为了加强对古树名木的保护，推进生态文明建设，传承中华优秀传统文化，制定本条例。
These Regulations are formulated to strengthen the protection of ancient and famous trees, promote ecological civilization, and inherit the excellent traditional Chinese culture.
本条例所称古树，是指树龄100年以上的树木，不包括人工培育、以生产木材为主要目的的商品林中的树木。
For the purposes of these Regulations, 'ancient trees' refer to trees with a tree age of 100 years or more, excluding trees in commercial forests that are artificially cultivated primarily for timber production.
本条例所称名木，是指具有重要历史、文化、科学、景观价值或者具有重要纪念意义的树木。
For the purposes of these Regulations, 'famous trees' refer to trees that have significant historical, cultural, scientific, or landscape value, or that have important commemorative significance.
国家保护古树名木，禁止损害古树名木及其生长环境。
The State protects ancient and famous trees and prohibits damage to ancient and famous trees and their growing environment.
古树名木保护管理工作坚持中国共产党的领导，坚持保护第一、合理利用、分级管理的原则，构建政府主导、属地负责、社会参与的工作机制。
The protection and management of ancient and famous trees shall adhere to the leadership of the Communist Party of China, adhere to the principles of protection first, rational utilization, and graded management, and establish a working mechanism featuring government leadership, territorial responsibility, and social participation.
全国绿化委员会负责组织领导全国古树名木保护管理工作。国务院林业主管部门、住房城乡建设主管部门(以下统称国务院古树名木主管部门)按照职责分工负责全国古树名木保护管理工作。国务院其他有关部门在各自职责范围内负责古树名木保护管理相关工作。
The National Greening Commission is responsible for organizing and leading the national protection and management of ancient and famous trees. The competent forestry department of the State Council and the competent housing and urban-rural construction department of the State Council (hereinafter collectively referred to as the competent departments for ancient and famous trees of the State Council) are responsible for the national protection and management of ancient and famous trees according to their respective functions and duties. Other relevant departments of the State Council are responsible for work related to the protection and management of ancient and famous trees within their respective functions and duties.
县级以上地方人民政府应当加强对古树名木保护管理工作的组织领导。县级以上地方人民政府林业主管部门、城市绿化主管部门(以下统称县级以上地方人民政府古树名木主管部门)按照职责分工负责本行政区域内古树名木保护管理工作。县级以上地方人民政府其他有关部门在各自职责范围内负责古树名木保护管理相关工作。
Local people's governments at or above the county level shall strengthen the organization and leadership of the protection and management of ancient and famous trees. The competent forestry departments and the competent urban greening departments of local people's governments at or above the county level (hereinafter collectively referred to as the competent departments for ancient and famous trees of local people's governments at or above the county level) are responsible for the protection and management of ancient and famous trees within their respective administrative regions according to their respective functions and duties. Other relevant departments of local people's governments at or above the county level are responsible for work related to the protection and management of ancient and famous trees within their respective functions and duties.
乡镇人民政府、街道办事处以及村民委员会、居民委员会应当协助做好古树名木保护管理相关工作。
Township people's governments, sub-district offices, villagers' committees, and residents' committees shall assist in the protection and management of ancient and famous trees.
县级以上人民政府开展古树名木保护管理工作所需经费，应当按照财政事权和支出责任划分原则列入本级预算。
The funds required by people's governments at or above the county level for the protection and management of ancient and famous trees shall be included in the budget at the corresponding level in accordance with the principle of division of financial powers and expenditure responsibilities.
国家鼓励通过认捐、认养等多种形式资助古树名木保护事业。
The State encourages the funding of the protection of ancient and famous trees through various forms such as donation and adoption.
国家鼓励、支持古树名木保护科学研究和先进技术推广应用，提高古树名木保护管理水平。
The State encourages and supports scientific research on the protection of ancient and famous trees and the promotion and application of advanced technologies to improve the level of protection and management of ancient and famous trees.
