retail.
从事烟花爆竹批发的企业和零售经营者的经营布点，应当经安全生产监督管理部门审批。
The business layout of enterprises engaged in fireworks wholesale and retail operators shall be approved by the safety production supervision and management department.
禁止在城市市区布设烟花爆竹批发场所；城市市区的烟花爆竹零售网点，应当按照严格控制的原则合理布设。
It is prohibited to set up fireworks wholesale venues in urban areas; fireworks retail outlets in urban areas shall be reasonably laid out in accordance with the principle of strict control.
从事烟花爆竹批发的企业，应当具备下列条件：
Enterprises engaged in fireworks wholesale shall meet the following conditions:
(一)具有企业法人条件；
(1) Having the status of an enterprise legal person;
(二)经营场所与周边建筑、设施保持必要的安全距离；
(2) The business premises shall maintain a necessary safety distance from surrounding buildings and facilities;
(三)有符合国家标准的经营场所和储存仓库；
(3) There shall be business premises and storage warehouses that meet national standards;
(四)有保管员、仓库守护员；
(4) There shall be custodians and warehouse guards;
(五)依法进行了安全评价；
(5) A safety evaluation has been conducted in accordance with the law;
(六)有事故应急救援预案、应急救援组织和人员，并配备必要的应急救援器材、设备；
(6) There shall be an accident emergency rescue plan, emergency rescue organizations and personnel, and necessary emergency rescue equipment and devices shall be provided;
(七)法律、法规规定的其他条件。
(7) Other conditions as prescribed by laws and regulations.
烟花爆竹零售经营者，应当具备下列条件：
Retail operators of fireworks and firecrackers shall meet the following conditions:
(一)主要负责人经过安全知识教育；
(1) The principal responsible person shall have received safety knowledge education;
(二)实行专店或者专柜销售，设专人负责安全管理；
(2) Sales shall be conducted in a dedicated store or dedicated counter, with a designated person responsible for safety management;
(三)经营场所配备必要的消防器材，张贴明显的安全警示标志；
(3) The business premises shall be equipped with necessary fire-fighting equipment and display conspicuous safety warning signs;
(四)法律、法规规定的其他条件。
(4) Other conditions stipulated by laws and regulations.
申请从事烟花爆竹批发的企业，应当向所在地设区的市人民政府安全生产监督管理部门提出申请，并提供能够证明符合本条例第十七条规定条件的有关材料。受理申请的安全生产监督管理部门应当自受理申请之日起30日内对提交的有关材料和经营场所进行审查，对符合条件的，核发《烟花爆竹经营(批发)许可证》；对不符合条件的，应当说明理由。
An enterprise applying to engage in fireworks wholesale shall submit an application to theWork Safety Supervision and Administration Department of the city divided into districts where it is located, and provide relevant materials proving compliance with the conditions specified in Article 17 of these Regulations. TheWork Safety Supervision and Administration Department that accepts the application shall, within 30 days from the date of acceptance, review the submitted materials and the business premises. If the conditions are met, it shall issue a "Fireworks (Wholesale) Business License"; if not, it shall state the reasons.
申请从事烟花爆竹零售的经营者，应当向所在地县级人民政府安全生产监督管理部门提出申请，并提供能够证明符合本条例第十八条规定条件的有关材料。受理申请的安全生产监督管理部门应当自受理申请之日起20日内对提交的有关材料和经营场所进行审查，对符合条件的，核发《烟花爆竹经营(零售)许可证》；对不符合条件的，应当说明理由。
An operator applying to engage in fireworks retail shall submit an application to the county-levelWork Safety Supervision and Administration Department of the People's Government where it is located, and provide relevant materials proving compliance with the conditions specified in Article 18 of these Regulations. TheWork Safety Supervision and Administration Department that accepts the application shall, within 20 days from the date of acceptance, review the submitted materials and the business premises. If the conditions are met, it shall issue a "Fireworks (Retail) Business License"; if not, it shall state the reasons.
《烟花爆竹经营(零售)许可证》，应当载明经营负责人、经营场所地址、经营期限、烟花爆竹种类和限制存放量。
The "Fireworks (Retail) Business License" shall specify the business responsible person, business premises address, business term, types of fireworks, and restricted storage quantity.
