总 则
General Provisions
为了加强煤矿安全生产工作，防止和减少煤矿生产安全事故，保障人民群众生命财产安全，制定本条例。
This Regulation is formulated to strengthen coal mine safety production, prevent and reduce coal mine production safety accidents, and protect the safety of people's lives and property.
在中华人民共和国领域和中华人民共和国管辖的其他海域内的煤矿安全生产，适用本条例。
This Regulation applies to coal mine safety production within the territory of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China.
煤矿安全生产工作坚持中国共产党的领导。
Coal mine safety production work adheres to the leadership of the Communist Party of China.
煤矿安全生产工作应当以人为本，坚持人民至上、生命至上，把保护人民生命安全摆在首位，贯彻安全发展理念，坚持安全第一、预防为主、综合治理的方针，从源头上防范化解重大安全风险。
Coal mine safety production work shall be people-oriented, adhere to putting people first and life first, prioritize the protection of people's life safety, implement the concept of safe development, adhere to the policy of safety first, preventionas the main, and comprehensive management, and prevent and resolve major safety risks from the source.
煤矿安全生产工作实行管行业必须管安全、管业务必须管安全、管生产经营必须管安全，按照国家监察、地方监管、企业负责，强化和落实安全生产责任。
Coal mine safety production work implements the principle that those who manage the industry must manage safety, those who manage business must manage safety, and those who manage production and operation must manage safety. In accordance with national supervision, local supervision, and enterprise responsibility, safety production responsibilities are strengthened and implemented.
煤矿企业应当履行安全生产主体责任，加强安全生产管理，建立健全并落实全员安全生产责任制和安全生产规章制度，加大对安全生产资金、物资、技术、人员的投入保障力度，改善安全生产条件，加强安全生产标准化、信息化建设，构建安全风险分级管控和隐患排查治理双重预防机制，健全风险防范化解机制，提高安全生产水平，确保安全生产。
Coal mining enterprises shall fulfill the main responsibility for safety production, strengthen safety production management, establish, improve and implement a full-staff safety production responsibility system and safety production rules and regulations, increase investment in safety production funds, materials, technology, and personnel, improve safety production conditions, strengthen safety production standardization and informatization construction, build a dual prevention mechanism for safety riskhierarchical control and hidden danger investigation and management, improve the risk prevention and resolution mechanism, enhance the level of safety production, and ensure safe production.
煤矿企业主要负责人(含实际控制人，下同)是本企业安全生产第一责任人，对本企业安全生产工作全面负责。其他负责人对职责范围内的安全生产工作负责。
The principal responsible person of a coal mining enterprise (including the actual controller, the same below) is the first person responsible for the safety production of the enterprise and is fully responsible for the safety production work of the enterprise. Other responsible persons are responsible for the safety production work within their scope of duties.
县级以上人民政府应当加强对煤矿安全生产工作的领导，建立健全工作协调机制，支持、督促各有关部门依法履行煤矿安全生产工作职责，及时协调、解决煤矿安全生产工作中的重大问题。
People's governments at or above the county level shall strengthen leadership over coal mine safety production work, establish and improve work coordination mechanisms, support and urge relevant departments to perform their coal mine safety production work duties according to law, and promptly coordinate and resolve major problems in coal mine safety production work.
县级以上人民政府负有煤矿安全生产监督管理职责的部门对煤矿安全生产实施监督管理，其他有关部门按照职责分工依法履行煤矿安全生产相关职责。
Departments of people's governments at or above the county level responsible for coal mine safety production supervision and management shall implement supervision and management over coal mine safety production, and other relevant departments shall perform coal mine safety production related duties according to their respective functions and duties.
国家实行煤矿安全监察制度。国家矿山安全监察机构及其设在地方的矿山安全监察机构负责煤矿安全监察工作，依法对地方人民政府煤矿安全生产监督管理工作进行监督检查。
The state implements a coal mine safety supervision system. The National Mine Safety Supervision Bureau and its local mine safety supervision agencies are responsible for coal mine safety supervision work and shall supervise and inspect the coal mine safety production supervision and management work of local people's governments according to law.
国家矿山安全监察机构及其设在地方的矿山安全监察机构依法履行煤矿安全监察职责，不受任何单位和个人的干涉。
The National Mine Safety Supervision Bureau and its local mine safety supervision agencies shall perform coal mine safety supervision duties according to law and shall not be interfered with by any unit or individual.
国家实行煤矿生产安全事故责任追究制度。对煤矿生产安全事故责任单位和责任人员，依照本条例和有关法律法规的规定追究法律责任。
The state implements a coal mine production safety accident accountability system. Legal liability shall be pursued against units and persons responsible for coal mine production safety accidents in accordance with this Regulation and relevant laws and regulations.
国家矿山安全监察机构及其设在地方的矿山安全监察机构依法组织或者参与煤矿生产安全事故调查处理。
The National Mine Safety Supervision Bureau and its local mine safety supervision agencies shall organize or participate in the investigation and handling of coal mine production safety accidents according to law.
县级以上人民政府负有煤矿安全生产监督管理职责的部门、国家矿山安全监察机构及其设在地方的矿山安全监察机构应当建立举报制度，公开举报电话、信箱或者电子邮件地址等网络举报平台，受理有关煤矿安全生产的举报并依法及时处理；对需要由其他有关部门进行调查处理的，转交其他有关部门处理。
Departments of people's governments at or above the county level responsible for coal mine safety production supervision and management, the National Mine Safety Supervision Bureau and its local mine safety supervision agencies shall establish a reporting system, disclose reporting telephone numbers, mailboxes or email addresses and other online reporting platforms, accept reports on coal mine safety production and handle them promptly according to law; if investigation and handling by other departments are required, they shall be transferred to other relevant departments for handling.
任何单位和个人对事故隐患或者安全生产违法行为，有权向前款规定的部门和机构举报。举报事项经核查属实的，依法依规给予奖励。
Any unit or individual has the right to report to the departments and agencies mentioned in the preceding paragraph about hidden dangers of accidents or illegal acts in safety production. If the reported matter is verified to be true, rewards shall be given according to laws and regulations.
