总则
General Provisions
为加强黄河水量的统一调度，实现黄河水资源的可持续利用，促进黄河流域及相关地区经济社会发展和生态环境的改善，根据《中华人民共和国水法》，制定本条例。
These Regulations are formulated in accordance with the Water Law of the People's Republic of China to strengthen the unified regulation of the Yellow River water volume, achieve sustainable utilization of the Yellow River water resources, and promote economic and social development and improvement of the ecological environment in the Yellow River Basin and related areas.
黄河流域的青海省、四川省、甘肃省、宁夏回族自治区、内蒙古自治区、陕西省、山西省、河南省、山东省，以及国务院批准取用黄河水的河北省、天津市(以下称十一省区市)的黄河水量调度和管理，适用本条例。
These Regulations apply to the regulation and management of the Yellow River water volume in Qinghai Province, Sichuan Province, Gansu Province, Ningxia Hui Autonomous Region, Inner Mongolia Autonomous Region, Shaanxi Province, Shanxi Province, Henan Province, Shandong Province in the Yellow River Basin, as well as Hebei Province and Tianjin Municipality (hereinafter referred to as the eleven provinces, autonomous regions, and municipalities) that are approved by the State Council to draw water from the Yellow River.
国家对黄河水量实行统一调度，遵循总量控制、断面流量控制、分级管理、分级负责的原则。
The state implements unified regulation of the Yellow River water volume, following the principles of total volume control, cross-section flow control, hierarchical management, and hierarchical responsibility.
实施黄河水量调度，应当首先满足城乡居民生活用水的需要，合理安排农业、工业、生态环境用水，防止黄河断流。
In implementing the Yellow River water volume regulation, priority shall be given to meeting the domestic water needs of urban and rural residents, and reasonable arrangements shall be made for agricultural, industrial, and ecological environment water use to prevent the Yellow River from drying up.
黄河水量调度计划、调度方案和调度指令的执行，实行地方人民政府行政首长负责制和黄河水利委员会及其所属管理机构以及水库主管部门或者单位主要领导负责制。
The implementation of the Yellow River water volume regulation plans, schemes, and dispatch instructions shall be subject to the responsibility system of the administrative heads of local people's governments and the principal responsible persons of the Yellow River Water Conservancy Commission and its subordinate management institutions, as well as reservoir authorities or units.
国务院水行政主管部门和国务院发展改革主管部门负责组织、协调、监督、指导黄河水量调度工作。
The water administrative department of the State Council and the development and reform department of the State Council are responsible for organizing, coordinating, supervising, and guiding the Yellow River water volume regulation work.
黄河水利委员会依照本条例的规定负责黄河水量调度的组织实施和监督检查工作。
The Yellow River Water Conservancy Commission shall be responsible for the organization, implementation, and supervision and inspection of the Yellow River water volume regulation in accordance with these Regulations.
有关县级以上地方人民政府水行政主管部门和黄河水利委员会所属管理机构，依照本条例的规定负责所辖范围内黄河水量调度的实施和监督检查工作。
The relevant water administrative departments of local people's governments at or above the county level and the subordinate management institutions of the Yellow River Water Conservancy Commission shall be responsible for the implementation and supervision and inspection of the Yellow River water volume regulation within their respective jurisdictions in accordance with these Regulations.
在黄河水量调度工作中做出显著成绩的单位和个人，由有关县级以上人民政府或者有关部门给予奖励。
Units and individuals that have made outstanding achievements in the Yellow River water volume regulation work shall be rewarded by the relevant people's governments at or above the county level or relevant departments.
水量分配
Water Allocation
黄河水量分配方案，由黄河水利委员会商十一省区市人民政府制订，经国务院发展改革主管部门和国务院水行政主管部门审查，报国务院批准。
The Yellow River water allocation scheme shall be formulated by the Yellow River Water Conservancy Commission in consultation with the people's governments of the eleven provinces, autonomous regions, and municipalities, reviewed by the development and reform department of the State Council and the water administrative department of the State Council, and submitted to the State Council for approval.
