总则
General Provisions
为了加强历史文化名城、名镇、名村的保护与管理，继承中华民族优秀历史文化遗产，制定本条例。
These Regulations are formulated to strengthen the protection and management of famous historical and cultural cities, towns, and villages, and to inherit the outstanding historical and cultural heritage of the Chinese nation.
历史文化名城、名镇、名村的申报、批准、规划、保护，适用本条例。
These Regulations apply to the declaration, approval, planning, and protection of famous historical and cultural cities, towns, and villages.
历史文化名城、名镇、名村的保护应当遵循科学规划、严格保护的原则，保持和延续其传统格局和历史风貌，维护历史文化遗产的真实性和完整性，继承和弘扬中华民族优秀传统文化，正确处理经济社会发展和历史文化遗产保护的关系。
The protection of famous historical and cultural cities, towns, and villages shall follow the principles of scientific planning and strict protection, maintain and continue their traditional patterns and historical features, preserve the authenticity and integrity of historical and cultural heritage, inherit and promote the excellent traditional culture of the Chinese nation, and properly handle the relationship between economic and social development and the protection of historical and cultural heritage.
国家对历史文化名城、名镇、名村的保护给予必要的资金支持。
The State shall provide necessary financial support for the protection of famous historical and cultural cities, towns, and villages.
历史文化名城、名镇、名村所在地的县级以上地方人民政府，根据本地实际情况安排保护资金，列入本级财政预算。
The local people's governments at or above the county level where the famous historical and cultural cities, towns, and villages are located shall, based on local actual conditions, arrange protection funds and include them in the fiscal budget at the corresponding level.
国家鼓励企业、事业单位、社会团体和个人参与历史文化名城、名镇、名村的保护。
The State encourages enterprises, institutions, social organizations, and individuals to participate in the protection of famous historical and cultural cities, towns, and villages.
国务院建设主管部门会同国务院文物主管部门负责全国历史文化名城、名镇、名村的保护和监督管理工作。
The competent department of construction under the State Council, together with the competent department of cultural relics under the State Council, shall be responsible for the protection and supervision of famous historical and cultural cities, towns, and villages nationwide.
地方各级人民政府负责本行政区域历史文化名城、名镇、名村的保护和监督管理工作。
Local people's governments at all levels shall be responsible for the protection and supervision of famous historical and cultural cities, towns, and villages within their respective administrative regions.
县级以上人民政府及其有关部门对在历史文化名城、名镇、名村保护工作中做出突出贡献的单位和个人，按照国家有关规定给予表彰和奖励。
The people's governments at or above the county level and their relevant departments shall, in accordance with state regulations, commend and reward units and individuals that have made outstanding contributions to the protection of famous historical and cultural cities, towns, and villages.
申报与批准
Declaration and Approval
具备下列条件的城市、镇、村庄，可以申报历史文化名城、名镇、名村：
Cities, towns, and villages that meet the following conditions may apply for recognition as famous historical and cultural cities, towns, or villages:
(一)保存文物特别丰富；
(1) Particularly rich in preserved cultural relics;
(二)历史建筑集中成片；
(2) Historical buildings are concentrated in clusters;
(三)保留着传统格局和历史风貌；
(3) Retain traditional layout and historical appearance;
(四)历史上曾经作为政治、经济、文化、交通中心或者军事要地，或者发生过重要历史事件，或者其传统产业、历史上建设的重大工程对本地区的发展产生过重要影响，或者能够集中反映本地区建筑的文化特色、民族特色。
(4) Historically served as a political, economic, cultural, transportation center or military stronghold, or witnessed important historical events, or whose traditional industries or major historical projects have had a significant impact on the region's development, or can reflect the cultural and ethnic characteristics of the region's architecture.
申报历史文化名城的，在所申报的历史文化名城保护范围内还应当有2个以上的历史文化街区。
For a city applying for recognition as a famous historical and cultural city, there shall be at least two historical and cultural districts within the protected area of the declared city.