煤矿企业从业人员有依法获得安全生产保障的权利，并应当依法履行安全生产方面的义务。
Employees of coal mining enterprises have the right to obtain safety production guarantees according to law and shall perform safety production obligations according to law.
国家矿山安全监察机构应当按照保障煤矿安全生产的要求，在国务院应急管理部门的指导下，依法及时拟订煤矿安全生产国家标准或者行业标准，并负责煤矿安全生产强制性国家标准的项目提出、组织起草、征求意见、技术审查。
The National Mine Safety Supervision Bureau shall, in accordance with the requirements of ensuring coal mine safety production, under the guidance of the emergency management department of the State Council, promptly draft national standards or industry standards for coal mine safety production according to law, and be responsible for the project proposal, drafting, solicitation of opinions, and technical review of mandatory national standards for coal mine safety production.
国家鼓励和支持煤矿安全生产科学技术研究和煤矿安全生产先进技术、工艺的推广应用，提升煤矿智能化开采水平，推进煤矿安全生产的科学管理，提高安全生产水平。
The state encourages and supports scientific and technological research on coal mine safety production and the promotion and application of advanced coal mine safety production technologies and processes, enhances the level of intelligent coal mining, promotes scientific management of coal mine safety production, and improves the level of safety production.
煤矿企业的安全生产责任
Safety Production Responsibilities of Coal Mining Enterprises
煤矿企业应当遵守有关安全生产的法律法规以及煤矿安全规程，执行保障安全生产的国家标准或者行业标准。
Coal mining enterprises shall comply with relevant safety production laws, regulations, and coal mine safety regulations, and implement national standards or industry standards for ensuring safety production.
新建、改建、扩建煤矿工程项目(以下统称煤矿建设项目)的建设单位应当委托具有建设工程设计企业资质的设计单位进行安全设施设计。
The construction unit of a new,renovation, or expanded coal mine project (hereinafter collectively referred to as coal mine construction project) shall entrust a design unit with construction engineering design enterprise qualifications to carry out safety facility design.
安全设施设计应当包括煤矿水、火、瓦斯、冲击地压、煤尘、顶板等主要灾害的防治措施，符合国家标准或者行业标准的要求，并报省、自治区、直辖市人民政府负有煤矿安全生产监督管理职责的部门审查。安全设施设计需要作重大变更的，应当报原审查部门重新审查，不得先施工后报批、边施工边修改。
The safety facility design shall include prevention measures for major disasters such as water, fire, gas, rock burst, coal dust, and roof in coal mines, meet the requirements of national standards or industry standards, and be submitted to the department of the provincial, autonomous region, or municipality directly under the Central Government responsible for coal mine safety production supervision and management for review. If major changes are needed in the safety facility design, it shall be re-submitted to the original review department for re-review; construction shall not proceed before approval, nor shall modifications be made during construction.
煤矿建设项目的建设单位应当对参与煤矿建设项目的设计、施工、监理等单位进行统一协调管理，对煤矿建设项目安全管理负总责。
The construction unit of a coal mine construction project shall coordinate and manage the design, construction, supervision, and other units participating in the coal mine construction project, and bear overall responsibility for the safety management of the coal mine construction project.
施工单位应当按照批准的安全设施设计施工，不得擅自变更设计内容。
The construction unit shall construct in accordance with the approved safety facility design and shall not change the design content without authorization.
煤矿建设项目竣工投入生产或者使用前，应当由建设单位负责组织对安全设施进行验收，并对验收结果负责；经验收合格后，方可投入生产和使用。
Before a coal mine construction project is completed and put into production or use, the construction unit shall be responsible for organizing the acceptance of safety facilities and shall be responsible for the acceptance results; only after passing the acceptance can it be put into production and use.
煤矿企业进行生产，应当依照《安全生产许可证条例》的规定取得安全生产许可证。未取得安全生产许可证的，不得生产。
A coal mining enterprise shall obtain a safety production license in accordance with the Regulations on Safety Production Licenses before production. Without obtaining a safety production license, production is prohibited.
煤矿企业主要负责人对本企业安全生产工作负有下列职责：
The principal responsible person of a coal mining enterprise shall have the following responsibilities for the safety production work of the enterprise:
(一)建立健全并落实全员安全生产责任制，加强安全生产标准化建设；
(1) Establish, improve and implement a full-staff safety production responsibility system, and strengthen safety production standardization construction;
(二)组织制定并实施安全生产规章制度和作业规程、操作规程；
(2) Organize the formulation and implementation of safety production rules and regulations, operating procedures, and work instructions;
(三)组织制定并实施安全生产教育和培训计划；
(3) Organize the formulation and implementation of safety production education and training plans;
(四)保证安全生产投入的有效实施；
(4) Ensure the effective implementation of safety production investment;
(五)组织建立并落实安全风险分级管控和隐患排查治理双重预防工作机制，督促、检查安全生产工作，及时消除事故隐患；
(5) Organize the establishment and implementation of a dual prevention working mechanism for safety riskhierarchical control and hidden danger investigation and management, supervise and inspect safety production work, and promptly eliminate hidden dangers of accidents;
(六)组织制定并实施生产安全事故应急救援预案；
(6) Organize the formulation and implementation of emergency rescue plans for production safety accidents;
(七)及时、如实报告煤矿生产安全事故。
(7) Timely and truthfully report coal mine production safety accidents.