国务院批准的黄河水量分配方案，是黄河水量调度的依据，有关地方人民政府和黄河水利委员会及其所属管理机构必须执行。
The Yellow River water allocation scheme approved by the State Council is the basis for the Yellow River water volume regulation, and the relevant local people's governments and the Yellow River Water Conservancy Commission and its subordinate management institutions must implement it.
制订黄河水量分配方案，应当遵循下列原则：
The formulation of the Yellow River water allocation scheme shall follow the following principles:
(一)依据流域规划和水中长期供求规划；
(1) Based on the basin plan and the medium- and long-term water supply and demand plan;
(二)坚持计划用水、节约用水；
(2) Adhere to planned water use and water conservation;
(三)充分考虑黄河流域水资源条件，取用水现状、供需情况及发展趋势，发挥黄河水资源的综合效益；
(3) Fully consider the water resource conditions of the Yellow River Basin, the current status of water withdrawal and use, supply and demand, and development trends, and give full play to the comprehensive benefits of the Yellow River water resources;
(四)统筹兼顾生活、生产、生态环境用水；
(4) Make overall plans and take into account domestic, production, and ecological environment water use;
(五)正确处理上下游、左右岸的关系；
(5) Correctly handle the relationship between upstream and downstream, left and right banks;
(六)科学确定河道输沙入海水量和可供水量。
(6) Scientifically determine the amount of water required for sediment transport into the sea and the available water supply.
前款所称可供水量，是指在黄河流域干、支流多年平均天然年径流量中，除必需的河道输沙入海水量外，可供城乡居民生活、农业、工业及河道外生态环境用水的最大水量。
The term "available water supply" in the preceding paragraph refers to the maximum amount of water that can be used for domestic, agricultural, industrial, and ecological environment water use outside the river channel, after deducting the necessary amount of water for sediment transport into the sea from the multi-year average natural annual runoff of the main stream and tributaries of the Yellow River Basin.
黄河水量分配方案需要调整的，应当由黄河水利委员会商十一省区市人民政府提出方案，经国务院发展改革主管部门和国务院水行政主管部门审查，报国务院批准。
If the Yellow River water allocation scheme needs to be adjusted, a proposal shall be made by the Yellow River Water Conservancy Commission in consultation with the people's governments of the eleven provinces, autonomous regions, and municipalities, reviewed by the development and reform department of the State Council and the water administrative department of the State Council, and submitted to the State Council for approval.
水量调度
Water Volume Regulation
黄河水量调度实行年度水量调度计划与月、旬水量调度方案和实时调度指令相结合的调度方式。
The Yellow River water volume regulation shall adopt a combination of annual water volume regulation plans, monthly and ten-day water volume regulation schemes, and real-time dispatch instructions.
黄河水量调度年度为当年7月1日至次年6月30日。
The water volume regulation year of the Yellow River is from July 1 of the current year to June 30 of the following year.
黄河干、支流的年度和月用水计划建议与水库运行计划建议，由十一省区市人民政府水行政主管部门和河南、山东黄河河务局以及水库管理单位，按照调度管理权限和规定的时间向黄河水利委员会申报。河南、山东黄河河务局申报黄河干流的用水计划建议时，应当商河南省、山东省人民政府水行政主管部门。
Annual and monthly water use plan proposals and reservoir operation plan proposals for the main stream and tributaries of the Yellow River shall be submitted by the water administrative departments of the people's governments of the eleven provinces, autonomous regions, and municipalities, as well as the Yellow River Bureau of Henan and Shandong Provinces and reservoir management units, to the Yellow River Water Conservancy Commission in accordance with the dispatch management authority and prescribed time. When the Yellow River Bureau of Henan and Shandong Provinces submit water use plan proposals for the main stream of the Yellow River, they shall consult the water administrative departments of the people's governments of Henan and Shandong Provinces.