从事烟花爆竹批发的企业，应当向生产烟花爆竹的企业采购烟花爆竹，向从事烟花爆竹零售的经营者供应烟花爆竹。从事烟花爆竹零售的经营者，应当向从事烟花爆竹批发的企业采购烟花爆竹。
Enterprises engaged in fireworks wholesale shall purchase fireworks from enterprises that produce fireworks, and supply fireworks to operators engaged in fireworks retail. Operators engaged in fireworks retail shall purchase fireworks from enterprises engaged in fireworks wholesale.
从事烟花爆竹批发的企业、零售经营者不得采购和销售非法生产、经营的烟花爆竹。
Enterprises engaged in fireworks wholesale and retail operators shall not purchase or sell illegally produced or operated fireworks.
从事烟花爆竹批发的企业，不得向从事烟花爆竹零售的经营者供应按照国家标准规定应由专业燃放人员燃放的烟花爆竹。从事烟花爆竹零售的经营者，不得销售按照国家标准规定应由专业燃放人员燃放的烟花爆竹。
Enterprises engaged in fireworks wholesale shall not supply to operators engaged in fireworks retail fireworks that, according to national standards, should be discharged by professional personnel. Operators engaged in fireworks retail shall not sell fireworks that, according to national standards, should be discharged by professional personnel.
生产、经营黑火药、烟火药、引火线的企业，不得向未取得烟花爆竹安全生产许可的任何单位或者个人销售黑火药、烟火药和引火线。
Enterprises that produce or deal in black powder, pyrotechnic compositions, or fuse shall not sell black powder, pyrotechnic compositions, or fuse to any unit or individual that has not obtained a fireworksWork Safety license.
运输安全
Transport Safety
经由道路运输烟花爆竹的，应当经公安部门许可。
Transport of fireworks by road shall be approved by the public security department.
经由铁路、水路、航空运输烟花爆竹的，依照铁路、水路、航空运输安全管理的有关法律、法规、规章的规定执行。
Transport of fireworks and firecrackers by rail, water, or air shall be carried out in accordance with the relevant laws, regulations, and rules on the safety management of rail, water, and air transport.
经由道路运输烟花爆竹的，托运人应当向运达地县级人民政府公安部门提出申请，并提交下列有关材料：
For road transport of fireworks and firecrackers, the consignor shall apply to the public security department of the people's government at the county level of the destination and submit the following relevant materials:
(一)承运人从事危险货物运输的资质证明；
(1) Qualification certificate of the carrier for engaging in dangerous goods transport;
(二)驾驶员、押运员从事危险货物运输的资格证明；
(2) Qualification certificates of the driver and escort for engaging in dangerous goods transport;
(三)危险货物运输车辆的道路运输证明；
(3) Road transport certificate of the vehicle for dangerous goods transport;
(四)托运人从事烟花爆竹生产、经营的资质证明；
(4) Qualification certificate of the consignor for engaging in fireworks and firecrackers production or operation;
(五)烟花爆竹的购销合同及运输烟花爆竹的种类、规格、数量；
(5) Purchase and sale contract for fireworks and firecrackers, and the type, specification, and quantity of fireworks and firecrackers to be transported;
(六)烟花爆竹的产品质量和包装合格证明；
(6) Certificate of product quality and packaging conformity for fireworks and firecrackers;
(七)运输车辆牌号、运输时间、起始地点、行驶路线、经停地点。
(7) Vehicle license plate number, transport time, starting location, driving route, and stopping points.
受理申请的公安部门应当自受理申请之日起3日内对提交的有关材料进行审查，对符合条件的，核发《烟花爆竹道路运输许可证》；对不符合条件的，应当说明理由。
The public security department that accepts the application shall review the submitted materials within 3 days from the date of acceptance. If the conditions are met, it shall issue the 'Road Transport Permit for Fireworks and Firecrackers'; if not, it shall state the reasons.
《烟花爆竹道路运输许可证》应当载明托运人、承运人、一次性运输有效期限、起始地点、行驶路线、经停地点、烟花爆竹的种类、规格和数量。
The "Fireworks and Firecrackers Road Transport Permit" shall specify the consignor, carrier, validity period for a single transport, starting location, driving route, stopping points, and the type, specification, and quantity of fireworks and firecrackers.