申报历史文化名城、名镇、名村，应当提交所申报的历史文化名城、名镇、名村的下列材料：
To apply for recognition as a famous historical and cultural city, town, or village, the following materials concerning the declared city, town, or village shall be submitted:
(一)历史沿革、地方特色和历史文化价值的说明；
(1) A description of the historical evolution, local characteristics, and historical and cultural value;
(二)传统格局和历史风貌的现状；
(2) The current status of the traditional layout and historical appearance;
(三)保护范围；
(3) The scope of protection;
(四)不可移动文物、历史建筑、历史文化街区的清单；
(4) A list of immovable cultural relics, historic buildings, and historical and cultural districts;
(五)保护工作情况、保护目标和保护要求。
(5) The status of protection work, protection objectives, and protection requirements.
申报历史文化名城，由省、自治区、直辖市人民政府提出申请，经国务院建设主管部门会同国务院文物主管部门组织有关部门、专家进行论证，提出审查意见，报国务院批准公布。
To declare a famous historical and cultural city, the people's government of the province, autonomous region, or municipality directly under the Central Government shall submit an application. The competent department of construction under the State Council, together with the competent department of cultural relics under the State Council, shall organize relevant departments and experts to conduct a demonstration, provide review opinions, and submit to the State Council for approval and announcement.
申报历史文化名镇、名村，由所在地县级人民政府提出申请，经省、自治区、直辖市人民政府确定的保护主管部门会同同级文物主管部门组织有关部门、专家进行论证，提出审查意见，报省、自治区、直辖市人民政府批准公布。
To declare a famous historical and cultural town or village, the county people's government of the location shall submit an application. The protection department designated by the people's government of the province, autonomous region, or municipality directly under the Central Government, together with the competent department of cultural relics at the same level, shall organize relevant departments and experts to conduct a demonstration, provide review opinions, and submit to the people's government of the province, autonomous region, or municipality directly under the Central Government for approval and announcement.
对符合本条例第七条规定的条件而没有申报历史文化名城的城市，国务院建设主管部门会同国务院文物主管部门可以向该城市所在地的省、自治区人民政府提出申报建议；仍不申报的，可以直接向国务院提出确定该城市为历史文化名城的建议。
For a city that meets the conditions specified in Article 7 of these Regulations but has not declared itself a famous historical and cultural city, the competent department of construction under the State Council, together with the competent department of cultural relics under the State Council, may submit a declaration proposal to the people's government of the province or autonomous region where the city is located; if the city still does not declare, they may directly submit a proposal to the State Council to designate the city as a famous historical and cultural city.
对符合本条例第七条规定的条件而没有申报历史文化名镇、名村的镇、村庄，省、自治区、直辖市人民政府确定的保护主管部门会同同级文物主管部门可以向该镇、村庄所在地的县级人民政府提出申报建议；仍不申报的，可以直接向省、自治区、直辖市人民政府提出确定该镇、村庄为历史文化名镇、名村的建议。
For a town or village that meets the conditions specified in Article 7 of these Regulations but has not declared itself a famous historical and cultural town or village, the protection department designated by the people's government of the province, autonomous region, or municipality directly under the Central Government, together with the competent department of cultural relics at the same level, may submit a declaration proposal to the county people's government where the town or village is located; if the town or village still does not declare, they may directly submit a proposal to the people's government of the province, autonomous region, or municipality directly under the Central Government to designate the town or village as a famous historical and cultural town or village.
国务院建设主管部门会同国务院文物主管部门可以在已批准公布的历史文化名镇、名村中，严格按照国家有关评价标准，选择具有重大历史、艺术、科学价值的历史文化名镇、名村，经专家论证，确定为中国历史文化名镇、名村。
The competent department of construction under the State Council, together with the competent department of cultural relics under the State Council, may, among the already approved and announced famous historical and cultural towns and villages, strictly in accordance with the national evaluation standards, select famous historical and cultural towns and villages with significant historical, artistic, and scientific value, and after expert demonstration, designate them as Chinese famous historical and cultural towns and villages.
已批准公布的历史文化名城、名镇、名村，因保护不力使其历史文化价值受到严重影响的，批准机关应当将其列入濒危名单，予以公布，并责成所在地城市、县人民政府限期采取补救措施，防止情况继续恶化，并完善保护制度，加强保护工作。
If an already approved and announced famous historical and cultural city, town, or village suffers serious damage to its historical and cultural value due to inadequate protection, the approving authority shall include it in the endangered list, announce it, and order the city or county people's government of the location to take remedial measures within a time limit to prevent further deterioration, improve the protection system, and strengthen protection work.