国务院有关部门、县级以上地方人民政府及其有关部门应当采取多种形式，组织开展古树名木保护宣传教育，传承古树名木文化，增强全社会的古树名木保护意识，营造保护古树名木的良好社会氛围。
Relevant departments of the State Council, local people's governments at or above the county level and their relevant departments shall adopt various forms to organize and carry out publicity and education on the protection of ancient and famous trees, inherit the culture of ancient and famous trees, enhance the awareness of the whole society on the protection of ancient and famous trees, and create a good social atmosphere for the protection of ancient and famous trees.
对古树按照下列标准实行分级保护：
Ancient trees shall be protected by grade according to the following standards:
(一)树龄500年以上的，实行一级保护；
(1) Those with a tree age of 500 years or more shall be subject to Grade I protection;
(二)树龄300年以上不满500年的，实行二级保护；
(2) Those with a tree age of 300 years or more but less than 500 years shall be subject to Grade II protection;
(三)树龄100年以上不满300年的，实行三级保护。
(3) Those with a tree age of 100 years or more but less than 300 years shall be subject to Grade III protection.
省、自治区、直辖市人民政府根据实际情况，可以决定对城市内树龄300年以上不满500年的古树实行一级保护、树龄100年以上不满300年的古树实行二级保护。
People's governments of provinces, autonomous regions, and municipalities directly under the Central Government may, based on actual conditions, decide to apply Grade I protection to ancient trees in urban areas with a tree age of 300 years or more but less than 500 years, and Grade II protection to ancient trees with a tree age of 100 years or more but less than 300 years.
对名木均实行一级保护，不受树龄限制。
All famous trees shall be subject to Grade I protection, regardless of tree age.
全国绿化委员会每10年组织开展一次全国古树名木资源普查。普查间隔期内，县级以上地方人民政府古树名木主管部门适时开展古树名木资源补充调查。在普查、补充调查以及古树名木认定等工作中，县级以上地方人民政府古树名木主管部门可以组织开展古树名木鉴定。
The National Greening Commission shall organize a national survey of ancient and famous tree resources every 10 years. During the interval between surveys, the competent departments for ancient and famous trees of local people's governments at or above the county level shall conduct supplementary surveys of ancient and famous tree resources as appropriate. In the course of surveys, supplementary surveys, and identification of ancient and famous trees, the competent departments for ancient and famous trees of local people's governments at or above the county level may organize the appraisal of ancient and famous trees.
国家鼓励单位、个人提供古树名木资源信息。
The State encourages units and individuals to provide information on ancient and famous tree resources.
县级以上地方人民政府古树名木主管部门根据古树名木资源普查、补充调查结果认定古树名木，报本级人民政府批准后依法公布。
The competent departments for ancient and famous trees of local people's governments at or above the county level shall identify ancient and famous trees based on the results of the national survey and supplementary surveys of ancient and famous tree resources, and shall report to the people's government at the same level for approval before announcing them in accordance with the law.
实行一级保护的古树和名木由省、自治区、直辖市人民政府古树名木主管部门认定，实行二级保护、三级保护的古树分别由设区的市级、县级人民政府古树名木主管部门认定。
Ancient trees subject to Grade I protection and famous trees shall be identified by the competent departments for ancient and famous trees of people's governments of provinces, autonomous regions, and municipalities directly under the Central Government; ancient trees subject to Grade II and Grade III protection shall be identified by the competent departments for ancient and famous trees of people's governments at the city with districts level and county level, respectively.
对在一定区域内集中生长形成的古树群体，可以实行整体保护，并按照涉及古树名木的最高保护等级，由相应的地方人民政府古树名木主管部门认定为古树群，报本级人民政府批准后依法公布。
For groups of ancient trees that grow together in a concentrated manner in a certain area, overall protection may be implemented, and according to the highest protection grade of the ancient and famous trees involved, the competent department for ancient and famous trees of the corresponding local people's government shall identify them as ancient tree groups, report to the people's government at the same level for approval, and announce them in accordance with the law.
古树名木的认定和公布实行动态管理。
The identification and announcement of ancient and famous trees shall be subject to dynamic management.
古树名木认定和分级保护管理的具体办法由国务院古树名木主管部门规定。
The specific measures for the identification and graded protection management of ancient and famous trees shall be prescribed by the competent department of ancient and famous trees under the State Council.