年度水量调度计划由黄河水利委员会商十一省区市人民政府水行政主管部门和河南、山东黄河河务局以及水库管理单位制订，报国务院水行政主管部门批准并下达，同时抄送国务院发展改革主管部门。
The annual water volume dispatch plan shall be formulated by the Yellow River Water Conservancy Commission in consultation with the water administrative departments of the people's governments of the eleven provinces, autonomous regions, and municipalities, as well as the Yellow River Bureau of Henan and Shandong Provinces and reservoir management units, and shall be submitted to the water administrative department of the State Council for approval and issuance, with a copy sent to the development and reform department of the State Council.
经批准的年度水量调度计划，是确定月、旬水量调度方案和年度黄河干、支流用水量控制指标的依据。年度水量调度计划应当纳入本级国民经济和社会发展年度计划。
The approved annual water volume dispatch plan is the basis for determining monthly and ten-day water volume dispatch schemes and annual water consumption control indicators for the main stream and tributaries of the Yellow River. The annual water volume dispatch plan shall be incorporated into the national economic and social development annual plan at the corresponding level.
年度水量调度计划，应当依据经批准的黄河水量分配方案和年度预测来水量、水库蓄水量，按照同比例丰增枯减、多年调节水库蓄丰补枯的原则，在综合平衡申报的年度用水计划建议和水库运行计划建议的基础上制订。
The annual water volume dispatch plan shall be formulated based on the approved Yellow River water allocation plan, the forecasted incoming water volume for the year, and reservoir storage volume, following the principles of proportional increase in wet years and decrease in dry years, and multi-year regulation reservoirs storing water in wet years for use in dry years, on the basis of comprehensive balancing of the submitted annual water use plan proposals and reservoir operation plan proposals.
黄河水利委员会应当根据经批准的年度水量调度计划和申报的月用水计划建议、水库运行计划建议，制订并下达月水量调度方案；用水高峰时，应当根据需要制订并下达旬水量调度方案。
The Yellow River Water Conservancy Commission shall, based on the approved annual water volume dispatch plan and the submitted monthly water use plan proposals and reservoir operation plan proposals, formulate and issue monthly water volume dispatch schemes; during peak water use periods, it shall formulate and issue ten-day water volume dispatch schemes as needed.
黄河水利委员会根据实时水情、雨情、旱情、墒情、水库蓄水量及用水情况，可以对已下达的月、旬水量调度方案作出调整，下达实时调度指令。
The Yellow River Water Conservancy Commission may, based on real-time hydrological conditions, rainfall, drought, soil moisture, reservoir storage, and water use conditions, adjust the issued monthly and ten-day water volume dispatch schemes and issue real-time dispatch instructions.
青海省、四川省、甘肃省、宁夏回族自治区、内蒙古自治区、陕西省、山西省境内黄河干、支流的水量，分别由各省级人民政府水行政主管部门负责调度；河南省、山东省境内黄河干流的水量，分别由河南、山东黄河河务局负责调度，支流的水量，分别由河南省、山东省人民政府水行政主管部门负责调度；调入河北省、天津市的黄河水量，分别由河北省、天津市人民政府水行政主管部门负责调度。
The water volume of the main stream and tributaries of the Yellow River within Qinghai Province, Sichuan Province, Gansu Province, Ningxia Hui Autonomous Region, Inner Mongolia Autonomous Region, Shaanxi Province, and Shanxi Province shall be dispatched by the water administrative departments of the respective provincial people's governments; the water volume of the main stream of the Yellow River within Henan Province and Shandong Province shall be dispatched by the Yellow River Bureau of Henan and Shandong Provinces respectively, and the water volume of tributaries shall be dispatched by the water administrative departments of the people's governments of Henan and Shandong Provinces respectively; the Yellow River water volume transferred to Hebei Province and Tianjin Municipality shall be dispatched by the water administrative departments of the people's governments of Hebei Province and Tianjin Municipality respectively.
市、县级人民政府水行政主管部门和黄河水利委员会所属管理机构，负责所辖范围内分配水量的调度。
The water administrative departments of city and county people's governments and the management agencies under the Yellow River Water Conservancy Commission shall be responsible for the dispatch of allocated water within their respective jurisdictions.