经由道路运输烟花爆竹的，除应当遵守《中华人民共和国道路交通安全法》外，还应当遵守下列规定：
When transporting fireworks and firecrackers by road, in addition to complying with the Road Traffic Safety Law of the People's Republic of China, the following provisions shall also be observed:
(一)随车携带《烟花爆竹道路运输许可证》；
(1) Carry the "Fireworks and Firecrackers Road Transport Permit" in the vehicle;
(二)不得违反运输许可事项；
(2) Do not violate the transport permit conditions;
(三)运输车辆悬挂或者安装符合国家标准的易燃易爆危险物品警示标志；
(3) The transport vehicle shall display or install warning signs for flammable and explosive dangerous goods that comply with national standards;
(四)烟花爆竹的装载符合国家有关标准和规范；
(4) The loading of fireworks and firecrackers shall comply with relevant national standards and specifications;
(五)装载烟花爆竹的车厢不得载人；
(5) No persons shall be carried in the compartment loaded with fireworks and firecrackers;
(六)运输车辆限速行驶，途中经停必须有专人看守；
(6) The transport vehicle shall drive at a limited speed, and any stops en route must be attended by a designated person;
(七)出现危险情况立即采取必要的措施，并报告当地公安部门。
(7) In the event of a dangerous situation, immediately take necessary measures and report to the local public security department.
烟花爆竹运达目的地后，收货人应当在3日内将《烟花爆竹道路运输许可证》交回发证机关核销。
After the fireworks and firecrackers arrive at the destination, the consignee shall return the "Fireworks and Firecrackers Road Transport Permit" to the issuing authority for cancellation within 3 days.
禁止携带烟花爆竹搭乘公共交通工具。
It is prohibited to carry fireworks and firecrackers on public transportation.
禁止邮寄烟花爆竹，禁止在托运的行李、包裹、邮件中夹带烟花爆竹。
It is prohibited to mail fireworks and firecrackers, and it is prohibited to conceal fireworks and firecrackers in checked luggage, parcels, or mail.
燃放安全
Setting Off Safety
燃放烟花爆竹，应当遵守有关法律、法规和规章的规定。县级以上地方人民政府可以根据本行政区域的实际情况，确定限制或者禁止燃放烟花爆竹的时间、地点和种类。
When setting off fireworks and firecrackers, the provisions of relevant laws, regulations, and rules shall be observed. Local people's governments at or above the county level may, based on the actual conditions of their administrative regions, determine the times, locations, and types of fireworks and firecrackers that are restricted or prohibited.
各级人民政府和政府有关部门应当开展社会宣传活动，教育公民遵守有关法律、法规和规章，安全燃放烟花爆竹。
People's governments at all levels and relevant government departments shall carry out social publicity activities to educate citizens to comply with relevant laws, regulations, and rules and to set off fireworks and firecrackers safely.
广播、电视、报刊等新闻媒体，应当做好安全燃放烟花爆竹的宣传、教育工作。
News media such as radio, television, newspapers, and periodicals shall conduct publicity and education on the safe setting off of fireworks and firecrackers.
未成年人的监护人应当对未成年人进行安全燃放烟花爆竹的教育。
Guardians of minors shall educate minors on the safe setting off of fireworks and firecrackers.
禁止在下列地点燃放烟花爆竹：
It is prohibited to set off fireworks and firecrackers in the following locations:
(一)文物保护单位；
(1) Cultural relic protection units;
(二)车站、码头、飞机场等交通枢纽以及铁路线路安全保护区内；
(2) Transportation hubs such as stations, docks, and airports, as well as within the safety protection zones of railway lines;
(三)易燃易爆物品生产、储存单位；
(3) Places producing or storing flammable and explosive articles;
(四)输变电设施安全保护区内；
(4) Within safety protection zones of power transmission and transformation facilities;
(五)医疗机构、幼儿园、中小学校、敬老院；
(5) Medical institutions, kindergartens, primary and secondary schools, nursing homes;
(六)山林、草原等重点防火区；
(6) Key fire prevention areas such as mountain forests and grasslands;
(七)县级以上地方人民政府规定的禁止燃放烟花爆竹的其他地点。
(7) Other locations where the local people's government at or above the county level prohibits setting off fireworks.