煤矿企业应当设置安全生产管理机构并配备专职安全生产管理人员。安全生产管理机构和安全生产管理人员负有下列安全生产职责：
Coal mining enterprises shall set up safety production management institutions and equip them with full-time safety production management personnel. Safety production management institutions and safety production management personnel shall have the following safety production responsibilities:
(一)组织或者参与拟订安全生产规章制度、作业规程、操作规程和生产安全事故应急救援预案；
(1) Organize or participate in the drafting of safety production rules and regulations, operating procedures, work instructions, and emergency rescue plans for production safety accidents;
(二)组织或者参与安全生产教育和培训，如实记录安全生产教育和培训情况；
(2) Organize or participate in safety production education and training, and truthfully record safety production education and training situations;
(三)组织开展安全生产法律法规宣传教育；
(3) Organize and carry out publicity and education on safety production laws and regulations;
(四)组织开展安全风险辨识评估，督促落实重大安全风险管控措施；
(4) Organize and carry out safety risk identification and assessment, and supervise the implementation of major safety risk control measures;
(五)制止和纠正违章指挥、强令冒险作业、违反规程的行为，发现威胁安全的紧急情况时，有权要求立即停止危险区域内的作业，撤出作业人员；
(5) Stop and correct illegal command, forced risky operations, and violations of procedures. When an emergency threatening safety is discovered, have the right to require an immediate stop to operations in the dangerous area and evacuate operators;
(六)检查安全生产状况，及时排查事故隐患，对事故隐患排查治理情况进行统计分析，提出改进安全生产管理的建议；
(6) Inspect the safety production status, promptly investigate hidden dangers of accidents, conduct statistical analysis on the investigation and management of hidden dangers, and propose suggestions for improving safety production management;
(七)组织或者参与应急救援演练；
(7) Organize or participate in emergency rescue drills;
(八)督促落实安全生产整改措施。
(8) Supervise the implementation of safety production rectification measures.
煤矿企业应当配备主要技术负责人，建立健全并落实技术管理体系。
Coal mining enterprises shall equip themselves with a principal technical responsible person, and establish, improve and implement a technical management system.
煤矿企业从业人员负有下列安全生产职责：
Employees of coal mining enterprises shall have the following safety production responsibilities:
(一)遵守煤矿企业安全生产规章制度和作业规程、操作规程，严格落实岗位安全责任；
(1) Comply with the safety production rules and regulations, operating procedures, and work instructions of the coal mining enterprise, and strictly implement post safety responsibilities;
(二)参加安全生产教育和培训，掌握本职工作所需的安全生产知识，提高安全生产技能，增强事故预防和应急处理能力；
(2) Participate in safety production education and training, master the safety production knowledge required for the job, improve safety production skills, and enhance accident prevention and emergency response capabilities;
(三)及时报告发现的事故隐患或者其他不安全因素。
(3) Promptly report discovered hidden dangers of accidents or other unsafe factors.
对违章指挥和强令冒险作业的行为，煤矿企业从业人员有权拒绝并向县级以上地方人民政府负有煤矿安全生产监督管理职责的部门、所在地矿山安全监察机构报告。
For acts of illegal command and forced risky operations, employees of coal mining enterprises have the right to refuse and report to the department of the local people's government at or above the county level responsible for coal mine safety production supervision and management and the local mine safety supervision agency.
煤矿企业不得因从业人员拒绝违章指挥或者强令冒险作业而降低其工资、福利等待遇，无正当理由调整工作岗位，或者解除与其订立的劳动合同。
Coal mining enterprises shall not reduce the wages, welfare, and other benefits of employees because they refuse illegal command or forced risky operations, adjust their job positions withoutlegitimate reason, or terminate their labor contracts.
煤矿企业主要负责人和安全生产管理人员应当通过安全生产知识和管理能力考核，并持续保持相应水平和能力。
The principal responsible person and safety production management personnel of a coal mining enterprise shall pass the assessment of safety production knowledge and management ability, and continuously maintain the corresponding level and ability.
煤矿企业从业人员经安全生产教育和培训合格，方可上岗作业。煤矿企业特种作业人员应当按照国家有关规定经专门的安全技术培训和考核合格，并取得相应资格。
Employees of coal mining enterprises can only take up posts after passing safety production education and training. Special operations personnel of coal mining enterprises shall, in accordance with relevant state regulations, undergo special safety technical training and pass the assessment, and obtain corresponding qualifications.
煤矿企业应当为煤矿分别配备专职矿长、总工程师，分管安全、生产、机电的副矿长以及专业技术人员。
Coal mining enterprises shall equip each coal mine with a full-time mine manager, chief engineer, deputy mine managers in charge of safety, production, and electromechanical, as well as professional technicians.
对煤(岩)与瓦斯(二氧化碳)突出、高瓦斯、冲击地压、煤层容易自燃、水文地质类型复杂和极复杂的煤矿，还应当设立相应的专门防治机构，配备专职副总工程师。
For coal mines with coal (rock) and gas (carbon dioxide) outburst, high gas, rock burst, easily spontaneous combustion coal seams, complex and extremely complex hydrogeological types, a corresponding specialized prevention and control institution shall be established and a full-time deputy chief engineer shall be assigned.
煤矿企业应当按照国家有关规定建立健全领导带班制度并严格考核。
Coal mining enterprises shall establish and improve a leadership shift system in accordance with relevant state regulations and strictly assess it.
井工煤矿企业的负责人和生产经营管理人员应当轮流带班下井，并建立下井登记档案。
The responsible persons and production and operation management personnel of underground coal mining enterprises shall take turns leading shifts and going down the mine, and establish a downhole registration file.
煤矿企业应当为从业人员提供符合国家标准或者行业标准的劳动防护用品，并监督、教育从业人员按照使用规则佩戴、使用。
Coal mining enterprises shall provide employees with labor protection articles that meet national standards or industry standards, and supervise and educate employees to wear and use them in accordance with usage rules.
煤矿井下作业人员实行安全限员制度。煤矿企业应当依法制定井下工作时间管理制度。煤矿井下工作岗位不得使用劳务派遣用工。
A safety limit system is implemented for underground coal mine operators. Coal mining enterprises shall formulate downhole working time management systems according to law. Labor dispatch employment shall not be used for underground coal mine work positions.
煤矿企业使用的安全设备的设计、制造、安装、使用、检测、维修、改造和报废，应当符合国家标准或者行业标准。
The design, manufacture, installation, use, testing, maintenance, modification, and scrapping of safety equipment used by coal mining enterprises shall comply with national standards or industry standards.