保护规划
Protection Planning
历史文化名城批准公布后，历史文化名城人民政府应当组织编制历史文化名城保护规划。
After the approval and announcement of a famous historical and cultural city, the people's government of that city shall organize the formulation of a protection plan for the famous historical and cultural city.
历史文化名镇、名村批准公布后，所在地县级人民政府应当组织编制历史文化名镇、名村保护规划。
After the approval and announcement of a famous historical and cultural town or village, the county-level people's government at the location shall organize the formulation of a protection plan for the famous historical and cultural town or village.
保护规划应当自历史文化名城、名镇、名村批准公布之日起1年内编制完成。
The protection plan shall be completed within one year from the date of approval and announcement of the famous historical and cultural city, town, or village.
保护规划应当包括下列内容：
The protection plan shall include the following contents:
(一)保护原则、保护内容和保护范围；
(1) Protection principles, protection content, and protection scope;
(二)保护措施、开发强度和建设控制要求；
(2) Protection measures, development intensity, and construction control requirements;
(三)传统格局和历史风貌保护要求；
(3) Requirements for the protection of traditional layout and historical appearance;
(四)历史文化街区、名镇、名村的核心保护范围和建设控制地带；
(4) Core protection zones and construction control areas of historical and cultural blocks, famous towns, and famous villages;
(五)保护规划分期实施方案。
(5) Phased implementation plan for the protection plan.
历史文化名城、名镇保护规划的规划期限应当与城市、镇总体规划的规划期限相一致；历史文化名村保护规划的规划期限应当与村庄规划的规划期限相一致。
The planning period for the protection plan of a famous historical and cultural city or town shall be consistent with the planning period of the city or town master plan; the planning period for the protection plan of a famous historical and cultural village shall be consistent with the planning period of the village plan.
保护规划报送审批前，保护规划的组织编制机关应当广泛征求有关部门、专家和公众的意见；必要时，可以举行听证。
Before submitting the protection plan for approval, the organization responsible for preparing the plan shall extensively solicit opinions from relevant departments, experts, and the public; if necessary, a hearing may be held.
保护规划报送审批文件中应当附具意见采纳情况及理由；经听证的，还应当附具听证笔录。
The submission documents for the protection plan shall include the status of opinion adoption and the reasons; if a hearing was held, the hearing record shall also be attached.
保护规划由省、自治区、直辖市人民政府审批。
The protection plan shall be approved by the people's government of the province, autonomous region, or municipality directly under the Central Government.
保护规划的组织编制机关应当将经依法批准的历史文化名城保护规划和中国历史文化名镇、名村保护规划，报国务院建设主管部门和国务院文物主管部门备案。
The organization responsible for preparing the protection plan shall submit the legally approved protection plan for famous historical and cultural cities and Chinese famous historical and cultural towns and villages to the construction administrative department of the State Council and the cultural relics administrative department of the State Council for record.
保护规划的组织编制机关应当及时公布经依法批准的保护规划。
The organization responsible for preparing the protection plan shall promptly publish the legally approved protection plan.
经依法批准的保护规划，不得擅自修改；确需修改的，保护规划的组织编制机关应当向原审批机关提出专题报告，经同意后，方可编制修改方案。修改后的保护规划，应当按照原审批程序报送审批。
A legally approved protection plan shall not be modified without authorization; if modification is truly necessary, the organization responsible for preparing the protection plan shall submit a special report to the original approval authority, and only after obtaining consent may a modification plan be prepared. The modified protection plan shall be submitted for approval in accordance with the original approval procedure.
国务院建设主管部门会同国务院文物主管部门应当加强对保护规划实施情况的监督检查。
The construction administrative department of the State Council, together with the cultural relics administrative department of the State Council, shall strengthen the supervision and inspection of the implementation of protection plans.
县级以上地方人民政府应当加强对本行政区域保护规划实施情况的监督检查，并对历史文化名城、名镇、名村保护状况进行评估；对发现的问题，应当及时纠正、处理。
Local people's governments at or above the county level shall strengthen the supervision and inspection of the implementation of protection plans within their administrative regions, and evaluate the protection status of famous historical and cultural cities, towns, and villages; any problems discovered shall be promptly corrected and addressed.