燃放烟花爆竹，应当按照燃放说明燃放，不得以危害公共安全和人身、财产安全的方式燃放烟花爆竹。
When setting off fireworks, one shall follow the discharge instructions and shall not set off fireworks in a manner that endangers public safety or personal or property safety.
举办焰火晚会以及其他大型焰火燃放活动，应当按照举办的时间、地点、环境、活动性质、规模以及燃放烟花爆竹的种类、规格和数量，确定危险等级，实行分级管理。分级管理的具体办法，由国务院公安部门规定。
For holding fireworks displays and other large-scale fireworks discharge activities, the hazard level shall be determined based on the time, location, environment, nature of the activity, scale, and the types, specifications, and quantities of fireworks to be discharged, and graded management shall be implemented. The specific measures for graded management shall be prescribed by the public security department of the State Council.
申请举办焰火晚会以及其他大型焰火燃放活动，主办单位应当按照分级管理的规定，向有关人民政府公安部门提出申请，并提交下列有关材料：
To apply for holding a fireworks display or other large-scale fireworks discharge activity, the organizer shall, in accordance with the provisions on graded management, submit an application to the relevant public security department of the people's government and provide the following relevant materials:
(一)举办焰火晚会以及其他大型焰火燃放活动的时间、地点、环境、活动性质、规模；
(1) The time, location, environment, nature of the activity, and scale of the fireworks display or other large-scale fireworks discharge activity;
(二)燃放烟花爆竹的种类、规格、数量；
(2) The types, specifications, and quantities of fireworks to be discharged.
(三)燃放作业方案；
(3) Fireworks display operation plan;
(四)燃放作业单位、作业人员符合行业标准规定条件的证明。
(4) Certificates proving that the fireworks display operation unit and operators meet the conditions specified in industry standards.
受理申请的公安部门应当自受理申请之日起20日内对提交的有关材料进行审查，对符合条件的，核发《焰火燃放许可证》；对不符合条件的，应当说明理由。
The public security department that accepts the application shall review the submitted materials within 20 days from the date of acceptance. For those meeting the conditions, it shall issue the "Fireworks Display Permit"; for those not meeting the conditions, it shall state the reasons.
焰火晚会以及其他大型焰火燃放活动燃放作业单位和作业人员，应当按照焰火燃放安全规程和经许可的燃放作业方案进行燃放作业。
Fireworks display operation units and operators for fireworks evening parties and other large-scale fireworks display activities shall carry out fireworks display operations in accordance with fireworks display safety procedures and the approved fireworks display operation plan.
公安部门应当加强对危险等级较高的焰火晚会以及其他大型焰火燃放活动的监督检查。
The public security department shall strengthen supervision and inspection of fireworks evening parties and other large-scale fireworks display activities with a higher danger level.

Legal Liability
对未经许可生产、经营烟花爆竹制品，或者向未取得烟花爆竹安全生产许可的单位或者个人销售黑火药、烟火药、引火线的，由安全生产监督管理部门责令停止非法生产、经营活动，处2万元以上10万元以下的罚款，并没收非法生产、经营的物品及违法所得。
Whoever, without permission, produces or operates fireworks and firecracker products, or sells black powder, pyrotechnic powder, or fuse to units or individuals that have not obtained a fireworks safety production permit, shall be ordered by the safety production supervision and management department to cease the illegal production or operation activities, and shall be fined not less than 20,000 yuan but not more than 100,000 yuan, and the illegally produced or operated items and illegal gains shall be confiscated.
对未经许可经由道路运输烟花爆竹的，由公安部门责令停止非法运输活动，处1万元以上5万元以下的罚款，并没收非法运输的物品及违法所得。
Whoever, without permission, transports fireworks and firecrackers by road shall be ordered by the public security department to cease the illegal transport activities, and shall be fined not less than 10,000 yuan but not more than 50,000 yuan, and the illegally transported items and illegal gains shall be confiscated.
非法生产、经营、运输烟花爆竹，构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
Illegal production, operation, or transport of fireworks and firecrackers that constitutes a violation of public security administration shall be subject to public security administration penalties according to law; if a crime is constituted, criminal liability shall be pursued according to law.