县级以上地方人民政府古树名木主管部门应当建立古树名木档案，并按照有关规范和要求，对古树名木设立保护标志，建设相应的保护设施，采取相应的保护措施。
The competent department of ancient and famous trees of the local people's government at or above the county level shall establish archives for ancient and famous trees, and in accordance with relevant specifications and requirements, set up protection signs, construct corresponding protection facilities, and take corresponding protection measures for ancient and famous trees.
县级人民政府应当按照国务院古树名木主管部门的规定，划定古树名木保护范围，并依法公布。
The county people's government shall, in accordance with the provisions of the competent department of ancient and famous trees under the State Council, delineate the protection scope of ancient and famous trees and make it public according to law.
古树名木保护范围划定后，应当及时纳入国土空间规划实施监督信息系统。
After the protection scope of ancient and famous trees is delineated, it shall be promptly incorporated into the territorial space planning implementation supervision information system.
因生态保护等公共利益需要，造成古树名木相关权利人合法权益受到损害的，县级以上地方人民政府应当依法给予补偿；涉及属于集体所有、私人所有的古树名木的，县级以上地方人民政府可以采取措施合理照顾有关单位、个人的利益。
If the legitimate rights and interests of relevant right holders of ancient and famous trees are damaged due to public interests such as ecological protection, the local people's government at or above the county level shall provide compensation according to law; if it involves ancient and famous trees owned by collectives or individuals, the local people's government at or above the county level may take measures to reasonably take care of the interests of relevant units and individuals.
县级人民政府古树名木主管部门应当按照有利于加强古树名木日常养护的原则，明确有关单位、个人作为古树名木的日常养护责任人，与日常养护责任人签订日常养护协议，根据古树名木权属情况、保护等级、养护状况、养护费用等，明确双方权利义务。
The competent department of ancient and famous trees of the county people's government shall, in accordance with the principle of facilitating the daily maintenance of ancient and famous trees, specify relevant units and individuals as the daily maintenance responsible persons for ancient and famous trees, sign daily maintenance agreements with the daily maintenance responsible persons, and clarify the rights and obligations of both parties based on the ownership, protection level, maintenance status, maintenance costs, etc., of the ancient and famous trees.
对在古树名木保护管理工作中作出突出贡献的单位、个人，按照国家有关规定给予表彰和奖励。
Units and individuals that have made outstanding contributions to the protection and management of ancient and famous trees shall be commended and rewarded in accordance with relevant state regulations.
县级人民政府古树名木主管部门应当加强对日常养护责任人的技术指导和培训，提高日常养护责任人的科学养护能力。日常养护责任人应当严格履行养护义务，对损害古树名木及其生长环境的行为应当予以制止。
The competent department of ancient and famous trees of the county people's government shall strengthen technical guidance and training for daily maintenance responsible persons to improve their scientific maintenance capabilities. Daily maintenance responsible persons shall strictly fulfill their maintenance obligations and shall stop acts that damage ancient and famous trees or their growing environment.
日常养护责任人发现古树名木遭受损害或者出现生长异常等情形的，应当及时报告县级人民政府古树名木主管部门，县级人民政府古树名木主管部门应当及时组织现场调查，并对所涉古树名木采取救治、复壮等措施。
If a daily maintenance responsible person discovers that an ancient or famous tree has been damaged or shows abnormal growth, he/she shall promptly report to the competent department of ancient and famous trees of the county people's government, which shall promptly organize an on-site investigation and take measures such as treatment and rejuvenation for the ancient or famous tree involved.
禁止采伐古树名木。
It is prohibited to fell ancient and famous trees.