保护措施
Protection Measures
历史文化名城、名镇、名村应当整体保护，保持传统格局、历史风貌和空间尺度，不得改变与其相互依存的自然景观和环境。
Famous historical and cultural cities, towns, and villages shall be protected as a whole, maintaining their traditional layout, historical features, and spatial scale, and shall not alter the natural landscape and environment on which they depend.
历史文化名城、名镇、名村所在地县级以上地方人民政府应当根据当地经济社会发展水平，按照保护规划，控制历史文化名城、名镇、名村的人口数量，改善历史文化名城、名镇、名村的基础设施、公共服务设施和居住环境。
The local people's government at or above the county level where a famous historical and cultural city, town, or village is located shall, based on the local economic and social development level and in accordance with the protection plan, control the population size of the famous historical and cultural city, town, or village, and improve its infrastructure, public service facilities, and living environment.
在历史文化名城、名镇、名村保护范围内从事建设活动，应当符合保护规划的要求，不得损害历史文化遗产的真实性和完整性，不得对其传统格局和历史风貌构成破坏性影响。
Construction activities carried out within the protected areas of famous historical and cultural cities, towns, and villages shall comply with the requirements of the protection plan, shall not harm the authenticity and integrity of historical and cultural heritage, and shall not cause destructive impact on their traditional layout and historical features.
在历史文化名城、名镇、名村保护范围内禁止进行下列活动：
The following activities are prohibited within the protected areas of famous historical and cultural cities, towns, and villages:
(一)开山、采石、开矿等破坏传统格局和历史风貌的活动；
(1) Activities such as mountain excavation, quarrying, and mining that damage the traditional layout and historical features;
(二)占用保护规划确定保留的园林绿地、河湖水系、道路等；
(2) Occupying gardens, green spaces, river systems, roads, etc., that are designated for preservation in the protection plan;
(三)修建生产、储存爆炸性、易燃性、放射性、毒害性、腐蚀性物品的工厂、仓库等；
(3) Constructing factories, warehouses, etc., for producing or storing explosive, flammable, radioactive, toxic, or corrosive substances;
(四)在历史建筑上刻划、涂污。
(4) Carving or defacing historic buildings.
在历史文化名城、名镇、名村保护范围内进行下列活动，应当保护其传统格局、历史风貌和历史建筑；制订保护方案，并依照有关法律、法规的规定办理相关手续：
The following activities carried out within the protected areas of famous historical and cultural cities, towns, and villages shall protect their traditional layout, historical features, and historic buildings; a protection plan shall be formulated, and relevant procedures shall be handled in accordance with relevant laws and regulations:
(一)改变园林绿地、河湖水系等自然状态的活动；
(1) Activities that alter the natural state of gardens, green spaces, river systems, etc.
(二)在核心保护范围内进行影视摄制、举办大型群众性活动；
(2) Conducting film and television production or holding large-scale public events within the core protection zone;
(三)其他影响传统格局、历史风貌或者历史建筑的活动。
(3) Other activities that affect the traditional layout, historical appearance, or historic buildings.
历史文化街区、名镇、名村建设控制地带内的新建建筑物、构筑物，应当符合保护规划确定的建设控制要求。
New construction of buildings or structures within the construction control areas of historical and cultural blocks, towns, and villages shall comply with the construction control requirements determined by the protection plan.
对历史文化街区、名镇、名村核心保护范围内的建筑物、构筑物，应当区分不同情况，采取相应措施，实行分类保护。
Buildings and structures within the core protection zones of historical and cultural blocks, towns, and villages shall be subject to differentiated measures and classified protection based on their specific conditions.
历史文化街区、名镇、名村核心保护范围内的历史建筑，应当保持原有的高度、体量、外观形象及色彩等。
Historic buildings within the core protection zones of historical and cultural blocks, towns, and villages shall maintain their original height, volume, exterior appearance, and color.
在历史文化街区、名镇、名村核心保护范围内，不得进行新建、扩建活动。但是，新建、扩建必要的基础设施和公共服务设施除外。
Within the core protection zones of historical and cultural blocks, towns, and villages, new construction or expansion activities are prohibited, except for necessary infrastructure and public service facilities.