实施黄河水量调度，必须遵守经批准的年度水量调度计划和下达的月、旬水量调度方案以及实时调度指令。
The implementation of Yellow River water volume dispatch must comply with the approved annual water volume dispatch plan, the issued monthly and ten-day water volume dispatch schemes, and real-time dispatch instructions.
龙羊峡、刘家峡、万家寨、三门峡、小浪底、西霞院、故县、东平湖等水库，由黄河水利委员会组织实施水量调度，下达月、旬水量调度方案及实时调度指令；必要时，黄河水利委员会可以对大峡、沙坡头、青铜峡、三盛公、陆浑等水库组织实施水量调度，下达实时调度指令。
Reservoirs such as Longyangxia, Liujiaxia, Wanjiazhai, Sanmenxia, Xiaolangdi, Xixiayuan, Guxian, and Dongpinghu shall have their water volume dispatch organized and implemented by the Yellow River Water Conservancy Commission, which issues monthly and ten-day water volume dispatch schemes and real-time dispatch instructions; when necessary, the Yellow River Water Conservancy Commission may organize and implement water volume dispatch for reservoirs such as Daxia, Shapotou, Qingtongxia, Sanshenggong, and Luhun, and issue real-time dispatch instructions.
水库主管部门或者单位具体负责实施所辖水库的水量调度，并按照水量调度指令做好发电计划的安排。
The reservoir competent department or unit shall be specifically responsible for implementing the water volume dispatch of the reservoir under its jurisdiction and shall arrange power generation plans in accordance with water volume dispatch instructions.
黄河水量调度实行水文断面流量控制。黄河干流水文断面的流量控制指标，由黄河水利委员会规定；重要支流水文断面及其流量控制指标，由黄河水利委员会会同黄河流域有关省、自治区人民政府水行政主管部门规定。
Yellow River water volume dispatch implements hydrological section flow control. The flow control indicators for hydrological sections of the main stream of the Yellow River shall be stipulated by the Yellow River Water Conservancy Commission; the hydrological sections of important tributaries and their flow control indicators shall be stipulated by the Yellow River Water Conservancy Commission jointly with the water administrative departments of the relevant provinces and autonomous regions in the Yellow River basin.
青海省、甘肃省、宁夏回族自治区、内蒙古自治区、河南省、山东省人民政府，分别负责并确保循化、下河沿、石嘴山、头道拐、高村、利津水文断面的下泄流量符合规定的控制指标；陕西省和山西省人民政府共同负责并确保潼关水文断面的下泄流量符合规定的控制指标。
The people's governments of Qinghai Province, Gansu Province, Ningxia Hui Autonomous Region, Inner Mongolia Autonomous Region, Henan Province, and Shandong Province shall respectively be responsible for and ensure that the discharge flow at the Xunhua, Xiaheyan, Shizuishan, Toudaoguai, Gaocun, and Lijin hydrological sections meets the prescribed control indicators; the people's governments of Shaanxi Province and Shanxi Province shall jointly be responsible for and ensure that the discharge flow at the Tongguan hydrological section meets the prescribed control indicators.
龙羊峡、刘家峡、万家寨、三门峡、小浪底水库的主管部门或者单位，分别负责并确保贵德、小川、万家寨、三门峡、小浪底水文断面的出库流量符合规定的控制指标。
The competent departments or units of the Longyangxia, Liujiaxia, Wanjiazhai, Sanmenxia, and Xiaolangdi reservoirs shall respectively be responsible for and ensure that the outflow flow at the Guide, Xiaochuan, Wanjiazhai, Sanmenxia, and Xiaolangdi hydrological sections meets the prescribed control indicators.
黄河干、支流省际或者重要控制断面和出库流量控制断面的下泄流量以国家设立的水文站监测数据为依据。对水文监测数据有争议的，以黄河水利委员会确认的水文监测数据为准。
The discharge flow at inter-provincial or important control sections and outflow control sections of the main stream and tributaries of the Yellow River shall be based on monitoring data from national hydrological stations. In case of disputes over hydrological monitoring data, the hydrological monitoring data confirmed by the Yellow River Water Conservancy Commission shall prevail.