煤矿企业应当建立安全设备台账和追溯、管理制度，对安全设备进行经常性维护、保养并定期检测，保证正常运转，对安全设备购置、入库、使用、维护、保养、检测、维修、改造、报废等进行全流程记录并存档。
Coal mining enterprises shall establish safety equipment ledgers and traceability and management systems, conduct regular maintenance, upkeep, and periodic testing of safety equipment to ensure normal operation, and conduct full-process records and archiving of safety equipment procurement, warehousing, use, maintenance, upkeep, testing, repair, modification, and scrapping.
煤矿企业不得使用应当淘汰的危及生产安全的设备、工艺，具体目录由国家矿山安全监察机构制定并公布。
Coal mining enterprises shall not use equipment and processes that should be eliminated and endanger production safety. The specific catalog shall be formulated and published by the National Mine Safety Supervision Bureau.
煤矿的采煤、掘进、机电、运输、通风、排水、排土等主要生产系统和防瓦斯、防煤(岩)与瓦斯(二氧化碳)突出、防冲击地压、防火、防治水、防尘、防热害、防滑坡、监控与通讯等安全设施，应当符合煤矿安全规程和国家标准或者行业标准规定的管理和技术要求。
The main production systems of coal mines, such as coal mining, excavation, electromechanical, transportation, ventilation, drainage, and dumping, and safety facilities such as gas prevention, coal (rock) and gas (carbon dioxide) outburst prevention, rock burst prevention, fire prevention, water control, dust prevention, heat damage prevention, landslide prevention, monitoring and communication, shall comply with the management and technical requirements stipulated in coal mine safety regulations and national standards or industry standards.
煤矿企业及其有关人员不得关闭、破坏直接关系生产安全的监控、报警、防护、救生设备、设施，或者篡改、隐瞒、销毁其相关数据、信息，不得以任何方式影响其正常使用。
Coal mining enterprises and their relevant personnel shall not close or damage monitoring, alarm, protection, and rescue equipment and facilities directly related to production safety, or tamper with, conceal, or destroy their related data and information, nor affect their normal use in any way.
井工煤矿应当有符合煤矿安全规程和国家标准或者行业标准规定的安全出口、独立通风系统、安全监控系统、防尘供水系统、防灭火系统、供配电系统、运送人员装置和反映煤矿实际情况的图纸，并按照规定进行瓦斯等级、冲击地压、煤层自燃倾向性和煤尘爆炸性鉴定。
Underground coal mines shall have safety exits, independent ventilation systems, safety monitoring systems, dust prevention water supply systems, fire prevention systems, power supply and distribution systems, personnel transport devices, and drawings reflecting the actual situation of the coal mine that comply with coal mine safety regulations and national standards or industry standards, and shall conduct gas grade, rock burst, coal seam spontaneous combustion tendency, and coal dust explosiveness identification as required.
井工煤矿应当按矿井瓦斯等级选用相应的煤矿许用炸药和电雷管，爆破工作由专职爆破工承担。
Underground coal mines shall select corresponding coal mine permitted explosives and electric detonators according to the mine gas grade, and blasting work shall be undertaken byfull-time blasters.
露天煤矿的采场及排土场边坡与重要建筑物、构筑物之间应当留有足够的安全距离。
A sufficient safety distance shall be left between the slopes of the open-pit mine and the dump and important buildings and structures.
煤矿企业应当定期对露天煤矿进行边坡稳定性评价，评价范围应当涵盖露天煤矿所有边坡。达不到边坡稳定要求时，应当修改采矿设计或者采取安全措施，同时加强边坡监测工作。
Coal mining enterprises shall regularly conduct slope stability evaluations of open-pit mines, and the evaluation scope shall cover all slopes of the open-pit mine. If the slope stability requirements are not met, the mining design shall be modified or safety measures shall be taken, and slope monitoring work shall be strengthened.
煤矿企业应当依法制定生产安全事故应急救援预案，与所在地县级以上地方人民政府组织制定的生产安全事故应急救援预案相衔接，并定期组织演练。
Coal mining enterprises shall formulate emergency rescue plans for production safety accidents according to law, link them with the emergency rescue plans for production safety accidents formulated by the local people's government at or above the county level, and organize regular drills.
煤矿企业应当设立专职救护队；不具备设立专职救护队条件的，应当设立兼职救护队，并与邻近的专职救护队签订救护协议。发生事故时，专职救护队应当在规定时间内到达煤矿开展救援。
Coal mining enterprises shall establish a full-time rescue team; if conditions for establishing a full-time rescue team are not available, a part-time rescue team shall be established and a rescue agreement shall be signed with a nearby full-time rescue team. In the event of an accident, the full-time rescue team shall arrive at the coal mine within the specified time to carry out rescue.
煤矿企业应当在依法确定的开采范围内进行生产，不得超层、越界开采。
Coal mining enterprises shall produce within the legally determined mining scope and shall not mine beyond layers or boundaries.
采矿作业不得擅自开采保安煤柱，不得采用可能危及相邻煤矿生产安全的决水、爆破、贯通巷道等危险方法。
Mining operations shall not arbitrarily mine safety coal pillars, nor adopt dangerous methods such as flooding, blasting, or tunneling through roadways that may endanger the safety production of adjacent coal mines.
煤矿企业不得超能力、超强度或者超定员组织生产。正常生产煤矿因地质、生产技术条件、采煤方法或者工艺等发生变化导致生产能力发生较大变化的，应当依法重新核定其生产能力。
Coal mining enterprises shall not organize production beyond capacity, intensity, or fixed personnel. If the production capacity of a normal production coal mine changes significantly due to changes in geological, production technical conditions, coal mining methods or processes, its production capacity shall be re-verified according to law.
县级以上地方人民政府及其有关部门不得要求不具备安全生产条件的煤矿企业进行生产。
Local people's governments at or above the county level and their relevant departments shall not require coal mining enterprises that do not meet safety production conditions to carry out production.