在历史文化街区、名镇、名村核心保护范围内，新建、扩建必要的基础设施和公共服务设施的，城市、县人民政府城乡规划主管部门核发建设工程规划许可证、乡村建设规划许可证前，应当征求同级文物主管部门的意见。
When constructing or expanding necessary infrastructure or public service facilities within the core protection zones of historical and cultural blocks, towns, and villages, the competent department of urban and rural planning of the city or county government shall seek the opinions of the competent department of cultural relics at the same level before issuing a construction project planning permit or a rural construction planning permit.
在历史文化街区、名镇、名村核心保护范围内，拆除历史建筑以外的建筑物、构筑物或者其他设施的，应当经城市、县人民政府城乡规划主管部门会同同级文物主管部门批准。
Within the core protection zones of historical and cultural blocks, towns, and villages, the demolition of buildings, structures, or other facilities other than historic buildings shall be approved by the competent department of urban and rural planning of the city or county government in conjunction with the competent department of cultural relics at the same level.
审批本条例第二十八条规定的建设活动，审批机关应当组织专家论证，并将审批事项予以公示，征求公众意见，告知利害关系人有要求举行听证的权利。公示时间不得少于20日。
When approving construction activities as specified in Article 28 of these Regulations, the approving authority shall organize expert argumentation, publicize the approval matter to solicit public opinions, and inform interested parties of their right to request a hearing. The publicity period shall not be less than 20 days.
利害关系人要求听证的，应当在公示期间提出，审批机关应当在公示期满后及时举行听证。
If an interested party requests a hearing, the request shall be made during the publicity period, and the approving authority shall promptly hold a hearing after the publicity period expires.
城市、县人民政府应当在历史文化街区、名镇、名村核心保护范围的主要出入口设置标志牌。
The people's government of a city or county shall set up signboards at the main entrances and exits of the core protection areas of historical and cultural blocks, famous towns, and famous villages.
任何单位和个人不得擅自设置、移动、涂改或者损毁标志牌。
No unit or individual may set up, move, alter, or damage signboards without authorization.
历史文化街区、名镇、名村核心保护范围内的消防设施、消防通道，应当按照有关的消防技术标准和规范设置。确因历史文化街区、名镇、名村的保护需要，无法按照标准和规范设置的，由城市、县人民政府公安机关消防机构会同同级城乡规划主管部门制订相应的防火安全保障方案。
Fire-fighting facilities and fire passages within the core protection areas of historical and cultural blocks, famous towns, and famous villages shall be installed in accordance with relevant fire-fighting technical standards and specifications. If it is truly impossible to install them in accordance with the standards and specifications due to the protection needs of the historical and cultural blocks, famous towns, and famous villages, the public security fire-fighting institution of the people's government of the city or county shall, together with the competent department of urban and rural planning at the same level, formulate corresponding fire safety protection plans.
城市、县人民政府应当对历史建筑设置保护标志，建立历史建筑档案。
The people's government of a city or county shall set up protection signs for historical buildings and establish archives for historical buildings.
历史建筑档案应当包括下列内容：
The archives of historical buildings shall include the following contents:
(一)建筑艺术特征、历史特征、建设年代及稀有程度；
(1) Architectural artistic features, historical features, construction period, and rarity;
(二)建筑的有关技术资料；
(2) Relevant technical data of the building;
(三)建筑的使用现状和权属变化情况；
(3) Current usage status and changes in ownership of the building;
(四)建筑的修缮、装饰装修过程中形成的文字、图纸、图片、影像等资料；
(4) Text, drawings, pictures, images, and other materials formed during the repair, decoration, or renovation of the building;
(五)建筑的测绘信息记录和相关资料。
(5) Surveying and mapping information records and related materials of the building.
历史建筑的所有权人应当按照保护规划的要求，负责历史建筑的维护和修缮。
The owner of a historic building shall be responsible for its maintenance and renovation in accordance with the requirements of the protection plan.
县级以上地方人民政府可以从保护资金中对历史建筑的维护和修缮给予补助。
Local people's governments at or above the county level may provide subsidies from protection funds for the maintenance and renovation of historic buildings.
历史建筑有损毁危险，所有权人不具备维护和修缮能力的，当地人民政府应当采取措施进行保护。
If a historic building is in danger of damage and the owner is unable to maintain or renovate it, the local people's government shall take measures to protect it.