需要在年度水量调度计划外使用其他省、自治区、直辖市计划内水量分配指标的，应当向黄河水利委员会提出申请，由黄河水利委员会组织有关各方在协商一致的基础上提出方案，报国务院水行政主管部门批准后组织实施。
If it is necessary to use water allocation indicators from other provinces, autonomous regions, or municipalities beyond the annual water volume dispatch plan, an application shall be submitted to the Yellow River Water Conservancy Commission, which shall organize relevant parties to propose a plan on the basis of consensus, and submit it to the water administrative department of the State Council for approval before implementation.
应急调度
Emergency Dispatch
出现严重干旱、省际或者重要控制断面流量降至预警流量、水库运行故障、重大水污染事故等情况，可能造成供水危机、黄河断流时，黄河水利委员会应当组织实施应急调度。
When severe drought, a drop in flow at inter-provincial or important control sections to the warning flow, reservoir operation failure, major water pollution incidents, or other situations occur that may cause a water supply crisis or the drying up of the Yellow River, the Yellow River Water Conservancy Commission shall organize and implement emergency dispatch.
黄河水利委员会应当商十一省区市人民政府以及水库主管部门或者单位，制订旱情紧急情况下的水量调度预案，经国务院水行政主管部门审查，报国务院或者国务院授权的部门批准。
The Yellow River Water Conservancy Commission shall, in consultation with the people's governments of the eleven provinces, autonomous regions, and municipalities, as well as reservoir competent departments or units, formulate a water volume dispatch plan for drought emergency situations, which shall be reviewed by the water administrative department of the State Council and submitted to the State Council or its authorized department for approval.
十一省区市人民政府水行政主管部门和河南、山东黄河河务局以及水库管理单位，应当根据经批准的旱情紧急情况下的水量调度预案，制订实施方案，并抄送黄河水利委员会。
The water administrative departments of the people's governments of the eleven provinces, autonomous regions, and municipalities, the Yellow River Bureau of Henan and Shandong Provinces, and reservoir management units shall, based on the approved water volume dispatch plan for drought emergency situations, formulate implementation plans and send a copy to the Yellow River Water Conservancy Commission.
出现旱情紧急情况时，经国务院水行政主管部门同意，由黄河水利委员会组织实施旱情紧急情况下的水量调度预案，并及时调整取水及水库出库流量控制指标；必要时，可以对黄河流域有关省、自治区主要取水口实行直接调度。
When a drought emergency occurs, with the consent of the water administrative department of the State Council, the Yellow River Water Conservancy Commission shall organize and implement the water volume dispatch plan for drought emergency situations and promptly adjust the control indicators for water intake and reservoir outflow flow; when necessary, it may directly dispatch the main water intakes in the relevant provinces and autonomous regions of the Yellow River basin.
县级以上地方人民政府、水库管理单位应当按照旱情紧急情况下的水量调度预案及其实施方案，合理安排用水计划，确保省际或者重要控制断面和出库流量控制断面的下泄流量符合规定的控制指标。
Local people's governments at or above the county level and reservoir management units shall, in accordance with the water volume dispatch plan for drought emergency situations and its implementation plan, reasonably arrange water use plans to ensure that the discharge flow at inter-provincial or important control sections and outflow control sections meets the prescribed control indicators.
出现旱情紧急情况时，十一省区市人民政府水行政主管部门和河南、山东黄河河务局以及水库管理单位，应当每日向黄河水利委员会报送取(退)水及水库蓄(泄)水情况。
When a drought emergency occurs, the water administrative departments of the people's governments of the eleven provinces, autonomous regions, and municipalities, the Yellow River Bureau of Henan and Shandong Provinces, and reservoir management units shall report daily to the Yellow River Water Conservancy Commission on water intake (discharge) and reservoir storage (release) conditions.