煤矿企业应当按照煤矿灾害程度和类型实施灾害治理，编制年度灾害预防和处理计划，并根据具体情况及时修改。
Coal mining enterprises shall implement disaster management according to the degree and type of coal mine disasters, prepare annual disaster prevention and treatment plans, and modify them promptly according to specific circumstances.
煤矿开采有下列情形之一的，应当编制专项设计：
Special designs shall be prepared for coal mining under any of the following circumstances:
(一)有煤(岩)与瓦斯(二氧化碳)突出的；
(1) There is coal (rock) and gas (carbon dioxide) outburst;
(二)有冲击地压危险的；
(2) There is a risk of rock burst;
(三)开采需要保护的建筑物、水体、铁路下压煤或者主要井巷留设煤柱的；
(3) Mining under buildings, water bodies, or railways that need protection, or leaving coal pillars for main roadways;
(四)水文地质类型复杂、极复杂或者周边有老窑采空区的；
(4) The hydrogeological type is complex or extremely complex, or there are old goafs nearby;
(五)开采容易自燃和自燃煤层的；
(5) Mining easily spontaneous combustion and spontaneous combustion coal seams;
(六)其他需要编制专项设计的。
(6) Other circumstances requiring special designs.

煤矿企业有下列情形之一的，属于重大事故隐患，应当立即停止受影响区域生产、建设，并及时消除事故隐患：

(一)超能力、超强度或者超定员组织生产的；

(三)煤(岩)与瓦斯(二氧化碳)突出矿井未按照规定实施防突措施的；
(3) Coal (rock) and gas (carbon dioxide) outburst mines failing to implement outburst prevention measures as required;
(四)煤(岩)与瓦斯(二氧化碳)突出矿井、高瓦斯矿井未按照规定建立瓦斯抽采系统，或者系统不能正常运行的；
(4) Coal (rock) and gas (carbon dioxide) outburst mines or high gas mines failing to establish a gas extraction system as required, or the system cannot operate normally;
(五)通风系统不完善、不可靠的；
(5) The ventilation system is incomplete or unreliable;
(六)超层、越界开采的；
(6) Mining beyond layers or boundaries;
(七)有严重水患，未采取有效措施的；

(八)有冲击地压危险，未采取有效措施的；

(九)自然发火严重，未采取有效措施的；

(十)使用应当淘汰的危及生产安全的设备、工艺的；
(10) Using equipment or processes that should be eliminated and endanger production safety;
(十一)未按照规定建立监控与通讯系统，或者系统不能正常运行的；
(11) Failing to establish a monitoring and communication system as required, or the system cannot operate normally;
(十二)露天煤矿边坡角大于设计最大值或者边坡发生严重变形，未采取有效措施的；
(12) The slope angle of an open-pit mine is greater than the maximum design value or the slope has severe deformation without effective measures;
(十三)未按照规定采用双回路供电系统的；
(13) Failing to adopt a dual-circuit power supply system as required;
(十四)新建煤矿边建设边生产，煤矿改扩建期间，在改扩建的区域生产，或者在其他区域的生产超出设计规定的范围和规模的；
(14) A new coal mine is constructed while producing, or during the expansion of a coal mine, production is carried out in the expanded area, or production in other areas exceeds the scope and scale specified in the design;
(十五)实行整体承包生产经营后，未重新取得或者及时变更安全生产许可证而从事生产，或者承包方再次转包，以及将井下采掘工作面和井巷维修作业外包的；
(15) After implementing overall contracting production and operation, production is carried out without re-obtaining or timely updating the safety production license, or the contractor sub-contracts again, or underground mining face and roadway maintenance operations are outsourced;
(十六)改制、合并、分立期间，未明确安全生产责任人和安全生产管理机构，或者在完成改制、合并、分立后，未重新取得或者及时变更安全生产许可证等的；
(16) During restructuring, merger, or division, the safety production responsible person and safety production management institution are not clarified, or after the restructuring, merger, or division is completed, the safety production license is not re-obtained or timely updated;
(十七)有其他重大事故隐患的。

法 律 责 任
Legal Liability
未依法取得安全生产许可证等擅自进行煤矿生产的，应当责令立即停止生产，没收违法所得和开采出的煤炭以及采掘设备；违法所得在10万元以上的，并处违法所得2倍以上5倍以下的罚款；没有违法所得或者违法所得不足10万元的，并处10万元以上20万元以下的罚款。
If a coal mine is produced without obtaining a safety production license according to law, it shall be ordered to immediately stop production, and the illegal income, the mined coal, and the mining equipment shall be confiscated; if the illegal income is more than 100,000 yuan, a fine of not less than 2 times but not more than 5 times the illegal income shall be imposed; if there is no illegal income or the illegal income is less than 100,000 yuan, a fine of not less than 100,000 yuan but not more than 200,000 yuan shall be imposed.
关闭的煤矿企业擅自恢复生产的，依照前款规定予以处罚。

煤矿企业有下列行为之一的，依照《中华人民共和国安全生产法》有关规定予以处罚：

(一)未按照规定设置安全生产管理机构并配备安全生产管理人员的；

(2) The principal responsible person and safety production management personnel failing to pass the assessment as required and continuously maintain the corresponding level and ability;
(三)未按照规定进行安全生产教育和培训，未按照规定如实告知有关的安全生产事项，或者未如实记录安全生产教育和培训情况的；
(3) Failing to conduct safety production education and training as required, failing to truthfully inform relevant safety production matters, or failing to truthfully record safety production education and training situations;
(四)特种作业人员未按照规定经专门的安全作业培训并取得相应资格，上岗作业的；
(4) Special operations personnel failing to undergo special safety operation training and obtain corresponding qualifications as required before taking up posts;
(五)进行危险作业，未采取专门安全技术措施并安排专门人员进行现场安全管理的；
(5) Carrying out dangerous operations without taking special safety technical measures and arranging special personnel for on-site safety management;
(六)未按照规定建立并落实安全风险分级管控制度和事故隐患排查治理制度的，或者重大事故隐患排查治理情况未按照规定报告的；
(6) Failing to establish and implement a safety riskhierarchical control system and a hidden danger investigation and management system as required, or failing to report the investigation and management of major hidden dangers as required;
(七)未按照规定制定生产安全事故应急救援预案或者未定期组织演练的。
(7) Failing to formulate emergency rescue plans for production safety accidents as required or failing to organize regular drills.