生产烟花爆竹的企业有下列行为之一的，由安全生产监督管理部门责令限期改正，处1万元以上5万元以下的罚款；逾期不改正的，责令停产停业整顿，情节严重的，吊销安全生产许可证：
If a fireworks production enterprise commits any of the following acts, the safety production supervision and management department shall order it to make corrections within a time limit and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan; if it fails to make corrections within the time limit, it shall be ordered to suspend production for rectification, and if the circumstances are serious, its safety production license shall be revoked:
(一)未按照安全生产许可证核定的产品种类进行生产的；
(1) Producing products not in accordance with the product types approved in the safety production license;
(二)生产工序或者生产作业不符合有关国家标准、行业标准的；
(2) Production processes or operations not conforming to relevant national or industry standards;
(三)雇佣未经设区的市人民政府安全生产监督管理部门考核合格的人员从事危险工序作业的；
(3) Employing personnel who have not passed the assessment by the safety production supervision and management department of the city with districts to engage in hazardousprocess operations;
(四)生产烟花爆竹使用的原料不符合国家标准规定的，或者使用的原料超过国家标准规定的用量限制的；
(4) Using raw materials for producing fireworks that do not meet national standards, or using raw materials exceeding the dosage limits specified in national standards;
(五)使用按照国家标准规定禁止使用或者禁忌配伍的物质生产烟花爆竹的；
(5) Using substances prohibited by national standards or prohibited in combination for producing fireworks;
(六)未按照国家标准的规定在烟花爆竹产品上标注燃放说明，或者未在烟花爆竹的包装物上印制易燃易爆危险物品警示标志的。
(6) Failing to label fireworks products with ignition instructions in accordance with national standards, or failing to print flammable and explosive dangerous goods warning signs on fireworks packaging.
从事烟花爆竹批发的企业向从事烟花爆竹零售的经营者供应非法生产、经营的烟花爆竹，或者供应按照国家标准规定应由专业燃放人员燃放的烟花爆竹的，由安全生产监督管理部门责令停止违法行为，处2万元以上10万元以下的罚款，并没收非法经营的物品及违法所得；情节严重的，吊销烟花爆竹经营许可证。
If a fireworks wholesale enterprise supplies illegally produced or operated fireworks to a fireworks retail operator, or supplies fireworks that should be ignited by professional igniters according to national standards, the safety production supervision and management department shall order cessation of the illegal act, impose a fine of not less than 20,000 yuan but not more than 100,000 yuan, confiscate the illegally operated items and illegal gains; if the circumstances are serious, the fireworks business license shall be revoked.
从事烟花爆竹零售的经营者销售非法生产、经营的烟花爆竹，或者销售按照国家标准规定应由专业燃放人员燃放的烟花爆竹的，由安全生产监督管理部门责令停止违法行为，处1000元以上5000元以下的罚款，并没收非法经营的物品及违法所得；情节严重的，吊销烟花爆竹经营许可证。
If a fireworks retail operator sells illegally produced or operated fireworks, or sells fireworks that should be ignited by professional igniters according to national standards, the safety production supervision and management department shall order cessation of the illegal act, impose a fine of not less than 1,000 yuan but not more than 5,000 yuan, confiscate the illegally operated items and illegal gains; if the circumstances are serious, the fireworks business license shall be revoked.
生产、经营、使用黑火药、烟火药、引火线的企业，丢失黑火药、烟火药、引火线未及时向当地安全生产监督管理部门和公安部门报告的，由公安部门对企业主要负责人处5000元以上2万元以下的罚款，对丢失的物品予以追缴。
If an enterprise that produces, operates, or uses black powder, pyrotechnic powder, or fuse fails to promptly report the loss of black powder, pyrotechnic powder, or fuse to the local safety production supervision and management department and public security department, the public security department shall impose a fine of not less than 5,000 yuan but not more than 20,000 yuan on the principal responsible person of the enterprise, and recover the lost items.