出现省际或者重要控制断面流量降至预警流量、水库运行故障以及重大水污染事故等情况时，黄河水利委员会及其所属管理机构、有关省级人民政府及其水行政主管部门和环境保护主管部门以及水库管理单位，应当根据需要，按照规定的权限和职责，及时采取压减取水量直至关闭取水口、实施水库应急泄流方案、加强水文监测、对排污企业实行限产或者停产等处置措施，有关部门和单位必须服从。
When situations such as a drop in flow at inter-provincial or important control sections to the warning flow, reservoir operation failure, or major water pollution incidents occur, the Yellow River Water Conservancy Commission and its management agencies, relevant provincial people's governments and their water administrative departments and environmental protection departments, and reservoir management units shall, as needed and in accordance with prescribed authority and responsibilities, promptly take measures such as reducing water intake or even closing water intakes, implementing reservoir emergency release plans, strengthening hydrological monitoring, and imposing production restrictions or shutdowns on pollutant-discharging enterprises; relevant departments and units must comply.
省际或者重要控制断面的预警流量，由黄河水利委员会确定。
The early warning flow rates at inter-provincial or important control sections shall be determined by the Yellow River Conservancy Commission.
实施应急调度，需要动用水库死库容的，由黄河水利委员会商有关水库主管部门或者单位，制订动用水库死库容的水量调度方案，经国务院水行政主管部门审查，报国务院或者国务院授权的部门批准实施。
When implementing emergency dispatch that requires the use of reservoir dead storage, the Yellow River Conservancy Commission shall, in consultation with the relevant reservoir competent department or unit, formulate a water volume dispatch plan for using reservoir dead storage, which shall be reviewed by the water administrative department of the State Council and submitted to the State Council or the department authorized by the State Council for approval before implementation.
监督管理
Supervision and Management
黄河水利委员会及其所属管理机构和县级以上地方人民政府水行政主管部门应当加强对所辖范围内水量调度执行情况的监督检查。
The Yellow River Conservancy Commission and its subordinate management agencies, as well as the water administrative departments of local people's governments at or above the county level, shall strengthen the supervision and inspection of the implementation of water volume dispatch within their respective jurisdictions.
十一省区市人民政府水行政主管部门和河南、山东黄河河务局，应当按照国务院水行政主管部门规定的时间，向黄河水利委员会报送所辖范围内取(退)水量报表。
The water administrative departments of the people's governments of the eleven provinces and autonomous regions, as well as the Henan and Shandong Yellow River Bureau, shall submit reports on the volume of water withdrawal (return) within their jurisdictions to the Yellow River Conservancy Commission within the time prescribed by the water administrative department of the State Council.
黄河水量调度文书格式，由黄河水利委员会编制、公布，并报国务院水行政主管部门备案。
The document format for Yellow River water volume dispatch shall be formulated and published by the Yellow River Conservancy Commission, and shall be reported to the water administrative department of the State Council for record.
黄河水利委员会应当定期将黄河水量调度执行情况向十一省区市人民政府水行政主管部门以及水库主管部门或者单位通报，并及时向社会公告。
The Yellow River Conservancy Commission shall regularly notify the water administrative departments of the people's governments of the eleven provinces and autonomous regions, as well as the reservoir competent departments or units, of the implementation of Yellow River water volume dispatch, and shall promptly make public announcements.
黄河水利委员会及其所属管理机构、县级以上地方人民政府水行政主管部门，应当在各自的职责范围内实施巡回监督检查，在用水高峰时对主要取(退)水口实施重点监督检查，在特殊情况下对有关河段、水库、主要取(退)水口进行驻守监督检查；发现重点污染物排放总量超过控制指标或者水体严重污染时，应当及时通报有关人民政府环境保护主管部门。
The Yellow River Conservancy Commission and its subordinate management agencies, as well as the water administrative departments of local people's governments at or above the county level, shall, within their respective responsibilities, conducttour inspection and supervision, carry out key supervision and inspection at major water intake (return) outlets during peak water use periods, and conduct stationed supervision and inspection on relevant river sections, reservoirs, and major water intake (return) outlets under special circumstances; when discovering that the total discharge of key pollutants exceeds the control target or that water bodies are seriously polluted, they shall promptly notify the relevant environmental protection department of the people's government.
