为了加强对世界博览会标志的保护，维护世界博览会标志权利人的合法权益，制定本条例。
These Regulations are formulated to strengthen the protection of World Expo emblems and safeguard the legitimate rights and interests of the owners of World Expo emblems.
本条例所称世界博览会标志，是指：
For the purposes of these Regulations, "World Expo emblems" means:
(一)中国2010年上海世界博览会申办机构的名称(包括全称、简称、译名和缩写，下同)、徽记或者其他标志；
(1) The name (including full name, abbreviation, translation, and acronym, the same below), emblem, or other symbol of the bidding entity for the World Expo 2010 Shanghai China;
(二)中国2010年上海世界博览会组织机构的名称、徽记或者其他标志；
(2) The name, emblem, or other symbol of the organizing entity for the World Expo 2010 Shanghai China;
(三)中国2010年上海世界博览会的名称、会徽、会旗、吉祥物、会歌、主题词、口号；
(3) The name, emblem, flag, mascot, anthem, theme, and slogan of the World Expo 2010 Shanghai China;
(四)国际展览局的局旗。
(4) The flag of the Bureau International des Expositions (BIE).
本条例所称世界博览会标志权利人，是指中国2010年上海世界博览会组织机构和国际展览局。
For the purposes of these Regulations, "owners of World Expo emblems" means the organizing entity for the World Expo 2010 Shanghai China and the Bureau International des Expositions.
中国2010年上海世界博览会组织机构为本条例第二条第(一)、(二)、(三)项规定的世界博览会标志的权利人。中国2010年上海世界博览会组织机构和国际展览局之间关于本条例第二条第(四)项规定的世界博览会标志的权利划分，依照中国2010年上海世界博览会《申办报告》、《注册报告》和国际展览局《关于使用国际展览局局旗的规定》确定。
The organizing entity for the World Expo 2010 Shanghai China is the owner of the World Expo emblems specified in Article 2, items (1), (2), and (3) of these Regulations. The division of rights between the organizing entity for the World Expo 2010 Shanghai China and the Bureau International des Expositions regarding the World Expo emblem specified in Article 2, item (4) of these Regulations shall be determined in accordance with the Bid Report and Registration Report for the World Expo 2010 Shanghai China and the BIE Regulations on the Use of the BIE Flag.
世界博览会标志权利人依照本条例享有世界博览会标志专有权。
Owners of World Expo emblems enjoy exclusive rights to the World Expo emblems in accordance with these Regulations.
未经世界博览会标志权利人许可，任何人不得为商业目的(含潜在商业目的，下同)使用世界博览会标志。
Without the permission of the owner of a World Expo emblem, no person may use the World Expo emblem for commercial purposes (including potential commercial purposes, the same below).
本条例所称为商业目的使用，是指以营利为目的，以下列方式使用世界博览会标志：
For the purposes of these Regulations, "use for commercial purposes" means using a World Expo emblem for profit in the following ways:
(一)将世界博览会标志用于商品、商品包装或者容器以及商品交易文书上；
(1) Affixing the World Expo emblem to goods, packaging or containers of goods, or transaction documents;
(二)将世界博览会标志用于服务业中；
(2) Using the World Expo emblem in the service industry;
(三)将世界博览会标志用于广告宣传、商业展览、营业性演出以及其他商业活动中；
(3) Using the World Expo emblem in advertising, commercial exhibitions, commercial performances, and other commercial activities;
(四)销售、进口、出口含有世界博览会标志的商品；
(4) Selling, importing, or exporting goods bearing the World Expo emblem;
(五)制造或者销售世界博览会标志；
(5) Manufacturing or selling the World Expo emblem;
(六)将世界博览会标志作为字号申请企业名称登记，可能造成市场误认、混淆的；
(6) Applying for registration of a World Expo emblem as a trade name in a business name, which may cause market confusion or misidentification;
(七)可能使他人认为行为人与世界博览会标志权利人之间存在许可使用关系而使用世界博览会标志的其他行为。
(7) Other acts that may lead others to believe that there is a licensing relationship between the actor and the owner of the World Expo emblem.
国务院工商行政管理部门依照本条例的规定，负责全国的世界博览会标志保护工作。
The administrative department for industry and commerce under the State Council shall be responsible for the protection of World Expo emblems nationwide in accordance with these Regulations.
县级以上地方工商行政管理部门依照本条例的规定，负责本行政区域内的世界博览会标志保护工作。
The local administrative departments for industry and commerce at or above the county level shall be responsible for the protection of World Expo emblems within their respective administrative regions in accordance with these Regulations.
世界博览会标志权利人应当将世界博览会标志报国务院工商行政管理部门备案，由国务院工商行政管理部门公告。
Owners of World Expo emblems shall file the World Expo emblems with the administrative department for industry and commerce under the State Council for record, and the said department shall make a public announcement.
在本条例施行前已经依法使用世界博览会标志的，可以在原有范围内继续使用。
Any person who has lawfully used a World Expo emblem prior to the effective date of these Regulations may continue to use it within the original scope.
未经世界博览会标志权利人许可，为商业目的擅自使用世界博览会标志即侵犯世界博览会标志专有权，引起纠纷的，由当事人协商解决；不愿协商或者协商不成的，世界博览会标志权利人或者利害关系人可以依法向人民法院提起诉讼，也可以请求工商行政管理部门处理。
Any unauthorized use of a World Expo emblem for commercial purposes without the permission of the owner constitutes an infringement of the exclusive right to the World Expo emblem. If a dispute arises, the parties shall attempt to settle it through consultation; if consultation fails or is refused, the owner or interested party may file a lawsuit with the People's Court or request the administrative department for industry and commerce to handle the matter.