任何单位或者个人不得损坏或者擅自迁移、拆除历史建筑。
No unit or individual may damage, or without authorization relocate or demolish, a historic building.
建设工程选址，应当尽可能避开历史建筑；因特殊情况不能避开的，应当尽可能实施原址保护。
The site selection for construction projects shall avoid historic buildings as much as possible; if avoidance is impossible due to special circumstances, on-site protection shall be implemented as much as possible.
对历史建筑实施原址保护的，建设单位应当事先确定保护措施，报城市、县人民政府城乡规划主管部门会同同级文物主管部门批准。
For on-site protection of a historic building, the construction unit shall determine protection measures in advance and submit them to the urban and rural planningcompetent authority of the city or county people's government for approval jointly with the competent cultural relics department at the same level.
因公共利益需要进行建设活动，对历史建筑无法实施原址保护、必须迁移异地保护或者拆除的，应当由城市、县人民政府城乡规划主管部门会同同级文物主管部门，报省、自治区、直辖市人民政府确定的保护主管部门会同同级文物主管部门批准。
If construction activities for public interest make on-site protection of a historic building impossible and relocation or demolition is necessary, the urban and rural planningcompetent authority of the city or county people's government, jointly with the competent cultural relics department at the same level, shall submit the matter to the protectioncompetent authority designated by the people's government of the province, autonomous region, or municipality directly under the Central Government for approval jointly with the competent cultural relics department at the same level.
本条规定的历史建筑原址保护、迁移、拆除所需费用，由建设单位列入建设工程预算。
The expenses required for on-site protection, relocation, or demolition of a historic building as stipulated in this article shall be included in the construction project budget by the construction unit.
对历史建筑进行外部修缮装饰、添加设施以及改变历史建筑的结构或者使用性质的，应当经城市、县人民政府城乡规划主管部门会同同级文物主管部门批准，并依照有关法律、法规的规定办理相关手续。
External renovation or decoration, addition of facilities, and changes to the structure or use of a historic building shall be approved by the urban and rural planningcompetent authority of the city or county people's government jointly with the competent cultural relics department at the same level, and relevant procedures shall be handled in accordance with laws and regulations.
在历史文化名城、名镇、名村保护范围内涉及文物保护的，应当执行文物保护法律、法规的规定。
Where cultural relics are involved within the protection scope of famous historical and cultural cities, towns, and villages, the provisions of laws and regulations on cultural relics protection shall be implemented.
法律责任
Legal Liability
违反本条例规定，国务院建设主管部门、国务院文物主管部门和县级以上地方人民政府及其有关主管部门的工作人员，不履行监督管理职责，发现违法行为不予查处或者有其他滥用职权、玩忽职守、徇私舞弊行为，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予处分。
Where, in violation of these Regulations, staff members of the competent department of construction under the State Council, the competent department of cultural relics under the State Council, and the local people's governments at or above the county level and their relevant competent departments fail to perform supervision and management duties, fail to investigate and deal with illegal acts found, or commit other acts of abuse of power, dereliction of duty, or engaging in malpractices for personal gain, which constitute a crime, criminal liability shall be pursued according to law; if the act does not constitute a crime, sanctions shall be imposed according to law.
违反本条例规定，地方人民政府有下列行为之一的，由上级人民政府责令改正，对直接负责的主管人员和其他直接责任人员，依法给予处分：
Where, in violation of these Regulations, a local people's government commits any of the following acts, the people's government at the next higher level shall order correction, and impose sanctions according to law on the directly responsible person in charge and other directly responsible persons:
(一)未组织编制保护规划的；
(1) Failing to organize the preparation of a protection plan;
(二)未按照法定程序组织编制保护规划的；
(2) Failing to organize the preparation of a protection plan in accordance with statutory procedures;
(三)擅自修改保护规划的；
(3) Unauthorized modification of a protection plan;
(四)未将批准的保护规划予以公布的。
(4) Failing to publish an approved protection plan.