因重大植物疫情防控、抢险救灾等特殊紧急情形，依法采取应急处置措施采伐古树名木的，县级人民政府有关部门应当及时通知县级人民政府古树名木主管部门。县级人民政府古树名木主管部门应当在应急处置工作结束后30日内将有关情况逐级报告至省、自治区、直辖市人民政府古树名木主管部门。涉及实行一级保护的古树和名木的，省、自治区、直辖市人民政府古树名木主管部门应当报告国务院古树名木主管部门。
If, due to special emergency situations such as major plant epidemic prevention and control, emergency rescue and disaster relief, emergency response measures are taken to fell ancient and famous trees according to law, the relevant department of the county people's government shall promptly notify the competent department of ancient and famous trees of the county people's government. The competent department of ancient and famous trees of the county people's government shall, within 30 days after the end of the emergency response, report the relevant situation level by level to the competent department of ancient and famous trees of the people's government of the province, autonomous region, or municipality directly under the Central Government. If it involves ancient trees under first-level protection or famous trees, the competent department of ancient and famous trees of the people's government of the province, autonomous region, or municipality directly under the Central Government shall report to the competent department of ancient and famous trees under the State Council.
古树名木原则上实行原地保护，不得移植。有下列情形之一，确需移植古树名木的，建设单位应当提出移植申请并提交相应的移植和养护方案，按照涉及古树名木的最高保护等级，经认定该古树名木的县级以上地方人民政府古树名木主管部门审核并报本级人民政府批准：
Ancient and famous trees shall in principle be protected in situ and shall not be transplanted. Under any of the following circumstances where transplantation is truly necessary, the construction unit shall submit a transplantation application along with a corresponding transplantation and maintenance plan, and subject to the highest protection level of the ancient or famous tree involved, after review by the competent department of ancient and famous trees of the local people's government at or above the county level that identified the ancient or famous tree, and approval by the people's government at the same level:
(一)国家能源、交通、水利、军事设施等重点建设项目选址确实无法避让古树名木；
(1) The site selection for key national construction projects such as energy, transportation, water conservancy, and military facilities truly cannot avoid ancient or famous trees;
(二)省、自治区、直辖市能源、交通、水利等重点建设项目选址确实无法避让实行二级保护、三级保护的古树；
(2) The site selection for key provincial, autonomous region, or municipal construction projects such as energy, transportation, and water conservancy truly cannot avoid ancient trees under second-level or third-level protection;
(三)其他基础设施建设项目选址确实无法避让实行三级保护的古树。
(3) The site selection for other infrastructure construction projects truly cannot avoid ancient trees under third-level protection.
古树名木的生长状况可能危害公众生命安全，采取修剪、支撑等防护措施仍无法消除安全隐患的，由县级人民政府古树名木主管部门提出相应的移植和养护方案，按照管理权限报有关人民政府批准。
If the growth condition of an ancient or famous tree may endanger public safety, and protective measures such as pruning and bracing cannot eliminate the safety hazard, the competent department of ancient and famous trees of the county people's government shall propose a corresponding transplantation and maintenance plan and submit it to the relevant people's government for approval in accordance with the management authority.
移植古树名木应当就近实施。
Transplantation of ancient and famous trees shall be carried out nearby.
古树名木移植，属于本条例第十五条第一款规定情形的，移植费用和移植后5年内的养护费用由建设单位承担；属于本条例第十五条第二款规定情形的，移植费用和移植后5年内的养护费用由有关县级人民政府承担。
For transplantation of ancient and famous trees under the circumstances specified in paragraph 1 of Article 15 of these Regulations, the transplantation costs and maintenance costs for five years after transplantation shall be borne by the construction unit; for transplantation under the circumstances specified in paragraph 2 of Article 15, the transplantation costs and maintenance costs for five years after transplantation shall be borne by the relevant county people's government.
任何单位、个人不得实施下列损害古树名木及其生长环境的行为：
No unit or individual shall engage in the following acts that damage ancient and famous trees or their growing environment:
(一)买卖、运输、加工非法采伐、移植的古树名木；
(1) Buying, selling, transporting, or processing illegally felled or transplanted ancient and famous trees;
(二)挖根、剥损树皮、过度修剪枝干；
(2) Digging roots, stripping bark, or excessively pruning branches;
(三)向古树名木灌注有毒有害物质；
(3) Injecting toxic or harmful substances into ancient and famous trees;
(四)在古树名木保护范围内铺设非通透性硬化地面、使用明火、堆放重物、倾倒易燃易爆物品或者有毒有害物质；
(4) Laying non-permeable hardened ground, using open flames, stacking heavy objects, or dumping flammable, explosive, or toxic or harmful substances within the protection scope of ancient and famous trees;
(五)在古树名木上刻划、架设线缆、缠绕或者悬挂物体等，攀爬古树名木；
(5) Carving, installing cables, winding or hanging objects on ancient and famous trees, or climbing them;
(六)破坏古树名木保护设施、保护标志；
(6) Damaging protection facilities or protection signs of ancient and famous trees.