煤矿企业有下列行为之一的，责令限期改正，处10万元以上20万元以下的罚款；逾期未改正的，责令停产整顿，并处20万元以上50万元以下的罚款，对其直接负责的主管人员和其他直接责任人员处3万元以上5万元以下的罚款：
If a coal mining enterprise has any of the following acts, it shall be ordered to correct within a time limit and fined not less than 100,000 yuan but not more than 200,000 yuan; if it fails to correct within the time limit, it shall be ordered to suspend production for rectification and fined not less than 200,000 yuan but not more than 500,000 yuan, and the directly responsible supervisors and other directly responsible personnel shall be fined not less than 30,000 yuan but not more than 50,000 yuan:
(一)未按照规定制定并落实全员安全生产责任制和领导带班等安全生产规章制度的；
(1) Failing to formulate and implement a full-staff safety production responsibility system and leadership shift system and other safety production rules and regulations as required;
(二)未按照规定为煤矿配备矿长等人员和机构，或者未按照规定设立救护队的；
(2) Failing to equip the coal mine with mine managers and other personnel and institutions as required, or failing to set up a rescue team as required;
(三)煤矿的主要生产系统、安全设施不符合煤矿安全规程和国家标准或者行业标准规定的；
(3) The main production systems and safety facilities of the coal mine do not meet the requirements of coal mine safety regulations and national standards or industry standards;
(四)未按照规定编制专项设计的；
(4) Failing to prepare special designs as required;
(五)井工煤矿未按照规定进行瓦斯等级、冲击地压、煤层自燃倾向性和煤尘爆炸性鉴定的；
(5) Underground coal mines failing to conduct gas grade, rock burst, coal seam spontaneous combustion tendency, and coal dust explosiveness identification as required;
(六)露天煤矿的采场及排土场边坡与重要建筑物、构筑物之间安全距离不符合规定的，或者未按照规定保持露天煤矿边坡稳定的；
(6) The safety distance between the slopes of the open-pit mine and the dump and important buildings and structures does not meet the requirements, or failing to maintain the stability of the open-pit mine slope as required;
(七)违章指挥或者强令冒险作业、违反规程的。
(7) Illegal command or forced risky operations, or violations of procedures.
对存在重大事故隐患仍然进行生产的煤矿企业，责令停产整顿，明确整顿的内容、时间等具体要求，并处50万元以上200万元以下的罚款；对煤矿企业主要负责人处3万元以上15万元以下的罚款。
For a coal mining enterprise that still produces despite the existence of major hidden dangers, it shall be ordered to suspend production for rectification, with specific requirements such as the content and time of rectification clarified, and fined not less than 500,000 yuan but not more than 2 million yuan; the principal responsible person of the coal mining enterprise shall be fined not less than 30,000 yuan but not more than 150,000 yuan.
煤矿企业超越依法确定的开采范围采矿的，依照有关法律法规的规定予以处理。
If a coal mining enterprise mines beyond the legally determined mining scope, it shall be dealt with in accordance with relevant laws and regulations.
擅自开采保安煤柱或者采用可能危及相邻煤矿生产安全的决水、爆破、贯通巷道等危险方法进行采矿作业的，责令立即停止作业，没收违法所得；违法所得在10万元以上的，并处违法所得2倍以上5倍以下的罚款；没有违法所得或者违法所得不足10万元的，并处10万元以上20万元以下的罚款；造成损失的，依法承担赔偿责任。
If safety coal pillars are mined without authorization or dangerous methods such as flooding, blasting, or tunneling through roadways that may endanger the safety production of adjacent coal mines are adopted for mining operations, it shall be ordered to immediately stop operations, and the illegal income shall be confiscated; if the illegal income is more than 100,000 yuan, a fine of not less than 2 times but not more than 5 times the illegal income shall be imposed; if there is no illegal income or the illegal income is less than 100,000 yuan, a fine of not less than 100,000 yuan but not more than 200,000 yuan shall be imposed; if losses are caused, compensation liability shall be borne according to law.
煤矿企业有下列行为之一的，责令改正；拒不改正的，处10万元以上20万元以下的罚款；对其直接负责的主管人员和其他直接责任人员处1万元以上2万元以下的罚款：
If a coal mining enterprise has any of the following acts, it shall be ordered to correct; if it refuses to correct, it shall be fined not less than 100,000 yuan but not more than 200,000 yuan; the directly responsible supervisors and other directly responsible personnel shall be fined not less than 10,000 yuan but not more than 20,000 yuan:
(一)违反本条例第三十七条第一款规定，隐瞒存在的事故隐患以及其他安全问题的；
(1) Violating the provisions of Article 37, paragraph 1 of this Regulation by concealing existing hidden dangers of accidents or other safety problems;
(二)违反本条例第四十四条第一款规定，擅自启封或者使用被查封、扣押的设施、设备、器材的；
(2) Violating the provisions of Article 44, paragraph 1 of this Regulation by unsealing or using sealed or seized facilities, equipment, or materials without authorization;
(三)有其他拒绝、阻碍监督检查行为的。
(3) Other acts of refusing or obstructing supervision and inspection.
发生煤矿生产安全事故，对负有责任的煤矿企业除要求其依法承担相应的赔偿等责任外，依照下列规定处以罚款：
If a coal mine production safety accident occurs, in addition to requiring the responsible coal mining enterprise to bear corresponding compensation and other liabilities according to law, a fine shall be imposed in accordance with the following provisions:
(一)发生一般事故的，处50万元以上100万元以下的罚款；
(1) For a general accident, a fine of not less than 500,000 yuan but not more than 1 million yuan;
(二)发生较大事故的，处150万元以上200万元以下的罚款；
(2) For a relatively serious accident, a fine of not less than 1.5 million yuan but not more than 2 million yuan;
(三)发生重大事故的，处500万元以上1000万元以下的罚款；
(3) For a major accident, a fine of not less than 5 million yuan but not more than 10 million yuan;
(四)发生特别重大事故的，处1000万元以上2000万元以下的罚款。
(4) For an extraordinarily serious accident, a fine of not less than 10 million yuan but not more than 20 million yuan.