黄河水利委员会及其所属管理机构、县级以上地方人民政府水行政主管部门实施监督检查时，有权采取下列措施：
When conducting supervision and inspection, the Yellow River Conservancy Commission and its subordinate management agencies, as well as the water administrative departments of local people's governments at or above the county level, have the right to take the following measures:
(一)要求被检查单位提供有关文件和资料，进行查阅或者复制；
(1) Require the unit under inspection to provide relevant documents and materials for review or copying;
(二)要求被检查单位就执行本条例的有关问题进行说明；
(2) Require the unit under inspection to explain issues related to the implementation of these Regulations;
(三)进入被检查单位生产场所进行现场检查；
(3) Enter the production premises of the unit under inspection for on-site inspection;
(四)对取(退)水量进行现场监测；
(4) Conduct on-site monitoring of the volume of water withdrawal (return);
(五)责令被检查单位纠正违反本条例的行为。
(5) Order the unit under inspection to correct any violations of these Regulations.
监督检查人员在履行监督检查职责时，应当向被检查单位或者个人出示执法证件，被检查单位或者个人应当接受和配合监督检查工作，不得拒绝或者妨碍监督检查人员依法执行公务。
When performing supervision and inspection duties, inspectors shall present their law enforcement credentials to the unit or individual under inspection. The unit or individual under inspection shall accept and cooperate with the supervision and inspection work, and shall not refuse or obstruct inspectors from lawfully carrying out their duties.

违反本条例规定，有下列行为之一的，对负有责任的主管人员和其他直接责任人员，由其上级主管部门、单位或者监察机关依法给予处分：
In violation of these Regulations, any of the following acts shall result in disciplinary action against the responsible supervisors and other directly responsible personnel by their superior competent departments, units, or supervisory organs in accordance with the law:
(一)不制订年度水量调度计划的；
(1) Failure to formulate an annual water volume dispatch plan;
(二)不及时下达月、旬水量调度方案的；
(2) Failure to issue monthly or ten-day water volume dispatch plans in a timely manner;
(三)不制订旱情紧急情况下的水量调度预案及其实施方案和动用水库死库容水量调度方案的。
(3) Failure to formulate water volume dispatch contingency plans and implementation plans for drought emergencies, and water volume dispatch plans for using reservoir dead storage.
违反本条例规定，有下列行为之一的，对负有责任的主管人员和其他直接责任人员，由其上级主管部门、单位或者监察机关依法给予处分；造成严重后果，构成犯罪的，依法追究刑事责任：
In violation of these Regulations, any of the following acts shall result in disciplinary action against the responsible supervisors and other directly responsible personnel by their superior competent departments, units, or supervisory organs in accordance with the law; if serious consequences are caused and a crime is constituted, criminal liability shall be pursued in accordance with the law:
(一)不执行年度水量调度计划和下达的月、旬水量调度方案以及实时调度指令的；
(1) Failure to implement the annual water volume dispatch plan, the issued monthly or ten-day water volume dispatch plans, and real-time dispatch instructions;
(二)不执行旱情紧急情况下的水量调度预案及其实施方案、水量调度应急处置措施和动用水库死库容水量调度方案的；
(2) Failure to implement the water volume dispatch contingency plans and implementation plans for drought emergencies, emergency response measures for water volume dispatch, and water volume dispatch plans for using reservoir dead storage;
(三)不履行监督检查职责或者发现违法行为不予查处的；
(3) Failure to perform supervision and inspection duties or failure to investigate and deal with discovered violations;
(四)其他滥用职权、玩忽职守等违法行为。
(4) Other acts of abuse of power, dereliction of duty, etc.