违反本条例规定，省、自治区、直辖市人民政府确定的保护主管部门或者城市、县人民政府城乡规划主管部门，未按照保护规划的要求或者未按照法定程序履行本条例第二十八条、第三十四条、第三十五条规定的审批职责的，由本级人民政府或者上级人民政府有关部门责令改正，通报批评；对直接负责的主管人员和其他直接责任人员，依法给予处分。
Where, in violation of these Regulations, the competent protection department designated by the people's government of a province, autonomous region, or municipality directly under the Central Government, or the competent department of urban and rural planning of a city or county people's government, fails to perform the examination and approval duties specified in Articles 28, 34, and 35 of these Regulations in accordance with the requirements of the protection plan or statutory procedures, the people's government at the same level or the relevant department of the people's government at the next higher level shall order correction and circulate a notice of criticism; sanctions shall be imposed according to law on the directly responsible person in charge and other directly responsible persons.
违反本条例规定，城市、县人民政府因保护不力，导致已批准公布的历史文化名城、名镇、名村被列入濒危名单的，由上级人民政府通报批评；对直接负责的主管人员和其他直接责任人员，依法给予处分。
Where, in violation of these Regulations, a city or county people's government, due to inadequate protection, causes an approved and published famous historical and cultural city, town, or village to be included in the list of endangered sites, the people's government at the next higher level shall circulate a notice of criticism; sanctions shall be imposed according to law on the directly responsible person in charge and other directly responsible persons.
违反本条例规定，在历史文化名城、名镇、名村保护范围内有下列行为之一的，由城市、县人民政府城乡规划主管部门责令停止违法行为、限期恢复原状或者采取其他补救措施；有违法所得的，没收违法所得；逾期不恢复原状或者不采取其他补救措施的，城乡规划主管部门可以指定有能力的单位代为恢复原状或者采取其他补救措施，所需费用由违法者承担；造成严重后果的，对单位并处50万元以上100万元以下的罚款，对个人并处5万元以上10万元以下的罚款；造成损失的，依法承担赔偿责任：
Where, in violation of these Regulations, any of the following acts is committed within the protected area of a famous historical and cultural city, town, or village, the competent department of urban and rural planning of the city or county people's government shall order cessation of the illegal act, restoration to the original state within a time limit, or adoption of other remedial measures; if there is illegal income, the illegal income shall be confiscated; if restoration to the original state or adoption of other remedial measures is not completed within the time limit, the competent department of urban and rural planning may designate a capable unit to carry out restoration or other remedial measures on behalf of the violator, with the costs borne by the violator; if serious consequences are caused, a fine of not less than 500,000 yuan but not more than 1,000,000 yuan shall be imposed on the unit, and a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be imposed on the individual; if losses are caused, compensation liability shall be borne according to law.
(一)开山、采石、开矿等破坏传统格局和历史风貌的；
(1) Opening mountains, quarrying, mining, and other activities that destroy the traditional pattern and historical features;
(二)占用保护规划确定保留的园林绿地、河湖水系、道路等的；
(2) Occupying gardens, green spaces, river systems, roads, etc., that are reserved in the protection plan;
(三)修建生产、储存爆炸性、易燃性、放射性、毒害性、腐蚀性物品的工厂、仓库等的。
(3) Building factories, warehouses, etc., for producing or storing explosive, flammable, radioactive, toxic, or corrosive substances.
违反本条例规定，在历史建筑上刻划、涂污的，由城市、县人民政府城乡规划主管部门责令恢复原状或者采取其他补救措施，处50元的罚款。
In violation of these regulations, anyone who carves or defaces a historic building shall be ordered by the urban and county people's government's urban and rural planning department to restore it to its original state or take other remedial measures, and shall be fined 50 yuan.
违反本条例规定，未经城乡规划主管部门会同同级文物主管部门批准，有下列行为之一的，由城市、县人民政府城乡规划主管部门责令停止违法行为、限期恢复原状或者采取其他补救措施；有违法所得的，没收违法所得；逾期不恢复原状或者不采取其他补救措施的，城乡规划主管部门可以指定有能力的单位代为恢复原状或者采取其他补救措施，所需费用由违法者承担；造成严重后果的，对单位并处5万元以上10万元以下的罚款，对个人并处1万元以上5万元以下的罚款；造成损失的，依法承担赔偿责任：

(一)拆除历史建筑以外的建筑物、构筑物或者其他设施的；
(1) Demolishing buildings, structures, or other facilities other than historic buildings;
(二)对历史建筑进行外部修缮装饰、添加设施以及改变历史建筑的结构或者使用性质的。
(2) Carrying out external repairs, decorations, adding facilities, or changing the structure or use nature of a historic building.