发生煤矿生产安全事故，情节特别严重、影响特别恶劣的，可以按照前款罚款数额的2倍以上5倍以下对负有责任的煤矿企业处以罚款。
If a coal mine production safety accident occurs with particularly serious circumstances and particularly adverse impact, the responsible coal mining enterprise may be fined not less than 2 times but not more than 5 times the amount of the fine specified in the preceding paragraph.
煤矿企业的决策机构、主要负责人、其他负责人和安全生产管理人员未依法履行安全生产管理职责的，依照《中华人民共和国安全生产法》有关规定处罚并承担相应责任。
If the decision-making body, principal responsible person, other responsible persons, and safety production management personnel of a coal mining enterprise fail to perform safety production management duties according to law, punishment shall be imposed and corresponding liability shall be borne in accordance with the relevant provisions of the Production Safety Law of the People's Republic of China.
煤矿企业主要负责人未依法履行安全生产管理职责，导致发生煤矿生产安全事故的，依照下列规定处以罚款：
If the principal responsible person of a coal mining enterprise fails to perform safety production management duties according to law, resulting in a coal mine production safety accident, a fine shall be imposed in accordance with the following provisions:
(一)发生一般事故的，处上一年年收入40%的罚款；
(1) For a general accident, a fine of 40% of the previous year's income;
(二)发生较大事故的，处上一年年收入60%的罚款；
(2) For a relatively serious accident, a fine of 60% of the previous year's income;
(三)发生重大事故的，处上一年年收入80%的罚款；
(3) For a major accident, a fine of 80% of the previous year's income;
(四)发生特别重大事故的，处上一年年收入100%的罚款。
(4) For an extraordinarily serious accident, a fine of 100% of the previous year's income.
煤矿企业及其有关人员有瞒报、谎报事故等行为的，依照《中华人民共和国安全生产法》、《生产安全事故报告和调查处理条例》有关规定予以处罚。
If a coal mining enterprise and its relevant personnel have acts such as concealing or falsely reporting accidents, punishment shall be imposed in accordance with the relevant provisions of the Production Safety Law of the People's Republic of China and the Regulations on the Reporting and Investigation of Production Safety Accidents.
有关地方人民政府及其应急管理部门、负有煤矿安全生产监督管理职责的部门和设在地方的矿山安全监察机构有瞒报、谎报事故等行为的，对负有责任的领导人员和直接责任人员依法给予处分。
If the relevant local people's government and its emergency management department, the department responsible for coal mine safety production supervision and management, and the local mine safety supervision agency have acts such as concealing or falsely reporting accidents, the responsible leading personnel and directly responsible personnel shall be given sanctions according to law.
煤矿企业存在下列情形之一的，应当提请县级以上地方人民政府予以关闭：
If a coal mining enterprise has any of the following circumstances, the local people's government at or above the county level shall be requested to close it:
(一)未依法取得安全生产许可证等擅自进行生产的；
(1) Producing without obtaining a safety production license according to law;
(二)3个月内2次或者2次以上发现有重大事故隐患仍然进行生产的；
(2) Within 3 months, major hidden dangers are discovered 2 times or more and production is still carried out;
(三)经地方人民政府组织的专家论证在现有技术条件下难以有效防治重大灾害的；
(3) After expert demonstration organized by the local people's government, it is determined that major disasters cannot be effectively prevented under existing technical conditions;
(四)有《中华人民共和国安全生产法》规定的应当提请关闭的其他情形。
(4) Other circumstances stipulated in the Production Safety Law of the People's Republic of China that should be requested for closure.
有关地方人民政府作出予以关闭的决定，应当立即组织实施。关闭煤矿应当达到下列要求：
After the relevant local people's government makes a decision to close, it shall immediately organize implementation. The closure of a coal mine shall meet the following requirements:
(一)依照法律法规有关规定吊销、注销相关证照；
(1) Revoke or cancel relevant licenses and certificates according to laws and regulations;
(二)停止供应并妥善处理民用爆炸物品；
(2) Stop supplying and properly handle civil explosives;
(三)停止供电，拆除矿井生产设备、供电、通信线路；
(3) Cut off power supply, dismantle mine production equipment, power supply, and communication lines;
(四)封闭、填实矿井井筒，平整井口场地，恢复地貌；
(4) Seal and fill mine shafts, level the wellhead site, and restore the landform;
(五)妥善处理劳动关系，依法依规支付经济补偿、工伤保险待遇，组织离岗时职业健康检查，偿还拖欠工资，补缴欠缴的社会保险费；
(5) Properly handle labor relations, pay economic compensation and work-related injury insurance benefits according to laws and regulations, organize occupational health examinations at the time of leaving the job, repay overdue wages, and pay overdue social insurance premiums;
(六)设立标识牌；
(6) Set up identification signs;
(七)报送、移交相关报告、图纸和资料等；
(7) Submit and transfer relevant reports, drawings, and materials;
(八)有关法律法规规定的其他要求。
(8) Other requirements stipulated by relevant laws and regulations.