(七)其他损害古树名木及其生长环境的行为。
(7) Other acts that damage ancient and famous trees or their growing environment.
建设项目选址、建设，应当避开古树名木保护范围；因特殊情况不能避开，确需在古树名木保护范围内新建、扩建建筑物、构筑物或者铺设管线的，应当在施工前报告县级以上地方人民政府古树名木主管部门，并按照要求采取必要的工程措施，尽可能减轻对古树名木及其生长环境的损害。
The site selection and construction of construction projects shall avoid the protection scope of ancient and famous trees; if it is impossible to avoid due to special circumstances and it is indeed necessary to construct new buildings, structures, or lay pipelines within the protection scope of ancient and famous trees, a report shall be made to the competent department of ancient and famous trees of the local people's government at or above the county level before construction, and necessary engineering measures shall be taken as required to minimize damage to ancient and famous trees and their growing environment.
古树名木保护范围内已有的建筑物、构筑物、管线等，不符合古树名木保护要求的，县级人民政府应当有计划地组织治理。
If existing buildings, structures, pipelines, etc. within the protection scope of ancient and famous trees do not meet the protection requirements, the county people's government shall organize governance in a planned manner.
古树名木保护与文物保护相关时，由县级以上地方人民政府古树名木主管部门和文物主管部门共同制定保护措施。
When the protection of ancient and famous trees overlaps with cultural relic protection, the competent department of ancient and famous trees and the competent department of cultural relics of the local people's government at or above the county level shall jointly formulate protection measures.
在不损害古树名木及其生长环境的前提下，可以开展下列活动：
Without damaging ancient and famous trees or their growing environment, the following activities may be carried out:
(一)合理利用古树名木资源开展保护技术、遗传育种、生物学等科学研究，推广应用科研成果；
(1) Reasonably utilizing ancient and famous tree resources to carry out scientific research on protection technology, genetic breeding, biology, etc., and promoting the application of research results;
(二)结合历史文化名镇名村、历史文化街区、传统村落以及传统节庆、民俗，挖掘古树名木的历史和文化价值；
(2) Combining historical and cultural towns and villages, historical and cultural blocks, traditional villages, and traditional festivals and folk customs to explore the historical and cultural value of ancient and famous trees;
(三)开展科普宣教，促进古树名木资源与生态旅游融合发展；
(3) Carrying out science popularization and education to promote the integrated development of ancient and famous tree resources and ecotourism;
(四)古树名木属于传统经济树种的，相关权利人依法开展必要的生产经营活动。
(4) If ancient and famous trees are traditional economic tree species, relevant right holders may carry out necessary production and operation activities in accordance with the law.
古树名木死亡的，由认定该古树名木的县级以上地方人民政府古树名木主管部门组织确认、查明原因并提出处置意见报本级人民政府；具有原地保留价值的，予以保留，并根据实际情况采取必要的保护措施。
If an ancient or famous tree dies, the competent department of ancient and famous trees of the local people's government at or above the county level that identified the tree shall organize confirmation, ascertain the cause, and propose handling opinions to the people's government at the same level; if it has value for in-situ preservation, it shall be preserved, and necessary protection measures shall be taken according to the actual situation.
县级以上地方人民政府古树名木主管部门应当建立古树名木分级保护巡查制度，根据古树名木的保护等级、分布地域、长势情况等确定巡查周期，定期开展巡查。
The competent department of ancient and famous trees of the local people's government at or above the county level shall establish a graded protection inspection system for ancient and famous trees, determine the inspection cycle based on the protection grade, distribution area, growth status, etc., and conduct regular inspections.