经由道路运输烟花爆竹，有下列行为之一的，由公安部门责令改正，处200元以上2000元以下的罚款：
If any of the following acts occur during the transport of fireworks by road, the public security department shall order correction and impose a fine of not less than 200 yuan but not more than 2,000 yuan:
(一)违反运输许可事项的；
(1) Violating the matters of the transport permit;
(二)未随车携带《烟花爆竹道路运输许可证》的；
(2) Not carrying the "Fireworks Road Transport Permit" with the vehicle;
(三)运输车辆没有悬挂或者安装符合国家标准的易燃易爆危险物品警示标志的；
(3) The transport vehicle is not equipped with or displays warning signs for flammable and explosive dangerous goods that meet national standards;
(四)烟花爆竹的装载不符合国家有关标准和规范的；
(4) The loading of fireworks does not comply with relevant national standards and specifications;
(五)装载烟花爆竹的车厢载人的；
(5) Carrying passengers in the compartment loaded with fireworks;
(六)超过危险物品运输车辆规定时速行驶的；
(6) Exceeding the prescribed speed limit for dangerous goods transport vehicles;
(七)运输车辆途中经停没有专人看守的；
(7) Stopping during transit without dedicated personnel on guard;
(八)运达目的地后，未按规定时间将《烟花爆竹道路运输许可证》交回发证机关核销的。
(8) After arriving at the destination, failing to return the "Fireworks Road Transport Permit" to the issuing authority for cancellation within the prescribed time.
对携带烟花爆竹搭乘公共交通工具，或者邮寄烟花爆竹以及在托运的行李、包裹、邮件中夹带烟花爆竹的，由公安部门没收非法携带、邮寄、夹带的烟花爆竹，可以并处200元以上1000元以下的罚款。
Anyone who carries fireworks on public transport, or sends fireworks by mail, or conceals fireworks in checked luggage, parcels, or mail shall have the illegally carried, mailed, or concealed fireworks confiscated by the public security department, and may also be fined not less than 200 yuan but not more than 1,000 yuan.
对未经许可举办焰火晚会以及其他大型焰火燃放活动，或者焰火晚会以及其他大型焰火燃放活动燃放作业单位和作业人员违反焰火燃放安全规程、燃放作业方案进行燃放作业的，由公安部门责令停止燃放，对责任单位处1万元以上5万元以下的罚款。
Anyone who holds a fireworks display or other large-scale fireworks show without permission, or if the operating unit or personnel of such events violate safety procedures or the display plan during the operation, the public security department shall order the cessation of the display and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan on the responsible unit.
在禁止燃放烟花爆竹的时间、地点燃放烟花爆竹，或者以危害公共安全和人身、财产安全的方式燃放烟花爆竹的，由公安部门责令停止燃放，处100元以上500元以下的罚款；构成违反治安管理行为的，依法给予治安管理处罚。
Anyone who sets off fireworks or firecrackers at a time or place where they are prohibited, or in a manner that endangers public safety or personal or property safety, shall be ordered by the public security department to stop the act and shall be fined not less than 100 yuan but not more than 500 yuan; if the act constitutes a violation of public security administration, administrative penalties for public security shall be imposed according to law.
对没收的非法烟花爆竹以及生产、经营企业弃置的废旧烟花爆竹，应当就地封存，并由公安部门组织销毁、处置。
Confiscated illegal fireworks and firecrackers, as well as discarded waste fireworks and firecrackers from production and operation enterprises, shall be sealed and stored on site, and shall be destroyed and disposed of by the public security department.
安全生产监督管理部门、公安部门、质量监督检验部门、工商行政管理部门的工作人员，在烟花爆竹安全监管工作中滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。
Staff members of the work safety supervision and management department, the public security department, the quality supervision and inspection department, and the administrative department for industry and commerce who abuse their power, neglect their duties, or engage in malpractice for personal gain in the safety supervision of fireworks and firecrackers, if constituting a crime, shall be investigated for criminal liability according to law; if not constituting a crime, administrative sanctions shall be imposed according to law.
附则
Supplementary Provisions
《烟花爆竹安全生产许可证》、《烟花爆竹经营(批发)许可证》、《烟花爆竹经营(零售)许可证》，由国务院安全生产监督管理部门规定式样；《烟花爆竹道路运输许可证》、《焰火燃放许可证》，由国务院公安部门规定式样。
The 'Fireworks and Firecrackers Safety Production License', the 'Fireworks and Firecrackers Operation (Wholesale) License', and the 'Fireworks and Firecrackers Operation (Retail) License' shall have their formats prescribed by the work safety supervision and management department of the State Council; the 'Fireworks and Firecrackers Road Transport License' and the 'Fireworks Display License' shall have their formats prescribed by the public security department of the State Council.
本条例自公布之日起施行。
These Regulations shall come into force as of the date of promulgation.