有下列情形之一的，依照《中华人民共和国安全生产法》有关规定予以处罚：
If any of the following circumstances occurs, punishment shall be imposed in accordance with the relevant provisions of the Production Safety Law of the People's Republic of China:
(一)煤矿建设项目没有安全设施设计或者安全设施设计未按照规定报经有关部门审查同意的；
(1) A coal mine construction project has no safety facility design or the safety facility design has not been submitted to the relevant department for review and approval as required;
(二)煤矿建设项目的施工单位未按照批准的安全设施设计施工的；
(2) The construction unit of a coal mine construction project does not construct in accordance with the approved safety facility design;
(三)煤矿建设项目竣工投入生产或者使用前，安全设施未经验收合格的；
(3) Before a coal mine construction project is completed and put into production or use, the safety facilities have not passed acceptance;
(四)煤矿企业违反本条例第二十四条第一款、第二十五条第一款和第二款、第二十六条第二款规定的。
(4) A coal mining enterprise violates the provisions of Article 24, paragraph 1, Article 25, paragraphs 1 and 2, and Article 26, paragraph 2 of this Regulation.
承担安全评价、认证、检测、检验等职责的煤矿安全生产技术服务机构有出具失实报告、租借资质、挂靠、出具虚假报告等情形的，对该机构及直接负责的主管人员和其他直接责任人员，应当依照《中华人民共和国安全生产法》有关规定予以处罚并追究相应责任。其主要负责人对重大、特别重大煤矿生产安全事故负有责任的，终身不得从事煤矿安全生产相关技术服务工作。
If a coal mine safety production technical service institution undertaking safety evaluation, certification, testing, inspection, and other duties has circumstances such as issuing false reports, renting qualifications, engaging in affiliation, or issuing false reports, the institution and the directly responsible supervisors and other directly responsible personnel shall be punished and held correspondingly liable in accordance with the relevant provisions of the Production Safety Law of the People's Republic of China. If its principal responsible person is responsible for a major or extraordinarily serious coal mine production safety accident, he or she shall be permanently prohibited from engaging in coal mine safety production related technical services.
本条例规定的行政处罚，由县级以上人民政府负有煤矿安全生产监督管理职责的部门和其他有关部门、国家矿山安全监察机构及其设在地方的矿山安全监察机构按照职责分工决定，对同一违法行为不得给予两次以上罚款的行政处罚。对被责令停产整顿的煤矿企业，应当暂扣安全生产许可证等。对违反本条例规定的严重违法行为，应当依法从重处罚。
The administrative penalties specified in this Regulation shall be decided by the departments of people's governments at or above the county level responsible for coal mine safety production supervision and management and other relevant departments, the National Mine Safety Supervision Bureau and its local mine safety supervision agencies according to their respective functions and duties. No administrative penalty of a fine shall be imposed twice or more for the same illegal act. For coal mining enterprises ordered to suspend production for rectification, the safety production license and other licenses shall be temporarily withheld. For serious illegal acts violating the provisions of this Regulation, heavier punishment shall be imposed according to law.
地方各级人民政府、县级以上人民政府负有煤矿安全生产监督管理职责的部门和其他有关部门、国家矿山安全监察机构及其设在地方的矿山安全监察机构有下列情形之一的，对负有责任的领导人员和直接责任人员依法给予处分：
If local people's governments at all levels, departments of people's governments at or above the county level responsible for coal mine safety production supervision and management and other relevant departments, the National Mine Safety Supervision Bureau and its local mine safety supervision agencies have any of the following circumstances, the responsible leading personnel and directly responsible personnel shall be given sanctions according to law:
(一)县级以上人民政府负有煤矿安全生产监督管理职责的部门、国家矿山安全监察机构及其设在地方的矿山安全监察机构不依法履行职责，不及时查处所辖区域内重大事故隐患和安全生产违法行为的；县级以上人民政府其他有关部门未依法履行煤矿安全生产相关职责的；
(1) The department of a people's government at or above the county level responsible for coal mine safety production supervision and management, the National Mine Safety Supervision Bureau and its local mine safety supervision agencies fail to perform their duties according to law and fail to promptly investigate and deal with major hidden dangers and safety production illegal acts within their jurisdiction; other relevant departments of people's governments at or above the county level fail to perform coal mine safety production related duties according to law;
(二)乡镇人民政府在所辖区域内发现未依法取得安全生产许可证等擅自进行煤矿生产，没有采取有效措施制止或者没有向县级人民政府相关主管部门报告的；
(2) A township people's government, upon discovering coal mine production without obtaining a safety production license within its jurisdiction, fails to take effective measures to stop it or fails to report to the relevant competent department of the county people's government;
(三)对被责令停产整顿的煤矿企业，在停产整顿期间，因有关地方人民政府监督检查不力，煤矿企业在停产整顿期间继续生产的；
(3) For a coal mining enterprise ordered to suspend production for rectification, due to ineffective supervision and inspection by the relevant local people's government during the suspension period, the coal mining enterprise continues production during the suspension period;
(四)关闭煤矿未达到本条例第七十条第二款规定要求的；
(4) The closure of a coal mine does not meet the requirements specified in Article 70, paragraph 2 of this Regulation;
(五)县级以上人民政府负有煤矿安全生产监督管理职责的部门、国家矿山安全监察机构及其设在地方的矿山安全监察机构接到举报后，不及时处理的；
(5) The department of a people's government at or above the county level responsible for coal mine safety production supervision and management, the National Mine Safety Supervision Bureau and its local mine safety supervision agencies fail to handle reports promptly after receiving them;
(六)县级以上地方人民政府及其有关部门要求不具备安全生产条件的煤矿企业进行生产的；
(6) A local people's government at or above the county level and its relevant departments require coal mining enterprises that do not meet safety production conditions to carry out production;
(七)有其他滥用职权、玩忽职守、徇私舞弊情形的。
(7) Other circumstances of abuse of power, dereliction of duty, or engaging in malpractice for personal gain.
违反本条例规定，构成犯罪的，依法追究刑事责任。
If a violation of this Regulation constitutes a crime, criminal liability shall be pursued according to law.
附 则
Supplementary Provisions
本条例自2024年5月1日起施行。《煤矿安全监察条例》和《国务院关于预防煤矿生产安全事故的特别规定》同时废止。
This Regulation shall take effect on May 1, 2024. The Coal Mine Safety Supervision Regulations and the Special Provisions of the State Council on Preventing Coal Mine Production Safety Accidents shall be simultaneously abolished.