对位于偏远地区和交通不便地区的古树名木，县级以上人民政府古树名木主管部门可以利用大数据、卫星遥感、无人机等技术手段开展动态监控。
For ancient and famous trees located in remote areas and areas with inconvenient transportation, the competent department of ancient and famous trees of the people's government at or above the county level may use technologies such as big data, satellite remote sensing, and drones to carry out dynamic monitoring.
国家鼓励单位、个人举报、制止损害古树名木及其生长环境的行为。
The state encourages units and individuals to report and stop acts that damage ancient and famous trees or their growing environment.
国务院古树名木主管部门应当建立古树名木保护管理信息平台。
The competent department of ancient and famous trees of the State Council shall establish an information platform for the protection and management of ancient and famous trees.
县级以上地方人民政府古树名木主管部门应当及时将本行政区域内的古树名木数据信息归集至古树名木保护管理信息平台。
The competent department of ancient and famous trees of the local people's government at or above the county level shall promptly collect and submit the data information of ancient and famous trees within its administrative region to the information platform for the protection and management of ancient and famous trees.
县级以上人民政府古树名木主管部门依照本条例规定，按照职责分工对古树名木保护管理等活动进行监督检查，有权采取下列措施：
The competent department of ancient and famous trees of the people's government at or above the county level shall, in accordance with these regulations and their respective responsibilities, supervise and inspect the protection and management of ancient and famous trees, and have the right to take the following measures:
(一)询问被检查单位、个人，要求其对与监督检查事项有关的情况作出说明；
(1) Inquiring of the inspected units or individuals, and requiring them to explain matters related to the supervision and inspection;
(二)进行现场检查；
(2) Conducting on-site inspections;
(三)查阅、复制有关文件、资料，对可能被转移、销毁、隐匿或者篡改的文件、资料予以封存；
(3) Reviewing and copying relevant documents and materials, and sealing up documents and materials that may be transferred, destroyed, concealed, or tampered with;
(四)查封、扣押涉嫌违法活动的场所、设施或者财物。
(4) Seizing or impounding places, facilities, or property suspected of being involved in illegal activities.
县级以上人民政府古树名木主管部门依法进行监督检查，有关单位、个人应当予以配合，不得拒绝、阻碍。
When the competent department of ancient and famous trees of the people's government at or above the county level conducts supervision and inspection in accordance with the law, the relevant units and individuals shall cooperate and shall not refuse or obstruct.
对古树名木保护管理工作不力、问题突出的地区，国务院古树名木主管部门可以约谈有关地方人民政府及其有关部门主要负责人，要求其采取措施及时整改。
For regions with weak or problematic protection and management of ancient and famous trees, the competent department of ancient and famous trees of the State Council may interview the main responsible persons of the relevant local people's government and its relevant departments, requiring them to take measures to rectify in a timely manner.
古树名木保护管理情况，应当纳入领导干部自然资源资产离任审计。
The protection and management of ancient and famous trees shall be included in the audit of outgoing leading cadres' natural resource assets.
国务院古树名木主管部门、县级以上地方人民政府及其古树名木主管部门、其他有关部门的工作人员在古树名木保护管理工作中滥用职权、玩忽职守、徇私舞弊的，依法给予处分。
If staff members of the competent department of ancient and famous trees of the State Council, local people's governments at or above the county level and their competent departments of ancient and famous trees, or other relevant departments abuse their power, neglect their duties, or engage in malpractice for personal gain in the protection and management of ancient and famous trees, they shall be given sanctions in accordance with the law.
违反本条例规定，采伐、移植古树名木的，由县级以上地方人民政府古树名木主管部门责令停止违法行为、采取补救措施，没收违法所得，并依照下列规定处以罚款：
Whoever, in violation of these regulations, fells or transplants ancient or famous trees shall be ordered by the competent department of ancient and famous trees of the local people's government at or above the county level to stop the illegal act, take remedial measures, confiscate the illegal gains, and be fined in accordance with the following provisions:
(一)涉及实行一级保护的古树和名木的，处每株50万元以上100万元以下的罚款；
(1) For ancient trees and famous trees under first-level protection, a fine of not less than 500,000 RMB and not more than 1,000,000 RMB per tree shall be imposed;
(二)涉及实行二级保护的古树的，处每株20万元以上50万元以下的罚款；
(2) For ancient trees under second-level protection, a fine of not less than 200,000 RMB and not more than 500,000 RMB per tree shall be imposed;
(三)涉及实行三级保护的古树的，处每株10万元以上20万元以下的罚款。
(3) For ancient trees under third-level protection, a fine of not less than 100,000 RMB and not more than 200,000 RMB per tree shall be imposed.