省际或者重要控制断面下泄流量不符合规定的控制指标的，由黄河水利委员会予以通报，责令限期改正；逾期不改正的，按照控制断面下泄流量的缺水量，在下一调度时段加倍扣除；对控制断面下游水量调度产生严重影响或者造成其他严重后果的，本年度不再新增该省、自治区的取水工程项目。对负有责任的主管人员和其他直接责任人员，由其上级主管部门、单位或者监察机关依法给予处分。
If the discharge flow at inter-provincial or important control sections does not meet the prescribed control indicators, the Yellow River Water Conservancy Commission shall issue a notice and order correction within a time limit; if correction is not made within the time limit, the water shortage amount at the control section shall be deducted twice in the next dispatch period; if it causes serious impact on downstream water dispatch or other serious consequences, no new water intake projects for that province or autonomous region shall be approved for the current year. The responsible persons in charge and other directly responsible persons shall be given sanctions by their superior competent departments, units, or supervisory organs according to law.
水库出库流量控制断面的下泄流量不符合规定的控制指标，对控制断面下游水量调度产生严重影响的，对负有责任的主管人员和其他直接责任人员，由其上级主管部门、单位或者监察机关依法给予处分。
If the discharge flow at the reservoir outlet control section does not meet the prescribed control indicators and causes serious impact on downstream water dispatch, the responsible persons in charge and other directly responsible persons shall be given sanctions by their superior competent departments, units, or supervisory organs according to law.
违反本条例规定，有关用水单位或者水库管理单位有下列行为之一的，由县级以上地方人民政府水行政主管部门或者黄河水利委员会及其所属管理机构按照管理权限，责令停止违法行为，给予警告，限期采取补救措施，并处2万元以上10万元以下罚款；对负有责任的主管人员和其他直接责任人员，由其上级主管部门、单位或者监察机关依法给予处分：
In violation of these regulations, if any water user or reservoir management unit commits one of the following acts, the water administrative department of the local people's government at or above the county level or the Yellow River Water Conservancy Commission and its subordinate management agencies shall, within their management authority, order cessation of the illegal act, issue a warning, order remedial measures within a time limit, and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; the responsible persons in charge and other directly responsible persons shall be given sanctions by their superior competent departments, units, or supervisory organs according to law:
(一)虚假填报或者篡改上报的水文监测数据、取用水量数据或者水库运行情况等资料的；
(1) Falsely reporting or tampering with submitted hydrological monitoring data, water intake data, or reservoir operation data, etc.;
(二)水库管理单位不执行水量调度方案和实时调度指令的；
(2) The reservoir management unit fails to implement the water dispatch plan and real-time dispatch instructions;
(三)超计划取用水的。
(3) Exceeding the planned water intake.
违反本条例规定，有下列行为之一的，由公安机关依法给予治安管理处罚；构成犯罪的，依法追究刑事责任：
In violation of these regulations, if any of the following acts occur, the public security organ shall impose public security penalties according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)妨碍、阻挠监督检查人员或者取用水工程管理人员依法执行公务的；
(1) Obstructing or impeding inspection personnel or water intake project management personnel from lawfully performing their duties;
(二)在水量调度中煽动群众闹事的。
(2) Inciting public disturbance in water volume dispatch.
附则
Supplementary Provisions
黄河水量调度中，有关用水计划建议和水库运行计划建议申报时间，年度水量调度计划制订、下达时间，月、旬水量调度方案下达时间，取(退)水水量报表报送时间等，由国务院水行政主管部门规定。
In the regulation of the Yellow River water volume, the time for submitting water use plan proposals and reservoir operation plan proposals, the time for formulating and issuing annual water volume dispatch plans, the time for issuing monthly and ten-day water volume dispatch plans, and the time for submitting water intake (return) water volume reports shall be prescribed by the water administrative department of the State Council.
在黄河水量调度中涉及水资源保护、防洪、防凌和水污染防治的，依照《中华人民共和国水法》、《中华人民共和国防洪法》和《中华人民共和国水污染防治法》的有关规定执行。
Matters involving water resources protection, flood control, ice prevention, and water pollution prevention in the regulation of the Yellow River water volume shall be handled in accordance with the relevant provisions of the Water Law of the People's Republic of China, the Flood Control Law of the People's Republic of China, and the Water Pollution Prevention and Control Law of the People's Republic of China.
本条例自2006年8月1日起施行。
These Regulations shall come into force as of August 1, 2006.