有关单位或者个人进行本条例第二十五条规定的活动，或者经批准进行本条第一款规定的活动，但是在活动过程中对传统格局、历史风貌或者历史建筑构成破坏性影响的，依照本条第一款规定予以处罚。
If a relevant unit or individual carries out activities specified in Article 25 of these regulations, or carries out activities specified in the first paragraph of this article after approval, but causes destructive impact on the traditional pattern, historical features, or historic buildings during the activities, punishment shall be imposed in accordance with the first paragraph of this article.
违反本条例规定，损坏或者擅自迁移、拆除历史建筑的，由城市、县人民政府城乡规划主管部门责令停止违法行为、限期恢复原状或者采取其他补救措施；有违法所得的，没收违法所得；逾期不恢复原状或者不采取其他补救措施的，城乡规划主管部门可以指定有能力的单位代为恢复原状或者采取其他补救措施，所需费用由违法者承担；造成严重后果的，对单位并处20万元以上50万元以下的罚款，对个人并处10万元以上20万元以下的罚款；造成损失的，依法承担赔偿责任。
In violation of these regulations, anyone who damages or without authorization moves or demolishes a historic building shall be ordered by the urban and county people's government's urban and rural planning department to cease the illegal act, restore the original state within a time limit, or take other remedial measures; if there is illegal income, the illegal income shall be confiscated; if the original state is not restored or remedial measures are not taken within the time limit, the urban and rural planning department may designate a capable unit to restore the original state or take other remedial measures, and the costs shall be borne by the violator; if serious consequences are caused, a fine of not less than 200,000 yuan but not more than 500,000 yuan shall be imposed on the unit, and a fine of not less than 100,000 yuan but not more than 200,000 yuan shall be imposed on the individual; if losses are caused, compensation liability shall be borne according to law.
违反本条例规定，擅自设置、移动、涂改或者损毁历史文化街区、名镇、名村标志牌的，由城市、县人民政府城乡规划主管部门责令限期改正；逾期不改正的，对单位处1万元以上5万元以下的罚款，对个人处1000元以上1万元以下的罚款。
In violation of these regulations, anyone who without authorization sets up, moves, defaces, or damages the signage of a historical and cultural block, famous town, or famous village shall be ordered by the urban and county people's government's urban and rural planning department to make corrections within a time limit; if corrections are not made within the time limit, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed on the unit, and a fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed on the individual.
违反本条例规定，对历史文化名城、名镇、名村中的文物造成损毁的，依照文物保护法律、法规的规定给予处罚；构成犯罪的，依法追究刑事责任。
Anyone who, in violation of these regulations, causes damage to cultural relics in famous historical and cultural cities, towns, or villages shall be punished in accordance with laws and regulations on the protection of cultural relics; if a crime is constituted, criminal liability shall be pursued according to law.
附则
Supplementary Provisions
本条例下列用语的含义：
For the purposes of these regulations, the following terms have the meanings as defined below:
(一)历史建筑，是指经城市、县人民政府确定公布的具有一定保护价值，能够反映历史风貌和地方特色，未公布为文物保护单位，也未登记为不可移动文物的建筑物、构筑物。
(1) "Historical building" means a building or structure that has been determined and announced by the people's government of a city or county to have certain preservation value, can reflect historical features and local characteristics, has not been announced as a cultural relic protection unit, and has not been registered as an immovable cultural relic.
(二)历史文化街区，是指经省、自治区、直辖市人民政府核定公布的保存文物特别丰富、历史建筑集中成片、能够较完整和真实地体现传统格局和历史风貌，并具有一定规模的区域。
(2) "Historical and cultural district" means an area that has been verified and announced by the people's government of a province, autonomous region, or municipality directly under the Central Government to be particularly rich in preserved cultural relics, with a concentrated cluster of historical buildings, capable of relatively completely and authentically reflecting the traditional layout and historical features, and having a certain scale.
历史文化街区保护的具体实施办法，由国务院建设主管部门会同国务院文物主管部门制定。
Specific implementation measures for the protection of historical and cultural districts shall be formulated by the competent department of construction under the State Council jointly with the competent department of cultural relics under the State Council.
本条例自2008年7月1日起施行。
These regulations shall come into force as of July 1, 2008.