违反本条例规定，损害古树名木及其生长环境，造成古树名木死亡的，依照前款规定处罚。
Where a violation of these Regulations damages ancient or famous trees or their growing environment, causing the death of such trees, the penalty shall be imposed in accordance with the preceding paragraph.
有本条例第十七条第一项、第二项、第三项、第四项规定行为之一的，由县级以上地方人民政府古树名木主管部门责令停止违法行为、采取补救措施，没收违法所得，并处1万元以上10万元以下的罚款；拒不停止违法行为、不采取补救措施或者造成严重后果的，并处5万元以上20万元以下的罚款。
Whoever commits any of the acts specified in items 1, 2, 3, or 4 of Article 17 of these Regulations shall be ordered by the competent department of ancient and famous trees of the local people's government at or above the county level to cease the illegal act, take remedial measures, and confiscate the illegal gains, and shall be fined not less than 10,000 RMB and not more than 100,000 RMB; if the illegal act is not ceased, remedial measures are not taken, or serious consequences are caused, a fine of not less than 50,000 RMB and not more than 200,000 RMB shall be imposed.
有本条例第十七条第五项、第六项、第七项规定行为之一的，由县级以上地方人民政府古树名木主管部门责令停止违法行为、采取补救措施，没收违法所得，可以并处1万元以下的罚款；拒不停止违法行为、不采取补救措施或者造成严重后果的，并处1万元以上10万元以下的罚款。
Whoever commits any of the acts specified in items 5, 6, or 7 of Article 17 of these Regulations shall be ordered by the competent department of ancient and famous trees of the local people's government at or above the county level to cease the illegal act, take remedial measures, and confiscate the illegal gains, and may be fined not more than 10,000 RMB; if the illegal act is not ceased, remedial measures are not taken, or serious consequences are caused, a fine of not less than 10,000 RMB and not more than 100,000 RMB shall be imposed.
违反本条例第十八条第一款规定的，由县级以上地方人民政府古树名木主管部门责令停止违法行为、限期恢复原状或者采取其他补救措施，没收违法所得；拒不停止违法行为、逾期不恢复原状、不采取其他补救措施或者造成严重后果的，依照下列规定处以罚款：
Whoever violates the provisions of paragraph 1 of Article 18 of these Regulations shall be ordered by the competent department of ancient and famous trees of the local people's government at or above the county level to cease the illegal act, restore the original state within a time limit, or take other remedial measures, and confiscate the illegal gains; if the illegal act is not ceased, the original state is not restored within the time limit, other remedial measures are not taken, or serious consequences are caused, a fine shall be imposed in accordance with the following provisions:
(一)涉及实行一级保护的古树和名木的，处每株20万元以上50万元以下的罚款；
(1) For ancient trees and famous trees under first-level protection, a fine of not less than 200,000 RMB and not more than 500,000 RMB per tree shall be imposed;
(二)涉及实行二级保护的古树的，处每株10万元以上20万元以下的罚款；
(2) For ancient trees under second-level protection, a fine of not less than 100,000 RMB and not more than 200,000 RMB per tree shall be imposed;
(三)涉及实行三级保护的古树的，处每株5万元以上10万元以下的罚款。
(3) For ancient trees under third-level protection, a fine of not less than 50,000 RMB and not more than 100,000 RMB per tree shall be imposed.
违反本条例规定，给他人造成损失的，依法承担赔偿责任；构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
Whoever violates these Regulations and causes losses to others shall bear compensation liability in accordance with the law; if the act constitutes a violation of public security administration, public security administration penalties shall be imposed in accordance with the law; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law.
本条例自2025年3月15日起施行。
These Regulations shall come into force on March 15, 2025.