应当事人的请求，工商行政管理部门可以就侵犯世界博览会标志专有权的赔偿数额进行调解；调解不成的，当事人可以依法向人民法院提起诉讼。
Upon request of the parties, the administrative department for industry and commerce may mediate the amount of damages for infringement of the exclusive right to a World Expo emblem; if mediation fails, the parties may file a lawsuit with the People's Court in accordance with the law.
工商行政管理部门根据已经取得的违法嫌疑证据或者举报查处涉嫌侵犯世界博览会标志专有权的行为时，可以行使下列职权：
When investigating suspected infringement of the exclusive right to use World Expo symbols based on obtained evidence of suspicion or reports, the administrative department for industry and commerce may exercise the following powers:
(一)询问有关当事人，调查与侵犯世界博览会标志专有权有关的情况；
(1) Inquire about the relevant parties and investigate the circumstances related to the infringement of the exclusive right to use World Expo symbols;
(二)查阅、复制与侵权活动有关的合同、发票、账簿以及其他有关资料；
(2) Review and copy contracts, invoices, account books, and other relevant materials related to the infringing activities;
(三)对当事人涉嫌侵犯世界博览会标志专有权活动的场所实施现场检查；
(3) Conduct on-site inspections of the premises where the party is suspected of engaging in activities infringing the exclusive right to use World Expo symbols;
(四)检查与侵权活动有关的物品；对有证据证明侵犯世界博览会标志专有权的物品，予以查封或者扣押。
(4) Inspect items related to the infringing activities; seal or seize items that have evidence proving infringement of the exclusive right to use World Expo symbols.
工商行政管理部门依法行使前款规定的职权时，当事人应当予以协助、配合，不得拒绝、阻挠。
When the administrative department for industry and commerce exercises the powers prescribed in the preceding paragraph in accordance with the law, the party concerned shall provide assistance and cooperation and shall not refuse or obstruct.
工商行政管理部门处理侵犯世界博览会标志专有权行为时，认定侵权行为成立的，责令立即停止侵权行为，没收、销毁侵权商品和专门用于制造侵权商品或者为商业目的擅自制造世界博览会标志的工具，有违法所得的，没收违法所得，可以并处违法所得5倍以下的罚款；没有违法所得的，可以并处5万元以下的罚款。
When the administrative department for industry and commerce handles acts infringing the exclusive right to use World Expo symbols and determines that the infringement is established, it shall order the immediate cessation of the infringing act, confiscate and destroy the infringing goods and tools specially used for manufacturing infringing goods or for making World Expo symbols without authorization for commercial purposes; if there is illegal income, confiscate the illegal income and may impose a fine of not more than five times the illegal income; if there is no illegal income, a fine of not more than 50,000 yuan may be imposed.
利用世界博览会标志进行诈骗等活动，构成犯罪的，依法追究刑事责任。
If the use of World Expo symbols for fraud or other activities constitutes a crime, criminal liability shall be pursued in accordance with the law.
侵犯世界博览会标志专有权的货物禁止进出口。世界博览会标志专有权海关保护的程序适用《中华人民共和国知识产权海关保护条例》的规定。
Goods infringing the exclusive right to use World Expo symbols are prohibited from import and export. The procedures for customs protection of the exclusive right to use World Expo symbols shall apply the provisions of the Regulations of the People's Republic of China on Customs Protection of Intellectual Property Rights.
侵犯世界博览会标志专有权的赔偿数额，按照权利人因被侵权所受到的损失或者侵权人因侵权所获得的利益确定，包括为制止侵权行为所支付的合理开支；被侵权人的损失或者侵权人获得的利益难以确定的，参照该世界博览会标志许可使用费合理确定。
The amount of damages for infringement of the exclusive right to use World Expo symbols shall be determined based on the losses suffered by the right holder due to the infringement or the profits gained by the infringer from the infringement, including reasonable expenses incurred to stop the infringement; if the losses of the infringed party or the profits gained by the infringer are difficult to determine, the amount shall be reasonably determined by reference to the licensing fee for the use of the World Expo symbol.
销售不知道是侵犯世界博览会标志专有权的商品，能证明该商品是自己合法取得并说明提供者的，不承担赔偿责任。
A person who sells goods without knowing that they infringe the exclusive right to use World Expo symbols, and can prove that the goods were legally obtained and identify the supplier, shall not bear liability for damages.
任何单位或者个人可以向工商行政管理部门或有关行政管理部门举报违反本条例使用世界博览会标志的行为。
Any unit or individual may report to the administrative department for industry and commerce or relevant administrative departments any act that violates these Regulations by using World Expo symbols.
世界博览会标志除依照本条例受到保护外，还可以依照《中华人民共和国著作权法》、《中华人民共和国商标法》、《中华人民共和国专利法》、《中华人民共和国反不正当竞争法》、《特殊标志管理条例》等法律、行政法规的规定获得保护。
In addition to being protected under these Regulations, World Expo symbols may also be protected under laws and administrative regulations such as the Copyright Law of the People's Republic of China, the Trademark Law of the People's Republic of China, the Patent Law of the People's Republic of China, the Anti-Unfair Competition Law of the People's Republic of China, and the Regulations on the Administration of Special Symbols.
本条例自2004年12月1日起施行。
These Regulations shall come into force as of December 1, 2004.
